Chairman Sheppard introduced the ratter of the International
Union of Operating Engineers, Local #49 claiming to represent certain
employees of the CorLmlssslcr- aid called upon D. 0. Comer., Attorney for
the Commission, who was also the Coirimissionts representative on the
Adjustrent and Arbitrat-J.or Panel-, to inform the Commission regarding
the proceedings. Mr. Comer gave a report of the activities of t1a
Minority Report,, the following Motion -t was made, seconded and unanimously.

THIS INDENTURE, made this day of , 19 , by

Hutchinson Utilities Commission of the City of Hutchinson, Minnesota, a
municipal corporation, party of the second part;
WITNESSETH:
That, for and in consideration of the sum of One Dollar and.other
good and valuable considerations in hand paid to the party - parties of
the first part by the party of the second part, the receipt and sufficiency
of which is hereby acknowledged, said party - parties of the first part
do hereby grant, bargain, sell, convey and warrant to the party of the
second part, its licensees, successors, and assigns, a perpetual right of
way and easement to construct, erect, install, operate, maintain, inspect
and alter and repair or replace, overhead or underground lines, pipes,
mains and other means and methods of transmitting for distributing electric
power and energy or natural gas, including transmission of gas through
underground gas mains over, through, across, in, on, along or under the
following described lands lying and being in the County of McLeod and
State of Minnesota, to -wit:
Four (4) feet on each side of a line described as:
Together with all rights of ingress and egress necessary for the
full and complete use, occupation, and enjoyment of the easement hereby
granted, and all rights and privileges incident thereto, including the
right from time to time to cut', trim, and remove trees, brush, overhanging
branches, roots and other obstructions which may injure or interfere with
the second party's use, occupation, or enjoyment of this easement and the
operation, maintenance, repair, alteration and replacement of second party's
transmission and distribution of electrical power and energy or gas, provided
that second party shall be responsible to first party - parties for any damage
that may be unnecessarily and unreasonably done to the property above described,
and to adjacent property of first parties.

It appeared that the reason that.the �Jnion accepted working conditions
as they exist for the employees of the Hutchinson Utilities Commission was that

these conditions appeared favorable after comparison witti comparable work in
surrounding cossounities.
A considerable issue was made by the Union representative on the Panel
of the method of determining the wages paid to employee• and the Union strongly

proposed and urged the placing of all employees of the 4tchinson Utilities

40d iaission in catagories,,. or boxes, or groups and then' i�p establishing a single
rate of 'for each and 'ever person in that articulatt�cata or or box. This

inconsistent, in defining what was in their boxes. As for example, a plant

mechanic in one plant would be paid substantially more than in another plant

and deeper investigation would then bring out facts such as the fact that
this plant might be a steam operation and the mechanic would be required to
have various licenses and be specifically trained in a particular field to
handle steam production of electricity while in another plant the plant
vachanic would have less responsibility. Likewise in a plant where the
plant mechanic was paid more than the average, it developed that this plant
mechanic or the plant mechanics in that plant were especially capable, qualified
A" responsible aad would not require supervision but were able to go ahead with
major jobs on their own. M examination of the wages paid by the Hutchinson
Utilities Cossnission to its employees developed certain facts among which would
ba the following:'
,. 1. That when the employees of the Hutchinson Util*t.ies Commission
were placed in categories or boxes, some of thsosn iu some of
the boxes were paid more than the average aad some of them were
`.' paid less than the average for somewhat sisdlar,i+ork in surrounding

communities.
2. In several instances, the employees of the Hutchinson Utilities

Commission were paid.more than the average and more than nearly
any similar employee in surrounding communities,
3. Fringe benefits or other working conditions, if they can be

termed thus, such as sick leave, holidays, vacations, hospitalization
and similar matters were also examined and it was found that employees
of the Hutchinson Utilities Coamission receive as good as or better
than the average employees in practically all of these fields.

It is my conclusion as a member of the Adjustment P4nel that:
1. The employees of the Hutchinson Utilities Commission receive the
average or better than the average of employees in similar occupations
in surrounding communities in the following fields:
Sick leave
Paid holidays
Vacation allowance
Overtime Compensation
Hospital - Medical Insurance Coverage
2. The employees working 44 hours per week work the same number of
hours per week as the employees of =any utilities 4n surrounding
communities and the Panel %as informed and the vWloyees are informed
by the Consisslon that the reduction in work Wire from 44 hours to
40 hours per week is going to be accomplished by the Comission within
the next two (2) years as rapidly as the n*ces"ry arrangements can
properly be made and the additional qualified w" power obtained.
3. One the question of wages, the majority of the 'P*ml adopted a report
recommending an across the board salary increase of $10.00 per stonth.
As an individualg I am in favor of the employees being paid as torch as
they can properly be paid taking into consideration the earnings of the
employer, the nature and amount of responsibility involved in their work,
the ability and knowledge required in the work done, the years of service

with this employer and most important the quality of work done by that
employee, the amount of work accomplished by that employee and the
ability of that employee to proceed with work without pressure from
the employer and without the necessity of close supervision. In this

regard, I Maud recommend to the Hutchinson Utilities Commission that either
annually or semi- asmraally all employees should be considered on their merits

there was considerable discussion regarding this question. There are numerous
r reasons why the Panel did not recommend to the Utilitiesl;ission that they

recognized the Union. Asiong these were the fact that there is changing personnel
om the Co=ission and one group should not bind and could not bind future members,
the Union cannot clam that it•represents the employera as the sole bargaining
agent of all.of the employees of the Commission and therefore, would leave the
t� matter open to nwwerous Unions to come in and represent many or a few of the
S x e"loyseg and ask for recognition and benefits for the feat they represent. This
d�f old make an entirely unworkable arrangement. As :long a,,# the majority of the r,
Friel does not recommend recognition of the Union .by the efitilities Commission .

Monthly Meeting.
A monthly meeting of the Hutchinson Utilities Commission was held on
.September 149 1964 in the Hutchinson Utilities -Billing Office.
All Commissioners were present; also Supt. R. E. Young, Supt. 0.
Kuiken, Hugo Mahs and Attorney Comer.
'Commissioner Quade made a motion to raise the salary of Loren Caskey
$10.00 per month and to place Robert McLain on a monthly payroll
basis instead of hourly)plus an additional $10.00 increase in salary.
Motion was seconded by Commissioner Tracy and unanimously carried.
Commissioner Quade made a motion to purchase the following described
property owned by Lewis Merrill:
Lot four, Block one, Harrington subdivision
of Lots seventy and seventy -one of 13ynn
addition to Hutchinson accept the East 1771
thereof; and., also, all of the vacated port ion
ttof Division Avenue lying immediately South of
Amount--$2.,500. O�e above described property.
Motion was seconded by Commissioner Tracy and unanimously carried.
Motion was made by Commissioner Tracy to buy a Treasury Bill in
the amount of $70,023 -.63 bearing 4.05% interest and to mature on
8/16/65. Motion was seconded by Commissioner Quade and unanimously
carried.
