REGULAR MEETING - HUTCHINSON CITY COUNCIL
TUESDAY, APRIL 13, 1993
1. The meeting was called to order at 7:30 P.M. by Vice - President
Mlinar. The following were present: Vice - President John
Mlinar, Council members Craig Lenz, Marlin Torgerson, and Don
Erickson. Absent: Mayor Paul L. Ackland. Also present: City
Administrator Gary D. Plotz, City Engineer John Rodeberg, and
City Attorney G. Barry Anderson.

The invocation was given by the Reverend Chuck Carlson.
3. MINUTES
The minutes of the regular meeting of March 23, 1993 were
approved as distributed.

The motion was made by Councilman Lenz, seconded by
Councilman Erickson and unanimously carried, to order
report and minutes filed and to issue permits.
5. PUBLIC HEARING - 8:00 p.m.
(a) LETTING NO. 4, PROJECT NO. 93 -05 (SOUTH GRADE ROAD)
Vice - President Mlinar called the hearing to order at 8:00
P.M. and read the notice of hearing. It was noted the
hearing was not required by law but was for the benefit
of the public to address proposed changes on South Grade
Road into the Hutchinson Mall.
• Engineer Rodeberg stated that because of the high volume
of traffic in front of Cash Wise, it was necessary to
relocate the entrance. The proposal was to add a right

turn lane east bound into the Mall and a right turn lane
at Hwy. 15 with two lanes west bound. The island would
be parted to provide access into the Cash Wise parking
lot and moved a little to the south. The project cost is
estimated at $70,352.74, with City cost of $33,854.79 and
assessable cost of $36,497.95.
Vice - President Mlinar read a letter from Earl Fitzloff
and a petition submitted with two names.
Glenn Woelfel, manager of Cash Wise, stated he was
opposed to closing off the entrance into the Mall. He
felt the proposed plan was very workable.
The City Engineer reported the subdivision agreement with
Developers Diversified was renegotiated to close the
entrance on Merrill Street because of safety concerns.
Ken Gruenhagen, Heritage Square Apartment Building, asked
if his property would be assessed for part of the
project. He was assured it would not be assessed.
Otto Rettig, 516 Adams Street S., inquired if an entrance
could be moved and the easement still stand. He asked if
the present easement was in effect or if the City had to
start over again. Mr. Rettig wondered why Lynn Road was
closed for access.
Attorney Anderson stated the relocation of the entrance
was not governed by an easement. It was covered by an
agreement between the City and Developers Diversified and
by platting when the property was developed. The hearing
was for the purpose of discussing islands, turn lanes,
and problems with Lynn Road. The issue of entrances was
decided in the subdivision agreement for Mall Plat 2.
Engineer Rodeberg commented on some of the traffic
hazards at the present entrance location due to heavy
use. MN /DOT recommended closing the Lynn Road entrance,
and the City protested the plan.
Otto Rettig questioned why Hwy. 15 was not placed further
east. He commented that access to the business entrances
on the south side of South Grade Road would require
crossing two lanes. It was his opinion that the proposed
plan was worse than the present situation.
Sgt. Ron Kirchoff reported the accident statistics from
1986 to present showed a drop from 8 accidents per year
to one per year.

A representative from Developers Diversified stated it
was in everyone's best interest to proceed with the
proposed plan.
Councilman Erickson moved to close the hearing at 8:25
P.M. Motion seconded by Councilman Lenz and unanimously
carried.
Following discussion, Councilman Erickson moved to
approve the project, to order plans and specifications,
and to waive reading and adopt Resolution No. 9922.
Motion seconded by Councilman Torgerson and unanimously
carried.
(b) ON -SALE INTOXICATING LIQUOR LICENSE FOR MICHAEL GENE
FASCHING, OWNER OF J'S PIZZA BAR & GRILL
Vice - President Mlinar called the hearing to order at 8:26
P.M.
It was reported the Building Official had done a walk
through of the structure; however, the final inspection
had not been completed by the Police Department. The
• applicant provided an insurance certificate, but the
restaurant license had not been issued to date.

Mr. Fasching stated he planned to install a pass- through
window from the kitchen into the bar area to enable food
to be passed into the bar where intoxicating liquor would
be served. Non - intoxicating malt liquor would be served
in the restaurant.
Following discussion, Councilman Torgerson moved to close
the hearing at 8:28 P.M. Motion seconded by Councilman
Lenz and unanimously carried.
The motion was made by Councilman Torgerson, seconded by
Councilman Lenz and unanimously carried, to approve and
issue liquor license contingent on a state food license
received and a walk through inspection.
6. COMMUNICATIONS. REQUESTS AND PETITIONS
(a) CONSIDERATION OF PETITION FOR BOULEVARD SIDEWALK ON WEST
SIDE OF ALAN STREET
The City Engineer explained the area of the request and
stated it was an appropriate location for a sidewalk.

