MONDAY, FEBRUARY 22, 1988
1. The meeting was called to order by Mayor Ackland at 7:30 P.M. The follow-
ing were present: Mayor Paul L. Ackland, Aldermen Mike Carls, John Mlinar,
and Pat Mikulecky. Absent: Alderman Marlin Torgerson. Also present: City
Administrator Gary D. Plotz, Director of Engineering Eugene Anderson and
City Attorney G. Barry Anderson.

There was no invocation due to the absence of a pastor.

CITY COUNCIL MINUTES - FEBRUARY 22, 1988

The Mayor adjourned the meeting at 8:50 P.M. to tour the new police
facilities with the architect and review the problem areas of the
garage and heating system. A mechanical engineer from Thorbeck &
Lambert will attend the next Council meeting to address these issues.
The meeting reconvened at 9:25 P.M.
(b) DISCUSSION OF SHERWOOD STREET SURFACING SOUTH OF CENTURY AVENUE
REQUESTED BY MIKE BECKER (PROJECT NO. 88 -07, SCHMIDTBAUER SECOND
ADDITION)
Mr. Mike Becker requested that the City Council reconsider the street
surfacing project on Century Avenue which was rejected at the last
meeting. He stated he was assessed for paving on Bradford Street ac-
cording to the subdivision agreement. Since he is the only property
owner who will directly benefit from the proposed project, the other
affected property owners objected to being assessed for the surfacing.
If the street is not surfaced, it will need to be regraveled and the
sewer cleaned out because of the dirt that goes into it.
Developer Richard 8chmidtbauer commented that Mr. Becker's road had
been graded for about five years but never biacktopped. This is the
last part of the subdivision that has not been done. He requested the
Council to put in the surfacing which leads to the City park.
Following discussion, Alderman Carls moved to reconsider Project No.
88 -07 by holding a public hearing on March 22, 1988 at 8:00 P.M. and
waive readings and adopt Resolutions No. 8714 and No. 8715, ?lotion sec-
onded by Alderman Mlinar and carried unanimously.
7. RESOLUTIONS AND ORDINANCES
(a) ORDINANCE N0. 4/88 - ORDINANCE AMENDING ORDINANCE NO. 735 OF THE
1974 ORDINANCE CODE OF THE CITY OF HUTCHINSON ENTITLED, "RULES AND
REGULATIONS OAKLAND CEMETERY"
Mayor Ackland expressed concern regarding some of the proposed changes
and requested the second reading be deferred. Alderman Mlinar moved to
table the second reading. Motion seconded by Alderman Mikulecky and
unanimously carried.

The motion was made by Alderman Carls, seconded by Alderman Mlinar, to

The motion was made by Alderman Mlinar, seconded by Alderman Mikulecky,
to waive reading and adopt Resolution No. 8713. Motion unanimously
carried.
8. UNFINISHED BUSINESS
(a) CONSIDERATION OF ESTABLISHING SALARY FOR HUTCHINSON UTILITIES
COMMISSION MEMBERS (DEFERRED JANUARY 26, 1988)
Following discussion, it was the consensus of the Council to continue
paying the Utilities Commission members the same salary as the Council
received. Alderman Carls moved to continue the policy as in the past.
Alderman Mlinar seconded the motion and unanimously carried.
(b) DISCUSSION OF ASSESSING PREVIOUS STORM SEWER COSTS TO TWIN OAKS
SUBDIVISION
Alderman Mlinar moved to defer to March 8, 1988 meeting. Motion sec-
onded by Alderman Carls and unanimously carried.
9. NEW BUSINESS
(a) COASIPERATICN OF DELIAQUENT WATER AND SEWER ACCOUNTS
The motion was made by Alderman Carls, seconded by Alderman Mlinar, to
discontinue service on February 29, 1988 at noon unless other arrange-
ments have been made. Motion unanimously carried.
(b) DISCUSSION OF PARKING LOT ON CORNER OF SECOND AVENUE AND GLEN STREET
City Administrator Plotz reported that the Council minutes of December
27, 1983 reflected authorization for the City to maintain the privately
owned parking lot used for public parking by snow removal and grading
once a year. In addition, a lease was to be prepared; however, there
is no record of a lease.
The City Attorney was directed to prepare a lease between the City and
property owners.
(c) CONSIDERATION OF ESTABLISHING DATE OF MAY 18, 1988 (4:30 F.M.) FOR
BOARD OF REVIEW
A motion was made by Alderman Carls, seconded by Alderman Mlinar, to
approve the date and time for the Board of Review. Motion carried
unanimously.

