Motion by Haugen, second by Arndt, to approve consent agenda with the exception of Items 5(h) and 5(k). Motion carried unanimously. Item 5(h) was discussed further. Mayor Cook asked Police Chief Dan Hatten if he had spoken with the applicant and reviewed the golf cart. Chief Hatten stated that he had met with the applicant and reviewed the ordinance with them. The only improvement he requested of the applicant was that the slow moving sign be enlarged. Motion by Peterson, second by Arndt, to approve golf cart permit. Council Member Arndt asked if the • approval of golf carts be delegated to the police department and not require Council approval. Attorney Marc Sebora stated that he could present a resolution or ordinance at the next Council meeting noting this delegation. Motion carried unanimously. Item 5(k) was discussed further. John Rodeberg, Director of Engineering, stated that this construction project has been in the Capital Improvement Plan for the past five years. The administration building does not have enough storage and is incompatible for current staff numbers. Part ofthis proposal includes adding vehicle storage at the HATS facility. This is basically a space needs analysis request. A schematic will be presented as a result of the analysis. Discussion was held regarding funding the entire construction project. Motion by Peterson, second by Stotts, to approve agreement with Wold Architect for pre-design at Wastewater Administration Building. Motion carried unanimously. 6. PUBLIC HEARINGS - 6:00 P.M. (a) CONSIDERATION FOR APPROVAL OF GRANTING FRANCHISE TO SALON 22 FOR PERMITTING FLOWER PLANTERS IN PUBLIC RIGHT-OF-WAY (WAIVE FIRST READING AND SET SECOND READING AND ADOPTION OF ORDINANCE NO. OS-0410 FOR JULY 12, 2005) Julie Wischnack, Director of Planning/ZoningBuilding, presented before the Council. Ms. Wischnack explained that Franchise applications are accepted by her department and require approval by the City Council, being adopted by ordinance. Motion by Arndt, second by Haugen, to close public hearing. Motion carried unanimously. Motion by Peterson, second by Stotts, to set second reading and adoption of ordinance No. OS-0410 for July 12, 2005, granting the franchise for $10.00/year, for a total of six years. Motion carried unanimously. •7. COMMUNICATIONS, REQUESTS AND PETITIONS yc~~ CITY COUNCIL MINUTES -JUNE 28, 2005 UNFINISHED Bi 9. NEW BUSINESS (a) LETTING NO. 10, PROJECT NO. OS-12 (PLAZA 15 PARKING LOT) -DECLARING COST TO BE ASSESSED, ORDERING PREPARATION OF PROPOSED ASSESSMENT, WAIVING HEARING, ADOPTING ASSESSMENT AND ACCEPTING BID John Rodeberg, Director of Public Works, stated that this project is 100% funded by the City and the hospital. One-third paid by Event Center and 2/3 by the hospital. City Engineer Kent Exner stated that very favorable bids came in on this project, approximately $100,000 under the engineer's estimate. Mr. Exner stated that an alternate was worked into the project of having all of the sidewalk work being included, and hospital management has approved proceeding with this. Council Member Haugen noted the weddings and other events scheduled at the Event Center. Kent Exner stated that the project will be staged and the contractor is fully aware of these events. Motion by Arndt, second by Haugen, to order preparation of proposed assessment, waive hearing, adopt assessment and accept bid on Letting No. 10, Project No. OS-12. Motion carried unanimously. (b) CONSIDERATION OF CONDITIONAL USE PERMIT REQUESTED BY THE CITY OF HUTCHINSON TO ALLOW CONSTRUCTION OF A BUILDING WITHIN THE FLOOD PLAIN LOCATED AT 1400 ADAMS STREET WITH STAFF RECOMMENDATION AND FAVORABLE RECOMMENDATION (ADOPT RESOLUTION NO. 12748) • Julie Wischnack, Director of Planning/ZoningBuilding, presented before the Council. Ms. Wischnack explained that the Planning Commission voted on this with a split vote of 6-1. The discussion at the Planning Commission level included the management of this area for residential/industrial/commercial users. Mayor Cook noted that it might be a good idea to have,a policy in place before granting such a use. John Rodeberg noted that this is in an I2 zone and, under the same circumstances, would more than likely be granted to a private entity. Because this property is m the flood plain, high investment is not promoted. This building is being considered for storage only. Discussion was held regarding the application process for private and public entities, which is virtually the same. John Olson, Public Works Superintendent, presented before the Council. Mr. Olson explained the need and reason for the style of this building. The City currently has heavy equipment and construction equipment that needs storage. This type of storage is the most cost-efficient. City Attorney Sebora suggested tabling this item due to the sentiments voiced, having Gary Plotz sign an extension authorization, have a policy developed to address this issue, and then take action at a later date. Motion by Peterson, second by Arndt, to table this item until a policy is developed to address construction in flood plains. Motion