BACKGROUND/EXPLANATION OF AGENDA ITEM:
About a year ago the Hutchinson Elks addressed the City Council about their plans to construct an Inclusive Play Park
in Elks Park. At the time, they were looking at a large project with a cost of over $300,000. Since their presentation to
the Council back in November of 2015, the Elks have redefined their project and have approached it in more of a
phased project to be done over multiple years. On Monday, the Elks is expected to present a check to the City in the
amount of $38,906 to do phase I of their Inclusive Play Park. The donation from the Elks is expected to cover all of
the costs for this first phase.
Members from the Hutchinson Elks will be present to give an update on their overall project and what Phase I will
detail. The group will share their plans for the future along with their proposed funding plans. This will be similar to the
presentation we received from the Rotary group at our last council meeting.
The work that is being proposed for phase I will be purchased by staff this fall to get current 2016 pricing. The Parks
Department will be preparing the site with an intended community build project of the new structure in May of 2017.
PRCE staff and Administration are recommending that the City Council accept the donation and approve the
purchase and installation of the new playground unit at Elks Park.
The Hutchinson Elks should have additional information on the details of Phase I at the meeting on Monday.

Mayor Gary Forcier called the meeting to order. Members present were Chad Czmowski, Bill
Arndt, and Mary Christensen. Member absent was John Lofdahl. Others present were Matt
Jaunich, City Administrator, and Marc Sebora, City Attorney.

(a) Approve/Deny Accepting $40,000 from City of Hutchinson Local Rotary Group and
Proceeding with Installation of Play Structure at Rotary Park
Jim Wendling, Hutchinson Rotary, presented before the Council. Mr. Wendling
explained that the local rotary group has sponsored Rotary Park since the 1990s.
Playground equipment was installed in 1993 and other amenities have been put in place
over the years which include a shelter, sand volleyball court, walking path, and a
ballfield. In addition, Heart of Hutch installed a fitness park within Rotary Park. Mr.
Wendling explained that for the last five years Hutchinson Rotary has been fundraising
for new playground equipment. The Rotary Group is ready to purchase the equipment
and is donating $40,000 to the City of Hutchinson for the purchase. The Rotary group's
intention is to give at least $5000 to the City for four more years to pay for the entire cost
of this new playground project which totals $59,888. The difference of the $19,888 will
come from the Public Sites fund with Rotary's yearly donation going back into that
account. The Parks Department will be removing the existing unit in November with an
intended community build project of the new play structure in early May 2017.
Motion by Arndt, second by Christensen, to approve accepting $40,000 from City of

9. APPROVE/DENY PROCUREMENT CARD POLICY
Andy Reid, Finance Director, presented before the Council. Mr. Reid explained that the
environment of company purchasing has migrated to an overwhelming amount of credit card
purchases. More and more vendors require online purchases be paid with a credit card
and/or lower costs are found online or some purchases can only be found online. Staff is
recommending that department procurement cards be distributed. The finance department
has maintained one "City" credit card since 2012 for all departments to use in those instances
where a check disbursement is not possible. The card's usage has increased substantially in
the past year. Wells Fargo has recommended that procurement cards offer more controls and
benefits than standard credit cards. Mr. Reid reviewed the advantages of procurement cards
which include cardholders having online access to review and approve purchases; monthly
purchasing card billing statement is paid electronically from the City's Wells Fargo bank
account; the online feature allows for a direct upload to the City's accounting software with
vendor names, expense accounts and descriptions of purchase information being
automatically populated; vendor purchases will be reflected in the City's accounting system
as paid to the actual vendor; the City can place restrictions on the purchasing cards to prevent
unauthorized purchases; the finance department has administrative access to the online
program and can change restrictions and credit limits as needed; Wells Fargo will dedicate a
representative to the City for assistance with all issues related to the purchasing card program
and the City will receive cash -back rewards if procurement card purchases reach an annual
threshold. Staff has established proposed departmental cards along with monthly limits
which range from $5000 to $10,000.