(d) CONSIDERATION OF PRELIMINARY AND FINAL PLAT OF CASA ADDITION SUBMITTED
BY 70H1 MILLER WITH UNFAVORABLE RECOMMENDATION OF PLANNING COMMISSION
Alderman Mikulecky moved to approve the plat. The motion failed for
lack of a second.
Following discussion, Alderman Carls moved to uphold the Planning Com-
mission's recommendation and reject. Motion seconded by Alderman
Mlinar and unanimously carried.
(e) CONSIDERATION OF AMENDMENT 10 ZONING ORDINANCE #464, SECTION 9 (aB)
SETBACK REQUESTED BY CITY STAFF WITH FAVORABLE RECOMMENDATION OF
PLANNING COMMISSION
Following discussion, the motion was made by Alderman Mikulecky, sec-
onded by Alderman Mlinar, to approve and waive first reading of Ordi-
nace No. 5/88 and set second reading March 8, 1988. Motion unanimously
carried.
(f) CONSIDERATION OF REVISED PRELIMINARY PLAT OF BRECHT RIVERSIDE REQUESTED
BY LOWELL BRECHT (WITHIN TWO MILE RADIUS) WITH FAVORABLE RECOMMENDATION
OF PLANNING COMMISSION
Alderman Mlinar moved to refer to the County with no objection. Motion
seconded by Alderman Mikulecky and carried unanimously.
(g) CONSIDERATION OF LEASING COUNCIL CHAMBERS TO MINNESOTA DEPARTMENT OF
PUBLIC SAFETY FOR USE AS DRIVER EXAM OFFICE ON THURSDAYS
City Administrator Flotz suggested the lease include a provision tr.at
the City would not be required to remodel existing bathrooms to meet
regulations for handicapped accessible and there be a 90 -day cancella-
tion clause.
Following discussion, Alderman Carls moved to approve the lease, with
the two contingencies mentioned by the City Administrator. Motion sec-
onded by Alderman Mlinar and carried unanimously.
(h) CONSIDERATION OF PURCHASE OF UNIFORM ITEMS FOR POLICE DEPARTMENT
During discussion, Police Chief Madson was agreeable to have the cost

City Administrator Plotz commented on the joint Council /County Board
meeting to be held February 24,
Mr. Plotz reported KDUZ had aired a press release from Dakota Rail re-
garding filing of a petition in Federal Bankruptcy Court under Chapter
11. The Shipping Association had scheduled a meeting for February 23,
7:30 A.M., at the Victorian Inn to discuss this issue.

SPECIAL MEETING - HUTCHINSUN CITY COUNCIL
WEDNESDAY, FEBRUARY 24, 1988
Mayor Ackland called the .joint meeting of City Council and County Board to order
at 5:30 P.M. Present were: Mayor Paul L. Ackland, Aldermen Mike Carls, John
Mlinar (left at 7:15 P.M.) and Marlin Torgerson. Absent: Alderman Pat Miku-
lecky. Others present: City Administrator Gary D. Plotz, City Engineer Eugene
Anderson, City Attorney G. Barry Anderson; County Commissioners Milo Kubat�c.h,
Melvin Dose, Shirley Nowak and Lawrence vlendorff; C:ouuty Attorney Micndel Jcnde,
Attorney Dan Prochnow and reYresentatives from Maplewood Academy.
Mayor Ackland introduced the topic of storm sewer drainage in the area of Mault�-
wood Academy. City Engineer Anderson outlined both the City storm sewer in the
area and also county ditch #18.
The Mayor suggested that the Engineer and City Council consider connecting the
outlet from Maplewood Academy on the east side of Highway 15 directly to county
ditch #18, thus bisecting the City storm sewer entirely. It appeared that this
was the most cost effective alternative at this time,
In addition, Mayor Ackland requested that the Engineering Department determine
if county ditch #18, from approximately Griffin Street to Carlisle Avenue, was
functional and, specificly, the capacity and the water intensity of this drain -
age pipe. It was the consensus that once this information was gathered, it
would be placed on the City Council agenda for consideration of addressing the
water problem.
The City and County officials also discussed the county landfill and, specific -
ly, the County indicated that they will be investigating recycling,
The joint meeting adjourned at 7:15 P.M.
The balance of the meeting was a presentation of goals and objectives from the
following Directors: Bruce Ericson, Steve Madson, Eugene Anderson, and Jim
Marka.
It was determined that an appointment of a designated SARA Coordinator be made
at an upcoming City Council meeting.

