Chambers at the hour of 7:30 P.M. Invocation by Rev McNeilly

Motion was made, seconded and carried to transfer $8,OOO.00,retro-
active to September 14, 1964, from the Liquor Fund to the General Fund.
Skip Quade was present to discuss the Parking Meter Ordinance in regard
to using parking meter space for the construction work at the Citizens
Bank building. No action taken.
Mr. Frederick of Nides Finance Co. was present to discuss moving their
sign from their former location to the present location.(Lodes building)
The sign does not conform to the zoning Ordinance. Referred to the
Planning Commission.
Alderman Fitzloff introduced Ordinance No. 264 and moved its third and
final reading.
ORDINANCE NO. 264
AN ORDINANCE ESTABLISHING THE AIRPORT COMMISSION OF HUTCHINSON
AND DEFINING ITS DUTIES

Alderman Stearns seconded the motion of Alderman Fitzloff to introduce
Ordinance No. 264 for its third and final reading. Upon roll call, all
members present voted in favor of Ordira nce No. 264 and it was declardd
passed on its third and final reading.
James Hamilton, Commander of the newly organized unit of the Civil
Air Patrol squadron was present to give information to the council.
He introduced Lt. Col. Quilling from the Minneapolis Wing Headquarters
who showed slides and gave information about their program. The group
asked the council to donate $500.00 to help support the local group.
No action was taken.
Eloi Hamre, Secretary of the Chambers of Commerce, was present to
discuss the z mill levy for Christmas Decorations, and if the money
could be maidr. used to purchase decorations or on a lease basis.
Mayor Rolffe informed the council that ground breaking ceremonies would
be held on Thursday October 1, 1964 at 8:30 14.M. for the Municipal Airport.
Engineer Wilson explained the North well is in worse condition than indicated
at first.
Alderman Stearns made a motion to repair the well on an emergency
--'"-`�--bas`is`; by placing a cement lining around the outside of the 10 inch
,,e &P7j, gr,dedpipe, remove the old screen and install a new screen. Estimated
cost, labor $2,900.00, parts $7,800.00.- total crost $10,700.00.
This repair would be equilivan-t of a new well and should extend the
life of the well for a permod of 20 - 25 years. .ie -
Alderman Johnson seconded the motion of Alderman Stearns and upoNvseing
taken, carried.
Motion was made, seconded and carried that the petition for a street
light lig at the corner of Maple Street and Northwoods Ave'. be referred
to the Engineer.
A petition for local improvement by watermain on Larson St. between
Lea Ave. and Roberts Road (Peterson School Addition) signed by the
property owner was presented.
Motion was made, seconded and carried to refer this petition to the
Engineer.
Motion was made, seconded and carried to grant a Special Permit and
Variance to construct a Dry Bulk Fertilizer building and facilities at
Erie St. and 3rd Ave South on land to be leased from the Great Northern
R.R. as follows:

PUBLICATION NO. 900
ORDINANCE NO. 264
AN ORDINANCE ESTABLISHING THE AIRPORT COMMISSION OF HUTCHINSON AND DEFINING
ITS DUTIES.
The City Council of the City of Hutchinson does ordain as follows:
SECTION I. AIRPORT COMMISSION ESTABLISHED. There is hereby established
a non-salaried Airport Commission. It shall be composed of five (5) members,
appointed by the Mayor with the approval of the Council, from citizens of
the City interested in the development and utilization of the municipal
airport. The chairman of the commission shall be elected by the members
from their membership. The first five commission members shall be appointed
for terms of one, two, three, four and five years respectively; and there-
after, commission members shall be appointed for a term of five years. A
vacancy shall be filled by the Mayor with the approval of the Council for
the unexpired term. The Mayor shall appoint one member of the City Council
to act as an ex-officio member of said commission.
SECTION II. MEETINGS AND REPORTS. The commission may make and alter
such rules and regulations for its government and the conduct of its busi-
ness as is consistent with the laws relating to cities of the fourth class,
pursuant to which Hutchinson was organized. It shall meet upon the call
of its chairman or a majority of its members and it shall keep an accurate
record of all its proceedings.
SECTION III. DUTIES. The commission shall plan, promote and encourage
the development and utilization of the municipal airport. It shall_ determine
the general policies and provide for the detailed administration, maintenance,
operation, management and control of said airport and all appurtenances
thereto. It shall advise the City Council on matters having to do with
acquisition of additional promises, any and all construction and improvements
thereon, and submit its proposed budget annually before the budget meeting
of the City Council. It shall also have the further duty of consulting
and cooperating with Federal, State and other agencies dealing with aeronautics.
It shall be the duty of the commission to see that all fees and charges due and
owing the City of Hutchinson are properly collected. Said commission may
contract and purchase all necessary equipment, apparatus and supplies for the
operation of said airport provided, however, that any single item of pur-
hase of more than $1,000.00 shall_ be advertised for public bid and shall. be
advertised at least onc,-, in a legal newspaper located in the City of Hutchinson;