Although it is in a major project, the sidewalk is not in
the City policy.
Following discussion, Councilman Torgerson moved to
approve the sidewalk contingent that snow removal,
maintenance, etc., would be the responsibility of the
residents. Motion seconded by Councilman Lenz and unani-
mously carried.
7. RESOLUTIONS AND ORDINANCES
(a) RESOLUTION NO. 9917 - RESOLUTION FOR PURCHASE
The motion was made by Councilman Erickson, seconded by
Councilman Torgerson and unanimously carried, to waive
reading and adopt.
(b) RESOLUTION NO. 9918 - RESOLUTION SUPPORTING ELIMINATION

(a) CONSIDERATION OF AMENDMENT TO ZONING ORDINANCE REQUESTED
BY CITY STAFF TO CHANGE DWELLING UNIT DENSITY FROM 4,500
SQUARE FEET TO 4,000 SQUARE FEET IN R -3 DISTRICT WITH
FAVORABLE RECOMMENDATION OF PLANNING COMMISSION
(DEFERRED MARCH 23, 1993)
The City staff recommended a compromise of 4,200 square
feet per dwelling unit density in the R -3 district.
Following discussion, Councilman Torgerson moved to
approve 4,200 square feet and to waive first reading of
Ordinance No. 93 -78 and set second reading for April 27,
1993. Motion seconded by Councilman Lenz and unanimously
carried.

(a) CONSIDERATION OF APPROVING NORTHERN NATURAL GAS COMPANY
PIPELINE EASEMENT
Discussion centered on the pipeline easement for con-
structing a natural gas pipeline across the east side of
the Hutchinson Utility site.
Councilman Torgerson moved to approve the pipeline ease-
ment with the contingency that there be no problems with
the railroad. Motion seconded by Councilman Erickson and
unanimously carried.
(b) CONSIDERATION OF WAIVING BUILDING PERMIT FEE FOR
HUTCHINSON UTILITIES UNIT NO. 1
Following discussion, Councilman Torgerson moved to
approve waiving the fee. Motion seconded by Councilman
Lenz and unanimously carried.
(c) CONSIDERATION OF APPldCATION FOR TEMPORARY RECYCLABLE
MATERIAL COLLECTION PERMIT FOR ELOUISE CARLSON, DBA

Following discussion, Councilman Erickson moved to
approve and issue permit. Motion seconded by Councilman
Torgerson and unanimously carried.
(e) CONSIDERATION OF AWARDING PROPOSAL FOR PROFESSIONAL LEGAL
SERVICES REGARDING RENEWAL OF CITY'S CABLE TELEVISION
FRANCHISE
Following discussion, Councilman Erickson moved to
authorize the City Attorney to enter into negotiations
with Bernick and Lifson, P.A., with a cap on the contract
for a maximum of $5,000. Motion seconded by Councilman
Torgerson and unanimously carried.
(f) CONSIDERATION OF NEW LEASE WITH MINNESOTA DEPARTMENT OF •
PUBLIC SAFETY FOR USE OF FIRE STATION PARKING LOT SPACE
FOR MOTORCYCLE TESTING
Following discussion, Councilman Erickson moved to table
and to wait for a recommendation from staff. Motion
seconded by Councilman Lenz and unanimously carried.
(g) CONSIDERATION OF AMENDING AGREEMENT WITH MCLEOD LANDFILL,
INC. FOR HAULING OF RESIDENTIAL REFUSE BY AAGARD WEST
Following discussion of a proposed change submitted by
Sanifill, the corporate parent to McLeod Landfill, Inc.,
a motion was made by Councilman Erickson for no action
and the contract stand as drafted. Motion seconded by
Councilman Torgerson and unanimously carried.
(h) CONSIDERATION OF ESTABLISHING OPEN HOUSE FOR OLD CITY
HALL BUILDING ON MAY 10, 1993 FROM 5:30 -9:00 P.M.
Following discussion, Councilman Erickson moved to
approve the open house. Motion seconded by Councilman
Torgerson and unanimously carried.
It was the consensus of the Council to hold a public
hearing on the future use of the old City Hall building
during the May 25 City Council meeting. 0

