Adiournment 0 5 MINUTES REGULAR MEETING - HUTCHINSON CITY COUNCIL TUESDAY, OCTOBER 8, 1991 1. The meeting was called to order at 7:30 P.M. by Mayor Ackland. The following were present: Mayor Paul L. Ackland, Aldermen Craig Lenz, John Mlinar, Marlin Torgerson, and Don Erickson. Also present: City Administrator Gary D. Plotz, City Engineer John Rodeberg, and City Attorney G. Barry Anderson. 2. The invocation was given by the Reverend Dan Cloeter. 3. MINUTES The minutes of the regular meeting of September 24, 1991 and bid opening of October 1, 1991 were approved as distributed. 4. ROUTINE ITEMS (a) REPORTS OF OFFICERS, BOARDS AND COMMISSIONS 1. BUILDING OFFICIAL'S REPORT - SEPTEMBER 1991 • 2. AIRPORT COMMISSION MINUTES OF SEPTEMBER 30 1991 The motion was made by Alderman Mlinar, seconded by Ald- erman Lenz and unanimously carried, to order report and minutes filed. 5. PUBLIC HEARING None. 6. COMMUNICATIONS, REQUESTS AND PETITIONS (a) DISCUSSION OF YOUTH CENTER AND PETITIONS FOR DRY DOCK The City Council received numerous petitions and letters from youth which expressed favorable and unfavorable support of the youth center. Approximately 40 youth attended the meeting. Seven students spoke in favor of the location, the need for the program, and the amount of time required to allow the youth center to succeed. Finance Director Kenneth Merrill presented a financial report on Dry Dock's operational expenses. The program had received funding from several private businesses in • addition to the City, school district and United Fund. It was reported there was a shortfall for 1991. CITY COUNCIL MINUTES - OCTOBER 8, 1991 During discussion the Councilmen addressed concern of low youth attendance at Dry Dock, operational expenses at its present location, the possibility of relocation, and con- sideration of other options. Following discussion, it was the consensus of the Council to direct the City Administrator and City Attorney to contact Dry Dock's landlord for a lease extension through the 1992 school year. The Council will then review the youth center's financial situation and consider other alternatives. (b) DISCUSSION OF WATER AND SEWER SERVICE TO WRIGHT PROPERTY Ms. Lorraine Wright discussed water and sewer service to her property on Third Avenue N.W. She requested hookup by November 1, 1991. It was reported that in the past Ms. Wright had not agreed to the City improvements. Engineer Rodeberg sug- gested two options, namely: (1) go into the street and connect the line to the sanitary sewer, or (2) come from the back side on Les Kouba Parkway. The cost to bring sanitary sewer to the property line is approximately • $5,000, with a total cost of $13,500. Following discussion, the motion was made by Alderman Torgerson, seconded by Alderman Mlinar and unanimously carried, to defer until 4:50 P.M. on October 15, 1991. 7. RESOLUTIONS AND ORDINANCES (a) RESOLUTION NO. 9578 - RESOLUTION SETTING ELECTION LOCATION OF PRECINCTS AND APPOINTING JUDGES The motion was made by Alderman Erickson, seconded by Alderman Mlinar and unanimously carried, to waive read- ing and adopt. NEW BUSINESS (a) CONSIDERATION OF MILEAGE REIMBURSEMENT POLICY • Following discussion, the motion was made by Alderman Erickson, seconded by Alderman Torgerson and unanimously carried, to approve increasing mileage reimbursement to 27 cents. (b) CONSIDERATION OF INCOME /ASSET LIMITATIONS FOR SENIOR CITIZEN DEFERRED ASSESSMENTS AND REDUCED REFUSE RATE Following discussion, the motion was made by Alderman Erickson, seconded by Alderman Mlinar and unanimously carried, to approve staff recommendations to use a per- centage of the federal poverty guideline (185% rule, including social security), a $30,000 asset limitation (excluding homestead and car) for deferred assessments, and an income status update on existing reduced refuse accounts,, with a two year review thereafter. (c) CONSIDERATION OF RETAINING WALL AGREEMENT WITH THOMAS AND MICHELLE CARRIGAN Following discussion, the motion was made by Alderman Torgerson, seconded by Alderman Lenz and unanimously car- ried, to approve and enter into agreement. 4 1] CITY COUNCIL MINUTES - OCTOBER 8, 1991 (d) CONSIDERATION OF SELECTING DEVELOPER FOR PHASE II DOWNTOWN REDEVELOPMENT Ericksons /Everest Group Proposal The Ericksons /Everest Group spokesperson stated Everest would be the construction project contractor, and Erick - sons would own and operate the proposed Festival Food store. The three and one -half acre site would provide for 41,000 square feet of store space and 5,000 square feet for additional corner retail space to be leased to the City for a liquor store. The proposal suggested a $595,000 tax free exchange of the present 15,000 square foot More -4 building, to be used as a future City Hall, for the relocation site. In addition, the developer would provide $150,000 for acqui- sition of the three parcels north of