CALL TO ORDER Mayor Westlund called the meeting to order at 7:30 P.M., with the following mem- bers present: Aldermen Peterson, Lueneburg, Gruenhagen and Beatty, in addition to Mayor Westlund. Absent: None. Also present: City Administrator Plotz and City Attorney Schantzen. 2. INVOCATION The invocation was given by the Reverend James P. Lauer of the Peace Lutheran Church. 3. MINUTES The minutes of the Regular Meeting of July 8, 1980 were approved as presented upon motion by Alderman Lueneburg, seconded by Alderman Peterson and carried unanimously. 4. PUBLIC HEARING None 5. COMMUNICATIONS, REQUESTS AND PETITIONS (a) CONSIDERATION OF CLAIM AGAINST CITY FOR SEWER BACK-UP On June 20, 1980 Mr. Bill Barrie of 145 Fifth Avenue N.E. had sewer water back up into his basement and main floor bathroom. He submitted a claim for $20.00 to cover damage and labor for clean-up. It was the recommendation of Director Neumann for the City to pay the amount for the claim. Following discussion, it was moved by Alderman Lueneburg to approve payment of $20.00 to Bill Barrie. Seconded by Alderman Beatty, the motion unanimously carried. (b) STATUS REPORT BY PHILIP GRAVES ON ENERGY MAXI -AUDIT FOR HUTCHINSON COMMUNITY HOSPITAL Administrator Graves presented a maxi energy audit report for the Hutchinson Community Hospital. This report has been submitted to the federal government for 50% matching funds to cover expenditures for equipment modifications in the approximate amount of $68,000. Mr. Graves requested approval from the City Council, pending matching funds from the government, to advertise for bids for the purchase of a microprocessor and related equipment modifications recommended in the Maxi Energy Audit. After discussion, the motion was made by Alderman Gruenhagen, seconded by Ald- erman Peterson and carried unanimously, to grant the request. COUNCIL MINUTES JULY 22, 1980 (c) CONSIDERATION OF APPOINTMENTS: 1) LARRY ROMO - PLANNING COMMISSION 2) EUGENE DAGGETT - UTILITIES COMMISSION, EFFECTIVE 9-1-80 Mayor Westlund requested the Council to ratify the appointment of Larry Romo to the Planning Commission to complete the term of Paul Christen and the ap- pointment of Eugene Daggett to the Utilities Commission, effective September 1, 1980. Alderman Peterson moved to ratify the appointment of Larry Romo-to the Planning Commission. The motion was seconded by Alderman Lueneburg and carried uvpi- mously. Alderman Beatty moved to ratify the appointment of Eugene Daggett to the Utili- ties Commission for a six year term, effective September 1, 1980. Seconded by Alderman Peterson, the motion unanimously carried. 6. RESOLUTIONS AND ORDINANCES (a) ORDINANCE NO. 15/80 - ORDINANCE AMENDING SECTION 800:45 OF THE 1974 ORDINANCE CODE OF THE CITY OF HUTCHINSON, ENTITLED HOURS OF SALE Following discussion, the motion was made by Alderman Gruenhagen, seconde4 by Alderman Beatty and carried unanimously, to waive the second reading and adopt Ordinance -No. 604 entitled Ordinance Amending Section 800:45 of the 1974 Ordi- nance Code of the City of Hutchinson, Entitled Hours of Sale. (b) ORDINANCE NO. 16/80 - ORDINANCE AMENDING SECTION 805:00 (XIII) OF THE 1974 ORDINANCE CODE OF THE CITY OF HUTCHINSON, ENTITLED INTOXICATING LIQUOR Following discussion, Alderman Lueneburg moved to waive the second reading and adopt Ordinance No. 605 entitled Ordinance Amending Section 805:00 (XIII) of the 1974.Ordinance Code of the City of Hutchinson, Entitled Intoxicating Liquor. The motion was seconded by Alderman Peterson and unanimously carried. UNFINISHED BUSINESS (a) CONSIDERATION OF REQUEST BY HUTCHINSON ELKS LODGE FOR "ON SALE" NON -INTOXICATING MALT LIQUOR LICENSE AND PERMISSION TO BLOCK OFF RIVER ROAD (DEFERRED 7-8-80) Alderman Peterson reported he had been contacted by someone from the Elks Lodge regarding the above stated request. Following. discussion, the motion was made by Alderman Gruenhagen to approve the issuance of an "On Sale" Non -Intoxicating Malt Liquot License and accept the recommendation from the Police Chief that snowfencing be used to close in the park area. Seconded by Alderman Peterson, the motion unanimously carried. (b) JUNE REDMAN'S CONDITIONAL USE PERMIT REQUEST REFERRED BACK TO PLANNING COMMISSION BY CITY COUNCIL (DEFERRED JUNE 24, 1980) City Administrator Plotz stated the request for a circle driveway had been referred back to the Planning Commission. It was their recommendation to amend the original recommendation, with the following stipulations: a) No off street parking in front setback, b) Garage be moved as far north as pos- sible, c) No business sign be permitted unless attached to main building, d) applicant provide installation of 6" high concrete curbing surrounding a mini- mum of green area of 20' x 30' and this not to be used as part of the off street parking, and e) "No Parking in Circle Drive" signs be posted in drive- way. -3- COUNCIL MINUTES JULY 22, 1980 After discussion, it was moved by Alderman Gruenhagen to waive reading and adopt Resolution No. 6557 entitled Resolution Granting Conditional Use Permit Under Section 6.07, C.5 of Zoning Ordinance No. 464 to Allow Utilization of Present Structure for Residence and Real Estate Office and Relocate Existing Garage, contingent on aforementioned stipulations of Planning Commission. The motion was seconded by Alderman Beatty and carried unanimously. 