Sheppard at 7;30 PM. All Commissioners were present. Bids were received by Arnel T. Erickson and Carl 0. F. Christen- sen for excavating the ground in preparation for Service Building on warehouse site. Bid of Arnel Erickson= Class A. Excavation Trees $ 15.00 Per Tree Stumps 10.00 Each Bid of Carl 0. F. Motion was made by Commissioner Kurth and seconded by Commissioner Thompson to accept the bid of Carl 0• F. Christensen. Motion was unanimously carried. The following is a copy of the contract* C O N T R A C T THIS AGREEMENT, made and entered into this day of April, 1962s by and between the Hutchinson Utilities Commission of the City of Hutchinson.* Hutchinson, Minnesota,a Municipal corporation, as parties of the first part, hereinafter called 294 (2 ")) Commission, and Carl 0. F. Christensen of Hutchinson, Minn- esota, party of the second part, hereinafter called Contractor. WITNESSETH$ Contractor agrees to furnish and supply the following equipment with qualified operator at the price per hour set forth opposite each item. of machinery to complete the excava- tion and removal of dirt and sloping of sides necessary to prepare the site for the construction of a garage building in Block Thirteen (13)y Tawnsit a of Hutchinson, North Half (NI-) as designated by the Engineer and duly authorized representa- tives of the Commission and agrees to furnish said equipment with operators on a full time basis as required until the con- tract is completed, said work to be started on April 9, 1962, or as soon thereafter as directed by Commission; Equipment to be furnished$ It yard dragline and operator $14.00 per hour 2 yard front end loader and operator 10.00 per hour 10 yard dump truck and operator 9.00 per hour D -8 bulldozer and operator 13.00 per hour In consideration of the rates paid on the above schedule, Contractor agrees to hold Commission harmless from any claims fcr bodily injury or property damage arising out of Contractor's 'work in completing this Contract and agrees to furnish Com- mission with a copy of an insurance policy or a certificate of insurance showing that Commission is protected for these haz- ards a rd risks. Contractor further agrees to carry Workmen's Compensation insurance on his operators and employees engaged or employed for work on this Contract and to in any other way hold Commission harmless from any and all claims that might be made against Commission for bodily injury or property damage to any person cr property whether an employee of con- tractor or property owned or in the custody of contractor. Included in the work to be done by Contractor shall be excavation to grade, gravel backfill, tree removal, salvage of wood and logs, removal and disposition of dirt and such other necessary tasks as may be required to complete the excavation and Contractor shall perform such undertaking in a workmanlike manner* Failure to provide the equipment and operator as requested and directed by Commission shall result in a penalty of twice the stated rate per hour for the period of any delay in fur- nishing said equipment and operat ar as liquidated damages for breach of this Contract by Contractor. Contractor further agrees to furnish the necessary public contractor bond in the amount of $2,500.00.