Following discussion, Councilman Torgerson moved to defer

(k) CONSIDERATION OF PARTIAL RELEASE OF STORM SEWER EASEMENT
WITHIN LOT 1 OF LYNN ADDITION
Following discussion, Councilman Erickson moved to
approve the partial release. Motion seconded by
Councilman Lenz and unanimously carried.
(1) CONSIDERATION OF NOTIFYING MAIN STREET PROPERTY OWNERS
REGARDING LIVE TRAPPING OF PIGEONS ON ROOFTOPS
Following discussion, Councilman Lenz moved to approve
with the addition of Lloyd Allen's building. Motion
seconded by Councilman Torgerson and unanimously carried.
(m) CONSIDERATION OF SELLING CITY PARCEL NEXT TO SHOPKO STORE
City Attorney Anderson reported Shopko was interested in
purchasing the City's adjoining lot. During discussion,
it was the consensus of the Council not to sell the
property at the present time but to honor a prior commit-
ment to grant Shopko a right of first refusal as well as
to agree to the restrictions previously discussed.
The motion was made by Councilman Torgerson, seconded by
Councilman Erickson and unanimously carried, to direct
the City Attorney to relay the information to Shopko.
(n) CONSIDERATION OF APPROVING PLANS AND SPECIFICATIONS AND
ADVERTISING FOR BIDS ON LETTING NO. 2, PROJECT NO. 93 -02
Following discussion, Councilman Lenz moved to approve
the plans and specifications, to advertise for bids on
May 17, 1993 at 2:00 P.M., and to waive reading and adopt
Resolution No. 9921. Motion seconded by Councilman
Erickson and unanimously carried.

Following discussion, Councilman Erickson moved to
approve the plans and specifications, to advertise for
bids on May 17, 1993 at 2:00 P.M., and to waive reading

(p) CONSIDERATION OF APPROVING PLANS AND SPECIFICATIONS AND
ADVERTISING FOR BIDS ON LETTING NO. 6, PROJECT NO. 93 -09,
93 -10, 93 -11, 93 -12 & 93 -13
Engineer Rodeberg reported project No. 93 -10 was dropped
from Letting No. 6. Following discussion, Councilman
Torgerson moved to approve the plans and specifications
except for project No. 93 -10 which was dropped, to adver-
tise for bids on May 17, 1993 at 2:00 P.M., and to waive
reading and adopt Resolution No. 9924.
10. MISCELLANEOUS
(a) COMMUNICATIONS FROM CITY ADMINISTRATOR
City Administrator Plotz commented on the special hard
goods pickup for May 17 and the special tire collection
day for April 17 behind the National Guard Armory.
It was reported all the city -owned properties were now
marked on a large map. Also, the Council was reminded of
the April 26 groundbreaking for utility unit No. 1.
Mr. Plotz stated Louis Brunner had submitted an offer to
purchase city -owned property located on the southeast
corner lot of Second Avenue and Huron (lot 10, block 21,
south half City) at its appraised value.
During discussion it was determined the minimum bid would
be the appraised value. Also, the buyer would be
responsible for taxes, assessments, and closing fees as
well as rezoning and a conditional use permit.
Councilman Torgerson moved to advertise for the sale of
the property, to assist Louis Brunner in obtaining the
information needed, and to proceed with a public hearing
for rezoning. Motion seconded by Councilman Lenz and
unanimously carried.

0 CITY COUNCIL MINUTES - APRIL 13, 1993
The City Administrator presented a request from the
Optimist Club to use Library Square on April 24, 1993,
for the annual community clean -up day. The motion was
made by Councilman Lenz, seconded by Councilman Torgerson
and unanimously carried, to approve the request.
Mr. Plotz commented on the special Planning Commission
meeting held April 14, 1993, regarding the proposed
annexation of the southwest area in Lynn Township.
It was noted the new part -time Fire Marshall, Mike Palm,
had begun his duties. Mr. Plotz also mentioned the 1993
Objectives had been categorized according to priority,
and he had presented them at a Kiwanis meeting.
(b) COMMUNICATIONS FROM COUNCILMAN CRAIG LENZ
Councilman Lenz reported the cable let go on one side.
(c) COMMUNICATIONS FROM COUNCILMAN DON ERICKSON
Councilman Erickson inquired about a leak on Main Street.
. (d) COMMUNICATIONS FROM COUNCILMAN MARLIN TORGERSON
Councilman Torgerson asked for an update on the status of
the Jay Freedland issue. The City Administrator respond-
ed Mr. Freedland had presented a proposal for the City to
reduce the assessments in Industrial Park from $10,000
per acre to $2,000 per acre.
It was the consensus of the Council to send Mr. Freedland
a letter stating the City's present policy and recommend-
ing he work with HCDC.
(e) COMMUNICATIONS FROM CITY ENGINEER
Engineer Rodeberg requested clarification on which
ventilation system to install in the proposed City Hall.
Discussion followed on the benefits of the VAV system
over the rooftop units. It was noted the initial cost of
the VAV system was approximately $32,000 more, but the
cost would be made up within i0 years.
The City Engineer reported Orfield & Associates proposed
two sky lights over the work area. The $14- 15,000 cost
was not included in the budget. It could be considered
as an alternate bid as well. as two front windows proposed
. in the Council Chambers.

