Adjournment in MINUTES REGULAR MEETING - HUTCHINSON CITY COUNCIL TUESDAY, MARCH 24, 1987 1. The meeting was called to order by Mayor Ackland at 7:30 P.M. The follow- ing were present: Alderman John Mlinar, Alderman Marlin Torgerson, Alder- man Pat Mikulecky and Mayor Paul L. Ackland. Absent: Alderman Mike Carls. Also present: City Administrator Gary D. Plotz, Director of Engineering Mar- low V. Priebe and City Attorney G. Barry Anderson. 2. INVOCATION The invocation was given by the Reverend David Anderson. 3. MINUTES The minutes of the regular meeting of March 10, 1987 and bid openings of March 17 and March 18, 1987 were approved as distributed. 4. COMMUNICATIONS, REQUESTS AND PETITIONS (a) UPDATE ON LIBRARY SQUARE RENOVATION PROJECT BY CITY FORESTER Chairman Jerry Brown of the Tree Board reported that First State Fed- eral had offered to fund the renovation project in the amount of $8,500. He then presented drawings of the proposed plan for Library • Square. Alderman Mlinar moved to approve the plan. Motion seconded by Alder- man Torgerson and carried unanimously. 1 �, CITY COUNCIL MINUTES - MARCH 24, 1987 There was discussion regarding the purchase of a tree spade and a City tree nursery. City Forester Schnobrich showed the Council a sample of a biodegrade - able bag for leaves and grass clippings. As soon as Jim Junker returns from vacation, the Mayor will meet with him to discuss picking up bags to be hauled to the City tree dump for composting. (b) CONSIDERATION OF REIMBURSEMENT FOR TRAINING FOR ENGINEERING TECHNICIAN Following discussion, Alderman Torgerson moved to pay 50 percent of the $480 tuition. Motion seconded by Alderman Mikulecky and unanimously carried. (c) CONSIDERATION OF REQUEST FOR STREET LIGHT ON ROLLING GREENS LANE The motion was made by Alderman Mlinar, seconded by Alderman Torgerson, to approve and refer to the Utilities. Motion carried unanimously. (d) CONSIDERATION OF SPECIAL RECOGNITION FOR RETIRING FIREFIGHTERS Alderman Mlinar moved to approve and present a "Certificate Of Appre- ciation" and Coat of Arms plaque to the retiring firefighters. Motion seconded by Alderman Torgerson and unanimously carried. • 7. RESOLUTIONS AND ORDINANCES (a) RESOLUTION NO. 8470 - RESOLUTION FOR PURCHASE Alderman Mlinar made the motion to waive reading and adopt Resolution No. 8470. Motion seconded by Alderman Torgerson and carried unani- mously. 8. UNFINISHED BUSINESS (a) CONSIDERATION OF AWARDING BID FOR SKID STEER LOADER (DEFERRED MARCH 17, 1987) Alderman Mikulecky moved to approve and award bid to Kortuem's Sales for a new Model 675 John Deere for a net bid with trade-in ($2,500) of $13,324.55. Alderman Torgerson seconded the motion and unanimously carried. (b) CONSIDERATION OF AWARDING BID FOR TWO POLICE PATROL CARS (DEFERRED MARCH 17, 1987) The motion was made by Alderman Torgerson, seconded by Alderman Mlinar, to approve and award the bid for two police cars to Plowman's Inc. for $26,264, less trade-in of two 1985 Victorias at $2,600 each. Motion • carried unanimously. 2 CITY COUNCIL MINUTES - MARCH 24, 1987 (c) CONSIDERATION OF REQUEST BY GALEN WITTE FOR AUTHORIZATION TO HAUL AND DISPOSE OF CONSTRUCTION AND OTHER MATERIALS WITHIN CITY LIMITS (DEFERRED MARCH 10, 1987) City Attorney Anderson reported he had reviewed the City ordinance and Junker's contract. It was his legal opinion that no action was re- quired by the Council since there would be no violation of the ordi- nance or refuse contract. Following discussion, Alderman Torgerson moved that on the recommenda- tion of the City Attorney, the Council take no action and let Galen Witte proceed with his business. Motion seconded by Alderman Mlinar and unanimously carried. (d) CONSIDERATION OF ESTABLISHING A SPECIAL CITY COUNCIL MEETING DATE TO REVIEW AND AWARD POLICE STATION BIDS Following discussion, it was the consensus of the Council to meet at 5:30 P.M. on April 1, 3.987 at City Hall to discuss the bids for the police station. Also, the Council would interview applicants for the city engineer position starting at 7:00 P.M. following the meeting with the Utilities Commission in the hospital conference room. • 9. NEW BUSINESS (a) CONSIDERATION OF DELINQUENT WATER AND SEWER ACCOUNTS The motion was made by Alderman Torgerson, seconded by Alderman Miku- lecky, to authorize discontinuation of service unless prior arrange- ments had been made. Motion unanimously carried. (b) CONSIDERATION OF DATE OF JUNE 19, 1987 FOR BOARD OF REVIEW MEETING Following discussion, it was the preference of the Council to establish an evening meeting on May 5, 1987 at 7:00 P.M. or May 11, 1987 at 7:00 P.M. The County Assessor's office would be notified regarding the pro- posed change of date and time. (c) CONSIDERATION OF MODIFICATION TO AERATION ROOM VENTILATION AT WATER TREATMENT PLANT After discussion, Alderman Mikulecky moved to approve the proposal for an estimated $2,859. Motion seconded by Alderman Mlinar and carried unanimously. (d) CONSIDERATION OF EXECUTING AGREEMENT FOR FORCE MAIN EASEMENT BETWEEN LORRAINE TREINEN AND CITY OF HUTCHINSON • Following discussion, the motion was made by Alderman Torgerson, sec- onded by Alderman Mlinar, to approve and enter into the agreement. The motion was amended by Alderman Torgerson to include execution of the 3 CITY COUNCIL MINUTES - MARCH 24, 1987 CJ notice of adverse claim. Amended motion seconded by Alderman Mlinar and unanimously carried. Main motion carried unanimously. (e) CONSIDERATION OF "CONSENT TO RELEASE OF FUNDS" TO JAMES H. SCHAEFER BY FRANK J. FAY AND CURTIS E. BURCKHARDT City Attorney Anderson pointed out the release did not indicate the City would be released from liability. After discussion, Alderman Mik- ulecky moved to approve and authorize release of the funds contingent upon the City Attorney being satisfied with the arrangement. Motion seconded by Alderman Torgerson and unanimously carried. (f) CONSIDERATION OF 1987 PROPOSAL FOR HUTCHINSON SENIOR CENTER NUTRITION PROGRAM The motion was made by Alderman Torgerson, seconded by Alderman Miku- lecky, to approve and enter into contract. Motion carried unanimously. (g) CONSIDERATION OF ENTERING INTO FARM PROGRAM AGREEMENT WITH CHRIS KADELBACH FOR CITY -OWNED PROPERTY City Administrator Plotz commented on the City -owned land that is used by Chris Kadelbach and that the one-year agreement had expired. He • suggested a trade-off with Mr. Kadelbach of a rent-free renewal of the land in exchange for an easement on the property adjacent to McKimm's land. Following discussion, Alderman Mlinar moved to table to the April 14 meeting. Motion seconded by Alderman Torgerson and unanimously car- ried. Mr. Kadelbach stated March 30 was the deadline for the farm program agreement to be submitted. After further discussion, Alderman Torger- son moved to approve the agreement in good faith that the City would make some progress with Mr. Kadelbach. Motion seconded by Alderman Mlinar and carried unanimously. (h) CONSIDERATION OF PAYMENT FOR REMOVAL OF PARKING LOT LIGHT AT BIG BEAR SITE With the letter from Big Bear and recommendation from City Engineer, Alderman Torgerson moved to approve payment from the City. Motion sec- onded by Alderman Mlinar and carried unanimously. (i) CONSIDERATION OF AMENDMENT TO ZONING ORDINANCE NO. 464, SECTION 6.01 AND 6.02 WITH FAVORABLE RECOMMENDATION OF PLANNING COMMISSION The motion was made by Alderman Mlinar to approve the amendment and to • waive first reading of Ordinance No. 1/87 and set second reading for April 14, 1987. El • CITY COUNCIL MINUTES - MARCH 24, 1987 (j) CONSIDERATION