The special meeting was called to order by Mayor Westlund at 2:05 P.M., with the fol-
lowing present: Alderman Peterson in addition to Mayor Westlund. Also present were:

TUESDAY, JUNE 24, 1980
1. CALL TO ORDER
The meeting was called to order by Mayor Westlund at .8:00 P.M., with the following
members present: Aldermen Peterson, Gruenhagen and Beatty, in addition to Mayor
Westlund. Absent: Alderman Lueneburg. Also present: Administrative Assistant
Plotz, City Engineer /Public Works Director Priebe, and City Attorney Schantzen.
2. INVOCATION
The invocation was given by the Reverend Darrel F. Thalman from our Savior's Luth-
eran Church.
3. MINUTES
The minutes of the Special Meetings of June 10, 1980, Regular Meeting of June 10,
1980, and Special Meetings of June 16, 1980 were approved as amended, upon motion
by Alderman Beatty, seconded by Alderman Peterson and carried unanimously.

(a) CONSIDERATION OF REQUEST FOR REDUCED TRASH AND REFUSE RATES:

After discussion, the motion was made by Alderman Beatty, seconded by Alder-
man Gruenhagen and unanimously carried, to approve the reduced trash and re-
fuse rates for the above named individuals.
(b) CONSIDERATION OF REQUEST BY JOHN MILLER TO MOVE BUILDING
Mr. John Miller requested approval to move an existing farm house into the
City and locate it in the Country Club Terrace. The building will be re-
modeled and used as an apartment house.
It was the recommendation of the Building Official to approve the relocation
of the structure, with the following stipulations:

Before any work is done to place this house on a permanent foundation
on the proposed site, two sets of plans and specifications shall be
submitted to this office for the proposed work to be done and a build-
ing permit applied for on or before 90 days following relocation of
the building.
Following discussion, it was moved by Alderman Beatty to approve the relo-
cation of the building, with the recommended stipulations. Seconded by Ald-
erman Gruenhagen, the motion unanimously carried.
(c) CONSIDERATION OF REQUEST BY HUTCHINSON DOWNTOWN RETAIL ASSOCIATION FOR
DOWNTOWN MERCHANTS TO USE SIDEWALKS FOR CRAZY DAYS ON JULY 23, 1980
The Downtown Retail Association requested permission to use
in front of downtown stores for Crazy Days on July 23, 1980.

BAND CONCERTS
Mayor Westlund reported the $1,000 contribution from the City for 1980 band
concerts had been budgeted.
Following discussion, the motion was made by Alderman Peterson, seconds$ by
Alderman Gruenhagen and unanimously carried, to approve payment.
(e) CONSIDERATION OF REQUEST BY CHAMBER OF COMMERCE FOR CITY'S PORTION OF
$2,000 FOR BROCHURES
Mayor Westlund commented that on Sepember 25, 1979 the Chamber of Commerce
had requested the City to budget $2,000 to assist in preparing a four -color
brochure on Hutchinson. This item had been included in the 1980 budget.
The Executive Vice President of the Chamber of Commerce, Clarice Coston, pre-
sented drawings of the brochure layout. She pointed out the motto would be
"Hutchinson, a town for all seasons."
After discussion, the motion was made by Alderman Gruenhagen to approve pay-
ment of $2,000 to the Chamber of Commerce for the City's portion of cost for
the brochures. The motion was seconded by Alderman Peterson and unanimously
carried.