Coast to Coast to be included in the project. It was requested that the developer be allowed to use tax increment financing. The project timeframe would be determined by the site delivery date to the developer. It would take six to • nine months to complete construction and to open the store. The target opening date would be January 1, 1993 if site delivery was by April 1, 1992. County Market /Super Valu Proposal The spokesperson for Super Valu stated the 45,000 square foot proposed food store included 5,000 square feet for a municipal liquor store. Once the site was obtained the developer would construct and open a store in a 23 -week timeframe with a target date of October 1992. Following extensive discussion, the motion was made by Alderman Erickson, seconded by Alderman Mlinar and unani- mously carried, to authorize the City Attorney to begin primary negotiations with Ericksons and Everest Group as developer for Phase II. RECESS: The meeting adjourned at 10:00 P.M. for a recess and reconvened at 10:15 P.M. (e) CONSIDERATION OF AWARDING BID FOR TWO POLICE VEHICLES Following discussion, the motion was made by Alderman Torgerson, seconded by Alderman Lenz and unanimously car- is ried, to approve and award contract to Myron Wigen Motor 5 CITY COUNCIL MINUTES - OCTOBER 8, 1991 0 Company for two 1992 police vehicles in the amount of $35,322.62 and to keep the two 1990 vehicles. (f) CONSIDERATION OF CHALUPSKY ASSESSMENT ISSUE City Attorney Anderson reported the Chalupsky deferred assessment had been activated. It was his recommendation that the City approve settlement of the assessment and accept the principal and forfeit the $200 accumulated interest from May 1990. Following discussion, the motion was made by Alderman Torgerson, seconded by Alderman Erickson and unanimously carried, to approve settlement of the Chalupsky assess- ment and to forfeit the interest since May 1990. (g) CONSIDERATION OF COMPENSATION REVISION FOR MAYOR AND COUNCIL Following discussion, the motion was made by Alderman Torgerson, seconded by Alderman Erickson, to waive first reading of revised Ordinance No. 91 -44 so that the monthly salary of the Aldermen shall not exceed the per- centage of the employees yearly salary increase in the • last three years and that the Mayor's proposed salary remain as presented. Upon roll call the motion carried four to one, with Alderman Mlinar voting nay in objec- tion to the Mayor's proposed per diem payment. (h) CONSIDERATION OF REVISED ASSESSMENT SEARCH PROCEDURE AND POLICY Following. discussion, the motion was made by Alderman Lenz, seconded by Alderman Mlinar and unanimously car- ried, to approve the revised assessment search policy. (i) CONSIDERATION OF SOUTH PARK TENNIS COURTS (PARK ELEMENTARY SITE) Following a report by City Administrator Plotz, the motion was made by Alderman Lenz, seconded by Alderman Mlinar and unanimously carried, to enter into an agreement with the school district to pay 50/50 on the cost of an architect/ engineer study, including soil borings, on the South Park tennis courts. 10. MISCELLANEOUS (a) COMMUNICATIONS FROM CITY ADMINISTRATOR • 6 . CITY COUNCIL MINUTES - OCTOBER 8, 1991 Administrator Plotz commented on correspondence received from Star Cablevision regarding their franchise agreement with the City. Attorney Anderson stated it was a breach of faith for Star not to pay HCVN the amount of money. Also, there were complaints about the quality of service. The City Administrator mentioned the City auction to be held October 17 at the Technical College parking lot. It was reported that Sharae Hogan had submitted a writ- ten request for Sgt. Ronald Kirchoff to be allowed to accompany her to the dedication of the National Law Enforcement Memorial in Washington, D.C. on October 14- 15. Following discussion, the motion was made by Alderman Mlinar, seconded by Alderman Torgerson and unanimously carried, to approve the request with the City covering the cost of air fare and one night's lodging. (b) COMMUNICATIONS FROM ALDERMAN CRAIG LENZ Alderman Lenz asked about the status of the revised • zoning ordinance. (c) COMMUNICATIONS FROM ALDERMAN JOHN MLINAR Alderman Mlinar inquired about the DNR Luce Line Trail snowmobile trail. He also commented on a memorandum from the Building official regarding septic tank hook -ups. Alderman Mlinar stated the sump pump problem on Cali- fornia was an issue between two property owners. (d) COMMUNICATIONS FROM CITY ATTORNEY Attorney Anderson reported on a vacation or quick claim deed for the Library Square building since it is one foot into the City right -of -way. (e) COMMUNICATIONS FROM DIRECTOR OF ENGINEERING Engineer Rodeberg commented on the septic tank problem on Ludtke Lane. He stated the City could go across the back property for about the same cost. The City Engineer reported there was an emergency repair on a collapsed storm sewer on Bluff