10-08-1973 HUCMREGULAR MEETING October 8, 1973 The meeting was called to order by President Quade at 2:00 PM. Counsel Anderson and Gilmer, along with Attorney Reyerson, reviewed the Worthington/Allis Chalmer's problem in detail. After much discussion, Counsel Anderson recommended that suit be brought against Worthington/Allis Chalmers. Motion was made by Commissioner Filk, seconded by Commissioner Tracy and unanimously carried to adopt the following resolu- tion: 17. -nz>X 0 c cn (p cn 3 m o Cn CD CD CD 0 �cao=3 -0 oo'co CO� CO E c' =0 (n, °o � o v 3 °- 0 co m wQ rn I N ' O N 0 cc 56 M WHEREAS, the Hutchinson Utilities Commission on October 21, 1966, entered into a contract with Worthington Corporation to furnish, erect, start -up, test and place in commercial operation two (2) dual fuel diesel engine electric generating units having a total net capacity of 4,000 KW and auxiliary equipment in the Municipal Power Plant at Hutchin- son, Minnesota; and WHEREAS, an Allis - Chalmers generator was installed pursuant to said contract; and WHEREAS, following installation of said units, certain defects and problems arose which have not been re- medied; and WHEREAS, demands have been made upon Worthington Corporation and Allis Chalmers to resolve the defects and problems; and WHEREAS, said demands have not been honored by either.Worthington Corporation or Allis - Chalmers; and WHEREAS, the Hutchinson Utilities Commission has 17. -nz>X 0 c cn (p cn 3 m o Cn CD CD CD 0 �cao=3 -0 oo'co CO� CO E c' =0 (n, °o � o v 3 °- 0 co m wQ rn I N ' O N 0 cc 56 M 18 been advised by counsel to commence a lawsuit against all parties who can be held responsible. BE IT RESOLVED, that Peterson & Gilmer, counsel for the Hutchinson Utilities Commission, are directed to initiate legal proceedings against all parties who may be held responsible for said defects and problems. BE IT FURTHER RESOLVED, that Peterson & Gilmer are authorized on behalf of Hutchinson Utilities Commission to engage associate counsel to assist in said legal proce- edings. Manager Wacker reported on the General Electric test relative to fuel and load on the stag unit. Final acceptance is planned on or about January 1, 1974. Motion was made by Commissioner Filk, seconded by Commissioner Tracy and unanimously carried to bill the General Electric Corporation for $7,534.17 and $1,564.50 for labor furnished by the Hutchinson Utilities Commission for work on the turbine unit. Motion was made by Commissioner Filk, seconded by Commissioner Tracy and unanimously carried to advertise for bids for a (50' X 1001) metal clad pole type building. Sealed bids to be received at the Hutchinson Utilities Commission's office until 2:00 PM on October 29, 1973• Motion was made by Commissioner Tracy, seconded by Commissioner Filk and unanimously carried to pay Energy Systems, Inc. $10,$00 as per recommendation;by Pfeifer and Shultz in their letter of October 2, 1973• Manager Wacker presented a letter from the Village of Brownton asking if we would help them when they had power outages, etc. Motion was made by Commissioner Filk, seconded by Commissioner Tracy and unanimously carried to inform the Village that we could not enter into such an agreement. Motion was made by Commissioner Filk, seconded by Commissioner Tracy and unanimously carried to send Manager Wacker to the APPA Management School in Des Moines, Iowa, October 23 -26, 1973• Motion was made by Commissioner Tracy, seconded by Commissioner Filk and unanimously carried instructing Manager Wacker to accept his appointment to the APPA Management Committee for 1973 -74. 11K Motion was made by Commissioner Tracy, seconded by Commissioner Filk and unaimously carried to send representatives to the Minnesota Municipal Utilities Association Convention in Minnea- polis, October 25 and 26, 1973. Motion was made by Commissioner Tracy, seconded by Commissioner Filk, and unaimously carried to send Manager Wacker and a selected employee to an Energy Conservation Program conducted by United Power at Elk River on October 11, 1973. Election of officers then took place: Motion to nominate: Filk - Tracy Quade- President Tracy - Quade Filk -Vice President Quade - Filk Tracy- Commissioner - Secretary Filk - Quade Instructing Secretary to cast a unanimous ballot for all. Motion was carried. Manager Wacker presented some preliminary ideas concerning Hutchinson Utilities and Circle Pines Utiliites entering into an agreement utilizing natural gas. A lengthy discussion took place with Manager Wacker being instructed to seek more inform- ation.
