WHEREAS, Vi Mayer has promoted Hutchison tirelessly and is Hutchison's very
owra master networker, and;
WHEIZEA5, Vi Mayer has an uncanny ability [o cut through bureaucracy and get
things dune, such as the restoration of the hand shell in Library Square, creation of
a fountain in the Crow River, and establishment of an informational marquee on
Main Street, and;
WHEREAS, Vi Mayer has been an active member in a number of civic
organizations for many years, and organized the famous annual Music in the Park
Series, and;
WHEREAS, Vi Mayer has assisted and promoted education on every level,
welcoming thousands of new students, staff & faculty to Hutchinson, serving on
key committees for Ridgewater Community Cngcge, and promoting [he student /
business shadowing progratn,and;

Mayor Marlin Torgerson explained that the Fire Department is requesting that the liquor license not
be Issued until appropriate code updates are made to the building.

- ADOPTING ASSESSMENT AND ACCEPTING BID
John Rodeberg, Director of Public Works, presented before the Council. Mr. Rodeberg explained
the drivers for this project are related to infrastructure management, storm sewer management, and
water and sewer management, The project includes reconstructing the deteriorating sanitary sewer &
related services, reconstructing water services, replacing most of the curb and gutter, constructing a
pond, widening the southem block of the street to allow parktnp, on both sides of the street and
constructing a sidewalk on the east side of the street and both sides vn the southern block. Mr.
Rodeberg continued to explain the process ofthe project. Mr. Rodeberg also explained funding for
the project and how the assessment rates were configured. The total cost of the project is
$626,733.08. Mr. Rodeberg continued to cover the payment options of the assessments.
• Mr. Rodeberg commented that concrete maybe considered as an alternative to bituminous due io
rising costs of fuel.

john Komgiebel, Leona Apartments, presented before the Council. Mr. Korngrebel asked if any
consideration could be given to the tenants ofhis apartment building, whom are elderly and disabled,
as far as deferred assessments are concerned for those meeting the income guidelines. The rent
charged is controlled by the federal government, but he is figunng that rent will increase
approximately $I D.00 per month to his tenants. Mr. Rodeberg explained that this item of concern
could be considered as an appeal and the rest of the assessment roll could be approved, with this item
to be determined.
Motion by Haugen, second by Arndt, to close public hearing. Motion carried unanimously.
Motion by Peterson, second by Stotts, to adopt assessment and accept bid for I,,etting No. 6, Project
No. D4-06 & 04-07, with the exception of John Korngiebel's appeal. Motion carried unanimously.
(c) ASSESSMENT HEARING -LETTING N0. 9, PROJECT N0.04-10 & 04-11 (ARCH STREET

John Rodeberg cxplained that the alley property is directly to the north of the City Center. Mr.
Rodeberg explained the Arch Street Trail will be paved at the cost of the City. Mr. Rodeberg
covered the project costs far both the alley and the trail, The cost for the project is $$4,861.20. The
alley will be constructed with concrete due to the utilities located underneath.
Motion by Arndi, second by Haugen, to close public hearing. Motion carried unanimously.

No. 04-] 0 & 04-11. Motion carried unanimously,
(d) LETTING NO. 11, PROJECT NO. 04-13 (12m AVENUE NW)
- ORDERING IMPROVEMENT AND PREPARATION OF PLANS

john Rodeberg explained that this area is knpwn as Krsiean Acres. This project would includ~
extending sanitary sewer to enable properties for residential development on the north side of ] 2`
Avenue NW. No street work is included. A 10-year deferment of assessments will be put in place
for lots that can be subdivided. The total project cost is $58,000.
Mr. Rodeberg explained chat he received a telephone call from the owner of the middle lot, whose
assessments are estimated at $]3,000-14,000. This property owner has no desire to develop and
would like the assessments deferred for more than 10 years. Mr. Rodeberg explained how interest is
configured into assessments.
$utch Hausladen, property owner, asked if a sanitary sewer could be located on 13`h Avenue. Mr.
Rodeberg explained that the City is responsible for providing service to all surrounding areas and if
the line would be located on 13 Avenue, it would not reach to the Rolling Meadows addition.
Owner of corner lot presented before Council. The owner explained that this lot is not buildable and
asks that assessments need not be paid. The assessments would not go into effect unless this
property is considered buildable.
The owner of the middle lot asked what happens, as far as assessments are concerned, if in 10 yeazs
he hasn't developed the lot. John Rodeberg explained that the 10-year deferment could be extended
if the Council desires. The deferment could pui stipulations that assessments be paid when the
property is sold or developed. The action tonight is to approve the plans and specifications with the
assessment hearing to be held at a later date.
$utch Ilausladen asked that a building permit be issued prior to the sanitary sewer be in place since
• the project has been approved. He would like to complete his construction protect prior to the winter
season. This will be addressed at assessment hearing.

