APPROVE/DENY SECOND READING AND ADOPTION OF ORDINANCE NO. 23-840 — AN ORDINANCE AMENDING CHAPTER 92 OF THE HUTCHINSON CITY CODE PERTAINING TO WEEDS John Paulson, Project/Environmental/Regulatory Manager, presented before the Council. Mr. Paulson noted that no further comments or changes have been made to the ordinance since its first reading at the last meeting. The primary changes made to the ordinance are due to legislative changes made earlier this year. Motion by May, second by Burley, to approve second reading and adoption of Ordinance No. 23- 840. Motion carried unanimously. NEW BUSINESS 10. APPROVE/DENY PROPOSED VACATION LEAVE, EARNED SICK AND SAFE LEAVE AND BEREAVEMENT LEAVE POLICIES Kellie Wendland, Human Resources Director, presented before the Council. Ms. Wendland explained that the proposed Earned Sick and Safe Leave is mandatory effective 1-1-24 by the state legislature. This new policy will replace the City's current sick leave policy. The new policy is more generous in a few areas, including ESSL to be used when a care provider is ill or when an employee needs more time for bereavement. A benefits survey was put out to employees earlier this year and the result of that survey was that a majority of city staff felt the vacation accrual structure needed attention. Therefore, a new accrual structure is being proposed that staff feels will positively affect employee morale and well-being. A couple of changes include providing all regular full-time employees with a bank of 40 hours of vacation at time of hire and then continue to accrue. The proposed adjusted vacation leave accrual schedule allows for more time to be accrued based on years of service. In addition, bereavement leave was another benefit that many city staff felt would be beneficial. Currently, employees must use sick leave and it is limited to only immediate family as defined by law. The new policy will allow employees to take time for any relationship they deem as significant. APPROVE/DENY RESOLUTION NO. 15646 — RESOLUTION UPDATING THE CITY'S ENDS STATEMENTS DOCUMENT Matt Jaunich, City Administrator, presented before the Council. Mr. Jaunich noted that staff and CITY COUNCIL MINUTES — October 24, 2023 Council have spent the last couple of months reviewing and discussing the Ends Statements document. Following the workshop that was held on this topic, revisions were made to update the document and now staff is requesting that the formal document be approved. COUNCIL/MAYOR UPDATE ADJOURNMENT Motion by May, second by Burley, to adjourn at 5:55 p.m. Motion carried unanimously. 4 HUTCHINSON CITY COUNCIL REVIEW OF COMMUNITY SURVEY RESULTS MINUTES TUESDAY, OCTOBER 24, 2023 - 4:00 PM CITY CENTER — COUNCIL CHAMBERS 1. Call to Order Mayor Forcier called the workshop to order at 4:00 p.m. Members present included Tim Burley, Pat May, and Dave Sebesta. Member absent was Chad Czmowski. Others present were: Matt Jaunich, City Administrator and other city directors. REVIEW OF COMMUNITY SURVEY RESULTS 2. Community Survey Results Matt Jaunich, City Administrator, presented before the Council. Mr. Jaunich noted that today's workshop is to review the results of the community survey that was distributed this past Summer. A third party administered the survey which was a collaboration between the National Research Center at POLCO and the International City/County Management Association. This benchmarking survey provides a comprehensive and accurate picture of livability and residents' perspectives about local government services, policies and management. The survey captures resident's opinions and the results are based on resident perceptions. The survey results also describes areas where the community believes things are going well and sheds light on the areas that could benefit from improvement. Mr. Jaunich also provided information about the National Citizen Survey which measures livability which describes a community that is not simply habitable but that is desirable and not only where people do live, but where they want to live. The 10 facets of a livable community described by the NCS are safety, mobility, natural environment, community design, utilities, economy, parks & recreation, education/arts/culture, inclusivity/engagement and health & wellness. The survey also contained some custom questions. The survey takes into account that "great communities arc partnerships of the government, private sector, community -based organizations and residents, all geographically connected". Again, the survey captures resident's opinions on the community. There were 3000 surveys that went out and of those 120 were returned. In the end, the results are the opinion of 761 residents. Households were randomly selected and the survey has a margin of error of +/- 4%. The response rate was 26% which was the lowest ever. The City has conducted the survey four times (2007, 2011, 2015 and 2019). In addition to the direct surveys, 74 opt -in online surveys were received. There was a demographic shift in survey respondents from past years with 71% being 55+, 59% being female and 80% owned a home. Mr. Jaunich reviewed survey results in all 10 facets: Quality of Life — 84% of the residents rated the overall quality of life in Hutchinson as excellent or good (same as in 2019). Economy — 68% rated the overall economic health of the City as excellent or good (67% in 2019); 75% would recommend Hutchinson as a place to work (same as in 2019); and 64% would recommend Hutchinson as a place to visit (65% in 2019). Mobility — 63% rated the overall quality of the City's transportation system as excellent or good (first time this question was asked). Community Design 7 1 % rated the overall design or layout of residential and commercial areas as excellent or good (74% in 2019) and 80% viewed their neighborhood as a good to excellent place to live (same as in 2019). Utilities — 83% rated the overall quality of the City's utility infrastructure as excellent or good (first time this question was asked). Safety — 83% rated the overall feeling of safety within the City as excellent or good (88% in 2019); 95% feel safe in their neighborhood during the day (97% in 2019); 93% feel safe in the downtown/commercial area during the day (96% in 2019); 84% feel safe from property crime (75% in 2015); 89% feel safe from violent crime (87% in 2015); and 86% feel safe from fire, flood or other natural disaster (first time this question was asked). Natural Environment — 84% rated the overall quality of the natural environment within the City as excellent or good (87% in 2019). Parks & Recreation — 85% rated the overall quality of parks and recreation opportunities within the City as excellent or good (first time this question was asked). Health & Wellness — 68% rated the overall health and wellness opportunities within the City as excellent or good (71% in 2019). Education, Arts & Culture — 75% rated the overall opportunities for education, culture and the arts within the City as excellent or good (73% in 2019). Inclusivity & Engagement — 58% rated their connection and engagement with their community as excellent or good (first time this questions was asked); 84% viewed Hutchinson as a good to excellent place to raise children (same as in 2019); 68% viewed Hutchinson as a good to excellent place to retire (same as in 2019); and 64% rated Hutchinson's sense of community as good to excellent (60% in 2019). Governance — 74% of residents rated the overall quality of services provided by the City as excellent or good (78% in 2019); 82% gave the City's customer service a positive rating (78% in 2019); 70% gave a positive rating in regard to value of public information services (72% in 2019); 52% gave a positive rating in regard to value o f services for taxes paid (same as in 2019); 59% of residents rated the overall direction of the City as excellent or good (same as in 2019); 54% stated that the City was welcoming of citizen involvement (53% in 2019); 5 1 % stated they were confident in City government (55% in 2019); 61% stated that the City was acting in the best interest of Hutchinson (58% in 2019); 61% stated that the City was being honest (63% in 2019); 58% stated that the City treats all residents fairly (same as in 2019); 55% stated they felt the City was being open and transparent to the public (first time this question was asked); 5 1 % stated that the City was informing residents about issues facing the community (first time this question was asked); and 66% stated that the City was treating residents with respect (first time this question was asked). Participation — 42% of residents have contacted the City for help or information (40% in 2019); 11% have contacted a Hutchinson elected official to express their opinion (14% in 2019); 11% have attended a local public meeting (16% in 2019); 27% have watched a local public meeting (28% in 2019); 44% have volunteered their time to some group/activity (48% in 2019); 13% have campaigned or advocated for a local issue, cause or candidate (same as in 2019); and 76% have voted in the most recent local election (77% in 2015). Recreational Facilities: 14% Strongly Oppose; 30% Strongly Support; 14% Somewhat Oppose; 42% Somewhat Support Water/Waste/Storm: 6% Strongly Oppose; 44% Strongly Support; 9% Somewhat Oppose; 41% Somewhat Support Roads & Bridges: 5% Strongly Oppose; 42% Strongly Support; 8% Somewhat Oppose; 45% Somewhat Support Mr. Jaunich also shared results of household questions that related to electric vehicles, recycling, composting and energy/heat conservation. Mr. Jaunich concluded survey results in that 1. Hutchinson rated higher than the national benchmark in the following areas: overall quality of the utility infrastructure, ease of travel by bicycle, ease of walking, well -planned residential growth, well -planned commercial growth, preservation of the historical or cultural character of the community, availability of paths and walking trails, volunteering time to some group/activity, storm water management and yard waste pick-up; 2. Hutchinson rated lower than the national benchmark in using public transportation instead of driving and shopping online; 3. Upward trends included overall economic health, overall opportunities for education/culture/arts; recommend living in Hutchinson to someone who