TREE BOARD: SCOTT PETERSON The motion was made by Councilman Erickson, seconded by Councilman Lenz and unanimously carried, to order report and minutes filed, to issue licenses, and to ratify appointments. • 5. PUBLIC HEARING - 8:00 P.M. (a) LETTING NO. 2, PROJECT NO. 93 -02 (SCHOOL ROAD) Mayor Ackland called the hearing to order at 8:00 P.M. and read the notice of hearing for project No. 93 -02. Engineer Rodeberg reviewed the project location between McDonald Drive and South Grade Road. The roadway will go from a rural to urban section. A sidewalk is proposed to go past the elementary school. The Engineer reported the assessments would be in the range of $95 - $100 per foot for the improvements. It was noted the City did not plan to assess Loretta McDonald's property since it is unbuildable wetland. Engineer Rodeberg reviewed the payment of assessments over a 10 -year period. Dean Braulick, 1400 McDonald Drive, wondered if the . property owners on McDonald Drive or the school would be taxed for the project. The City Engineer responded the assessments would be to the school property, Vineyard Methodist Church, and some personal property. Rev. Robert Gamble, pastor of Vineyard Methodist Church, asked if the church would be assessed for the water line. They already have water coming in from one side. He also inquired if the sanitary sewer would run along South Grade Road. He stated it would save the church many dollars if the church could hook on at South Grade Road. Engineer Rodeberg stated there would be no assessment to the church since the water lines are all around the property. The City was proposing to build the sanitary sewer line up to South Grade Road so he would work with the church on options available. Jeff Bennin, 745 Wagner Street, wondered if there was proposed building in the wetland area. The City Engineer noted the City was storing some • 2 11 CITY COUNCIL MINUTES - FEBRUARY 9, 1993 material there at present, but it will be removed by next year. The wetland area is not supposed to be filled. The fill is on high ground and is permitted. The motion was made by Councilman Erickson, seconded by Councilman Torgerson and unanimously carried, to close the hearing at 8:15 P.M. Councilman Torgerson moved to approve and to order the improvement and preparation of plans and specifications, and to waive reading and adopt Resolution No. 9892. Motion seconded by Councilman Erickson and unanimously carried. (b) LETTING NO. 6, PROJECT NO. 93 -09 - 93 -13 Mayor Ackland called the hearing to order and read the notice of hearing for projects No. 93 -09 - 93 -13. Project No. 93 -09 Engineer Rodeberg stated the project would be for construction of bituminous wear course and appurtenances in the Wagner Development Plats 1 & 2, Stillings -Hoeft Addition, Priebe Addition, and School District Plat. The typical assessments will be $450 - $620 per lot. Kevin Cowles, 1105 Goebel Street, asked if the assess- ments would be based on the original subdivision agree- ment prior to when the School District Plat was prepared. He inquired about the timeframe for the project. The City Engineer responded the City would do wear course paving in the spring. He planned to follow the subdivision agreement as much as possible. Project No. 93 -10 Engineer Rodeberg noted the typical assessments for wear course paving in Schmidtbauers Fourth Addition would be $450 - $620. Raymond Otto, 75 10th Avenue NE, requested the project be delayed until fall. The City Engineer noted nothing was legally binding until after the public hearing was held. He noted that this project could be the last scheduled, so it would not • affect housing construction. 3 CITY COUNCIL MINUTES - FEBRUARY 9, 1993 Project No. 93 -11 Engineer Rodeberg stated the subdivision agreement would determine the assessments on the project for North Oak Ridge and Hellands Third and Seventh. No one was present to be heard regarding the project. Project No. 93 -12 Engineer Rodeberg explained the typical assessment for Plaza Heights (blocks 3, 4, 5, & 6) would be $1,200 - $2,500. No one was present to be heard regarding the project. Project No. 93 -13 Engineer Rodeberg reported the typical assessment for Mac's Bluff would be $2,600 - $4,500. No one was present to be heard regarding the project. The motion was made by Councilman Lenz, seconded by Coun- • cilman Torgerson and unanimously carried, to close the hearing at 8:27 P.M. (d) DISCUSSION BY SHARON DEZIEL OF MULTIPLE SCLEROSIS SOCIETY OPERATING PULL TABS AT HUTCH BOWL Sharon Deziel requested approval to put pull tabs in the Hutch Bowl. The City would receive 10 percent directly from the income of the pull tabs, and the funds could be used for worthwhile projects in the community. Attorney Anderson recommended the City Administrator talk to the other license holders. Then the topic would be discussed again at the March 9, 1993 Council meeting. (e) DISCUSSION OF DOLLAR RAISE IN MIDWEST CABLEVISION FEES Following discussion, Councilman Torgerson moved to reject the one dollar fee increase and to refer to City Attorney regarding the legality of the increase. Motion seconded by Councilman Lenz and unanimously carried. 