Notice is hereby given that a public hearing will be held on

This department has received a request for investigation into the
application for an on sale intoxicating liquor license as well as
a non - intoxicating liquor license in the name of Hark and Julie
Gaarder of Darwin, Minnesota. The thrust of the investigation into
this license application was directed toward criminal activity,
personal knowledge of the individuals involved and prior work
performance.
The investigation by the Hutchinson Police Department revealed no
criminal activities on either subjects part and no derogatory
information regarding any personal references or information about
personal character. Prior work performance indicates that Mark
Gaarder is the past commander of the engineer unit of the Hinnesota
National Guard stationed in Hutchinson. Additionally, Hark Gaarder
is the owner of the Subway sandwich shop in Litchfield, Minnesota,
and also works at Hutchinson Technology.
This department does have a major concern regarding the
applications which have been presented. On both applications the
name "Pappa Vern's" appears as a possible location. I would like
to point out that Pappa Vern's is located next to the Dry Dock and
as a result of this, this department would be strongly opposed to
the granting of any license which will provide an influx of alcohol
into the complex where the Dry Dock is located. As you are aware,
the bowling alley currently has a non - intoxicating liquor license
as well as a set up license. I believe that any further influx of
alcohol into this location would be greatly detrimental to the
thrust of the youth center program. If this application is
approved, I would recommend that the location of the Dry Dock be
moved to a location where no alcohol is present.

EXPANSION OF AREA INCLUDED IN
DEVELOPMENT DISTRICT NO. 4
NOTICE IS HEREBY GIVEN that the City Council of the City of
Hutchinson will hold a public hearing on the proposal that the City
Council approve the inclusion of additional property in Development
District No. 4 (the Development District) previously designated by
the City Council, pursuant to Minnesota Statutes, Sections 469.124
and 469.134. The public hearing will be held at P.M. on
December 30, 1991, at the Hutchinson City Hall, 37 Washington
Avenue West, Hutchinson, Minnesota.
The additional property proposed to be included in the
Development District is generally described as:
Block 47 and Block 48, N 1/2 of City, including the
entire street right -of -way of First Avenue N.E., Hassan

ASSESSMENT AGREEMENT
BETWEEN LOCAL UNIT AND COUNTY
THIS AGREEMENT is made and entered into by and between the City
of Hutchinson and the County of McLeod State of Minnesota, this
2nd day of January , 19 -92— .
WHEREAS, the City of Hutchinson wishes to abolish the
office of assessor for said . City under the provisions of Minnesota
Statutes, Section 273.072, and enter into an agreement with the County of McLeod
to provide for the assessment of the property in said City by the
county assessor: and
WHEREAS, it is the wish of said county to cooperate with said City
to provide for a fair and equitable assessment of property;
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS HEREIN CONTAINED,
IT IS AGREED AS FOLLOWS:
1. That the City -of Hutchinson which lies within the
County of McLeod and constitutes a separate assessment district,
shall have its property assessed by the county assessor of McLeod County,
beginning with the assessment of the year 19 providing this agreement is
approved by the Commissioner of Revenue of the State of Minnesota.
2. It is further agreed that the office of local assessor of the City
of Hutchinson is hereby abolished, pursuant to this agreement and the
approval of the Commissioner of Revenue, and that such office shall cease to exist
for the duration of this agreement, which shall be until npcgmb r 11 1 9. 92 .
3. In consideration for said assessment services, the r;r of
Hutchinson hereby agrees to pay the County of McT.pnd the annual sum of
$22.200.00 such payment to be made to the county treasurer on or before
December 1. 1992

SUBJECT: RELOCATION - HUNTER'S HAVEN
Hunter's Haven (second business to Mike's Mobil) was located
outside the ShopKo development parcel, specifically across the
street on the corner of Main Street and 1st Avenue.
The city council has expressed an interest in compensating
Mike Commerford, although we are fully aware that legally we have
no obligation.
Assuming for discussion purposes, we would compensate Mike
Commerford for moving Hunter's Haven, what would be the eligible
amounts due for each of the categories that total $13,899.00. If
compensation is made, we want to be "consistent" with payments made
to others (Dr. Rannow, etc.)
We do not want to spend a lot of your time on this review, so
please limit your time to 1 -2 hours on providing a written
response. We do need this no later than Tuesday, December 17,
1991.

elapsed since I moved to the coast. It was also great to
hear all the exciting news about what is going on in Hutchinson;
certainly more pleasant than the economic news in general.
Per our telephone conversation, I am writing to request your
consideration in allowing us to use six (6) parking__ s aceg_ in
the Senior Center parking lot for tenant — tie Evergreen
Apartments. I understand that they are not to be the closest
spots to the front door of the Senior Center and that you
will designate which spots we can use.
I really appreciate your consideration of this request as it
is certainly the quickest, simplest and least expensive way
of resolving the issue that has arisen.
Please let me know if you are able to make this accomodation
at your earliest convenience. It has come up at all of the
tenant meetings and seems to be a pressing problem.

