(h) CONSIDERATION OF NEW LAW INCENTIVE BILL EARLY RETIREMENT It was noted the 1993 Minnesota Legislature passed an early retirement incentive bill that permits public employers to offer improved retirement benefits to employees from May 17, 1993 through January 31, 1994. WATER AND SEWER ACCOUNTS The motion was made by C- un --ilman Erickson, seconded by Councilman Torgerson and unanimously carried, to authorize discontinuation of service on June 28, 1993 at noon unless other arrangements were made. 3 CITY COUNCIL MINUTES - JUNE 22, 1903 • (b) DISCUSSION OF WARNING SIRENS WITHIN MUNICIPALITY Police Chief Steve Madson presented city maps showing present and proposed locations of the warning sirens. He recommended condensing the system from 12 permanent sirens to 4 rotating, battery- operated sirens. Chief Madson requested authorization to research available federal funding. Following discussion, Councilman Torgerson moved to approve research for federal funding as alternative funding for the warning sirens. Motion seconded by Councilman Erickson and unanimously carried. (c) CONSIDERATION OF AWARDING BIDS FOR NEW CITY HALL BUILDING Wold Architects reported 10 contractors submitted bids for the City Hall project. Breitbach Construction Co. was the low bidder at a base bid of $1,007,700.00. Discussion followed regarding nine options which totaled approximately $69,000.00 and funding of the project. It was reported the Ciiy had $1,321,185.00 funding available. A letter frc*nPttorn.y Jerome P. Gilligan of the Dorsey & Whitney law firm addressed his legal opinion regarding the City use of excess funds in the debt service fund for fully paid general obligation bonds for any general purpose. The motion was made by Councilman Torgerson to accept the low bid of Breitbach, including alternates 1 -9. Motion seconded by Councilman Erickson and unanimously carried. Engineer Rodeberg stated six bids were received for the removal of floor tile and asbestos in the new City Hall building. Skitch Enterprises, Inc. (Pro -Dec) was the low bidder at a cost of $26,660.00.• The motion was made by Councilman Torgerson to approve and award the contract to Skitch Enterprises for $26,660.00 and to waive reading and adopt Resolution No. 9997. (k) CONSIDERATION OF PROPERTY /LIABILITY RENEWAL POLICIES FOR CITY OF HUTCHINSON Dennis Potter, insurance acier_t fcir Insurance Planners and Mark Flaten, risk manager for American Risk Services, presented the City's 1993 -94 property and casualty insurance program, effective July 1, 1993. Following discussion, Councilman Mlinar moved to approve the renewal policies. Motion seconded by Councilman Erickson and unanimouslv carried. (1) CONSIDERATION OF AMENDMENT TO DOWNTOWN LIFE SAFETY PROGRAM Connie Mangan, Housing and Community Development Coordinator, requested an amendment to the downtown life safety program. She reported two buildings were accepted into the program, as well as 12 doors by the Fire Marshal, for an increased cost of $37,812.30. You ask what this means. The answer is that for most cities in the State of Minnesota no procedural changes are required to fill positions where people have retired under the early retirement incentive. In a few cities, where the city manager, coordinator, or administrator has the authority or responsibility to hire and fire, the act would .require a change in procedure. In these manager cities, the manager could not hire a person to replace someone who retired with an early retirement incentive under the act without the city council passing a resolution or motion or some other act authorizing the replacement. However, in the vast majority of cities, where the governing body is the administrative arm as well as the policymaking arm of city government, a resolution or motion to replace the early retiree would be required as usual for any other employee. For purposes of keeping track of backfilled positions, it would probably be wise for the governing body member making the motion or offering the resolution to include wording which identifies this replacement for a person who retired with the early retirement incentive under the act, but that language is not mandated by the statutes. It was certainly the legislature's wish to see the public work force reduced or reorganized by these early retirement incentive options and thus to the extent that it is possible for the city to carry on its normal work activities without backfilling positions, the council would be wise to do that. The League of Cities and PERA office have provided us with basic information about the law. (PERA Information is attached.) The potential impact on employees of the City of Hutchinson follows. OPTION 2: For employees age 65 or older with at least one year of service credit, a pension formula increase can be offered by the City Council, at no cost to employer or employee. If offered, it must be available to all eligible employees. The law summary states that "until June 30, 1995, a local government cannot hire a replacement for a person who retires under this optional program 'except under position - specific action of the governing body.'" PERA interprets this to