A) Education - Doff Moon commented on the Kick Off to the May 6th event.
Dave Mueller will present bike safety issues to the third - fifth grades. Doff
stated there would be approximately 30 Gasses reached.
B) Walking - Rick Larson presented a booklet on Low Impact Activity explaining
the Volkssports. He commented on the participation at the Hutchinson
Volkswalk, noting there were 91 participants in 1994. Rick anticipates an
increase in participation over the next 3 years. He hopes to have a seasonal
walk as well as a yearly event to promote walking.
C) Running - Will Mangum stated he trying to get a running club started in
Hutchinson and has some interest already. He commented it would help to
have interested runners on the committee to get the club off the ground. The
Library has meeting rooms. Will stated St. Cloud has a Gub of 150
members. He would like the first meeting of Hutchinson's Club to be held in
April. Some suggestions were to post the meeting date at 3M, HTI, etc.
D) Biking - John Rodeberg reported on the State Conference stating it was a
very upbeat meeting. He commented on the Helmet Safety Program by the
State and the funding available for helmets. The State will monitor the bike
helmet use in eleven cities.

A. RESIDENT SURVEY
Will stated Utilities can order labels for 5,000 households. Mary Anne
commented on the help needed for preparing the surveys for mailing. A date
was set for March 21, 1995, 6;30 p.m. at the City Center to help with the
mailing.

B. CONSULTANT FUNDING
John reported there is possible funding of $75,000 for a consultant. He also
stated Hutchinson will be receiving $5,000 for Helmet Promotion with a
possibility of $1,000 to $5,000 more. He stated the survey will the task force
with decisions as to a consultant.
Ed Doring reported on funding for the McLeod Trail Foundation to create a
trail along the Crow River to Glencoe.
C. COUNTY RD 12 PROJECT
Al Koglin commented the County Board approved the paving for bike paths
on County Rd. 12 from Hwy 15 to #19. He stated the board would like to
see provision for bike paths in the Comprehensive Plan.
III. NEW BUSINESS
A) "BIKE BONANZA" AND STATE BICYCLE SAFETY HELMET PROMO -MAY
6TH
Dolf Moon commented on the bicycle helmet safety program. He stated the
Bike Bonanza will be held at the Rec Center from 10:00 a.m. to 1:00 p.m.
There will be a $2.00 fee and the event is for both adults and kids. Dolf
stated this will be a family event with a 10 point maintenance check, reflector
program,obstacle course, Public Health booth, Volkssports, running club,
roller blades, etc. in a carnival atmosphere. There will be a pre - registration
through the park and recreation department. Drawings for prizes will be part
of the event. Discussion followed as to the fairgrounds as a rain site. Task
force help is needed. There will be a sign up sheet at the next meeting for
help.
B) B -BOP DAYS - MAY 18TH
Mary Ann explained this event as a promotion of walking, biking, running to
work on May 18th. She stated the Light Traffic Task Force should begin the
promotion for this event. Doff suggested the City Wellness Committee help
in the promotion for city employees. There was some discussion on
promoting the Hutchmobile and taking the bus to work.

C) NATIONAL BIKE SAFETY WEEK
Discussion was to promote Bike Safety Week during the Bike Bonanza.
A) LUCE LINE TRAIL AND BLUFF STREET BRIDGE PROJECT STATUS
John Rodeberg reported that the final paperwork is with the District Engineer.
John stated the DNR Grant has been delayed. The appraisals will be
completed this week. Paving is scheduled to begin in August.
John stated he will be meeting with a consultant on the Bluff St. bridge
project.
John also explained a proposed route to tie in the rec center with the
schools.
0 B) COMMENTS ON COMPREHENSIVE PLAN
John Rodeberg commented on the new update of the city comprehensive
plan. He explained the urban boundary area and the fact the city will be
working with the townships to redefine the boundary. John explained the
input from the Light Traffic Task force could be a one page description of
what the goals are for Light Traffic in Hutchinson.