The Library Board met at 5:00 pm in the library meeting room with the
following members present: Chairman, Ralph Bergstrom, Kathleen McGraw,
Dolores Brunner, Larry Ladd, Bill Scherer, Teri Eilertson, Roxanne Wigen,
Linda Wilmsen and Mary Henke. Absent: Albert Linde, Mike Carls (conflict
- Hospital Board meeting).
* Librarian, `Mary Henke, gave a report on the Arts Festival (Sno -Break
Weekend / February 5 -6 -7th): The display boards made by Bill Scherer at
a cost )f $211.00 (Expenditure was not to exceed $250.00) worked well with
all the artwork fitting easily on the boards, rather than scattered all over
the Library. The Art Guild and Library co- hosted the Art Show with shared
2 -hour work shifts by members. / Mfary commented that approximately 200
visited the show on Saturday, with approximately 65 -70 people on Sunday.
Comments and suggestions were then made by board members. Linda Willmsen
suggested that the Library continue in the effort to improve and expand
with more displays next year. It was also suggested that advertising be
pursued more next year through the Leader ( "Reader ") and Shopper, KDUZ, Chamber,
Cable TV, and the schools. Mary thanked••.all board members for their help.
• Linda Willmsen and Mary Henke informed board members of the availability
and application deadline for a grant through the Southwest Arts and Human-
ities Council which could help purchase displays and help fund publicity
costs. Linda and Mary will be meeting with Mary Beth Rupp regarding the
grant next week. They will follow up with the application and meet the
deadline.
Ralph Bergstrom informed the board that the present 3 -year term of office
of Library Board members is the only city board without the new 5 -year term
of office. In order to keep uniformity among all boards, the motion was
made by Roxanne Wigen and seconded by Dolores Brunner to extend the Library
Board term of office to the 5-year term (Members are limited to two con-
secutive terms of office under the new rule (10 years). The present terms
of office of Albert Linde (board member since 1962) and Kathleen McGraw (1973)
will end in April of this year with their replacements filling the new S -year
term.
• Motion was made at 5:35 p.m. by Linda Willmsen to adjourn. Dolores Brunner
seconded the motion.

Costs to Twin Oaks Subdivision
The Council did, at its meeting on February 9th, 1988, instruct this
department to investigate the feasibility of assessing the downstream storm
sewer cost incurred to serve, among other areas, the Twin Oaks Subdivision.
Such costs from the 1970 project can be assessed in conjunction with
improvement costs that will be incurred in 1988, in accordance with Statute
429.051. Interest can be included in the downstream cost since it is a cost
that the City has incurred, particularly in the case of Twin Oaks, which is
located near (one -half block away) the trunk storm sewer system and where it
has been the owner's decision to forego developing the property until the
present, while interest expenses have continued to accrue.
on the other hand, at the time the property was annexed into the City, the
assessments could have been levied and probably previously collected in their
entirety.
The area in Twin Oaks Addition affected by impending development and public
improvements, is Lot 1, Block 1, which is about 265,716 square feet; the rate
of cost from Assessment Roll No. 33 for the 1970 storm sewer improvement is
$0.038 per square foot. The total City Cost, based on the original 1970
cost, is then $10,097.21. Interest on the 1970 improvement bond was 6 percent.
If interest on the City Cost is computed at 6 percent for the 10 year life of
the bond, and 5 percent thereafter to the present, interest cost would be
$ 9,718.54 , and the total City Cost $ 19,815.75.
Since the 1988 improvements on Texas Avenue adjacent to the subdivision have
been ordered, if the Council wishes to assess the City Cost and part or all
of the interest cost, the proceedings for the 1988 improvements on Texas Avenue
must be initiated by once again adopting a Resolution Calling for the Hearing
on Improvement, which resolution would include the previous City Cost; sending
a revised Notice of Hearing to affected owners; and holding a second
. improvement hearing.