_Following discussion, the motion was made by Alderman Beatty to waive the
second reading and adopt Ordinance No. 601 entitled Amendment of Hutchinson
Zoning Ordinance, Section 10: Special Provisions. Seconded by Alderman Gruen -
hagen, the motion carried unanimously.
(f) ORDINANCE NO. 13/80 - ORDINANCE RESCINDING ORDINANCE NO. 519 AND ORDINANCE
NO. 551 FOR DISSOLUTION OF HUTCHINSON CIVIC ARENA BOARD
Mayor Westlund commented that some time ago he had recommended the Civic
Arena be placed under the jurisdiction of the Park and Recreation Board.
This Ordinance would dissolve the Civic Arena Board.
After discussion, Alderman Beatty moved to waive the first reading of Ordi-
nance No. 13/80 entitled Ordinance Rescinding Ordinance No. 519 and Ordinance
No. 551 for Dissolution of Hutchinson Civic Arena Board and set second read-
ing for July 8, 1980. The motion was seconded by Alderman Peterson and car-
ried unanimously.
(g) RESOLUTION NO. 6556 - TRANSFERRING $10,000 FROM LIQUOR STORE TO GENERAL FUND
Following discussion, the motion was-made by Alderman Peterson, seconded by

Alderman Gruenhagen reported all'of the items requested by the Hospital have
been budgeted, with the exception of the blood gas machine. The following
recommendations have been made by the Hospital Board:

1) Purchase portable x -ray unit in amount of $18,995 from Northern
X -Ray Company of Minneapolis.
2) Purchase security television camera systems in amount of approxi-
mately $5,400.
3) Purchase emergency generator in amount of $39,000 from Cummins
Diesel of Minneapolis.
4) Advertise for bids for purchase of an Arterial Blood Gas Analyzer
in amount of approximately $13,000.
Following discussion, it was moved by Alderman Gruenhagen, seconded by Ald-
erman Beatty and carried unanimously, to approve the above recommendations.
9. NEW BUSINESS
(a) CONSIDERATION OF RECLASSIFICATION OF PERSONNEL IN POLICE DEPARTMENT
Chief of Police O'Borsky reported- on-a'1979 Bill passed-by the Minnesota
State Legislature which required part -time peace officers to be licensed
and the procedure to obtain said license. -'These officers under State law
will have the full authority of the full -time officers and be authorized
to carry firearms.
After discussion, Alderman Gruenhagen moved to approve the change in status
for part -time officers. Seconded by Alderman Beatty, the motion carried unani-
mously.
(b) CONSIDERATION OF SUMMER EMPLOYEE IN ENGINEERING DEPARTMENT
Following discussion, the motion was made by Alderman Peterson, seconded by
Alderman Gruenhagen and unanimously carried, to approve the employment of
Dan St. Pierre as a summer employee in the Engineering Department.
(c) CONSIDERATION OF HIRING BIKE SAFETY AIDE
After discussion, it was moved by Alderman Beatty to approve the employment
of Richard Duehn as bike safety aide for the summer. The motion was seconded
by Alderman Peterson and carried unanimously.
(d) CONSIDERATION OF RECOMMENDATION FOR MERIT INCREASES FOR EMPLOYEES
Following discussion, the motion was made by Alderman Peterson, seconded by
Alderman Beatty and unanimously carried, to approve the recommended merit
increases, effective July 1, 1980.

