A Regular Council meeting was called to order by Mayor Don 0. Kost in the Council
Chambers at! -the hour of 7:30 P.M. Invocation by Rev. James Slack.

Alderman Rapp made a motion that the following delinquent assessments as of
October 24, 1966, be certified to the County Auditor for spreading on the
tax,rolls, together with such interest and penalties as required under
Minnesota Statutes, Section 429.061, for the improvement of:

Alderman Hanson made a motion that the deferred assessments against the follow-

Alderman Linder made a motion that Edwin "Bud" Maynard be appointed to a five-
year term .on the Airport Commission, to replace James Hanson.
Alderman Popp seconded the motion of Alderman Linder, and upon vote being
taken, carried.
The City Clerk was instructed to notify the following property owners that
their sidewalks should be repaired as quickly as possible, as they constitute
a hazard to pedestrians:

Alderman Hanson introduced the following resolution and moved its adoption:

RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND
ORDERING ADVERTISEMENT FOR BIDS
WHEREAS, pursuant to a resolution passed by the Council on September
26, 1966, the city engineer has prepared plans and specifications for the im-
provement of
Lot 10, Block 29, S 1/2 City (Second Avenue SW - south side from
Olen Street to alley between Glen &
Franklin)
Lot 14, Block 53, S 1/2 City (Glen St. - west side north of Fifth Ave.)
by the installation of sidewalk, and has presented such plans and specifications
to the City Council for approval:
NOW THEREFORE, be it resolved by the City Council of Hutchinson,
Minnesota:
1. Such plans and specifications, a copy of which are attached hereto
and made a part hereof, are hereby approved.

2. The City Clerk shall prepare and cause to be inserted in the
official paper, an advertisement for bids upon the making of such improvement
under such approved plans and specifications. The advertisement shall be
published twice, shall specify the work to be done, shall state that bids will
be opened and considered by the council at 8:15 P.M. November 14, 1966, in
the council chambers of the city hall, and that no bids will be considered
unless sealed and filed with the clerk and accompanied by a cash deposit,
certified check or bid bond payable to the City of Hutchinson for 10% of the
amount bid.

Charles Duenow was present and stated that he is interested in buying the busi-
ness formerly known as Riley's Bar, and asked the qualifications necessary to
receive the required licenses for the sale of beer.
Mr. Duenow was advised that he should file an application for license with the
City Clerk, and submit a statement of his qualifications to the Police Department.
Mayor Kost announced that the Hospital Board had passed a resolution instructing
thei��k-ptbrney to start dissolution proceedings in the District Court.
Mayor Kost stated that Fred Sorensen had contacted him about selling his property
on Franklin Street to the city before January 1, 1967. Mr. Sorensen would sell
on a five-year contract basis at 6% interest, total price $7500.00. No action
taken.
Discussion on water and sewer project for Third Avenue NW.
The Council stated their desire for a bid opening at the second meeting in
November, including services for the Park Board.
Dr. Curt Schafer, Chairman of the Planning Commission, submitted the commission's
recommendation for aerial survey work to be done the fall of 1966.
Bob Carroll from Rieke -Carroll -Muller Associates, Inc., presented a proposal
from Chicago Aerial Survey, together with cost (figures. (Proposal on file in
City Clerk's office) .
Alderman Linder introduced the following Resolution and moved its adoption:

Mayor Kost read a letter received from Water Pollution Control Commission, in
which they inquired as to the progress being made on the Sewage Treatment Plant
per the agreement made by the Council in Resolution #2270 dated January 13,
1964.

