Engineer Rodeberg noted the City received a signed
petition and waiver of hearing for project No. 93 -18 from
property owner Muriel Felska.
Following discussion, Councilman Erickson moved to
approve and accept the engineer's report and the petition
to waive hearing, to waive readings and adopt Resolutions
No. 9980 -9982, contingent upon receiving a signed waiver
from Robert and Karen Peterson. Motion seconded by
Councilman Mlinar and unanimously carried.

(h) CONSIDERATION OF NEW LAW
INCENTIVE BILL
EARLY RETIREMENT
It was noted the 1993 Minnesota Legislature passed an
early retirement incentive bill that permits public
employers to offer improved retirement benefits to
employees from May 17, 1993 through January 31, 1994.
Since there was a question on the wordage regarding
replacement of an employee who retires, it was the
consensus of the Council to obtain language clarification
before any action was taken.

Gene Anderson from Rust Engineering presented a report on
the comprehensive sanitary sewer plan, including options,
costs, and pipe sizes, for future expansion in the south
and southwest areas of the city.
No action was required on the report.

The motion was made by C- un --ilman Erickson, seconded by
Councilman Torgerson and unanimously carried, to
authorize discontinuation of service on June 28, 1993 at
noon unless other arrangements were made.

(b) DISCUSSION OF WARNING SIRENS WITHIN MUNICIPALITY
Police Chief Steve Madson presented city maps showing
present and proposed locations of the warning sirens. He
recommended condensing the system from 12 permanent
sirens to 4 rotating, battery- operated sirens. Chief
Madson requested authorization to research available
federal funding.
Following discussion, Councilman Torgerson moved to
approve research for federal funding as alternative
funding for the warning sirens. Motion seconded by
Councilman Erickson and unanimously carried.
(c) CONSIDERATION OF AWARDING BIDS FOR NEW CITY HALL BUILDING
Wold Architects reported 10 contractors submitted bids
for the City Hall project. Breitbach Construction Co.
was the low bidder at a base bid of $1,007,700.00.
Discussion followed regarding nine options which totaled
approximately $69,000.00 and funding of the project. It
was reported the Ciiy had $1,321,185.00 funding
available. A letter frc*nPttorn.y Jerome P. Gilligan of
the Dorsey & Whitney law firm addressed his legal opinion
regarding the City use of excess funds in the debt
service fund for fully paid general obligation bonds for
any general purpose.
The motion was made by Councilman Torgerson to accept the
low bid of Breitbach, including alternates 1 -9. Motion
seconded by Councilman Erickson and unanimously carried.
Engineer Rodeberg stated six bids were received for the
removal of floor tile and asbestos in the new City Hall
building. Skitch Enterprises, Inc. (Pro -Dec) was the low
bidder at a cost of $26,660.00.•
The motion was made by Councilman Torgerson to approve
and award the contract to Skitch Enterprises for
$26,660.00 and to waive reading and adopt Resolution No.
9997. Motion seconded by Councilman Mlinar and
unanimously carried.

EMPLOYEE SALARIES
It was reported there was no wage freeze on city
employees' salaries. No action was required.
(k) CONSIDERATION OF PROPERTY /LIABILITY RENEWAL POLICIES FOR
CITY OF HUTCHINSON
Dennis Potter, insurance acier_t fcir Insurance Planners and
Mark Flaten, risk manager for American Risk Services,
presented the City's 1993 -94 property and casualty
insurance program, effective July 1, 1993.
Following discussion, Councilman Mlinar moved to approve
the renewal policies. Motion seconded by Councilman
Erickson and unanimouslv carried.
(1) CONSIDERATION OF AMENDMENT TO DOWNTOWN LIFE SAFETY
PROGRAM
Connie Mangan, Housing and Community Development
Coordinator, requested an amendment to the downtown life
safety program. She reported two buildings were accepted
into the program, as well as 12 doors by the Fire
Marshal, for an increased cost of $37,812.30.
Following discussion, Eoun;ilman Torgerson moved to
approve the amendment. Motion seconded by Councilman
Lenz and unanimously carried.
(m) CONSIDERATION OF DOWNTOWN COMMERCIAL REHABILITATION LOAN
PROGRAM
Connie Mangan, HCDC Coordinator, reported the HCDC Board
recommended char.ging the lean terms to 6k interest on a
15 year term or 4% interest on a 10 year term at the
option of the building owner, as well as an addition to

Following discussion, Councilman Lenz moved to approve
the amendment and set the interest rate at 4% for 15
years and 2% for 10 yea=s. Motion seconded by Councilman

(n) CONSIDERATION OF LEASE AGREEMENT BETWEEN CROW RIVER ARTS,
INC. AND CITY OF HUTCHINSON
Following discussion, Councilman Erickson moved to
approve entering into a lease agreement with Crow River
Arts, Inc. for the period of September 1, 1993 through
December 31, 1994 for $5,000.00 rental cost. Motion
seconded by Councilman Mlinar and unanimously carried.