and any single'item of purchase of more than $5,000.00 shall also be
approved by the City Council.
SECTION IV. ABMINISTRATIVE CONTROL. Nothing in this ordinance shall
be construed as taking away from the City Council any of its governmental
powers which it does not have authority to delegate to other agencies.
SECTION V. Any other ordinances, resolutions, etc.,inconsistent
with this ordinance are hereby repealed.
SECTION VI. This ordinance shall take effect and be in force from
and after its passage and publication.

A letter X[ M from Phillips
Petroleum Co. accompanied this application explaining that there will
be no odor from this blending plant.
Discussion of the sanitary land fill program at the dump, XM the
collection procedure and hours the dump should be open to the public.
No action taken.
Alderman Fitzloff reported the Police Dept. were repairing the older
meters and would have a report on necessary meter replacements.

WHEREAS, the City Oouncil has resolved to sell by Quit Claim

NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON,MINN:
1. Whereas the City Council has resolved to sell by Quit Claim
Deed, all its right, title and interest to the following described
real property:
Lots 1, 2,3,4 and 5, Park Subdivision to the City of Hutchinson.
2. The City Clerk shall prepare and cause it to be inserted in
the official paper, and advertisement for bids upon the selling of the
above described property. The advertisement shall be published for one
day, shall specify the legal description, shall state that bids will
be opened and considered by the Council at 12:30 P.M., Monday,
October 5, 1964 in the Council Chambers of the City Hall, and that
no bids will be considered unless sealed and filed with the City
Clerk and accompanied by a certified check in the amount of five (`5)
per cent of the amount of such bid, and that the council shall reserve the
right to reject any and all bids and to waive defects in bidding.

Motion was made, seconded and carried to authorize Dr. D. W. Huebert,
Health Officer to purchase a filing cabinet for filing city records.

Kenneth Butler - five years
Alderman Fitzloff made a motion to ratify these appointments.
Alderman Stearns seconded the motion of Alderman Fitzloff and upon
vote, carried.
Discussion on the care of the grounds at the Burns Manor Nursing
HoMe. It was decided to ask Fred Robertsand the Park Board crew
to take care of the grounds for the first year.

A Special Council Meeting was called to order by Mayor Rolfe in the
Council Chambers at the hour of 12:30 P.M.

Mayor Rolfe called for bids Publication No.899 for sale of Lots
1-5 Park Subdivision.

Alderman Fitzloff made a motion to reject the bids on Lots 1 - 5
and readvertise for bids until 8:00 P.M. Monday, October 12, 1964
for the sale of each of the following described parcels now owned
by the City of Hutchinson to -wit:
Lots 1,2,3,4 and 5, Park Subdivision,City of Hutchinson, less
16.5 feet for alley right of way.
Lots 6 - 10 Park Subdivision to the City of Hutchinson,
Lots 1 - 5 Park Subdivision to the City of Hutchinson, less
16.5 feet for alley right of way.
Lots 6,7,8,9 and 10 Park Subdivision to the City of Hutchinson,
according to the map or plat thereof on file and of record in the o
office of the Register of Deeds in and for McLeod County, Minnesota.
The City of Hutchinson intends to sell and convey, by Quit Claim
Deed, all its right, title and interest to the above described real
property.
A certified check in the amount of not less than T 5% of the
total amount bid shall accompany each bid.

vote, carried.
Ken Butler of the Airport Commission was present to discuss plans
and development of the Airport, and rental of the land.
Alderman Stearns introduced the following resolution and moved its

By the City Council of the City of Hutchinson in the County of
McLeod and State of Minnesota that the following sums of money be
levied and assessed upon the taxable property in the City of Hutchinson
for the following pruposes for the current year and that a copy
thereof be sent to the County Auditor of said McLeod County,Minnesota.