OF REVIEW OF COMPREHENSIVE PLAN WITH FAVORABLE RECOMMENDATION OF PLANNING COMMISSION Alderman Mlinar moved to approve the comprehensive plan with the recom- mended change. Motion seconded by Alderman Torgerson and carried unan- imously. (k) CONSIDERATION OF ANNEXATION PROPOSED BY FRANK FAY WITH FAVORABLE RECOMMENDATION OF PLANNING COMMISSION Alderman Mlinar made the motion to approve the referral of the annex- ation to the Minnesota Municipal Board and to waive reading and adopt Resolution No. 8469. (n) CONSIDERATION OF SECTION BREAKDOWN FOR MAPPING AND PLANNING The motion was made by Alderman Mikulecky, seconded by Alderman Tor- gerson, to approve the work. Motion carried unanimously. (o) CONSIDERATION OF HERCULES INCORPORATED USE OF EXTRA CAPACITY IN HUTCHINSON'S NEW WASTEWATER TREATMENT PLANT Following discussion, Alderman Torgerson moved to approve on a tempor- ary basis. Motion seconded by Alderman Mlinar and unanimously carried. (p) CONSIDERATION OF APPROVING PLANS AND SPECIFICATIONS FOR 1987 IMPROVEMENT PROJECTS AND ORDERING ADVERTISEMENT FOR BIDS The motion was made by Alderman Mikulecky, seconded by Alderman Mlinar, • to approve the plans and specifications for the 1987 improvement proj- ects, to open bids April 22, 1987 at 2:00 P.M., and to waive reading and adopt Resolution No. 8471. Motion carried unanimously. 5 CITY COUNCIL MINUTES - MARCH 24, 1987 • (q) CONSIDERATION OF NEW WELL AND HIGH SERVICE PUMP FOR WATER DEPARTMENT Alderman Torgerson moved to approve and enter into agreement with RCM. Motion seconded by Alderman Mikulecky and unanimously carried. 10. MISCELLANEOUS (a) COMMUNICATIONS FROM CITY ADMINISTRATOR City Administrator Plotz commented on the expired farm lease with Gene Birk. Mr. Birk had indicated he wanted to rent the farm land at the airport for 1987, with the same conditions of the present contract. The Council was reminded of the groundbreaking ceremony on April 4 at 10:00 A.M. for the new wastewater treatment plant. Donohue & Associ- ates will be sending out special invitations to the event. (b) COMMUNICATIONS FROM MAYOR PAUL L. ACKLAND Mayor Ackland presented the Minnesota Coalition of Outstate Cities' program in H.F. 847 for property tax relief and requested the Council to go on record in support of the Coalition bill. Following discussion, Alderman Mlinar moved to adopt Resolution No. • 8472 and to support the Coalition in this effort. Motion seconded by Alderman Torgerson and carried unanimously. (c) COMMUNICATIONS FROM ALDERMAN JOHN MLINAR Alderman Mlinar inquired about the uncompleted portion of the railroad project which was mentioned at a recent Council workshop. Engineer Priebe reported that clean-up was not completed, and one crossing was waiting for further work by Jerry Ross. It was suggested this topic be discussed at the up -coming joint Utilities and Council meeting. (d) COMMUNICATIONS FROM ALDERMAN PAT MIKULECKY Alderman Mikulecky asked if the problem with the Gopher Campfire well had been resolved. He was informed by Engineer Priebe that a variance would be obtained from the State by the well driller. (e) COMMUNICATIONS FROM ALDERMAN MARLIN TORGERSON Alderman Torgerson inquired about the plans for the 1987 improvement projects. Engineer Priebe stated that bids were received today. 11. The meeting adjourned at 2:23 P.M. 2 MINUTES • SPECIAL MEETING - HUTCHINSON CITY COUNCIL FRIDAY, MARCH 27, 1987 The open portion of the closed special City Council meeting was called to order by Mayor Ackland at 12:45 P.M. Present were: Alderman John Mlinar, Alderman Marlin Torgerson, Alderman Pat Mikulecky, and Mayor Paul L. Ackland. Absent: Alderman Mike Carls. Also present: Assistant City Clerk Kenneth B. Merrill and Legal Counsel Dayle Nolan. 1. CONSIDERATION OF RESOLUTION NO. 8473 - RESOLUTION OF AGREEMENT WITH CHIEF OF POLICE AND RELEASE OF ALL CLAIMS Mayor Ackland stated that although Alderman Carls was on vacation, he had been advised of the contents of the agreement and had sent a note stating he was in full agreement with the claims of settlement. The motion was made by Alderman Mikulecky, seconded by Alderman Torgerson, to waive reading and adopt Resolution No. 8473 entitled Resolution Relating To Certain Proceedings Involving The Chief Of Police; Authorizing Settle- ment Of Claims. Motion unanimously carried. 2. CONSIDERATION OF RESOLUTION NO. 8474 - SPECIAL LEGISLATION REMOVING CHIEF OF • POLICE OF HUTCHINSON FROM CIVIL SERVICE RULES AND REGULATIONS Mayor Ackland stated that upon adoption of this Resolution, he would deliver copies to Senator John Bernhagen and Rep. Steve Dille for legislative action which would affect only the City of Hutchinson. Alderman Torgerson moved to waive reading and adopt Resolution No. 8474. Motion seconded by Alderman Mikulecky and carried unanimously. 3. CONSIDERATION OF REPEALING PROMOTION OF NANCY BUSS TO OFFICE SUPERVISOR Mayor Ackland stated that Nancy Buss' promotion should have gone through the Civil Service Commission and was improperly handled. He then reviewed her previous salary and recommended her promotion be repealed and put the salary back to $8.59, effective now. Following discussion, Alderman Torgerson moved to repeal the promotion and put the salary at $8.59, effective immediately. Motion seconded by Alder- man Mlinar and unanimously carried. 4. CONSIDERATION OF REQUESTING CIVIL SERVICE COMMISSION TO ADVERTISE AND INTERVIEW FOR POSITION OF OFFICE SUPERVISOR There was discussion whether the position of office supervisor should be advertised at this time or wait until a full-time chief had been hired. • The motion was made by Alderman Mlinar to request the Civil Service Commis- sion to advertise and interview for the position of office supervisor. Also present: Police Civil Service Commission members Dr. W. G. Miskoff, Dr. Robert Prochnow, and Jeff Haag; City Attorney G. Barry Anderson, City Administrator Gary D. Plotz, and Acting Chief Richard Waage. Mayor Ackland recommened the City Council withdraw the City's Resolution No. 8474 from consideration by the Minnesota State Legislature. Specifically, this resolution requesting special legislation to have the position of Hutchinson police chief be exempt from Police Civil Service. Alderman Carl made a motion, seconded by Alderman Torgerson, to withdraw Reso- lution No. 8474. Discussion followed that it may be untimely because a cooling off period from the last six to eight months of activity between the Council, Commission and police department is needed. Motion unanimously carried. The Mayor presented the legal opinion by City Attorney Barry Anderson dated April 5, 1987 stating the City Council, as provided by the City Charter, has • the authority to appoint an acting chief of police. Acting Chief Richard Waage read a statement offering to step down as acting chief in the interest of opening up the temporary position (acting chief) to competitive examination and calming the waters. Richard Waage would remain as acting chief until the City Council acted on three names submitted by the Police Commission for the temporary position lasting six to eight months. Attorney Barry Anderson stated he felt if the selection process took more than 30 days for a temporary chief, it would not violate the "spirit" or "intent" of the civil service rules drawn from state statute. A motion was made by Alderman Torgerson, and seconded by Alderman Carls, that the City Council and Police Commission proceed to fill the position of permanent police chief no later than December 31, 1987 and that the Commission recommend three names for