Monthly Meeting.
The Hutchinson Utilities Commission of the City of Hutchinson met at the
Utilities Billing office on February 8, 1965.
All Commissioners were present; also Supt. Kuiken.
Quotations f or a ditching machine were received from the following

Commissioner Tracy made a motion to accept the lowest bid, that being
from Burkhardt -Larsen Compar7. The motion was seconded by Commissioner
Quads and unanimously carried.

The following opinion has been given/to the Hutchinson Utilities
Commission regarding the legality of extending natural gas service
outside the City Limits of the City of Hutchinson:
1. That neither the provisions of the Home Rule City
Charter of the City of Hutchinson and its amendments
nor the applicable statutes of the State of Minnesota
have the effect of limiting the distribution of
natural gas by the Hutchinson Utilities Commission
to tre City Lirr_its of the City of Hutchinson.
2. That Section 453.04 of the statutes of the State of
Minnesota as cited in Minnesota Statutes annotated,
Section 453.04 and the opinions of the Attorney General
of the State of Minnesota cited thereunder, as well as
the past interpretations and exercise of the general
purposes of the Utilities Commission., establish that
the Utilities Commission has the full, absolute and
exclusive control over the electric and gas distrib-
ution and may go beyond the City Limits of the City
of Hutchinson if such extension is reasonably feasible
and wi 11 ultimately provide a benefit by way of a re-
turn on the investment required or may anticipate future
expansion of the City itself.
3. Extension of the distribution systems must be done only
after receiving the permission and authority of the
governing body having jurisdiction over the area into
which the extension is made if under the law such
permission and authority is required.

The following is a Resolution permitting the Hutchinson Utilities
Commission to lay and install natural gas mains and distribution
lines in Acoma Township:
R E 0 0 L U T 1 0 N
"RESOLVED.. That upon request of land owners and taxpayers in
Acoma Township, McLeod County, Minnesota, and upon request and agreemdAt
to abide by the terms of this Resolution by the Hutchinson Utilities
Commission, the Town Board of Acoma Townhip does hereby franchise,
authorize and permit the Hutchinson Utilities Commission of the
City of Hutchinson, Minnesota, to lay and install natural gas
mains, distribution lines and a distribution system and to place
such gas mains and distribution system along township roads and
other township lands in Acoma. Township with all construction,
maintenance, installation and inspection costs to be borne by
Hutchinson Utilities Commission for the purpose of serving users
of natural gas in Acoma Township on condition that Hutchinson
Utilities Commission lay and install, and as necessary, maintain,
repair arA replace such gas mains and gas distribution system
so as to do as little damage as possible to the property through
which it passes and to replace and resurface the area through
which the main passes with the same surface as existed prior to
the installation, .repair or replacement of the main all to be
done at the expense of the Hutchinson Utilities Commission and
on the further condition that the Hutchinson Utilities Commission
prepare in detail a map or plan showing the location of all mains
.installed and showing the location of any tie -ins or taps into
the main and the position of any distribution lines leading away
from the main to the various users and to furnish a copy of said

plan, plat or map to the Clerk of the Acoma Town Board and from
time to time to amend the map or plat to bring it up- todate.
Such franchise, authority and permit is to be issued to the
Hutchinson Utilities Commission for which the Hutchinson Utilities
Commission shall pay to Acoma Township the sum of One Dollar(41.00)
per year by the lst day of April of each year starting April 1,
1965, and with such authority continuing until April 1, 1970, at
which time the renewal of such franchise shall be reconsidered by
the Town Board of Acoma Township and renewed on such terms as the
parties shall agree.