7. RESOLUTIONS AND ORDINANCES (a) RESOLUTION NO. 9887 - RESOLUTION FOR PURCHASE The motion was made by Councilman Torgerson, seconded by Councilman Lenz and unanimously carried, to waive reading and adopt. • (b) RESOLUTION NO. 9888 - RESOLUTION RELATING TO FINANCING A WATER STORAGE TOWER TO BE UNDERTAKEN BY THE CITY OF HUTCHINSON; ESTABLISHING COMPLIANCE WITH REIMBURSEMENT BOND REGULATIONS UNDER THE INTERNAL REVENUE CODE The motion was made by Councilman Erickson, seconded by Councilman Torgerson and unanimously carried, to waive reading and adopt. (f) ORDINANCE NO. 93 -74 - AN ORDINANCE AMENDING ZONING REGULATIONS IN THE CITY OF HUTCHINSON AND THE OFFICIAL ZONING MAP (HTI PROPERTY) The motion was made by Councilman Erickson, seconded by Councilman Torgerson and unanimously carried, to waive second reading and adopt. 8. UNFINISHED BUSINESS (a) CONSIDERATION OF SUPPLEMENTAL CONSULTANT AGREEMENT WITH SHORT ELLIOTT HENDRICKSON INC. FOR ADAMS STREET /TH 22 RECONSTRUCTION (DEFERRED JANUARY 26, 1993) City Engineer Rodeberg presented a report on the project. He suggested terminating the SEH agreement and allowing MN /DOT to do the project according to their schedule. • Engineer Rodeberg will meet with MN /DOT officials and report back to the Council. A petition was received by the Council which contained 50 signatures out of 66 property owners opposed to the Adams Street project. No action was taken, and Engineer Rodeberg will report back to the Council at a future meeting. (b) DISCUSSION OF COUNTRY CLUB TERRACE MOBILE HOME PARK Director Randy DeVries reviewed the MVTL Laboratories wastewater survey of flow data for the Country Club Terrace Mobile Home Park which covered the period of January 29 to February 5, 1993. He stated the purpose of the flow study was to monitor the wastewater discharged from the Country Club Terrace trailer court. No action was taken. The City Attorney will meet with Director DeVries, Bill Block, and Mr. Block's attorney next week to discuss the issue. 4 0 • CITY COUNCIL MINUTES - FEBRUARY 9, 1993 9. NEW BUSINESS (a) CONSIDERATION OF RECOMMENDATION FOR PURCHASE OF POLICE DEPARTMENT VEHICLE During discussion, it was the consensus of the Council that acceptance of the second lowest bid from Plowman Ford justified the $446 difference in cost of the low bid by the time and expense incurred for City employee(s) to drive back and forth to Superior Ford in Plymouth for service on the vehicle. The motion was made by Councilman Torgerson to accept the quote from Plowman Ford for $14,114.00 for the police car. Motion seconded by Councilman Erickson and unani- mously carried. (b) CONSIDERATION OF APPROVAL FOR USE OF VACATED OLD FIRE STATION BUILDING Following discussion, Councilman Lenz moved to have City staff review use of the old fire station building and bring back suggestions. Motion seconded by Councilman Torgerson and unanimously carried. (c) CONSIDERATION OF WORKERS COMPENSATION INSURANCE CHANGE Insurance agent Dennis Potter presented the workers' compensation retrospective rating program of the League of Minnesota Cities Insurance Trust. He recommended the City change from its current guaranteed cost plan to the League's conservative retrospective rating plan to be effective February 1, 1993. Following discussion, Councilman Erickson moved to approve the terms of the League of Minnesota Cities Insurance Trust, effective February 1, 1993. Motion seconded by Councilman Torgerson and unanimously carried. (d) DISCUSSION OF ADAMS STREET (TH 22) COOPERATIVE AGREEMENT WITH MN /DOT This item was deferred (see 8 -a). (e) CONSIDERATION OF AIRPORT CONSULTANT AGREEMENT WITH TKDA REGARDING AIRPORT CONSTRUCTION SERVICES Engineer Rodeberg stated the TKDA supplemental agree- ment for construction services and contract closeout was 5 CITY COUNCIL MINUTES - FEBRUARY 