Street for an approx- imate cost of $3,400. He stated the Shopko site sanitary • sewer was to the parking lot. 7 CITY COUNCIL MINUTES - OCTOBER 8, 1991 (f) COMMUNICATIONS FROM FINANCE DIRECTOR Director Kenneth Merrill requested a workshop date for Council review of the proposed 1992 budget. Also present: City Engineer John Rodeberg, Fire Marshal George Field, Building offi- cial Jim Marka, Finance Director Kenneth B. Merrill, and City At- torney G. Barry Anderson. Sanitary And Water Services at 196 & 186 Third Avenue N.W. Engineer Rodeberg reported on the project and commented the work could not be done without violating the City's ordinance. Atten- tion was directed to the Hutchinson Zoning Ordinance, Section 5.05, Repairs And Maintenance. The property in question is a noncon- forming use and is in the 100 year flood plain. He stated it was staff recommendation to activate all past deferred assessments and future assessments on Third Avenue N.W. and actively pursue removal of all substandard and vacant housing on Third Avenue N.W. Attorney Anderson stated there were deferred assessments against the property on a 10 -year payment period. The value of the im- provements exceed the value of the property. If the property were forfeited for back taxes, the property was not worth the amount of the assessments. Mayor Ackland reported Mrs. Lorraine Wright had written a letter opposing the curb and gutter improvement project in 1988 and had objected to water service in the past. He questioned whether the City could activate the deferred assessments according to the May 10, 1988 City Council minutes. The question was whether or not the City should or could install water and sanitary sewer service to the property. Following discussion, Alderman Torgerson moved to accept the recom- mendation of City staff not to provide installation of sanitary sewer line service to the property based on the present City ordi- nance and not to activate the deferred assessments at this time. Motion seconded by Alderman Mlinar and unanimously carried. The meeting was adjourned at 5:40 P.M. NOTE: Engineer Rodeberg made a few minor changes in the content of the minutes after - they had gone out in the Council packets. Both John and I felt the motion needed a couple of words changed to clarify the intent of the motion. Since the Secretary has no authority to modify a motion, I contacted Alderman Torgerson who made the motion and Alderman Mlinar who seconded it. They both gave me verbal approval to reword the last part of the motion for the purpose of clarification. CALL TO ORDER The meeting was called to order by Chairman Bill Craig at 7:30 p.m. with the following members present: E1Roy Dobratz, Tom Lyke, Clint Gruett, Roland Ebent and Chairman Bill Craig. Absent: Dean Wood and Craig Lenz Also Present: Gary Plotz, City Administrator, John Rodeberg, Director of Engineering and G. Barry Anderson, City Attorney. 2. MINUTES Mr. Gruett made a motion to approve the minutes of the regular meeting dated Tuesday, August 20, 1991. Seconded by Mr. Dobratz the motion carried unanimously. 3. PUBLIC HEARINGS • (a) CONTINUATION OF CONSIDERATION OF VARIANCE REQUESTED BY ROBERT HORNICK AT QUIK -HART Chairman Craig reopened the hearing at 7:32 p.m. with the reading of publication #4284 as published in the Hutchinson Leader on Thursday, August 8, 1991. The request is for the purpose of considering a variance to reduce front green space from 15' to 0' located at Hwy 15 and Hwy 7, Quik -Mart. City Administrator Gary Plotz explained the request and staff recommendations. Mr. Jim White, J.R.P. Architects, representing Mr. Hornick commented on the proposed development of Hwy 7 and 15. a stated they would like to compromise on curbing using wheel stops in lieu of permanent curbs. fir. White commented on accesses and the need for different accesses if the property to the West is developed. He presented a new site plan addressing the staff concerns. Discussion followed on the drainage and water and sewer line capacity. . City Engineer John Rodeberg stated staff is comfortable with the green space variance and explained the site plan is to be complete and acceptable before a building permit is issued. i HUTCHINSON PLANNING COMMISSION MINUTES September -17, 1991 NOTE: The variance is for the gas station only. The request is for the purpose of considering a variance to construct a 4'x4' daycare sign at 4 -11th Ave NE. City Administrator Plotz commented on the staff recommendations and home occupation signs in residential zones. He stated staff is concerned with establishing a precedence for many more home occupation signs. (d) CONS*TDERATION OF VACATION OF ALLEY LOCATED BETWEEN MILWAUKEE AND DIVTSION STREET REQUESTED BY WARREN DEMUTH Chairman Craig opened the hearing at 8:01 p.m. with the reading of publication #4294 as published in the Hutchinson Leader on Thursday, September 5, 