(e) LETTING NO. S, PROJECT N0.04-OS (ROLLING MEADOWS EAST)
This project is to complete street improvements and utilities in Rolling Meadows East and
approximately 200 feet east of Texas Avenue. The total project cost is $843,359.57. Mr. Rodeberg
explained the financing for the project, with assessments m ~ollmg Meadows being deferred for 10
years and assessments to be active immediately on Texas Avenue. An appeal was received from
Sand Properties, owners of Huski Townhomes located on Texas Avenue, who are requesting a
detailed breakdown of the assessment costs.
Motion by Arndt, second by Stotts, to close public hearing. Motion carried unanimously.

7. COMMUNICATIONS, RFOUESTS AND PETITIONS
(a) Brenda Ewing, Human Resources Director, presented before the Council. Ms. Ewing explained that
the Council had previously authorized hiring a City Engineer, however a favorable candidate has not
been able to be found through regular advertising. Due to the supply of inadequate candidates, staff
is requesting to contract with a recruiter to find more favorable candidates. A fee structure will be
established when a recruiter is selected, however verbal information from two recruiting groups
estimated that the rate will range from $16,000-19,000.
Gary Plotz informed the Council that back when john Rodeberg, current City Engineer, was
hired the same situation arose. Much advertising was done via regular avenues and staff ended
up contracting with a recruiter to fill the position. The funds for the recruiter will be used from
the salary that was budgeted for the postnon.
Motion by Arndt, second by Haugen, to authorize staff to hire recruiter to begin search to fill
City )~ngineer position. Motion carried unanimously.
(b) PRESENTATION BY MARC VAILLANCOURT, CHAIR, HUTCHINSON 150T"
ANNIVERSARY CELEBRATION
Marc Vaillancourt presented what has been planned for the 150`h anniversary celebration. Mr.
Vaillacourt shared the logo for the celebration. Mr. Vaillancourt also introduced the steering
committee for the celebration. Events include a kickoff dinner on January 29, 2005, acity-wide
block party July 22-24, 2005, wish proposed activities outlined, Gala Reception Dinner November
19, 2005. Mr. Vaillancourt outlined funding opportunities to businesses and citizens. A web site is
being developed that will go live September 1, 2004. Mr. Vaillancourt intends to return the end of
September for another presentation to the Council.

Keith Kamrath, Chair of Hutchinson School Board, presented before the Council. Mr. Kamrath
requested that the City Council set a public hearing to discuss vacating the property that Park
Elementary currently sits on. Mr. Kamrath clarified that this action is not to vacate the school

Dan Cole, Briggs and Morgan, presented before the Council. Mr. Cole explained that the request of
the School District is to vacate the property, which is ggi~ving up legal rights to the property. The
school is requesting that the City recognize the fact thatPark Elementary school is sitting on public
property that was dedicated hundreds of years ago as a park. The District is re uesting that the
property to be vacated is where the school sits and not the other parkland surrounding it.
The school district's recommendation is that virtually the entire city receive notice of the public
hearing since it is a park.
Motion by Stotts, second by Peterson, to set public hearing to discuss vacation of Park Elementary

Julie Wischnack, Director of Plannine/Zoning/Building, presented before the Council. Ms.
Wischnack explained that the request off the applicant is to allow for an accessory use for storage
without a primary structure (home) on the lot. The planning staff approved ibis item, however the
Planning Commission unanimously recommends denial of this conditional use permit. Since the
Commission's vote, a petition has been received with 34 signatures of area neighbors opposing the
conditional use permit.
Casey Stotts expressed that he understands surrounding property owner's fiustration, however he
wants to make sure things are done legally. He also has concerns about the property owner not being
able to construct what she wants on the property. According to the Zoning Ordinance, an accessory
building can be built on a lot, however the intention and understanding must be that a principal
building must be constructed within a certain time frame.
Motion by Amdt, second by Peterson, to approve Planning Commission's recommendation to deny
the conditional use permit application. Motion carried unanimously.
Randy Redman, At Home Realty, stated that Mr. $etker had planned on withdrawing his application
far a conditional use permit.