(e) CONSIDERATION OF HIRING PART -TIME DISPATCHER
After discussion, Alderman Gruenhagen moved to approve the employment of
Janet Wieland as part -time dispatcher in the Police Department. Seconded
by Alderman Beatty, the motion carried unanimously.
(f) CONSIDERATION OF HIRING SECRETARY FOR PARK AND RECREATION DEPARTMENT
Following discussion, it was moved by Alderman Peterson, seconded by Alder-
man Beatty and unanimously carried, to approve the employment of Karen Staf-
ford as Park and Recreation Secretary, effective July 7, 1980.
(g) CONSIDERATION OF REQUEST FOR REZONING SUBMITTED BY JUNE REDMAN WITH
FAVORABLE RECOMMENDATION OF PLANNING COMMISSION
After discussion, the motion was made by Alderman Beatty to waive the frst
reading of Ordinance No. 14/80 entitled An Ordinance Amending Ordinance No.
464 Concerning Zoning Regulations In the City of Hutchinson and the Ofcial
Zoning Map and set second reading for July 8, 1980. Seconded by Alderman
Peterson, the motion carried unanimously.
(h) CONSIDERATION OF REQUEST FOR CONDITIONAL USE PERMIT SUBMITTED BY JUNE REDMAN
WITH FAVORABLE RECOMMENDATION OF PLANNING COMMISSION, WITH CONTINGENCY,.,,
Administrative Assistant Plotz distributed copies of a map showing the property
involved. He reported June Redman had requested a circle drive, and this
would require application to the State Department of Transportation for high-
way right -of -way to allow a second entrance off of Highway No. 7.
Alderman Gruenhagen pointed out the Planning Commission had stipulated no
off - street parking in the front setback. He suggested referring it back to
the Planning Commission for further study.
Following discussion, the motion was made by Alderman Gruenhagen to refer the
matter back to the Planning Commission to resolve the parking issue. Seconded
by Alderman Beatty, the motion unanimously carried.
(i) CONSIDERATION OF REQUEST FOR CONDITIONAL USE PERMIT SUBMITTED BY DEBRA
BOMSTAD WITH UNANIMOUS RECOMMENDATION TO REJECT BY PLANNING COMMISSION
Mr. Blaine Bomstad appeared before the Council and stated that if they could
not get approval for a Conditional Use Permit, they would not rent out a por-
tion of their house inasmuch as the neighbors were opposed.
After discussion, Alderman Beatty moved to uphold the Planning Commission's
decision to reject the request for a Conditional Use Permit. The motion was
seconded by Alderman Gruenhagen and carried unanimously. .

(j) CONSIDERATION OF DELINQUENT WATER AND SEWER ACCOUNTS
Mayor Westlund read a copy of the letter sent to all delinquent account hold-
ers. He then.inquired if there was anyone present who wished to be heard re-
garding his /her account. There was no response.
It was pointed out the property owner of 642 Adams Street requested the water
to be shut off at 12:00 Noon on Wednesday, June 25, 1980 -(03- 1055- 2 -00).
After discussion, Alderman Gruenhagen moved to discontinue service on June 30,
1980 at 1:00 P.M. as recommended by staff, for any unpaid accounts as follows:

(k) CONSIDERATION OF ENTERING INTO A REFUSE COLLECTION AGREEMENT WITH JUNKER
SANITATION
Mayor Westlund stated the City Council and City Attorney had reviewed the
present contract with Junker Sanitation and some changes had been made in the
agreement. The base fee payable to Junker Sanitation will be $5.10 per month,
with the addition of 15q� for the City's cost of doing the billing. The pro-
posed contract would cover a 10 year period and include an exclusive right
for one hauler to remove sanitation from the commercial area.
Mention was made that a Board of Review meeting would be held on June 27,
1980, beginning at 10:00 A.M. and continuing through the day. At that time
appointments with individual businessmen would be held to discuss any com-
mercial refuse problems.
Attorney Francis Eggert--reported he was representing Leonard Ri.emann of the
A & W Drive -In. He stated his client's needs were not being met for a nego-
tiated rate. The A & W had paid $90 for 18 yards of refuse; the rate was in-
creased to $140 in June, 1980. The complaint wasn't about the service, but
rather the rates charged. Mr. Eggert expressed .concern over the City.enter-
ing into a new contract with Junker without first putting it up for bids.
He was also concerned about the large rate increase on commercial accounts.
A & W's located in other cities have more output and lower rates than in
Hutchinson. He felt Junker's charge was out of line. Attorney Eggert re-
quested the Council to consider tabling action on the contract until after
the meeting with commercial users scheduled for Friday, June 27, 1980.
Mr. Galen Witte of Witte Sanitation requested a permit to allow him to haul
refuse within the City limits. He commented on the old contract and asked
why there are other containers in town.

