Invocation by Rev Travaille Members present: Aldermen Gruett, Fitzloff, Johnson, Stearns, Atty Schantzen, Engineer Wilson, Treas Smith Members absent: None Motion was made, seconded and carried to approve the minutes of the Regular Meeting of April 27, 1964 and Special Meetings of April 29 and May 2, 1964. He also recommended moving the semaphores on 4th Ave NW & Main St. back from the intersection and having larger color signals. Motion was made, seconded ano carried to accept the resignation of Clinton Gruett and ask the Police Commission to recommend hiring another patrolman and call for applications and a�f-: C 1 V I `' v Fx.A `' t Alderman Fitzloff introduced the following resolution and moved its adoption: RESOLUTION NO. 2291 WHEREAS, Leonard Gruett, Alderman for the City of Hutchinson, is retiring from his job as a public servant for our city, and WHEREAS, this individual has devoted time and talent to the service to the City of Hutchinson at little personal reward to himself. NOW THEREFORE, BE IT RESOLVED: That the City of Hutchinson does hereby commend and thank Leonard Gruett for his service and help on the City Council and appreciates the work done on behalf of the City. Municipal Judge Brick, a qualified and acting notary public swore in the newly elected officials: Alderman - Earl Fitzloff - 2 years Alderman - Harry R. Hanson - 2 years City Clerk - Lida E. Rolander - 1 year Treasurer - Leslie 0. Smith - 1 year Motion was made, seconded and carried that Leonard Johnson be nominated to the Office of Vice President of the council, to be known as "Acting Mayor" for the ensuing year, during the absence of the Mayor. Upon the count of the ballots, Mayor Rolfe declared Leonard Johnson "Acting Mayor" for the ensuing year. Motion was made, seconded and carried that the duties of the several departments of the council be assigned as follows: Supt. of Public Bldgs & Fire Protection - Harry R. Hanson Supt. of Streets & Alleys - Earl Fitzloff Supt of Water Works & Sanitary Sewer - Leonard Johnson Supt. of Acct, Finances, Health & Sanitation - Ned Stearns Mayor Rolfe called for bids - Publication No. 870 at 8:00 P.M. for Hydrant painting. There were four bids: Mayor Rolfe voted nay - not carried. Alderman Stearns made a motion to accept the bid of Bob Plowman because of convenience of service in Hutchinson. Attorney Schantzen advised the Council they had no alternative but to take the low bid. Motion was made, seconded and carried that the time and place respectively of the regular bi-monthly Council meetings be at 7:30 P.M. on the second and fourth Mondays of each month in the Council Chambers. Motion was made, seconded and carried that the Hutchinson Leader be designated as the Official newspaper for the ensuing year. Motion was made, seconded and carried that the Ministerial Association be asked to furnish one of their memobers or a representcAttfve to open the Regular Council meetings with scripture and prayer. Alderman Johnson introduced the following resolution and moved its adoption: RESOLUTION NO. 2292 APPOINTMENT OF CHIEF OF POLICE BE IT RESOLVED: That Frank Broderius be re -appointed as Chief of Police of the City of Hutchinson for a period of .f one year. Alderman Stearns introduced the following resolution and ,moved its adoption: RESOLUTION NO. 2296 RESOLUTION DESIGNATING DEPOSITORIES BE IT RESOLVED: That the following named banks which are authorized to do a banking business in Minnesota, be and they hereby are designated depositories of the Public Funds of the City of Hutchinson in the County of McLEod, State of Minnesota, by the City Council of said City, for the term commencing the 11th day of May, 1964 for 1 year (June 25, 1964) to replace present depository expiring June 25, 1964. Citizens Bahk, Hutchinson, Minnesota and the First National Bank of Hutchinson, Minnesota, upon the terms and conditions following to -wit: That this designation is subject to the right of said City of Hutchinson, Minnesota to modify, vacate, or revoke the same accordingly to law and also subject to any depository agreement executed or to be executed pursuant to Sec. 118.01 Minnesota Statutes fe 1945, and that said depositories shall pay on demand all deposits there in subject to payment on demand, and BE IT RESOLVED: That the Treasurer of the City of Hutchinson is hereby authorized and directed to deposit in each of said banks in a special fund known as "City of