April 5, 2004
Members Present: Mike Scltiesl, Jay Beytien, Bill Amdt, Kirk Kosel, Bernie Miner and Mary
inglis. Also present were Dolf Moon, john McRaith, September Jacobsen and Karen McKay.
The meeting was called to order at 5:15 pm '
A motion made by Bill Arndt and seconded by Mary Inglis approved the minutes dated February
2, 2004. The motion passed unanimously.
ANNUAL REPQRT
john McRaith, Recreation Services Coordinator presented a review of 2003 goals and program
statistics to board members.
-The middle school age soccer program began with parent volunteers organizing the games and
practices. John attends meetings and offers programming suggestions.
-The Recreation Center courts have been sponsored Cor the next five years at $500 per court per
year. Bemick's Pepsi is sponsoring the Recreation Center building for $50,000, which provides
funding for a divider curtain and flooring in the facility. The curtain is royal blue; the floor will
be blue and charcoal. The lighting will also be upgraded this year. Kirk told the board that when
playing volleyball, the ball is lost in the overhead lights. That issue will be addressed with bi-
level lighting that provides a glare guard. The new lights will be an energy saving repair.
Repairs/replacements are becoming necessary; the Recreation Center is 1 S years old.
-John attends the Hutchinson Junior League Baseball meetings. The registration is taken through
the PRCE pffice. John will be writing the schedules and assigning the umpires.
-A sporting goods garage sale is a goal that Jahn believes would be great opportunity for people
to buy and sell used sporting goods. This goal is in the idea stage.
-The Parks, Recreation & Community Education web page provides information, schedules and
a web store, which provides intemet users an opportunity to register for some of the PRCE
programs, mainly those without class limits.
-The participant numbers in adult programs reached a high in 1997 and have leveled off in 2002
and '03. The youth participant numbers have remained stable.
Goals for 2004 include:
-Oversee the development of the middle school age United Soccer Association program.
-Develop the an-line web store.
-Renew youth sponsorships for another three-year term in the amount of $1 ],000.
-Become more efTicient with the registration process, all of the PRCE employees have the
capability to take phone in registrations at their computers.
-Develop divisions for girls in sports, past numbers suggest that participation increased with
separate divisions for boys and girls.

-There will be 30 tournaments in the City's facilities including a 14 and under state baseball
tournament. Hutchinson will host the State Amateur $aseball tournament in 2005. Associations
supply staff for tournaments as a fundraiser for their organizations.
lay Beytien asked about a message board outside the Civic Arena. Dolf told the board that
funding is not available, but a sponsor would be welcome.
September Jacobsen, Receptionist at the Event Center presented a slide show of some of the
major activities that took place at the Event Center including the Twins Caravan, a job fair, 3M
Craft Fair, Ambassadors Food Fair and a Comedy Show. Other groups have booked marketing
and financial group meetings. Rentals coming up are wedding receptions and dances and an art
show. There are many daily activities for the senior citizens at the Event Center including
fellowship dinners, arts and crafts, cards and games, book club, "Red Hat Society", defensive
driving, and various clinics. Altogether there were 421 activities at the Event Center in 2003.
NEW BUSINESS
Msss Registration is scheduled for Tuesday, May 4'h 6:00-8:00 pm. $oard members are
encouraged to volunteer to help cashier and distribute registration forms.
BOARD MEMBER ITEMS
$il] asked about the 15Q`h Anniversary celebration. bolf told the board that the PRCE would be
heavily involved in activities. There will be a kick off event at the Event Center and afour-day
block party.