Meeting called to order by Dennis Kahl at 7:40 p.m..
Members present: Dennis Dahl, Tim Miller, Joe Dooley and Jim Faber.
Members absent: Dave Skaar.
City Staff present: Doug Meier.
Guests present: Tom Parker and Bernie Knutson.
Motion made by Tim Miller and seconded by Jim Faber requesting permission
to allow 3.2% Beer at the Hutchinson Municipal Airport on August 26 -27, 1995,
commemorating the 50th Anniversary of WWII and also the dedication of the
Runway. License to be applied for by Robert Hantge at a later date. Motion
Passed unanimously.
Motion made by Tim Miller and seconded by Jim Faber requesting permission
to close the Hutchinson Municipal Airport during the evening hours of August
lst and 2nd for the Dooley Air Show, in conjunction with the Regional Tractor
Pull being conducted at the McLeod County Fairgrounds. Motion passed unani-
mously.

Prior to the meeting, the new Hutchinson Area Foundation for Health Care video was shown and discussed. This
video will be continuously shown in the new kiosk located in the hallway across from the Hutchinson Medical
center. The kiosk will also have space for brochures and a drop box for donations. Yet to come will be a "you are
here" map of the hospital and medical office building. A brief listing of items over $500 purchased by the
Foundation in 1994 was read to the group, and the board members expressed their appreciation for the work of the

The remainder of the meeting included discussion of quality, improvement regarding delinquent charts and the
group worked through the process of committee reporting and accompanying communication issues.
Question was asked about the information systems plan and whether the new information system will help the
physicians complete their charts. It was noted that the new system may not be helpful because the majority of
issues concern physicians who have not signed their charts.

A. Values Statement. The board learned of possible objections to the acronym representing the revised
organizational values statement as it was presented at the January meeting. Concern was expressed earlier
that the "CHOICE" acronym could be confused with the "pro- choice movement." The Divisional Services
Team reviewed options to change the acronym and made the decision to revise the values statement to •
read "Caring, Holistic, Open, Innovative, Collaborative, Exceptional Services" or "CHOICES." Those
present expressed their support of the revision.
A. Dassel Clinic. The group discussed the Allina plan to build a new medical clinic in Cokato and remove
Paul Francois from the Dassel Clinic. Graves stated he had expected some representation from the Dassel
community but those representatives decided to seek a meeting with the board after the board has
considered Allina's plan. Graves gave a brief history of HCH/BMNH's involvement with the Dassel
Clinic operation, which began when the hospital bought the practice from Dr. Joe Houts upon his
retirement and staffed it with Dr. Craig Belcourt. The hospital brought LifeSpan in to manage the practice.
When Dr. Belcourt left after one and one -half years, we brought in temporary physicians to maintain
staffing of the clinic. While the hospital tried to recruit physicians, we couldn't find a physician to anchor
themselves in the community. The alternative chosen was to recruit a physicians assistant (Paul Francois)
and his wife (Laurie Francois) to staff and manage the clinic, but the HCHBMNH continued to use
LifeSpan as a vehicle to employ them. The Francoises have been aligned with HCH/BMNH but employed
by LifeSpan. The merger between LifeSpan and HealthOne occurred, which resulted in a new company
(first HealthSpan, now Allina) and a group practice organization (GPO) overseeing Allina's regional
clinics. Paul Francois's formal reporting relationship changed to the GPO; however, he wanted to relate
only with Hutchinson (which is outside the GPO). The Litchfield physician clinic merged a few years ago
with the Cokato Clinic and began planning for improved practice within the community. They have added
physicians, services, and now a new building.
Graves asked the board members to keep in mind that the Litchfield Clinic is owned by Allina. Allina
approved the Litchfield Clinic's adding a new clinic facility in Cokato. The Litchfield Clinic is asking the
Hutchinson Medical Center if they are interested in joining forces to jointly staff the Cokato Clinic.