10. APPROVE/DENY ITEMS FOR SUBMISSION OF AN APPLICATION TO THE
MINNESOTA DEPARTMENT OF EMPLOYMENT AND ECONOMIC DEVELOPMENT
CONTAMINATION CLEANUP GRANT PROGRAM
(a) Resolution No. 14629 — Resolution Approving Submission of an Application to the
Minnesota Department of Employment and Economic Development Contamination
Cleanup Grant Program
(b) Resolution No. 14632 — Resolution Committing to Provide the Required 25% Local
Match For a Contamination Cleanup Grant and Authorizing Contract Signature
Miles Seppelt, EDA Director, presented before the Council. Mr. Seppelt explained that
the resolutions before the Council are required for a grant application Mr. Seppelt is
submitting a grant application for the hotel project that is proposed on the northeast
corner of Hwy 7/Hwy 15. The proposed grant would cover up to 75% of the costs of the
environmental investigation and cleanup of the site. This site was once a gas station, so
much environmental and soil corrections will be necessary.
Motion by Czmowski, second by Arndt, to approve Resolution Nos. 14629 and 14632.
Motion carried unanimously.

11. APPROVE/DENY AWARDING BID FOR HUTCHINSON ENTERPRISE CENTER
Matt Jaunich, City Administrator, presented before the Council. Mr. Jaunich explained that
bids were opened yesterday and the low bid came in approximately 20% higher than the
project estimate. Because of this, the EDA Board is requesting that the Council table this
item to November 22, 2016, to allow time for the EDA Board to review the project needs.
Motion by Arndt, second by Czmowski, to table this item to November 22, 2016. Motion
carried unanimously.
12. APPROVE/DENY SETTING COUNCIL BUDGET WORKSHOP FOR NOVEMBER 7,
2016, AT 4:00 P.M.
Mr. Jaunich noted that a budget workshop should be held to review the enterprise fund budgets.
Motion by Czmowski, second by Christensen, to set budget workshop for November 7, 2016, at
4:00 p.m. Motion carried unanimously.

BACKGROUND/EXPLANATION OF AGENDA ITEM:
The City received a donation back in January from the VFW in the amount of $15,000. The donation was made at the
time on the condition that the money be used to construct a bathroom facility at the VFW Park and that the money be
spent by July 1, 2016. If not spent by July 1, 2016, the money was to be returned to the VFW. In June, we had yet to
use the money for a bathroom facility and we received a request to push that deadline back to July 1, 2017, of which
we granted.
We have now received a request to change the designated use of the donation. The VFW is asking that we use the
money to help purchase playground equipment at VFW Park instead of constructing a bathroom facility. City staff
feels this request is appropriate and is accepting of this request and that it may actually be a better use of the money.
Adopting the resolution would approve of these conditions.

RESOLUTION ACCEPTING A CHANGE IN DESIGNATED DONATION
WHEREAS, The City of Hutchinson is generally authorized to accept donations of real and
personal property pursuant to Minnesota Statutes Section 465.03 for the benefit of its citizens
and is specifically authorized to accept gifts and bequests for the benefit of recreational service
pursuant to Minnesota Statutes Section 471.17; and,
WHEREAS, the following organization has offered to contribute the cash amount set forth
below to the City of Hutchinson:

through Resolution 14510 on January 12, 2016 and amended by resolution 14582 on June 28,

construction of a bathroom at VFW Park and that the money is spent by July 1, 2017; and
WHEREAS, the construction of the bathroom at VFW Park has not taken place and plans to do
so are no longer in the works; and
WHEREAS, the VFW Post 906 has extended the offer to use the donated money to help
purchase new playground equipment at VFW Park; and
WHEREAS, City Staff feels this is an appropriate use of the money and will utilize the donated
money to make such a purchase by July 1, 2017; and
WHEREAS, the City Council hereby finds that it is appropriate to accept the donation offered
and use it to purchase playground equipment at VFW Park,
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HUTCHINSON, NHNNESOTA THAT the donation and proposed change in designated use
described above is hereby accepted by the City of Hutchinson with the conditions as laid out in
the resolution.