Subd. 6. Percentage payment on engineer's estimate. In case the contracto:
properly performs the work, the council may, from month to month before comple
ton of the work, pay him not to exceed 9D percent of the amount already carne(
under the contract, upon the estimate of the engineer or other competent person
selected by the council. and the contract may so provide.
Subd. 7. Modification of contracts. After work has been commenced on ar
improvement undertaken pursuant to a contract awarded on a unit price basis tlu

Fifth Addition to Lakewood Terrace
An Amended Subdivision Agreement was prepared for the Fifth Addition to
Lakewood Terrace at the request of the Subdivider.
The original agreement prepared in July 1987, and associated sketch, are
attached. That agreement provides for all improvements costs being assessed
to the 15 lots in the subdivision, with no City cost or deferred assessments
due to the unincorporated property east of Honey Tree Road. However, based
on our current cost estimates, the assessment per lot would be $16,800 for
all improvements.
The amended agreement and associated sketch are, also, attached. Improvements
during the period 1988 through 1990 would be constructed on Park Island Drive,
Darrell Drive, and on McDonald Drive as far east as the west right -of -way line
of Loretta Lane. The cost would be assessed to the twelve outlined lots at an
estimated cost for all improvements of $12,200 per lot. Improvements on
Loretta Lane and on Honey Tree Road would be constructed when deemed feasible
by the subdivider and the City, ie. after the property east of Honey Tree Road
is annexed. As stipulated in parts 4,5,7 and 9, the cost therefor could be
assessed to property on both sides of Honey Tree Road and on the east side of
Loretta Lane.
Incidentally, the McDonald's are presently working on plans to provide
right -of -way for the completion of McDonald Drive from Honey Tree Road to
McDonald's Sixth Addition (Jackson Street), which would enhance access to the
Fifth Addition and to developments west.
The Amended Subdivision Agreement would pose less risk to the City because,
with the reduced scope of improvements in the immediate future, there would be
less improvement cost in the unlikely event that the subdivision defaults on
the assessments therefor.
A motion approving the amended agreement is requested.

SUBDIVISION AGREEMENT
FIFTH ADDITION TO LAKEWOOD TERRACE
CITY OF HUTCHINSON, MINNESOTA
THIS AGREEMENT, made and entered into the day and year set forth
hereinafter, by and between Loretta McDonald, hereinafter called the
"Subdivider ", and the City of Rutchinson, a Municipal corporation in the
County of McLeod, State of Minnesota, hereinafter called the "City";
WITNESSETH:
WHEREAS, the Subdivider is the owner and developer of a certain
subdivision known as FIFTH ADDITION TO LAKEWOOD TERRACE, which is located in
the City of Hutchinson, McLeod County, Minnesota, and;
WHEREAS, City Ordinance 464 and 466 requires subdividers to make certain
improvements in the subdivision;
NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS:
1. That a certain document entitled "Subdivision Agreement, Fifth
Addition to Lakewood Terrace, City of Hutchinson, Minnesota "; signed
by Loretta McDonald on the 23rd day of July, 1987; approved by the
Council of the City of Hutchinson on the 28th day of July, 1987; and
signed by the Mayor and Clerk of said City on the 29th day of July,
1987; be and is hereby declared null and void; and the provisions and •
covenants hereinafter contained as they pertain to the aforedescribed
subdivision shall be binding.
2. The Subdivider hereby petitions the City of Hutchinson to construct,
during the 1988 construction season, grading, gravel sub -base,
sanitary sewer, watermain, storm sewer and sewer and water service
leads on McDonald Drive from the West line of the plat to the
extended East line of Lot 29 Block 19 and on Park Island Drive from
McDonald Drive to the South line of the plat. It is understood and
agreed that the total cost of these improvements will be assessed on
a per lot basis in an equal amount to the following lots in the
subdivision: Lots 1 A 2, Block 1; Lots 1 through 51 Block 2; and
Lots 1 through 59 block 3.
3. The Subdivider hereby petitions the City of Hutchinson to construct,
during the 1988 construction season, grading, gravel sub -base and
storm sewer on Darrel Drive from McDonald Drive to the North line of
the plat. It is understood and agreed that the total cost of these
improvements will be assessed on a per lot basis in an equal amount
to the following lots in the subdivision: Lots 1 A 2, Block 1; Lots
1 through 5, Block 21 and Lots 1 through 5, Block 3.