Rc~ Monthly Update on Actfvlties of Ute Fire Department
The fire department responded to 37 general alarms in the month of June.
Example of a few of the calls:
1. We responded to a rare sprinkler head malfunction at 3M causing some minor water damage.
2. We responded to a minor chlorine leak at the wastewater treatment plant.
3. Afire offwer investigated why the northwest part of the city was covered with smoke. It was
. discovered that a farmer was burning old wet hay.
4. We responded to two gas line strikes 6y contractors.
5. We responded to a down aircraft. A crop dusting plane lost power and ended upside down In a
slough. The pilgt and two firefighters were sent to the hospital for chemicel exposure.
6. We were called to the Hutchinson High School were the parts washer in the auto repair shop was
left on with no oil. The shop was filed with smoke.
7. We responded to a residential house fire on Madson Avenue were an overloaded electrical service
box started a fire in the basement. The fire caused approximately $75,000 damage to the house
and contents.
8. We responded to a construction trailer that flipped over in the ditch trapping the two workers inside.
The trailer flipped frgm high winds and soft ground during a passing storm.

• We moved to the Fair Grounds while the station was being remodeled. We had 51 hours of labor
involved with removal of the lockers, patching holes in the concrete, and moving. We will be
moving back July 5.
• We conducted level 1 and level 2 live bums at a vacant house soutlr of Hutchinson qn Hwy 15.
• We trained with the Plato Fire Department at the training site.
• We have introduced a new pumping procedure; we will be working on the instruction of this new
method aver the next four months.
• We held new recruit testing, we had ten people show up. We anticipate hiring flue.

Pursuant to Minnesota Statute 414.033 (2), the propery owner has petitioned to annex approximately 23.85 acres located in
Section 7, Hassan Valley Township.
HISTORY
The property owner has petitioned the City of Hutchinson tv annex pxvpcrty presently surrounded by city limits. The property is
located south of Applebee's and north of Mcnatd's and is 23.85 acres. Fan Development is developing the property- The
proposal is tv develop the Highway frontage into commercial lute and the back portion of the property into a senior housing
development. (When the Menard's property was annexed, the City and Township resolution indicated this property would only
be annexed when the prvptrty owner petitioned.)
FINDINGS OF FACT
1. The required petition was submitted.
2. Notices were mailed by certified mail to the surrounding property owners as well as published in the
Hutchinson Leader on Thwsday, 7rme 3, 2004.
3. The proposal is in conforrnanec with the requirements far annexation.
4. There was no one present objecting to the request.
RECOMMENDATION
Since this property was anticipated to be annexed and there are wban services available to the parcel, the
Planning Commission voted unanimously to reconnmend apprmal of the annexation request.

Notice is hereby given that the City Council will meet at 6:00 P.M. on the 10th day of August,
2004, in the Council Chambers at City Hall at Hutchinson, Minnesota, to consider and possibly

Adoption by the Council of the proposed assessment against abutting properly may occur at
the hearing.

proposed individual assessment at an adjourned meeting upon such further notice to the affected
property owners as it deems advisable.
If an assessment is contested or there is an adjourned hearing, the following procedure will
be followed:
The City will present its case first by calling witnesses who may testify
by narratives or by examination, and by the introduction of exhibits.
After each witness has testified, the contesting parry will be allowed to ask
questions. This procedure will be repeated with each witness until neither
side has further questions.
2. After the City has presented all its evidence, the objector may call witnesses
or present such testimony as the objector desires. The same procedure for
• questioning of the City's witnesses will be followed with the objector's
witnesses.

4. Minnesota rules of evidence will not be strictly applied; however, they maybe
considered and argued to the Council as
to the weight of items of evidence or testimony presented to the Council.
5. The entire proceedings will be tape-recorded.
6. At the close of presentation of evidence, the objector may make a final
presentation to the Council based on the evidence and the law. No now
evidence may be presented at this paint.
An owner may appeal an assessment to District Court pursuant to Minnesota Statutes
Section 429.081 by serving notice of the appeal upon the Mayor or City Administrator within 30 days
after the adoption of the assessment and filing such notice with the District Court within ten days
after service upon the Mayor or City Administrator.
Under Minnesota Statutes, Section 435.193 to 435.195, the Council may, in its discretion,
defer the payment of this special assessment for any homestead property owned by a person 65
years of age or older for whom it would be a hardship to make the payments. When deferment of
. the special assessment has been granted and is terminated far any reason provided in that law, all
amounts accumulated, plus applicable interest, become due. Any assessed property owner meeting
the requirements of the law and the resolution adopted under it, may within 3D days of the
confirmation of the assessment, apply to the City Clertc, for the prescribed farm for such deferral of
payment of this special assessment on his property.