9. NEW BUSINESS (a) CONSIDERATION OF MOTOROLA SERVICE CONTRACT FOR RADIO EQUIPMENT MAINTENANCE IN POLICE DEPARTMENT U Chief of Police O'Borsky presented a Service Agreement with Motorola for ain- tenance of radio equipment in the Police Department. The contract would be effective July 1, 1980, with no increase.in price over the present contract. Following discussion, the motion was Alderman Gruenhagen and unanimously with Motorola. made by Alderman Lueneburg, seconded by carried, to approve the Service Agreaent (b) CONSIDERATION OF DELINQUENT WATER AND SEWER ACCOUNTS A copy of the letter sent to all -delinquent account holders was read by Mayor Westlund.-- He then inquired if there was anyone present wishing to be heard regarding his/her account. No one responded. After discussion, Alderman Gruenhagen moved to discontinue service on Monday, July 28, 1980 at noon for the following accounts if unpaid by that date, with the exception of account No. 02-0280-1-00 to be paid August 1, 1980: 01-0660-1-00; 02-0125-0-00, 02-0575-2-00, 04-0675-0-00, 05-0765-2-00, 07-0355-3-00, 07-0870- 0-00, 07-0880-6-00, 07-0935-2-00, 12-1015-2-00, 12-1037-0-00, 16-0435-0-00, 25- 0140-2-00, 42-0070-1-00, 10-0475-7-00, and 40-0217-0-00. Secdnded by Alderman Lueneburg, the motion carried unanimously. (c) CONSIDERATION OF ADVERTISING FOR BIDS ON HOSPITAL PARKING LOTS Administrator Graves reported on the need for resurfacing two parking lots at the hospital. The bituminous surfacing in the Medical Office Building park- ing lot will have to be replaced with concrete because of ground water prob- lems. The south employee parking lot and regular visitor's parking lot need a one inch coat of bituminous surfacing. Also, Mr. Graves requested permis- sion to inform the design architectural firm of Horty, Elving, and Associates of the hospital's dissatisfaction with the life of the bituminous surfacing of the Medical Office Building parking lot. Following discussion, it was moved by Alderman Gruenhagen to approve adver- tising for bids for additional concrete surfacing in the Medical Office Build- ing parking lot in the approximate amount of $14,500, with bids to be opened at 2:00 P.M. on August 12, 1980. Seconded by Alderman Beatty, the motion unani- mously carried. -4- ti COUNCIL MINUTES JULY 22, 1980 It was moved by Alderman Gruenhagen, seconded by Alderman Beatty and carried unanimously, to approve the services of Preferred Paving of Young America to put on the one inch bituminous coat on the south employee parking lot and the regular visitors parking lot in the amount of $8,800. (d) CONSIDERATION OF GROUP HEALTH AND BENEFIT RENEWALS The group health and benefit insurance policies will expire August 1, 1980. It was the recommendation of the City Accountant to approve the proposals re- ceived from the present carriers and sign the appropriate contracts. After discussion, Alderman Gruenhagen moved to approve the group health and benefit renewals and authorize signing the contracts. The motion was seconded by Alderman Beatty and carried unanimously. (e) CONSIDERATION OF ADDITIONAL SUMMER EMPLOYEES FOR FORESTRY The City Forester requested three additional summer employees for_.the tree in- jection program. The Department of Natural Resources has funds available to reimburse wages for people to help with tree injections. -It vias, therefore, recommended that Barbara Rossing, Russell Willard and Eric Skeie be employed as summer employees. Alderman Beatty moved to approve the employment of the three above-named in- dividuals. Seconded by Alderman Lueneburg, the motion unanimously carried. (f) CONSIDERATION OF REQUEST FOR CONDITIONAL USE PERMIT SUBMITTED BY THE BIG C (CHARLES BOETTCHER) WITH FAVORABLE RECOMMENDATION OF PLANNING COMMISSION, WITH CONTINGENCY The City Administrator reported that The Big C had requested a Conditional Use Permit to allow a 12' x 42' addition to an existing building in an IC -1 zone. The Planning Commission recommended approval, with the condition that parking regulations of the zoning ordinance be met and hard surfaced parking be provided. Following discussion, the motion was,.made by_..Alderman Lueneburg, seconded by Alderman Beatty and carried unanimously, to waive reading and adopt Resolution No. 6569 entitled Resolution Granting Conditional Use Permit Under Section 6.07, C.5 of Zoning Ordinance No. 464 to Allow 12' x 42' Addition to Existing Build- ing In IC -1 Zone. Seconded by Alderman Beatty, the motion unani- mously carried. A (h) CONSIDERATION OF REQUEST FOR VARIANCE SUBMITTED BY ERICKSONS DIVERSIFIED CORPORATION WITH FAVORABLE RECOMMENDATION OF PLANNING COMMISSION, WITH CONTINGENCY City Administrator Plotz reported a variance was necessary for a rear se,ack from 50 feet to 25 feet for a residential zone to allow the construction of a new service station building. After discussion, the motion was made by Alderman Beatty, seconded by Al( "-r- man Peterson and carried unanimously, to waive reading and adopt Resolut 5n No. 6571 entitled Resolution Granting Variance from Section 6.05, B.3 of the Zoning Ordinance No. 464 for Rear Setback from Residential Zone to Allow Con- struction of New Service Station Building, contingent upon parking requirements being met and the Fire Marshal inspection and approval. (i) CONSIDERATION OF REQUEST FOR CONDITIONAL USE PERMIT SUBMITTED BY CROW RIVER COUNTRY CLUB WITH FAVORABLE