9, 1993 necessary to proceed with the airport improvements. • Following discussion, Councilman Lenz moved to approve the supplemental agreement with TKDA. Motion seconded by Councilman Torgerson and unanimously carried. (f) CONSIDERATION OF SUPPLEMENTAL AGREEMENT FOR OTTER LAKE (CROW RIVER) SEDIMENT ANALYSIS WITH BARR ENGINEERING The City Engineer reported Barr Engineering's Phase I project expenditures will total $14,000. They are requesting an additional $4,500 to include sediment core sampling and analyses, for a total of $18,500. Following discussion, Councilman Torgerson moved to approve the agreement with Barr Engineering. Motion seconded by Councilman Lenz and unanimously carried. (g) CONSIDERATION OF SETTING PUBLIC HEARING DATE FOR INTOXICATING LIQUOR LICENSE APPLICATION FROM DAVID M. SOWERS AND RICHARD S. BLACK FOR THE FLYERS /HI TOPS BAR & GRILL During discussion, it was the consensus of the Council to inform the current liquor license holder to submit a . notice of intent to surrender his liquor license before the hearing. Also, the applicants will be notified of the requirement to have a restaurant license by the date of the public hearing. Following discussion, Councilman Torgerson moved that the applicants have a restaurant license in hand at the time of the public hearing on February 23, 1993, at 8:00 P.M. Motion seconded by Councilman Lenz and unanimously carried. 10. MISCELLANEOUS (a) COMMUNICATIONS FROM PSI RECYCLING Gary Bergemann submitted an application for a temporary recyclable material collection license. Following discussion, Councilman Lenz moved to deny the license. Motion seconded by Councilman Torgerson and unanimously carried. (b) COMMUNICATIONS FROM CITY ATTORNEY Attorney Anderson presented a Findings regarding Junker 6 0 CITY COUNCIL MINUTES - FEBRUARY 9, 1993 litigation which required Council approval. Since Junker Sanitation Services did not file any further appeals on the first lawsuit, he was confident the lawsuit was near completion. The motion was made by Councilman Erickson, seconded by Councilman Lenz and unanimously carried, to approve the findings. The City Attorney reported the appraisal on the Sheppard property had been received. He will present it at the next Council meeting. (c) COMMUNICATIONS FROM DIRECTOR OF FINANCE Director Kenneth B. Merrill reported on a telephone call regarding Erickson's quote for the liquor store cooler. Since there was no communication on the height of the cooler, a 10 foot cooler at $30,000 was ordered instead of the authorized 6 foot cooler at $26,000. It was the consensus of the Council to honor the quoted price from Erickson's for the approved cooler. Mr. Merrill stated a tire recycling day will be held in Hutchinson on April 17 and in Glencoe on April 24 by BFI Tire Recyclers. There will be a nominal charge for each tire dropped off. The Council was reminded of upcoming meetings with the HCDC Board at 7:00 P.M. and the Utilities Commission at 8:15 P.M. on February 22 at the Hutchinson Community Hospital Conference Room. It was reported the City's vision statement had been prepared by Kathleen Skarvan. It will be reviewed by the directors on February 16. Since the Finance Director was not able to present his annual report, Councilman Lenz moved to hold a special meeting February 23, 1993 at 6:00 P.M. for the Finance Director and City Administrator's annual reports. ACKLAND Mayor Ackland stated he attended the Pioneerland Regional Library System meeting in Glencoe on February 8. The Mayor requested the City Attorney to prepare an amended ordinance regarding the number of members serving on the Hospital /Nursing Home Board. 11. Building Official Jim Marka explained planning staff talked to Wigens in regard to including their property in the rezoning. Mr. Craig representing Hutchinson Technology presented sketches of the site plan. He explained the history of the buildings and the proposed plan. Mr. Craig also commented on the traffic flow and parking changes. There was discussion on the water treatment and copper levels. Discussion followed on the 7' exit off of Hwy 7, the use of neighboring owners property and the possibility of the service entrance as a one -way street. The request is for the purpose of considering a conditional use permit to allow the owner to construct a karate school located on Hwy 15 N. Ms. Connie Camps, Crow River Karate School, commented on the proposal for a wood frame building. Building Official Jim Marka explained the type building