carried unanimously. (c) CONSIDERATION FOR APPROVAL OF COMMUNICATIONS UPGRADE TO HUTCHINSON POLICE SERVICES Police Chief Dan Hatten stated that this request is to approve the communications radio system upgrade to the police department. The current system is operated by Motorola and has been outdated. The current system will not be supported by Motorola at the end of the year unless the system is upgraded. The funding for this includes $60,000 from the CIP budget and $13,000 from unreserved dollars in the CIP budget. The entire upgrade includes the radio system, furniture and security system. It was noted that this new system will be completely compatible with the McLeod County Sheriff's Office. ~~a) CITY CO UNCIL MINUTES -JUNE 28, 2005 Motion by Stotts, second by Arndt, to approve communications upgrade to Hutchinson Police Services. • Motion carried unanimously. (d) CONSIDERATION FOR APPROVAL OF WATER TREATMENT PLANT ENGINEERING SERVICES AGREEMENT FOR CONSTRUCTION RELATED SERVICES WITH EARTHTECH John Rodeberg, Director of Public Works, stated that contract is afollow-up to the design and specifications services contract. This agreement covers the construction related services on the RO membrane system, biological filter system, water supply well and ground storage reservoir. It was noted that some of this work has already been started. Motion by Arndt, second by Peterson, to approve water treatment plant engineering services agreement with EarthTech for construction-related services. Motion carried unanimously. (e) CONSIDERATION FOR APPROVAL OF SETTING QUARTERLY UPDATE MEETINGS BETWEEN CITY COUNCIL MEMBERS AND CITY DIRECTORS Mayor Cook noted that it has been suggested to hold quarterly meetings with city directors for them to provide updates to the Council on projects. It was suggested to hold these updates on a regular basis. It was noted that all of the directors are not required to attend the Council workshops if they do not relate to a director's particular area of business. Motion by Peterson, second by Haugen, to approve setting quarterly meeting updates on the third Wednesday of the month from 9:00 a.m. - 12:00 noon in the following months: July, October, January, April. The first meeting will be July 20, 2005 (it was noted the Wage Committee meeting will need to be rescheduled). Motion carried unanimously. 10. MISCELLANEOUS • (a) COMMUNICATIONS 1. Consideration of Setting Public Hearing for Establishment of TIF District to Redevelop for Cornerstone Commons Miles Seppelt, EDA Director, noted that the bank financing has been put into place for this project, however is contingent upon a Redevelopment TIF District being established. The funds in this project aze used to finance the project itself The first action is to set the public hearing and direct staff to develop the TIF District Plan. Motion by Arndt, second by Haugen, to set public hearing for August 23, 2005, to discuss creation of Redevelopment TIF District and direct staffto develop TIF District plan. Motion carried unanimously. Mr. Seppelt also noted that the liquor store construction project is under way. The expansion and loading docks will be completed first and then the present liquor store will move into the new area with remodeling taking place in the current location. 2. Consideration of Solicitor's License for Commercial Concepts Publishing. Motion by Haugen, second by Peterson, to approve solicitor's license for Commercial Concepts Publishing to sell ads in Relocation Guide. Motion carried unanimously. Jim Haugen -Congratulated the Jaycees on the fabulous Water Carnival event. Council Member Haugen asked for an update on the garage issue that was brought up by the property owner on Jefferson Street at the last City Council meeting. Julie Wischnack noted that she and the City . Attorney had met with the applicant on his options for the construction of the garage. These options. include: 1)not allowing the garage to be located m the easement as it could be located m a different area, ~~~) CITY CO UNCIL MINUTES -JUNE 28, 2005 2)allow for a partial vacation of the easement (garage would be located four feet from the storm sewer • line), 3)remove a tree that is located near the home and move the gaaage west six feet or 4)have the garage load from the north and have stacked pazking with the garage. Mayor Cook also noted that he had asked Ms. Wischnack about the language as it relates to building permit applications. It was noted that there is a disclaimer on the applicatron that notes it is the property owner's responsibility to provide information related to the property. Ms. Wischnack shared various ways a property owner could find out information (i.e. setbacks, easements, etc.) as it relates to their property. Mayor Cook noted that he feels it is the responsibility of the property owner to identify encroachments and things. John Rodeberg expressed he does not feel it is feasible to be able to work with only four feet within the pipe. Much discussion was held regarding the options provided to the applicant. Motion by Arndt, second by Peterson, to direct 