The following were present: Mayor Paul L. Ackland, Council members John Mlinar and Don Erickson. Absent: Council members Craig Lenz and Marlin Torgerson. Also present: City Administrator Gary D. Plotz and City Attorney G. Barry Anderson. Mayor Ackland stated the purpose of the meeting was to approve the documents for Erickson's Downtown Redevelopment Condominium, Phase II Development. Following discussion, the motion was made, seconded and unanimously carried, to approve and sign the closing documents. He stated the developer is working on the financing of the project. Mr. Marka addressed the following items of staff recommendation: - Proposed parking is adequate for the development. - There are concerns with water service for fire protection. - Dolf Moon is discussing park land with the Park Board. - Calculations for ponding are adequate. • - Addressing system has been completed. - A mechanical engineer is to verify the 8" watermain. - Water services are to be upgraded to 1 -1/2 ". - 10' easements are now revised on the property. - The plat name is to be changed. (The new proposed name is Jim Johnson Addition). - $75.00 fee is to be paid for the conditional use permit. (This fee was paid on 3/18/93) Mr. Marka stated the staff is positive to the development. HELLAND FOR CONSTRUCTION OF HOUSE LOCATED AT 1200 7TH AVE NW Chairman Gruett opened the hearing at 5:43 p.m. with the reading of publication #4485 as published in the Hutchinson Leader on Thursday, March 4, 1993. The request is for the purpose of considering a variance to meet average setback located at 1200 7th Ave NW. Building Official Marka commented on the site plan and the minimum setbacks. Mr. Les Bulau, 530 School Rd N, voiced concern with the proposed home blocking view for his home. • 3 HUTCHINSON PLANNING COMMISSION MINUTES 3/16/93 Mr. Marka commented on the previously granted variance in • the area also on a corner lot. He stated the home fits with the character of the neighborhood. Discussion followed on the size of home that would fit on the lot. After explanation Mr. Bulau had no problem with the request. IN R -3 DISTRICTS Chairman Gruett opened the hearing at 5:53 p.m. with the reading of publication #4487 as published in the Hutchinson Leader on Thursday, March 4, 1993. The request is for consideration requested by city staff to amend the Zoning Ordinance #464 to change dwelling density in the R -3 District from 4,500 square feet to 4,000 square feet per unit on 4 or more family or • townhouses in Section 8.05 and Section 9. Building Official Jim Marka explained the previous ordinance was considerably less and the revised ordinance in very restrictive to develop. He explained density fluctuates from city to city. The request is for the purpose of considering a conditional use permit requested by McLeod Group Home for a resident's school. Building Official Jim Marka commented on the school the use of the building. NEW BUSINESS (a) CONSIDERATION OF SKETCH PLAN SUBMITTED BY LEROY CHRISTENSEN, HUTCHINSON TWP, 2 MILE RADIUS Building Offic "ial Marka explained the staff recommendations and the major concern is developing urban in rural. County Zoning Administrator Ed Homan addressed the procedure for reviewing the proposed streets. Discussion followed on the testing of soils and the desirability to develop outside the city limits. Mr. Craig moved to recommend no objection to the concept of this sketch plan, seconded by Mr. Lenz the motion carried unanimously. Mr. Lenz moved to direct city staff to work with county staff to develop a procedure for criteria of which the city and county would have the same procedures to follow. This would be presented at the next planning commission meeting. Seconded by Mr. Ebent the motion carried unanimously. (b) COMMUNICATION FROM STAFF Building Official Marka presented a request for a conditional use permit within the 2 mile radius submitted by Skip Quade regarding a gravel pit operation. HUTCHINSON HOUSING AND REDEVELOPMENT AUTHORITY REGULAR BOARD MEETING MARCH 16, 1993 MINUTES I. CALL TO ORDER: 1:00 P.M. CHAMBER BOARD ROOM Chairman John Paulsen called the meeting to order. Members present - Shirley Wass, Tammy Wendlandt, Lyle Van Hale and Don Erickson. Members absent -none. II. CONSIDERATION OF MINUTES OF SPECIAL BOARD MEETING FEBRUARY 26, 1993 There being no additions or corrections, Don Erickson moved that the minutes be approved as submitted. Shirley Wass seconded and the motion carried unanimously. III. CONSIDERATION OF STATUS OF ACCOUNTS FOR PARK TOWERS PROJECT AND GENERAL FUND Budget status and monthly disbursements were reviewed. Don Erickson moved that the financial statements be approved as submitted. Shirley Wass seconded and the motion carried unanimously. IV. SECTION 23 /PARK TOWERS PROJECT 1. There are no rent receivables and no vacancies. 