and the foundation on filled property. City Engineer John Rodeberg commented on the services to the property. He stated generally the developer pays for the connection fee. (c) CONSIDERATION OF SKETCH PLAN SUBMITTED BY RICH WESTLUND IN LYNN TWP, 2 MILE RADIUS Mr. Rich Westlund explained the location of the property across Otter Lake from the city. He stated they are not interested in annexing but would have restrictive covenants regarding city water. City Engineer John Rodeberg commented on problems with septic systems in the area and the servicing of the area. (e) DISCUSSION OF HOUSEHOLD HAZARDOUS WASTE RECYCLING CENTER PRESENTED BY PAUL MELCHOIR, MCLEOD COUNTY 1. The county board voted to pursue plans for a Hazardous Household Waste Collection site. 2. The county board directed Mr. Melchoir to pursue the feasibility of the County Fairgrounds for the site. The Scope is to provide a Household Hazardous Waste Collection facility to McLeod County residents. The enclosed city map shows the parade route highlighted in pink and the proposed detour route of T.H. 15 highlighted in orange. Enclosed is a letter from MN D.O.T. permitting closing T.H. 15 for this parade. A verbal conversation with Sgt. Schwartz of the Hutchinson Police Dept. in December confirmed the support and cooperation of the Hugchinson Police Department and Hutchinson Street Department upon approval by MN D.O.T. We have received approval from Citizen Bank to use the vacant lot south of their Drive -In Bark on Echo Drive and from Cash Wise Foods to use their parking lot at their current location for our assembly area. We also request the use of Echo Drive for our line- up area from the City of Hutchinson. The parade will end at our parking lot at the corner of 3rd Avenue and Hassan Street. We also request closing one block of 3rd Avenue SE between Main Street and Hassan Street between the hours of 1:00 PM and 3:00 PM. This will eliminate traffic conjestion in front of our Clubroom during the parade. The proposed detour would divert traffic off T.H. 15 just north of the T.H. 15 and South Grade Road junction to Lynn Road, following Lynn Road north to Washington Avenue and then east on Washington Avenue to T.H. 15 and T.H. 22 junction at Main Street. PART I PROJECT DESCRIPTION /SCOPE OF SERVICES A PROJECT DESCRIPTION The Project is described as follows: The Owner is in need of a guide for the orderly extension of its sanitary sewage collection facilities to areas presently outside of the corporate boundary, and the approximate costs therefor. The study area as previously designated by the Owner is to encompass all of the area primarily south and southwest of the City lying within approximately one - and - one -half miles of the present corporate limits, except that along Trunk Highway 15 South the study area extends to about two- and - one -balf miles south of the City for a distance of about one -half mile on both sides of the highway. Preliminary design and final design are not included within the scope of this agreement. B. SCOPE 0 Services to be provided for the Project under this Agreement are as follows: Comprehensive Sanitary Sewer Plan The Engineer will prepare a comprehensive sanitary sewer plan for the Owner. The plan will include explanatory text, cost estimates, and appropriate figures showing recommended future extensions and improvements. Fifty copies of the report will be provided to the Owner. Since the area southwest of the city along Otter Labe is of immediate concern, the south and southwest areas will be analyzed first, and a report will be prepared The existing sanitary sewage collection system has demonstrated adequate capacity. Hence the existing system will not be addressed except where future possible extensions into outlying areas may result in surcharging, thus necessitating improvements to the existing system. Services will also include the following: • meet with the Owner to collect data necessary for performing the study; • estimated sanitary sewage flow rates and direction of discharge will be determined for outlying areas by using the City's "Comprehensive Plan," other available future land use plans as provided by the Owner, and assuming land uses when necessary, in conjunction with USGS topographic maps; 2 • • define appropriate trunk or interceptor facilities that will be needed to accommodate the estimated flow; • where extensions of the collection system area are required for servicing future areas, provide estimates of possible