1991 and Tuesday, September 10, 1991. The request is for the purpose of considering a petition to vacate alley between Milwaukee and Division Street. City Administrator Plotz explained the alley is extra wide at 33'. Normally alleys are 16' wide. City Engineer Rodeberg explained the city has no need for a 33' alley. He stated there is some confusion as to the possibility of that alley being vacated in the past but no record has been found and sugg=sts all but 18' be vacated. There was discussion of the use of this alley. Mr. DeMuth, petitioner, explained the petition and his observation of other garages on the alley. Mr. Rodeberg explained that 18' will address utilities access concerns. Mr. Dobratz moved to close the hearing, seconded by Mr. Ebent and hearing closed at 8:09 p.m. Mr. Gruett made a motion to recommend approval of vacating all but 18' of the alley. Seconded by Fir. Ebent the motion carried unanimously. (e) CONSIDERATION OF VARIANCE FOR GARAGE CONSTRUCTION REQUESTED BY WARREN DEMUTH LOCATED AT 550 BROWN ST Chairman Craig opened the hearing at 8:10 p.m. with the reading of publication #4293 as published in the Hutchinson Leader o:: Thursday, September 5, 1991. The request is for the purpose of considering a variance to reduce side yard setback for garage construction from 6' 3 HUTCHINSON PLANNING COMMISSION MINUTES September 17, 1991 to 2.7'. Mr. Plotz commented on side yard setback requirements and made reference to the untitled 4' between Lots 1 and 2. He explained that staff looks at setbacks of what the property owner actually owns. Mr. Plotz stated that ease of access in not a hardship under State Statute and the ability to move the garage 6 feet is there. He explained that amending the ordinance is being discussed and on the agenda for this meeting, however, staff must go by the ordinance in place at this time. Mr. Warren DeMuth explained his request and presented photos of the present garage condition and difficulty in accessing the garage. Discussion followed on the accessibility to garages. Neighboring property owners voiced concern over the condition of the present garage. Mr. Ebent made a motion to continue the hearing to next month and directed staff to prepare a proposed amendment to the ordinance regarding garages. Seconded by Mr. Dobratz the motion carried unanimously. (f) CONSIDERATION OF VARIANCE FOR SIGN REQUESTED BY DR. MICHAEL MERCK LOCATED AT REGIONAL EYE SPECIALISTS, 221 PREEMONT AVE EAST Chairman Craig opened the hearing at 8:30 p.m. with the reading of publication #4295 as published in the Hutchinson Leader on Thursday, September 5, 1991. The request is for the purpose of considering a variance to reduce setbacks for sign placement at 2 locations, one from 5' to 3.8' and one will encroach into street right - of -way; also, to increase square footage of sings as they are larger than the allowable square footage. City Administrator Plotz commented on the request and read the owners proposed hardship. He commented on the city staff recommendations being concerned with emergencies and different than the hospital. Dr. Merck, owner, commented that patients do drive with bad eyes and explained the reason for the signs. Mr. Nallyn, owner, explained they see emergency cases on a daily basis. Discussion followed on the signs as being directional. 4 HUTCHINSON PLANNING COMMISSION MINUTES September 17, 1991 There was lengthy discussion on signs in the boulevard and Mr. Plotz read the ordinance regarding directional signage. It was suggested the doctors rezone the property to C -4 to allow for the size of the signs. City Attorney Barry Anderson commented on :sting on a variance for placement of the signs and rezone to address size of signs. Mr. Ebent moved to continue the hearing to next month to coincide with the rezoning, seconded by Mr. Gruett the motion carried unanimously. (g) CONSIDERATION OF CONDITIONAL USE PERMIT REQUESTED BY JUNE REDMAN, REDMAN REAL ESTATE FOR CLUSTER. HOUSING LOCATED ON 6TH AVE NE Chairman Craig opened the hearing at 9104 p.m. with the reading of .publication #4296 as published in the Hutchinson Leader on Thursday, September 5, 1991. The request is for the purpose of considering a conditional use permit to allow for the construction of cluster housing located on 6th Ave NE. City Administrator Plotz explained the proposal of multiple housing and what is permitted in R -2 zoning. Ms. Redman explained the history of the property for a lot split, which has already been done. She also explained the cost to replat and resurvey as she unde - stands it. Rod Saar, 595 Peterson Circle, voiced concern with drainage of the property and elevation of the yard. Duwayne Briese, 585 Peterson Circle, explained where his property is and the proposed building placement. Mr. Saar questioned the ordinance permitting such a development. Discussion followed on the unusual size of the