2. The bid tabulation for window replacement was reviewed. Phil Blot from PBA recommended to the Director that the Board approve the low bid from Gopher State Contractors subject to HUD review for previous participation. Shirley Wass moved that the low bid be approved from Gopher State; Lyle Van Hale seconded and the motion carried unanimously. V. OTHER BUSINESS 1. Mark Ruff from Publicorp recommended that we invite several experienced developers to Hutchinson to discuss serving as a project coordinator. After interviewing, the HRA should ask developers to submit formal proposals. At this time, we should also begin work on obtaining credit enhancement for our bond issue. The Board consensus was to extend an invitation to interested potential project coordinators. There was also some discussion regarding the supply of affordable lots in Hutchinson. Mark stated that there are methods of funding that can be used for this purpose such as: 1.) TIF or 2.) MHFA or FMHA. 2. U.S. West Paging has asked The HRA to sign a letter of • intent to negotiate lease of space for their cellular phone antennae to extend their range of service to Hutchinson. Don Erickson moved that we sign the intent to negotiate; _11-40) Page 2 • HRA Regular Board Meeting, March 16, 1993 Shirley Wass seconded and the motion carried unanimously. 3. The Minnesota City Participation program was discussed. There are two advantages over the regular first time homebuyer program: 1. We can petition for a higher purchase price based on our local market; according to sales records obtained from the County Assessor our median sales price for a six month period from June through November 1992 was $73,500 2.) The income limits for this program may be set at $33,700 instead of $28,000 for an existing house and $29,000 for new construction. We will need to find at least one local lender to originate the loans in order to submit an application. Don Erickson moved that we send out a letter to determine if any local lenders may be interested in originating the loans; if so we will proceed with the application asking for an allocation of $1,000,000. OTHER BUSINESS 1. The Maxfield proposal has been executed and is scheduled to be completed in 60 days. A check for $5000 has been submitted to Lee Maxfield as required by the contract. 2. Don Erickson asked the Board if a change in meeting time might be advantageous and to discuss at the next meeting. 3. Don Erickson updated the Board about a meeting of Don Erickson, John Paulsen, Connie Mangan and Jean Ward where possible sites for employee housing was discussed. Areas of R3 zoning were reviewed; the next step will be to contact owners to determine availability, size of parcels and price. Jean and Connie will research. V. As you know, this will be our 51st Water Carnival Celebration. In that regard, we would request that permits be issued for the 1993 Water Carnival as follows: 1. Close Street and Issue Parade Permit for Kiddie Day Parade and related events on Saturday, June 19th from 11:00 a.m. until 1:30 p.m. The same route will be used this year, starting at the South side of Park Towers and continuing around South Park in a clockwise direction to Glen Street. We may have additional Kiddie Events an hour before the parade in the same area. 2. Close Street and Issue Parade Permit for Grande Day Parade on Sunday, June 20th, from 11:00 a.m. to 4:00 p.m. Again, the same route will be used this year starting at Lake Street, continue down Second Avenue to Franklin Street, then south on Franklin Street to Linden Avenue. 3. Issue Permit for the Carnival Midway Show June 16th -20th at West River Park. The Park and Rec Board has been asked to approve this location again for this year. An alternative site can be set for Optimist Park parking lot if we have a wet season again this year, or another sight agreeable with the Park and Rec Board. 4. Issue Permit to Sell Food at the Grande Day Parade, Waterski Show and Mud Volleyball Tournament on Sunday, June 20th at South Park, West River Park and Les Kouba Park. 5. Issue Permit for Fireworks Display on Sunday, June 20th at approximately 10:00 p.m. at Les Kouba Point. We will arrange to have the Fire Department stand by if any assistance is needed. 6. Mini - Biffs. In the past, needed for the weekend. I Department regarding this. matter. the City has taken care of the Mini - Biffs have contacted the Park & Recreation We appreciate your assistance with this Page 2 7. A non - intoxicating liquor license for liquor sales on the following • days: Thursday evening, June 17th, at West River Park; Saturday evening, June 19th at the Civic Arena; and, Sunday afternoon, June 20th at Les Rouba Park. We would also like to sell set -ups at the Civic Arena and have attendees bring their own bottles. The Jaycees would appreciate waiver of any license fees. Last fall I made a request for a donation from the City of Hutchinson in the amount of $1,500 to help defray expenses on sponsored community events. This amount is $500 lower than last year. The difference was due to the increase last year for the 50th celebration. Gary Plotz has informed me that the City will provide a $1,000 donation in 1993. The Jaycees sincerely appreciate the monetary support. • This year we are celebrating our Slat annual Water Carnival. In 1992, we worked hard to improve the Grande Day Parade and fireworks, both of which were very successful. our goal for 1993 is to maintain the same quality level which can only be done with the City's help. The Jaycees truly appreciate all of the assistance and support that the Water Carnival receives from the City of Hutchinson. The first concern had to do with the method of calculating rent. • Previously, rent was calculated on the basis of $60 per tillable acre. The lease as drafted and approved by the City Council, I simply set out the total rent. Mr. Knutson would like to see a clause in the lease regarding calculation based on tillable acres and I have no objection. Accordingly, paragraph 3A has been revised slightly. The tenant has also raised a concern regarding construction of municipal improvements by the City and possible loss of crop. I am not aware of any plans for construction that would take land planted by the tenant, but I have included language as requested by the tenant in paragraph 3C. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged If the entire assessment is paid by the 1st day of October, 1993; and he may, at any time thereafter, pay to the City Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to the 31st day of December, of the year in which such payment is made. Such payment must be made before November 15th, or interest will be charged through December 31st, of the next succeeding year. 4. Mr. Rodeberg stated commercial property is to be a minimum of one acre and this lot is less. With new development on North High Dr. and Hwy 15, the lots would be squeezed. Mr. Craig stated the best -use- of= the - proper -ty wou14rbe commercial and this property is not large enough to subdivide. City Engineer Rodeberg commented on parking requirements and the limitations on the property. Mr. Fraser asked about dividing the property into 2 commercial lots. Discussion followed on the fact residential does not fit the area and the lot is too small for 2 commercial lots. A multi family dwelling unit could possibly work. Mr. Reiwer asked about mini storage. (b) DISCUSSION OR PAUL BETKER PRELIMINARY AND FINAL PLAT, REZONING AND CONDITIONAL USE PERMIT REQUEST Mr. Plotz commented on the concern of substandard lot size in the plat. Mr. Rodeberg stated that Mr. Betker is not ready for a public hearing at this time. (c) DISCUSSION OF VILLAGE COOPERATIVE PRELIMINARY AND FINAL PLAT, VACATION OF STREET AND REZONING REQUEST City Administrator Plotz stated the developer would like to consider the cooperative in May. Mr. Rodeberg stated the submittal was incomplete. (d) CONSIDERATION OF LOT SPLIT IN THE SCHOOL DISTRICT PLAT Gary Plotz explained the replat of the Wagner plat to School District Plat and that the ordinance allows for one lot split in a plat. Mr. Neil Jensen, school district attorney, commented on the history of the plat the sale of what was lot #15 in HUTCHINSON PLANNING COMMISSION MINUTES . APRIL 20, 1993 the Wagner plat. This property was sold on a meets and bounds description and must be split from the School District Plat. (e) OTHER NEW BUSINESS Ms. Ruby Carlisle, 494 California St, was present to comment on her proposed addition to her mobile home. City Administrator Gary Plotz explained the lot is nonconforming and the new ordinance states the foundation is to be a continuous perimeter frost footing. Ms. Carlisle commented on her property and neighboring property conditions. She explained the addition proposed. Director of Engineering John Rodeberg stated the home was nonconforming because it is on piers. There was discussion on the ordinance intent and frost footing as opposed to piers. Building Inspector Mark Hensen stated some mobile homes were not designed to sit on continuous foundations. Discussion followed on the fact Ms. Carlisle's piers are beneath the frost line. Marka RE: Recreation Center Roof - warranty Mike Maiers with Laraway Roofing has confirmed with Firestone that a 6 -year warranty can be issued on the Recreation Center roof provided: 1) The roof be reinspected by Firestone at a fee of $325.00 (Mike Maiers will be the inspector). 0 2) All punchlist repairs are paid by the City, and corrected by Laraway who is the franchise installer. Firestone will issue the balance of the 10 -year warranty believed to be thru 1999 at seven cents per square foot with a mimimum charge of $350.00. All future warranty repairs after correction will be at Firestone's expense. I suggest we request from the designer- Borngiebel Architecture, the general contractor -E.J. Pinske and Marty's Roofing cost sharing on this matter. If cost sharing is not accepable we may want to consider documentations for future qualified services. The price requested by the county was $5,000. This was more than the City's anticipated $1 cost plus the unpaid assessments. Ed indicated the price quoted of $5,000 for the lot was required • payment as that had been established by the Board of Commissioners. He did indicate he would hold the property open for city use and try next, year to have the property reappraised to a lower value since it would be public purpose. John Rodeberg indicated the land would not be used at the present time but would be a future road use and the wait for the year did not present a problem. We will bring this matter back to the city council next year. As you know, the petrofund approved our first application for reimbursement on November 19, 1991. On October 26, 1992, this office, acting on behalf of the city, submitted a second application for reimbursement. I spoke earlier this week with Bonney at the petrofund who advised me that leak number 2801 (our matter) is scheduled to be heard on June 3, 1993. If the application for reimbursement is approved, a check will issue in the following four or five months. It thus appears likely that reimbursement will be received prior to the end of the year. There is nothing further that needs to be done in connection with this particular application, but I simply wanted to keep you and the council advised of the status of this matter. Thank you.