the temporary appointment of acting chief. Discussion on the criteria for selection of the temporary chief followed. Attorney Anderson ad- vised that it should be by competitive examination, however, the details of the process are up to the Civil Service Commission. The above motion was called and unanimously approved. In discussing the Five Year Airport Development Program, the commission by unanimous vote rated additional hangar space as top priority with runway overlay and ramp overlay next in priority. The Jaycees have been able, with the generous help of city businesses, to generate the funds necessary to stage a first-class event. During recent years, however, the financial climate has been such that our costs have been rising faster than the support through contributions. We have attempted to look very closely at our expenses, and have trimmed them wherever we felt possible, while maintaining the integrity of the Water Carnival. One of the Water Carnival events which we have looked at closely is the fireworks display. The display appears to be one of the few in the area, drawing people from the surrounding communities. We have looked at the event in order to cut costs, however, we have received requests from area residents and business persons to put on a larger display. The display now costs us approximately $1,500. We would like to ask the City of Hutchinson to sponsor a fireworks display at an approximate cost of $2,000. We extend to you and your employees best wishes for an enjoyable Holiday Season and Continued Success in the New Year. ,i . 1111h,04 /"VA M/94% ny, ire Office of State Aidctor Enclosures: (2) Agency Agreements Revised 11/1986 Office of State Aid MINNESOTA DEPARTMENT OF TRANSPORTATION AGENCY AGREEMENT This Agreement made and entered into by and between the City of Hutchinson herein after referred to as the "City" and the Commissioner of Transportation of the State of Minnesota hereinafter referred to as the "Commissioner", WITNESSETH: WHEREAS, pursuant to M.S. 161.36 the City of Hutchinson desires the Commissioner to act as its agent in accepting federal aid on the City's behalf, for road and bridge construction and in contracting for the construction, improvement or maintenance of roads or bridges financed either in whole or . part with federal moneys: and WHEREAS, M.S. 161.36, Subdivision 2, requires that the terms and condition of the agency be set forth in an agreement: NOW, THEN, IT IS AGREED: - 1 - That pursuant to M.S. 161.36, the City does hereby appoint the Commissioner its agent with respect to all federally funded projects, to accept and receive all federal funds made available for said projects and to let contracts pursuant to law for the construction and improvement of local roads and bridges. Each contract will be in accordance with plans and special provisions for said projects on file in the Department of Transportation, State Transportation Building, St. Paul, Minnesota • Page No. 1 55155, and the latest edition of "Standard Specifications for Highway Construction" and all amendments thereof, which said • plans, special provisions and specifications are made a part of this agreement by reference as though fully set forth her -tin. In the letting of said contract, it is hereby agreed that the following procedures shall be followed, to -wit: (a) The Commissioner shall cause the advertisements calling for bids on said work to be published in the Construction Bulletin. He shall also cause advertisements for bids to be published in the officially designated newspaper of the City. Said advertisement or call for bids shall specify that sealed proposals or bids will be received by the City Purchasing Agent on behalf of the Commissioner as agent of said City. Proposals, plans and specifications shall be available for the inspection of • prospective bidders at the Department of Transportation, St. Paul, Minnesota 55155, and at the office of said City Purchasing Agent and the advertisement shall so state. The bids received in response to said advertisements for bids shall be opened for and on behalf of the Commissioner by a District Director of the Department of Transportation or such other engineer of the Department of Transportation as may be from time to time selected by the Commissioner. After said bids shall have been opened, the City Council shall first consider the same and thereupon transmit to the Commissioner all bids received together with its recommendation that the lowest bid submitted by a responsible bidder be accepted or that all bids be rejected. Upon receipt of • Page No. 2 all said bids, the Commissioner shall duly cause all of said bids • to be tabulated and shall thereupon determine who is the lowest responsible bidder and shall award the contract to the lowest responsible bidder or shall reject all bids. (b) The Commissioner shall supervise and have charge of the construction of said projects after the same has been let. The City agrees to furnish its City Engineer or other registered engineer and assign him to the active supervision and direction of the work to be performed under any contract let for the aforesaid projects. Said engineer so assigned shall act under the supervision and direction of the Commissioner. The City further agrees to furnish such other personnel, services, supplies and equipment as shall be necessary in order to properly supervise and • carry on said work. (c) The Commissioner may make changes in the plans or r 1 U the character of the work as shall be recommended by the engineer in charge of the work. If he concurs in such recommendations, the Commissioner may enter into, for and on behalf of the City, supplemental agreements with the contractor for the performance of any extra work or work occasioned by any necessary, advantageous, or desirable change in plans or construction. It is understood by the City that the Commissioner cannot personally investigate and pass judgment on the various items of extra work and plan changes necessary and desirable during the construction of the projects but that he must delegate such duties to engineers under his supervision and control that Page No. 3 0 are employed by the Minnesota Department of Transportation. The City does hereby authorize these engineers, so delegated by the • Commissioner, to enter into, for and on behalf of the City, the supplemental agreements specified in the preceding paragraph hereof. (d) The City hereby authorizes its City Engineer, for and on behalf of the City, from time to time, during the progress of the work on said projects, to request the Commissioner to furnish for use on said projects specific engineering services to be performed by skilled employees of the Minnesota Department of Transportation. The Commissioner may but is not obligated to furnish the services so requested. If the Commissioner in compliance with such request shall furnish for the use of the City on said project the services of any Minnesota Department of • Transportation employee, then and in that event, the City agrees to reimburse the Trunk Highway Fund for the full cost and expense of the furnishing of such services including all costs and expenses of any kind or nature whatsoever arising out of, connected with, or incidental to the furnishing of such services. (e) The Commissioner shall receive the funds to be paid by the City and the funds to be paid by the United States as federal aid funds, for said projects and to pay therefrom when due any and all sums that may become due the contractor to whom the contract is awarded, and