RECOMMENDATION OF PLANNING COMMISSION Following discussion, it was moved by Alderman Peterson to waive reading and adopt Resolution No. 6572 entitled Resolution Granting Conditional Use Permit Under Section 6.07, C.5 of Zoning Ordinance No. 464 to Allow Construction of Detached Club House Facility In R-1 District. The motion was seconded by Ald- erman Beatty and unanimously carried. (j) CONSIDERATION OF REQUEST FOR CONDITIONAL USE PERMIT SUBMITTED BY 3M COMPANY WITH FAVORABLE RECOMMENDATION OF PLANNING COMMISSION City Administrator Plotz reported the 3M Company needed a Conditional Use Per- mit to allow the installation of two underground solvent storage tanks; one with a 20,000 gallon capacity and one with a 13,000 gallon capacity. It was the recommendation of the Planning Commission to approve the Conditional Use Permit, subject to inspection and approval by the Fire Marshal. After discussion, Alderman Beatty moved to waive reading and adopt Resolution No. 6573 entitled Resolution Granting Conditional Use Permit Under Section 6.07, C.5 of Zoning Ordinance No. 464 to Allow Installation of Two Underground Sol- vent Storage Tanks. Seconded by Alderman Gruenhagen, the motion unanimously carried. (k) CONSIDERATION OF REQUEST BY RONALD W. BURANDT TO MOVE MOBILE HOME ENTRANCE M COUNCIL MINUTES JULY 22, 1980 Mr. Ronald W. Burandt requested permission to move a 12' x 14' mobile home entrance addition from the rural area to Lot 19, McDonald's Lakeview Park. The Building Official Willardrecommendedapproval, subject to four stipu- lations. Following discussion, it was moved by Alderman Beatty, seconded by Alderman Gruenhagen and carried unanimously, to approve moving the mobile home entrance. (1) CONSIDERATION OF REPAIR OF DECKING AND STEPS OF BAND STAND Two bids were received to repair the decking and steps of the band stand in Library Square. It was recommended to accept the low bid from Betker Con- struction Inc. in the amount of $942.00. After discussion, the motion was made by Alderman Lueneburg to award the bid for repairs to Betker Construction Inc. in the amount of $942.00. Seconded by Alderman Gruenhagen, the motion unanimously carried. 10. MISCELLANEOUS (a) COMMUNICATIONS FROM CITY ADMINISTRATOR City Administrator Plotz commented he had received a telephone call from a representative of Plaza 15 stating there will be a Farm Produce Sale on Aug- ust 9, 1980 at Plaza 15.. No permit would be required. On July 17, 1980 the bond closing for $900,000 was held. Now the City can proceed with the improvement projects. Messrs. Merrill and Plotz attended a meeting on Wednesday, July 21, regarding city parking assessments. They have prepared a formula for parking assessments which is ready for presentation to the Council. The Council members were reminded of up -coming meetings scheduled for Thursday, July 23, 1980. (b) COMMUNICATIONS FROM CHAMBER OF COMMERCE The Chamber. -of Commerce requested permission to extend the band concert series for an additional Thursday night, _namely August 14, 1980, and to use the Li- brary Square for said concert. It was moved by Alderman Gruenhagen, seconded by Alderman Peterson and car- ried unanimously, to grant the request for use of Library Square on August 14, 1980 for a band concert. (c) COMMUNICATIONS FROM CITY ATTORNEY SCHANTZEN The legal opinion of the City Attorney was sought regarding whether the City -7- COUNCIL MINUTES JULY 229 1980 could hold a referendum on a Fire Station only in the amount of $900,000 be- fore waiting a period of one year. City Attorney Schantzen stated a.referendum for a Fire Station only could be held prior to a one year waiting period. (d) COMMUNICATIONS FROM THE MAYOR Mayor Westlund reported Paul Berg had resigned from the Library Board, and he asked for Council ratification to appoint Paul Barcenas to complete the unex- pired term. It was moved by Alderman Lueneburg, seconded by Alderman Beatty and unaniaously carried, to ratify -the appointment of Paul Barcenas to the Library Board„;; (e) COMMUNICATIONS FROM MARK JOHNSON Mark Johnson appeared before the Council to complain about noise in Library Square that continues until early hours in the morning. He stated he lived across the street from the Library Square and wondered if something could be done about it. Mayor Westlund concurred with Mr. Johnson that the noise needed to be con- trolled, and the Police Department would be notified of the problem. 11. CLAIMS, APPROPRIATIONS AND CONTRACT PAYMENTS _ (a) VERIFIED CLAIMS It was moved by Alderman Lueneburg, seconded by Alderman Beatty and carried unanimously, to approve the verified claims and authorize payment from the appropriate funds. A statement from Korngiebel Architects in the amount of $3,622 was submitted for payment to cover architectural fees for the design of the Police/Fire Sta- tion. Following discussion, it was moved by Alderman Gruenhagen, seconded by Alder- man Beatty and carried unanimously, to approve payment to Korngiebel Archi- tects. 