Mayor Gary Forcier called the meeting to order. Members present were Chad Czmowski, Bill
Arndt, and Mary Christensen. Member absent was John Lofdahl. Others present were Matt
Jaunich, City Administrator, and Marc Sebora, City Attorney.

Council Member Arndt recognized the Hutchinson Police Department on the work they did
during the Orange Spectacular held this past weekend at the McLeod County Fairgrounds.
Council Member Arndt mentioned that people from all across the United States and Canada
were in attendance and he heard several positive comments about the City.

5. CITIZENS ADDRESSING THE CITY COUNCIL
Doreen Smithers, 526 Adams Street SE, presented before the Council. Ms. Smithers asked for
the Council's help in having the alley fixed behind her house. Ms. Smithers stated that the alley
has been a problem for years. Ms. Smithers stated she has replaced her garage door twice since
she purchased the home. Because the garage is so close to the alley, snow has beenpushed up
against it during snow plowing and ice has frozen the bottom of the garage door to the ground
due to water flow. Ms. Smithers has spoken to the previous mayor when he was in office, the
current mayor and the engineering department about this problem. Ms. Smithers stated that
engineering had informed her that the alley would be part of an improvement program, but thus
far it has not.
John Olson, Public Works Manager, presented before the Council. Mr. Olson noted that he and
Ms. Smithers have spoke in the past regarding the alley. Mr. Olson stated that the alley, along
with improvements to 5 Avenue Southeast, were scheduled to be improved, but because of

other projects and grant funding, the project has been pushed out. Mr. Olson spoke about issues
with the line in the area for p toper drainage. Mr. Olson talked about using the current drainage
system with a redesign to 5 Avenue to potentially take care of some issues. The cost of
installing the drain would be approximately $15,000-20,000. Mr. Jaunich talked about the
financing options available and the reasons that this project got pushed back.
The Council asked that public works explore different options to see what would be feasible in
the near future to alleviate this issue. Options could include asking the apartment complex
across the alley to put their drain spouts facing the street side instead of the alley side, look at
hard costs for the redesign system, etc.

9. APPROVE/DENY ADOPTION OF A MODIFICATION TO THE DEVELOPMENT
PROGRAM FOR DEVELOPMENT DISTRICT NO. 4, THE PROPOSED
ESTABLISHMENT OF TAX INCREMENT FINANCING DISTRICT NO. 4-18 WITHIN
DEVELOPMENT DISTRICT NO. 4 AND THE PROPOSED ADOPTION OF A TAX
INCREMENT FINANCING PLAN
Jean Ward, HRA Director, presented before the Council. Ms. Ward explained that the item
before the Council is to establish a TIF District for the new apartment complex being constructed
on Hwy 15 South. With the general occupancy apartment vacancy rate of less than 2%,
apartments are in short supply and new rental construction is badly needed to achieve a healthy
vacancy rate of 5%. Financing is needed to bridge the shortfall between the development costs
and the financing available to the project. A TIF district will allow the capture of property taxes
from the project to provide the financing to bridge that shortfall.
Nick Anhut, Ehlers & Associates, presented before the Council. Mr. Anhut explained that this
will be a housing district and will be governed by a development agreement. Mr. Anhut
explained the parameters that have been identified in the TIF document, such as the TIF district
collecting TIF dollars for 18 years. Mr. Anhut asked that the Council consider adoption of
Resolution No. 14590 adopting a modification to the development program for Development
District No. 4 and establishment of TIF District No. 4-18 and Resolution No. 14591 approving
the development agreement for TIF District No. 4 and TIF District No. 4-18.
Motion by Czmowski, second by Christensen, to close public hearing. Motion carried
unanimously.

Steve Kuepers, developer of apartment complex, presented before the Council. Mr. Kuepers
thanked the Council and staff for a great working relationship and he expressed his excitement in
the development. Work will begin in September.

10. PRESENTATION OF CITY OF HUTCHINSON FIVE-YEAR CAPITAL IMPROVEMENT
PLAN ACCORDING TO CITY CHARTER SECTION 7.05
Matt Jaunich, City Administrator, presented the proposed five-year capital improvement plan
as required by the Hutchinson City Charter. Mr. Jaunich noted that this is a preliminary plan
that includes road/infrastructure improvements, sewer/stormsewer, buildings, aquatic center
and Hwy 15. A more in depth workshop will be held in August regarding the plan. No
action required.