upon final completion and acceptance of the work, to pay from said funds the final estimate to said contractor for said work. Page No. 4 (f) The Commissioner shall perform on behalf of the • City all other acts and things necessary to cause said projects to be completed in a satisfactory manner. (g) The Commissioner may enter into any agreement for and on behalf of the City with the United States or any officer or agent thereof that may be required or necessary for the purpose of procuring and actually causing to be paid the federal aid funds available for said projects and to that end to bind and commit the City in such agreement to the performance of any and all things required by any law of the United States or of any rule and regulation issued by federal authority pertaining thereto necessary for the purpose of procuring and having paid the federal aid available for said projects. . (h) It is the policy of the United States Department of Transportation and the Minnesota Department of Transportation that E Disadvantaged Business Enterprises and Women Business Enterprises as defined in 49 CFR, Part 23, shall have the maximum opportunity to participate in the performance of contracts financed in whole or in part with federal funds. Consequently, the requirements of 49 CFR, Part 23, apply to this agreement. In this regard, the Commissioner and the City shall take all necessary and reasonable steps in accordance with 49 CFR, Part 23, to insure that Disadvantaged Business Enterprises and Women Enterprises have the maximum opportunity to compete for and perform on contracts and subcontracts. The Commissioner and the City shall not discriminate on the basis of race, color, national origin, or sex Page No. 5 in the award and performance of federally funded contracts. Failure to carry out the above requirements shall constitute a • breach of this agreement and may result in termination of the agreement or other such remedy that the Commissioner deems appropriate. (i) The Commissioner may perform on behalf of the City any other and further acts as may be necessary or required under any law of the United States or of any rule or regulation issued by proper federal authority in order to cause said projects to be completed and to obtain and receive the federal aid made available therefor. - 2 - The City agrees that it will from time to time, after the execution of this agreement, make such reports, keep such records and perform such work in such manner and time as the • Commissioner shall from time to time request and direct so as to enable the Commissioner as its agent to collect for it the federal aid sought. Said records and reports shall be retained by the City in accordance with the Commissioner's record retention schedule for federal aid projects. - 3 - It is anticipated that the United States will pay to the Commissioner as the agent of the City, the federal aid funds available to said City toward the construction of said projects. It is further anticipated that the contracts to be let by the Commissioner as the agent of the City, for the construction of Page No. 6 • said projects shall provide that the contractor, as the work • progresses, shall, from time to time, be paid partial payments designated in said contract as partial estimates and on the completion and acceptance of said work to be paid a final payment designated in said contract as a final estimate for all work performed. The City further agrees that any City funds and/or Municipal State Aid funds to be applied to any contract covered by this agreement shall be deposited with the Commissioner in accordance with Minnesota Rules Chapter 8820.1500 Subp. 3. At regular monthly intervals after contractors shall have started work under contracts let by the Commissioner as agent for the City for the construction of said projects, the engineer • assigned to and in charge of said work shall prepare partial estimates in accordance with the terms of said contracts let for said projects and the procedures established by the Office of Contract Administration and Maintenance, Minnesota Department of Transportation. The said engineer in charge of said work shall immediately after preparing each partial estimate, transmit the same to the Commissioner in duplicate. Each such partial estimate, shall be certified by the engineer in charge and by the contractor performing such work. The said engineer assigned to and in charge of said work shall also prepare and submit to the Commissioner the final estimate data, together with the required project records in accordance with the terms of said contracts let for said projects. Quantities listed on said partial and final Page No. 7 estimates shall be documented in accordance with the guidelines set forth in the applicable documentation manual. After the • approved final estimate has been submitted to the Commissioner, the City will pay to the Commissioner any additional amount which together with the federal funds received for that project will be sufficient to pay all the contract costs of the project When the contractor shall have completed the work on said projects, the City agrees to inspect the same and forthwith upon the completion of said inspection advise the Commissioner whether or not the work performed should be, by the Commissioner as its agent, accepted as being performed in a satisfactory manner. In the event the City should, after said inspection, recommend to the Commissioner that he should not accept said work, then the City shall at the time such recommendation is made • specify in particularity the defects in said work and the reasons why the work should not be accepted. It is further agreed that any recommendations made by the City are not binding on the Commissioner but that he shall have the right to determine whether or not the work has been acceptably performed and to accept or reject the work performed under any said contract. - S - It is further agreed that the decision of the Commissioner on the several matters herein set forth shall be final, binding and conclusive on the parties hereto. Page No. 8 - 6 - • It is anticipated that the entire cost of said projects is to be paid from funds made available by the United States, by way of federal aid, and by the City. If for any reason the United States fails to pay any part of the cost or expense of said projects, then and in that event the City agrees to pay the same. The City further agrees to pay any and all lawful claims or demands of any kind or nature whatsoever arising out of or incidental to the performance of the work under any contract let for said projects in the event that the United States does not pay the same, and in all events, agrees to save the State of Minnesota and the Commissioner harmless from said claims and from any claims arising out of this agreement and to pay any and all expenses and • costs connected with said projects or the construction thereof which the United States does not pay. - 7 - The City further agrees that: 1) All right-of-way acquisition and relocation will be conducted in accordance with 49 CFR Part 25. Procedures implementing their regulation are contained in Mn/DOT State Aid Manual, Chapter 5-892.310. (Additional guidance may be obtained by referring to the FHWA's Real Estate Acquisition Guide for Local Public Agencies). 