12. Christmas Decorations Clarice Coston, Chamber of Commerce Executive Vice President, presented a drawing of the proposed decorations for the Plaza 15 area. She suggested taking the "Happy Holidays" sign out to the Plaza, which would eliminate the need for an additional banner to match for the downtown area. It was further suggested to eliminate the decoration on Main Street by the churches and add decorations by School Road Bridge and Plaza 15. Mr. Lyle Koehler, representative for Plaza 15, stated the shopping center would be agreeable to purchasing the•Christmas tree decorations -for the four -poles on private property if the City would furnish the decorations on the Plaza 15 sign. However, the poles would need'to be wired for 110 voltage. City Administrator Plotz reported the proposed Christmas decorations were over budget, but he thought the money would be available to cover the cost. After discussion, the motion was made by Alderman Gruenhagen to authorize the pur- chase of the proposed Christmas decorations, not to exceed $2,500, contingent upon Plaza 15 having 110 voltage on the four poles. The motion was seconded by Alderman Lueneburg and carried unanimously. Request to Move Building Building Official Willard reported that Roger Bakken is purchasing the house located at 25 Second Avenue Northeast which belongs to Joe Anglin. Mr. Bakken has requested. to move the house to a new location at Lot 5, Merrill's Subdivision - Lynn Addition. In order for the house to meet Building Code, there are 13 items that need to.be.-.cor- rected. Following discussion, Alderman Peterson moved to approve the request to move a house, with the stipulations indicated by the Building Official. The motion was seconded by Alderman Lueneburg and unanimously carried. COUNCIL MINUTES JULY 31, 1980 Joe Anglin Property City Administrator Plotz stated that the original Purchase Agreement with Joe Anglin, dated January 22, 1980, gave him salvage rights of the buildings on the property pur- chased by the City for park land (service station and house at 25 Second Avenue NE) until September 1, 1980. A new Agreement has been drawn up, changing the -possession date by the City of Hutchinson to October 1, 1980. Mr. Anglin had inquired if the basement should be filled in after the house is moved from the lot. He would not remove the foundation but put fill in the hole. Mr. Plotz thought the foundation should be removed at the same time the City did other work in the area. The City Council concurred that the foundation should not be covered over. Request for "On Sale" Non -Intoxicating Malt Liquor License :rz, zN1 The Hutchinson Elks Lodge requested an "On Sale" Non -Intoxicating Malt Liquor Li*ense for a fast pitch tournament to be held August 9-10, 1980. MINUTES SPECIAL MEETING - HUTCHINSON CITY COUNCIL FRIDAY, AUGUST 8, 1980 Vice -Mayor Ken Gruenhagen called the special meeting to order at 8:30 A.M., with the following members present: Aldermen Ted Beatty, Milt Lueneburg, and Bruce Peterson in addition to Vice -Mayor Gruenhagen. Absent: Mayor Westlund. Also present were City Administrator Gary Plotz and City Attorney Schantzen. Mr. Schantzen explained he requested this meeting to request the City Council to authorize Mayor Ralph Westlund to act on behalf of the Council at the trial concerning the bridge lawsuit which will begin on Monday morning at Glencoe. He stated he felt it would be easier dealing with one member rather than all of the council. He explained Krueger was the contractor hired and he sublet the surfacing portion to Glenwood Bridge. The City received 13 claims filed on people who hadn't been paid. These were, however, all paid except Glenwood Bridge which had a contract with Krueger for $30,000 to be withheld. We then refiled a claim for $68,000 less the hold back claiming the job was insufficient. The engineers decided the deterioration was increasing so the claim went to $146,000 since it had not been done correctly to begin with. In the meantime Krueger is no longer in business. City Attorney Schantzen also commented all members of the Council were welcome to come to the trial. Alderman Milt Lueneburg made the motion to authorize Mayor Ralph Westlund to act as sole representative of the entire City Council of -City of Hutch- inson at the trial. Seconded by Alderman Bruce Peterson, the motion unani- mously carried. City Administrator Gary Plotz updated the council on the Senior Citizens high rise. He stated he had met with the Minn. Housing Finance Agency and if the developer can get all the drawings and bidding done by Sept. 15th the project will began by fall. If this is done, the interest rate will be 7 1/2% but if the project waits until spring, the rate of interest will be 9 3/4%. He went on to explain a conditional use permit will be needed as well as a vacation of an alley. These would require two readings before the council. Alderman Bruce Peterson commented he had received a call from the township inquiring the city's position on burning at the city tree dump. Mr. Plotz explained there had been a fire out there in which some chips had started but it has been taken care of. He also informed the Council the City has a burning permit issued by the State. OlBorskv_ Chief of Pnlire DATE August 6, 1980 SUBJECT: Purchase of Patrol Vehicle I request that the Council authorize the Police Department to purchase a patrol vehicle in 1980 to replace one of the Plymouth Volares, both of which are now receiving an inordinate amount of repair and down time and will require replacement as soon as possible. We budgeted in 1980 for two police vehiclds to the total amount of $11,000. We purchased one vehicle in 1980 which was the Buick LeSabre at a total cost of $7,300. The total cost was greater than