Following discussion, Councilman Lenz approved the
$32,000 additional cost for the VAV ventilation system.
Motion seconded by Councilman Torgerson and unanimously
carried.
Engineer Rodeberg commented on a meeting with MN /DOT and
the County to discuss the by -pass construction and
possible swaps of streets. Since the City may get Adams
Street back, it could be necessary to close out the Adams
Street project and dismiss the consulting engineer.
It was noted that the increased costs for the pedestrian
bridge might prohibit continuation of the project. Bud
Daggett was reconsidering his donation for a bridge to
replace the railroad trestle.
The City Engineer reported the situation with Tom Carri-
gan's retaining wall had not been resolved. The existing
wall is an encroachment on City property and is a hazard
to the public health and safety. It was Engineer Rode -
berg's recommendation to rescind the City's prior
proposal and proposed arrangement with Mr. Carrigan and
to approve City expense to remove the rock wall, to do •
rough grading to slope the yard, to provide sufficient
sod, and to pay one -half of the bill for the bobcat
rental.
Following discussion, Councilman Lenz moved to approve
the recommendation, except for paying one -half of the
bill for the bobcat cost. Motion seconded by Councilman
Erickson and unanimously carried.
Engineer Rodeberg requested Council approval for a MN /DOT
agreement for state financial assistance for airport
improvement.
Following discussion, Councilman Torgerson moved to
approve and enter into the agreement and to waive reading
and adopt Resolution No. 9925. Motion seconded by
Councilman Lenz and unanimously carried.
11. CLAIMS. APPROPRIATIONS AND CONTRACT PAYMENTS
(a) VERIFIED CLAIMS
The motion was made by Councilman Torgerson, seconded by
Councilman Lenz and unanimously carried, to approve the

(b) CONSIDERATION OF NEW LEASE WITH MINNESOTA DEPARTMENT OF

City Administrator Plotz reported the civic arena /recrea-
tion center parking lot was being recommended as the site
for motorcycle testing.

(f) CONSIDERATION OF RECREATION CENTER ROOF
Director Dolf Moon reported on the leakage problems with
the recreation center roof. He noted Marty Is Roofing did
not provide a warranty for the roof at the time of con-
struction. Laraway Roof Systems recently performed a
roof repair, but there were three holes in the repair
work. It was Director Moon's recommendation to instruct
Laraway to complete the roof inspection, to provide a
quote on their findings, and to provide a warranty to .

cover their work on the roof repair.
Following discussion, Councilman Erickson moved to accept
the recommendation from Director Moon to repair the roof.

(g) CONSIDERATION OF DELINQUENT WATER AND SEWER ACCOUNTS
The motion was made by Councilman Erickson, seconded by
Councilman Lenz and unanimously carried, to authorize
discontinuation of service at noon on May 3 unless other
arrangements were made.
10. MISCELLANEOUS
(a) COMMUNICATIONS FROM CITY ADMINISTRATOR
It was reported that the Hutchinson Handicap Advisory
Committee was requesting authorization to join the
National Organization On Disability. There is no fee
involved.
Following discussion, the motion was made by Councilman
Erickson, seconded by Councilman Lenz and unanimously
carried, to approve membership.
Administrator Plotz noted the quarterly monitoring report
by Twin City Testing dated February 18, 1993, required
City Council approval.
The motion was made by Councilman Lenz, seconded by
Councilman Erickson and unanimously carried, to approve
the quarterly monitoring report.
Mr. Plotz stated Brown's Floral & Gift had submitted an
application for a temporary sign permit. Following dis-
cussion, Councilman Erickson moved to approve the permit.