2) If the City receives total direct and indirect federal assistance of: • Page No. 9 I A. $100,000 or more per year, the City agrees to obtain a financial and compliance audit made in accordance with • the Single Audit Act of 1984 (P.L. 98-502) and Office of Management and Budget (OMB) Circular A-128. The law and circular provide that the audit shall cover the entire operations of the City government or, at the option of the City government, it may cover departments, agencies or establishments that received, expended, or otherwise administered federal financial assistance during the year. However, if the City government receives $25,000 or more in General Revenue Sharing Funds in a fiscal year, it shall have an audit of its entire operations. B. Between $25,000 and $100,000 per year, the City agrees to obtain either: 1. a financial and compliance audit made in • accordance with the Single Audit Act of 1984 and OMB Circular, A-128, or 2. a financial and compliance audit of all federal funds. The audit must determine whether the subrecipient spent federal assistance funds in accordance with applicable laws and regulations and the audit must be made in accordance with any federal laws and regulations governing the federal programs the subrecipient participates in. Audits shall be made annually unless the state or local government has, by January 1,1987 a constitutional or statutory requirement for less frequent audits. For those governments, the cognizant agency shall permit biennial audits, Page No. 10 • covering both years, if the government so requests. It shall also • honor requests for biennial audits by governments that have an administrative policy calling for audits less frequent than annual, but only for fiscal years beginning before January 1, 1987. The audit shall be made by an independent auditor. An independent auditor is a state or local government auditor or a public accountant who meets the independence standards specified in the General Accounting Office's Standards for Audit of Governmental Organizations, Programs, Activities, and Functions. The audit report shall state that the audit was performed in accordance with the provisions of OMB Circular A-128 (or A-110 as applicable). • The audit report shall include: A. The auditor's report on financial statements and on a schedule of federal assistance; the financial statements; and a schedule of federal assistance, showing the total expenditures for each federal assistance program as identified in the Catalog of Federal Domestic Assistance. Federal programs or grants that have not been assigned a catalog number shall be identified under the caption "other federal assistance". B. The auditor's report on the study and evaluation of internal control systems must identify the organization's significant internal accounting controls, and those controls designed to provide reasonable assurance that federal programs are being managed in compliance with laws and Page No. 11 0 regulations. It must also identify the controls that were evaluated, the controls that were not evaluated, and the material • weaknesses identified as a result of the evaluation. C. The auditor's report on compliance containing: 1. a statement of positive assurance with respect to those items tested for compliance, including compliance with law and regulations pertaining to financial reports and claims for advances and reimbursements; tested; noncompliance; 2. negative assurance on those items not 3. a summary of all instances of 4. an identification of total amounts questioned, if any, for each federal assistance awarded, as a • result of noncompliance; and 5. a statement on the status of corrective action taken on prior findings. 6. refer to the use of the standards required by the Minnesota Legal Compliance Audit Guide for Local Governments, prepared by the Office of the State Auditor. The purpose of this guide is to establish compliance guidelines for verification by auditors auditing political subdivisions of the state. In addition to the audit report, the recipient shall provide comments on the findings and recommendations in the report, including a plan for corrective action taken or planned • Page No. 12 d and comments on the status of corrective action taken on prior • findings. If corrective action is not necessary, a statement describing the reason it is not should accompany the audit report. The City agrees that the grantor, the Legislative Auditor, and any independent auditor designated by the grantor shall have such access to grantee's records and financial statements as may be necessary for the grantor to comply with the Single Audit Act and OMB Circular A-128. Required audit reports must be filed with the Office of the State Auditor, Single Audit Division and state agencies providing federal assistance, within six months of the City's fiscal year end. If a federal cognizant audit agency has been assigned for the City, copies of required audit reports will • be filed with that agency also. Recipients of more than $100,000 in federal assistance must also submit one copy of the audit report within 30 days after issuance to the central clearinghouse. Assuming the position is classified correctly, and finding his performance over the last 12 months very cooperative, I would recommend 2%. Since being the planning carmission secretary, she has rapidly caught on to all aspects of the job. She has excelled at learning the computer, asking questions, and following things up. She is also doing a fine job with the charter cannission. She has both a professional and friendly approach; very importantly stays neutral on all city issues, and provides the confidentiality and loyalty throughout her work activities and assignments. The board feels that the city crews should be responsible only for city trees, parks, boulevards, public property, etc. Property owners would then be responsible for disposal of storm damage from private trees. They feel that the fact that the tree dump is available for disposal purposes is a valuable benefit and the responsibility of hauling the storm damage from private trees should belong to the property owner. That Melvin Klockmann and Jan Klockmann are the fee owners • of certain real estate located at 239 Fifth Avenue S.W., Hutchinson, Minnesota 55350 legally described as: -1- Lot 11, excepting the east 18 feet thereof, Block 53, South Half, City of Hutchinson. • 2. That Citizens Bank 6 Trust Co., Hutchinson, Minnesota, holds a first mortgage interest against the above described property. 3. That the property in question is unoccupied and vacant and has been unoccupied and vacant for a period of several years. 4. That the foundation of the building located on the above described property is eroding and that the structural integrity of the building is therefore threatened. 5. The interior flooring of the building is sagging and that pools of water have been allowed to accumulate inside the building increasing the damage to the foundation and structure of the building. 6. The walls, windows and foundation of the building all con- tain holes and points of entry for rats, cats and other animals. 7. Unsanitary conditions prevail in the interior of the buil including the depositing of items of personal property, including wash tubs, left over construction material and old furniture, none of which has any apparent market value. In addition to the fore- going, vermin have been observed on site. 8. The owners of the subject property, Melvin Klockmann and Jan Klockmann, have been given written notice of the need to repair and/or remove the offending property on several occasions including but not limited to October 21, 1983, June 17, 1981, August 18, 1986 and most recently, at the time of personal service of the Order issued by the City of Hutchinson. 