improvements to the existing system to handle future flows. The engineer will rely on flow data collected by the owner and estimates based on land use; • estimate proposed sanitary sewage collection facilities, and showing general routes and sizes on drawings of an appropriate scale. Drawings will be prepared using USGS topographic maps as a base unless the Owner provides a more appropriate base map. Autocad formatted drawing will be provided to the owner. Final route determinations for trunk sewers is a task performed during preliminary and final design and is predicated upon considerations at the time of design including right -of- way availability, existing and proposed development, other potential public improvements, and specific service needs. Hence final route citing is beyond the scope of this Agreement. • investigate available alternatives which might affect the feasibility or economy of segments of the system; and • estimate the approximate cost of trunk facilities and pump stations. PART iI OWNER'S RESPONSIBBITIES Owner, at its expense, shall do the following in a timely manner so as not to delay the services of Engineer. A. INFORMATION/REPORTS Furnish maps, inspection reports, and information relating to completing the project, including the following: • aerial photos, topographic maps, plat maps, sanitary sewer record drawings, storm sewer record drawings, and watermain maps, of those areas within the study boundary, together with information regarding right -of -way and improvements that may not be shown on said drawings or maps; • any pending improvements by the Owner or other agency that may impact contributing areas, flowrates, or trunk facility locations or alignments either within the City or in outlying areas. • plat or ownership maps or drawings of areas outside of the city; 3 • any previous sanitary sewer system studies, reports or evaluations; • peak flowrates in the existing sewage collection system together with date and time of reading, at locations that will be designated by the engineer; • if available, a suitable base map in DXF, Autocad, or Intergraph format; • a city zoning and subdivision ordinance; and • a county zoning and subdivision ordinance. B. OWNER'S REPRESENTATIVE Owner shall assign a project representative who shall have the authority to transmit instructions, receive information, interpret and define Owner§ policies and make decisions with respect to Engineer's services under this Agreement. PART III COMPENSATION, BILLING, AND PAYMENT A. COMPENSATION Compensation for the services set forth in Part I shall be per diem not to exceed as follows: South and Southwest Areas Comprehensive Sanitary Sewer Study and Report - $13,430. B. BII.LIlVG AND PAYMENT 1. Timing/Format /Acceptance Engineer will bill the Owner monthly, with net payment due in 20 days. The invoice shall consist of a summary of direct labor hours by Engineers; standard job classification, plus listing of reimbursable costs incurred. Unless Owner provides Engineer with a written statement of any objections to the invoice within 15 days of receipt, Owner shall be deemed to accept the invoice as submitted. 2. Late Payments Past due balances shall be subject to a service charge at the rate of 1% per month. 3. Delay /Adjustment . The not to exceed price will remain firm if authorization to proceed is effective 2 . by March 31, 1993. RELATIONSHIP WITH CONTRACTORS SEC Donohue shall serve as OmWs professional representative for the services defined in this Agreement and may make recommendabons to Owner concerning actions relating to Owners contractors, but SEC Donohue specifically dmscirns any authority lo draw or supervise the means, methods, recumiques, sequences or procedures of construction selected by Owners contractors. 5. 'There are 81 parcels with temporary construction easements and 10 parcels with permanent right -of -way easements needed for the project. The enclosed plan sheet, Option No. 5, also depicts the latest geometric layout for the project. Prior to proceeding with final design, the layout must be approved by Mn/DOT. We have not made a request of Mn/DOT to review and approve the layout. We are awaiting the results of your Mn/DOT meeting to determine the appropriate next action. From my review, I have determined that the fence was constructed according to appropriate plans and specifications, a building permit was properly issued, and the fence is properly located as required by our zoning ordinance. The city has no authority