WHEREAS, the City Council of the City of Hutchinson has determined that
certain aerial mapping .is nc-c( -ary for the future planning and develop-
ment of the City of Hutchins, )i: , and
WHEREAS, the City Council ha; decided to engage the professional services
of Chicago Aerial Survey for �ciid aerial mapping in accordance with its
written proposal to the City of Hutchinson dated October 6, 1966, a copy
of which is on file in the City (:l(,rk's office,
NOW THEREFORE, it is hereby re-iolved by the City Council of the City of
Hutchinson that the professional services of Chicago Aerial Survey be
retained in accordance with their written proposal dated October 6, 1966,
as follows:
1. Photograph 15 square miles in accordance with Item A of
"Costs" at a price of $850.00.
2. Three square miles of ground control at $1.87 per acre
3. Three square miles of mapping at $2.81 per acre
and the Mayor of the City of Hutchinson is hereby authorized to accept
the above proposal on behalf of the City of Hutchinson.
Alderman Johnson seconded the motion to adopt said Resolution.

Plant as soon as the required information is available from Chicago Aerial
Surveys.
Alderman Hanson seconded the motion of Alderman Popp, and upon vote being
taken, carried.
Alderman Linder made a motion that Mayor Kost be authorized to sign an Escrow
Agreement with Hutchinson Activities, Inc., accepting the sum of$2,O0O.0O
to be held in escrow for the construction of a municipal wading pool on or
before January 1, 1973.
Alderman Popp seconded the motion of Alderman Linder, and upon vote being
taken, carried.
RATHBUN PROPERTY. The Council ordered the Clerk to publish a Notice of Intention
to Purchase Real Estate, with the Viewing Committee's report to be considered
at 7:45 P.M. November 14, 1966.
METHODIST CHURCH PROPERTY. The Council ordered the Clerk to publish a Notice
of Intention to Purchase Real7Estate, with the Viewing Committee's report to
be considered at 8:00 P.M. November 14, 1966.
Mayor Kost reported that the School District is considering several sites for
their Vocational School and has not stated a definite interest in ranting the
St. Anastasia school property.
No action taken on the City's purchase of this property.
Alderman Hanson introduced Ordinance No. 286 for its third and final reading:
ORDINANCE NO. 286
AN ORDINANCE REGULATING GARBAGE AND REFUSE COLLECTION WITHIN
THE CORPXORATE LIMITS OF THE CITY OF HUTCHINSON

Alderman Johnson seconded the motion of Alderman Hanson to introduce Ordinance
No. 286 for its third and final reading. Upon roll call, all members present
voted in favor of Ordinance No. 286 and it was declared passed on its third
and final reading.
Discussion of retirement policy for city employees, No action taken.
Mayor Kost read a report from Engineer Wilson on uncompleted work in the
Engineering Department which would require engineering services after his
resignation becomes effective.
Aldermen Linder and Johnson were requested to meet with Engineer Wilson to
discuss the unfinished work in their departments.
Motion was made, seconded and carried that the Mayor and City Clerk be authorized
to sign the Agreement for BRarbage and Refuse Collection with Leonard Miller,
d/b/a Hutchinson Refuse Service.
Discussion of land dedication for extension of Maple Street from 11th Avenue
NE to North High Drive. No action taken.
Discussion of deferred watermain assessment against Nellie Rice property for
watermain on Roberts Road.
Alderman kinder introduced the following resolution and moved its adoption:

WHEREAS, dAseasment roll No. 13, adopted December 27, 1960, included
a deferred assessment as follows:

ORDINANCE NO. 286
AN ORDINANCE REGULATING GARBAGE AND REFUSE COLLECTION
WITHIN THE CORPORATE LIMITS OF THE CITY OF
1I11TCHINSON
SECTION I. All garbage accuiiiul;it Lon in the City of Hutchinson shall be
accumulated, conveyed and dispo,ed of by the City of Hutchinson through its
legally authorized agent, the City Collection Contractor. No person shall
collect or convey over any „f Die streets or alleys of the City, or dispose of
any garbage accumulated in the City, except the City's duly authorized agent.
SECTION II. For the purpose of this Ordinance the following terms, phrases,
words, and their derivations shall have the meaning given herein. When not
inconsistent with the context, words used in the present tense include the
future, words in the plural number include the singular number,the words in
the singular number include the plural number. The word "shall" is always
mandatory and not merely directory.
(1) "Garbage" is animal and vegetable wastes resulting from the
handling, preparation, cooking and consumption of food.
(2) ''Garbage Collection Contractor" is the person with whom the City
shall contract for collection of garbage in the City.
(3) "Refuse" is all wastes (except body wastes), including rubbish,
tin cans, paper, cardboard, yard clippings, glass jars and
bottles, and wood normally resulting from the operation of a
household or business establishment, but not including garbage.
(4) "Commercial Establishment" is any premises where a commercial
or industrial enterprise of any kind is carried on, and shall
include clubs, churches and establishments of non-profit
organizations where food is prepared or served or goods are
sold.
(5) "Single Family Residential Unit" is any household with a single
family residing therein.
(6) "Multiple Family Residential Unit" is any household wherein
more than one family resides.
SECTION III. All garbage accumulated in the City shall be collected, conveyed,
and disposed of by the City of Hutchinson through its legally authorized agent,
the City Collection Contractor. No person shall collect, convey over any,of.
the streets or alleys of the City, or dispose of any garbage accumulated in
the City, except the duly authorized City Garbage Collector, provided that
this Ordinance shall not prohibit the disposal of garbage in dwellings by
any device which grinds and deposits the garbage in a sewer. The Garbage
Collection Contractor and his employees shall have the right to enter upon
private property at all reasonable hours of the day for the purpose of
collecting garbage.
SECTION IV. All garbage and refuse accumulated on any premises shall be
placed and maintained in containers. Garbage and refuse containers shall
be provided by the owner, tenant,, lessee or occupant of the premises. Such
container shall be maintained in a good, clean, neat and sanitary condition
at all times. The garbage containers shall be equipped with -handles, tight
fitting covers and shall be water tight. The garbage containers shall have
a capacity of not more than thirty (30) gallons.
SECTION V. Garbage and refuse containers shall be placed for collection
at one place at ground level on the property and accessible to the street or
alley from which collection is made.

SECTION VI. Garbage and refuse accumulated at residential properties shall
be collected at least once each week. The owners of premises upon which
garbage or refuse is accumulated who desire personally to collect and dispose
of their own garbage and refuse shall use a container provided with a tight
cover so operated and maintained as to prevent offensive odors escaping
therefrom, and refuse from being blown, dropped or spilled from the container.
The ownership of garbage and refuse material set out for collection and
collected by the City Garbage Collection Contractor shall be vested in the
City.

SECTION VII. The City shall charge each single family residential unit
the sum of $1.50 per month for the collection of garbage and refuse. The
charges for garbage and refuse collection shall be made on the following
three-month billing periods:
October, November ind December
January, February and March
April, May and June
July, August and tieptember
All accounts shall be consid(-red delinquent if not paid by 20 days after
the due date. All delinquent accounts shall be certified by the City
Clerk of the City of Hutchinson, who shall prepare an assessment roll each
year on or before October 1, providing for assessment (:f the delinquent
amounts against -the respective properties served.
SECTION VIII. The City Garbage Collection Contractor shall and is hereby
authorized to negotiate for the collection of garbage and refuse with the
owners or occupants of multiple family residential units, commercial
establishments and industrial establishments located within the City of
Hutchinson. Any dispute for charges, by said customers and the Contractor,
or Contractor aid said customers, shall be allowed to be appealed by either
party to the City Council of the City of Hutchinson, who shall then set and
establish the collection fee.
SECTION IX. No commercial collection and refuse hauler shall operate on
the streets, alleys and right-of-ways of the City of Hutchinson without a
permit by the City Council, and in no instance shall collection of garbage
and refuse be made within the City by a commercial hauler with vehicles
other than those equipped with regulation garbage'f)ackers.,r
SECTION X. Should any section, sub -section, sentence, clause or phrase of
this Ordinance, for any reason, be held invalid, such decision shall not
off -set the validity of the remaining portions of this Ordinance. The
City of Hutchinson hereby declares that it would have passed this Ordinance
and each section, sub -section, clause, sentence and phrase hereof, irrespec-
tive of the possibility that any one or more sections, sub -sections, clauses,
sentences or phrases be declared unconstitutional or invalid.
SECTION XI. Ordinances Nos. 146 and 215, together with the provisions of
any ordinances or parts of ordinances heretofore enacted which are in
conflict herewith, are hereby repealed.
SECTION XII. Any person, firm or corporation violating any provisions of
this Ordinance, upon conviction thereof, shall be fined not to exceed $100.00
or by imprisonment in the county jail for not more than ninety (90) days.
SECTION XIII. This Ordinance shall be in full force and effect from and
after its passage and publication in the official city newspaper.