anticipated because there was no trade in, as we transferred the 1976 Chevrolet Nova to the Engineering Department. Because of this fact that only leaves us $3,700 in the vehicle budget for 1980. We have received price quotes from various dealerships in the City of Hutchinson and feel that we can purchase a satisfactory police package vehicle for approximately $5,900 which includes the trade in of the Plymouth Volare. This means that we will need $2,200 -in addition to the $3,700 that we have remaining in our vehicle budget. I therefore would request that $2,200 be transferred from the contingency fund to the vehicle purchase fund to make up for the deficiency which was created by the lack of a trade when we purchased the first vehicle in 1980. I have discussed this matter with the City.Accountant and he feels that this is an equitable solution to the problem. I should also advise you that we have had conversations with Ralph Neumann and intend to join the recently formed Motor Pool and _intend to replace our-�.- vehicles in the future through the Motor Pool System which I feel is a much better method of operation and could allow us to more efficiently replace our vehicles in the future. The replacement of the vehicle before the first of the year is a necessity, as we feel that we are going to have increasing problems with the Volares,and feel that their replacement should be done as quickly as possible to save the expenditure of more funds for maintenance and repair, as well as the lack of availability of the vehicles as they are placed out of service for several days at a time during the month. Members present were: Roy Johnsen, Jerry Brown, Mrs. Axel Jensen, Mark Schnobrich, Ivan Larson. Old Business A status report on the condition of the Swanke trees and those received from the DNR was reported by Mark Schnobrich. He stated survival rate was greater than 75%, which was quite exceptable. He commented that the tree retrieval from North Dakota by the Country Club were not surviving as well -as those gotten by city crews. New Business Jerry Brown suggested that Pin Oak, Red Maple, Red Oak be deleted from the desired street tree species listing in the City Tree Ordinance. Discussion on those trees suggested our soils were to alkaline for the Pin and Red Oaks. Agreement was made to -include Blue Ash to the sug- gested tree list and place it in the large tree catagory. Board agreed. Jerry Brown suggested that regulations governing tree species selection for public property be applied to private property also. Roy Johnsen suggested that the city make a public request that property owners only plant our suggested tree spp. It was agreed upon by the Board. Roy Johnsen suggested that value of trees damaged by vandals etc., be based upon the current --market value for a replacement tree. Board agreed. Jerry Brown suggested we consult the University Extension office about a bulletin available through them -on new construction and tree damage associated with it, after reviewing, make our own recommendation on construction and tree damage. Also, make_ it mandatory for all new subdivisions, in wooded areas, that they must first consult the city forestry before construction begins. Ivan Larson stated that utilities now have five feet of utility right- of-way in new construction areas for the placement of utilities. Ivan suggested we expand that officially t. ten feet of right-of-way, thus allowing greater area with which to work around trees. Board agreed upon adopting an official comprehesive Master Tree Plan. Upon completion of DNR Tree Inventory, goals can than be better estab- lished. Board approved and recommends that a storm tree damage and brush policy be as follows: Upon completion of a wind, hail, snow, or any other natural occurance, where trees and limbs have been lost due to those effects, be it the policy of the City of Hutchinson, that within two days of such a natural occurance the home owner shall place that portion of debris lost from his/her trees on the boulevard, in such a pile as is easily seen and excessable by city crews, the city will, to the best of their ability and as time allows, pick up this debris for the property owner. June 17, 1980 Each debris owner must, whtin two days, notify the city of the presence of such debris, either by phone or personal notification, at City Hall, before such debris shall be removed. Only storm damage material will be removed by the city. It is not, and henceforth shall cease to be, the policy of the City of Hutchinson to remove private trimmings from personal. property. Storm damage material shall be the only material eligable for this service. Proposed June 17, 1980 Hutchinson City Tree Board The Board discussed the problem of tall hedges and visual problems at intersections., Glen Engwail residing at 506 Jurgens Road was -brought to the attention of the board and it was agreed upon that Mr. Engwall be notified to lower his hedge to regulated height. Ivan Larson recommended the City Council give formal recognition to the people who volunteered to retrieve the Swanke donated trees. Board Agreed. The Tree Board adjourned the meeting at 8:30 p.m. After adjourning, the council was transported by Jerry Brown to various locations around town to observe,first hand, some improper planting: and make suggestions on ground cover and additional plantings. Tom