08-08-1980 CCMI/ MINUTES SPECIAL MEETING - HUTCHINSON CITY COUNCIL FRIDAY, AUGUST 8, 1980 Vice -Mayor Ken Gruenhagen called the special meeting to order at 8:30 A.M., with the following members present: Aldermen Ted Beatty, Milt Lueneburg, and Bruce Peterson in addition to Vice -Mayor Gruenhagen. Absent: Mayor Westlund. Also present were City Administrator Gary Plotz and City Attorney Schantzen. Mr. Schantzen explained he requested this meeting to request the City Council to authorize Mayor Ralph Westlund to act on behalf of the Council at the trial concerning the bridge lawsuit which will begin on Monday morning at Glencoe. He stated he felt it would be easier dealing with one member rather than all of the council. He explained Krueger was the contractor hired and he sublet the surfacing portion to Glenwood Bridge. The City received 13 claims filed on people who hadn't been paid. These were, however, all paid except Glenwood Bridge which had a contract with Krueger for $30,000 to be withheld. We then refiled a claim for $68,000 less the hold back claiming the job was insufficient. The engineers decided the deterioration was increasing so the claim went to $146,000 since it had not been done correctly to begin with. In the meantime Krueger is no longer in business. City Attorney Schantzen also commented all members of the Council were welcome to come to the trial. Alderman Milt Lueneburg made the motion to authorize Mayor Ralph Westlund to act as sole representative of the entire City Council of City of Hutch- inson at the trial. Seconded by Alderman Bruce Peterson, the motion unani- mously carried. City Administrator Gary Plotz updated the council on the Senior Citizens high rise. He stated he had met with the Minn. Housing Finance Agency and if the developer can get all the drawings and bidding done by Sept. 15th the project will began by fall. If this is done, the interest rate will be 7 1/2% but if the project waits until spring, the rate of interest will be 9 3/4%. He went on to explain a conditional use permit will be needed as well as a vacation of an alley. These would require two readings before the council. Alderman Bruce Peterson commented he had received a call from the township inquiring the city's position on burning at the city tree dump. Mr. Plotz explained there had been a fire out there in which some chips had started but it has been taken care of. He also informed the Council the City has a burning permit issued by the State. There being no further business, the meeting adjourned at 8:45 A.M.