(a) COMMUNICATIONS FROM CITY ATTORNEY
Attorney Anderson presented a Resolution to vacate a
portion of First Avenue N E. for the liquor store
condominium.
The motion was made by Councilman Lenz, seconded by
Councilman Mlinar and unanimously carried, to waive
reading and adopt Resolution No. 9994.
(b) COMMUNICATIONS FROM FINANCE DIRECTOR
Director Kenneth Merrill retorted Jean ward would like to
present the Maxfield Housing Study to the City Council at
a special meeting.
Following discussion, Councilman Erickson moved to hold
a special meeting with the HRA at 6:00 P.M. on July 13,
1993. Motion seconded by Councilman Lenz and unanimously
carried.
Director Merrill comment ?d oa the 1993 improvement bonds •
and water tower funding.
Councilman Mlinar moved to authorize contacting bond
consultant Ehlers & Associates for the bond issue.
Motion seconded by Councilman Torgerson and unanimously
carried.
(c) COMMUNICATIONS FROM COUNCILMAN MARLIN TORGERSON
Councilman Torgerson inquired about Mr. Buske's refuse
container problem. He also asked if the pigeon droppings
at the hotel stairway had been resolved.
Councilman Torgerson quest ioned if the deadline had been
met for filling in holes on Hwy. 7 West property (All
Season) . Engineer Rodeberg responded the DNR recommended
giving the owner 30 days in which to comply.

Councilman Lenz inquired about follow up on the curb and
dirt in the street.

(e) COMMUNICATIONS FROM DIRFCIOR OF ENGINEERING
Engineer Rodeberg made re { =rence to the area around the
southwest storm sewer. H-2 sugcested reducing the load on
the problem area by rua:L_irg a line up to Jefferson
Street.
The City Engineer requested approval on behalf of
Albrecht Oil Co. for Ncv'a Ervi.ronmental Services, Inc. to
perform soil borings and /or __ound water monitoring well
installation on City property (fire station) . It was
noted that if a monitoring well was installed, Albrecht
Oil Co. would be responsible for all costs incurred.
The motion was made by Councilman Torgerson, seconded by
Councilman Mlinar and unanimously carried, to approve and
enter into agreement.

I am respectfully requesting Council consideration to finance up to $1,600.00 to
attend the 1993 I.C.B.O. Code Development Conference in Sacramento, California,
September 10th - 17th.
This travel request represents my first request for financial support for an
. out -of -state conference in my 8 -1/2 year career history with the City of
Hutchinson.
This conference is important and unique in that a code - change moratorium has
been placed on the three model codes by the Federal Government requiring
integration to become more competitive internationally. Also, incorporation of the
metric system and proposal to incorporate revised handicap access regulations
will be heard.
If approved, funding for this request can be taken from excess Building
Department revenues or 1985 -1991 rebated surcharge monies.

Community Video Network, Inc. and president of the corporation.
As you know, there have been some discussions between the City of Hutchinson and the public
access channel regarding locating the channel in the new City Hall structure. The Board of
Directors has asked me to advise you that HCVN is not only interested in such an arrangement,
we believe it would be in the best interests of both the city and HCVN.
As I understand it, there is approximately 1100 square feet available in the rear of the building
and this would suit HCVN's needs. I believe our conversation centered around the possibility
of securing some estimates from the contractor who receives the award for the remodeling of
City Ball. While the construction work necessary for HCVN is not particularly extensive, there
will need to be a wall or two put up and perhaps some other fairly minimal remodeling.
In that regard, HCVN would then continue to pay rent (as it does in its present location) until
the city's costs are fully covered and thereafter, the city and HCVN could negotiate for a
longer term, if that seems to be in the best interests of everyone. Obviously, HCVN recognizes
that as the city grows and the needs of the city change, the space may be ultimately be needed
for other purposes, but in the interim, this is an excellent match for both parties.

recreational buildings, parks, playgrounds, hospitals,

Historically, the City of Hutchinson has had a problem with
Christmas tree signs being placed on City boulevards and private
properties other than the sale premises.
Because both of these practices are prohibited by City ordinance,
it is required that prior approval by the City Council be obtained.
Any violation of this ordinance during the year 1992 will be
recorded and the documentation of such violation may prohibit
issuance of a 1993 permit.

