A Regular Council meeting was called to order by Mayor Kost in the Council
Chambers at the hour of 7:30 P.M. Invocation by Rev. Shdffield.

Alderman Linder introduced Ordinance No. 283 and moved its first reading:
ORDINANCE NO. 28�
AN ORDINANCE FOR THE PURPOSE OF PROVIDING HEALTH, SAFETY,
ORDER, CONVENIENCE AND GENERAL WELFARE, BY REGULATING
THE USE OF THE MUNICIPAL DUMP
The City Council of the City of Hutchinson ordains:
SECTION I. The starting or spreading, either directly or indirectly, of any
fire within or upon the confines of the City Dump is prohibited by anyone
other than a duly authorized agent or employee of the City of Hutchinson.
SECTION II. The dumping or depositing of any material, of any kind or nature,
which contains or may contain any fire is prohibited within the confines of
the City Dump.
SECTION III. No one shall dump, place or otherwise deposit any materials within
the confines of the City Dumps except in those areas so distinguished by duly
authorized employees or agents of the City of Hutchinson.
SECTION IV. Any person violating any provision of this ordinance shall be
guilty of a misdemeanor and upon conviction shall be punished by a fine of not
more than one hundred dollars ($100.00) or by imprisonment for not more than
ninety (90) days.
SECTION V. This ordinance shall take effect from and after its final passage
and publication.
Alderman Manson seconded the motion of Alderman Linder to introduce Ordinance
No. 283 for its first reading. Upon roll call, all members present voted in favor
of Ordinance No. 283 and it was declared passed on its first reading.

Alderman Hanson seconded the motion of Alderman Popp to introduce Ordinance
No. 283 for its second reading. Upon roll call all members present voted in
favor of Ordinance No. 283 and it was declared passed on its second reading.
Wally Seegert of Waconia, Minnesota, was present to discuss franchise operation
of the City Dump. He expressed an interest -in bidding on a franchise for the
Hutchinson dump.
Richard J. Peterson, real estate agent, was present oxi behalf of Earl Muelling
to request abandonment of Glen Street north of Fifth Avenue NW, which street
is not now being used. Attorney Schantzen stated that if the street were
abandoned it would revert to the adjoining property owners.
Motion was made, seconded and carried to table until August 22, 1966, meeting.
Mayor Kost opened the hearing on Publication No. 991 for improvement of Third
Avenue NW from Main Street to the West city limits by sanitary sewer and water -
main at 8:30 P.M.
Six property owners were present to ask questions about the proposed improvement.
Hearing closed at 8:45 P.M. No action taken.
Aldermen Hanson, Linder and Popp reported they had examined the Methodist
Church property at Glen Street and Second Avenue SW and asked that the Council
recess so they could offer a recommendation.

Alderman Linder made a motion that the council be authorized to offer the
Methodist Church $3000.00 in cash, with a suitable marker, approved by the
City Council, to be erected at the property marking it as the site of the
first community church in Hutchinson.
Alderman Hanson seconded the motion of Alderman Linder, and upon vote being
taken, carried, with Alderman Hanson abstaining from the vote.
Mayor Kost was requested to contact the Board of the Methodist Church.
Discussion of 16-1 Street Improvement Project. Engineer Wilson reported
that the Second Avenue Bridge would be built whether or not Second Avenue
is improved as proposed. No action taken.
Discussion of city dump with Howard Rackliffe of Delano, who expressed an
interest in bidding for franchise operation of the municipal dump.
Don Peterson and Iry Burich of Hutchinson Associates requested clarification
of water and sewer assessments due on Peterson's School Addition, per Engineer
Wilson's letter of August 1, 1966.
Motion was made, seconded and carried that water and sewer assessments for
benefitted properties west of Alan Street and north of Lea Avenue be deferred
until such property is annexed to the city.
Motion was made, seconded and carried that Mayor Kost send a letter to
organizations and neighboring township boards asking for their support of
the proposed hospital and for names of persons to be members of a Hospital
Citizens Committee.
Alderman,Johnson introduced the following resolution and moved its adoption:

RESOLUTION ORDERING PREPARATION OF REPORT ON IMPROVEMENT
WHEREAS, it is *posed to improve the following:
That area west of Main Street bounded on the north by First Avenue
NW, on the west by Lynn Road, and on the south by Linden Avenue, and
That area east of Main Street bounded on the north by Second Avenue
NE, on the east by Jefferson St., and on the south by Fifth Avenue SE
by sidewalk construction, and to assess the benefited property for all or a-,
portion of the cost of the improvement, pursuant to Minn. Stats., Sec.
429.011 to 429.111 (Laws 1953, Ch. 398, as amended.)
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:
That the proposed improvement be referred to Charles Wilson for study
and that he is instructed to report to the Councilwith all convenient speed
advising the Council in a preliminary way as to whether the proposed improve-
ment is feasible and as to whether it should best be made as proposed or in
connection with some other improvement, and the estimated cost of the
improvement as recommended.
Alderman Hanson seconded the motion to adopt such resolution, and upon vote
being taken, the following voted in favor of Resolution No. 2469:

Dear Irv:
Enclosed is a report written for the City Council in 1964. A copy
of this report was given to you at that time.
You recently requested that the City participate in the cost of
utilities installed in 1966, because they were so placed as to give
service to property outside of the city limits on both the north and west
sides of the plat. As pointed out in the above mentioned report, this
was one factor considered in the agreement previously reached.
At the time that the report was written, you were interested in
fully servicing the Peterson's School Addition. On this basis, no water
tie was anticipated between Larson and Kay Streets on Lea Avenue. In
1965 you requested service on Larson and Kay Streets only. Accordingly,
because no time table was available, it was deemed necessary to make this
water tie to avoid a dead-end main.
With the improvement of Alan Street in 1966, the water tie proposed
in 1964 was still necessary, and was constructed.
Based on the 1964 report, the council agreed with you on an escrow
deposit as recommended for Roberts Road, Larson Street, Kay Street, and Lea
Avenue, for the 1965 improvement.
If the full subdivision had been served in 1965, as assumed in the
report, less watermain would have been installed, realizing an overall
savings of about $1091. This is probably the only area which the City
Council would give consideration to cost sharing.
Based on the 1964 report of participation, I still recommend that the
deferred assessments on Roberts Road be waived, and that the connection
charges at the Alan Street - Roberts Road intersection be collected, as
required by Ordinance No. 234.

struction on Larson Street, abutting this addition. The Engineer's
Report, received on October 12, 1964, noted that there presently are
deferred assessments on this property. The Engineer was directed to
report on these assessments and to request that Mr. Burich attend the
Council meeting on October 26, 1964, to discuss these and also the
proceedure for installing the watermain.

A petition was received by the City Council, for watermain construction
on Larson Street, abutting this addition. The Engineer's Report, received
on October 12, 1964, noted tti<t there presently are deferred assessments on

At the time that sanitary sewer was installed to the high school site,
the subject property was assessed for frontage on Larson Street and on Roberts
Road. Intersections were not deducted, as the property was not subdivided at
that time. At the same time, a watermain was installed on Roberts Road and
this property was assessed for that cost.
In 1962, prior to paving Roberts Road, sewer and watermains were stubbed
out of the intersections of Larson, Kay and Alan Streets. This cost was also
assessed back to the affected properties.
These assessments were all deferred until such time as the property would
be developed.
Ordinance Number 234 relating to deferred assessments, calls for payment
of the assessment, plus collection of interest from the date of assessment,
not to exceed the cost on construction at the time of connection.
The attached map indicates the affected parcel and the assessed frontages.
The deferred assessments are:
Sanitary Sewer (Frontages A & B) $2,925.42
Watermain (Frontage B)
1,152.76
Stubs at Larson, Kay, and Alan Streets 1,589.90
These amounts do not include interest.
It is in the best interests of the City of Hutchinson that the surface on
Roberts Road not be disturbed. Therefore, an agreeable solution should be
arrived at with the subdivider at this time.
Considerations for this should cover some or all of the following matters:
Cost of the watermain on Larson Street
Cost of the watermain and sanitary sewer on Alan Street
Cost of the watermain on Lea Avenue
Deferred assessments on Roberts Road and on Larson Street '
It is recommended that ti,e deferred assessment for 425.35 ft. on Larson
Street be paid by the subdivider, that assessments be waived on Roberts Road,
that the full cost of the watermaiii on Larson Street be paid by the subdivider,
that the full cost of the watermain and sanitary sewer on Alan Street and the
watermain on Lea Avenue between Alan and Kay Streets be paid by the subdivider,
and that the assessments for the stubs be paid by the subdivider.
The amount of the assessments waived on Roberts Road would be $2,822.12
and interest of about $608.00 (depending upon date of payment). In return
the city would be avoiding damage to the pavement on Roberts Road, and gaining
the opportunity to charge connection charges to the properties on the East
side of Larson Street (frontage C) and on the West side of Alan Street (frontage
D) at a future time. Based on present assessments this would be about $3,900.
On the basis of these recommendations the approximate amount to be collected
on the remaining assessments (based on interest rounded to full years) is:
Sanitary Sewer $1,526.75
Water and Sewer Stubs 1,786.41
Total $3,313.15
If the sanitary sewer were to be constructed at this time, the assessable
amount would be $1,625, and the stubs at the intersections would cost $2,189.