carried.
The City Administrator reported on an upcoming meeting to
discuss a joint powers agreement to merge the community
education and park and recreat4on programs.
It was noted that Councilman Torgerson had toured the
Sheppard house (15 Franklin Street N.) and thought it was
in good condition. He had suggested offering $62,600 for
the purchase of the property. Larson Restoration had

submitted a proposal to relocate and remodel the Sheppard
house at a cost of $38,000. During discussion it was
suggested a survey be taken of the downtown business
owners to determine their viewpoint of a parking lot on
the Sheppard property.
The motion was made by Councilman Erickson, seconded by
Councilman Lenz and unanimously carried, to postpone
decision making until the next Council meeting and to
have a walk- through tour of the Sheppard house at 7:00
P.M. on May 11, 1993, prior to the Council meeting.
(b) COMMUNICATIONS FROM VICE- PRESIDIZNT JOHN MLINAR
Vice - President Mlinar referred to a letter received from
Valerie Doering in which she requested consideration of
a crosswalk in the South Grade Road area.
(c) COMMUNICATIONS FROM COUNCILMAN DON ERICKSON
Councilman Erickson inquired about the use of the Fire
Marshall's car.
(d) COMMUNICATIONS FROM CITY ATTORNEY 0
Attorney Anderson commented on the memorandum regarding
condemnation of utilities.
(e) COMMUNICATIONS FROM DIRECTOR OF ENGINEERING
Engineer Rodeberg requested authorization to terminate
the Crow River pedestrian bridge project (Letting No. 11,
Project No. 92 -17) due to design changes and escalating
costs.
Following discussion, Councilman Erickson moved to
terminate the bridge project, Letting No. 11. Motion
seconded by Councilman Lenz and unanimously carried.
The Director of Engineering commented that the Crow River
Task Force had presented a project for lake and river
enhancement The cost would not exceed $30,000.
Engineer Rade )Derg requested approval of $5,000 to begin
the task of finishing the wetland before July.
Councilman Erickson moved to approve $5,000 for the Crow

Parks & Recreation Board
March 31, 1993
Members present were Mike Schall, Mike Cannon, John Ninar, J.P. Auer, Linda Martin and
Virgil Voigt. Also present were Dolf Moon and Karen McKay.
The meeting was called to order at 5:24 p.m.
The minutes dated February 24, 1993 were approved by a motion made by John Mlinar and
seconded by J.P. Auer, the board unanimously agreed.
OLD BUSINESS
Rotary Playground - The bid from Gametime was approved at the City Council meeting, and
the playground equipment has been ordered. Delivery should be approximately mid -May; city
crews along with a couple of representatives from Gametime will assemble the structure. The
surface will be sand and will include a ramp for handicap accessibility.
MNDot Finn /RA - 24 Communities were chosen to apply for the grant. Eight applications
were submitted, and Hutchinson was chosen as the recipient for the pilot program through the
Minnesota Department of Transportation and the Finnish Road Administration. The program
focus is to use bike trails as an alternate form of transportation.
NEW BUSINESS
Tent Troupe Theatre - Pastor Tim Maland was present and outlined The Tent Troupe Theatre.
They are a group of 30 young adults that present a play under a large tent to groups as large as
1,000. There is a program for children in the afternoon, and for adults in the evening. It will
be promoted through the area churches. The Troupe requires shower and rest room facilities.
Pastor Maland is requesting use of Linden Park and the Rec Center for the event scheduled for
Thursday, July 8, 1993. Set up will begin at 8:30 a.m. and dismantling will conclude at
12 Midnight that same day. Pastor Maland also requests that all baseball/softball programs be
cancelled for that afternoon.
After a brief discussion, J.P. Auer made a motion to accept the request from Pastor Maland
for use of Linden Park for Tent Troupe on Thursday, July 8, 1993; the Parks & Recreation
Department will work out the details. John Mlinar seconded the motion, and the board
unanimously agreed.

Parkland Contribution/Tot Contribution/Tot Lot Facility, Twin Oaks Addition - Jim Johnson is scheduled to
build a 92 unit complex in the vicinity of County Road #12 and Texas Avenue. With Rotary
Park in the area of the development, it is the Dolf s recommendation that cash be accepted
rather than parkland. The cash could be used to reduce the money owed for Rotary Park. Mr.
Johnson would be required to provide a tot lot for the residents of the complex. J.P. Auer
made a motion to accept a cash donation from Mr. Jim Johnson and the Park Board would
provide a letter outlining the guidelines of a tot lot i.e. surfacing. Virgil Voigt seconded the
motion and the board agreed unanimously.
Parkland Contribution Compton - Anderson /Baptist Church - 60 -100 homes and a church are
proposed for the property between School Road and Lakewood Drive along South Grade
Road. With the 35 acres nearby at Roberts Park it is recommended by Dolf and the
Engineering and Building Departments that a cash contribution be accepted in lieu of property
for this development project. Mike Cannon made a motion to accept the cash contribution
with all details considered for the Compton- Anderson /Baptist Church development.
Linda Martin seconded the motion, and board unanimously agreed.
Walnut Street - Walnut Street will run straight through with an eight unit complex constructed
in a cul-de -sac behind Our Saviors Church. It is the board's opinion that Jaycee Park could
serve the needs of residents in that development, provided that the complex install a tot lot and
green space for their residents. Mike Cannon made a motion to accept a cash contribution the
money to be used to develop current parkland, J.P. Auer seconded the motion and the board
agreed unanimously.
Midwest Paddle Tennis Clinic - The board received a request from the Midwest Paddle Tennis
Association for use of the Recreation Center for the purpose of conducting a "Paddle Tennis
Clinic" to be conducted in April or May. Mr. Paul Kelly would appreciate a small expense
allowance, but would not require it.
After a brief discussion, Virgil Voigt made a motion to support the Midwest Paddle Tennis
Association's offer for a paddle tennis clinic and offer the Rec Center to them free of charge,
however disregard the expense allowance. John Mlinar seconded the motion and the board
unanimously agreed.
Hutchinson Kiwanis Discussion - The Kiwanis are interested in constructing a park shelter in
the current J -Crow Demolay Park. They are requesting that the name be changed to
Hutchinson Kiwanis Park. After reviewing the proposal, the board agreed that there should be
further discussion, in addition, an attempt should be made to contact former members of the .
J -Crow Demolay. They felt that Lee Cox may be able to provide some information.