Hutchinson" all monies that may come into this hands, and the City Treasurer shall maintain an equal amount of monies in deposit at each of said banks at all times. BE IT FURTHER RESOLVED: That a copy of this resolution shall be delivered to the City Treasurer and each of the banks so designated. Motion was made, seconded and carried that this appointment be and is hereby ratified and confirmed. Mayor Rolfe re -appointed Ned Stearns as ex -off icid representative of the City Council to the Nursing Home Board for a period of one _year. Mayor Rolfe re -appointed the following: Building Inspector - Sidney Carlson Electrical Inspector-- Ralph Young Plumbing Inspector - Walter Rippe Motion was made, seconded and carried that these appointments be and hereby are ratified and confirmed. Mayor Rolfe re -appointed Walter Dorniebel as'Fire Marshall for the ensuing year with fees not to exceed 40.00 a month. Motion was made seconded and carried that this appointment be and is hereby ratified and confirmed. M Mayor Rolfe re -appointed Harold Popp to the Park Board for a period of six years. Motion was made, seconded and carried that this appointment be and is hereby ratified and confirmed. Mayor Rolfe re -appointed Walter Rippe t o the Police Commission for a period of three years. Motion was made, seconded and carried that this appointment be and is hereby ratified and confirmed. Mayor Rolfe re -appointed Eric Smith as Uivil Defense Director for a period of one year allowing $300.00 for postage and supplies. Motion was made, seconded and carried that this appointment be and is hereby ratified and confirmed. Mayor Rolfe re -appointed Grace Sanstead as Secretary of the Park Board for a period of one year. Motinn was made, seconded and carried that this appointment be and is hereby ratified and confirmed. Hutchinson Planning Commission s MINUTES May 18, 1964 The regular monthly meeting of the Hutchinson Planning Commission was held on Monday May le, 1964 at 7:30 P.M. in the City Hall. All members were present. President Carlson introduced the two new members,iiarry Hanson of the City Council,and Clinton Tracy, the representative of the Utilities Commission. The minutes of t:.e April 20th meeting were read and approved. Discussion of the Acoma Twp.Board request that the small parcel of land west of Peterson's garage be annexed to the City resulted in no action being taken. It was agreed that a letter of thanks be sent to Eloi Hamre for his action in bringing Mr. Franz 'Mogen, the President of The Montevideo Chamber of Commerce, and Mr.James Russell, the Executive Secretary of that body to the April 20th meeting of the Hutchinson Planning Commission so that they might present their views,and experiences with Federal Renewal Programs in their City. President Carlson appointed a committee consisting of Torgrimson, chairman, and Hanson and Thompson to study the Capitol Improvement Program. Discussion relative to rezoning Blocks -'?-25, north half of the City resulted in no action being taken. LynnTwp.hoar, members were present and mutual problems were dis- cussed. The scheduled public hearing relative to annexation of Blocks 3 and 4, Larson's Subdivision was held at 8 P.M. After a discussion and study of the Preliminary Plat Hoel sugggested that Larson's surveyor meet with City Engineer Wilson and Mr. Larson in an attempt tp iron out difficulties posed by said Plat. At 9:00 P.M. the scheduled hearing on rezoning property owned by Joe Satterlee,adjacent to the Texaco station wa-, held. Mr. and Mrs. Otto Zeleny and Miss Rose Jenecky appeared in opposition, and Cliff Moldestad, Mr. Wiley4c Luverne Wiley spoke for the rezoning . Geo. Schlueter was also present. After a lengthy discussion, and due consideration, Dr. Schafer made a motion that The Commission recommend to the City Council that approv- al be given to the request of Mr. Satterlee to have his property rezoned from R-1 to R-3. Torgrimson seconded, and the motion was unanimously approved. Discussion relative to securing clerical assistance for the Planning Commission resulted in ftreement that President Carlson and Hoel make the proper contacts with the City Clerks Office in an effort to hire a clerk from that office. There being no further business the meete' as adjourned at 10:10 P.M. ,A Thompson, cretary Y ENGINEERIS REPORT PETITIONS FOR CURB AND GUTTER BY DIRECT CONTRACTOR AGREEMENT MAY 19, 1961 Petitions have been received