Mayor Kost read a letter of notice of hearing on petition and preliminary
survey on County Ditch 18 repair, with hearing to be held at 10:00 A.M.,
October 25, 19661 in the Courthouse at Glencoe.
The Council noted copy of a petition from property owners involved, petition-
ing that their lands and properties be set out of the drainage system known
as County Ditch No. 18, and be free from further assessments for repairs,
which/will be submitted at the County hearing.

RESOLUTION CALLING HEARING ON PROPOSED ASSESSMENT
WHEREAS, by a resolution passed by the council on August 8, 1966, the
city clerk was directed to prepare a proposed assessment of the cost of
improving the following streets by grading, base construction, curb and
gutter, bituminous surfacing, and sidewalk:

1. A hearing shall be held on the 28th day of November, 1966, in the
city hall at 8:00 P.M. to pass upon such proposed assessment and at such
time and place all persons owning property affected by such improvement
will be given an opportunity to be heard with reference to such assessment.
2. The city clerk is hereby directed to cp�.,se a notice of the hearing
on the proposed assessment to be published once in the official newspaper at
least two weeks prior to the hearing, and she shall state in the notice the
total cost of the improvement. She shall also cause mailed notice to be
given to the owner of each parcel by certified mail, requesting a return receipt,
as required under Minn. Statutes.

an Airport Commission resolution relative to construction of hangars at the
Airport, subject to approval by the City Attorney.
Engineer Wilson recommended installation of a street light on Sherwood Street
as per petition presented October 10, 1966.
Motion was made, seconded and carried that the street light on Sherwood Street
be installed as recommended by the Engineer.
A request for storm sewer tap at Lot 14, Oak Park 2nd Addition, was noted
from James Reid for the purpose of garage slab and yard drainage.

Engineer Wilson reported that a manhole should be installed on Franklin Street
and lst Avenue NW in order to clean acid televise the sanitary sewer line as
ordered by the City Council. The cost would be approximately $300.00.
Alderman Hanson made a motion that a manhole be installed on Franklin Avenue
and lst Averitie NW.
Alderman Johnson seconded the motion of Alderman Hanson, and upon vote being
taken, carried.
Alderman Linder made a motion that Mayor Kost be authorized to sign an agree-
ment with Harold Molls whereby the City will rent the following described
property:
SE 1/4 of NE 1/4 Section 17-116-29
for a term of one year, for a fee of $50.00, for use as a dump for burning.
Alderman Popp seconded the motion of Alderman Linder, and upon vote being taken,
carried.
Motion was made, seconded and carried that Fred Roberts be instructed to place
proper signs at the site of the burning dump, and that users of the dump be
required to receive a daily permit from the City Clerk for use of the dump.
Attorney Schantzen was requested to draw up a "No Burning Ordinance" for sub-
mission at the City Council meeting of November 14, 1966.

granted as recommdnded by the Planning Commission:

Motion was made, seconded and carried that a variance be granted on Application
No. 613 for front -yard set back for a storage building at 3rd Avenue NW & Water
Street by the Farmer's Union Coop. Oil Assn.