7ulie Wischnack and John Rodeberg to work with the applicant on the options. Council Member Arndt noted that the easement shall not be vacated. Motion carried unanimously. Bill Arndt -Council Member Amdt thanked city staff for marking South Grade Road appropriately. Council Member Amdt asked if the agenda could be printed in the newspaper or if the cable network could publish the agenda as opposed to the Mayor reading it live. Kudos on the Water Carnival. Kay Peterson -Council Member Peterson noted the all school reunion on July 2 & 3 at the Fairgrounds Casey Stotts -Council Member Stotts noted that he has been asked by residents about aerial mosquito spraying. John Rodeberg noted that that has been researched and is regulated completely different than ground spraying. That is something that can be reseazched further. Spraying will be considered seriously in the 2006 budget. • Gary Plotz - Mr. Plotz noted that the City is currently negotiating for the garbage hauling contract. A committee has met with two parties that are interested in providing this service, West Central Sanitation and Waste Management. Mr. Plotz explained the current negotiations with Waste Management. West Central Sanitation was unable to provide a concrete answer on where the refuse would be taken (Waste Management owns the local landfill and can charge an uncapped rate). The Committee is requesting that a contract be drafted based on these negotiations and brought forwazd to the Council at the July 12` City Council meeting. John Rodeberg - Mr. Rodeberg noted that a meeting was held yesterday with MNDOT on the Highway 7 project. They noted that a municipal consent hearing needs to be held to move forward with the project. Mr. Rodeberg is proposing to hold this hearing on August 11, 2005, at 6:00 p.m. at the Event Center. Motion by Arndt, second by Peterson, to set August 11, 2005, at 6:00 p.m. to hold municipal consent hearing at the Event Center for the Highway 7 project, with an Open House held from 4:00 - 6:00 p.m. Motion carried unanimously. Mayor Cook -Mayor Cook noted that on July 5, 200, an E85 event will be held at Cenex with Senator Mark Dayton attending. The public is invited to attend. 11. CLAIMS, APPROPRIATIONS AND CONTRACT PAYMENTS Motion by Peterson, second by Arndt, to pay claims, appropriations and contract payments. Motion carried unanimously. 12. ADJOURN • With no further business to discuss, a motion was made by Arndt, and seconded by Haugen, to adjourn at 7:40 p.m. ~La) Minutes Hutchinson Public Library Boazd May 23, 2005 • Members present: John Paulsen, Kay Peterson, Julie Jensen, Lany Ladd, Janet Vacek, and Mary Henke Members absent: Kay Johnson and John Hassinger Presided Julie Jensen called the meeting to order. Kay Peterson moved that the minutes from the April 25, 2005 meeting be approved with John Paulsen seconding the motion. The motion passed. Report from County Commissioners' meeting on May 23, 2005: Mary reported that she requested a 4% increase to cover operating funds in 2006. This was a joie request from the McLeod libraries: Brownton, Hutchinson, Glencoe and Winsted. Jackee Fountain, the Glencoe librarian then spoke about the updated computer information system and the selection process. John Houlahan, Pioneerkmd Library System director, made a speech regarding the automation project's cost and funding proposal. The commissioners listened, asked questions, and will make a decision in the future. Old business 1. Librarians' portrait project: Mr. Corby gave us examples of photographs he enhanced from a small picture of one of the librarians. Janet Vacek moved to choose the sepia colored photograph vs. the black and white photograph for all the librarians with the exception of Mary Henke's, which will be in wlor. Kay Peterson seconded the motion. Motion passed. 2. Community forum: Tabled until future meeting when Forum Committee members Kay Johnson and John Hassinger are presem. 3. Thank you note from Connie Lambert, former Library Boazd President, was passed around. • New business 1. PLS automation presentation to City Council: Mary Henke prepared a fact sheet for the Library Board members, City Council, and to provide general information about the project. Mary will present to the City Council using this tool. 2. Children's summer reading program: Sherry Lund, Children's Librarian, shared plans for this summer's programs for children. "What's Buzzing at Your Library" is the statewide theme and features bugs of all kinds. Stories in the Park, a story hour located outside with community readers, will be held on Thursday mornings throughout June, July and August. The summer reading program sign-up starts June 6. Businesses in the community have been generous in supplying weekly prizes for the children as they meet their reading goals. These businesses aze Mid Country Bank, Scoop's, McDonald's, CashWise, Hazdee's, Taco John's, Dairy Queen and Subway. Sherry displayed the reading records, punch cards and stickers that will be used to track the children's progress. Friends of the Library have donated funds for a puppet show at the end of the summer. Last year, about 370 kids participated. 