for the private installation of curb and gutter as follows: PARCEL NO. PETITIONER LOCATION 1. Marvin Burghart Lot 1 Block 11, Nj City 2. H. Theo Hanson Lot 7 & Part of Lot 6, Block 2, Hansen's Nofth High Addition 3. Dean Hansen Lot 8, Block 2, Hansen's North High Addition Parcel one is located on Fifth Avenue Northwest. This is a McLeod County Highway. There is.eurb and gutter across the street from this location, and also to the East of this lot. The land to the West is that owned by Eben Dennis in which the City it interested for playground purposes. This highway was previously improved with gravel base and a road mixed surface. T4ie chances of a street improvement in the foreseeable future are remote. Parcels two and three are located bn North -Maple Street between 11th Avenue and North High Drive. At the present time the road is not improved. These parcels are corner lots with curb and gutter on the other sides of these lots. Under notmal circumstances this would be a good location for curb and gutter and a full street improvement. However, this street is on the City Limits and is only,,dedicated. The East half of the street is neither dedicated nor traveled on.� RECOMMENDATIONS It is recommended that parcel one be allowed to install curb and gutter. Because of snow plowing, maintenance, and safety, it is not recommended that parcels two and three be allowed to install curb and gutter. COMMENTS The method by which these property owners have requested curb and gutter is that of a SPECIAL IMPROVEMENT PETITION and DIRECT CONTRACTOR AGREEMENT. It has been the practice to diseounage these petitions due to future problems and cost to the City. Past experience has shown that these segments must often be replaced, due to settlement, changes in street width, or later home building activity which affects street grade. The City also has initial costs for this work, either patching or major street repair, and the Engineeeing costs. For this work the City receives reimbursement of 5% from the curb and gutter contractor. Whether there is 75 feet or 300 feet, the Engineering and inspection costs are almost the same. The reimbursement which the City will receive for parcel one, above, is $6.48. This is probably 1/3 or 1/4 of the total cost of the Engineering alone. By comparison, on an improvement contract let by the City the charge for Engineering and billing is 10%, and here we are working so to speak on a volume basis where costs are lower. U 1 .11*A k 9; Jewel FAST � OF LoRr 11, BLACK 12, NORTH J OF CITY MAY 21, 1964 The Planning Commission held a public hearing on the rezoning of the subject property on May 18, 1964 and has recommended to the City Council that the property be rezoned from R-1 to B-3. Questions were asked by persons present at the hearing regarding excessive surface water runoff in this area. Alderman Hanson asked that the City Engineer investigate the situation and report to the Cou neil. INVFSTIGATICK The periods of excessive runoff do not occur often so there are no signs.of washing or erosion. Conversations with residents indicate that the situation occurs during heavy rainfalls rather than during the spring runoff. There is one small inlet on the subject tile, it has grass clippings in the bottom of it, so its effectiveness is questionable. There is a County Ditch running throubh this property which would be under the proposed building. REGULATIONS Ordinance Net. 245 requires that the Council act within 30 days after May 25, 19611 (June 24, 1964). 'his Ordinance also has requirements as to site developuent, including fencing, landscaping, and provisions for draining surface water (to be approved by the City Engineer). The Minnesota Highway Department has requirements for driveway locations and widths. (Technical YAnual 5-292.655) The question of whether_ior not a building can legally be constructed over a County Ditch is ane which the petitioner should seek counsel or, and advise the City Council. 1PR%' The City Council }robably ean.place any requirements on the petitioner that theywtmay desire as requirements for this building and its site. The burden of solution of any problem involving stormwater runoff lies with the petitioner. If the petitioner does not construct a building and improve the land in the manner indicated on his proposal, the Council must rely on enforcement of the certificate of occupancy permit section of the zoning code.