(A.) The dilemma facing our organization is whether we help the Cokato Clinic, beef up Dassel and support
Paul Francois, or compete with each other. The importance of having a northern presence was discussed.
Our organizational focus will be services to customers in the area. It was acknowledged that if we close
the Dassel Clinic, the community will feel they are being left with no medical coverage and Cokato gets it
all. The Hutchinson Medical Center is also discussing the possibility of doing a "Winsted Clinic" deal
with HCHBMNH at Cokato.
Blue prints of the proposed Cokato clinic were shown. The clinic will be on the east side of Cokato, on
Olson Boulevard, and will have 15 offices with room for five practitioners there. There are lots of
unanswered questions at this point as to how the clinic will operate. Litchfield physicians plan to cycle
through.
The Allina timeframe is very aggressive. They anticipate building to begin as early as April or as late as
May and occupancy in February or March. Allina has announced they won't operate clinics in the future
with less than four or more than eight physicians.
Myers shared his belief that this would be a satellite operation which the organization ought to be
interested in supporting because of customers' drive time. This would be an opportunity for Hutchinson to
become a dominant player and bring in new business.
The group's consensus was to meet with a delegation from the Dassel community to listen to their
concerns. Bill Ward, administrator of the Dassel Lakeside Community Home, will be contacted and asked
for dates their group would be available for a meeting.
B. Utilization Management Plan. Revisions in the utilization management plan were presented and each
discussed individually. It was noted that changes were made to reflect current practice and meet JCAHO
standards.
Following discussion:
Motion was made by Myers, seconded by Slanga, to approve the revised utilization management
plan as presented. All were in favor. Motion carried.
C. Funded Depreciation. A proposal to open an investment designated by Medicare as funded depreciation
was reviewed. This account will build income and still allow us to gain better reimbursement through
Medicare. Tusa credited the City Finance Director for the investment tip. He noted an investment like
this usually pays in the 7 -7.5% range but we will receive a higher S.15% in interest and continue to
diversify our investment portfolio.

Motion was made by Erickson, seconded by Daggett, to approve the investment as proposed. All

D. Parking at Technical College. It was learned that the Hutchinson Technical College (HTC) is considering
construction of a housing complex on its east side. They are requesting to use the City's bonding authority
to finance the project The college is not in a position to fund the construction, and its foundation is
unable to help them at this time.
HCH/BMNH is looking at this as an option to ease cramped HMC parking conditions. Because property is
at a premium, HCH/BMNH management will continue dialogue about purchasing up to three quarters of
an acre. HCH/BMNH's goal would be to align the entrance with an entrance on the south side. Covenants
restricting the sale of the property were discussed. A maximum of 45 parking stalls and a minimum of 23
parking stalls are being contemplated. This was presented for information only at this time.
President's Repg . Graves presented a legislative update to the board: He shared that the Republican agenda and
the balanced budget amendment introduced may help us as taxpayers ultimately but as healthcare providers, the
majority of cuts to achieve the balanced budget would come from the Medicare and Medicaid programs.
Information was also shared regarding the MinnesotaCare 2% provider tax. In the fust few years, more money
would be paid in from the providers; however, by the late 1990s, more money would be paid to the providers as a
result of more lives being covered.
Senior Care Report. Richards relayed he would be presenting the annual long -term care report and the annual
safety management report at the next monthly meeting.
Accounts Payable. The January, 1995, listing of accounts payable was presented. Following discussion: !
Motion was made by Daggett, seconded by Erickson, to approve for payment the attached
listing of accounts payable and cash disbursements in the amount of 5997,008.52. All were
in favor. Motion carried.
Statistical Report. The revised statistical report for January, 1995, was distributed and discussed. The hospital had
229 admissions during the month of January, 21 above budget, with an average daily census of 24.8. Census days
were 770, up from a budget of 752; average length of stay was 3.1 days, down from a budget of 3.6; percentage of
occupancy was 41.4, up from a budget of 40.4. %.
The nursing home percentage of occupancy was 93.03% with a case mix of 2.37.
Financial Reps. The organization realized a gain of S138,224 for the month of January.
Auxili= Meeting Minutes. Minutes of the February hospital auxiliary meeting were presented. No unusual
comments were made.