asks; remain in Hutchinson for the next five years; feeling safe from property crime; feeling safe from violent crime; vibrancy of downtown/commercial area; ease of public parking; ease of travel by car; ease of travel by bicycle; recreational opportunities; opportunities to attend cultural/arts/music activities; neighborliness of residents; opportunities to participate in social events and activities, opportunities to attend special events and facilities, storm water management, emergency preparedness, preservation of natural areas, government generally acting in the best interest of the community, and importance of the community to focus on the overall quality of natural environment; 4. Downward trends include overall health and wellness opportunities, ease of travel by public transportation, contacted a Hutchinson elected official within the last 12 months, watched a local public meeting over the last 12 months, walked or biked instead of driving over the last 12 months, importance of the community to focus on the overall opportunities for education, culture and the arts and importance of the community to focus on residents' connection and engagement with their community. Mr. Jaunich also reviewed significant increases and decreases (6% or more) from 2019. The survey results showed that the top -rated City services are public library services, fire services, City parks and public power (electric/gas). The four key findings of the survey results showed that: 1. While the economy remains a top priority for residents, perceptions of local businesses are on the rise. 2. Residents highlight the City's overall design and ease of mobility as a community strength. 3. Hutchinson residents appreciate the City's natural environment and offer insight into their own sustainability practices. 4. Overall, ratings in Hutchinson for 2023 generally remained stable. Mr. Jaunich then reviewed the next steps Council and staff should take with the survey results. Discussion was held on strategies to use to get more residents to participate in the survey. 3. Such revised assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted, and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of ten (10) years, the first of the installments to be payable on or before the first Monday in January, 2024 and shall bear interest at the rate of 4.58 percent per annum as set down by the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from November 1, 2023, until the 31st day of December 2024. To each subsequent installment when due, interest shall be added for one year on all unpaid installments. 3. MN) DATE: October 6, 2023 RE: 2023 Assessments to Wurdell Property MEMORANDUM This memo outlines considerations for 2023 assessments on the Wurdell property for the mill and overlay improvements on School Road NW as part of the 2023 Pavement Improvement Project. The 2023 assessments for the Wurdell property should be revised from $22,275 to $16,474. The assessment value of $22,275 that was included on the final assessment roll was based on the fixed cost method. This method of assessment was calculated based on 13 future lots having direct driveway access to School Road NW. In 2004, when this segment of School Road NW was constructed, it was determined that direct driveway access to this new segment of street would not be allowed. Recent discussions with planning staff and further consideration by engineering staff, confirmed the 2004 decision to not allow direct driveway access to School Road NW. However, based on redevelopment plans of the former golf course property adjacent to School Road NW and the fact that this parcel has no other street access available, it was determined that a maximum of two access points would be allowed in this segment of School Road NW. School Road NW provides street access and a benefit to the adjacent Wurdell property, therefore special assessments should be levied on the property for the 2023 improvements. The Area method of assessments would be used to calculate assessments for the property. Based on a sketch plan submitted to the City a potential of 16 twin home lots could be developed in the parcel east of School Road NW (see attached). The sketch plan shows 6 lots that would be directly adjacent to School Rd NW. Access for these lots would not be directly to School Rd NW, but there is a benefit to having two access points off School Rd NW to develop these lots. Assessment value based on lot area is calculated using a standard 66 ft x 132 ft City lot as basis for computing a per square foot assessment rate. Using the per foot assessment rate of $33.75/ft on a 66 ft front lot width, establishes an assessment value that can be converted to square feet using on the standard lot depth of 132 feet. The calculation is as follows: 66 ft frontage x $33.75 / ft = $2,227.50 66 ft x 132 ft = 8,712 sq ft $2,227.50/8,712 sq ft = $0.26/ sq ft Based on the sketch plan submitted, assessments would be levied for the 6 twin home lots that are adjacent to School Rd NW. Lot dimensions of 80 ft x 132 ft would result in the following total area calculation: 6 lots x 80 ft x 132 ft = 63,360 sq ft of total lot