Aldermen Beatty and Gruenhagen both expressed concern over granting exclu-
sive right to one hauler.
Following discussion, Alderman Peterson made the motion to table action on
the refuse collection agreement until a special meeting of the Council on
Monday, June 30, 1980 at 1:00 P.M. Seconded by Alderman Beatty,ythe motion
unanimously carried.
Mr. Robert Swanke of the Book End & Mary Lue's Nit Pik commented he had chosen
not to use the refuse service but was still billed for it. In 1977 his store
had put out garbage and received good service; then all of a sudden the pick-
ups ended. He then talked to Jim Junker for half an hour and got nowhere.
He never heard from Junker again. In 1978 his rate was increased $5 a Z�,on•th,
but still no pickup. In 1979 he received a note saying his service wou ;d
stop if no payment was received within 10 days. In March of 1980, he w4s
sent a letter stating he was being sued and the service would stop. The
suit was dropped after Junker learned of his mistake. Mr. Swanke stated he
had his own truck for hauling refuse from his store so he pays the base -.fee
and forgets about the pickup service. He had no idea how Junker determines
his rates.
Mrs. Jerry Brown asked the Council what was included in the base charge for
commercial users. She then stated it had taken her several years to finally
learn that the base charge covers one pickup per month.
Mrs. Jean Davison of Northside Grocery asked why residents have to pay for
trash pickup when there is none to be picked up.
Clarice Coston stated Junker Sanitation had given good service and allowed
additional items to be picked up. However, she did feel the commercial ac-
counts deeded proper consideration and information on what they were being
charged, what it covered, etc.
City Attorney Schantzen drew attention to items No. 12 and 13 in the proposed
contract. He pointed out they give the City the right to cancel the contract
if the hauler failed to give proper performance.
(1) CONSIDERATION OF CONTACTING DON CASWELL OF MINNESOTA DEPARTMENT OF
TRANSPORTATION FOR INSPECTION OF SCHOOL ROAD BRIDGE REPAIR
City Engineer /Public Works Director Priebe stated that Mr. Don Caswell had
been recommended to do inspection of the School Road Bridge during the deck
removal operations. He is considered an expert in the State relative to this
type of deck surfacing. Mr. Priebe requested permission to contact Mr. Cas-
well's office in writing regarding the inspection.
After discussion, it was moved by Alderman Beatty, seconded by Alderman
Peterson and unanimously carried, to contact Don Caswell for said bridge
repair inspection.

Following discussion, the motion was made by Alderman Beatty, seconded by
Alderman Peterson and carried unanimously, to approve the employment of Mary
Haugen as Civic Arena Coordinator, effective August 4, 1980 as recommended
by staff, and approve transfer of Mark Weis to the new position of Parks/
Arena Maintenance.

Administrative Assistant Plotz reminded the Council of the Department Heads
Meeting on Thursday morning, June 26, 1980 at 8:00 A.M. and the up- coming
Board of Review on Friday, June 27, 1980, starting at 10:00 A.M.
(b) COMMUNICATIONS FROM BECKY WALRADTH ON MOSQUITO CONTROL
Mayor Westlund commented he had received a telephone call earlier in the day
from a concerned citizen who was interested in the City spraying for mosqui-
toes. He then asked Becky Walradth to present her request.
Becky Walradth presented to the Council a petition signed by 518 signatures
requesting mosquito control within the City.
City Engineer Priebe reported the City had done spraying to control mosqui-
toes about 10 years ago, but it was discontinued due to problems encountered.
The City crew does some spot spraying around the lake area. The cost for
spraying 10 years ago was approximately $500 or $600.
Mayor Westlund felt some research should be done on this matter and instructed
the City Engineer to present a report at the next Council meeting.
(c) COMMUNICATIONS ON ELECTION RESULTS
Administrative Assistant Plotz reported the election results were in and
asked the Council to approve the canvassing. The election results were then
presented to the Mayor and Council by City Accountant Merrill.
It was moved by Alderman Beatty, seconded by Alderman Gruenhagen and unani-
mously carried, to waive reading and adopt Resolution No. 6558 entitled Reso-
lution Canvassing Election Returns of City Special Election Held June 24,
1980.
(d) COMMUNICATIONS FROM CITY ENGINEER /PUBLIC WORKS DIRECTOR
City Engineer /Public Works Director Priebe stated that bids were opened at

Mayor Westlund commented on the Board of Review held Monday, June 23, 1`'80
and the requested changes. It will be-necessary to approve and accept the
assessor's recommendations and authorize him to post the changes.
It was moved by Alderman Peterson to close the hearing for the Board of he-
view. The motion was seconded by Alderman Gruenhagen and carried unanimously.
It was moved by Alderman Peterson, seconded by Alderman Gruenhagen and unani-
mously carried, to accept the recommendations of the County Assessor, with
changes,for the 1980 assessments.