10.15 shall read as follows:
Subd. 1 Definitions. All rights of way running
generally in a northerly or southerly direction shall be identified
as streets while all rights of way running generally in a easterly
or westerly direction shall be identified as avenues. Cul de sacs
shall be identified as courts or circles. All rights of way shall
be identified with directional calls as well.
Subd. 2. Administration. The zoning administrator shall
be responsible for addressing buildings and identifying streets.
The administrator shall consult with the Chief of Police, the City
Engineer and the United States Postmaster assigned to the
Hutchinson district in the process of addressing buildings and
identifying streets. Any change in existing street names, other
than by addition of descriptive terms such as "street" or "avenue"
or directional designations, shall be accomplished by resolution of
the City Council of the City of Hutchinson.
Subd. 3. Property Owner Responsibility. The property
owner shall number each principal structure located on the property
using numbers which contrast with the background and are at least
four inches in height and displayed in such a fashion so as to be
plainly visible and legible from the street. Accessory structures
need not be addressed. Condominiums, cooperatives, duplexes and
other buildings where units are individually owned shall be
individually addressed. Apartment buildings and other rental
structures shall be assigned a single address with each unit
thereafter receiving a number designation in addition to the street
address. The Zoning Administrator shall have the authority to
issue addresses in circumstances no covered by or inconsistent with
this ordinance, for good cause shown. Any property owner aggrieved
by the decision of the Zoning Administrator may appeal the decision
to the City Council.
Section 2. City Code Chapter 1 entitled "General Provisions

Attached for your consideration is Ordinance No. 95 -145 adopting the 1995 MN State
Building Code, and Resolution No. 1 0424 amending Building/Zoning/
. Planning fee schedules.
As you will recall, fee schedules were briefly reviewed with my "94" year -end report. As a
practical matter, the proposed fee changes are minor, as itemized below:

1) Fence permits - moved from valuation to a $20.00 fixed fee, plus 50 cents
surcharge and a $10.00 excavation permit Based on a $500.00 value - This
represents a $5.00 increase.
2) Mobile/Manufactured Home Installation - proposed increase from $25.00 to
$50.00, plus 50 cents surcharge.
At first glance this appears to be a 100% increase, however please keep in mind that a
natural gas piping inspection manometer test alone is $50.00. Additionally, the
permits must be filed and recorded, and a blocking/strapping/plumbing waste, and
water line connection inspection must be completed. Many times two inspection trips
are necessary.

3) Annexation Fees - proposed increase to cover mapping, publishing, notices, and
recorder filing. The present fee at $135.00 minimum, $5.00 per acre, and $635.00
maximum is inadequate. Of that fee, only $35.00 is retained by the City. The
remaining $100 - $600 is forwarded to the State of Minnesota Municipal Board.
As a practical matter, most larger scale annexations will be initiated and financed by
the City. Our recommended fee schedule for annexation is as follows:

AN ORDINANCE ADOPTING THE 1995 MINNESOTA STATE BUILDING CODE. THIS
ORDINANCE: PROVIDES FOR THE APPLICATION, ADMINISTRATION, AND
ENFORCEMENT OF THE MINNESOTA STATE BUILDING CODE BY REGULATING
THE ERECTION, CONSTRUCTION, ENLARGEMENT ALTERATION, REPAIR,
MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE,
HEIGHTS, AREA, AND MAINTENANCE OF ALL BUILDINGS AND /OR STRUCTURES
IN THIS MUNICIPALITY; PROVIDES FOR THE ISSUANCE OF PERMITS AND
COLLECTION OF FEES THEREOF; PROVIDES PENALTIES FOR VIOLATION
THEREOF; REPEALS ALL ORDINANCES AND PARTS OF ORDINANCES THAT
CONFLICT THEREWITH.
The City of Hutchinson does ordain as follows:
Section 1. Application, Administration and Enforcement. The application, administration,
and enforcement of the code shall be in accordance with Minnesota Rule part 1300.2100 and as
modified by Chapter 1305. The code shall be enforced within the extraterritorial limits permitted
by Minnesota Statute 16B.62 subdivision 1 when so established by ordinance.
The code enforcement agency of this municipality is called the City of Hutchinson
Building/Zoning/Planning Department.
A Minnesota Certified Building Official must be appointed by this jurisdiction to administer the
code (Minnesota Statute 16B.65).
Section 2. Permits and Fees. The issuance of permits and the collection of fees shall be as
authorized in Minnesota Statute 16B.62 subdivision I and as provided for by separate resolution
and Minnesota Rules parts 1305.0106 and 1305.0107.
Permit fees shall be assessed for work governed by this code in accordance with resolution
number 10424 . In addition, a surcharge fee shall be collected on all permits issued for work
governed by this code in accordance with Minnesota statute 16B.70.
Section 3. Violations and Penalties. A violation of the code is a misdemeanor (Minnesota
Statute 16B.69).
Section 4. Building Code. The 1995 Minnesota State Building Code, established pursuant to
Minnesota Statutes 16B.59 to 16B.75, is hereby adopted as the building code for this jurisdiction.
The code is hereby incorporated in this ordinance as if fully set out herein.