State law requires the City to adopt a data practices policy which guides both the City and members of the public in
obtaining information that the City retains. The data practices policy informs people of what type of information is
public and what is not, how to obtain that information and who is responsible for overseeing data that is kept by the
City.
State law also requires that the City adopt the data practices policy annually.
For your consideration and approval is the data practices policy for the City of Hutchinson. There is no proposed
change from the version we adopted last year.
I recommend adoption of the data practices policy.

Data Practices Policy for Data Subjects
Data about You
The Government Data Practices Act (Minnesota Statutes, Chapter 13) says that data subjects have
certain rights related to a government entity collecting, creating, and keeping government data about
them. You are the subject of data when you can be identified from the data. Government data is a term
that means all recorded information a government entity has, including paper, email, DVDs,
photographs, etc.
Classification of Data about You
The Government Data Practices Act presumes that all government data are public unless a state or
federal law says that the data are not public. Data about you are classified by state law as public,
private, or confidential. See below for some examples.
1. Public data: We must give public data to anyone who asks; it does not matter who is asking for
the data or why.
The following is an example of public data about you: the names of Minnesota government
employees
2. Private data: We cannot give private data to the general public, but you have access when the
data are about you. We can share your private data with you, with someone who has your
permission, with our government entity staff who need the data to do their work, and as
permitted by law or court order.
The following is an example of private data about you: Social Security numbers
3. Confidential data: Confidential data have the most protection. Neither the public nor you can
get access even when the confidential data are about you. We can share confidential data
about you with our government entity staff who need the data to do their work and to others as
permitted by law or court order. We cannot give you access to confidential data.
The following is an example of confidential data about you: the identity of the subject of an
active criminal investigation
Your Rights under the Government Data Practices Act
This government entity must keep all government data in a way that makes it easy for you to access
data about you. Also, we can collect and keep only those data about you that we need for administering
and managing programs that are permitted by law. As a data subject, you have the following rights.
• Access to Your Data
You have the right to look at (inspect), free of charge, public and private data that we keep
about you. You also have the right to get copies of public and private data about you. The

Government Data Practices Act allows us to charge for copies. You have the right to look at
data, free of charge, before deciding to request copies.
Also, if you ask, we will tell you whether we keep data about you and whether the data are

minor children (under the age of 18). As a legally appointed guardian, you have the right to look
at and get copies of public and private data about an individual for whom you are appointed
guardian.
Minors have the right to ask this government entity not to give data about them to their parent
or guardian. If you are a minor, we will tell you that you have this right. We may ask you to put
your request in writing and to include the reasons that we should deny your parents access to
the data. We will make the final decision about your request based on your best interests.
Note: Minors do not have this right if the data in question are educational data maintained by
an educational agency or institution.

The notice is sometimes called a Tennessen warning. The notice controls what we do with the
data that we collect from you. Usually, we can use and release the data only in the ways

different way, or if you ask us to release the data to another person. This permission is called
informed consent. If you want us to release data to another person, you must use the consent
form we provide.
• Protecting your Data
The Government Data Practices Act requires us to protect your data. We have established
appropriate safeguards to ensure that your data are safe.
In the unfortunate event that we determine a security breach has occurred and an unauthorized
person has gained access to your data, we will notify you as required by law.
When your Data are Inaccurate and/or Incomplete
You have the right to challenge the accuracy and/or completeness of public and private data
about you. You also have the right to appeal our decision. If you are a minor, your parent or
guardian has the right to challenge data about you.
How to Make a Request for Your Data
To look at data, or request copies of data that this government entity keeps about you, your minor
children, or an individual for whom you have been appointed legal guardian, make a written request.

BACKGROUND/EXPLANATION OF AGENDA ITEM:
Enclosed for your consideration is a new contract for prosecution services with the Gavin Law office in Glencoe. As
you know, their office has assisted the City of Hutchinson with prosecution services for many years. The contract is
now expired and needs to be renewed. In the proposed contract they are willing to perform up to 40 hours of
preparing criminal complaints, attendance at court hearings and other legal services for the amount of $3300 per
month. They have not increased their fees to the city since 2010.
I would add that the Gavin Law office has provided the City of Hutchinson with excellent service through the years. In
addition, they are one of the only law offices in the area experienced in the prosecution of criminal matters. In
addition, the State of Minnesota has gone to an all -electronic criminal charging system about a year ago and they are
one of the few law offices in our area that is equipped by and registered with the State of Minnesota for the electronic
processing of criminal complaints.
I recommend that you approve this contract. Ms.Jody Winters of the Gavin Law office will be in attendance to address
any questions you may have about their firms' proposal.