FRANCHISE TO CARIBOU COFFEE (FIRST READING, SET PUBLIC HEARING AND
SECOND READING AND ADOPTION FOR AUGUST 9, 2016)

Marc Sebora, City Attorney, presented before the Council. Mr. Sebora explained that as
part of the site plan and plat approval process, the plan includes using right of way along
Century Avenue for access and traffic flow. Because this is using city property, a franchise
agreement is required. One thing the Council will need to consider is whether or not a fee
should be charged to the applicant, either a one-time fee or an annual fee.
Motion by Christensen, second by Arndt, to set public hearing and approve first reading of
Ordinance 16-762 which includes a $50.00 franchise fee. Motion carried unanimously.
12. APPROVE/DENY PAVING PROJECT AT CREEKSIDE
Andy Kosek, Creekside Manager, presented before the Council. Mr. Kosek explained that
quotes have been received for pavement repair work at the Creekside Composting Facility.
Three areas have been identified to be repaired. In addition, a drainage pipe will be
installed that will run from a storm sewer catch basin to each corner of the tipping building.
The purpose of the pipe is to collect rain water run-off from the building's rain gutter
downspouts to prevent sub -grade saturation and heaving and potential cracking of the new
bituminous surfaces during freeze/thaw cycles. The low bid came in from Wm Mueller &
Sons in the amount of $76,575.05 which was considerably lower than estimated.
Motion by Czmowski, second by Arndt, to approve paving project at Creekside. Motion
carried unanimously.
Mr. Kosek provided a brief update on activities occurring at the facility.
13. APPROVE/DENY PUBLIC WORKS EQUIPMENT ACQUISITIONS

John Olson, Public Works Manager, presented before the Council. Mr. Olson explained that
the wheel loader transaction will be considered a 2-for-1. The proposed transaction reduces
the number of wheel loaders from eight to six. Reduction of the loader fleet has been made
possible by utilizing tractors rented for the residential leaf vacuum service, up -fitting them
with snowplows. Included with this purchase will be an HLA plow. The current loader -
mounted snow blower is now 25 years old. The current snow blower has reached the end of
its service life. The loader -mount snow blower has a cost of $98,175.00; the wheel loader
with snow equipment has a cost of $122,499.00; and the HLA snow wing snowplow has a
cost of $13,562.43. Funding sources come from the debt management plan.
Motion by Czmowski, second by Christensen, to approve public works equipment
acquisitions as described above. Motion carried unanimously.

Marc Sebora, City Attorney, presented before the Council. Mr. Sebora explained that
earlier this year, the Council passed an ordinance amending the Charter changing the
mayoral terms from two years to four years and requested that the language change be put
forth before the voters at the November election. Mr. Sebora noted a minor typographical
error in the ballot language that was changed.
Motion by Czmowski, second by Christensen, to approve Resolution No. 14589. Motion
carried unanimously.
15. APPROVE/DENY SETTING COUNCIL BUDGET WORKSHOP FOR AUGUST 23,
2016, AT 4:00 P.M.
Matt Jaunich noted that this will be the annual workshop to review the CIP and review
preliminary budget numbers. There will also be an update from the Coalition of Greater
Minnesota Cities during the workshop.
Motion by Czmowski, second by Arndt, to approve setting Council budget workshop for
August 23, 2016, at 4:00 p.m. Motion carried unanimously.
16. APPROVE/DENY SETTING AUGUST 12, 2016, TO CANVASS PRIMARY ELECTION
RESULTS
Matt Jaunich noted that three days following the election, the Council must canvass the City
election results.