WHEREAS, the Building/Planning/Zoning Department of the City of Hutchinson has

WHEREAS, cost has been determined for the improvement of Harmony Lane and Lincoln Avenue by
construction of sanitary sewer and services, watermain and services, storm sewer, grading, gravel base, bituminous
base and surfacing and appurtenances, and the bid price for such improvement is $276,403.30 and the expenses
incurred or to be incurred in the making of such improvement amount to $66,336.79, so that the total cost of the
improvement will be $342,740.09.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HUTCHINSON, MINNESOTA:
1. The portion of the cost of such improvement to be paid by the City is hereby declared to be $178,803.09
and the portion of the cost to be assessed against benefitted property owners is declared to be $163,937.00.
2. Assessments shall be payable in equal annual installments extending over'a period of 10 years, the fast
of the installments to be payable on or before the first Monday in January, 1996, and shall bear interest at the rate
of 10 percent (+ or -) per annum from the date of the adoption of the assessment resolution.
3. The City Administrator, with the assistance of the Director of Engineering, shall forthwith calculate the
proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land
within the district affected, without regard to cash valuation, as provided by law, and he shall file a copy of such
proposed assessment in his office for public inspection.
4. The City Administrator shall, upon the completion of such proposed assessment, notify the Council

Richard Seipel has held a transient merchant permit since 1991 to allow him to sell fresh produce •
within the city limits.
Again this year, Mr. Seipel is requesting a permit to sell his farm products on the vacant lot across
from Hardee's which is owned by North Central Food Systems. He has permission to use this
commercial property during the summer months.
In the past, there have been no complaints or problems with Mr. Seipel's business operation.
Therefore, it is recommended that the transient merchant permit be issued.

Dear John:
It is my understanding that you are presently considering an offer
of employment elsewhere. I have been authorized to extend to you
a counter offer consisting of an adjustment in salary to $64,000.00
annually plus a car allowance of $200.00 per month.
As you know, only the City Council for the City of Hutchinson has
the authority to formally extend the offer described above and I
would anticipate that we would include this item on the consent
agenda for the City Council meeting scheduled for April 11. As you
may also know, the Council will need to amend the pay plan in some
form to permit this adjustment.
I hope this information is helpful to you in making your decision.

Attached please find a petition from approximately 200 residents requesting that
sidewalk be installed adjacent to Linden Avenue SW, and Harrington and
Sunset Streets adjacent to the City Civic Arena and Rec Center. We have
proposed this work the last two years, but removed these items due to the high
demand for other projects. At this point we have this work on next year's
project schedule.
We agree with the petitioners that sidewalks are necessary in this area, and
recommend that the City Council agree to include this work in the 1996
Improvement Program.

Section I. City Code Section 5.40 entitled "Liquor License
Required" is hereby amended as follows:
(T)he City may issue annual on sale liquor licenses only to
restaurants and clubs or congressionally chartered veterans
organizations, provided that liquor sales are to be made only
to members and bona fide guests. The City, at the option of
the City Council, may also issue joint beer and wine licenses.
Section 2. City Code Chapter 1 entitled "General Provisions
and Definitions Applicable to the Entire City Code Including
Penalty for Violation" and Section 2.99 entitled "Violation a
Misdemeanor" are hereby adopted in their entirety, by reference, as
though repeated verbatim herein.
Section 3. This ordinance shall take effect upon its adoption