Alderman Stearns introduced the following resolution and moved its
adoption:
RESOLUTION NO. 2332
WHEREAS, on December 3, the City Council of the City of
Hutchinson passed a resolution levying taxes for the payment of
$450,000.-00 nursing home bonds of 1964; and
WHEREAS, on December 13, said REsolution was filed with the
County Auditor of McLeod County authorizing said auditor to make
the necessary tax levy to meet the obligation of said bond issue;
and
WHEREAS, during the year 1965, there will be a principal and
XXXM interest payment due on said bond issue in the amount of
$34,700.00; and
WHEREAS, it has been determined that there are sufficient
funds available to enable the City of Hutchinson to meet said
principal and interest payment in the amount of $34,700.00 during
the year 1965 without levying an ad valorem tax to raise said funds.
NOW THEREFORE, the County Auditor of McLeod County is hereby
instructed not to levy an ad valorem tax on the property of the
City of Hutchinson for the purpose of raising funds to meet the
principal and interest payment of $34,700.00 due in the year 1965
on the City of Hutchinson nursing home bonds and in lieu thereof; the
City of Hutchinson will provide said sum of $34,700.00 to mett said
obligation from funds here and now available in the nursing home fund
of the City of Hutchinson.

It was decided to start the sanitary land fill system at the dump on
Wednesday October 7, 1964. Dumping hours will be from 10:30 A,M.
until 6:00 P.M. Mondays through Saturdays and from 1)00 to 6:00 P.M.
Sundays. Gates will be locked at all other times.

Si,CTI0U. jo perenn or persons, firm or corporation shall collect,
gather and 'haul garbage, refuse and like matter for hire or compensation
in any form within tale corporate li-mits of the City Of tiutch111s0n with-
out having first obtained from the City Council of tree City of Hutch-
inson a license to do so.
SECTION II. Persons, firms or corporations desiring to collect, gather
and haul garba<;e, refuse and Like matter for hire within the City
of Hutchinson, shall make and file with the City Clerk of said pity
written application for an arulu-il license, wnich said license shall be
accompanied by the spun cf $24.JJ as a license fee and Li addition to
such license each licenbee spall also pay fees on the basis of the
schedule appearing under Section 5 of this Ordinance, which said license
expire December 31, or each year.

City Council at its next regnilar meeting and Council may act oil such
application at sued or any :subsequent meeip*as.
SECTI)N IV. if the Goancil shall act favoraoly on suer, applications,
to same shall be granted on the i'ollowing conditions, to -wit:
1. Tnat the applicant snall have nib vehicle or co-veyance so
rpvered as tp prpvent 5arba�e, refuse, and liZu matter from
falling, sliking and blowing off tile same;.
2. That the applicant will discarge his cargo only at tree designated
Ci City Jump or at such planes as trie caretaker of tr.e City Dump
may direct.
3. That the applicant will on th;; first day of eaca month furnish
the City Clerk with a true statement signed by the Licensee
as to the number of nis customers indicating in suprl :statement
the number of residential customers and tn�_7 number of commercial
customers.
4/ That the applicant will abide and comply wittlamy and all
rules relating to tree -se of t, e City Du*p/
SECTION V. License fees to be paid by any applicant pursuant to the
Provisionb of tnis Ordinance shall be paid monthly in advaace and shall be
based tand paid upon tree following classifications.

by fine of not more than one hundred dollars or in default of such payment

SECTION VII. E:F.CT. This Ordinance shall take €fact and be in force
from and after its p,)blication.