Request to Place Sign Near Popcorn Wagon - A request has been submitted from MainStreet
to have a sign placed in Library Square near the Popcorn Wagon. After a brief discussion by
the board, Virgil Voigt made a motion to approve the proposal as submitted to Dolf. Mike
Cannon seconded the motion, and the board unanimously agreed.
Garden Plot Rentals - Dolf received a letter from Marie Klinghagen, America the Beautiful
Seed Program, requesting that additional gardening sites be available throughout Hutchinson to
provide more accessibility to low income families. After brief discussion, J.P. Auer made a
motion to continue to provide the Garden Plots at the Tartan Park site as the sole source at this
time and not provide plots in additional sites. Mike Cannon seconded the motion, and the
board agreed unanimously. Virgil Voigt suggested that perhaps a letter be sent to the gardens
suggesting that if they have any surplus, it be left at a drop off site.
Parks, and Recreation - Community Education Update - At this time a group with
representatives from the School Board, the City and Jim Mills are in a fact finding stage. It
was the board's opinion that what ever transpires, the Parks and Recreation Department must
maintain good quality in leadership that the community expects. Dolf will continue to update
the board.
BOARD MEMBER ITEMS
J.P. questioned the progress with the Civic Arena updates. Dolf reported that the rest rooms
are scheduled to be remodeled this year. Dolf and Mary will be visiting the Albert Lea Arena
in April to see their refrigeration system. Mary will be at the April board meeting.

AN ORDINANCE OF THE CITY OF HUTCHINSON, MINNESOTA, AMENDING
SECTION 3.20, SUBD. 2 OF THE HUTCHINSON CITY CODE AND ADOPTING BY
REFERENCE CITY CODE CHAPTER 1 AND SECTION 2.99 WHICH, AMONG OTHER
THINGS, CONTAIN PENALTY PROVISIONS.
THE CITY OF HUTCHINSON ORDAINS:
Section 1. City Code Section 3.20, Subd. 2 is hereby amended
as follows:
Subd. 2. Repairs of Leaks. It is the responsibility of the
consumer or owner to maintain the service pipe from the main into
the house or other building, including, but not limited to, the
service line, stand pipe or curb stop. In case of failure upon
the part of any consumer or owner to repair any leak eeeu .nj .x
his serviee pipe within twenty -four (24) hours after oral or
written notice has been given the owner or occupant of the
premises, the water may be shut off and will not be turned on until
a reconnection charge has been paid and the water service has been
repaired. When the waste of water is great or when damage is
likely to result from the leak, the water will be turned off if the
repair is not proceeded with immediately. Following notice as
property benefitted. The costs to be so assessed may include, but
are not limited to material, labor and professional fees and
expenses incurred in the repair.
Section 2. City Code Chapter 1 entitled "General Provisions
and Definitions Applicable to the Entire City Code Including
Penalty for Violation" and Section 2.99 entitled "Violation a
Misdemeanor" are hereby adopted in their entirety, by reference, as
though repeated verbatim herein.
Section 3. This ordinance shall take effect upon its adoption
and publication.

RESOLUTION TO RENAME J -CROW DEMOLAY TO KIWANIS PARK
WHEREAS, the City of Hutchinson has received financial donations from many
fine institutions over the year, and
WHEREAS, former J -Crow Demolay Members have been consulted, and
agreed that the Hutchinson Mwanis could adopt the park; and
WHEREAS, the plaque located in the park that recognizes the J -Crow Demolay
Group will remain to historically preserve their fine contributions; and
WHEREAS, the Hutchinson Kiwanis have pledged future support to
development Kiwanis Park.
• NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF HUTCHINSON, MINNESOTA:
1) That the Hutchinson City Council hereby recognizes and appreciates the
support of the Hutchinson Kiwarnis, and to recognize their effort, renames J -Crow
Demolay Park to Mwanis Park located along Fifth Avenue Northwest.