THE URBAN BOUNDARY DISTRICT
According to Minnesota Statute 462.358...
1. By resolution to the County Auditor from a city, county or town, a board
can be established to exercise planning and land use control authority in the
unincorporated area within two miles of the corporate limits of a city.
2. Upon the request of more than one county or town board with respect to the
unincorporated area within two miles of the corporate limits of a single city, like
•
Hutchinson, the parties may create one board rather than a separate board for each
county or town, with equal membership from each affected governmental unit.
3. The board shall have members in a number determined by the city, county and
town(s). Each governmental unit shall have an equal number of members who shall
be appointed from the governing bodies of the city, county and town(s).
4. The board shall serve as the governing body and board of appeals and adjustments for
purposes of Minnesota Statutes sections 462.351 to 462.364 within the urban
boundary district or two mile radius, whatever is designated by the joint board.
5. The board shall have all of the powers contained in sections 462.351 to 462.364
(planning/zoning/subdivision regulations/etc.) and shall have the authority to adopt
and enforce the uniform fire code promulgated pursuant to section 299F.011 and the
building code.
6. The city shall provide staff for the preparation and administration of land use controls
unless otherwise agreed by the governmental units.

What can all the parties gain from the establishment of a
*Joint Planning Board?
1. Improved communications between the City of Hutchinson, McLeod County, and the
four townships - Acoma, Hassan Valley, Hutchinson, and Lynn.
2. Better informed public officials who are able to address and effectively plan and
coordinate engineering feasibility studies to expand services and land use planning.
3. Better planning practices within the urban boundary district. The joint board will
work to prepare a comprehensive plan of the area based on the trends and activities in
the city and the townships. More important, the board will actively enforce and
execute the plan. This will lead to more proactive planning rather than knee -jerk
reactive planning.
4. Better development should result from the recommendations of the comprehensive
plan and by establishing practical subdivision regulations.
•5. Consistent interpretation and enforcement.
6. Convenient for property owners and applicants. It will no longer be necessary to
travel to the courthouse in Glencoe to make application or to attend hearings or
meetings. Presently, applicants must appear before three (3) government agencies -
city, county and township.
7. Could be a fee generator for the governments represented.
8. The City is not planning to annex additional property in the near future. Quality
development of properties should decrease the need for the City to annex areas to
provide them with services on an emergency basis. Annexations will be initiated by
the City only when they are necessary and practical.
9. The Joint Planning Board can be instituted on a trial basis if so desired by the
represented governments. The City would like to see that the Board is in place for at
least a period of one year.
10. Revision to the Urban Boundary District can be reviewed and amended as

needed on an ongoing basis.

Enclosed please find an Order extending for 150 days the City's time to review the rates
recently submitted by Midwest CableVision. This Order should be addressed and adopted at the
• City Council's next meeting on April 11. In the event an Order extending the review period is
not passed, the submitted rates will be deemed accepted 30 days after the City received the rate
request; i.e. the rates will become effective on or about April 15, 1995.
After the City extends its time to review Midwest's rates, we will need to determine how
closely the Company's requested rates should be scrutinized. Very generally, the Company has
submitted a "cost -of- service" rate justification which requests a basic tier rate which exceeds the
FCC "benchmark" rate by $1.23. Because this is a fairly substantial deviation, some review of
the requested rates is advised.

REGARDING THE TOLLING OF THE EFFECTIVE DATE OF THE
RATES SUBMITTED BY INTERMEDIA PARTNERS ON BEHALF OF DD
CABLE HOLDING, INC. D /B /A MIDNNTST CABLEVISION TO THE
CITY OF HUTCHINSON
WHEREAS, the City of Hutchinson (hereinafter "City") is certified as a rate regulatory
authority pursuant to rules of the Federal Communications Commission (hereinafter "FCC "),
WHEREAS, the City has notified Midwest CableVision (hereinafter "Company ") that the
Company is subject to the rate regulatory authority of the Commission,
WHEREAS, the Coriumssion has received from the Company FCC Forams 1220, 1205,
and 1200, on or about March 15, 1995,
WHEREAS, the Company has elected to rely on a cost -of- service showing rather than
the primary benchmark approach to setting cable service rates,
WHEREAS, the Company, in electing the cost -of- service approach, has thereby requested
of the Commission that the Commission determine the Company's reasonable rates pursuant to
• a cost -of- service proceeding,
WHEREAS, the Commission has determined that it needs additional time to evaluate the
cost -of- service filing and documentation,

WHEREAS, the additional time is required to solicit, receive and analyze information
related to the Company's cost -of- service rate filing, and to allow for review of the rate filing by
Commission staff and consultants, and to determine the reasonable rate.
NOW, THEREFORE, IT IS HEREBY ORDERED by the City of Hutchinson that the
initial thirty (30) day period for the review of the submitted rates is hereby tolled for an
additional one hundred fifty (150) days.
FURTHER, that this Order shall be effective immediately, however, the tolling period
shall not begin until the expiration of the initial thirty (30) day period.