This letter is in confirmation of our conversation of June 24th concerning the meaning of the provision in
Laws 1992, Chap. 192 (the early retirement incentive act), requiring position- specific action of the
governing body to replace a retiring employee. You ask what this means.
The answer is that for most cities in the State of Minnesota no procedural changes are required to fill
positions where people have retired under the early retirement incentive. In a few cities, where the city
manager, coordinator, or administrator has the authority or responsibility to hire and fire, the act would
.require a change in procedure. In these manager cities, the manager could not hire a person to replace
someone who retired with an early retirement incentive under the act without the city council passing a
resolution or motion or some other act authorizing the replacement.
However, in the vast majority of cities, where the governing body is the administrative arm as well as the
policymaking arm of city government, a resolution or motion to replace the early retiree would be required
as usual for any other employee. For purposes of keeping track of backfilled positions, it would probably
be wise for the governing body member making the motion or offering the resolution to include wording
which identifies this replacement for a person who retired with the early retirement incentive under the act,
but that language is not mandated by the statutes.
It was certainly the legislature's wish to see the public work force reduced or reorganized by these early
retirement incentive options and thus to the extent that it is possible for the city to carry on its normal work
activities without backfilling positions, the council would be wise to do that. However, the legislature left
that decision in the hands of the local governing body.

RE EARLY RETIREMENT INCENTIVE BILL
The 1993 Minnesota Legislature passed an early retirement
incentive bill that permits public employers to offer improved
retirement benefits to employees from May 17, 1993 through
January 31, 1994. The League of Cities and PERA office have
provided us with basic information about the law. (PERA
Information is attached.) The potential impact on employees of
the City of Hutchinson follows.
OPTION 2: For employees age 65 or older with at least one
year of service credit, a pension formula increase can be offered
by the City Council, at no cost to employer or employee. If
offered, it must be available to all eligible employees.
The law summary states that "until June 30, 1995, a local
government cannot hire a replacement for a person who retires
under this optional program 'except under position - specific
action of the governing body.'" PERA interprets this to mean
that a council would need to take specific action to replace any
employee retiring under the option.
Oction 1. One of them (Don Broten) plans to retire this summer
at age 65. There has been no discussion to date with the others
about any retirement plans.
OPTION 2: For employees age 55 to 65 with at least 25 years
of service, a pension formula increase or employer -paid health
Insurance can be offered. No City employees meet this guideline

employer -paid health insurance coverage — or both — to eligible members of PERA's Basic
and Coordinated pension plans. To be eligible for the early retirement incentive program,
employees, at minimum, must:
• be contributing members of PERA's Basic or Coordinated pension plans,
• be currently eligible to draw a PERA pension, and
• terminate public employment on or after May 17, 1993, but before January 3,[, 1994.
In addition, employees must:
■ be age SS or older with at least 2S years of service in one or more qualified Minnesota
public pension plans,
Or,
■ be age 6S and have at least one year of service credit in one or more qualified Minnesota
public pension plans.
The options you may offer to employees under this early retirement program are:
Option 1. An increase in the pension formula of 1/4 percent (.25 %) for each year of service
up to the first 30 years (the maximum formula increase is 7.5 percent). There is no cost to either
the employer or employee for this option.
Option 2. Employer -paid health insurance for employees who are between ages 55 and 65
with certain service requirements.
You may offer the improved pension formula (option 1), the employer -paid health
insurance (option 2), or both options. But eligible employees map elect only one option.
Eligible employees tray, however, choose the improved pension option, if it is offered, and
accept employer -paid health insurance if such insurance would have been available to them
before passage of the early retirement legislation.
To inform our members of this new law, PERA will in June send estimates of pensions to
PERA members eligible for the improved pension option. The information will include pension
estimate both with and without the pension increase afforded by Chapter 192. In addition,
PERA will report the features of the early retirement program in the summer edition of our
member newsletter, The PERAgraph.
Questions concerning the improved pension option may be directed to PERA's Member
Services Division at 1 (800) 652 -9026 or (612) 296 -7460. It is suggested that you obtain
additional information about the employer -paid health insurance option by
reviewing Minnesota Laws Chapter 192 or by contacting the individual or firm
responsible for providing your legal services.

The HCDC finance committee met on Wednesday, June 16, 1993, and
discussed Augusta Building Corporation's request for tax
increment financing. Augusta Building Corporation requested that
the City of Hutchinson provide $126,576 in tax increment
financing assistance for the construction of a 24 unit multi-
family building consisting of 3 bedroom apartments and 12
garages. Augusta Building has received $367,298 in low income
tax credits for the project.
After review of Augusta's proposal the HCDC finance committee
recommends rejection of the proposal because:
1.) Precedent of establishing a housing increment district
2.) Lack of equity injection in this project by Augusta
Building Corporation
The HCDC Board of Directors agrees with the Finance committee
and recommends denial.

Enclosed please find rough draft copies of the condemnation
pleadings in connection with the proposed quick take of the
electrical service territory known as the "Compton- Anderson"
property.
I do want to bring to your attention one issue. In discussing this
matter with Willard Pellinen, he tells me that the north 700 feet
of the west 373.37 feet contains a house. I assume this house is
presently served by the Cooperative. Are we condemning this
territory as well? If so, the legal description should be amended
and specific reference to this situation should be made.
Also, the legal description for the property involved includes an
exception for some property owned by a church. I am presuming that
we intend to condemn this territory and accordingly, I have omitted
that exception.
Again, please advise if this is not the case.
I am enclosing for your information a copy of the legal description
for the Compton Anderson property which notes these two exceptions
(the exception for improved property and the exception for the
property owned by the church).