FEE AGREEMENT
This Agreement is made this 1 st day of January, 2017, at Hutchinson, Minnesota between
the City of Hutchinson, hereinafter called "Client" and Gavin, Winters & Long, Ltd., Attorneys
at Law, hereinafter called "Attorneys."
The Client has requested the Attorneys undertake legal prosecution services for criminal
cases for the Client at the direction and discretion of the Hutchinson City Attorney which will
include but is not limited to the following -
A. Prosecution of gross misdemeanor, misdemeanor and petty misdemeanor cases
including traffic violations, DWI cases, theft and code violations initiated by the
Hutchinson Police Department.
B. Prosecution of all gross misdemeanor, misdemeanor and petty misdemeanor cases
that occur in Hutchinson and initiated by the Minnesota State Highway Patrol.
C. Drafting complaints, representing the Client at court appearances which currently
include an assignment of 2-3 days per week plus jury trials. The court
appearances include omnibus hearings, pretrial conferences, court and jury trials
and post -conviction hearings.
D. Preparation of regular reports of prosecution activities and staff activities.
E. Being available to meet with the Chief of Police to review prosecution matters.
F. Advise and consult with City inspection staff regarding abatement of nuisances
and other city code violations.
G. Being available for meetings as directed by the Client.
The Attorneys have consented to accept this employment. Said services shall begin on
January 1, 2017.
It is agreed between the Client and Attorneys as follows:
1. The Attorneys agree to undertake the services rendered at a flat fee of $3,300.00
per month with the agreement that the hours of service will not exceed 40 hours per month. If
said services exceed 40 hours, the Client agrees to pay $125.00 per hour for the services
provided which exceed 40 hours. Compensation to be reviewed annually based upon workload.
2. Both the Attorneys and Client may terminate this agreement by 30 days written
notice, one to the other, of their intention to so terminate, except that the Client shall pay the
Attorneys for all Attorneys' fees and costs rendered to the date of termination according to said
agreement and the Client shall provide a substitute attorney to handle the pending prosecution
matters.

Parks, Recreation & Community Education Advisory Board
October 3, 2016
Members present were John Rodeberg, Marsha Anderson, Marlys Hoeft, Chad Czmowski, and
Mary Haugen. Also present were Dolf Moon, and Jody Harms.
The meeting was called to order at 5:15 pm by John Rodeberg.
A motion was made by Chad Czmowski to approve minutes from the June 7 meeting and was
seconded by Marlys Hoeft. The board unanimously agreed.
OLD BUSINESS
Aquatic Center Update:
• Mary Haugen gave an update on the progress and August flood of the center.
• The loss of the flooded pool was $640,000. Insurance covered all but the $25,000
deductible.
• Demo is complete on the damaged portion of the pool. Concrete will be poured
for the remaining two larger pools by the end of this week.
• Discussion on winter maintenance and needs.
• Locker rooms will be open around December 15 for the upcoming activities at the
recreation center.
State Baseball Tournament:
• Hutchinson hosted the State B Tournament from August 20 -September 5.
• Due to weather and wet fields, the first eight games were moved to Brownton.
• Attendance was the highest since 1988 at over15,000.
• Positive comments were shared regarding the playing field and spectator
visibility.
NEW BUSINESS
Program Numbers:
• Summer and fall participation numbers were shared with comparisons with 2015
programs.
Brochure Improvements:
• The PRCE brochure is now in all full color.

• They will be included in Advisory Board communications until the Mayor has
appointed new members.
Linden Park Pond:
• Due to frequent flooding a storm water pond may be installed on the north end of
Linden Park.
• A path, benches, and plants will be added.
• A turf area will remain on the south end. It will be able to accommodate one full
size soccer field or multiple fields for younger soccer players.