Alderman Popp reported that the Park Board expects to install playground
equipment at the NE Park in late 1968 when the sod has matured.
Alderman Linder reported that the DC -6 now used at the dump is need of repairs,
Haxim3diRata]dxax4xRxtlmmxwhatak questioning whether its condition warrants
repair.
Alderman Linder was instructed to contact Civil Defense Director Eric Smith
concerning the DC -6 and also to ;inquire whether other equipment may be avail-
able from the Civil Defense Department.
Alderman Linder reported that the Highway Department has requested use of the
city dump without charge. Engineer Wilson was instructed to obtain more in-
formation from the Highway Department.
Motion was made, seconded and carried that the City Attorney write William
Janousek, instructing Mr. Janousek to fill in the hole in his lot on North
Main Street.
Alderman Linder reported that the extension of Milwaukee Avenue in Merickel
Addition should be leveled. The Council questioned whether building permits
should be issued for lots in Merickel Addition when the street is not usable.
Motion was made, seconded and carried that the Mayor and City Clerk be author-
ized to sign a Quit Claim Deed for abandonment of the storm sewer easement
across Lot Nine (9), Block 28, S 1/2.
Treasurer Smith questioned whether he should re -invest any of the $55,000.00
U. S. Treasury Bills which will soon be due the City. Treasurer Smith was
instructed to check the financial status of the City to determine the ad-
visability of re -investing these funds.

The City Clerk was requested to start a list of those persons who object to
the present garbage setup and those who have little garbage.

A Special Council meeting was called to order by Mayor Don 0. Kost in the
Council Chambers at the hour of 10:30 A.M.
Members present: Aldermen, Linder, Popp, Hanson, Johnson; Engineer Smith,

Alderman Johnson stated that production is dropping at the north well, and that
a new well will be neede&n the near future.

of Health to proceed with a test well.

Alderman Linder introduced the following Resolution and moved its adoption:
RESOLUTION NO. 2493
WHEREAS, after investigation and discussion the City Council of the City
of Hutchinson has decided in its judgment that because of the low water output
of the city well it must be immediately replaced with a new well,
AND WHEREAS, tMt the present condition of said city well, because of
its low water output, has created a fire hazard as well as a knicU a hazard to
to the health and welfare of the City of Hutchinson,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON,
MINN: that the City shall immediately and does hereby engage the Frederickson
Well Company of Hutchinson, Minnesota, to immediately commence work on the
drilling of a test well and thereafter a permanent well, and in connection
therewith to purchase any equipment for the operation of said well, said work
to be completed at the earliest possible date; and it is further resolved that
the Engineering firm of Rieke, Carroll & Muller Associat&s, Inc. shall be
engaged as the engineering firm to supervise this project on behalf of the
City of Hutchinson.
Alderman Johnson seconded the motion to adopt said Resolution, and upon vote
being taken, the following voted in favor of Resolution No. 2493:

Alderman Hanson made a motion that the engineering firm of Rieke -Carroll -Muller
Associates Inc. be employed by the City of Hutchinson as consulting engineers,
until a full-time City Engineer is employed
Alderman Johnson seconded the motion of Alderman Hanson, and upon vote being

The City Clerk was instructed to place advertisements for a full-time city
engineer in the appropriate trade magazines.
Alderman Popp requested that city equipment and labor be used to sweep the
E.U.B..Church parking lot.
Alderman Linder was requested to ask the city street department to do this work.
The City Clerk reported that permit applications are on file in her office for
persons who wish to use the Molls dump for burning.
Alderman Hanson reported that the hole at the Janousek Barber Shop property has
been filled.

Meeting was opened by President Teskey anA with silent table prayer.

On mot -ion of Les Linler, seconjed by L. Ladd, the minutes and treasruer's report
were accepted as presented.

to the Minr. S`t-te 'r:ighway rept. that cloverleaf and diamond exits off highways be
so designated. Motion approved.
A letter on a meeting on two wheeled motor vehicles was read by L•ir. Teskey. It
was moved by Les Linder, seconded by Bill urodd that President Teskey, Frank
Broderius and 2 students from the High ^chool attend this meeting. Reservations
for meal to be paid by the Safety Council.