3. Library endowment: The library boazd has received a request from a patron to consider establishing a librazy endowment. Our fast hurdle as a board is to decide if we would like such a fund to exist with what terms and options. If we want to do this, we need to have an informed person advise us. Kay Peterson made the motion that we contact a person to present information about endowment at our next boazd meeting. John Paulsen seconded the motion. Motion passed. Julie will contact Rich Peterson, a local lawyer and former library board member, about talking to us with Ron McGraw or Neil Jensen as back-up choices. Staff Present: Jean Wazd, and Judy Flemming. 2. MINUTES OF THE HRA BOARD MEETING ON APRIL 19, 2005 Becky Felling moved to approve the Minutes as written. RECOMMENDATION TO CITY COUNCIL FOR REPLACEMENT OF BRIG KNOTT ON HRA BOARD The Board reviewed the submitted interest forms for serving on Boards/Commissions for the City of Hutchinson. Casey Stotts recommended Dan Cazlson the 3M plant manager. Becky Felling seconded and the motion carried unanimously. 5. PARK TOWERS • a. Jean Wazd presented Resolution #OS-O5, Disposal of Washing Machine. Casey Stotts moved to approve the Resolution #OS-O5. Becky Felling seconded and the motion carried unanimously. b. Jean Ward updated the Boazd on the Renovation Project. The first phase of residents will be moving back to their apartments June 6`n c. Jean Ward reviewed with the Board the PHAS score. 93% is considered a High Performer. 5. Presentation of Drafr Audit Report Mark Babcock presented to the Board the draft Audit Report. Presentation on Meth Lab Houses Police Chief Dan Hatten updated the Board on Meth lab houses and how they are dealt with in Hutchinson. The Police Department will keep the HRA informed of any Meth lab houses that are confiscated. It is possible that the HRA could help remodel the home or if it is bad • enough it could be demolished and rebuild. 5f~~~-- 7. SCHOOL CONSTRUCTION PROGRAM UPDATE • a. Becky Felling seconded and the motion carried unanimously. 8. ROLLING MEADOWS EAST UPDATE a. Consideration of Home Stretch Vaziance The homebuyer was not able to attend the May Home Stretch class because of scheduling conflicts and the small period between the purchase agreement and the closing. The homebuyer is registered to attend the June class. GMHF will allow a onetime vaziance for the homebuyer to attend the class after the closing. However it was suggested to keep $200 back to guarantee that she will attend the class. Becky Felling moved to approve the one time vaziance and hold back $200 until the homebuyer takes the Home Stretch class. Casey Stotts seconded and the motion carried unanimously. Consideration of HHPOP Loan #8807 for the School Construction Program Homebuyer The loan review committee reviewed the file and recommended approval. Casey Stotts moved to approve HHPOP Loan #8807. Becky Felling seconded and the motion carried mnanimously. 9. FRANKLIN-GROVE NEIGHBORHOOD PROJECT UPDATE • a. Consideration of Franklin-Grove Neighborhood SCDP Loan #8680-17 Judy Flemming presented to the board the recommendation from the Loan Review committee to approve Franklin-Grove Neighborhood SCDP Loan #8680-17 with the option that if the homeowner cannot get an addition $860 that the City Revolving Rehab loan could be used. Casey Stotts moved to approve Resolution #OS-07 Changing the Procedural Guidelines of the HRA Entry Cost Assistance Program and the New Construction City Revolving Loan Program to incorporate the maximum loan amount increases to $5,000 for the HRA Entry Cost and $15,000 for the New Construction City Revolving Loan. Becky Felling seconded and the motion carried • unanimously. 13. OTHER • Casey Stotts was wondering if there was any follow-up or inspections on the rehab loans after completion of the project. Currently there is not, because there is nova post-rehab inspection requirement with the state or local rehab program guidelines for owner occupied rehab programs. To our knowledge, there have not been any city enforcement issues post-rehab with our funded owner occupied rehab loans. 14. Example of a few of the calls: • We responded to a call of smoke in area of Bluff Street NE. After going door to door in a six-block area we discovered a smoldering fre in a house. The fre was ruled to be arson. • We responded to a kitchen fire in the 600 block of Third Avenue SW. The house suffered only • minor fire damage. • We responded to four calls to activate our sky-wam procedure. Sky-wam is when we send our weather spotters in the rural area to give the citizens some early warning in case of severe weather, • We responded to a call from one of our hotels where a guest ripped out the smoke alarm system from the room setting off the alarm system for the entire building. We recommended the individual be charged. • We evacuated Wal-Mart when a strong smell of natural gas was detected. • We responded to a call for mutual aid from W insted when a plane went down in a lake. • We responded to a garage fire