9. As of the date of the hearing of the above entitled matter, no corrective action was taken on the subject property nor any . indication that corrective action will take place in the future. -2- • r,IL CONCLUSIONS OF LAW 1. The building owned by Melvin Klockmann and Jan Klockmann located at 239 Fifth Avenue S.W., Hutchinson, Minnesota, on property legally described as Lot 11, Block 53, excepting therefrom the easterly 18 feet thereof, Townsite of Hutchinson, South Half, is a hazardous building, having been inadequately maintained and allowed to become dilapidated and unsanitary and as a consequence constitutes a fire hazard and a hazard to public safety or health. 2. The City of Hutchinson is authorized to raze and remove the building located on the property described above and to assess the costs for the razing and removal of the property against the real estate in the same manner as a special assessment as provided by Minnesota Statute Section 463.21. 3. Enforcement of the judgment issued herein is stayed for ten (10) days following entry of judgment to permit the owners of the property to raze and remove the building themselves and, if they wish, to remove items of personal property stored within the building or on the grounds surrounding the building. At the expiration of the ten day period, the City is authorized to remove and dispose of the remaining items of personal property by discarding the same, if it so chooses. 4. A copy of the Court's Findings of Fact and Conclusions of Law shall be served upon Melvin Klockmann, Jan Klockmann and the Citizens Bank & Trust Co., Hutchinson, Minnesota in the same manner as the service of a Summons in a civil action. It is the recamiendation of the Sergeant in charge of field training (Gregor) and Acting Chief Waage that newly hired part • time officers start work at a special training rate in the future. They are required to complete 8 weeks or 320 hours of field training immediately upon employment, and it is recommended that they be paid in the T4 range during this training ($4.50 approximately). On ompletion of training they would be classified in Grade V ($6.46 starting pay), which has been their assigned pay grade in the past. Peter presently works half time in parking enforcement and is one of the recommended candidates for part time licensed officer. • The department supervisors advise that if Peter begins work as a part time officer he will be able to continue the parking enforcement duties. Theytiancipate'that his hours will average 29 or under per week through the year until next anniversary date (February 24, 1987) if he also serves as a part time officer. Some of these meters were incorrectly giving a higher than actual reading. Dick Nagy has checked all 1�" meters and reports three (3) such meters had existed. These meters have been replaced and we have reviewed the overcharge made to these three customers. We have gone back to when two of the three buildings came under the present owners or 1983. The computation gives a result of a refund to the following: Haukos Bros. $ 8,096.14 Maplewood Academy 7,442.02 Chet $ Assoc. 5,326.13 Mr. Willard Haukos owner of 535 Jefferson St S. has become aware of the problem and has reviewed his numbers. The other two customers are unaware at this time of a refund. It is the opinion of Mr. Haukos, interest should be added to the refund. Discussions with City Attorney Anderson have been made and the opinion of no interest added is his conclusion. Mr. Haukos will be at the meeting Tuesday evening to review this with the Council. At the same time, both bridges over the Crow River will be rebuilt. The bridge in Hutchinson is to remain on the same alignment. This decision was made when the bridge project was set to coincide with the roadway project. • The present plan for reconstruction of T.H. 7 East in Hutchinson is still planned for 1989. It, therefore, is important that the City consider grading and place a gravel sub -base on Hilltop Drive between Clifton Heights and Michigan Street in 1988 to enable the residents of the Clifton Heights area to travel in and out of the area when the highway construction closes off travel on T.H. 7. MINN. 55350 M E M 0 DATE: April 3, 1987 TO: Mayor and City Council FROM: Director of Engineering RE: Project No. 87-02 Project No. 87-03 Project No. 87-04 All of the above projects were different considerations to provide an access to or from the Big Bear Site for East bound traffic on T.H. 7/22. Project No. 87-02 and Project No. 87-03, both included a Service Road involving • property acquisition from Larry Sorenson and Plowman's, Inc. They both have indicated they are not willing to donate any right-of-way. They did not respond relative to providing right-of-way at a given cost. The attorney for College of St. Benedict indicated the college would provide the necessary 15 foot right-of-way, provided they are compensated in an amount comparable to that paid to the adjacent property owner. Since condemnation will be required for the Sorenson and Plowman property, I recommended no further consideration be given to Projects No. 87-02 and 87-03. Project 87-04 was the route between Big Bear and Tom Thumb site and across the North side of the Tom Thumb site. Mr. Nick Gikas, owner of the Tom Thumb site, set a price of $6,162.25 for the necessary right-of-way. Mr. Orville Peterson, owner of the Big Bear, informed me on November 19, 1986, that he notified the lessee, "Big Bear Stores, Inc." to respond to the right-of-way request. Any easements that would be satisfactory to them, would be available at no cost. Since November 19, 1986, I have had no response from the Big Bear Stores, Inc. Since the location of this roadway may not be that beneficial, the cost per foot would be above normal and the silence of Big Bear, I recommend no further consideration be given to Project No. 87-04. 21 2 � • Marlow V. On January 6th, a meeting was held with all interested parties. A commitment from Maplewood was discussed since a large share of the cost would be assessed to the Academy under the normal policy. On January 16th, I wrote to Dan Prochnow, attorney for the Academy and a copy of said letter is attached. To • date, no response has been received. It has been my opinion, that this is a neighbor to neighbor problem. With no commitment from the Academy to date, I would assume the project could be dropped for 1987. No design has been done as yet. Prochnow Bradford & Prochnow Attorneys at Law 126 North Franklin St. Hutchinson, HN 55350 RB: Maplewood Academy City Project No. 87-05 Dear Dan: The following is background data and a summary of the items that came forth during the meeting held in your office on January 6th, relative to the above - referenced project: 1. Several property owners on Fifth Avenue Northwest petitioned the City in 1986 to resolve the drainage problem they are having with run-off from the Maplewood Academy site. • 2. The City Council accepted the petition, ordered an Engineer's Report, accepted the Report and held a Public Hearing. 3. At the Public Hearing, Maplewood Academy representatives notified the City that they would not participate in the coat. 4. 1 recommended that the City proceed with the project with the anticipation that the cost situation with Maplewood Academy could be resolved. The City Council accepted the recommendation by approving the project and ordering plans and specifications. 5. At this time, we have a total of 18 projects to design. Completion date for this project is unknown at this time. The bid date would be scheduled when plans are approved. 