lot. Shasyn Smithers,262 6th Ave NE, commented on the parking of vehicles and congestion on the street already. Mr. Saar stated he does not want that type of housing in that area. Sharon Neumann, 590 Peterson Cr, sucgested a park be . placed in the area. 5 HUTCHINSON PLANNING COMMISSION MINUTES September 17, 1991 Discussion followed on the rights of the property owner • to develop his property. Mr. P1'otz explained the replatting procedure and cost involved. City Engineer John Rodeberg stated a developer must meet city requirements as not to affect the neighboring property owner. Chairman Craig explained the development needs to meet code requirements to build anything. Mr. Plotz explained the concept of cluster housing of private ownership on one lot. Mr. Saar stated the issue is the value of his property and again questioned drainage. City - Engineer Rodeberg explained the requirements for drainage. Mr. Smit;:ers is concerned with the excessive access to the property and drainage. The neighboring property owners object to cluster housing and asked to change ordinance. City Attorney Anderson commented that this request must be dealt with according to the present ordinance in place. There was discussion on discrimination of property • development, prohibition and appropriateness in areas and question of a price tag in this issue. Mr. Lyke commented that the planning commission does have a right, according to ordinance to request a site plan. There was discussion on the requirement of the site plan. Mr. Gruett made a motion to table the hearing and that the developer present a site plan addressing drainage, elevation,' parking and covenants. Seconded by Mr. Lyke the motion carried 4 ayes, Chairman Craig voting nay. (h) CONSIDERATION OF VACATION OF EASEMENT REQUESTED BY STEVE WADSWORTH LOCATED ON LEWIS AVE. (b) DISCUSSION OF ZONING ORDINANCE AMENDMENT OF REVISED LANGUAGE REGARDING GARAGE REPLF.CEMENT It was the consensus of the Planning Cormission to change the wording of the ordinance. Discussion followed on the words for existing or all garages. City Attorney Anderson commented the City Council needs to know what the Planning Commission wants and needs. After discussion the Planning Commission agreed possibly using existing garages. 5. OLD BUSINESS (a) CONSIDERATION OF ANNUAL REVIEW Or CONDITIONAL USE PERMIT ON MUNSELL PROPERTY - DANCE STUDIO City Attorney Barry Anderson commented on the property owners agreements and explained fir. (c) COM14UNICATION FROM STAFF City Administrator Plotz commented on a request for rezoning by the county within the 2 mile radius from agricultural to industrial. Mr. Rodeberg stated the well head protection should be considered by the county. The consensus of the Planning Commission is to recommend the county consider well head protection and requests commercial zoning and industrial zoning be on a conditional use basis. 6. I do not believe the personnel policy should deal with emergency procedures. These procedures will vary from time to time and we may need to be able to change them relatively quickly. Including them in the policy will have a tendency to "freeze" these procedures and accordingly, in my opinion, they should be left out. 2. The suggestion to include a policy on snow days is a good one. The personnel policy presently addresses vacation and leave time and the snow days issue should be addressed as well. I would also recommend including the smoke -free policy as well. 1] 3. One of the items raised had to do with the question of the City's funeral leave policy. The suggestion to change the characterization of immediate family to "legally recognized" immediate family probably makes sense in view of second and third marriages. Including grandparents is a matter of choice and does not raise any legal issues should the City wish to include that designation. A question has arisen regarding military leaves. I would recommend leaving the policy as is because this issue is addressed by both federal and state statute. 5. The suggestion that notice be required for parental leave is a good one; however, the fifth month of pregnancy appears to be early for most employees. A 60 -day notice with a waiver in unusual circumstances would appear to be appropriate. 6. A question has arisen regarding leaves without pay. We may not want a failure to return without pay to be grounds for absolute termination. The use of the more flexible "may" language may be helpful in this case. 7. A request has been made to consider a cap on the number of days an individual can be gone for jury duty. I do not believe such a cap is advisable, principally for political reasons. I am not aware of any long running jury trials which have posed a problem to the City and I am not sure the City wants to be in a position of encouraging other employers to limit the commitment a resident gives to his or her civic responsibilities. In the absence of a problem, I recommend no action. 