ENGINEER'S PRELIMINARY REPORT
16-6 SIDEWALK PROJECT
JULY 25, 1966
I. INTRODUCTION
An inspection of existing sidewalks in the central area of Hutchin-
son has been made. This report shows the area inspected , the amount
of sidewalk to be replaced, and estimated costs. In addition, recom-
mendations regarding new sidewalks are included together with costs.
This report does not include a list of individual properties affected
by this improvement.
II. REPLACEMENT SIDEWALK
The area inspected is shown on the attached map. West of Main
Street, this area is bounded on the south by Linden Avenue, on the
north by First Avenue N.W., and on the west by Lynn Road. East of
Main Street, the boundaries are Fifth Avenue S.E., Second Avenue N.E.,
and Jefferson Street. Because of the pending improvement of Main
Street in 1967, no inspection of the sidewalk there was made. Instead,
replacement due to widening, grade change, or deterioration should be
made in conjunction with the street improvement.
The criteria used for replacement were:
1. Vertical displacement as to cause pedestrians to trip.
2. Depressions which cause water to pond and freeze.
3. Deterioration of the surface.
4. Structural failure as evidenced by severe cracking.
III. NEW SIDEWALK
Thetarea considered for construction of new sidewalk is the same
are as that inspected for replacement sidewalks. The attached map
shows the recommended locations. These locations are recommended for
the following reasons:
1. Obvious blank spots with sidewalks adjoining.
2. Necessity for pedestrian traffic to the central business
district.
3. Necessity for pedestrian traffic to school bus stops or
to the elementary school.
IV. CONSTRUCTION REQUIREMENTS
General practice in recent years has been to omit the use of sand
base under replacement sidewalk. This is not recommended practice

where a non -granular soil exists. As a cost cutting feature, this
is not recommended. Ratifier a well compacted pit run sand should be
used.
V. METHODS OF ACCOMPLISHING PROJECT
The City Charter provides for calling a hearing on sidewalk
repair and construction, and levying the cost to abutting properties.
The proceedure is similar to that used by the City for other
improvements (MSA 429). Past practice has been to allow property
owners to repair their own sidewalks and if they don't, the City then
makes the repairs. Another method would be to follow the same
proceedure as that used for other improvements, namely that outlined
in M.S.A. 429.
VI. COST
When only a small piece of sidewalk is replaced, a contractor's
costs due to moving are higher per square foot than on a larger
length of sidewalk. For this reason, bids would be taken using
100 square feet as the dividing point. It is estimated that unit
prices bid for sidewalk would be:

These costs include $0.20 for placing a granular sub -surface. These
prices do not include engineering and administrative costs. The
total cost of the project and apportionment of this cost would be:

VII. RECOMMENDATIONS
It is recommended that the proceedure for local improvements
outlined in M.S.A. 429 be used to carry out this improvement. Past
experience has shown that fewer problems are encountered if this
proceedure is used.
It is recommended that granular backfill be used where necessary.

WHEREAS, pursuant to Resolution No. 2469 of the City Council adopted
August 8, 1966, a +report has been prepared by the City Engineer with

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:
1. The City Council will consider the improvement of such street in
accordance with the report and the assessment of abutting property for all
or a portion of the cost of the improvement pursuant to Minnesota Statutes,
Sec. 429.011 to 429.111 (Laws 1953, Ch. 398, as amended) at an estimated
total cost of the improvement of $15,345.50.
2. A public.hearing shall be held on such proposed improvement on the
12th day, of September, 1966, in the council chambers of the city hall at
8:00 P.M. and the city clerk shall give published notice of such hearing and
improvement as required by law.

Discussion of Small Claims Court. Attorney Schantzen was instructed to con-
tact Muni6ipal Judge Hassenstab to draw up the mechanics for establishing
such a court.
Discussion of liquor ordinance violations by Wm. F. Rylel, holder of on -sale
and off -sale liquor licenses at Riley's Bar, 134 Main Street South, who was
convicted of selling beer to minors.
Alderman Johnson made a motion that the on -sale and off -sale liquor licenses
for Riley's Bar at 134 Main Street South, Hutchinson, be suspended for a
period of thirty (30) days, effective immediately, and that such licenses be
permanently revoked if there are any further violations of the liquor ordi-
nances.
A1dXe rman Hanson seconded the motion of Alderman Johnson, and upon vote being
taken, carried.
Discussion of application for federal grant on construction of a sewage
treatment plant. Alderman Johnson reported no complaints of contamination
or water pollution below the sewage treatment plant.
The suggestion was made that Harold Popp and the Public Health Service be
contacted for help in securing additional points on the federal aid grant
application.
The City Clerk was instructed to write to the Water Pollution Control Commission,
to make an appointment for a hearing at their next meeting on August 25th.
Action on the water main extension on Lynn Road'South was tabled.

