REGULAR MEETING
January 14, 1974
A regular meeting of the Hutchinson Utilities Commission was
held on January 14, 1974, in the Hutchinson Utilities meeting
place at 2:00 PM.
All Commissioners were present; also Manager Steve Wacker and
Counsel Gilmer and Peterson.
The minutes of the December 10, 1973 meeting were read and ap-
proved as read.
Counsel Gilmer reported on the complaint to be filed against
the Worthington Corporation and all. More study and work will
be necessary to complete the complaint,.
Counsel Peterson presented his view on the pay schedule pre -
taining to the Worthington case. This amount would be up and
above the general retaining fee of $1,500.00 per year. All
expenses incurred will be billed to the Utilities on a monthly
basis.
After discussion about joining with Circle Pines on a group
billing program with Northern Natural Gas to better utilize gas
usage, a motion was made by Commissioner Filk, seconded by
Commissioner Tracy and unanimously carried to enter into an
agreement with Circle Pines to purchase Natural Gas on a group
billing program with Hutchinson Utilities. This will be pre-
sented to Northern Natural Gas for their consideration.
Motion was made by Commissioner Tracy, seconded by Commissioner
Filk and unanimously carried to send employees to the Municipal
Utilities Workshop in Minneapolis held February 4, thru February 8,
1974.
As all work has been completed on the Peak - Shaving Plant, recom-
mendation was made by Pfeifer and Shultz, Consulting Engineers,
to issue a check in the amount of $13,630 representing final
payment. A motion was made by Commissioner Tracy, seconded by
Commissioner Filk and unanimously carried to accept the recom-
mendation.
Motion was made by Commissioner Filk, seconded by Commissioner
Tracy, and unanimously carried to send Manager Wacker to an
American Public Power Meeting in Washington, D.C. on January 28 -29,
1974.

Motion was made by Commissioner Filk, seconded by Commissioner
Tracy and unanimously carried to call for bids on a trenching
machine to be opened February 11, 1974.

L. D. Mills, being duly sworn, on oath says he is and during all the times herein stated
has been the publisher and printer of the newspaper known as The Hutchinson Leader and has
full knowledge of the facts herein stated as follows: (1) Said newspaper is painted in the English
language in newspaper format and in column and sheet form equivalent in printed space to at
least 900 square inches.__ (2)_ Said newspaper is a semi - weekly and is distributed at least twice
each week. (3) Said newspaper has 25% of its news
to the community which it purports to serve and does not wholly duplicate any other publication
and is not made up entirely of patents, plate matter and advertisements. (4) Said newspaper
is circulated in and near the municipality which it purports to serve, has at least 500 copies
regularly delivered to paying subscribers, has an average of at least 75% of its total circulation
currently paid or no more than three months in arrears and has entry as second class matter
in its local post- office. (5) Said newspaper purports to serve the City of Hutchinson in the
County of McLeod and it hag, its known office of issue in the City of Hutchinson, in said county,
established and open during its regular business hours for the gathering of news, sale of adver-
tisements and sale of subscriptions and maintained by the managing officer of said newspaper
or persons in its employ and subject to his direction and control during all such regular business
hours and at which said newspaper is printed. (6) Said newspaper files a copy of each issue
immediately with the State Historical Society. (7) Said newspaper has complied with all the
foregoing conditions for at least two years preceding the day or dates of publication mentioned
below, (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1,
1966, and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State
and signed by the managing officer of said newspaper and sworn to before a notary public
stating that the newspaper is a legal newspaper.