As we've noted before, we have begun to readvertise and hire a recruiter to fill the City Engineer
position. We have now been without that position (formerly Assistant City Engineer) for almost 7
months, expect to be without this position for an additional 2 or more months, and are getting further
and further behind in our (specifically my) work. l am also scheduled for 3 weeks of vacation over
the next month and a half.
Attached is a proposal from Short-Elliott Ilendrickson to provide engineering support services for
this period on an hourly basis. We have requested up to 20 hours/week for weeks when I am here,
and up to 40 hours per week for periods when I am not. This work is at our request, based on our
needs, and will terminate once the new position is filled. The hourly cost noted is significantly
reduced from their standard rate.
W e have funding in the Professional Services budget, and within our project bonding budget to cover
these costs. The engineer noted is proposed to be our new Project Engineer for work in Hutchinson,
so it is also expected that a portion of the work can be completed within those already established
contracts.
We strongly recommend approval of this engineering support contract.

I am providing the following information regarding assisting the City with various engineering tasks
over the summer months. We are proposing that Kent Exner provide these services to you. As you
know we have identified him as the engineer to work directly with the City after Dick Potz's
retirement. This will give you the opportunity to get to know him and his abilities and it will give
him the opportunity to get to know the City and its infrastructure as well as your staff:
We propose that Kent start working with the City on or about July 6`h and continue through the end
of August. He would work approximately twenty (20) hours per week throughout that period,
• although, it is our understanding we will remain flexible on the number of hours he will work each
week. During the weeks of July 26, August 2 and August 16 it is expected he would work
approximately 40 hours with the City. We propose that Kent would work ]0 hour days at the City
rather then the standard 8 to minimize travel costs.
We propose billing Kent at a rate of $95 per hour for this service. Kent lives in Chanhassan. We
propose billing for total actual mileage both ways between his home and Hutchinson and billing for
his time one way between his home and Hutchinson.

Prepared preliminary design and corresponding cost estimate for feasibility
study implementation. The project improvements included complete street

• subgrade drain tile, sedimentation ponds and boulevard grading. The project
extends through existing residential neighborhoods on approximately five
miles of streets. Responsibilities included setting alignments to minimize
boulevard disturbance, grading for positive drainage, drainage calculations,

The Board of Directors of the Hutchinson Area Health Care (HAHC), as part of their regular
meeting on June 15, 2004, considered a capital improvement request from staff which requires
you approval. The following is a draft excerpt from the minutes of the meeting.
"Business Office Construction Plaza 15. Graves explained a need to develop space in
the Plaza 15 Mall (north of Mental Health Clinic) in order to relocate the HAHC
Business Office and allow expansion space for an existing tenant. The current Business
Office space, in the Plaza (approximately three thousand sq fi), would be provided to
Allina Health System for their durable medical equipment product line. I[ is anticipated
the cost of the Business Office relocation project would 6e approximately $200,000 for
six thousand square feet. Because of our ability to rent the current business ofTice space
to Allina, we anticipate aseven-year pay back on the relocation cost.
Following discussion, Knutson made a motion, seconded by McGinnis, to
request authority from the City Council to proceed with the Business Office
relocation, Plaza 15, at a cost not to exceed $200,000. All were in favor. Motion

Purpose: The bonds will finance the remaining 2003 capital improvements and the City's
2004 capital improvement projects.
Term/Call Feature: 12 year bonds, callable in 2011 for maturities 2012 and after (7 years).
Funding Sources: Special assessments, property tax levy, and cash from the sewer ($471,161) and
water utility funds ($105,387). $2,330,332 (or 57%) of the bonds will be repaid
with special assessments levied against the benefiting properties. The special
assessments will be for a term of ten years at an interest rate 1% higher than the
interest rate on the bonds.