TO THE ABOVE NAMED COURT:
Petitioner, the City of Hutchinson, Minnesota ( "Petitioner ")
respectfully states and alleges as follows:
1. Petitioner is a municipal corporation duly organized and
existing under the laws of the State of Minnesota and is authorized
by law to exercise the right of eminent domain.
2. Petitioner seeks to acquire the interests and property
rights hereinafter described for public purposes.
3. On July 13, 1993, at the regular meeting of the City
Council of the City of Hutchinson, said Council, in the exercise of
its legislative powers, adopted a Resolution determining that it
was necessary, proper and expedient and in the interests of the

public health, convenience and general welfare of the citizens of •
the City of Hutchinson to acquire title to and use of the
electrical service areas and such other property interests as are
necessary therein, over, under, across and through the lands
described in attached Exhibit "A" incorporated as if fully set out
herein, all of which lands are located in the City of Hutchinson,
County of McLeod, State of Minnesota. A copy of the Resolution
approved by the Hutchinson City Council is attached hereto as
Exhibit "B" and is made a part of this Petition as though fully set
out.
4. As a result of the provisions of Minnesota Statute §465.01
(1988), Minnesota Statute §117.011 (1988), Minnesota Statute
§216B.47 (1988) and the Home Rule Charter of the City of
Hutchinson, Petitioner has the right to initiate an action to .
acquire, and to acquire from the Respondents named in this action,
property or necessary interests in property, for the public
purposes hereinafter set forth.
5. Petitioner operates an electric utility through the
Hutchinson Utility Commission which provides electrical energy to
persons, businesses and other entities located within the municipal
limits of the City, as well as outside the municipal limits of the
City.
6. Respondent, McLeod Cooperative Power Association, Inc.
( "Cooperative ") is a cooperative electric association, organized
under the laws of the State of Minnesota, which provides electrical
service to persons and entities in McLeod County not residing
within the municipal limits of Petitioner.
. 7. Respondent, United States of America, through its
Administrator of the Rural Electrification Administration (REA) and
National Rural Utilities Cooperative Finance Corporation (NRUCFC)
are security holders by virtue of a security instrument given by
Cooperative on or about the 23rd day of October, 1991 which
security instrument was duly recorded with the office of the
Secretary of State for the State of Minnesota as Document No.
1452549.
8. Cooperative, according to the files and records of the
Minnesota Public Utilities Commission, has an "assigned service
area" established pursuant to the procedure sent forth in Minnesota
Statute §216B.39 (1988), which includes certain undeveloped lands
presently within the municipal limits of the Petitioner where no
0 retail electric customers exist or are served by any electric
utility.
9. Included within this assigned service area of Cooperative
are the lands described on attached Exhibit "A"
lo. The Petitioner and Cooperative entered into an agreement
on or about March 11, 1974 and a true and correct copy of said
agreement is attached hereto and made a part hereof. Pursuant to
the agreement, Petitioner is entitled to provide electric service
to the property described on attached Exhibit "A" without providing
any compensation to Cooperative for the transfer of the service
territory from Cooperative to Petitioner.
11. Cooperative has refused to transfer the service territory
to Petitioner for the property described on attached Exhibit "A ".
• 12. Petitioner desires to extend its existing electric
facilities to serve retail customers located within the property
described on attached Exhibit "A" and the governing body of
Petitioner has concluded the extension of Petitioner's existing
electric facilities to serve the undeveloped land set forth on
attached Exhibit "A" is reasonably necessary to serve a public
purpose.
13. The governing body of Petitioner has determined that it is
necessary that Petitioner serve the undeveloped lands set forth on
attached Exhibit "A" as soon as practical, in order to eliminate
confusion, potential delay and to provide the City and potential
customers with an opportunity to plan for electrical service
appropriately.
14. Petitioner to seeks to acquire, in this proceeding,
property rights of Respondents, to the extent any exist,
represented by the privileges granted to Cooperative by law to
provide electric service at retail to future customers in the
undeveloped lands set forth on attached Exhibit "A" if Petitioner
did not otherwise choose to provide electrical services to these
potential customers.
15. None of the aforedescribed lands are presently devoted to
a public purpose.
WHEREFORE, Petitioner prays for an order of this Court as
follows:
1. Adjudging that said taking is for a public purposes, is
reasonably necessary and convenient, and is as authorized by law;
2. Appointing three disinterested persons, and at least two
alternates, residents of McLeod County, as commissioners to
• ascertain and report the amount of damages, if any, that may be
occasioned by the taking; fixing the time and place of the first
meeting of the commissioners; prescribing their compensation; and
requiring the commissioners to file their report with the District
Court Administration, within one hundred eighty (180) days unless
said time by further extended by order of the Court;
3. Petitioner further prays for an order of this Court
pursuant to Minnesota Statute §117.042 authorizing the transfer to
Petitioner of all right, title and interest in and to the electric
service areas and associated property rights to said real estate
described in Exhibit "A" effective as of November 1, 1993; and
4. Such other and further relief as this Court finds just and
equitable.