6. The Subdivider hereby petitions the City of Hutchinson to construct,
during the 1989 construction season or later as deemed feasible by
the Subdivider and the City, gravel base, curb and gutter and
is appurtenances on McDonald Drive from the West line of the plat to the
extended East line of Lot 29 block 19 and on Park Island Drive from
McDonald Drive to the South line of the plat; and on Darrel Drive
from McDonald Drive to the North line of the plat. It is understood
and agreed that the total cost of these improvements will be assessed
on a per lot basis in an equal amount to the following lots in the
subdivision: Lots 1 & 2, Block 1; Lots 1 through 59 Block 2; and

7. The Subdivider hereby petitions the City of Hutchinson to construct,
at a time deemed feasible by the Subdivider and the City, gravel
base, curb and gutter on both sides of the street, and appurtenances,
on Loretta Lane from McDonald Drive to the North line of the plat,
and on McDonald Drive from the extended East line of Lot 2, Block 19
to Honey Tree Road, and on Honey Tree Road from McDonald Drive to the
South line of the plat. It is understood and agreed that the total
cost of the improvements will be assessed on a per lot basis in an
equal amount to Lots 6, 7 and 8, Block 3.
The Council for the City of Hutchinson may exercise its authority in
assessing a portion or the entire cost of these improvements on Honey

10. The Subdivider hereby waives all rights to a public hearing and
appeal for the cost of all improvements petitioned for in Paragraphs
19 2, 3, 49 59 69 7 and 8. The waiving of all such rights shall be
binding upon and extend to the heirs, representatives, assigns and
successors of the Subdivision.
11. It is understood and agreed that the Subdivider will make a cash
contribution to the City of Hutchinson Parks and Playground for
FIFTH ADDITION TO LAKEWOOD TERRACE in the amount of 31,737.12, which
contribution is for one dwelling unit per lot. Charges for
additional dwelling units per lot will be due at the time a Building
Permit is issued and the cost will be a000rding to the City Parks and
Playground Contribution Schedule for additional units at the time
said permit is issued.
12. It is understood and agreed that, prior to the installation of
electrical and gas utilities and appurtenances in the platted
easements, the Subdivider will clear any trees and /or debris and
grade the easements to within 6" of finish grade.
13. It is understood and agreed that all electrical and gas lines in
easements that may here to be moved by request of the property owner•
will be relocated at said property owners expense.
14. It is understood and agreed that to fulfill City Policy, two trees
will be provided in the margin (boulevard) of each lot. The
Subdivider or property owner shall purchase from the City and pay one

• half the cost of said trees and the City's portion of the payment for
the trees shall not exceed 110.00 per tree. Said trees shall be

The Subdivider hereby petitions the City to install two trees per lot
and assess the properties in the subdivision, the cost less allowed
City's portion of said oost. Said installation to be included in the
last assessable improvement to be installed for the subdivision. All
trees installed at the time of said last assessable improvement will
be credited to the properties where the trees are located.
Species selection will be determined by the Tree Board. Should the
Subdivider or property owner wish to plant a tree which deviates from
the selected specie list, he /she must present his /her request to the
Tree Board.
The City will, at no charge to the property owner, replace any tree
which dies within one year of the time of planting.
15. This agreement shall be binding upon and extend to the heirs,
representatives, assigns and successors of the parties.
16. It is understood and agreed that it is the responsibility of the
Subdivider to record this agreement at the County Recorder's Office
and that no Building Permits will be issued until said Agreement is
recorded.

RE: Bids for Water Tower Painting
Six bids were received for painting and miscellaneous repairs on the northwest
water tower. The low bid of H 6 H Watertower, Inc., of Sleepy Eye,
Minnesota, was about $21,0000 or 30% below the second low bid. The disparity
in the bids, together with the relatively recent formation of the company,
(within the past 3 years), was a cause of concern. However, although the
company is new, the supervisors and most of the employees are evidently
experienced in the type of work that must be done.
In checking past performance on projects with the owners, including the City
of Aberdeen, SD; Safegaurd Power Tech.; the City of Atwater; and the City of
Farmington, and with the intended paint supplier for this project, it appears
that this contractor has a proven record of cooperation with the owner,
generally completes the work on time, has sufficient well maintained
equipment, and performs quality work.
It is therefore recommended, that the attached resolution awarding a contract
to H 8 H Watertower Inc., be adopted.
The 1988 Water Department budget included $55,000, for the tower project. To
insure adequate quality control during the work, we have requested quotations
from various engineering firms to inspect the project as work progresses.
When quotations have been obtained, we will approach the Council with a
request for authorization to retain an engineering inspector.