mean that a council would need to take specific action to replace any employee retiring under the option. Oction 1. One of them (Don Broten) plans to retire this summer at age 65. There has been no discussion to date with the others about any retirement plans. OPTION 2: For employees age 55 to 65 with at least 25 years of service, a pension formula increase or employer -paid health Insurance can be offered. To be eligible for the early retirement incentive program, employees, at minimum, must: • be contributing members of PERA's Basic or Coordinated pension plans, • be currently eligible to draw a PERA pension, and • terminate public employment on or after May 17, 1993, but before January 3,[, 1994. In addition, employees must: ■ be age SS or older with at least 2S years of service in one or more qualified Minnesota public pension plans, Or, ■ be age 6S and have at least one year of service credit in one or more qualified Minnesota public pension plans. The options you may offer to employees under this early retirement program are: Option 1. An increase in the pension formula of 1/4 percent (.25 %) for each year of service up to the first 30 years (the maximum formula increase is 7.5 percent). There is no cost to either the employer or employee for this option. Option 2. Employer -paid health insurance for employees who are between ages 55 and 65 with certain service requirements. You may offer the improved pension formula (option 1), the employer -paid health insurance (option 2), or both options. But eligible employees map elect only one option. Eligible employees tray, however, choose the improved pension option, if it is offered, and accept employer -paid health insurance if such insurance would have been available to them before passage of the early retirement legislation. To inform our members of this new law, PERA will in June send estimates of pensions to PERA members eligible for the improved pension option. The information will include pension estimate both with and without the pension increase afforded by Chapter 192. In addition, PERA will report the features of the early retirement program in the summer edition of our member newsletter, The PERAgraph. As a result of the provisions of Minnesota Statute §465.01 (1988), Minnesota Statute §117.011 (1988), Minnesota Statute §216B.47 (1988) and the Home Rule Charter of the City of Hutchinson, Petitioner has the right to initiate an action to . acquire, and to acquire from the Respondents named in this action, property or necessary interests in property, for the public purposes hereinafter set forth. 5. Petitioner operates an electric utility through the Hutchinson Utility Commission which provides electrical energy to persons, businesses and other entities located within the municipal limits of the City, as well as outside the municipal limits of the City. 6. Respondent, McLeod Cooperative Power Association, Inc. ( "Cooperative ") is a cooperative electric association, organized under the laws of the State of Minnesota, which provides electrical service to persons and entities in McLeod County not residing within the municipal limits of Petitioner. . 7. Respondent, United States of America, through its Administrator of the Rural Electrification Administration (REA) and National Rural Utilities Cooperative Finance Corporation (NRUCFC) are security holders by virtue of a security instrument given by Cooperative on or about the 23rd day of October, 1991 which security instrument was duly recorded with the office of the Secretary of State for the State of Minnesota as Document No. 1452549. 8. Cooperative, according to the files and records of the Minnesota Public Utilities Commission, has an "assigned service area" established pursuant to the procedure sent forth in Minnesota Statute §216B.39 (1988), which includes certain undeveloped lands presently within the municipal limits of the Petitioner where no 0 retail electric customers exist or are served by any electric utility. 9. Included within this assigned service area of Cooperative are the lands described on attached Exhibit "A" lo. The Petitioner and Cooperative entered into an agreement on or about March 11, 1974 and a true and correct copy of said agreement is attached hereto and made a part hereof. Pursuant to the agreement, Petitioner is entitled to provide electric service to the property described on attached Exhibit "A" without providing any compensation to Cooperative for the transfer of the service territory from Cooperative to Petitioner. 11. Cooperative has refused to transfer the service territory to Petitioner for the property described on attached Exhibit "A ". • 12. Petitioner desires to extend its existing electric facilities to serve retail customers located within the property described on attached Exhibit "A" and the governing body of Petitioner has concluded the extension of Petitioner's existing electric facilities to serve the undeveloped land set forth on attached Exhibit "A" is reasonably necessary to serve a public purpose. 