SPECIAL MEETING - HUTCHINSON CITY COUNCIL
MONDAY, JUNE 30, 1980
Mayor Westlund called the special meeting to order at 1:00 P.M., with the following
members present: Aldermen Peterson, Gruenhagen and Beatty, in addition to Mayor West -
lund. Absent: Alderman Lueneburg. Also present were: Administrative Assistant Plotz,
Rick and Jim Junker of Junker Sanitation, and Attorney Lee L. LaBore.
The Mayor explained the purpose of the meeting was to discuss the contract between
the City of Hutchinson and Junker Sanitation. The present contract will expire at
midnight today, June 30, 1980. Mr. Westlund then alluded to several options the City
had for garbage removal and stated it was his opinion that a contract with one hauler
was the best choice. The proposed contract with Junker Sanitation would cover a 10
year period and provide for an annual Board of Review.
Attorney Tom Nagel stated he represented Galen Witte of Witte Sanitation. He concurred
that one hauler was the best approach for the City, but he felt one hauler was being
given a powerful right. He questioned the fact that bids were not let for more than
one private hauler. Also, Mr. Nagel pointed out the new contract with Junker did not
provide a rate schedule for the commercial users nor did it provide for any pickup
schedule for commercial areas. Although a municipality the size of Hutchinson should
be served by one hauler, the City needs to be aware of the vulnerability the commercial
users are placed in since there is no negotiation with only one hauler. Further, he
felt 10 years was too long a time period for a contract. Competitive bidding would
enable the City to satisfy both the commercial and residential users that the best
rate and service was obtained. It suggests to the general public that some thought
and decision was put into the final contract. In closing, Mr. Nagel stated that Mr.
Witte would be interested in hauling for the commercial users but would not bid on
service for the entire City.
Attorney LaBore responded to Mr. Nagel's comments and stated the City had given much
thought to the new contract with Junker Sanitation. He pointed out it was difficult
to write a rate structure into the contract because of the diversity of the commercial
services. The City Council has the power to regulate the rates and hold a Board of
Review. Also, the City has the right to enter into a 10 year contract. Junker has
earned the right to enter into a new contract with the City based on its past perfor-
mance.
Mayor Westlund reported that Junker Sanitation had provided a rate breakdown for the
Council to review, and these rates would be reviewed annually. The rates could be
amended into the contract and changed each year, if necessary.
Following extensive discussion, it was the consensus of the Council that the refuse
contract should be awarded to one hauler, namely Junker Sanitation.
The motion was made by Alderman Peterson to enter into a contract with Junker Sanita-
tion, effective July 1, 1980, for an-eight year period, with a four year option, with
an addendum for a Board of Review to be held in the month of June, with the date to

be set by the City Council, and a rate schedule for commercial accounts be attached
to the contract. The motion was seconded by Alderman Beatty, and unanimously carried.
It was moved by Alderman Peterson, seconded by Alderman Beatty and carried unanimously,
to approve the container rate schedule for the period July 1, 1980 to June 30, 1981.
Discussion was given to the rates charged the A & W Drive -In. It was determined that
no rate exception would be given to the A & W, and their charges would be based on the
type of container used and the number of pickups. During the less busy months, the
refuse pickup service would be on an "on call" basis. A letter would be sent to Mr.
Leonard Riemann from City Hall explaining the options.
Alderman Beatty moved that there would be no reduction in commercial rates for the
A & W Drive -In and arrangements would be made with A & W for an acceptable rate for
their business. Seconded by Alderman Gruenhagen, the motion unanimously carried
An agreement was reached that the Country Kitchen would receive refuse service f
eight yards, three times a week.