Attached are three copies of Change Order No. 5 on the
Hutchinson Wastewater Treatment Facility for review and execution
by the City.
This change allows the Substantial Completion Date of
June 28, 1988 to be extended 21 calendar days to July 20, 1988 for
only the demolition and renovation work at the Raw Water Pumping
Station (East half). The Substantial Completion Date of June 28,
1988 remains unchanged for all other work. The Final Completion
Date for all work remains at August 27, 1988.
Due to the potential late delivery of equipment, the
Contractor has explored several alternatives and is now proposing
a differing sequence of activities at the Raw Water Pump Station
that will better assure that the new WWTF is operable by the re-
quired Substantial Completion Date of June 28, 1988.
Basically in this plan, the Contractor concentrates his
efforts on completing the new west half of the Raw Water Pumping
Station and the new WWTF. After flow is routed through the new
treatment units and tested out, the electrical power to the old
WWTF is cut and the demolition and renovation work in the existing
lift station (future east half of Raw Water Pumping Station) is
completed.
The advantage of this change to the City is
less disruption of the existing treatment plant
the point in time when the new WWTF is ready to
service.

Representatives of the Minneapolis Pollution Control
Agency and the U.S. Corps of Engineers have been briefed on
this plan. They indicated they will concur with the change.
City operations personnel agree that this plan would be less
disruptive to their operations.
Therefore, it is recommended that the City of Hutchinson
approve Change Order No. 5 for a time extension of 21 calendar
days for only the demolition and renovation work at the Raw
Water Pump Station at no change in Contract Price. After
execution, please return two copies and I will return one to the
contractor.

Carr to install a box out in east wall of the west well before this
wall is poured to provide a future opening between the coarse grit
tank in the cast wet well and the west wet well. All pumping pro-
cedures would stay as are until start -up of the new facility.

would be diverted to enter the west end of the screenings room and then
diverted into the west well for pumping over to the new facility.

it was discussed between John Longfellow and R-on Peterson that a
temporary slide gate of some. sort be installed at the outlet of '
the screening -room; so flow could be controlled entering the east
vet well in the event of a high flow situation and avoid flooding
the east wet well. If necessary, flow could go back through the
temporary 240 pipe until flow drops back to-normal.

Upon completion of the demolition and new installation in building
20, both temporary holes would be filled with concrete.
NOTE: G' waterstop. will- >be installed around the new opening and
waterstop plus sealant would be installed in the hole of the
existing wall before pouring the concrete to patch these
two openings.
This is basically the latest scheme which was discussed that has
several advantages for all parties involved..
1. Lack of interruption of the City's plant operations.
2. Lack of risks involved with temporary pumping.
3. Allows more time for late deliveries of equipment.
4. Eliminates the need for temporary wiring to keep the
existing plant operational.
S. In the event of start -up problems at the new facility,
it leaven the existing plant for backup.
At this time we would like to proceed with this procedure. -In the
event that the demolition work may extend past the substantial
completion date, it would have to be clearly stated that the con-
tractors would not ask for compensation for extended time and also
that the City and Donohue not pursue liquidated damages.
This is my understanding of the situation
of what would take place. If you have any
this matter, please contact me.

I have studied the following areas and find that the proposed project is
feasible and recommend it be constructed. If acceptable, I recommend a
hearing be held on the 22nd day of March, 1988. The project entails the
complete reconstruction of 3rd Avenue N.W. from Main Street to T.H. 7.
Curb and gutter and concrete driveways would be constructed on both sides
of the street and geometric improvements would be made as shown on attached
Exhibit "A ". Storm sewer would be installed to intercept runoff and to
improve capacity as shown on attached Exhibit "B ".

1988, a report has been prepared by Eugene Anderson with reference to the

SUBJECT: New Police Facility
It has come to my attention this date that there are no provisions in the
contractor's specifications for installing electrical wiring in the outlets
along the southwest and partial north wall of the training room, located in
the basement of the new facility.
Evidently these outlets were listed on the blueprints as being future use
outlets and therefore will be not be completed by the electrical contractor.
In addition, the outlet openings located on the walls of the exercise
room are also listed as future use outlet openings. These outlets are not as
critical as the training room since the training room will be utilized also as
an emergency operations control center. However, any use of electrical
equipment in the exercise room will be greatly curtailed because of the lack
of wall outlets.
I have checked with the electrical contractor and currently have received
a verbal price of $435.00 to complete the wiring in the training room and the
exercise area if done prior to their departing from the work site. It would
be an additional price if they were required to come back after completing the
initial contract.
Because of this new development this memorandum will serve to request
that this item be placed before the Council and to obtain a decision as to
whether or not the $435 could be funded so that we could have electrical
outlets in the basement of the police facility in the rooms as identified
previously. I would also like to point out that several items previously
approved by the Council will not now be needed and therefore the majority of
the $435 that it would take to wire these two rooms would be covered by the
items that would not be purchased.