13. The governing body of Petitioner has determined that it is necessary that Petitioner serve the undeveloped lands set forth on attached Exhibit "A" as soon as practical, in order to eliminate confusion, potential delay and to provide the City and potential customers with an opportunity to plan for electrical service appropriately. 14. Petitioner to seeks to acquire, in this proceeding, property rights of Respondents, to the extent any exist, represented by the privileges granted to Cooperative by law to provide electric service at retail to future customers in the undeveloped lands set forth on attached Exhibit "A" if Petitioner did not otherwise choose to provide electrical services to these potential customers. 15. None of the aforedescribed lands are presently devoted to a public purpose. WHEREFORE, Petitioner prays for an order of this Court as follows: 1. Adjudging that said taking is for a public purposes, is reasonably necessary and convenient, and is as authorized by law; 2. As you may recall, Assessment Roll No. 284, for Project No. 93 -07 (Erie Street and Huron Street improvements from Second Avenue S.E. onward) include assessments against property owned by Dakota Rail, or its predecessors. Specifically, there is an assessment against property owned by Dakota Rail, Inc. in Block 39 which assessment totals $5,740.68. This block is adjacent to Second Avenue S.E. and contains a rental property as well as general railroad property. The property is rented by the elevator and Great Lakes Gas Company. There is an additional assessment against property owned by Dakota Rail, Inc. in Block 22 which assessment is in the total amount of $11,481.36. This real estate is entirely vacant and includes no rental property. (It does include some storage buildings which are used by the railroad, but these buildings are not presently hooked up to any city services). Mr. Mills and I have had an extensive discussion regarding these assessments. Plotz June 28, 1993 Page 2 He has conceded that the street improvements will probably bring some benefit to his tenants in Block 39. He has pointed out, however, that the railroad also owns property in Block 39 which clearly does not benefit from the improvements even though it is assessed for those improvements. Nonetheless, I feel the City has a fairly strong argument with respect to these properties because they are rental properties and will receive some benefit. I have proposed that Dakota Rail, Inc. pay the entire assessment. They have agreed to do so. They would like the City to verify the amounts charged so that they can determine that the proper running footage was used (and no street right -of -way, for example was included) and they would prefer that the tenants be billed directly. I doubt this is possible, but I did tell Mr. Mills that I would bring up his request at our next regularly scheduled City Council meeting. Normally, the assessment would go on the Assessment Roll, it would be picked up by the County, and included on the property tax statement that Dakota Rail, Inc. will receive. Normally, it would thereafter be their responsibility to pay this assessment and to handle collection from the tenants in whatever manner Dakota Rail, Inc. chooses. We then discussed the assessment against the other property. There is presently no income property that would receive a benefit from roadway or utility improvements. There is presently no use of the property to which the improvements would make any difference. Thus, it seems to me that Dakota Rail, Inc. has a strong argument that it has received no benefit from the improvement, or at least a very minimal benefit. On the other hand, it is clear that these improvements will at least increase the possibility that presently unusable property may be used in the future by the railroad because of improved access, the availability of better sewer and water service and the like. Dakota Rail's proposal is that they pay nothing for this assessment and that the City simply relieve the property from any further obligation. Perhaps a better approach would be to figure out a reasonable connection charge and upon increased use of the property, collect a substantial part of the assessment in that manner. While the entire assessment could not, and probably should not, be collected as a result of a connection charge, this would recover a significant part of the City's cost. I am uncertain as to the present City policy regarding connection charges and perhaps either the Engineering Department or the Building Department could provide more information on this issue. In any event, this issue should be discussed at our next regularly Mr. Gary D. Plotz June 28, 1993 Page 3 scheduled City Council meeting I also bring to your attention the requirement that an appeal be filed by Dakota Rail, Inc. within thirty (30) days of the date the Assessment Roll was adopted. The Assessment Roll was adopted at our last meeting and our next regularly scheduled meeting falls outside of this thirty (30) day window. Rather than force the parties to immediately begin litigation, I have suggested to Council members in other correspondence that I will not raise the thirty (30) day period as a bar to litigation on the part of Dakota Rail, Inc. if the matter is resolved