RECOMMENDATIONS AND SUGGESTIONS BY THE HUTCHINSON CHAMBER OF COMMERCE, PARKING COMMITTEE
TO THE CITY COUNCIL, HUTCHINSON, MINNESOTA FOR DEVELOPEMENT OF OFF-STREET PARKING
It is the unanimous view of the above named committee that parking in the business
district is now totally inadequate and rapidly becoming so; it further is their opinion
that it is in the best interest of the City of Hutchinson to maintain a strong central
business district. Further, it ig the recommendation of this committee that, in con-
junction with the proposed and recommended development of on -street parking, that
immediate steps be taken to inaugerate a program of property acquisition for off -•street pa7kIn€
and that the City Council seriously consider the following recommendations and suggestions
to implement such a program:
(1) Commence immediately to initiate the necessary procedures, legal and ancillary,
allocating all parking meter receipts to a separate account established for
the express purpose of acquiring property to be utilized for off-street parking
and the purchase of additional necessary meters.
(2) Obtain options to purchase property in locations of determined highest parking
density. It is quite possible that it may be necessary to resort to condemnation
in order to obtain suitable and desirable sites.
(3) Issue revenue bonds secured by an assignment of parking meter revenues to
site
provide immediate funds for immediate acquisition and to also provide initial
equitable distribution of parking areas.
We trust that the suggestions will merit your serious and immediate consideration.

Mayor Kost reported on a request from the Seventh Day Adventist Church to hold
a North Central Conference camp meeting in June or July of 1967 with approxi-
mately 1500-1800 people attending.
The Council voiced no objections to this request, provided the church meets
the requirements of the State Department of Health on sanitary facilities.
Mayor Kost called the Council's attention to the fact that Ordinance No. 63,
adopted 1932, governing distribution of handbills, circulars, etc., should be
revoked, enforced or amended. No action taken.
Engineer Wilson reported limited success in tile inspections to date, and
presented anproposed inspection form governing all inspections to be made on
construction in the City of Hutchinson.
Discussion.
Motion was made, seconded and carried that the engineer be authorized to
proceed with the use of the proposed building inspection forms, with the
stipulation that the card must be posted before construction is started.

August 15, 1966
The regular meeting of the Hutchinson Planning Commission was called to order
by Chairman Curt Schafer at 7:30 P.M., August 15, 1966, in the Council Chambers
of City Hall. Members present were Gordon Bublitz, Lloyd Torgrimson, Cal
Bonniwell, Clainton Tracy, Floyd Hoel, and Engineer Wilson. Members absent
were Dr. A. J. Thompson and Harry Hanson.
Minutes of the regular meeting of July 18, 1966, were approved upon motion.
VARIANCE NO. 582 - Request for variance in floor -area ratio and rear yard set
back for garage addition at 94 -5th Avenue NW. Motion was made by Gordon Butlitz,
seconded by Lloyd Torgrimson, that the Planning Commission recommends that this
application be denied, with the suggestion that Mr. Lueck submit another plan
for adding on to his present garage. Carried.

Lloyd Torgrimson, seconded by Clinton Tracy, that the Planning Commission recommer,
to the City Council that this request for variance be granted on the basis that
it conforms to the neighborhood. Carried.
SPECIAL PERMIT NO. 584. Sign for Citizens Bank at 102 Main South. Motion was
made by Gordon Bublitz, seconded by Floyd Hoel, that the Planning Commission
recommends to the City Council that this permit.be granted. Carried.
FINAL PLAT RICE ADDITION. Motion was made by Lloyd Torgrimson, seconded by Clinto
Tracy, that the Planning Commission recommends to the City Council that this final
plat be approved, with specific attention drawn to drainage and the need for a
storm sewer in the near future; upon payment of donation of $910.00 for parks
and playgrounds; and with the recommendation that the street be named "Goebel
Street," or that the entire street be renamed, including that portion north of
Roberts Road and in Merickel's Addition. Carried.
The Lynn Township Board requested an opinion from the Planning Commission concern-
ing a construction firm built without a building permit, and a trailer court
existing on the McDonald farm in Lynn Township. The Planning Commission will
obtain copy of the Lynn Township zoning ordinance and examine it for possible
action.
Discussion of Engineer's report of May Loth on Subdivision Ordinance No. 235 -
Payments for Improvements in New Subdivisions.
Discussion of parking area requirements for the front portion of Wally Crandall's
garage which has been sold and is to be used for auction sales.