THIS .AGREEMENT made and entered into by and between the
• State of Minnesota, Department of Transportation, hereinafter
referred to as the "State ", and the City of Hutchinson,
hereinafter referred to as the "City", WITNESSETH:
WHEREAS, the State has determined that there is
justification and it is in the public's best interest to remove
the existing temporary traffic control signal and install a
permanent traffic control signal with street lights and signing
on Trunk Highway No.. 15 at County Road No. 82 (South Grade
Road) - Cashwise Shopping Center Entrance; and
WHEREAS, it is considered in the public's best interest
for the State to provide a new cabinet and control equipment to
operate said permanent traffic control signal; and
• WHEREAS, it is anticipated that the traffic control
signal with street lights and signing work is eligible for 90
percent Federal -aid Hazard Elimination Safety Funds; and
WHEREAS, the City and State will participate in the
cost, maintenance and operation of the permanent traffic control
signal with street lights and signing as hereinafter set forth;
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
1. The State shall prepare the necessary plan,
specifications and proposal and shall perform the engineering and
inspection required to complete the items of work hereinafter set
forth. Such work as described immediately above shall constitute
"Engineering and Inspection" and shall be so referred to
hereinafter.

• 2. The contract cost of the work or, if the work is
not contracted, the cost of all labor, materials, and equipment
rental required to complete the work, except the cost of
providing the power supply to the service pole or pad, shall
constitute the actual "Construction Cost" and shall be so
referred to hereinafter.
3. The State with its own forces and equipment or by
contract shall remove the existing temporary traffic control
signal and install a permanent traffic control signal with street
lights in accordance with State Project No. 4304 -31 and
Federal -aid Project No. F HES 015 -2(45) on Trunk Highway No. 15
at County Road No. 82 (South Grade Road) - Cashwise Shopping
• Center Entrance. Estimated Construction Cost is $79,500 which
includes State furnished materials. Anticipated Federal -aid
share is 90 percent. Anticipated State's share is 5 percent.
City's share is 5 percent.
4. The State shall install or cause the installation
of overhead signing and shall maintain said signing all at no
cost to the City.
5. Upon execution of this agreement and a request in
writing by the State, the City shall advance to the State an
amount equal to its portion of the project cost. The City's
total portion shall consist of the sum of the following:

• a) The City's share (as specified in Paragraph
3) based on the actual bid price and the
estimated State furnished materials costs.
b) Six (6) percent of its share [Item (a) above]
for the cost of Engineering and Inspection.
6. Upon completion and final acceptance of the
project, the City's final share shall consist of the sum of the
following:
a) The City's final share, based on the final payment
to the Contractor and the actual State furnished
materials costs.
b) Six (6) percent of its final share [Item (a)
• above) for the cost of Engineering and Inspection.
The amount of the funds advanced by the City in excess
•
of the City's final share will be returned to the City without
interest and the City agrees to pay to the State that amount of
its final share which is in excess of the amount of the funds
advanced by the City.
7. The City shall perpetuate an adequate electrical
power supply to the service pad or pole, and upon completion of
said permanent traffic control signal with street lights
installation shall continue to provide necessary electrical power
for its operation at the cost and expense of the City.

0 8. Upon completion of the work contemplated in
Paragraph 3 hereof, it shall be the City's responsibility, at its
cost and expense, to: (1) maintain the luminaires; (2) relamp
the traffic control signal and street lights; and (3) clean and
paint the traffic control signal, cabinet and luminaire mast arm
extensions. It shall be the State's responsibility, at its cost
and expense, to perform all other traffic control signal and
street light maintenance.
9. Any and all persons engaged in the aforesaid work
to be performed by the State shall not be considered employees of
the City and any and all claims that may or might arise under the
Worker's Compensation Act of this State on behalf of said
• employees while so engaged, and any and all claims made by any
third party as a consequence of any act or omission on the part
of said employees while so engaged on any of the work
contemplated herein shall not be the obligation and
responsibility of the City. The State shall not be responsible
under the Worker's Compensation Act for any employees of the
City.
10. Timing of the traffic control signal provided for
herein shall be determined by the State, through its Commissioner
of Transportation, and no changes shall be made therein except
with the approval of the State.