Whenever the Petitioner shall require title and

to the filing of an award by the court - appointed
commissioners, the Petitioner shall, at least ninety (90)
days prior to the date on which possession is to be
taken, notify the owner of the intent to possess by
notice served by certified mail and before taking title
and possession shall pay to the owner or deposit with the
court an amount equal to Petitioner's approved appraisal
of value. Amounts deposited with the court shall be paid
out under the direction of the court. If it is deemed
necessary to deposit the above amount with the court the
Petitioner may apply to the court for an order
transferring title and possession of the property or •
properties involved from the owner to the Petitioner. In
all other cases, Petitioner has the right to the title
and possession after the filing of the award by the
court - appointed commissioners as follows:
(a) if appeal is waived by the parties upon payment of
the award;
(b) if appeal is not waived by the parties upon payment
or deposit of three fourths of the award. The
amount deposited shall be deposited by the clerk of
court in an interest bearing account no later than

RESOLUTION NO. 10000
THIS RESOLUTION is made and entered this 13th day of July,
1993, by the Hutchinson City Council.
RECITALS:
1. The City of Hutchinson includes within its incorporated
territory the following described real estate:
The Southeast Quarter of the Southeast Quarter of Section
2, Township 116 North, Range 30 West of the Fifth
Principal Meridian, except the north 700 feet of the west
373.37 feet thereof, all located in McLeod County, State
of Minnesota.
2. Said property is located within the city limits of the
City of Hutchinson and has been so located since 1987.
3. The property is unimproved, but is the subject of plans
for improvement in 1993, 1994 and subsequent years, with said
improvements consisting of and including but not limited to home
. building, road and utility installation and similar construction.
4. The McLeod Cooperative Power Association asserts that the
property is part of the Cooperative's service territory.
5. As a result of an agreement dated March 11, 1974 between
the City of Hutchinson and the Cooperative, the above described
property is or ought to be within the service territory of the City
of Hutchinson.
6. The City of Hutchinson provides electrical and other
utility services to properties both within and without the City of
Hutchinson and is in a position to provide services to the property
described above.
7. The City of Hutchinson and the Cooperative have been
unable to agree on the orderly transfer of the service territory
for the above described property from the Cooperative to the City
of Hutchinson.
8. For the convenience of the residents of the above
described property and for other good and sufficient reasons, it is
in the public interest for the City to acquire the electrical
service territory for the above described real estate by the use of
eminent domain proceedings.
. 9. Acquisition by the municipality of the electrical service
territory furthers important public policy and municipal objectives
including but not limited to local citizen control of electric

standards and provision for a financial return to the City.
10. Acquisition of electrical service territory is important
to the City and is consistent with acquisition of service territory
in the past as the City has grown.
NOW THEREFORE, HE IT RESOLVED by the City Council for the City
of Hutchinson, Minnesota: that the law firm of Arnold & McDowell,
as counsel for the City of Hutchinson, is hereby authorized to
commence and complete eminent domain proceedings pursuant to
Chapter 117 of Minnesota Statutes for the purpose of acquiring the
electrical service territory for the above described real estate
including authorization to acquire the service territory by the use
of the accelerated acquisition provisions ( "Quick Take ") of Chapter
117 of Minnesota•Statutes.

I am writing to you today with regard to the special assessments
pending against property owned by Dakota Rail, Inc.
As you may recall, Assessment Roll No. 284, for Project No. 93 -07
(Erie Street and Huron Street improvements from Second Avenue S.E.
onward) include assessments against property owned by Dakota Rail,
or its predecessors.
Specifically, there is an assessment against property owned by
Dakota Rail, Inc. in Block 39 which assessment totals $5,740.68.
This block is adjacent to Second Avenue S.E. and contains a rental
property as well as general railroad property. The property is
rented by the elevator and Great Lakes Gas Company.
There is an additional assessment against property owned by Dakota
Rail, Inc. in Block 22 which assessment is in the total amount of
$11,481.36. This real estate is entirely vacant and includes no
rental property. (It does include some storage buildings which are
used by the railroad, but these buildings are not presently hooked
up to any city services).
Mr. Mills and I have had an extensive discussion regarding these
assessments.