After discussing the parking issue at the Hutchinson Senior
Center, we have come to a consensus that we are unable to
_ grant the request of Mr. Lever :r 6 permanent parking

This descision is based in part, or the fact the parking lot
capacity falls short of the dai =y needs for the Senior
Citizen program participants. t for snow removal
purposes, six cars in the lot on a permanent basis would
greatly hinder the snow removing cmabilities for the Street
and Parks Departments.

WHEREAS, the Building Department of the City Hutchinson has prepared and
submitted the attached 1992 Building Permit Fee Schedule for consideration by the

Building Code Fee Schedule; and

This cost shall include supervision, overhead, equipment, hourly wages and
fringe benefits of the employees involved.
As you probably remember the fee was increased in 1991 from the "82" fee
_ schedule halfway to the "85" fee schedule. This proposed increase would bring
Ask Hutchinson to both the "85" and the "88" fee schedules, as they are typical.
Legislation in 1992 also requires "Contractor Licensing ", which provides a
$5.00 fee on the Building Permit for construction license verification. This
law change is confusing at best, but I suggest we begin enforcement compliance
and struggle through it.
Hutchinson Utilities also blessed the Building Department this year with the
"gas piping" inspections. The code does require inspection on all alterations
including appliance change outs, etc. Obviously, this department is not
staffed to provide near the service Hutchinson Utilities provided with two full
time persons. It is my intentions to provide inspection only on new gas piping
installations for a proposed fee of $100.00 per structure. I would like to
discuss this matter along with the possibility of electrical code enforcement
with the Council after I receive a Revenue History from the State Board of
Electricity for Hutchinson.
City Engineer Rodeberg and I have been discussing the possibility of licensing
"Infrastructure Contractors" for sewer and water hookup and curb replacement.
The council may also want to consider licensing gas pipe installers. This
matter also needs further discussion and consideration.
Park and Recreation Director, Dolf Moon and I also discussed alternatives to
the Public Site and Open Spaces schedule. It was also the Planning Staff's
consensus that the Park Board should make a recommendation to the City Council
prior to action.

Proposed Fee Schedule Changes
Generally speaking, staff recommendation to the Park Board includes the
following changes: '
1. Revise the land percentage dedication to 10% on single family
housing (R-1)
2. Revise the description to the appropriate zoning district - Example
R -2 verses duplex.
3. Include commercial and industrial with multi - Family - R -3 and R -4.
4. Describe "Fair Market Land Value" as either sale price or City
Assessor's value prior to infrastructure.
5. Revise the payment in lieu of land dedication to directly correspond
land dollar value and cash dollar value.
6. Collect fees at the time of platting - with the subdivision
agreement.
7. Provide language so City Council can waive these requirements, when
deemed necessary to do so. Example: Schools, Economic Development,
etc.
The last and final consideration is to reactivate the Building Permit fee on
the downtown grant construction with exception of the signs.
There are alot of changes taking place and of course more regulations to
remember and attempt to enforce. I look forward to discussing these proposed
changes and as always appreciate your direction and support.
Another consideration is to charge plan review on minor permits which require
blue prints or a site plan. This could include items such as garages, decks,
and fences. A permit application with a site plan and/or a blue print could
be charged.

As I discussed with individual members of the city council at
various occasions over the course of the last week or so and with
yourself today (Thursday) I have conveyed to Erickson's the pro-
posal of ShopKo that Lot 2, Block 1, of the Hutchinson Downtown
Redevelopment Plat be conveyed to ShopKo in exchange for a complete
waiver of the cross easement agreement. I also indicated that since
there were approximately two lots, the City would be looking for a
purchase price for the conveyance in the neighborhood of $42,000 to
$45,000.
•
Erickson's, obviously, is not going to be wild about paying for some-
thing they won't receive, although the consideration is effective for
the release of the cross easement agreement.
I have also made it clear that I have no authority to act without
official city council approval.
I would appreciate it if you would distribute copies of this corres-
pondence to all of the council members.