to take action as requested by Ross. It is possible that the fence may be slightly higher than technically permitted by the ordinance, but in these kinds of discussions, there is also an issue as to the place of measurement. This fence has become a safety and traffic hazard problem to my property at 533 Huron. Since I have a daughter who is handicapped, there are times when she becomes so critically ill that I have to rush her to the hospital. The fence blocks my vision of on- coming traffic. Therefore, I would like to request the fence be reduced to a height of 30 inches from the garage to the alley for safety reasons. If it is not possible to grant this request, then I would like the City Council to enforce the City Zoning Ordinance, Section 10.0 SPECIAL PROVISIONS, 10.07 Fences and Walls (see attached). Hutchinson. The study area is generally bounded on the north by McDonald Drive, on the east by School Road, South Grade Road on the south, and on the west by Lakewood Drive. Our work tasks will provide the City of Hutchinson and area developers with the following planning information: 1. A proposed alignment of an east -west collector roadway from School Road to Lakewood Drive. The roadway will be located to provide an orderly transition with the Lakewood Terrace area, on the west, and proposed development adjacent to the existing wetland area west of School Road. The roadway location will accommodate and minimize impacts on existing properties, farmsteads, within the area. 2. Preliminary location and design of trunk utilities, sanitary sewer, water and storm sewer, to serve the area. Various options will be investigated to provide the most cost effective method of providing utilities for the area. An objective of the trunk sanitary sewer alignment proposed will be to provide service for residential areas proposed along the west shore of Otter Lake, both north and south of South Grade Road. The City's two foot topographic mapping will be used for the preliminary design of the utilities. A cost estimate for the preliminary utility design and roadway construction proposed. At the initial stages of the planning process, we will meet with City staff and area developers to discuss and determine the final scope of work. We will also meet with City staff and area developers when the preliminary alignment(s) have been determined. This will enable the comments and objectives of the City and area developers to be incorporated early in the planning process. Preliminary development proposals or concepts available will be used in the planning of utilities for this area. We propose to complete the work tasks as outlined on a time and expenses basis at a cost not to exceed $10,500 without written authorization. If field survey or soil borings are necessary to supplement available information, a cost estimate will be prepared and submitted to the City for approval prior to undertaking this additional work. The request is to continue the bonds as Industrial Revenue Bonds but rates would become variable under the refinancing arrangement. I have discussed this with Jerry Gilligan, city bond consul with Dorsey Whitney. Jerry, in turn has discussed the matter with attorneys at Faegre & Benson who are representing Hutchinson Technology. We will be receiving from Faegre a resolution calling for a public hearing for action on Tuesday evening. Background. The City has heretofore issued $1,600,000 Industrial Development Revenue Bonds (Hutchinson Industrial Corporation), dated May 1, 1973 (the 111973 Bonds ") and $3,000,000 Industrial Development Revenue Bonds (Hutchinson Industrial Corporation Project) , dated June 1, 1979 (the 111979 Bonds ") to finance the acquisition and improvement of certain real and personal property used by Hutchinson Technology Incorporated (formerly Hutchinson Industrial Corporation) (the "Company "). The currently outstanding principal amount of the 1973 Bonds is $710,000 and the currently outstanding principal amount of the 1979 Bonds is $2,070,000. The 1973 Bonds and the 1979 Bonds were issued pursuant to the Minnesota Municipal Industrial Development Act (the "Act ") (which is now Minnesota Statutes, Sections 469.152 to 469.165). The Company has requested that the City consider the issuance pursuant to the Act of up to $2,780,000 in principal amount of Industrial Development Revenue Refunding Bonds (the "Refunding Bonds ") to refund the 1973 Bonds and the 1979 Bonds. Under the proposal, the 1973 Bonds would be called for prior redemption on May 1, 1993 and the 1979 Bonds would be called for prior redemption on June 1, 1993. It is proposed that the • Refunding Bonds be issued as variable rate bonds secured by a letter of credit to be issued by Harris Trust and Savings Bank, Chicago, Illinois. In order to effect the transaction, the City Council must first hold a public hearing on the proposal to issue the Refunding Bonds pursuant to Section 147 (f) of the Internal Revenue Code of 1986. 