MISCELLANEOUS
18. STAFF UPDATES
John Olson — Mr. Olson provided a project update. Madson Avenue is having utility work
completed currently; Milwaukee Avenue has been paved with backfilling and restoration being
completed, the same as Linden Avenue (east of Lynn Road); utility work is beginning
tomorrow on Linden Avenue (west of Lynn Road); Church Street utility work will be
coordinated with Linden Avenue work. All projects are pretty close to schedule and not delayed

too much. Parking lot behind Main Street $ports Bar has been improved as well as the trail area
near SuperAmerica on Hwy 7 West. 3r Avenue SE old alley panel has been restored to
parking.
Mr. Olson explained that at the end of May/early June two mosquito traps are put in place that
monitor the populations. The numbers are not dramatically high but are consistently high,
especially with higher rains and warmer temperatures. A second count is then taken in July.
Two more applications are scheduled this season per the contract, however staff will determine
if more applications will be needed with some of the activities that are occurring within the city
later in the summer.
Matt Jaunich — Mr. Jaunich reminded the Council that the August 9th meeting begins at 4:00
p.m. due to the primary election. The City has been selected as a finalist for First Annual Clean
Energy Program award and the award will be presented at the State Fair on August 28, 2016.
Mr. Jaunich noted that a study will be completed on the water bodies in Hutchinson. The study
will review upgrades and improvements to potentially be made. Mr. Jaunich asked for two
council members to sit on the steering committee for this project. Mayor Forcier noted he
would be interested and it was mentioned that Council Member Lofdahl may be interested. If
Council Member Lofdahl is not interested, Council Member Christensen stated she would serve
on the steering committee.
19. COUNCIL/MAYOR UPDATE
Bill Arndt — Council Member Arndt mentioned that National Night Out is scheduled for August
2nd and is a great time to meet your neighbors.
Mary Christensen — Council Member Christensen commented on the joint meetings that
Council had last week with EDA and the McLeod County Commissioners. She noted how
beneficial both of those meetings were and she hopes they continually annually.

Call to Order
The joint meeting was called to order at 11:30 a.m. by Mayor Forcier and Jonny
Block. Members present were: Mayor Gary Forcier, Council Member Chad
Czmowski, Council Member Mary Christensen, Council Member John Lofdahl,
Council Member Bill Arndt, EDA Board Member Mike Cannon, EDA Board Member
Corey Stearns, EDA Board Member Daron VanderHeiden, and EDA President Jonny
Block. Others present were Matt Jaunich, City Administrator, Miles Seppelt, EDA
Director and Marc Sebora, City Attorney.

Miles Seppelt, EDA Director, presented before the group. Mr. Seppelt reviewed the
EDA's marketing initiative which includes Business Climate Minnesota which was
launched six month ago. It is print material that is distributed throughout the state.
Mr. Seppelt also spoke about the EDA's web site and the social media avenues that
the EDA uses to get information out. Lastly, Mr. Seppelt talked about the
Manufacturer's Summit that was held last February with local manufacturing
companies.
B. Business Recruitment Update
Mr. Seppelt noted that an interested party may be very close to buying/investing in the
building for sale on the HTI property. He also noted that a current business has
spoken to him about a potential significant expansion. Mr. Seppelt explained that the
current businesses in the city are all maintaining a high level of busyness.

Mr. Seppelt reviewed various ongoing/incoming projects. These projects include the
hotel project at the intersection of Hwy 15/Hwy 7 which could potentially move forward
in the Fall of 2016; old medical clinic site on Franklin Street which could potentially
have a project in 2017; signage and wayfinding master plan which will be instituted in
August/September this year; Farmer's Market which includes the depot and its
amenities as well as the large number of vendors and patrons that attend the
Farmer's Market underneath the pavilion and a new program called Power of
Produce Kids' Club.
D. Hutchinson Enterprise Center Update
Miles Seppelt noted that he is hoping the ground breaking will occur in early October
with the project completed by June 1, 2017. Mr. Seppelt noted he has one committed
tenant so far with another tenant in the works.
E. Skilled Workforce Development Update
Because of the shortage of the skilled workforce, the EDA has partnered with the
school district, Ridgewater College and local industry to help with this shortage
challenge. The goal of the program is to build a talent pipeline from school to
industry. Currently, certain skilled courses have peaked in areas such as welding,
woods and drafting. With this, the technical area at the high school is getting a
complete upgrade with very high-tech equipment being put in place. 19 local partners
have contributed to this project so far.
IV. Business Climate in Hutchinson/City Council Items for EDA Board to Consider
Mayor Forcer asked if the EDA could provide a monthly email update to council
members on hot topics.

