05-08-1979 HUCMMeeting May 8, 19 79 All Commissioners were present, also Mgr. Alexander, Counsel Peterson and Ruth.Hakel. The meeting was called to order at 2:00 p.m. by President Quade. On a motion by Commissioner Filk, seconded by Commissioner Tracy the minutes of the Regular Meeting of April 16, 1979 were accepted as presented. Mgr. Alexander presented a letter from Curtiss - Wright Corporation concerning the purchase order and the repair of the Rolls Royce Engine #9 Counsel Peterson discussed the Curtiss - Wright Corporation letter, concerning the purchase order issued by the Hutchinson Utilities authorizing #9 repair. He discussed the letter in general, covered the failure items and felt the Utilities was in technically good shape. He then recommended that we hire expert counsel and suggested Mr. Larry Zelle of the firm of Robins, Davis and Lyons of Minneapolis, M. After discussion, the Commission agreed that Mr. Larry Zelle should meet with Counsel Peterson, Mgr. Alexander and such members of the Commission that could attend. Mgr. Alexander reported that he is in close contact with John Nixon concerning the Curtiss - Wright engine repair. Counsel Peterson reported he is still working with Tom Polacek on insurance claims. Due to a delay in settlement, Commissioner Filk expressed concern regarding the amount of money involved and its effect on cash flow. Counsel Peterson presented a summary of his time spent on insurance claims and the Curtiss - Wright engine warranty. After discussion, the Commission felt we should pay for time spent on Curtiss - Wright up and above the retainer. Such work as insurance claims should be covered by the retainer. A motion was made by Commissioner Filk, seconded by Commissioner Tracy to pay Marley Cooling Tower in the amount of $31,253.40 leaving a 10% retention and to pay the Harold K. Scholz Company Estimate #4 in the amount of $65,000. 1 i] 1 Mgr. Alexander reported on the amount of deterioration in the old cooling tower. Bolts and footings have been repaired. Mgr. Alexander asked that the quarterly audits be dispensed with citing the savings at about $2,700 per quarter. The Commission agreed with the suggestion. Mgr. Alexander reported the outlook for natural gas for generation looked very good. Mgr. Alexander reported that progress was being made in figures to present to the Commission substantiating a rate increase, also cited that this was a recommendation from the auditors.