area. This will eliminate a lot of unnecessary counting of random write in votes (e.g., "Mickey Mouse" votes), when essentially those votes have already been overturned by the results of the regular contest. The purpose of this purchase is to replace the current 2017 John Deere WAM (wide area mower) that has reached the end of its usable life expectancy. Currently, PRCE has two Toro 4000D Grounds Masters in our current fleet. This purchase would replace the John Deere WAM to align our fleet with another Toro 4000D Grounds Master for ease of operations and maintenance. The mower is part of the Parks Department's mower fleet, which mows over 500 acres on a weekly basis. If not replaced, the mower will significantly reduce the amount of grass that can be cut in a week, resulting in unmowed Parks, Athletic Fields, and other city -owned facilities. The current mower is costing an average of $6k-8k in repairs, and its failing components are due to the harsh environment it consistently operates in. Therefore, City of Hutchinson PRCE staff have tested multiple mowers, including Jacobsen, John Deere, and Toro. After conducting a 1-day demo, they have concluded that the Toro 4000D is the best machine to fit the department needs based on machine structure, dependability, and functionality for seasonal and full-time staff. The information will be used to prioritize drainage improvements and to inform us of future system needs due to changes in precipitation intensity and duration. As of the Effective Date, Assignor assigns to Assignee all of Assignor's rights, title, interest and obligations as tenant in, to and under (a) the Client Lease Agreement dated December 1, 2017, executed by and between the City of Hutchinson (City / Landlord) and Laser Dynamics Inc. (Client / Tenant), as amended by the Client Lease Amendment dated February 11, 2022, City of Hutchinson (City / Landlord); Laser Dynamics Inc. (Client / Tenant) (the "Lease"), and (b) all of Assignor's right, title and interest in and to any prepaid rents and security deposits (collectively, the "Deposit"), if any, given by Assignor under the Lease, and Assignee assumes all of Assignor's rights, title, interest and obligations as tenant in, to and under the Lease and the Deposit. All capitalized terms not defined herein shall have the meanings ascribed to such terms as set forth in the Lease. 2. Indemnification of Assignee by Assignor. Assignor agrees to indemnify Assignee against and hold Assignee harmless from any and all liabilities, losses, claims, damages, costs or expenses, including, without limitation, reasonable attorneys' fees and costs (collectively, the "Claims"), originating prior to the Effective Date and arising out of tenant's obligations under the Lease and the Deposit, if any. 3. Indemnification of Assignor by Assignee. As of the Effective Date, Assignee agrees to indemnify Assignor against, and hold Assignor harmless from, any and all Claims originating on or subsequent to the Effective Date and arising out of the Assignee's performance of the tenant's obligations under the Lease and the Deposit, if any. 4. No Liens. Assignor represents that (a) it has good title to the Lease and the Deposit and they are free from any liens or encumbrances, (b) the Lease is in full force and effect in accordance with its terms, and (c) it has not received nor has it delivered any notice of any default under the Lease. 5. Assignor Loan. Pursuant to the Forgivable Loan Agreement dated August 28, 2023 (the "Loan Agreement"), the City made a loan to Assignor in the original principal amount of $23,000.00 (the "Loan") which Loan is outstanding as of the Effective Date. Assignor and Assignee each acknowledges and agrees that the term of this Assignment shall have no effect on the Loan or on Assignor's obligations under the Loan Agreement. The City acknowledges and agrees that Assignee does not have any obligations for the Loan under the Loan Agreement and has not assumed any portion of or liability for the Loan under this Assignment. 6. Landlord's Consent. The City acknowledges and consents to the foregoing assignment of the Lease and Deposit from Assignor to Assignee and the assumption of the Lease and Deposit by Assignee. From and after the Effective Date, all references to "Client" or "Tenant" in the Lease shall refer to the Assignee. 7. Termination of Lease. Notwithstanding anything set forth in the Lease to the contrary, provided that Assignee and the City have executed a new lease agreement for the Client Space commencing on December 1, 2023, the term of the Lease shall terminate and expire at 11:59 p.m. on November 30, 2023 (the "Early Termination Date"). From and the Early Termination Date, the Deposit shall be transferred to and provide security for the new lease. 