in the 15000 section of Walden Avenue. The garage suffered only minor damage. • We responded to a call of a house hit by lightning in the 600 block of Dale Street. • We responded to a missing child report in the southwest part of the city. Five bids were received, ranging in cost from $723,000.00 to $948,000.00. KEIC Construction Inc. submitted the lowest, responsible bid at a cost of 5723,000.00. Two alternates were also bid. Alternate one included painting the existing clarifier domes exterior and alternate two was for gel coating the exterior. KHC Constmction altemate bids were $15,000.00 and $22,000.00, respectively. The improvements that were bid include the removal of the existing clarifier equipment and • replacement with new clarifier equipment at Building 60 and the renovation of the dome covers. The dome resurfacing could be accomplished by either painting or gel coating with gel coating providing the most durable option. At Building 20 the existing bar screens will be removed and channel grinders installed. At Building 30 a screenings washer and compactor will be installed. Additionally the upper level of the screenings room in Building 20 and the entire screenings azea in Building 30 will be cleaned and repainted. The clarifier and coarse bar screen equipment maintenance has increased dramatically and is at the end of its design life. The equipment replacement was budgeted in 2005 for $620,000. The owner of ICHC Construction Inc. has previous experience working with the original Constmction of the WWTF as well as numerous other wastewater facility retrofit work. Dalbec, President, Rolling Green, Inc., a Minnesota Corporation, "Subdivider" and Hutchinson, a Municipal Corporation in the County of McLeod, State of Minnesota, hereinafter called the "City' ; • WITNESSETH: WHEREAS, the Subdivider is the owner and developer of property situated in the County of McLeod, State of Minnesota, which has been surveyed and preliminary platted as "Summerset 3'd Addition" and further described in the existing legal description as attached in Exhibit A. WHEREAS, City Ordinance No. 464 and 466 requires the Subdivider to make certain improvements in the subdivision; NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS: I. SITE PREPARATION AND GRADING 1. It is agreed and understood that the Subdivider shall be responsible for all work associated with site preparation and grading. All areas within the final plat, but outside of the rights-of--way, shall be graded to within 0.5 feet of final grade to allow for proper drainage, and the installation of utilities. The entire right-of- way shall be graded to within 0.2 feet of final subgrade, as noted in the approved improvement plans for the project. Any and all unstable soil conditions or soils unsuitable for construction in the right-of--way shall be corrected and/or replaced The Subdivider shall clear trees and/or debris from utiliTy easements and rights-of- way, as per the request of the City or utility, prior to installation of the improvements. All soils shall be compacted to a minimum of 90% Standard Proctor Density. All work shall conform to the approved Site Grading and Improvements Plan, and shall be completed prior to the commencement ofbuilding construction on the site. The Subdivider shall complete all work noted in Paragraph No. 1, and provide a written verification from a professional engineer or surveyor, prior to installation of utilities and/or issuance of building permits. This work must be approved by City staff and related utilities to allow for extension of utilities to serve the site. Any costs associated with these requirements shall be the sole responsibility of the Subdivider, and are not financed through the City. It shall be the responsibility of the Subdivider to assure that the Site Grading Plan and Final Plat are being conformed to during house construction within this subdivision. This responsibility shall include the notification of contractors, builders, and lot buyers as to the drainage and grading requirements, lowest floor elevation requirements, and the type of house (i.e. split entry, walkout, etc.) that may or may not be able to be built for each lot. Site plans for each house must conform to the approved Site Grading Plan. It is essential that the vertical and horizontal locations of the structure are verified to avoid conflict with infrastructure and potential drainage issues. Any costs associated with correcting these conflicts and issues shall be the sole responsibility of the Subdivider. 