Jim P. asked if we could put the 1" responder patches on the uniforms. Chief Emans approved.
Tom P. requested that the pump be put back into 2338. All approved.
Duane H. talked about a MIMS (Minnesota Incident Management System) class that could be
taught in the Hutchinson area. Duane +Hill get back to the officers.
Brad E. announced that the 3M tour and steak fry will be April 10, starting at 5:00 P.M.
Brad E. reported that Ryan Huls has been granted a leave of absence until July 7, 1995.

I believe you have received Morgan Godfrey's letter of March 31,
1995. I echo his sentiments. Additionally, as you know from other
correspondence that you have received, the League Trust has
withdrawn its prior offer to pay for legal services on this matter
because all non contract issues have been resolved and the only
question that remains is a contract dispute between Junker and the
City. This is the issue of whether or not there was a contract,
and if so on what terms, for the hauling of garbage from the
wastewater treatment facility.
Morgan has requested a closed meeting for April 11, 1995 and I
would request that you have the Mayor issue a written notice for a
closed meeting, preferably at 6:30 P.M., but if not than,
thereafter at the close of the meeting.
If this case can be settled for less than $12,000 as Godfrey's most
recent correspondence seems to indicate, then from an economic
standpoint, there would be little reason to continue this nonsense
and this matter should be resolved as soon as possible. It is my
judgment that the League Trust is not going to be willing to
contribute one half of the settlement amount as we have been able
to persuade them to do in the past because there are no damages
left in this case that are covered under the policy of insurance.
The fact that they have withdrawn their offer of defense in this
matter is an indication of how strongly they feel about the matter
and I think it very unlikely that they will agree to make any
payment in this regard.

However, if we are agreeable to resolving the matter, it might make
sense to request as part of the settlement that they cover all of
the attorney's fees and expenses relative to wrapping the matter up
including preparation of the appropriate settlement documents. This
concession might be worth a few hundred dollars or perhaps even a
little bit more.

I would appreciate it if you would pass along this correspondence
to the City Council for the City of Hutchinson.
As you know, the one unresolved property interest left from the
airport project concerned the access road acquired from Mr. and
Mrs. Svanda. As you may or may not remember, an order was issued
in January, 1994 allowing the City to complete a quick take which
was subsequently completed on or about June 27, 1994 with payment
in the amount of $1700 was forwarded to Attorney Frankman who
represents Mr. and Mrs. Svanda.
Settlement negotiations were ultimately not successful. The City
at one point offered approximately $2500 plus the cost of a curb
cut (another $1,000 or so), but this was not accepted by Mr. and
Mrs. Svanda.
At trial in connection with this matter Mr. and Mrs. Svanda
requested an award of approximately $12,500 plus costs. The City
presented, to the three commissioners who made up the eminent
domain panel in this case, evidence suggesting that the maximum
award ought to be approximately $2500, plus the $500 owed to the
land owner under state and federal law for the appraiser's fee.

The debate in this case was over whether or not the City should
receive credit for having previously offered access to Mr. and Mrs.
Svanda should they desire to develop the property. As you may or
may not recall, because the City now has access to the airport, it
is unlikely that the Minnesota Department of Transportation will
allow an additional access anywhere along Highway 15, on the
frontage owned by Mr. and Mrs. Svanda.
Apparently, the commissioners were satisfied that the City was
likely to grant access at some point to Mr. and mrs. Svanda and did
not award much, if anything, in additional damages to Mr. and Mrs.
Svanda since the total award in this case was $4,000 plus the $500
appraiser's fee.
I believe this has to be considered an excellent result for a
condemnation proceeding and this award should be put in line for
payment and approval by the Council at the first meeting in April.
It should be noted that David Lorene, the appraiser hired 1* the
City in connection with this transaction, made a very nice
presentation and I think made an excellent witness. He testified
in a very even handed fashion and I think his work is at least a
partial reason for the excellent result in this case.