the Radisson South Hotel in Bloomington, Minnesota,.on

co- operative program composed of law enforcement officials,
prosecutors, judges and defense attorneys, each working to
ensure the fair administration of justice.

of grant funded tuition scholarships are available to law

The Hutchinson Elks Lodge has been asked by the Minn. International
Softball Congress to run the State Double nA" fastpitch softball tournament
the second and - -third of August, All proceeds from our concession stands
goes toward Youth Recreation Activities and the proposed new softball field
complex.
In order to cover a $600.00 expense fee to the State Commissioner, we
need to sell admission tickets to cover this added overhead. What we are
asking permission to do in order to control ticket sales is block off river-
road immediately west of Riverside Park completely and partially block off
the intersection of river -road and Lind Street, which is just east of River-
side Park, to allow one lane of traffic to enter and leave the area.
The admission charge would be $1.50 for an all day pass to all games.
Children 12 and under would be admitted free. Also, these tickets would be
sold strictly on a honor system so as to allow people into the other park
facilities that don't want to watch softball.
Your approval would be greatly appreciated.

I recommend the attached request to block off the river road
be denied and submit the following suggestions:
I suggest that snowfencing be used to close in the park area
starting at the horseshoe pit north into the parking lot and west
past the ball diamond. This could be done inexpensively by Elks
Club labor and would accomplish the same goal without causing the
traffic problem.
I have no objection to the sale of tickets to the games, however,
the Elks should limit the hours of sale to when games are being played
and not allow beer or liquor to be brought in the park area.

OF THE CITY OF HUTCHINSON, ENTITLED HOURS OF SALE
THE CITY OF HUTCHINSON DOES ORDAIN:
SECTION 1. Section 800:45 of the 1974 Ordinance Code of the City of Hutchinson,
entitled Hours of Sale, is hereby amended to read as follows:
Section 800:45. Hours of Sale.
No sales of any non - intoxicating malt liquor shall be made between
the hours of 1:00 A.M. and 8:00 A.M. any day except Sunday on which
day no sales shall be made before 12 :00 noon nor after 12:00 midnight.
In addition, no sales shall be made during such hours as the polls are

to Minnesota Statutes annotated.

HUTCHINSON CIVIC ARENA BOARD
JUNE 18, 1980
The Board of Directors of the Hutchinson Civic Arena met on Wednesday,
June 18, 1980 at the Prairie House Restaraunt in Hutchinson.
The following persons were present: Rollie Jensen, Lyle Block, Ralph
Neumann, Mayor Ralph Westlund, Gary Plotz, and Jim Waldron.
An official meeting was not held because there was no quorum .
Discussion was held regarding building rental policies and charges.
Ralph Neumann reported on activities held throughout the summer.
Discussion was held regarding the amount the Youth Hockey Assoc.
pays for the ice time they use.
Mayor Westlund advised the Board that this would be the last meet-
ing of the Civic Arena Board as the new city structuring calls for
the Board to be dissolved and the general supervision of the Civic
Arena would be placed inder the Park and Recreation Board,
Mayor Westlund presented Certificates of Appreciation to the Civic
Arena Board members present at the meeting.