The following Boards have made their recommendations with respect to the
future of the Hutchinson Youth Center.
Dry Dock Board - Motion made and seconded to use the Fire Barn location as
the future Youth Center; unanimously approved.
Community Education Advisory Council - Motion made and seconded to use the
Fire Barn location as the future Youth Center; unanimously approved.
Hutchinson Park and Recreation Board - Motion made and seconded to
discontinue financial support for a facility based Youth Center, but continue funding
for special event programs for Hutchinson youth; unanimously approved.
As staff, we support the recommendation of the Park and Recreation Board.
We believe a special event structure paired with a program to address the needs of
youth at risk should be the direction the program moves. We also agreed with the
Board that a future city owned facility that could be used as a drop in site should be
considered; based on the success of a Special Event/Youth at Risk program, and also
the willingness of Hutchinson's youth to support this type of facility

RE: Consideration of Terminating Project No. 92 -05,
Letting No. 3 /Adams Street (TH 22)
Due to escalating costs, lack of funding from MnDOT, and
difficulties in scheduling and estimating by the consultant, we are
recommending that the above project be terminated. Attached is a
final invoice from SEH covering the remaining expenses that were
previously approved by the Council.
We have had detailed discussions with the consultant regarding the
problems encountered. They have noted that over $10,000 of fees
have not been invoiced, and represent errors and omissions on their
part. I would therefore recommend project termination.
The State Aid Engineer, Tom Behm, has proposed an innovative plan
to work with the City, County and State to get the TH 22 East
Bypass completed much sooner than possible with MnDOT funding, and
then completing the Adams Street /Washington Avenue improvements
with Trunk Highway Turnback Funds, which are much more
comprehensive. This will involve redesignating city, county and
state routes. Our first detailed meeting is set for May 20th.

WHEREAS, a resolution of the City Council adopted the 14th day of January,
1992, fixed a date for a Council Hearing on the improvement of:
Project No. 92 -05 (aka 93 -03) Adams Street /Trunk Highway 22 from Fair Avenue
to Washington Avenue; and
Project No. 92 -06 (aka 93 -04) Fair Avenue from Adams Street to Jefferson
Street;
by construction of sanitary sewer and services, watermain and services, trunk and
lateral storm sewer, grading, gravel base, bituminous base, bituminous surfacing and
appurtenances.
AND WHEREAS, ten days' published notice of the hearing through two weekly
publications of the required notice was given and the hearing was held thereon on
the 25th day of February, 1992, at which all persons desiring to be heard were given

Property along Trunk Highway 15
The State of Minnesota is planning on widening the shoulders and
providing a safer slope along Trunk Highway 15 from Hutchinson to
TH 212. Construction is proposed for 1995. As part of this
construction, additional permanent and temporary easements are
required. Attached is a letter from the Right -of -Ways and Surveys
Office of MnDOT briefly describing the process and compensation.
A packet of information was included that describes the process in
much more detail.
Based on my brief review of the documentation, I would recommend
approving the acquisition of the City property by the State,
following review of the documents by the City Attorney. We will
need to also review the effect of this taking on Federal grants
that were used for the original purchase of property/

AGREEMENT OF REASSESS2 -MNT
This agreement is made and entered into this 11th day of May, 1993, by and
between the City of Hutchinson, State of Minnesota (City) and Bernard 24cRaith
and Mary McRaith, husband and wife,(Owner).
RECITAL:
1. The City, at the request of the then owners of the property, contracted
for the construction of a variety of municipal improvements, including but not
limited to, sanitary sewer main and services, water main and services, storm
sewer, grading, concrete curb and gutter, gravel base, bituminous base and
surfacing and appurtenances for the following described real estate, all located
within the City of Hutchinson and County of McLeod:
Lot 5, Black 2, Paden First Addition
McLeod County PID # 23.316.0080
City of Hutchinson PID # 12- 116 -30 -08 -0080
2. In connection with those improvements, all of the property described
above was subject to a series of assessments for the cost of the improvements as
is more particularly set out in assessment rolls SA -122, SA -123, SA -126, SA -127,
SA -128, SA -131, SA -132, SA -135, SA -138, SA -142, SA -143 and SA -160.