Stibal reported he had contacted Tony Fratzke to ride on the Surrey in the water carnival parade. It was learned he could not be present. It was then decided_to ask Mr. and Mrs. Ralph Berry to ride -along with Tom Stibal and driver, Mr. Barrick. Bruce Ericson suggested the Recreation Department combine a unit with the Surrey. He suggested that youngsters from Recreation Department toss out Frisbees to be furnished by Fabricare. Don Falconer made a motion to order 5 gross of Frisbees. Tom Stibal seconded the.motion, carried. - Bruce Ericson offered help from Recreation Department to assist with Bunco and Bingo games if necessary. Motion by Tom Stibal to adjourn, carried. Tom Stibal reported on the parade situation during water carnival, as it concerned the Senior Citizens taking part in the parade and their being placed near the end and having to wait in the heat so long.. Steve Jensen reported on hiking and destination points of interest such as tours of HAVTI, 3M and Harris Pine Mills. It was decided to host a "corn picnic" for all Hutchinson Seniors at a local park on Monday, August 11, 1980. Jo Ann Gehlen assigned each member of the Board to appear -on an inter- view with her on the Monday "Silver Threads Program", aired on KDUZt each Monday at 2:50 P.M., and that each one bring a guest along. Park & Recreation Board -June 4, 1980 The Park & Recreation Board met with Dr. Chernausek, Don Falconer, Kathy McGraw, Ward Haugen, and Roy Johnsen present. Also present were Fred Roberts, Bruce Ericson, Steve Jensen, Sherry Crawford and Grace Sanstead present. Dr. Chernausek opened the meeting with the reading of the May meeting which was approved by Don Falconer, seconded by Roy Johnsen, and passed by the Board. Fred gave his report, the new Park Shelter has been put up at Legion Park. More summer help will be added soon. Fred also reported Carnival people in the West Park which he will see are out of there. He reported the Park is being used a lot. Mr. Daggett, whose term is up in August wishes to be replaced. Mr. Haugen suggested delaying action till next month as the Arena Board is to be combined with the Park & Recreation Board. Mr. Haugen made a motion to accept Fred's report seconded by Kathy McGraw, and accepted by the Board. Bruce Ericson. gave his report, listing the number of registrations for the summer program which begins June 9th. The City Council has okayed the Archeological survey ' at McDonald's Park altho the final contract has not been granted. Some additional personnel for supervision thru C.E.T.A. looks favorable. The Youth Hockey program at Linden looks favorable for fall tho temporary till the Master Plan is completed. All swimming instructors hired from Hutchinson have been hired. Ward Haugen approved Mr. Ericson's report, seconded by Don Falconer, and approved by the Board. The Federal Adminstration_has requested that 110 million -in -the fiscal year 1980 Park Preservation Grant funds be rescinded which results in a halt to all (Lawcon) programs.as of March 8th. Bruce requested the Council approval of the (Lawcon) funding because it would be putting a freeze on all state matching funds, administered thru the Legislative commision on Minnesota Resources for Park projects including McDonald's Park which would put it beyond the construction season in Minnesota. Roy Johnsen made a motion to release the 1980 funds. Seconded by Don Falconer, accepted by the Board with the exception of Ward Haugen who gave a "nay" vote to the motion for asking for the release of the approximate $65,000 ahead of time which has already been approved by the Council May 27th, 1980. Fred asked for a load of rock and two satellites at Tartan Park w1cih the Budget should cover. The Ball players at the High School complain of poor lighting at the Tennis Courts and Kathy asked Fred to check the lights at the Elementary School. Bruce Ericson brought up a program he favors for fund raising for youth activities, he said free programs do not work. People sign up and do not show up. His idea is for a civic organization assisted by the Recreation Dept. to be held in August with interested youngsters in Recreational programs. The Civic group turning the money over to the City keeping the accumulated interest, the list of participants and how much they had made. The Recreation Dept. deducting registration costs for those participating in the fund raising according to what they contributed. The Board questioned the work involved in keeping records and Bruce was told to look into it further. A motion was made at 1:30 to adjourn by Mr.,Haugen, seconded by Roy Johnsen and adjourned by Dr. Chernausek. The next meeting at noon on July 2nd. Respectfully submitted, Grace Sanstead, Secy MINUTES Park and Recreation Board July 2, 1980 The Park and Recreation Board met with "Bud" Daggett, Dr. Chernausek, Don Falconer, Roy Johnsen, and Ward Haugen present, Also present were Fred Roberts, Bruce Ericson, Cliff Paulsen, Steve Jensen, Penny Klitzke, Mark Schnobrich, Sherry Crawford and Grace Sanstead, Secretary. The June minutes were read and approved by Mr. Daggett. John Zwagerman, representing the Lion's Club, was introduced by Mr. Daggett. He told the Board that the Lion's Club wishes to raise some money and contribute to some park project. He named the Civic Arena park area specifically. Mr. Daggett told him they would welcome