(k) CONSIDERATION OF VARIANCE SUBMITTED BY MCLEOD COUNTY FAIR BOARD WITH FAVOR-
ABLE RECOMMENDATION OF PLANNING COMMISSION, WITH CONTINGENCIES
Following discussion, it was moved by Alderman Lueneburg, seconded by Alder-
man Gruenhagen and unanimously carried, to waive reading and adopt Resolution
No. 6543 entitled Resolution Granting Variance from Section 6.05, B.3 of the
Zoning Ordinance No. 464 for Zero Setback On North Side of Proposed Structure
Located at McLeod County Fairgrounds, contingent upon the proposed structure
meeting the building code requirements, specifically: a) Sprinkler system in-
stallation, b) North wall, with minimum setback, shall be concrete block con-
struction, and c) North wall, with minimum setback, shall have no openings.
(1)1 CONSIDERATION OF SETBACK REQUIREMENTS REFERRED BACK TO PLANNING COMMISSION,
WITH FAVOFABLE RECOMMENDATION, CONTINGENT ON EXCEPTIONS
City Engineer /Public Works Director Priebe reported the setback requirements
were again reviewed by the Planning Commission. It was their recommendation
that the two areas already platted, namely McDonald's Sixth Addition and Town
& Country Estates, should be exempt from the proposed 8' side setback build-
ing to lot line for a period of 18 months. These two plats would then have
two years in which to build.
Also, it was the Planning Commission's recommendation that Lots 1, 3, 4, 7.,
and 8 of Block 2, Cedar Acres and Lots 2, 3, 4, 5 and 6 of Block 1, Boyle's
Addition should be exempt from the minimum lot area per dwelling for a period
of 18 months inasmuch as plans for these particular lots have already been
made and money invested in the development.
Alderman Gruenhagen stated he saw no reason for this action on setbacks and
couldn't follow the reasoning of the Planning Commission.
Following discussion, Alderman Peterson made the motion to table the matter
until the June 24, 1980 Council meeting. The motion died for lack of a
second.
Alderman Gruenhagen requested that with the present reasoning given by the
Planning Commission, the City Council look for more valid reasons than those
given. The staff was instructed to provide additional information on lot
size requirements,and the Planning Commission minutes from the May 20, 1980
meeting be made available for review by the Council.
The motion was made by Alderman Peterson, seconded by Alderman Lueneburg
and unanimously carried, to defer action until June 24, 1980.

spaces and access drives shall have a minimum design of 6' of gravel base
with a 2" plant mix bituminous surface or an approved equal subject to
approval by City Engineer, shall become effective subsequent to adoption
by City Council.

City Council of the preliminary plat for "Schmidtbauer's First
Addition ". Seconded by Bill Backen, the motion carried unanimously.

The hearing was opened by Chairman Christen at 11:04 P.M.
Mr. Clem Mackenthum of the McLeod County Fair -Board explained a
main sewer line would be directly in the path of the building and
if it should need repair there would be a problem so they were ask-
ing for a variance which would permit the building to be moved back
to the lot line on the north.
The hearing was closed at 11:02 P.M. Seconded by Bob Otte, the
motion unanimously carried.
Mr. Ted Beatty then made a motion to recommend approval of the
variance request contingent upon the proposed structure meets
building code requirements specifically: 1) Sprinkler system
installation; 2) North wall with minimum setback shall be concrete
block.construction; 3) North wall, with minimum setback, shall
have no openings. Seconded by Bill Backen, the motion carried
unanimously.

HISTORY
At its regular meeting on February 19, 1980 the Planning Commission was
presented with a proposal from staff for the changing of Zoning Ordinance
No. 464. A public hearing was held on March 18, 1980 at which time no
one was present to voice opposition to staff's recommendation. The pro-
posed change is as follows: Amendment of Section 9 of Zoning Ordinance No.
464 Zone R -2, 3b. Side setback building to lot line shall be; each side 81.
Zone R -3, 2b. Minimum lot area per dwelling unit shall be 2,200 square feet.

Feds may pay for
fatal heart attacks
The Federal Public Safety Officers' Benefit Act of 1976
authorizes the Law Enforcement Assistance Administration
(LEAA) to pay a "death benefit" of $50,000 to survivors of a
firefighter who died as a "direct and proximate result of per-
sonal injury sustained in the line of duty." Both paid and
volunteer firefighters are covered by the Act.
This tax -free benefit does not apply to "deaths resulting
from occupational illness or chronic disease." However, in cer-
tain cases, the benefit is available to firefighters who suffer
fatal heart attacks following a fire.
In consultation with physicians, LEAA has determined that
a fatal heart attack which is induced by exposure to carbon
monoxide (where CO level in the blood is 107r or more for non-
smokers and 15% or more for smokers) would qualify as a sub-
stantial "line -of -duty traumatic injury" for compensation
purposes.
Fire service personnel should keep in mind the following
recommendations in order to maintain survivors' rights under
the death benefit program:
(1) An entry -level physical examination for firefighters is
essential. Such a physical examination not only aids in es-
tablishing that a heart attack is not the result of "oc-
cupational illness or chronic disease" — it's also required
to prove occupationally- acquired heart and lung disorders
for purposes of certain workman's compensation benefits
to paid and volunteer firefighters under Minnesota law.
(2) If a firefighter suffers a fatal heart attack at a fire scene, or
within a few hours of fighting a fire, an autopsy (and a tox-
icology analysis) must be performed, and the toxicology
analysis report must list exact toxic levels, so the
10%+/15%+ CO level can be established.