2. This problem has been diagnosed by Dr. Virgil Voigt and I have personally discussed this issue with Dr. Voigt. It is believed that K -9 Sam's useful life will not extend past the end of this year. Therefore, it is necessary to obtain a new canine if we are to continue the canine program. It is my understanding from our February 9 meeting that the council is desirous of continuing the canine program and indicated at that time that the cost of a new canine would be underwritten by the city with the police department attempting to obtain donations from private sources which, hopefully, would cover the entire cost of the new canine. This department has started the process of attempting to obtain donations, however, it is necessary to place an order for a canine at this time so that we can obtain the animal, get to the animal to Hutchinson following training and have the animal available to work before K -9 Sam is unable to function. The police department canine handler, Officer Mark Shoutz, has contacted several suppliers of canines. He has obtained price quotes from different organizations with the cost being between $5,800 and $8,000. Officer Shoutz has located an animal with the necessary dual training; i.e. narcotics and tracking as well as criminal apprehension. This animal can be purchased through the Sun Coast Canine Academy which is located in Florida. The price for the animal is $5,800. At this time a deposit would be required in the amount of $3,800 to reserve the animal and complete its canine training. The animal would be available for pick up in six to seven weeks and the Sun Coast Canine Academy has indicated that this dog is "a natural ". One item concerning payment or construction of a 24' X 24' building for use of V.F.M. field was left to be determined. . At this time, I would request that consideration be given to accept the 24' X 24' building in lieu of a rental payment of $600 for a five year period for the following reasons. One, with construction of the rest room facility in 1992, we virtually eliminated all on site storage capacity for a ball field groomer, field maintenance supplies and pitching machines. Two, construction of this building would be of use to all park users including the High School, Huskies, Legion, V.F.W. Elks and Recreation Department sponsored teams. For practice three (3) fields are used from 3:00 - 5:30 P.M. For games two (2) fields are used from 4:00 - 6:00 p.m. High school softball practice starts indoors at the elementary school in the beginning of March. As soon as weather permits, usually the first week in April, practice is moved outdoors to Roberts Park. The above mentioned 39 days does not account for any inclement weather cancellations. It shall be the policy of the school district amd the City of Hutchinson that the school district will rent Roberts Park for $1600 per softball season for the above mentioned use. This cost is based on 40 days x 3 fields. This includes material, labor and use of city equipment. '` Baseball As of this time we do not have a schedule for use of Tartan Park as it is not prepared for this spring. The cost for the use of this facility will be determined at a later date. It is agreed between the Hutchinson School District and the City of Hutchinson that the school district will rent Tartan Park at a cost of $600 per year for the high school baseball season, effective with the 1993 school year. This includes material, labor and use of City equipment to prepare and maintain the baseball field for practice and games of the high school baseball team. This agreement is for five years: 1993 through 1998. In lieu of cash payment for this five year lease, the school district agrees to confer upon the City a 24' x 24' building constructed by the high school carpentry class. The aforementioned building to be built during this contract period and will be conferred to the City with the moving and placing of said building being the responsibility of the City. The City shall provide any cement work and