Purpose: The bonds will refinance the $723,543 G.O. Tax Increment Bonds (Capital
Appreciation Bonds with annual payments), Series 1990.
7'ermlCall Feature: 12 year bonds, callable in 2011 for maturities 2012 and after (7 years).
Funding Sources: Tax increment revenues from Tax ]nerement District No. 5 (Shopko).
Refunding Savings: In 1990 the City issued tax increment bands to Finance public improvements
related to the development of Shapko. 13y refunding these bonds, the City can
achieve interest savings. The net present value of the interest savings over the
next 12 years is expected to be $67,440, or approximately $9,300 per year.
Refunding the bonds is part of the strategy to cure projected deficits in the City's
tax increment districts caused by tax rate compression.

WHEREAS, by a resolution passed by the Council on thel3th day of July, 2D04, the Director of
Engineering was directed to prepare a proposed assessment of the cost improvement of 12th
Avenue NW by construction of sanitary sewer and services, restoration and appurtenances, and
WHEREAS, the Director of Engineering has notified the Council that such proposed.assessment
has been completed and filed in his office for public inspection.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HUTCHINSON, MINNESOTA:
1. A hearing shall be held on the 10th day of August 2004, in the Council Chambers at
Hutchinson City Center at 6~D0 P.M. to pass upon such proposed assessment and at such time and
place all persons owning property affected by such improvement will be given an opportunity to be
heard with reference to such assessment.
2. The City Administrator is hereby directed to cause a notice of the hearing on the proposed
assessment to be published once in the official newspaper at least two weeks prior to the hearing,
and he shall state in the notice the total cost of the improvement. He shall also cause mailed notice
to be given to the owner of each parcel described in the assessment roll not less than two weeks
prior to the hearing.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the County Auditor, pay the whole of the assessment on such property, with interest
accrued to the date of payment, to the City Administrator, except that ne interest shall be charged if
the entire assessment is paid by November 15th, 2D04. He may at any time thereafter, pay tc the
City Administrator, the entire amount of the assessment remaining unpaid, with interest accrued to
December 31 of the year in which such payment is made. Such payment must be made before
November 15 or interest will be charged through December 31 of the succeeding year.

Notice is hereby given that the City Council will meet at 6:00 P.M. on the 10th day of August,
2004, in the Council Chambers at City Hall at Hutchinson, Minnesota, to consider and possibly
adopt, the proposed assessment for the improvement of 12th Avenue NW by construction of
sanitary sewer and services, restoration and appurtenances.
Adoption by the Council of the proposed assessment against abutting property may occurat
the hearing.
You may at anytime prior to certification of the assessment to the County Auditor, pay the
entire assessment on such property, with interest accrued to the date of payment, to the City
Administrator. No interest shall be charged if the entire assessment is paid by November 15th,
2004. You may, at anytime thereafter, pay to the City Administrator the entire amount of the
assessment remaining unpaid, with interest accrued to December 31st of the year in which such
payment is made. Such payment must be made before November 15th or interest will be charged
through December 31st of the succeeding year. If you decide not to prepay the assessment before
the date given above, the rate of interest that will apply is 10 percent (plus or minus) per year. The
right to partially prepay the assessment shall be until November 15, 2004.
• The proposed assessment is on file for public inspection at the City Administrator's Office.
The total amount of the proposed assessment is $ W ritten or oral objections will be
considered at the meeting.
No appeal may be taken as to the amount of an assessment unless a signed, written
objection is filed with the City Administrator prior to the hearing or presented to the presiding officer
at the hearing. The Council may, upon such notice, consider any objection to the amount of a
proposed individual assessment at an adjourned meeting upon such further notice to the affected
property owners as it deems advisable.
If an assessment is contested or there is an adjourned hearing, the following procedure will
be followed:
The City will present its case first by calling witnesses who may testify
by narratives or by examination, and by the introduction of exhibi#s.
After each witness has testified, the contesting party will be allowed to ask
questions. This procedure will be repeated with each witness until neither
side has further questions.
2. After the Gity has presented all its evidence, the objector may call witnesses
or present such testimony as the objector desires. The same procedure for
questioning of the City's witnesses will be followed with the objector's
witnesses.

