October 12, 1970
Mayor 4ost called the meeting to order at the hour of 7:30 P. M. Reverend
Donald McCann delivered the invocation.
Members present were Mayor Kost, Aldermen Peterson, Linder, Black and
Alrick. Also present were Attorney Schantzen, Engineer Priebe and Adminis-
trative Assistant Mealey. Members absent: None.
Mayor Kost indicated that the minutes of September 28 should be amended to
state that Mayor Kost explained to the Civic Committee of the Hutchinson
Women's Club that the old hospital building would be demolished in the
event of purchase by the HRA.
Alderman Black pointed out that the following statement from the September
28 minutes is inaccurate and should be stricken: "It was determined

that in the instance of a three sided lot, the longest side only would
be assessed for street improvements or two thirds of the total, which-
ever is greater."
Alderman Black then moved that the minutes of September 28 be approved
as amended and the minutes of October 6 Special meeting be approved as
submitted. Alderman Alrick seconded the motion and it was carried.
Alderman Black questioned the payment of overtime for police patrolmen.
It was decided, upon discussion, to withhold approval of the four
verified accounts submitted until a clarification of policy has been
established with the Police Commission for payment of overtime at time
and a half as well as the regulations concerning legal holidays, a
mandatory retirement age and the number of hours composing a regular
work week; and vacation policy. Administrative Assistant Mealey was
directed to meet with Chief Broderius and request these clarifications
of regulation from the Police Civil Service Board.
Alderman Black moved that the bills be approved, Alderman Alrick
seconded the motion and it was carried.
Mr. Kenneth Born, Midwest Modules, Inc. was present at the meeting to
request approval of a special use permit to set up a model mobile home
on the property in the South section of the City along Highway 15, to
be used as a temporary sales office. Some discussion was held, after
which Alderman Linder moved and Alderman Black seconded the motion, that
the request be granted in accordance with conditions as outlined and
attached to the permit. Upon vote being taken all members voted "aye"
and the motion was declared carried. The permit was thereupon signed
by the Mayor and presented to Mr. Born.
Park Department Superintendent Roberts appeared before the Council to
report on vandalism in the parks. 27 trees in Northeast Park were
apparently run down by an automobile; tombstones in the cemetery have
been tipped over and partitions torn out of the comfort station in South
Park. Considerable discussion was held on methods of preventing this
kind of activity, presumably by juveni-les. Superintendent Roberts suggested
a cyclone fence around the comfort station with only one exit to make it
easier to apprehend vandals. Additional lighting was recommended by
Council. It was also de-cided to rent the house in West Park at a minimum
rate in exchange for maintenance on the building which would also provide
additional supervision of that area. It was suggested to Superintendent
Roberts that when the trees are replaced in Northeast Park, and at any
time new young trees are planted, that a pipe or posts be driven into the
ground so that a car couldn't drive over without being impaled. The
news media representatives present were asked to give maximum publicity
to the damage done and to emphasize the fact that the money spent on
repairing vandalism damage is money allocated to expansion and upgrading
of the park system in the City as well as pointing out that the police
cannot adequately patrol all of the parks all of the time.

Administrative Assistant Mealey was directed to contact the junior and
senior high school principals for their suggestions on communication
with the students so that they understand that money spent on repairing
vandalism prevents City support of recreational facilities they could
all enjoy. Attorney Schantzen was directed to review the legal aspects
of destruction of public property.
Administrative Assistant Mealey presented the 1971 budget for final
review. Alderman Black introduced Resolution No. 3089, Resolution
Adopting Budget For 1971-1972 and roved its adoption. Alderman Linder
seconded the motion and upon vote being taken, all members voted "aye"
and Resolution N . 3089 was thereupon declared adopted unanimously.

BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA, COUNTY OF

Alderman Black introduced Resolution No. 3091 approving appropriation
of debt retirement funds and moved its adoption. Alderman Alrick
seconded the motion and it was put to vote. All members of the Council
voted "aye" whereupon said resolution was declared passed unanimously.