JULY 21, 2016
Mayor Gary Forcier called the joint City Council/County Board meeting to order at 12:15 p.m.
Members Present: Mayor Gary Forcier, Council Member Mary Christensen, Council Member
Bill Arndt, Council Member John Lofdahl, Council Member Chad Czmowski, Commissioner Paul
Wright, Commissioner Joe Nagel, Commissioner Sheldon Nies, Commissioner Doug Krueger,
Commissioner Ron Shimanski, City Administrator Matt Jaunich, County Administrator Pat

Staff Present: Marc Sebora, Mike Schumann, Dan Jochum
Matt Jaunich, City Administrator, provided a State of the City presentation to the group.
Information contained in the presentation included unemployment rates, rental/housing data,
building permit/construction data, new developments (aquatic center, apartment complex on
Denver Avenue, ALDIs/Pizza Ranch, Caribou Coffee/Einstein Bagel Shop, hotel at Hwy 15/Hwy 7,
old medical clinic site, enterprise center for business incubation), and business attraction
efforts.
Questions were asked regarding staffing levels for the City. Mr. Jaunich explained that the
City's workforce was reduced significantly in the mid/late-2000s. A few positions have been
added in the last couple of years but not to the level previously. The police department has
recurring staffing shortages and the parks department works with a very lean staff. The aquatic
center will be run by seasonal employees and will require more staff than previously.
Mr. Jaunich also noted that the City is in the middle of an intensive comprehensive job study as
well which was last conducted approximately 10-15 years ago.
Paul Wright, County Board Chair, presented before the group. Mr. Wright provided an update
on various activities occurring within the county such as the county jail remodel, improvements
at the solid waste facility, fairgrounds activities, compensation study/restructuring, land values,
and first-ever solar garden. Mr. Wright also spoke about the recycling efforts and the materials
that can be used for new products. Commissioner Nagel spoke about the restructuring efforts
that have been tasked to the county administrator.
General discussion was held regarding Trailblazer Transit services and the possibility of a
designated bus service. The group spoke of positives and negatives that this type of service will
bring to constituents.
Commissioner Shimanski brought up the topic of shared dispatch services. Mr. Jaunich noted
that the Hutchinson dispatch center had received grant funds for an equipment upgrade years
ago and the center will need to be operated independently until 2020. Mayor Forcier noted
that as 2020 nears closer, Hutchinson will study the feasibility of sharing this service between
the two entities. Details will need to be determined about the type of facility and staffing that
would be housed in Hutchinson if the dispatch center would be relocated.
Mr. Jaunich then opened the discussion up regarding current shared services and joint ventures
between the county and the city. Mr. Jaunich distributed a list of the services currently shared.
Council Member Arndt suggested the entities working together to improve the Crow River and
watershed. Mr. Jaunich noted that he just recently authorized a study to be completed on the
lakes in Hutchinson that lead to the river to see if there are things that can be done to improve
situations. Commissioner Krueger mentioned that One Watershed, One Plan would be a good
organization for a city representative to sit on. Commissioner Wright spoke of work being done
on some local lakes that has been achieved through legacy grant funds that Ducks Unlimited
has acquired.
Mr. Jaunich brought up the topic of the grinder used at Creekside which was originally
purchased jointly with the county. The grinder is near the end of its life and decisions will need
to be made on whether or not to replace the equipment and if it is replaced, how it will be
funded. Mr. Jaunich noted that the grinder would work well for the county's ag bag grinding
operation. The grinder is scheduled on the City's CIP plan for replacement in 2017.
(Council Member Czmowski left the joint meeting at 1:30 p.m.)
Discussion was held on the current use of the grinder which is provided for free to other cities
in the county for yard waste grinding. Both entities want to keep communication open about
partnering together on the future use of a new grinder.
Mr. Jaunich also mentioned marketing of facilities within Hutchinson that could be done jointly,
such as the fairgrounds with the various amounts of tournaments that are held.
Mr. Melvin spoke of the McLeod for Tomorrow program that many City and County employees
have attended and graduated from. Mr. Melvin mentioned the Chamber of Commerce's
Leadership Program which is more Hutchinson -centered where McLeod For Tomorrow is more
McLeod County -centered. He asked if there is a way that those two groups could get together
to maybe integrate the two in some capacity. It was noted that the Chamber Director could be
contacted to work with the McLeod For Tomorrow coordinator.
Mr. Jaunich also noted that he and Mr. Melvin have discussed potentially holding a bi-annual
City/County meeting of all elected bodies. Additionally, Mr. Melvin noted that the McLeod
County Wellness Coordinator will be holding a meeting with all cities to see how partnerships
could be had for City wellness programs.
Council Member Arndt asked for the County Board's assistance in working with the Winsted
Airport and the Luce Line Trail to help with maintenance and signage.
Joint Planning Board — It was suggested that a subcommittee of the County Board and City
Council meet to work out issues of the joint planning board. Dan Jochum noted that this would
be considered in the early part of 2017.
It was also noted that the topic of the grinder would be discussed early next week at a County
Board meeting.
In addition, improvements to the Crow River will stay on the radar of both entities.
Commissioner Wright spoke of McKewon Creek which is a courseway to get to Crow River. This
area needs to be cleaned out, which comes at a cost of approximately $150,000. This area
floods out when parking lots drain out and the question that will be raised is how much is the
City willing to contribute towards the cleanout costs? Commissioner Wright spoke of a formula
to use to apportion out payment.