or that litigation is commenced no later than August 1, 1993. His skills in this area would be difficult to replace. Rodeberg, Director of Engineering RE: McKimm Transit Annexation and Utility Service Larry McKimm has requested annexation to the City in order to facilitate the extension of utilities to his business on TH 22 south. The utilities are required to meet state regulations regarding the disposal of wastes potentially generated from a transit facility. The services must be extended from the west side of TH 22 to the east side. This will require boring a casing pipe under the highway, and extending lateral lines through the casing. It is proposed that we extend lines large enough to serve future areas directly to the south, and a watermain large enough to provide for fire service. It is proposed that the McKimm Transit property pay an assessment based on a typical assessment rate, for the lots adjusted front footage, or an assessment equal to the Juul Contracting estimate to serve the property, with or without added expenses. If the triangular lot was squared off, the front footage would be approximately 525 feet. The City's current average assessment rate is approximately $17 /front foot each for sanitary sewer and watermain (or approximately $ 17,850). Following are a few of the calls: - Grass fire, can you believe a grass fire with all the rain we • have had? - Sky -warn - Lightning strike at the Goldschm_d*_ residence. - Mutual Aid to Silver Lake Fire llepa :,rme.nt for a barn fire. - Assist McLeod County with a car i. ') *_ter Lake. - Rescue from a runaway car after the Water Carnival parade. DRILLS FOR JUNE - Inventory - This is done twice a to help keep track of our equipment. - Hose Testing - This is done once a year. This time we had S, 50' lengths of 2 1/2" hose break, w:. For local government, a Presidential Disaster Declaration means 90% of allowable expenses incurred can be reimbursed through state and federal funding. The Emergency Services Division of the Sheriff's Dept will be filing a "Notice of Interest" for reimbursement of public funds due to cost incurred from the heavy rains and flooding throughout the county. any local government agency desiring to be included and represented by McLeod County in this notification of interest should contact myself or Rhonda Zajicek at 861 -3131 before July 16th if possible. Should you want to declare your own "Notice of Interest ", there will be a meeting at 10:00 July 16, at 1661 Park Ridge Dr, Chaska, MN explaining everything you would need to is qualify for reimbursement. For those that wish to be represented by McLeod County, a meeting will be held on Monday July 19th at 09:00 in the Assembly Room of the McLeod County Courthouse that will assist you with the forms and allowable expenses. Please try to have a representative from your jurisdiction available. If no one can possibly be in attendance we will make other arrangements to get the information to you. For those of you I have not spoken with, these reimbursable expenses will include emergency and mitigation costs including materials, labor, existing equipment use, rented equipment, damage to existing equipment and other related expenses due to the rains and flooding since May 6, 1993. Effected areas include buildings, equipment, roads, culverts, recreational areas, and other public owned areas effected by the rains and flooding. Although not all of these problem areas have been corrected as of yet, a "to date" cost should be established along with a listing of list of uncompleted projects with an estimated cost of completion. In your correspondence, you rely on exclusion 2b of Coverage A stating the coverage does not apply to a contractual agreement. Please be advised that plaintiff's claims, while they arise in part out of an alleged agreement with the city, also include a claim that the City of Hutchinson is not authorized to charge plaintiff, under general principles of Minnesota law, for sewerage services in the manner chosen by the city. Essentially, plaintiff alleges that he is being deprived of his assets and unfairly charged for sewer services. The contractual exclusion clearly does not apply to this argument. It would seem to me that the city is entitled to a defense in indemnity under Coverage D under this theory as well. Huff /Ulrich moved to discontinue bookmobile service effective August 1, 1993. Motion approved 19 in favor, 3 opposed. Motion to approve proposed 1994 budget was made • (Sanders /Hauer). Houlahan explained FY 94 state and federal budget. Matson explained income and expense for city and county libraries. Counties are being asked for a five percent increase. Increase from cities varies. Capital money is being requested from cities and counties for automation equipment. Motion passed. c. System Study Committee -- Alsop presented report. Committee recommends reference, interlibrary loan, delivery, and technical services be moved to Montevideo Library. Alsop /Huff moved above. Passed. Alsop /Nevins moved to approve proposed lease agreement. Passed. Matson presented FY 1994 grant applications for state and federal funds, totaling $396,000.