Councilman Lueneburg, Ralph Neumann, Finley Mix and myself reviewed all of the
bids received. It'was mutually agreed that the costs for the used equipment
would not be cost effective for the City.
After a review of the bids for the new equipment, we all reviewed the
equipment and discussed same, with Ag Systems of Hutchinson. It was agreed that
the equipment bid will fulfill the needs of the City. We therefore recommend
awarding a contract to purchase the equipment from Ag Systems for a base cost
of $43,700.00 plus $1,120.00 optional extra (water tank) for a total of
$44,820.00. This equipment will not require an addition to the sewer plant
building at a cost of $2,881.00.

AERIAL SPRAYING
The cost for aerial spraying is $1.00 per acre, based on spraying an entire city of
approximately 10,000 residents. Within the City limits we have 3,200 acres (5 square
miles); therefore, the cost would be approximately $3,200 per application.
SPRAYING OFF A TRUCK
The cost for the sprayer would be $3,500 and have a range of 300 -500 feet. It would
be mounted on a pick -up truck.
The pyrethrins spray solution would cost approximately $ .40 /acre. Based on 3,200
acres within the City, the cost for the pyrethrins solution would be $1,280 per ap-
plication. Labor would be an additional expense.
Spraying by this method would require evening application(s). Approximately 20 appli-
cations per year would be needed for a long term solution.
BACK -PACK SPRAYING
Selected spraying can be effective if the area is sprayed every three days.
The back -pack sprayer would cost approximately $300. The sprayer has a range of 30
feet.
One application of pyrethrins solution would average $ .50 per acre.

ADDITIONAL INFORMATION
The Metropolitan Mosquito Control District will not loan or lease their equipment
outside the six county metro area.
It is also noted that prior to any mosquito control spraying, an application by the
City to the Minnesota Department of Agriculture is required.

SUBJECT: Mosquito Control
I rechecked with Litchfield personnel subsequent to the last Council Meeting.
The equipment they have is small and has limited use for small areas. They
showed no interest in doing work outside the City. They recommended
contacting Cenex or Farmers Elevator or some other firm that does crop
spraying to see about getting spraying done by them.
I later talked with Dr. Robert Sjogren with Metropolitan Mosquito Control
District. He first stated anyone spraying must be registered as a pest
control applicator with the State. Dr. Arthur Mason is with the State
Department of Agriculture. Attached is information from Dr. Sjogren and Dr.
Mason.
Dr. Sjogren did state that success in mosquito control depends on background
training of personnel. If anything is sprayed, DNR does not require a permit
to spray.
This is all of the information I have been able to collect. I hope it is
helpful in making a decision. Roger with Lystads, Inc. here in town could
spray, but did not sound too interested.

The City has reviewed the current vendor and solicited
another quote for uniforms for the City Crews. Due to the
poor service, it would be the recommendations of the department
heads (Marlow, Bruce $ Ralph) to change vendors.
It is requested to enter into a service agreement with
Gross Industries to supply uniforms for the next 12 months.
If we continue with the same number of change, the cost would
increase by 30¢ per change or approximately $21.00 per week for the City.
There has been a request to go to a clothing change every
day. The cost would be $5.75 per week. The effect on this
would be an added cost of $3.10 per employee per week from
our present city cost.

be needed in this years budget.