The CrossPoint Church (1215 Roberts Rd SW) has requested authorization to set up barricades to block traffic flow
in front of the church during a Block Party on Sunday August 28, 2016.
Our specific request is for the section of Roberts Road between School Road and Boulder Street be blocked off from
11:30-3:30 pm on Sunday, August 28, 2016.
The reason for our request is that they will be hosting a car show, as well as all of our parking for the church and
event in the high school parking lot. There will be a significant amount of foot traffic between the school parking lot
and our church's outdoor space during the block party.
The Hutchinson Police has reviewed and approves of the plan. They have also reviewed this request with the
Hutchinson School District to ensure traffic flow in to the High School parking would be accessible from School Rd
with the pending construction project on that site.

FACTS
1. Carlton Holdings I, LLC, is the owner of a parcel of land located at 1315 Montreal St. S.E.,
Hutchinson Minnesota; and,
2. The subject property is legally described as:
Calaford Place Outlot B.
Kuepers Architects and Builders, has applied to the City for a site plan review, preliminary and final
plat at 1315 Montreal St. S.E., Hutchinson MN.
4. The Planning Commission met on June 21, 2016, and reviewed the proposed site plan, preliminary
and final plat and hereby recommends approval of the request subject to the following findings and
conditions:
a. The proposed building and site improvements shall comply with the standards of the C-4
district and the Zoning Ordinance, as well as all other City regulations.
b. Any reconstruction of existing infrastructure within City of Hutchinson easement areas shall be
the developer's responsibility, including improvements and associated costs. This work shall
meet all of the City's engineering standards and be approved by the City.
c. There must be emergency service access around the building that meets the fire code. Fire
hydrants must be located no farther than 400 feet from the building.
d. Exterior refuse collection area must be fully screened.
e. Moving or relocating utility services will be at the property owner's expense.
f. SAC/WAC charges will be due at the time building permits are issued.
g. A parkland contribution fee will be collected with the building permit.
h. The City of Hutchinson must approve a traffic control plan prior to any construction activity
impacting Montreal St. SE or Denver Avenue SE. The City of Hutchinson must be notified 7
days prior to any roadway or utility work that is going to be done within the City right of way.
All roadway work must be fully completed to City standards within 10 calendar days of the
original disturbance. If the work isn't fully completed within 10 calendar days, the City
reserves the right to have the work completed and invoice/assess the property owner for all
associated costs.
i. Any reconstruction of existing infrastructure within City of Hutchinson easement areas or
right-of-way shall be the developer's responsibility, including improvements and associated
costs. This work shall meet all of the City's engineering standards and be approved by the City.
j . The play area must be constructed and maintained as noted on the site plan.

BACKGROUND/EXPLANATION OF AGENDA ITEM:
Sara Pollmann of Zellas Company has submitted an on-sale/Sunday liquor license application to provide liquor at an
establishment located at 14 Main Street South. Ms. Pollmann and her husband are the new owners of Zella's
restaurant which is currently in that same location. City code requires that a public hearing be held when a new liquor
license is applied for. Since this is an establishment under new ownership, a public hearing is required.