8. Counterparts; Execution. This Assignment may be executed in any number of identical counterparts, each of which, for all purposes, shall be deemed an original, and all of which shall constitute, collectively, one and the same Assignment. ALTERNATIVE LANDSCAPES IN ROW c. LANDSCAPE MANAGEMENT PLAN John Paulson provided an overview of alternative landscaping concepts and what the City allows. The City of Hutchinson currently allows property owners to utilize alternative landscapes when they are being specifically managed for native prairie landscapes. This alternative is considered on a case by case basis and only after in- depth review and discussion with the landowner. Understanding the maintenance needs for such a landscape is integral to the success of the area being converted but also to prevent harboring of noxious weeds and to keep area from becoming overgrown and causing a nuisance. Currently the City does not refer to this alternative in City Code. A revision to the Code will be prepared to align with the new legislation and existing alternative landscape guidance. 5. UNFINISHED BUSINESS A. CLIMATE POLLUTION REDUCTION GRANT UPDATE Mr. Paulson updated the board on the status of the Stormwater Resiliency Modeling project underway. City staff is working with SEH to complete a ag�p analysis and fill in any missing storm sewer system data that exists. Over the next month staff will be collectingmissing GIS information necessar t�prove the accuracy and outputs of the storm sewer system model. Once the data gaps are filled then SEH will begin building and running model projections with various rainfall inputs and intensitX projections that reflect current and projected intensities. Work will also include communityput gathering over the winter with project concluding in June 2023. 6. COMMUNICATION FROM STAFF A. COMPOST IT RIGHT — THINK BEFORE YOU THROW PRESENTED BY — AMPLIFY FOR CHANGE An update of the Compost It Right program was provided remotely y Betsy Lipson, Amplify for Change. Her presentation was an overview of the work done to date that included citizen survey data and analysis of the level of contamination present. The desired program outcomes were also discussed. Community engagement and user education are fundamental items that will be improved with this project and should serve as a roadmap for continuing those efforts into the future. It is apparent that many people were not aware they were doing an. tag wrong. Continued education about reducing contamination is a high priority. Discussion about maximizing outreach effectiveness led to finding who community influencers are and finding a way for them to help spread that message. B. SWC CLIMATE RESILIENCY GRANT UPDATE John Paulson updated the Board on the recently completed GIS data ag�p analysis and the subsequent data collection efforts that are ongoing. The data gap collection should conclude in September with an immediate transition into building the model and beginning to run various model scenarios. There is also an opportunity for information sharing and partnering with the UofM Saint Anthony Fall LaboratorX while they conduct research on stormwater modeling calibrations and data input accuracy. There was support to continue expoloring a partnership with the UofM on the research. 7. ADJOURNMENT Library Board Meeting September 25, 2023 Members Present: Mary Christensen, Sue Griep, Margaret Hoffman, Kay Hultgren, Julie Lofdahl, Dianne Wanzek, and Katy Hiltner, Ex -off icio. Excused/Absent: Tim Burley Dianne called the meeting to order at 4:30. Minutes from the August 28, 2023, meeting were reviewed and approved. Old Business: 1. Western Novel Night (Aug. 30): Twelve attendees enjoyed author Mark Mitten's presentation, which included Trivia, and a question/answer session. 2. Launch of Fall Children's Programs: The fall sessions are off to a good start. The first Lego night drew 50 attendees. The first meeting of the Graphic Novel Book Club drew 7 participants. Chess club was well attended. Story Time, which also includes art/crafts, sensory, and STEM activities, has drawn in around 20 attendees each time. Feedback has been good on the increased activities for middle graders. 3. Reminder: History of Money program on Thursday, Sept. 28, 6:30-7:30, with Dave Daubert. 4. Friends of Library Book Sale: This year's sale, held during Arts and Crafts Festival, was very successful and brought in $2238 ($1526/2022). Tables were donated (from two churches and the city) and city workers helped with set up. New Business: 1. October Calendar of Events: "Teentober": A grant from Prairielands will fund a Halloween teen night with activities including building Halloween houses using Peeps candy, trivia, etc. Meet the Author: A Legacy grant will fund an author visit, in conjunction with the writers' book club. Mindy Mejia, author of crime and thriller books, will present on Wed., Oct. 25, from 6:30-7:30. Her latest book is To Catch a Storm. Pumpkins with Bling: This is the second year for this project and will take place on two dates. Sat., Oct. 28 will have two sessions (12 attendees per session) and Mon., Oct. 30, will have one session of 12 openings. Participants will need to register for their preferred session. 2. MN Library Association Conference: October 4-5, 2023, at St. Paul River Centre. 3. Little Free Libraries —Connect Committee: Katy provided the board with a new brochure she created to highlight the LFL program, library locations, and an explanation of the Hutchinson Connects committee's purpose.