He has conceded that the street improvements will probably bring
some benefit to his tenants in Block 39. He has pointed out,
however, that the railroad also owns property in Block 39 which
clearly does not benefit from the improvements even though it is
assessed for those improvements. Nonetheless, I feel the City has
a fairly strong argument with respect to these properties because
they are rental properties and will receive some benefit. I have
proposed that Dakota Rail, Inc. pay the entire assessment. They
have agreed to do so. They would like the City to verify the
amounts charged so that they can determine that the proper running
footage was used (and no street right -of -way, for example was
included) and they would prefer that the tenants be billed
directly. I doubt this is possible, but I did tell Mr. Mills that
I would bring up his request at our next regularly scheduled City
Council meeting. Normally, the assessment would go on the
Assessment Roll, it would be picked up by the County, and included
on the property tax statement that Dakota Rail, Inc. will receive.
Normally, it would thereafter be their responsibility to pay this
assessment and to handle collection from the tenants in whatever
manner Dakota Rail, Inc. chooses.
We then discussed the assessment against the other property. There
is presently no income property that would receive a benefit from
roadway or utility improvements. There is presently no use of the
property to which the improvements would make any difference.
Thus, it seems to me that Dakota Rail, Inc. has a strong argument
that it has received no benefit from the improvement, or at least
a very minimal benefit. On the other hand, it is clear that these
improvements will at least increase the possibility that presently
unusable property may be used in the future by the railroad because
of improved access, the availability of better sewer and water
service and the like. Dakota Rail's proposal is that they pay
nothing for this assessment and that the City simply relieve the
property from any further obligation. Perhaps a better approach
would be to figure out a reasonable connection charge and upon
increased use of the property, collect a substantial part of the
assessment in that manner. While the entire assessment could not,
and probably should not, be collected as a result of a connection
charge, this would recover a significant part of the City's cost.
I am uncertain as to the present City policy regarding connection
charges and perhaps either the Engineering Department or the
Building Department could provide more information on this issue.

scheduled City Council meeting
I also bring to your attention the requirement that an appeal be
filed by Dakota Rail, Inc. within thirty (30) days of the date the
Assessment Roll was adopted. The Assessment Roll was adopted at
our last meeting and our next regularly scheduled meeting falls
outside of this thirty (30) day window. Rather than force the
parties to immediately begin litigation, I have suggested to
Council members in other correspondence that I will not raise the
thirty (30) day period as a bar to litigation on the part of Dakota
Rail, Inc. if the matter is resolved or that litigation is
commenced no later than August 1, 1993.

RE: Consideration of Establishing New Classification for GIS
Coordinator
We are currently developing the job classification for a new
position to be titled "GIS Coordinator ". The position will
encompass the development and maintenance of the GIS (Geographic
Information System) for the City. The position will also
coordinate all Computer Aided Drafting (CAD) applications. It is
proposed to fund the position 75% from the Engineering Department
and 25% from the Planning Department.
• Larry Huhn of the Engineering Department has completed Associate
Degrees in Engineering Technology and Geographic Information
Systems (3.91 GPA /Gradu ate d with honors). His skills in this area
would be difficult to replace. We are interested in providing a
new position which will allow specific personnel to:
•
> Complete the required work necessary to develop and
maintain the GIS system.
> Coordinate and input new information, select appropriate
software as needed.
> Coordinate G.I.S. activities with all City Departments as
well as Hutchinson Utilities, the County, and other
agencies.
This work will require technical, organizational and communication
skills. It is proposed to change Larry from an Engineering
Technician II (Grade IX /Hourly) to GIS Coordinator (Grade
G /Salaried). He will continue his coordination with the
Engineering Department for computer drafting. We plan and
providing a detailed job description for approval at the next City
Council meeting. We are not proposing to add an additional
employee to fill his current position.

This Agreement, is made this 13th day of July, 1993, between the City of
Hutchinson, State of Minnesota, hereinafter referred to as the City and
Morningside Land Company, Darrel Kothe, Title: , of
Hennepin County, State of Minnesota, and Morningside Land Company, Dean
Limoges, Title: 1, of Hennepin County, State of Minnesota,
hereinafter referred to as Owner.
In consideration of the action of the City Council, at the owner's request, to
cause the improvement of Lots 1 thru 11, Block 1, and Lots 1 thru 18, Block 2,
Santelman's Third Addition by construction of storm sewer, sanitary sewer and
services, watermain and services, concrete curb and gutter, bituminous base,
bituminous surfacing and appurtenances, and to assess 100% of the cost of said
improvements to the Owner, the Owner agrees to pay said percentage, as may be
determined by the Council of the City to be a fair apportionment of the costs of
said improvement not to exceed $ over a period ten years. Owner
expressly waives objection to any irregularity with regard to the said
improvement assessments and any claim that the amount thereof levied against
owner's property is excessive, together with all rights to appeal in the courts.