At the June 14, 2016, City Council meeting, the City Council approved the site plan and other documents for Caribou
Coffee/Einstein Bagels to be located on the southwest corner of Century Avenue and Highway 15. The site plan for
Caribou Coffee included the use of a portion of the City's right-of-way along Century Avenue for access and traffic
flow around the new Caribou Coffee building.
Attached for your consideration is a franchise agreement between the City of Hutchinson and 1100 Highway 15 S,
LLC, the owner of the Caribou Coffee business, which would allow Caribou Coffee to utilize city right-of-way for these
purposes. The main components of the franchise agreement are:
• a term of 20 years
• liability insurance to be provided by 1100 Highway 15 S, LLC in the amount of $1.5 million per occurrence
• the franchise is revoked should 1100 Highway 15 S, LLC cease to do business on the property for a year or more
• the franchise must be recorded at the McLeod County Recorder's office
At the last Council meeting and the first reading of this ordinance, the Council voted to add a $50.00 franchise fee.
That fee has been included in the proposed franchise agreement.

AN ORDINANCE OF THE CITY OF HUTCHINSON, MINNESOTA, GRANTING
1100 HIGHWAY 15 S, LLC THE RIGHT TO ENCROACH IN PUBLIC RIGHT OF WAY ON
CENTURY AVENUE, EAST OF STATE HIGHWAY NO. 15
THE CITY OF HUTCHINSON ORDAINS:
Section 1. The City of Hutchinson, in the County of McLeod, State of Minnesota,
hereafter referred to as Grantor, hereby grants 1100 Highway 15 S, LLC, a Minnesota limited
liability company, hereafter referred to as Grantee, a franchise to place and construct certain
drive aisles into the right of way of Century Avenue, as drawn in Exhibit A, on certain property
owned by the City of Hutchinson, described as follows:

Section 2. The franchise is granted for a term of 20 years commencing on the date of
the acceptance of the franchise. Grantee shall file a written acceptance of the franchise with the
City Administrator of the City of Hutchinson within thirty (30) days after the effective date of
this ordinance. The franchise shall become effective only when the acceptance has been filed
and evidence of the general liability insurance to be maintained by Grantee, as provided for in
this grant of franchise, has been delivered to the City of Hutchinson. In addition, an annual fee
of $50.00 per year must be paid.
Section 3. Grantor reserves the right to enforce reasonable regulations concerning
construction, operation and maintenance of facilities located along, over and under the public
premises before mentioned and the placement of such facilities.
Section 4. Grantee shall indemnify and defend Grantor, its boards, commissions,
officers, agents and employees, in any and all other public agencies, and their members, officers,
agent and employees (the "Indemnified Parties"), against any and all liabilities for injury to or
death of any person or any damage to any property caused by Grantee, its officers, agents or
employees in the construction, operation or maintenance of its property, or arising out of the
exercise of any right or privilege under the franchise, but specifically excluding all liabilities
caused by or attributable to the gross negligence or willful misconduct of Grantor or any other
Indemnified Party.
Section 5. At all times during the term of the franchise, Grantee will, at its own
expense, maintain in force general liability insurance, with an insurance company and with
policy limits approved by the City of Hutchinson of not less than $1,500,000.00 per occurrence
which approval shall not be unreasonably withheld, conditioned or delayed, such policies, being
for the protection of Grantor and its officers, agents and employees, against liability for loss or
damage for bodily injury, death or property damage occasioned by the activities of the grantee
under the franchise, shall name the City of Hutchinson as an additional insured.

Section 6. Grantee shall not have the right to assign the franchise or otherwise
transfer it in any manner whatsoever or sell, lease, license, mortgage or permit others to use in
any manner whatsoever any interest in all or any part of its facilities that are installed or operated
under this grant, except on prior written approval by ordinance of the City Council of the City of
Hutchinson. Notwithstanding the foregoing, any tenant of the improvements now or hereafter
located on Grantee's property (including, without limitation, Caribou Coffee & Einstein Bros.
Bagels), and their customers and invitees, shall be entitled to utilize any and all rights available
to Grantee under the franchise.
Section 7. In the event that 1100 Highway 15 S, LLC should cease to exist or should
fail to use the franchise for one consecutive calendar year, this franchise shall be deemed null
and void and shall revert to the City of Hutchinson without any action on the part of the City of
Hutchinson whatsoever.
Section 8. The City may at the point of expiration of this franchise request that the
encroachments be removed form the rights of way at the Grantee's expense.
Section 9. 1100 Highway 15 S, LLC shall record this franchise agreement with the
McLeod county Recorder's office within 30 of its acceptance by 1100 Highway 15 S, LLC.
Section 10. This ordinance shall take effect from and after passage and publication,
subject to the provision above requiring written acceptance by 1100 Highway 15 S, LLC.