4. The Subdivider shall provide all turf establishment and erosion control necessary to protect the utilities and street improvements on the entire site. The Subdivider shall also provide all erosion control during site grading and improvement work necessary to meet local, state and federal requirements. Any subdivision disturbing one acre or more of land needs to obtain an NPDES/SDS (National Pollutant Discharge Elimination System/State Disposal System) pemut through the MPCA (Minnesota Pollution Control Agency). Information regazding the permitting process can be accessed at www.pcastate.mn.us/water/stormwater/stormwater-e.html or by calling the City's Regulatory Specialist at (320) 234-5682. A copy of the submitted permit and associated Stormwater Pollution Prevention Plan (5 WPPP) must be provided to the Regulatory Specialist prior to construction commencing within the site. All • disturbed areas shall be seeded, mulched, and disc anchored with MNDOT seed mix 250GR within 48 hours after final grading is completed or within one week after rough grading is completed. Any areas disturbed adj acent to a stormwater pond, drainage ditch ar existing wetland shall be seeded with MNDOT seed mixture 310 and covered with erosion control blanket. Any corrective measures to address erosion control and turf establishment are at the expense of the Subdivider. The City shall notify the Subdivider in writing, of work needing completion Ifno action is taken by the Subdivider within 10 days or sooner ifdetermined necessary, the City reserves the right to complete this work and invoice or assess the Subdivider. 5. It is understood and agreed that it shall be the Subdivider s responsibility to provide survey control points for all infrastructure and site construction. 6. It is understood and agreed that the Subdivider shall be responsible for maintaining the condition of the infrastructure, mowing, weed control and other site maintenance issues during site and building construction. The Subdivider shall be required to maintain and clean the roadways and storm sewers/ponds on a regular basis, and shall repair or replace any street, storm sewer/ponds, sanitary sewer or watermain infrastructure damaged by operations related to site and building construction. The Subdivider hereby designates Prieve Landscaping as the person responsible for site issues. The City will not be responsible for any maintenance of the site. The City shall notify the Subdivider in writing, of work needing completion. Ifno action is taken by the Subdivider within 10 days or sooner if determined necessary, the City reserves the right to complete this work and invoice or assess the Subdivider. 7. The Subdividers will complete the grading, turf establishment and necessary erosion control on the site by November 1, 2005. ASSESSMENTS/IMPROVEMENTS The Subdivider hereby agrees to construct lateral and trunk sanitary sewer mains and appurtenances, lateral and trunk watermain and appurtenances, sanitary sewer service leads, water service leads, lateral and trunk storm sewer and appurtenances, curb and gutter, street grading, street base, street surfacing, street signs and lighting, and appurtenances to serve the entire plat. All work shall be completed by forces employed by the Subdivider, and the work shall meet all applicable local, state and federal regulations and construction standards. The City shall approve all construction documents and shall have overview and fmal approval of all infrastructure proposed to be fumed over to the City. 2. It is understood and agreed that the City of Hutchinson shall be responsible for the additional costs associated with the necessary oversizing of lateral mains required to install trunk sanitary sewer and trunk watermain that serve areas beyond the plat, as noted within City policy and ageed to by the City Engineer. This shall include the extension of approximately 520 LF of 18" PVC watermain within Bradford Street, 200 LF of 12"PVC watermain within Denver Avenue, and 190 LF of 8"PVC sanitary sewer main within Denver Avenue west of Bradford Street. Current City policy states that 100% of all lateral mains and services shall be assessed to the benefiting property owner. Thus, the City will reimburse the Subdivider for the difference between the actual private bid prices (subject to City approval) ofthe trunk watermain sizes and 8" watermain. At this time, the entire cost of the 190 LF sanitary sewer extension within Denver Avenue will be the responsibility of the City and then assessed to upstream property owners in the future. The costs of appurtenances that would be required on normal lateral mains such as hydrants, gate valves and manholes willbe the sole responsibility of the Subdivider. Additional costs to upsize appurtenances on trunk mains such as gate valves and manholes will be the City's responsibility based on the bid price difference method. The City will reimburse the • Subdivider based on the actual private bid prices of the utility work and calculated differences (subject to City approval) as mentioned above afrer the work is completed and accepted by the City. This reimbursement will be from the City's Water/Wastewater Funds and distributed to the Subdivider via a City check. 3. It is understood and agreed that the City shall collect a lump sum fee for services provided to the Subdivider. It is agreed that the Subdivider will have a consultant, Otto Associates, complete the following at his own expense: project design (including plans and specifications), construction staking, general project administration, construction observation, and detailed as-built drawings in AutoCAD. The City shall complete the following at the noted percent of construction cost. It is agreed and understood that these costs will be paid prior to construction, and that rates are in consideration of work to be famished and completed by the Subdivider's consultant. Thus, the lump sum fee shall be $84,566. 