the garage door. * (See page 3) Track Should the city recreation department decide to offer track activities, a cost for the use of the track will be determined. -2- Golf It shall be the policy in the use of the city recreation building that only golf wiffle balls can be used in the facility and these wiffle balls must be hit off special rubber mats used for indoor golf. Tennis It shall be the policy that the school district and the City of Hutchinson will share equally the cost of maintaining tennis court surfaces, lights and fences. The tennis courts referred to are located on the elementary school and high school site. This equal sharing of maintenance costs will allow the school district to use the courts for the high school program and allow the city recreation department to use the courts for their activities. The school sports season shall receive priority time on the courts. The 1993 Budget provided dollars to start a phased in approach to establish a playground at the Rotary Park location. However, this proposal would allow us the opportunity to complete the equipment in one year, and provide an $11,000 dollar savings. In addition, the proposed equipment meets or exceeds Consumer Product Safety Guidelines (C.P.S.C.) as well as serving the intent of the Americans with Disabilities Act (A.D.A.) We have now received the results of the technical audit and while I am not an engineer, it appears to indicate noncompliance with FCC regulations in at least a few areas. The question is whether or not the city wishes to retain outside counsel to assist in the renewal of the cable franchise and the drafting of any new franchise agreement. Additionally, the City of Hutchinson is in a unique position in terms of its ability to construct a competing system or perhaps to explore other alternatives to the present franchise holder. This field is extremely technical and it involves regulations yet to be issued by the federal government. As you may recall, the city retained the law firm of Moss & Barnett to represent the city on some issues in the transfer of the franchise from Star to D.A. Cable Partners L.P. Moss & Barnett already has copies of the city's cable franchise ordinance and related material. I have discussed with Moss & Barnett the possibility of representing the city's interests, at least in part, in connection • with the franchise renewal process. Moss & Barnett would be willing to work out a more limited arrangement in which we consult with them on an hourly basis and they would also agree to be present during the negotiation process. They would also take responsibility for drafting the final version of the franchise agreement. Under this eystem, with the city and its cable TV advisory committee doing much of the leg work, a more likely range of fees would be in the $5,000 to $10,0o0 area. Information was distributed regarding the kinds of financing HRA's may use to stimulate, develop or rehabilitate housing. Publicorp is interested in attending future strategy and planning meetings. The Director has received some information on purchasing our own washers and dryers for Park Towers instead of contracting for those services. It appears that the payback is about two years if we purchase the machines and we would also look into purchasing a front -load washer for our handicapped tenants which we need to do in order to comply with the new disablility laws. OTHER BUSINESS I. Joann Peterson, HRA and HCDC intern updated the Board on the Housing Survey. Joanne has distributed 6300 surveys; 800 -1000 have been returned from HTI. The Vo -Tech has agreed to reserve a computer to enter housing survey data and Don Winkler from the Mid - Minnesota Development Commission will cross tabulate the data. 2. Connie Mangan will submit an updated pre - application for the Small Cities grant. Connie plans to restructure the payback differently and is considering charging interest of 31 on the loan for up to 15 years. Connie feels that it will take one person one and one -half months to complete the application. In addition, a door to door survey will need to be taken of the designated rehab area. Tammy Wendlandt indicated that First -State Federal would probably be interested in helping conduct that survey. In the meantime, Connie will be working on targeting a neighborhood and thinking about the design of the program. 3. The Board looked at the HRA Workplan; a final update will not be completed until after the Housing Surveys are completed. VI.