them coming to some park project, and while they could not name any park for them, some recognition would be made for their contribution. However, at this time as Bruce Ericson suggested the Comprehensive Guide Plan for the city is not completed and suggested the $1500 score board for McDonald's Park might be a consideration. Fred Roberts gave his report and said more benches and a drinking fountain are needed in the Pub.lic.Square, which they have the money for, a new cement floor is also needed in the bandstand, Satellites at Tarton Park have been added. Mr, Daggett thanked Fred for his work as assis- tant director of Public Works, as this was Fred's last meeting in that capacity due to city organizational changes. Bruce Ericson gave his report. The recreation column in the Leader has been changed to read "Parks, Recreation and Forestry," The new secretary will be Karen Stafford of Hutchinson, replacing Penny Klitzke, who will be replacing Steve Jensen as Recreation Co-ordinator, Mary Haugen of Fargo, N.D. will be Civic Arena Co-ordinator beginning August 4th. Karen beginning July 7th. The Arena Board has been dissolved by the Council. The State Natural Resources Fund Project agreement for develpment of McDonald's Park has been received, the city will receive $65,000 in state funds, $40,000 to allocated by the city this year. Bruce reported the Optimists will take on the youth program and supervise the kids. Dr. Chernausek made a motion to accept the reports of Fred Roberts and Bruce Ericson, seconded by Ward Haugen and approved by the Board. Steve Jensen was presented a plaque by Mr. Daggett from the City Council for his two years as Co-ordinator of Recreation. Mr. Daggett, who is retiring from the Board after serving nine years, will be replaced by Dr. Chernausek, Mr. Falconer making the motion, seconded by Mr. Daggett, and "aye" vote by the Board. Mr. Falconer asked to see if his term on the Board is expiring. Bruce reported the Council passed a motion to block off the West River Road, west of the sanctuary. There being no further business the meeting was adjourned by Mr. Daggett at 1:15 p.m., the next meeting to be held at noon on August 6. I feel that each firm had their strong points in various areas. Since we are dealing with a park master plan, which has been designated a regional park by the State Planning Agency, I am recommending the services of Saunders-Thalden & Associates, Inc. for the following reasons: A. Park Master Planning is their major field of work. B. I feel confident that through their construction management, that they will see the project all the way through. C. I agree with their planning processes, which are: 1. Analyze. 2. Develop a concept. 3. Check responses which lead to the details of the master plan. D. And they will work with the City to develop the plans, rather than design the plans for the City. I feel that with all the park acreage presently undeveloped in Hutchinson, that the services of a professional landscape architect would greatly enhance the development of these parks, and provide the necessary plans and guildlines for future devel- opment. Your File Number: 80-H-34 Our File Number: '2859 Dear Mr. Plotz: Your letter of July 2, 1980 has been referred to this -office for reply as we have been retained by the Forum Insurance Company to represent its interests in the above -captioned matter. When the Developers Diversified, Ltd. suit was filed on January 30, 1980 and shortly thereafter served upon the -City, notice of claim was given to the Forum by a letter from Madsen Agency, Inc. on February 4, 1980. The Madsen letter in turn was apparently prompted by a letter to Madsen from Mr. Schantzen on February 1, 1980, which stated: "Please submit this to Forum Insurance Company . . . for submission of a defense pursuant to the City of Hutchinson's public officials liability policy." As a result of the request on behalf of the City, Forum retained Messrs. Popham, Haik, Schnobrich, Kaufman & Doty, Ltd. of Minneapolis to defend the City and the individual defendants. Messrs. Popham, Haik immediately undertook the defense of the City and the individual defendants and continued that defense through trial and the ultimate settlement. The Forum Insurance Company later confirmed in writing the defense arrangements which-, had been established and reserved certain rights under its policy,,, At no time has Forum Insurance Company retained the firm of f eefe & Schantzen. Indeed, it is our understanding that Keefe & chantzen provided legal services to the City which they have illed as a result of their representing the City's uninsured nterests in the lawsuit as the claim against the City was in xcess of the limits of the Forum policy. We further understand hat Mr. Schantzen had previoulsy advised Messrs. Popham, Haik hat this was his function. Accordingly, the Forum Insurance mpany hereby declines payment of Keefe & Schantzen's statement. As you are aware, the Forum has also received a letter from Mr. Schantzen dated April 2, 1980 forwarding a statement from Messrs. Briggs & Morgan. Again, Briggs & Morgan was not retained by the Forum Insurance Company, and the Forum Insurance Company also declines to make payment of this statement. There has been considerable contact between Fred Roberts, Ralph Newman and myself in order to gather information and prepare for this