4. It is understood and agreed that each lot shall pay a Trunk Sanitary Sewer and Watermain Access Charge. n U Summerset 3rd Addition/Page 3 -June 30, 2005 sr-~> This fee will compensate the City for improvements required to provide trunk sanitary sewer and watermain • access to the plat property boundary. This fee shall be based on the most current fees being chazged by the City and is due at the time of building permit issuance. These rates for the year 2005 are $1,415 per lot for trunk sanitary sewer and $1,075 perlot for trunk watermain. It ismmderstood that there is a can-ent assessment against the property for work previously completed within adjacent City projects and private developments. The original total principal amount was $49,596.07. The current principal and interest amount can be calculated and provide upon request. It is understood and agreed that these assessments shall be activated and spread against the property within this plat. A separate agreement as to how these assessments aze to be spread shall be completed prior to issuance of building permits for the plat. 6. It is understood and agreed that any agreements regazding the method and procedure for assessments from municipal improvements shall, at the sole option of the City, cease to be effective thirty-six (36) months following approval of the Subdivision Agreement by the City. The City may exercise the option granted herein by giving written notice at any time, either before or after the expiration of the thirty-six (36) month period, of the City's intention to nullify the method and procedure for spreading assessments under the terms of the Subdivision Agreement. In the event the City so elects, all assessments subsequent to the notice shall be spread and imposed pursuant to Chapter 429 of Minnesota Statutes or other applicable laws. The written notice called for by this pazagaph shall be given to the fee owner of the property as disclosed by the records of the McLeod County Recorder or Registraz of Titles. III. OTHER FEES, CHARGES AND DEDICATIONS 1. It is agreed and understood that the Subdivider shall provide a surety in the form of a bond or letter of credit • in favor of the City, in the amount of 100% of the proposed improvements cost excluding grading ($1,208,091 based on the City approved Otto Associates Engineer's Estimate dated 6/1/05). The bond or letter of credit is due prior to the commencement of construction. 2. It is understood and ageed that the Subdivider shall pay a fee of $800 per lot for single-family residents as a municipal electric service access charge, as noted by agreements with McLeod Cooperative Power Association (Coop). These fees shall be collected with the building permit for all properties, unless otherwise noted in the agreement with McLeod Cooperative Power Association. The checks shall be made out directly to the "McLeod Cooperative Power Association". 3. It is understood and agreed that the Subdivider shall, prior to installation of utilities, pay connection fees for Electric/Gas Service to Hutchinson Utilities for all units to be served in the final plat. These fees include the standazd connection to each house including required meters. Services lazger than the standard residential sizes will be at a higher cost. 4. It is understood and agreed that a parks and playground contribution shall be made in the form of 10' bituminous trail construction along the entire length of Denver Avenue within this plat and the trail connection between Eau Claire Street and Edmonton Avenue. It is understood and agreed that future additions/phases would be required to pay park fees, which aze currently $215 per unit for Rl; $175 per unit for R2; and $135 per unit for R3. 5. The Subdivider will provide dollars to the City for the planting of boulevard trees at a rate of $180 per tree (2 trees per lot x 102 original lots - 4`" addition would create an additional 11 lots), which equals $40,680. Any damage to surrounding private property or City infrastructure that occurs due to building construction shall be the responsibility of the Subdivider to correct. 2. It is understood and agreed that all local, state and federal permits required to be obtained for the development shall be the responsibility of the Subdivider. 3. This agreement shall be binding upon and extend to the heirs, representatives, assigns and successors of the parties. 4. It is understood and agreed that the Subdivider shall record this agreement at the McLeod County Recorder'sOffice or McLeod County Registrar of Titles Office, and that no Building Permits will be issued until said Agreement is recorded and a certified copy of this agreement is provided to the City. Our objective is to identify and prioritize traffic flow and safety issues that impact the Traveling Public.