6. On January 6th, the Maplewood Academy drainage problem at the Northeast corner of their property that is tied with Lateral No. 1 of County Ditch No. 18, was discussed. 7. Maplewood Academy clarified that its objection to the Fifth Avenue project was tied with their frustration that the drainage problem tied with Lateral No. 1 had not been resolved to date. 8. The total cost for the Fifth Avenue project is estimated at $68,970. • Of this cost, $14,610 is deferred to other properties, this cost is for capacity designed for future connection to County Ditch No. 31 West by James Street. The balance of the project cost is $54,360, Mr. Dan K. Proohnow Maplewood Academy City Project Ifo. 87-05 January 16th, 1987 Page 2 which is considered to be assesbabie. As I stated on January 6th, it appears that about $14,360 would be assessed to the properties on Fifth Avenue and about $40,000 to Maplewood Academy. This is based on making the assessment in accordance with our normal policy, which is on a square foot basis. 9. The main reason the City is continuing with this project, 1s to help resolve the drainage problem and avert the need for legal action to be taken by the property owners. 10. Before the City proceeds to the point of taking bids on this project, it is important to obtain some commitment from Maplewood Academy that it will participate in the coat of the project. 11. The commitment format that I suggested is as follows: If we assume that Maplewood Academy and the City resolve the Lateral No. 1 drainage problem, then to what extent will Maplewood Academy be willing to participate in the Fifth Avenue Project (87-05). Je°t I�WO; r, mmissioner • • Addenda to May 21, 1986 Agreement USE OF FACILITIES HUTCHINSON SCHOOL DISTRICT - CITY OF HUTCHINSON BASEBALL - TARTAN PARR It is agreed between the Hutchinson School District and the City of Hutchinson that the School District will rent Tartan Park at a cost of $600 per year for the high school baseball season, effective with the 1986 school year. This includes material, labor, and use of City equipment to prepare and maintain the baseball field for practice and games of the high school baseball team. This agreement is for five years ---1987 through 1991. In payment for this five year lease the School District agrees to confer upon the City a building constructed by the • high school carpentry class. Merrill, Finance Director ------------------------------ SUBJECT: — Establishing Interest Rate On 1987 Assessments — — — — — — Under 1986 amendments, the City must now establish an interest rate prior • to the hearing on proposed assessments. In the past this interest rate has always been established after the bond sale and has been the net inter- est rate. Because we need this rate to go on the proposed assessment notices, I have asked Bill Fahey of Ehlers S Associates to the best of his ability to give an interest rate on a 10 -year improvement bond to be sold in June. Bill has given a return of 6.5 percent. I would ask Council approval of estab- lishing an interest rate for the 1987 bonds of 6.5 percent. See the attachment regarding 1986 amendments. /ms Attachment L� 0 1986 LOCAL IMPROVEMENT GUIDE - ERRATA 1. The "Notice of Hearing on Proposed Assessment," Item 25 on page 39, is in error. In the second paragraph, the model notice leaves blank the number of days after adoption of the assessment within which the assessment can be paid without interest. Note 2 on the following page indicates that the council can choose any number of days it wishes. ,The time period for payment without interest is actually specified to be 30 days, by M.S. 429.061, subd. 3. The blank in the model notice should therefore be filled in with "30" in all, cases. 2. The 1986 amendments require the notice of hearing on the special assessment to state the interest rate to be charged on assessments. M.S. 429.061, subd. 2 implies that the interest rate is to be set in the resolution adopting the assessment, and this has certainly been the general practice to date. However, since the notice of hearing must now contain the interest rate, • it is clear that the interest rate must be established by the council at an earlier point in the proceedings. (The actual interest rate may not be known until bonds are issued, which in some cities won't be until after the appeals period. The same problem exists though if the rate is set in the assessment resolution.) It would seem reasonable to include the establishment of the ,interest rate as part of the "Resolution Declaring Cost to be _Assessed and Ordering Preparation of Proposed Assessment" (Item 22, page 36. It probably also makes sense in this resolution to establish the period of years over which the assessment is payable. The following language could be incorporated into this resolution: "Assessments shall be payable in equal annual installments extending over a period of _ years, the first of the installments to be payable on or before the first Monday in January, 19_ and shall bear interest at the rate of _per cent per annum from the date of the adoption of the assessment resolution." It might also be appropriate to repeat this language in the resolution adopting the assessment (Item 26, page 42). The annual rainfall has been increasing over said time period. This has caused the soil to be saturated. Then with more intense storms and heavy snow falls, runoff has increased. All this has caused the problem to increase. • When the development plan for Roberts First Addition was presented to the City by Mr. Roberts, it was accepted by the City, based on facts, standards and conditions at that time. If other options had been available at that time, that would have been more acceptable, they would have been required by the City. There is no doubt in my mind, that said options would have increased the cost for the develoner. This cost would have been paid, first by the developer, and then by the buyer via increased lot prices. MINN 55350 M E M 0 DATE: March 30, 1987 TO: Mayor and City Council FROM: Director of Engineering RE: Project No. 87-17 FOR YOUR INFORMATION Bids were received on March 24th, for the above -referenced project that will provide sanitary sewer and storm sewer service to the new Elementary School. We designed Routes A and B to the site and Quam Construction Company was low bidder on each route. Based on the low bids, the total cost for Route A is $3,624.86 higher than Route B. Due to the location of Route B, a section of it would not serve the Rickemann property in the future. Therefore, the deferred assessment for Route B would decrease by $15,036.00, and the City cost would increase a like amount. I have, therefore, calculated the assessment costs based on the bid for Route A. • The assumption has been made that the City will be able to obtain the easements from the School District, Mr. Rickemann and Mr, Wagner, by the time the assessment hearing is held. In addition, the assumption has been made that there will be no charge for the easements. The total project cost and assessment does not include any cost for easements. In the event there is a cost for anv of the easements and said cost is to be included in the project cost, a new assessment roll and hearing would be necessary. In addition, any crop damage or crop loss, due to construction, will have to be determined after the project has been completed. I do not expect this will be a large amount and could be paid by the City and would not be part of the assessment. Marlow