The Planning Commission met on July 26, 2016 and discussed the new law the State passed regarding Temporary
Family Health Care Dwellings. The dwellings are accessory structures similar to "tiny homes" and are also known as
"granny pods" and would be allowed as accessory structures on properties unless the City opts out of the law, as was
outlined in the legislation.
The Planning Commission discussed this issue and felt that there were a lot of unanswered questions regarding the
impact these dwellings could have on a neighborhood. Staff also noted that they have never had any questions about
these types of structures so is there really a demand from the public for them? There were also many questions
regarding how these structures would be served by electric, water, sewer, etc. Because of these questions and the
apparent lack of demand for these type of structures the Planning Commission voted to unanimously recommend to
the City Council that the City pass an ordinance opting out of the temporary family health care dwelling provisions that
was signed into law on May 12, 2016. It should also be noted that the vast majority (95%) of Cities that participated in
an informal survey with the Minnesota City Managers Association indicated they planned on opting out of this law.

Temporary Family Health Care Dwellings of 2016
Allowing Temporary Structures — What it means for Cities
Introduction:
On May 12, 2016, Gov. Dayton signed, into law, a bill creating a new process for landowners to
place mobile residential dwellings on their property to serve as a temporary family health care
dwelling.' Community desire to provide transitional housing for those with mental or physical
impairments and the increased need for short term care for aging family members served as the
catalysts behind the legislature taking on this initiative. The resulting legislation sets forth a short
term care alternative for a "mentally or physically impaired person", by allowing them to stay in a
"temporary dwelling" on a relative's or caregiver's property.2
Where can I read the new law?
Until the state statutes are revised to include bills passed this session, cities can find this new bill at
2016 Laws, Chapter 111.
Does the law require cities to follow and implement the new temporary family
health care dwelling law?
Yes, unless a city opts out of the new law or currently allows temporary family health care
dwellings as a permitted use.
Considerations for cities regarding the opt -out?
These new temporary dwellings address an emerging community need to provide more convenient
temporary care. When analyzing whether or not to opt out, cities may want to consider that:
• The new law alters a city's level of zoning authority for these types of structures.
• While the city's zoning ordinances for accessories or recreational vehicles do not apply,
these structures still must comply with setback requirements.
• A city's zoning and other ordinances, other than its accessory use or recreational vehicle
ordinances, still apply to these structures. Because conflicts may arise between the statute
and a city's local ordinances, cities should confer with their city attorneys to analyze their
current ordinances in light of the new law.

Although not necessarily a legal issue for the city, it seems worth mentioning that the
permit process does not have the individual with the physical or mental impairment or that
individual's power of attorney sign the permit application or a consent to release his or her
data.
The application's data requirements may result in the city possessing and maintaining
nonpublic data governed by the Minnesota Government Data Practices Act.
The new law sets forth a permitting system for both cities and counties3. Cities should
consider whether there is an interplay between these two statutes.
Do cities need to do anything to have the new law apply in their city?
No, the law goes into effect Sept. 1, 2016 and automatically applies to all cities that do not opt out
or don't already allow temporary family health care dwellings as a permitted use under their local
ordinances.
Do cities lose the option to opt out after the Sept. 1, 2016 effective date?
No, the law does not set a deadline for opting out, so cities can opt out after Sept. 1, 2016.
However, if the city has not opted out by Sept. 1, 2016, then the city must not only have
determined a permit fee amount before that date (if the city wants to have an amount different
than the law's default amount), but also must be ready on that date to accept applications and
process the permits in accordance with the short timeline required by the law. Cities should consult
their city attorney to analyze how to handle applications submitted after Sept. 1, 2016, but still
pending at the time of a later opt out.
What if a city already allows a temporary family health care dwelling as a
permitted use?
If the city already has designated temporary family health care dwellings as a permitted use, then
the law does not apply and the city follows its own ordinance. The city should consult its city
attorney for any uncertainty about whether structures currently permitted under existing ordinances
qualify as temporary family health care dwellings.
What process should the city follow if it chooses to opt out of this statute?
Cities that wish to opt out of this law must pass an ordinance to do so. The statute does not provide
clear guidance on how to treat this opt -out ordinance. However, since the new law adds section
462.3593 to the land use planning act (Minn. Stat. ch. 462), arguably, it may represent the adoption
or an amendment of a zoning ordinance, triggering the requirements of Minn. Stat. § 462.357,
subd. 2-4, including a public hearing with 10 -day published notice. Therefore, cities may want to
err on the side of caution and treat the opt -out ordinance as a zoning provisions

