Alderman Fitzloff made a motion to advertise for bids for a Patrol Car for the Police Dept., with a heavier powered engine as an alternate bid; bids to be opened at 8:00 P.M. February 22, 1965. Alderman Stearns seconded the motion of Alderman Fitzloff and upon vote being taken, carried. (Publication No. 916.) A letter from the City Attorney of the City of Montgomery was pre- sented, requesting permission to examine a copy of the audit of the City of Hutchinson books as made by Boulay, Anderson, Waldo & Co. The City Clerk was instructed to write a letter granting such per- mission, for the Mayor's signature. Motion was made, seconded and carried that the application for Cigarette License from Farmers Union Copp. Oil, for a period beginning February 1, 1965 and ending December 31, 1965, accompanied by the proper fee of $11.00s, be granted and license be issued in accordance with Ordinance No. 105. Engineer Wilson presented specifications for a four-wheel drive front end loader. Alderman Fitzloff made a motion to advertise for bids for a four-wheel drive front end loader according to specifications proposed by the City Engineer (with snow blower, and cab, optional); bids to be opened on February 22, 1965, at 7:45 P.M. (Publication No. 917.) Alderman Stearns seconded the motion of Alderman Fitzloff and upon vote being taken, carried. Attorney Schantzen presented a proposed ordinance on removal of snow, ice, dirt and rubbish from sidewalks, noting that parking restrictions would require a separate ordinance. Alderman Stearns introduced Ordinance No. 270 and moved its first reading. ORDINANCE NO. 270 AN ORDINANCE PROVIDING FOR THE REMOVAL OF SNOW, ICE, DIRT AND RUBBISH FROM SIDEWALKS The City Council of the City of Hutchinson ordains: SECTION I. All snow, ice, dirt and rubbish remaining on a public side- walk more than 24 hours after its deposit thereon, is hereby declared to be a public nuisance. The owner or occupant of any property adjacent to a public sidewalk shall use due diligence to keep such walk safe for pedestrians. No such owner or occupant shall allow snow, ice, dirt or rubbish to remain on the sidewalk longer than 24 hours after its deposit thereon. SECTION II. The City of Hutchinson, through a designated official, shall remove from all public sidewalks all snow, ice, dirt and rubbish as soon as possible beginning 24 hours after any such matter has been deposited thereon, or after the snow has ceased to fall. Such designated official of the City shall keep a record showing the costs of such removal adjacent to each separate lot and parcel and shall deliver such information to the City Clerk. SECTION III. The owner of property on which or adjacent to which snow, ice, dirt or rubbish has been removed by the City of Hutchinson, shall be personally liable to the City of Hutchinson for the cost of said re- moval. As soon as said removal has been completed and the cost deter- mined, the City Clerk shall prepare a bill and mail it to the owner and thereupon the amount shall be immediately due and payable at the office of the City Clerk. SECTION IV. On or before ­_6ctober 1 of each year the City Clerk shall list the total unpaid charges for each removal against each separate lot or parcel to which they are atrributable under this ordinance, and the Clerk shall certify said charges to the County Auditor for collection the following year along with current real estate taxes. -4 - SECTION V. Any person who maintains a nuisance in violation of any section hereof, or any person who interferes with a City employee or other authorized person in the performance of any service under this ordinance, or any person who violates any terms, sections or provisions of this ordinance is guilty of a misdemeanor, but a prosecution thereof shall be brought for such violation only under action of the Council. If convicted of such violation such person - shall be subject to a fine of not more than $100.00 or imprisonment for not more than 90 days. SECTION VI. If any section of this ordinance is held invalid by a court of competent jurisdiction the invalidity shall extend only to the section affected and other sections of the ordinance shall con- tinue in full force and effect. SECTION VII. This ordinance shall be in full force and effect from and after ita: publication. Alderman Fitzloff seconded the motion of Alderman Stearns to introduce Ordinance No. 270 for its first reading. Upon roll call, all members present voted in favor of Ordinance 270 and it was declared passed on its first reading. Alderman Johnson introduced Ordinance No. 270 and moved its second reading. ORDINANCE NO. 270 AN ORDINANCE PROVIDING FOR THE R A -L OF SNOW, ICE, DIRT AND RUBBISH FROM SIDEWALKS Alderman Hanson seconded the motion of Alderman Johnson to introduce Ordinance No. 270 for its second reading. Upon roll call, all members present voted in favor of Ordinance No. 270 and it was declared passed on its second reading. Mayor Rolfe called for bids on Publication No. 913 for the purchase of two pick-up trucks. Alderman Johnson "aye" Alderman Stearns "aye TT Wesley Abrams, McLeod County Assessor, was present to answer questions concerning the City Assessor's office. He strongly urged action by the Council before March 1, inasmuch as there will be a training school for Assessors at the University of Minnesota March 2-5, and it would be advisable for the new Assessor to attend. -5 - Mr. Charles E. Swenson, Area Business Representative, Local 49, Inttl. Union of Operating Engineers, presented an eight -point program, and requested that a negotiation committee be set up to consider the proposal. Attorney Schantzen and the City Clerk were instructed to write to Mr. Swenson to the effect that the Council will take the matter under advisement. Fred Roberts presented a proposal from Mr. Katusky to top (12) trees at $23.00 per tree. The Council requested a written proposal from the Park Board as to their recommendations on tree trimming. Engineer Wilson presented a proposal from Robert Hartel, Glencoe, to re -appraise city -owned property for a fee of $80.00. Alderman Johnson made a motion to accept Mr. Hartel's offer. Alderman Fitzloff seconded the motion of Alderman Johnson and upon vote being taken, carried. Discussion on proposed Truck Route Ordinance. Tabled for the next meeting. Alderman Hanson introduced the following resolution and moved its adoption. Engineer Wilson presented and explained the proposal of the Mark Hurd Company for aerial contour and topography maps of Hutchinson and the surrounding area. Discussion. Referred to the Hutchinson Planning Commission for recommendations. Alderman Stearns made a motion that the Engineering Department be authorized to accept applications for a full-time Engineering Aide in the Engineering Department. Alderman Johnson seconded the motion of Alderman Stearns, and upon vote being taken, carried. Discussion of 1965 Street Improvement Project. NOW THEREFORE, upon giving due consideration to all of the information for and against the vacation of said avenue, it is hereby decided that the vacation of said avenue is necessary and proper and that the public interest would be promoted thereby, and we thereby grant the prayer of said petition and the same is hereby vacated. Present w ere: Joe Youmans, Ivan Hurt' Earl Fitzloff, Milt Altmeyer, and Gene May;, A check for .170.00 was received from the Newcomers, Club for use in purchasing playground equipment. They requested that they as a group would like to take over the SOi1THVIEiW neighbor hood playground to put in the playground equipment with the City Recreation Board matching their funds as they progressed. Motion by Youmans, second by Fitzlof, and passed to allow this group to equip this playground with our help. Equipment and placement will be left up to the playground recreation board committee. Bills were read and approved on a motion by Fitzloff, second by Youmans. Adiscussion on the budget showed that we had stayed within our budget for tht year in operational expense and capital out lay. It was agreed that Hurt would work with the City Engineer to obtain bids on this proiect. Discussion also pointed ojt that it may be possible for us to do this by paging one half the first ,year with the balance the year following. Discussion then centered around the possibility of evaluating our program to see what we are spending for recreation in comparison to other towns our siz e. Hurt will try to obtain some information from the Minnesota Recreation Association or the University of Minnesota where some studies have been made. It was also agreed that we look into the possibility of the Recreation Program being put on a fixed mill r ate income.