• 11. Upon execution by the City and the State and

completion of the construction work provided for herein, this
agreement shall supersede and terminate Agreement No. 62197M
dated July 7, 1984, between the parties.

Re: Railroad Grade Crossing at MSAS 104 (Bluff Street) and
MSAS 120 (3rd Avenue NW)
Dear Mr. Anderson:
This letter is in response to your request that the Minnesota
Department of Transportation install new surfaces at the rail -
highway crossings at Bluff Street and 3rd Avenue NW in
Hutchinson.
In general, the minimum criteria for consideration of funding
for surface improvements under the federal rail grade crossing
program is (1) an AADT of at least 2500, (2) there are at least
two trains per day travelling over the crossing and (3) the
crossing surface is in poor condition even after a demonstrated
record by the railroad of responsible maintenance.
Although our information indicates that both crossings meet our
criteria for AADT, there is clearly a lack of responsible
maintenance performed by the current and past operators of the
railroads operating over these crossings.
However, more importantly, Dakota Rail has filed a Chapter 11
petition in federal bankruptcy court.
Based on the above information, we do not consider these
crossings potential projects at this time.

RECORDING SUBDIVISION AGREEMENTS - SECOND TIME CHECK

The former engineer provided the farmer City Attorney with all
subdivisions to record at the county. The former attorney stated to
me that all the subdivision agreements were recorded.
Now, we receive the attached letter from Citizens Bank claiming
that McOonalds Second Addition Subdivision Agreement is not recorded.
I hereby request, that you check at the county if all the attached
subdivision agreements are recorded, and if not, do so. Bonnie Baumetz
has copied all the subdivision agreements from the former city engineer's
file, plus enclosed any recent ones from Gene.
I regret this is being requested a second time, however, it is the
only way the staff and council can have a measure of "assurance" on follow -
th ru .

HUTCHINSON FIRE DEPARTMENT
RELIEF ASSOCIATION
Monday, January 4, 1988
The meeting was cassed to order at 8:15 pm. A motion was made and seconded to .
approve the minutes of the previous years' meetings as written and read. Motion
passed.
The results of the Annual Election are as follows; all offices elected by
unanimous ballot.
President: Steve Schramm - 3 year term
Vice Presidents Jim Brodd 3 year term
Trustee: Ed Homan — 2 year term*
Trustee: George Field _ 2 year term **
*A motion was made and seconded to accept Marlin Torgerson's letter of
resignation. Motion passed. This position filled by Ed Homan.
* *This position is 2 years due to the fact thet Steve Schramm was a trustee, his
position as trustee became vacant when he was elected president. His position
filled by George Field.
A motion was made by Eric Smith, and seconded by Jim Brodd to:
1) Allow the Board of Trustees to consider raising the salaries of the
Secretary and Treasurer after evaluating their duties according to the
by -laws. and,
2) Allow the Board of Trustees to consider establishing a salary for
the President after evaluating his duties according to the By -Laws.
A motion was made and seconded to pay for the retired firefighter's steaks for

the Annual Steak Fry out of the Relief Association General Account. Motion
Passed.
Gary Henke gave a preliminary treasurer's report, with the formal report to be
read and discussed on February 1, 1988. Gary noted that we have not yet
recieved a bill for the 1987 Actuarial Report. Gary is also checking into the
possibilities of a Gradual Death Benefit. A motion was made and seconded to
accept the preliminary treasurer's report as read. Motion Passed.

OFFICERS MEETING
Monday, February 15, 1988
Oe meeting was called to order at 9:50 p.m.
Jeff reported the new pump for the Hurst Tool will be mounted in #235 soon.
Brad mentioned there is a problem with the SCBA masks being thrown on the floor
and are being broke and scratched. Please be careful and hang them up after
fires.
A lengthy discussion on what if anything to charge the Farmers Elevator for
their fire. Butch is taking care of it.
There was a lengthy discussion on the new tanker and seeing we do not know what
we want. It was tabled until the March meeting.
Meeting adjourned at 11:17 p.m.

Monday, February 1, 1988
The meeting was called to order at 7:20 p.m. The minutes of the previous
meetings were read and approved.
Gary Henke reported that we have received about $6,900.00 in on the dance so
far.
George Field reported there is a Fire Prevention Conference coming up on
February 26, 27, 28.
It was reported that #237 will be going to Pierce Manufacturing sometime in May.
The rural numbering system is on hold temporarily while we look into some
options.