8. Council member Lenz has suggested a five -day filing period for a grievance and I think this is a good suggestion. 9. The suggestion regarding discipline for raffle solicitation and the like does not merit further action at the present time. In the absence of significant problems, and in the absence of a policy on the part of the City, I would just as soon not see this language included in the personnel policy. 10. Finally, as we all know, the subject of sexual harassment has managed to make the news over the course of the last several days. I believe the City's present policy is extremely vague and has not been updated in the last four years. Further revision to this policy necessary. There are some features of the Lenz, Inc. policy that might be worth incorporating and in general, I would be of the opinion that the Lenz, Inc. policy is superior to the City's policy. Rather than adopt that policy, I would recommend the City re -write its existing policy, incorporating such features as may be appropriate in the Hazel Sitz October 16, 1991 Page 3 new policy. I am in the process of pulling together some additional information regarding the sexual harassment policy, but this process will probably take some time. I see no reason to hold up adoption of the personnel policy based on revisions to the sexual harassment policy as we will be making changes in other elements of the policy from time to time anyway. I hope my comments are viewed as helpful. As a sidenote, I would specifically thank council member Lenz for his careful review of the proposed draft. In nearly every case, his suggestions were common sense oriented, practical and helpful. Please do not hesitate to call me with questions. Best personal regards. GENERAL PROVISIONS: The customer will receive scheduled and corrective services as described under detailed provisions for a program of preventive maintenance and repair. Equipment to be maintained Is located at: Wastewater Treatment Plant In addition to maintenance and repair service, F & P will provide at no additional coat: A. Record of maintenance and repairs. B. F & P will supply necessary repair components and invoice at time of installation. 2. Updating of existing equipment will be ac- complished by mutual agreement of both parties at additional cost. E. Warranty and Limitations: 1. Subject to the limitations of Paragraph E (3) below, F & P warrants that all service and repair work performed under this contract shall be free from defects in workmanship and that all F & P manu- factured equipment supplied thereunder shall, at the time of installation, be free from defects In material and workmanship. F & Ps sole obli- gation under this warranty shall be, at F & P's option, to: replace, repair, refurbish, overhaul or rebuild any item of equipment, covered by this agreement, that has been promptly reported to F & P as defective in material and workmanship and upon investigation by F & Pshall be determined by F & P to have been defective. 1. F & P will provide the services of a factory trained representative for preventive maintenance, cali- bration and repair of all equipment listed in Schedule "B ". 2. Secondly, the Council requests to know what percent of this cubic yard volume was attributable to residential pickup and hcw much to commercial pickup from the City of Hutchinson for each month from January I 1990 to April 30, 1991 (16 respective months). Diamond Five may attend or not attend as it sees fit, as it will be a public meeting and even though litigation may ensue, at the present time, it is not my intention to close the meeting. A -� I told you over the telephone when we discussed this matter last week, the City was sa',A sfied with the performance of Diamond Five relative to the work undertaken by Diamond Five. There is a substantial and significant disagreement regarding the interpretation of the contract and it is the feeling of the City that there is no ambiguity in the contract. Further, I am advised by the City Engineer that final payment was accepted by Diamond Five despite express warnings by the City that such payment might be a.waiver of its rights to appeal under the terms of the contract. I'm not sure that this is an issue, but I bring it to your attention for your information at the' present time. Our client has asked us to bring legal action to collect a claim for salvage items which were not received in the demolition project performed under the contract. • At your request, we are providing an itemization of the claim. Attached is a list which was prepared by Quentin Larson as he and Mr. Madsen reviewed the salvage items. Mr. Larson apparently has more detailed notes on the size, model, brand, etc. of the mechanical equipment. The values written on the list were written by Mr. Madsen. tie have the following information