3. The City and Owner acknowledge and agree that the assessments now
associated with the above - described property, whether levied, pending or
deferred, represent an amount equal to at least the benefit received by the •
property owner for the services rendered by the City in constructing the
improvements described above.
4. In an effort to promote the sale and development of the above described
real estate, the parties hereto desire to enter into an agreement to annul and
reassess the property for the benefit received.
NOW THEREFORE FOR $1.00 AND OTHER GOOD AND VALUABLE CONSIDERATION,
THE PARTIES DO HEREBY AGREE AS FOLLOWS:
1. Agreement of Assessment Annulment and Waiver of Irregularity and
Appeal of Reassessment. The parties hereto have entered into an agreement of
assessment annulment and waiver of irregularity and appeal of reassessment, a
true and correct copy of which is attached hereto, marked as Exhibit "A" and
incorporated as if fully set out herein. It is understood that the noted
assessments will be updated prior to certification to the County. The assessments
shall be assessed for five years at 7% interest, as per City Policy.
2. Representations of Owner. The Owner of the property, represents and
acknowledges that the City has relied on the representations, that it is the sole
owner of the above described parcels and that no party or parties have any prior
interest in the real estate and further agrees to indemnify the City from any
intervening claim that would impair the ability of the City to collect the reimposed
assessments described herein.

• 3. Payment of Assessments. It is understood and aareed that assessments
contemplated under this agreement will be paid in connection with the property
taxes associated with the above described property, or under such procedures as
the County Auditor may determine are appropriate. In no event shall the failure
of the County Auditor to collect the assessments in semi - annual payments with
interest, beginning January 1, 1993, affect the validity of this agreement.
4. Foreclosure by Action. In the event the Owner or its successor, in
interest to any of the described property, forfeits or fails to make payments
either to the Auditor if the Auditor collects the same or to the City if for some
reason payments are not made in connection with the property taxes, then, in that
event, at the sole option of the City, the City may elect to collect the assessments
either through the tax forfeiture process provided by Minnesota State Law or by
foreclosure by action or both.
5. Lien. The City shall have a lien on the property for the unpaid
assessment amounts, as well as accrued interest, if any.
6. Waiver. In addition to the waiver set forth in the attached Agreement of
Assessment Annulment and Waiver of Irregularity and Appeal of Reassessment, the
Owner hereby waives any right to petition for reassessment or to claim the
assessments, either past or present, were not correctly imposed.

SUBJECT: Pickup of Water Damaged Property at Private Homes
We have received numerous calls over the past few days requesting
City involvement in picking up items water damaged in resident
basements.
At this time we have been informing all residents the method of
removal of these items is by contract with any of our licensed
haulers within the City. This comes as a result of our changing of
garbage contracts. Previously the garbage hauler picked up all
such items.
Unless the City Council would decide otherwise, this would be the
policy we would follow for this and any future such occurrence.

RE PUBLICITY FOR "TRY TRANSIT WEEK"
The MN Department of Transportation is encouraging transit
providers throughout the state to observe "Try Transit Week 93"
(May 17 -21) with special promotions. Accordingly, the
Hutchmobile will be publicising and providing free rides on May
19, and conducting drawings for regular riders during the week.
Costs incurred by this promotion are included in our transit
grant marketing line item.

salute to transit personnel and riders. The celebration will take
place May 17th through 21st with the theme "Try Transit Week 93 ".
This is a prime opportunity for you to showcase your system and
recognize the efforts of your system's personnel.
Enclosed is a copy of a materials from the American Public Transit
Association (APTA) announcing Try Transit Week 93, including
Transit Appreciation Day on Wednesday, May 19th. Also included are
sample proclamations, press releases and camera ready logos and
advertisements for your use.
Other themes for the week include: Clean Air, Clean Environment on
Monday, May 17th; Energy Conservation, on Tuesday May isth; Better
Mobility For All, on Thursday May 20th; and Boosting Economic

John R. reported on new procedures for 235 medical supplies.
Supplies are to be picked up at the hospital immediately following
the run.
Brad and department would like to thank the banquet committee for ��
their hard work and the excellent banquet they put on.
Jamie E. requested a 30 day medical leave.
Craig A. talked about summer picnic.
Brad reported on the fire marshal position. The new fire marshal
has been chosen.

Tuesday, April 13, 1993
The meeting opened at 8:50 p.m.
Motion was made and seconded to build dryer for SCBA.
Mike S. reported shift control for aerial control need to be
protected please use correct procedure. Also grass fire air
filters need to be sealed after use otherwise filters will be
ruined.
Jim P. reported air masks must be hung so no part of the mask rests
on SCBA. This permanently deforms the mask preventing a good seal.
Brad reported on fire marshal's hours.
The meeting adjourned at 9:20 p.m.