change which was effective July 1st. One of the main problems is radio contact from the office to trucks, however, we should have a base station installed and operating soon. Another change which has been made is that the phone number at the arena has 'been changed. The new number is 587-4279. The reason for this is with a 587 number the phone can be coded in to ring at our office when there is no one available at the arena. This is extremely helpful during the summer months and ' at certain times during the winter. In addition, this also allows the arena to use our answering service after hours. You will notice that we have changed the Recreation Column in the Leader to "Parks, Recreation and Forestry" and plan to incorporate various articles of information in each area. We have included the Parks, Recreation and Forestry phone number and the Civic Arena number in the new heading. We received the contract for the McDonalds Park project and are now in the process of taking bids from Landscape Architects for the Park Master Plan. We hope to complete the. grading of the park and get the building installed this year.. The Archeologicial Survey should be completed in about two weeks. - The summer programs seem to be going well. We are now using regulation Little League Baseballs for practice only for T -Ball, however, we are still using a -rubber ball for games. The swimming pool was not in operation for three days this session which caused many participants to miss lessons, however, we cancelled a number of open swims and used Saturday to complete this set of swimming lessons. We also let anyone transfer who would rather return another session due to the inconvenience of the make-up scheduling. Resp_ fully submitted, ruce Ericson Recreation Department �f' REPOki OF THE PARKS & RECREATION DEPARTMENT for the Month of July, 1980 FOR YOUR INFORMATION We are currently in the process of winding up the summer programs, with youth programs ending August 1, and the softball leagues to end during this month. We are also preparing the brochure for fall and winter, and are trying to include as many independent organizations as possible, along with our usual information. This coming weekend we will be hosting the Men's Class "B" District Fast -Pitch Tournament, and August 23 & 24 the Elks will host their Men's Slo-Pitch tournament. We have also been working with the Cokato Roller Rink, and have established three roller skating nights at the Civic Arena. They provide the music, supervision on the skating floor, and skate rentals, which include 350 pair of roller skates. If we get a good turn out at these events, they have indicated that they would be interested in providing the same services throughout next summer. We have initiated our fund raising program for Youth Activities. We have also increased our press coverage by placing our information in the Shoppers Guide. McDonalds Park has been staked, except for the fill that has been dumped on the park. We have received the final, signed copy of the grant and work should begin this month. Following the storm of Sunday night, August 3, it has taken our Maintenance Department three days to pick up all the broken tree limbs and brush etc, We have also completed the grading at Linden Park for the temporary hockey rink. We have repaired the fences at Riverside and Tartan Parks. Due to the dry weather during July we have had to spend more time to water trees and shrubs, and have occasionally watered the ball fields. The grindings from the new bridge have been dumped on the camp- ground Road in an attempt to keep the dust down in the area. Two new members have been appointed to the Advisory Council, both being from our region. (Carol Conradi from the Rice Hospital Library and Nancy Olson from the Willmar Public School Library system.) Kathy Matson has been nominated for re -election -- to this Board. Computer -Based Catalog Study Grant: The directors of the regional systems involved met and drafted specifications for bids. These will be mailed to interested bidders and are scheduled to be opened on September 22. The Minnesota Humanities Commission approved our application to have Mr. Bruce Hanks of Milaca present the program "Lincoln Speaks Today," and awarded a grant of $496.00 to CRRL system for this. 80% of the grant will be received after they have received our signed agreement. This project must be completed by September 30. Six locations have been selected for this program and a contract has been sent to Mr. Hanks. Several tentative dates are being considered. LSCA Grant for Adult Illiteracy: Kathy Matson met with Jean Hammick of the Minnesota Literacy Council to discuss ways in which they could cooperate with us on this j project. } Kathy Matson presented the highlights of her trip to the ALA Conference in New } York City. She felt it was an excellent conference. Continuing Education Workshop: Kathy Matson and Martin Swalboski attended this in St. Paul. The group wrote a program which will be put on the Plato system in October. Unfinished Business: None New Business: a. Investment of Amortization Funds: Five of our CD's matured in June and need to be reinvested. Types of accounts and names of banks for deposit were discussed. The mortgage underwriting process normally takes between five and eleven months from the time of selection until construction can begin.