NHEREAS, pursuant to resolution of the Council adopted July 13th, 1993,
a report has been prepared by the Director of Engineering with reference to

WHEREAS, the Director of Engineering has prepared plans and specifications
for the improvement of Lots 1 thru 11, Block 1, and Lots 1 thru 18, Block 2,
Santelman's Third Addition by construction of storm sewer, sanitary sewer and
services, watermain and services, grading, gravel base, concrete curb and gutter,
bituminous base, bituminous surfacing and appurtenances.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HUTCHINSON,MINNESOTA:
1. Such plans and specifications, a copy of which is attached hereto and made
a part hereof, are hereby approved.
2. The City Administrator shall prepare and cause to be inserted in the official
newspaper, an advertisement for bids upon the making of such improvements under
such approved plans and specifications. The advertisement shall be published for
three weeks, shall specify the work to be done, shall state that bids will be publicly
opened at 2:00 pm on Friday, August 6th, 1993, in the Council Chambers of the City
Hall by the City Administrator and Director of, Engineering, will then be tabulated,
and will be considered by the Council on August 10th, 1993, in the Council Chambers •
of the City Hall, Hutchinson, Minnesota. Any bidder whose responsibility is
questioned during consideration of the bid will be given an opportunity to address
the Council on the issue of responsibility. No bids will be considered unless sealed
and filed with the City Administrator and accompanied by cash deposit, cashier's
check, bid bond or certified check payable to the City of Hutchinson for 10 percent
of the amount of such bid.

RE: McKimm Transit Annexation and Utility Service
Larry McKimm has requested annexation to the City in order to
facilitate the extension of utilities to his business on TH 22
south. The utilities are required to meet state regulations
regarding the disposal of wastes potentially generated from a
transit facility. The services must be extended from the west side
of TH 22 to the east side. This will require boring a casing pipe
under the highway, and extending lateral lines through the casing.
It is proposed that we extend lines large enough to serve future
areas directly to the south, and a watermain large enough to
provide for fire service.
It is proposed that the McKimm Transit property pay an assessment
based on a typical assessment rate, for the lots adjusted front
footage, or an assessment equal to the Juul Contracting estimate to
serve the property, with or without added expenses. If the
triangular lot was squared off, the front footage would be
approximately 525 feet. The City's current average assessment rate
is approximately $17 /front foot each for sanitary sewer and
watermain (or approximately $ 17,850).

The Hutchinson Fire Department had 19 calls in the month of June,
for the first half of 1993 we responded to 127 calls.
Following are a few of the calls:
- Grass fire, can you believe a grass fire with all the rain we
• have had?
- Sky -warn
- Lightning strike at the Goldschm_d*_ residence.
- Mutual Aid to Silver Lake Fire llepa :,rme.nt for a barn fire.
- Assist McLeod County with a car i. ') *_ter Lake.
- Rescue from a runaway car after the Water Carnival parade.
DRILLS FOR JUNE
- Inventory - This is done twice a to help keep track of our
equipment.
- Hose Testing - This is done once a year. This time we had S,
50' lengths of 2 1/2" hose break, w:. Lave never had that many break
before. We are having the hose lo,.,- -d a.i for possible tampering.
- We had a live burn on an old house. fatchinson Twp., this is
very good training for our interior fine- fighters.
EXTRA TIME
is - We were very involved in the water carnival, with the parade on
the river, Sunday parade, mud volleyball and fire works.

County, City and Township Officials;
McLeod County has now been included in the Presidential Disaster
Declaration due to the heavy rains and flooding since May 6th. For
local government, a Presidential Disaster Declaration means 90% of
allowable expenses incurred can be reimbursed through state and
federal funding. The Emergency Services Division of the Sheriff's
Dept will be filing a "Notice of Interest" for reimbursement of
public funds due to cost incurred from the heavy rains and flooding
throughout the county. any local government agency desiring to be
included and represented by McLeod County in this notification of
interest should contact myself or Rhonda Zajicek at 861 -3131 before
July 16th if possible. Should you want to declare your own "Notice
of Interest ", there will be a meeting at 10:00 July 16, at 1661
Park Ridge Dr, Chaska, MN explaining everything you would need to
is qualify for reimbursement.
For those that wish to be represented by McLeod County, a meeting
will be held on Monday July 19th at 09:00 in the Assembly Room of
the McLeod County Courthouse that will assist you with the forms
and allowable expenses. Please try to have a representative from
your jurisdiction available. If no one can possibly be in
attendance we will make other arrangements to get the information
to you.
For those of you I have not spoken with, these reimbursable
expenses will include emergency and mitigation costs including
materials, labor, existing equipment use, rented equipment, damage
to existing equipment and other related expenses due to the rains
and flooding since May 6, 1993. Effected areas include buildings,
equipment, roads, culverts, recreational areas, and other public
owned areas effected by the rains and flooding. Although not all
of these problem areas have been corrected as of yet, a "to date"
cost should be established along with a listing of list of
uncompleted projects with an estimated cost of completion.
Photographs or other documentation would greatly appreciated,
especially for uncompleted projects.

I am enclosing herewith and serving upon you by U.S. Mail the Answer of the Defendant City
of Hutchinson in the above entitled litigation. Also enclosed please find discovery materials
• to which you should respond within the appropriate time frame.
At the present time, I do not have any offer on behalf of the City of Hutchinson to extend to
you. If your client has a settlement proposal, it might be easier for me to take that proposal
to the council for its consideration rather than the reverse. I am reasonably certain that the city
will not be interested in any long term arrangement involving individual meters.
Finally, we have received another check from Mr. Block marked "full payment' but apparently
based on his individual meter formulation. Consistent with past practice, unless you direct
otherwise immediately upon receipt of this letter, I will instruct the City Finance Director to
deposit said check with the understanding that said deposit does not constitute an accord in
satisfaction and is not a waiver of any rights any party may have, notwithstanding the legend
on the check indicating that it is payment in full.