RESOLUTION APPROVING APPROPRIATION OF DEBT RETIREMENT FUNDS
BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:
THAT the City Council notwithstanding any previous resolutions to
any other effect, does appropriate money from current accounts to
satisfy principal and interest payments in these following debt

Administrative Assistant Mealey reviewed the application for funding

RESOLUTION TO APPLY FOR GRANT ASSISTANCE - ACQUISITION OF
PARKLAND
WHEREAS, the Land and Water Conservation Fund Act and the State
Natural Resource Fund provides for the making of grants to assist
local public bodies in the acquisition and development of outdoor
recreation projects, and

WHEREAS, the City of Hutchinson desires to acquire and develop
certain land bordering onto Otter Lake reservoir of the Crow River,
which land is to be held and used for permanent open space, and
WHEREAS, Title VI of the Civil Rights Actof 1964 (P.L. 88-354)
and of the regulations promulgated pursuant to such Act by the Secretary
of the Interior and contained in 43 CFR 17, effectuating that title,
provides that no person shall be discriminated against because of
race, color or national origin in the use of the land acquired and
developed, and
WHEREAS, it is estimated that the cost of acquiring and developing
said interest shall be $113,600
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HUTCHINSON, MINNESOTA:
1. That an application be made to the Office of Local and Urban
Affairs of the Slate Planning Agency for a grant from the Land and
Water Conservation fund as amended in 1965for an amount presently
estimated to be $56,800 and the applicant will pay the balance of
the cost from other funds -available to it.
2. That an application be made to the Office of Local and Urban
Affairs of the State Planning Agency for a grant from the Natural
Resource Fund (Chap. 879 and 1139 Minn. Laws 1969) for an amount
presently estimated to be $28,400 and the applicant will pay the
balance of the cost from other funds available to it.
3. That the Mayor is hereby authorized and directed to execute and
to file such application with the State of Minnesota Office of Local
and Urban Affairs of the State Planning Agency and to provide such
additional information and to furnish such documents as may be
required by said Agency, to execute such contracts as are required by
said Agency and to act as the authorized correspondent of the Applicant.
4. That the proposed acquisition and development is in accordance
with the plans for the allocation of land for open space uses,and
that should said grant be made, the applicant will acquire, develop
and retain said land for uses designated in said application and
approved by the Office of Local and Urban affairs and the Bureau of
Outdoor Recreation.
5. That the United States of America and the State of Minnesota be,
and they hereby are, assured of full compliance by the applicant with
regulations of the Department of the Interior, effectuating Title VI
of the Civil Rights Act of 1964.

Alderman Black then introduced Resolution No. 3093, a resolution
regarding Policy Statement regarding Power and Utility Construction
for application of financial assistance under the Land and Water
Conservation Fund Act of 1965. Alderman Linder seconded the motion
and upon being put to vote, all members of the Council voted "aye"
and the resolution was adopted unanimously.
RESOLUTION NO. 3093
POLICY STATES?ENT REGARDING POWER AND UTILITY CONSTRUCTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON,
MINNESOTA:
THAT it is recognized that electrical power and communication
services are an essential requirement for the economical and efficient
operation and maintenance of public service facilities in state,
county, and municipal Outdoor Recreation Areas. Communication lines
are necessary in the interest of public safety. It is our policy
in planning for these services to arrange and provide them with a
minimum of intrusion on the natural features of the area. In order
to accomplish this, the followingfactors must be given every considera-
tion:
1. Only those utilities necessary for the public accomodations,
maintenance and operation of an Outdoor Recreation Area shall be
permitted within the Area's limits. litility lines extending through
area properties to private properties beyond shall be avoided and
eliminated wherever possible.
2. Every effort shall be made to provide underground -type
services for all utilities where practical.
3. Where underground construction of electric power lines is
impossible and pole structures are necessary, they shall be located
so as to be tha#roughly screened from Recreation Area roads and/or
foot trails.
Wherever possible, overhead communication lines shall be combined
with overhead structures to minimize the amount of clearing necessary
to provide these overhead utilities. In thos instances where such
overhead lines cannot be screened from the roadway right of way, they
shall be so placed that they will blend with the background --that is,
they will run along the thre-line where their intrusion would not be
readily observable. In open prairie areas where overhead construc-
tion cannot be a oided, there will be every attempt made to utilize
topographical features to mimimize the intrusion of transmission
line and pole structures.