4. Minnesota rules of evidence will not be strictly applied; however, they maybe
considered and argued to the Council as
to the weight of items of evidence or testimony presented to the Ccuncil.
5. The entire proceedings will be tape-recorded.
6. At the close of presentation of evidence, the objector may make a final
presentation to the Gouncil based on the evidence and the law. No new
evidence may be presented at this point.
An owner may appeal an assessment to District Court pursuant to Minnesota Statutes
Section 429.081 by serving notice of the appeal upon the Mayor or CityAdministratorwithin 30days
after the adoption of the assessment and filing such notice with the District Court within ten days
after service upon the Mayor or City Administrator.
Under Minnesota Statutes, Section 435.193 to 435.195, the Gouncil may, in its discretion,
defer the payment of this special assessment for any homestead property owned by a person 65
years of age or older for wham it would be a hardship to make the payments. When deferment of
the special assessment has been granted and is terminated for any reason provided in that law, all
amounts accumulated, plus applicable interest, became due. Any assessed property owner meeting
the requirements of the law and the resolution adopted under it, may within 30 days of the
confirmation of the assessment, apply to the City Clerk, for the prescribed form for such deferral of
payment of this special assessment on his property.

I am writing this letter in regards to the 12th Ave. Sewer and Water Project. I have owned a lot in the
middle of 12th Ave. and 13th Ave. since 1974. When the City of I Iutchinson incvrpnrated our land htto the city
limits we where incorporated as one city lot and at this time all of our services were accessed &nm 13th Ave. Since
we have never had arty intentions of sub dividing our lot, in 1980 we planted over 50 trees and have enjoyed our
large lot as a whole, I am nut against this project, however I have two hig concerns we will never get any use out of
this project if we do not sub divide our lot, also what effect it may have on our property. Al this time I have no
intention of subdividing our lot, I also feel that I should not have to pay 1'or two of the same services coming into
one single lot that will only be utilizing one line of service. I also have wondered if it is legal to charge twice for
running sewer and wafer into one lot, being i have already paid for installing these services once.
1 do not want to stop this project but would propose that my share be deferred until this lot is developed.
I also feel that interest should not be incurred on this deferment as this would be a hardship to myself and whom ever
develops [his lot in the future. Having many years of excess interest accrued on this lot would eventually make this
lot nu longer of value.
In closing if the project is approved I would like to defer my payment without interest until it is split into a
legal city lot, while not having any time limits as W when my ane lot would need to be sub divided.

Creekside Soils by construction of grading, bituminous base and appurtenances.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON,
MINNESOTA:
1. Such plans and specifications, acopy of which is attached hereto and made a part hereof, are
hereby approved.
2. The Director of Engineering shall prepare and cause to be inserted in the official newspaper, an
advertisement for bids upon the making of such improvements under such approved plans and spec cations.
The advertisement shall be published for three weeks, shall specify the work to be done, shall state that bids

the main track near Hutchinson Iron & Scrap Metal (5~'' Avenue SE near Arch
Street), and continues north and west io approximately llutchinsnn
Manufacturing. This does not include properties an which there is only atr
casement (Hutchinson Iron and Metal/Cenex, Daggett, etc.)- The City has
identified 1 R.18 acres in 17 separate parcels, plus 2.24 acres of property
proposed to he transferred to Gopher Campfire. The City ofHutchinson is not
allowed to donate land io Gopher Campfire (the Authority may have the same
limitations), and would agree to either have McLeod Kail Authority transfer
the property to Gopher Campfire.
Al] other property rcntaining in McLeod County and the City of llutclrinson
will remain under control of the Authority- The three Rai] Authorities noted
above shall regulate crossings and land dealings on the remaitring property. All
three Authorities have voting/vclo rights for land use and transfer. The Rail
Authorities shall collect ]case payments within McLeod County to cover
administrative/operational and capital costs. _
$600,000. Yaytnent will be made to the McLeod County Aail Authority based
nn a 20-year nn-interest loan, or $30,000 per year (Comes out to $33,000 per
acre w/o Gopher Campfire considered, nr $29,400 w/Gopher Campfire
considered). 17tis payment shall also cover permits fur those specific items
noted below. It is understood that this is only an average price per acre. Some
oi' the ]and has less value to the city, and may not be able to he sold. Other
property that maybe sold by the City may be at a substantially higher price per
acre. This rate would need to be agreed upon by the City and the purchaser.
It is understood that the financial value of the properties noted may or may not
equal $GOO,OOD. An infotanal appraisal completed for the Authority noted the
vahte as high as $1.3M. The City and the McLeod County Rail Authority
("Authority") understand that there is a value to the community in preserving
the rail corridor from the Twin City metro area to the City ofHutchinson, and a
cost to the City for short and long-ternt maintenance/liability.