I write to you today in response to your correspondence of February 11, 1993 asking that
GAB, and the league trust, reconsider its position with respect to the provision of a defense
to the City of Hutchinson and indemnity to the City of Hutchinson as to any damages paid out
of this litigation.
In your correspondence, you rely on exclusion 2b of Coverage A stating the coverage does not
apply to a contractual agreement. Please be advised that plaintiff's claims, while they arise in
part out of an alleged agreement with the city, also include a claim that the City of Hutchinson
is not authorized to charge plaintiff, under general principles of Minnesota law, for sewerage
services in the manner chosen by the city. Essentially, plaintiff alleges that he is being
deprived of his assets and unfairly charged for sewer services. The contractual exclusion
clearly does not apply to this argument. It would seem to me that the city is entitled to a
defense in indemnity under Coverage D under this theory as well.

I do not understand your description and use of exclusion 2(d) of Coverage D because that
exclusion deals with employment contracts between the city and its employees. Thankfully,
Mr. Block is not now and never has been an employee of the city.
I would respectfully request that the league trust reconsider its position with respect to
coverage in this case.

Defendant.
Defendant City of Hutchinson, a Minnesota municipal corporation, for its Answer to
Plaintiff's Complaint, now does state and allege as follows:
1. Generally denies each and every allegation as set forth in Plaintiffs Complaint
except as hereinafter qualified, admitted or otherwise answered.
2. Admits that part of Paragraph 1.1 which alleges the place of business of Plaintiff
Hutch, Inc. and its ownership of Country Club Terrace mobile home park but is without
information with respect to the balance of Paragraph 1.1 and therefore denies the same.
3. Admits Paragraphs 1.2, 1.3, and 2.1 of Plaintiff's Complaint.
4. This answering Defendant admits that portion of Paragraph 2.2 which alleges that
water going into the park first passes through a master meter and is then piped into each of the
individual homes located in the park. This answering Defendant is without information with
respect to the balance of Paragraph 2.2 and therefore denies the same.

5. This answering Defendant specifically denies that any agreement was reached, •
as alleged by Plaintiff in Paragraph 3.4 of Plaintiffs Complaint, to provide for billing for
sewerage based on the total of the reading of individual meters located within the park. This
answering Defendant specifically denies that Plaintiff has breached any such agreement and
further specifically denies that Plaintiff will be charged for sewer services not actually used.
6. Plaintiffs Complaint fails to state a cause of action for which relief can be
granted.
7. As and for an affirmative defense, this answering Defendant alleges that any
contract claim sought to be enforced by Plaintiff is barred by the statute of frauds.
8. As and for a second affirmative defense, this answering Defendant alleges that
any claims by the Plaintiff against the Defendant are barred by the application of the doctrines
of waiver or estoppel or both. •
WHEREFORE, Defendant prays for judgment against Plaintiff as follows:
1. For judgment that Plaintiff has been properly charged for sewer services supplied
to Plaintiff;
2. For judgment in favor of the Defendant and against the Plaintiff on the merits
of Plaintiffs Complaint;
3. For judgment in favor of the Defendant and against the Plaintiff for Defendant's
costs and disbursements and for further relief as this Court finds just and equitable.

deposit at Good Samaritan Home in Clinton. Huff /Ulrich moved
to discontinue bookmobile service effective August 1, 1993.
Motion approved 19 in favor, 3 opposed.
Motion to approve proposed 1994 budget was made

(Sanders /Hauer). Houlahan explained FY 94 state and federal
budget. Matson explained income and expense for city and
county libraries. Counties are being asked for a five
percent increase. Increase from cities varies. Capital money
is being requested from cities and counties for automation
equipment. Motion passed.
c. System Study Committee -- Alsop presented report.
Committee recommends reference, interlibrary loan, delivery,
and technical services be moved to Montevideo Library.
Alsop /Huff moved above. Passed. Alsop /Nevins moved to
approve proposed lease agreement. Passed.
Matson presented FY 1994 grant applications for state and
federal funds, totaling $396,000. Miller /Ulrich moved
approval of grant application. Passed.
Houlahan presented need to extend term of present contract
with GRC for catalog services to December 1, 1993.
Huff /Johnsen moved extension of contract. Passed.
d. Automation Committee -- Alsop presented report in absence
of Kreie, committee chair.

e. Policy Review Committee -- Alsop presented committee
report. Committee will June
meet on 29 to discuss concerns
of cities regarding agreement revision, specifically
downsizing of board, authority to borrow money, and
suspension of agreement.