and comments in support of those values: CAR QUEST: Heat /air conditioner (shop) - one - $500.00 This is a roof unit. Mr. Madsen has sold approximately 150 salvaged units such as this. He normally expects to receive 20 to 30 percent of the new value. This is how he arrived at this value. He has various buyers coming through every few months who buy these'in bulk, often as much as a pickup load at a time. Most of the three phase equipment goes to the Twin City area. He has checked with Root Equipment Supply, 3930 University Ave SE, Columbia Heights, (788 -9738) to verify that these values are accurate. Exterior doors (service) - five - $ -0- Items were received and should be deleted from the list. Exterior door (service) - one - $150.00 This was a steel door with no window which was taken off of the back of the building. Interior doors - eight - _$480._00 These are valued at $50.00 each. They include the wood door, the frame and the hardware. These were office doors in good condition and could have been sold for this amount. • page 3 40 MOBILE: Gas pumps - three - $1,500.00 The value of these pumps was obtained by calling Zahl Equipment Company which is in the business of selling these. Their number is 331 -8550. Air conditioning unit - one - $750.00 This unit had the air compressor cn the YoGf wit.. the coil on top of the furnace. This type of, equipment is very adaptable to a large furnace. Probable cost new is $2,000.00. Heating units - two - $800.00 These are large gas furnaces, probably double the size of the typical home furnace. The items listed in the steel building /tire shop should be • deleted. Mr. Madsen voluntarily gave those up to the city as part of the negotiations on that building after the contract was made. Therefore, his claim totals $7660.00. Demolition contractors rely on the salvage as part of their compensation. The salvage is evaluated as part of the process of calculating a bid. For this purpose, Mr. Madsen did a "walk through" of the buildings with which he was not already familiar. The Contract, therefore, clearly indicates that no further compensation is due for these properties: - Condition of the structures was not guaranteed. - None of the properties you are requesting additional compensation for were vacated prior to December 21, 1991. - Neither the Owner or the City were required to leave the structures in a habitible condition. Although the City made the request to the Owners, there was no requirement to do so. - It was clearly noted that the Owner had salvage rights within their buildings. He stated the county and township also had concerns. The township concerns have not been addressed and future plans and growth show no ability to service the area. Mr. Priebe explained the proposal of showing the whole picture of the land. It is not to be all developed at one time but over a period of years. He explained contour of the land made loss of some sites. The county should test the sites, and put findings in a agreement. Discussion followed on the range of percolation testing. (d) DISCUSSION OF SKETCH PLAN OF SUBDIVISION SUBMITTED BY JIM JOHNSON Mr. Tom Veenker, All Metro Developers, commented on the proposal. City Engineer Rodeberg explained the area and zoning. There was discussion on the layout and staff • . suggestions of buffer between apartments and single family unit. Mr. Jim Tammeus, realtor representing Mr. Jim Johnson, commented on the apparent needs for housing in the city. It is the consensus of the Planning Commission that they are uncomfortable with the small lots and for the park board to look at the tot lot concept for playground. There was discussion on the access of North /South streets. (e) CONSIDERATION OF LOT SPLIT ON BRADFORD ST REQUESTED BY ARLEN AAS City Administrator Gary Plotz explained the reason for a lot split and the requirements regarding lot splits as opposed to platting. John Rodeberg reported that thus far there have been no accidents reported due to stop sign and route changes in the downtown area. The goal is to provide alterior routes and to make selected intersections safer. The Dam Truth, a history of the dam and the repairs being made has been shown on Channel 10. I accordance with a conversation with James Marka after receiving a letter from him dated October 18, 1991, (copy attached) I am writing, for your consideration to state that we have never had any septic system problems. Because of the problems experienced by our neighbors on Luedtke Lane, we had no choice but to agree to sewer installation on Luedtle Lane ending at our property. As I recall, at one of the hearings I asked if we would have to hoof: up at this time since we do not have a problem and the response was "no ". The goal is to provide alterior routes and to selected intersections safer. The Dam Truth, a history of the dam and the repairs being made has been shown on Channel 10.
