09-22-1960 HUCM29. SPECIAL MEETING September 22, 1960 The Hutchinson Utilities Commission of the City of Hutchinson, Minnesota, met at the office of Dr. R. I. Sheppard, President, on September 22, 1960. All members of the Commission were present. The following is a General Certificate of the City Clerk, to be spread on the face of the minutes, dated Sept. 22, 19601 STATE OF MINNESOTA) GENERAL CERTIFICATE COUNTY OF McLEOD } OF CITY CLERK CITY OF HU`?'Cr INSON ) I, the undersigned City Clerk of the City of Hutchinson, Minnesota, hereby certify as follows; 1. The City of Eutchinson is a duly incorporated city of the 4th Class, under a home rule charter adopted in 1913 and last amended in 1956, a true and correct copy of said charter and all amendments thereto to date being hereto attached. 2. Pursuant to Chapter 1? adopted as an amendment to said charter in September 1936, and as again amended on .April 26, 1955, the City of Hutchinson has created Hutchinson Utilities Commission of the City of Hutchinson, with control and management of the light plant, the light plant distribution system, the gas plant and the gas distribution system of the City of Hutchinson. 3• The following are members of the Hutchinson Utilities Commission, secretary and city treasurer, with the date their terms commenced and expire. 30. Jensen City Treasurer May 1960 May 1961 4• There are no special laws or statutes of the State of T,Zinnesota relating to or regulating the powers of the Corn- mission excepting Chapter 524 Session Laws of Minnesota, 1959) which provides as follows; "fin act to authorize the Hutchinson Utilities Commission of the City of Hutchinson to issue and sell revenue bonds to provide money to construct a city gas distribution system; +Re it enacted by the Legislature of the State of Minnesota; Section 1. "as distribution system. The Hutchinson Utilities Commission of the City of Hutchinson is hereby author- ized to issue and sell negotiable coupon revenue bonds in a total ar: ount not exceedinE_, '$650,000 in order to provide money to construct or otherwise acquire a city gas plant and dis- tribution system including the power to purchase gas, natural or otherwise, said bonds to be payable solely from the revenues from such gas distribution system, and to make the usual and necessary covenants for the security of said bonds and all pro -. ceedings heretofore taken by the said commission in the issuance and sale of such bonds are hereby validated. Sec. 2. This act shall be in full force and effect when approved by the governing body of said city. Approved April 24, 1959." 5. There is no litigation now pending questioning the organization of the City, the offices of the members of the utilities commission, or the right and power and authority of the said commission to issue w650,000 gas utility revenue bonds or to impose rates and charges for E,,-,as utility service or to provide funds for payment of said bonds.