In all concentrated use areas, that is, picnic grounds, campgrounds,
children's camps, beach and boating areas, all electric power service
under 2,300 volts and all communication cables shall be underground
between points of service and no overhead lines will be constructed.

ASSURANCE OF COMPLIANCE UNDER TITLE VI, CIVIL RIGHTS
ACT OF 1964
BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF HUTCHINSON,
MINNESOTA:
THAT the City of Hutchinson, Minnesota (hereinafter called
"Applicant -Recipient" hereby agrees that it will comply with Title VI
of the Civil Rights Act of 1964 (P.L. 88-352) and all requirements
imposed by or pursuant to the Department of the Interior Regulation
(43 CFR 17) isued pursuant to that title, to the end that, in accordance
with Title VI of that Act and the Regulation, no person in the United
States shall, on the ground of race, color, or national origin be
excluded from participation in, be denied the benefits of, or be
otherwise subjected to discrimination under any program or activity for
which the Applicant -Recipient receives financial assistance from
Office of Local and Urban Affairs and hereby gives assurance that it
will immediately take any measures to effectuate this agreement.
If any real property or structure thereon is provided or improved
with the aid of Federal financUl assistance extended to the Applicant -
Recipient, or in the case of any transfer of such property, any
transferee for the period during which the real property or structure
is used for a purpose involving the provision of similar services
or benefits. If any personal property is so provided, this assurance
obligates the Applicant -Recipient for the period during which it
retains ownership or possession of the property. In all other cases,
this assurance obligates the Applicant -Recipient for the petiod
during which the Federal financial assistance is extended to it by
Office of Local and Urban Affairs.
THIS ASSURANCE is given in consideration of and for the prupose of
obtaining any and all Federal grants, loans, contracts, property
discounts or other Federal financial assistance extended after the
date hereof to the Applicant -Recipient by the bureau or office,
including installment payments after such date on account of
arrangements for Federal financial assistance which were approved
before such date. The Applicant -Recipient recognizes and agrees
that such Federal financial assistance will be extended in reliance
on the representations and agreeements made in this assurance, and

Administrative Assistant Mealey presented an application for snow
removal permit from John H. Reynolds and Leslie R. Johnson. Alderman
linder moved approval, Alderman Black seconded the motion and it was
carried unanimously.
An application for a third taxi permit for a 1965 Chevrolet Station
Wagon from Gene Decker was considered. Upon motion by Alderman Blacks
seconded by Alderman Linder and unanimously approved, the application
was granted.
Engineer Priebe presented a preliminary plat for Rolling Oaks Second
Addition, After due consideration, Alderman Black moved public hearing
be set for 7:45 P.M. at the next regular'Planning Commission meeting
October 19, 1970. Alderman Peterson seconded the motion and it was
carried.
Administrative Assistant Mealey presented a request from Chief Broderius
for a new ordinance restricting parking on Second Avenue from Franklin
to Dale and on Dale Street to City Limits between the hours of 2:00 A.M.
and 6:00 A.M. Considerable discussion was held after which Alderman
Black moved the subject be tabled. Alderman Peterson seconded the
motion and it was carried.
REGULAR COUNCIL MEETING - 18 - OCTOBER 12, 1970
Alderman Black reminded the Council that it had been decided that
Mr. Jim Junkers, dba Junkers Sanitation Service, would meet with the
Council to establish determination of a number of unresolved problems.
Administrative Assistant Mealey was directed to invite Mr. Junkers to
the next Council Meeting.
Administrative Assistant Mealey requested authority to transfer
$5,000 received from the Liquor Store to General Fund. Alderman Black
moved the transfer be approved, Alderman Linder seconded the motion
and it was carried.
Administrative Assistant Mealey presented a draft of a resolution
designating polling places and appointing Election Judges for the
General Election in November. Alderman Black, after due deliberation,
introduced Resolution No. 3088 and moved its adoption. Alderman
Linder seconded the motion and it was carried.