V. Schrum's appointment be- came effective immediately and will continue for 180 days or until a full-time successor to Petersen officially takes office. Because the Litchfield Po- lice Civil Service Commission does not have an eligibility list from which to draw on for new chief candidates, the com- mission, at a meeting Friday, approved a resolution re- questing the council to adopt an emergency ordinance per- mitting the appointment of an interim chief. Under ordinances governing the Police Civil Service Com- mission. this group will now advertise for applicants for the position and following tests and interviews will draw up a list of the top three candidates for the job. Selection from among the final three for the permanent appointment will be made by the city council. It's expected that the entire search and appointment pro- cess will take between ninety and one hundred twenty days. e reso utton appointing Schrum as interim chief stated that while he will have all the powers of a dulv appointed chief, he will not have the au- thority to initiate disciplinary proceedings against the men under him. At the police commission meeting Friday, discussion centered on what,tbe Job. qualifications of the office should be. One discussion centered on whether or not applicants should be solicited only from the state of Minnesota. The police commission was slated to meet again at noon on Thursday, April 2. to clearly define the qualifications job applicants must have and to determine how fho, position. will be advertised. Present were 13 members. The meeting was called to order by Vice -President Mark Schnobrich. We observed a moment of silent prayer. The minutes of the January meeting were read and approved. The treasurer's report was noted. For old business Mrs. Johnson reported that meals will continue to be $2.00. She is not allowed to make a profit without a catering license and does this as part of her civic duty. The council members gave her a hand of appreciation and expressed their satisfaction with all of her meals. It was noted the Hazardous Materials Committee has not met for some time. It is difficult to get all of the members of the committee together. For new business Marlin Torgerson suggested we have a program scheduled for each monthly meeting. He offered to be the program Chairman. John Renyolds moved we adopt this program. Orville Kuiken seconded and the motion carried unanimously. It is recommended that we suggest to our • speakers that they talk for ' hour maximum. Les Linder questioned the traffic patterns of the city, and expressed his concern of busses crossing 5th and Adams and also 5th and Main. It was mentioned that the State sets requirements as to where lights can be placed and that often traffic counts are taken that are averages for a dav--and do not take into consideration 3M "rush-hour" traffic which the bus drivers encounter daily. It is a request of Mr. Linder that the Cit: Council consider a request of the State to place lights at these corner=. It was mentioned that the lights on Hwy 7 by HapPy Chef will be wired as soon as the ground thaws. The meeting was adjourned. Our next meeting will be March 30, 1987 at 12:00 noon at the Fire Hall. Statement: The Hutchinson Police Commission is concerned for the future of the Police Department. It is apparent that the current Mayor and Council are committed to take over control of the Police Department by circumventing Police Commission control of the Police Chief. The very purpose of a Police Commission is to control the level of politics that enter in to a relationship between a Police Department and the power of a Mayor and/or Council. It is our opinion that the Council action to bypass the Commission responsibility of hiring a temporary Police Chief, handling a demotion of an existing department staff member, expresses further the Councils lack of respect for the abilities of the Commission and the need to control an emotional, disgruntled police department. it is our hope and intention to regain control of the police department and hopefully serve the City of Hutchinson as state statue directs. Commissioner Haag also read the following resolution made by the Police Civil Service Commission and addressed to the Mayor and City Council. Resolved that: The Hutchinson Police Commission is on record as opposing the appointment of the interim Police Chief and also the demotion of Nancy Buss. We recommend that the body rescind the appointment and demotion and to work within the rules and regulations of the Hutchinson Police Commission. Meeting was opened to discussion - Several questions were asked and several comments made from the audience regarding: 1. The removal of Nancy Buss from the position of office supervisor. 2. The appointment of Acting Chief of Police Waage 3. The resolution passed by the Hutchinson City Council requesting that a resolution be presented in the State Legislature - such resolution asking that the job of PoliceChief of the City of Hutchinson be removed from Civil Service Commission authority. The Commission stated that they have requested legal opinions from City Attoney Barry Anderson regarding the actions taken by the city council on March 27th. After these opinions are determined, the Commission and the City Council will hold a joint meeting to discuss further policy for the Police Department. Meeting adjourned at 7:00 p.m. Dr. R. W. President Miskoff state that the intended purpose of this meeting was to conduct oral interviews with candidates for Interim Police Chief. All candidates are present employees of the depatment and qualify according to the general qualifications established by the Commission. City Attorney, G. Barry Anderson, made brief remarks concerning the legal and proper conduct of these interviews. He also informed each candidate of the purpose and intent of these interviews and stated that their employment in the City of Hutchinson Police Department would not in any way be affected by their selection or rejection as Interim Chief of Police. Director's report: The statistical report showed a busy month in all locations. The libraries at Stwater, New London and Spicer doubled the circulation figures of February, 1986• 2. A new listing of board members, the LDS newsletter and clippings were passed around. 3. The Raymond library has been open for two weeks. Spicer is looking at a new Glencoe is negotiating purchase of a building for the library since its present building has been sold. Winsted and Hector also may change locations. b. Since the Madison school library was totally destroyed in a fire that burned h fh 3 location. The executive committee approved signing a contract between the Pionserland Library System and the Madison School District for the rest of the school year at a rate of $57.00 per week. The Madison librarian is working 2 to 4 hours extra per week. Requests for materials are heavy at Montevideo with a large increase in photocopying. The school librarian is acting as a liaison between the school and the library. Nelson/$uhr moved payment of the bills. Carried. Mr. Turek, Mrs. Frederickson, Mrs. Quinn and Mr. Sundbarg attended the MLA's annual Legislative Day on February 24 as representatives of the Pioneerland area. Communications: 1. The state aid payment was $18,000 short in January. The check for that amount was received March 6. 2. All but five of the governing units--gandiyohi County, Meeker County, Hutchinson, Ortonville and Hector --have signed the Revised Agreement. There is no deadline. Old Business: 1.