The City of Hutchinson would like the fees for the three following
improvements/hems to be included in the payment noted above. Points of
discussion are:
I) The City would like to construct a new road (as early as 2005) with a new
crossing, through the east side of the Cenex Elevator property on 5`t Avenue
5E near the current spur location. The crossing fee would be included in the
annual payment amount. The City understands there maybe a future obligation
to construct safe /crossin im rovements.
2) The City of Hutchinson would like to construct a roundabout at the
intersection of Washington Avenue East and Adams Street. This would require
land that is currently owned by the Authority. It is understood that sale of the
property to the City is unlikely and/or unfeasible, however along-term lease
could be a suitable alternative. The fee for this is proposed for consideration in
the annual payment. The City understands that use of this property may be
affected b future trans ortation uses of the rail corridor.
3) The City would like consideration for cooperative development (with
McLeod County Parks and the DNR) of a trail along the main track from the
area of the depot through the industrial park, including upgrading the existing
trestle near 3M. The City understands that any consideration of this project may
include additional maintenance responsibilities. Both parties agree that further
stud and a eements are necess
RailAmerica's agreement with the Authority requires removal of the ties and
rail by RailAmerica, however it is considered possible that RailAmerica will
not complete this work. The City may become responsible for removing and
dis osin of old ties, rail and oilier materials in the ri t-of-wa .
It is understood that the building located west ofAdams Street that was utilized
by ltai]America to rehab cars will not become the property of the City of
Hutchinson. Jay Freedland has had discussions with the McLeod Rail Authority
regarding the building, which would be proposed to be removed and relocated
for Mr. Preedland's use. The City of Hutchinson does not object to this issue,
but would like consideration of Mr. Freedland also removing the track in the
area of the buildin as art of the arran ement.
The property purchased by the City of Hutchinson shall have no
limitations placed on it by the Authority that would limit the City's ability
to transfer, sell, collect lease payments or utilize the property for other
uses. Any sale of land and/or collection of ]ease payments in excess of the
annual payment shall be considered part of the mortgage obligation of the City
of Hutchinson to the Rail Authority. These additional amounts shall be added
to the annual payment as an "advance payment", and the amount shall be
reduced from the total financial obli ation of the Ci

What are the expectations/liabilities/responsibilities for maintaining the right-of--way in
McLeod County?
The Rail Authority has the responsibility over the main rail line, the City for the purchased portion.
Is the City expected to continue to maintain the portion in the City limits?
Only the portion that it purchases. The McLeod Rail Authority may ask the City for help in certain
areas ofthe city on the main line, especially ifthe City is allowed to complete improvements (trails,
etc.) within the right-o£--way.
Who has environmental liability over the remaining track?
McLeod Rail Authorit and/or Henne in Count
Does the City of Hutchinson have additional rights or authority regarding the sale of the
remaining right-of--way property?
No. The specific authority for preserving theright-of--way corridor is with the Hennepin, Carver and
McLeod County Rai] Authorities. The Rail Authorities will retain al] remaining property, and
collect all lease payments and funds received from sale of "excess" property.
Do we have more authority/rights than other communities ar governmental organizations due
to our financial commitment?
No. The purpose of the purchase by the Rail Authoritics was tv preserve the corridor for future
ublic use.
Does ar should the City of Hutchinson have direct invalvement/autbority/membership in the
Rail Authority to protect our investment?
The Authority does not believe that it is prudent or advisable to officially have a City ofHutchinson
representative on the Board, however, City representatives are free to attend all public meetings and
Board membcrshi of individuals with relativnshi s to rail and cit interests will be considered.

Pursuant to your earlier telephone conversation with Sergeant Tom Gifferson, I would
support the proposed sale of our used out-of-service, 2002 Ford Crown Victoria police car
to the Glencoe Police Department. It is my understanding that Glencoe is in need of this
vehicle because of emergency circumstances. I believe that $2,500.00 would be a fair
price, and as earlier discussed, the money obtained from this sale would be forwarded to
our department and applied to the purchase of new radar units. Thank you for your
cooperation in this matter.