Can cities partially opt out of the temporary family health care dwelling law?
Not likely. The opt -out language of the statute allows a city, by ordinance, to opt out of the
requirements of the law but makes no reference to opting out of parts of the law. If a city wanted a
program different from the one specified in statute, the most conservative approach would be to
opt out of the statute, then adopt an ordinance structured in the manner best suited to the city.
Since the law does not explicitly provide for a partial opt out, cites wanting to just partially opt out
from the statute should consult their city attorney.
Can a city adopt pieces of this program or change the requirements listed in the
statute?
Similar to the answer about partially opting out, the law does not specifically authorize a city to
alter the statutory requirements or adopt only just pieces of the statute. Several cities have asked if
they could add additional criteria, like regulating placement on driveways, specific lot size limits,
or anchoring requirements. As mentioned above, if a city wants a program different from the one
specified in the statute, the most conservative approach would involve opting out of the statute in
its entirety and then adopting an ordinance structured in the manner best suited to the city. Again, a
city should consult its city attorney when considering adopting an altered version of the state law.
What is required in an application for a temporary family health care dwelling
permit?
The mandatory application requests very specific information including, but not limited to:6
• Name, address, and telephone number of the property owner, the resident of the property
(if different than the owner), and the primary care giver;
• Name of the mentally or physically impaired person;
• Proof of care from a provider network, including respite care, primary care or remote
monitoring;
Written certification signed by a Minnesota licensed physician, physician assistant or
advanced practice registered nurse that the individual with the mental or physical
impairment needs assistance performing two or more "instrumental activities of daily
life;"7

communities.

preparation; basic assistance with paying bills; shopping for food, clothing, and other essential items; performing
household tasks integral to the personal care assistance services; communication by telephone and other media; and
traveling, including to medical appointments and to participate in the community."

• An executed contract for septic sewer management or other proof of adequate septic sewer
management;
• An affidavit that the applicant provided notice to adjacent property owners and residents;
• A general site map showing the location of the temporary dwelling and the other structures
on the lot; and
• Compliance with setbacks and maximum floor area requirements of primary structure.
The law requires all of the following to sign the application: the primary caregiver, the owner of
the property (on which the temporary dwelling will be located) and the resident of the property (if
not the same as the property owner). However, neither the physically disabled or mentally
impaired individual nor his or her power of attorney signs the application.
Who can host a temporary family health care dwelling?
Placement of a temporary family health care dwelling can only be on the property where a
"caregiver" or "relative" resides. The statute defines caregiver as "an individual, 18 years of age or
older, who: (1) provides care for a mentally or physically impaired person; and (2) is a relative,
legal guardian, or health care agent of the mentally or physically impaired person for whom the
individual is caring." The definition of "relative" includes "a spouse, parent, grandparent, child,
grandchild, sibling, uncle, aunt, nephew or niece of the mentally or physically impaired person.
Relative also includes half, step and in-law relationships."
Is this program just for the elderly?
No. The legislature did not include an age requirement for the mentally or physically impaired
dweller. 8
Who can live in a temporary family health care dwelling and for how long?
The permit for a temporary health care dwelling must name the person eligible to reside in the unit.
The law requires the person residing in the dwelling to qualify as "mentally or physically
impaired," defined as "a person who is a resident of this state and who requires assistance with two
or more instrumental activities of daily living as certified by a physician, a physician assistant, or
an advanced practice registered nurse, licenses to practice in this state." The law specifically limits
the time frame for these temporary dwellings permits to 6 months, with a one-time 6 month
renewal option. Further, there can be only one dwelling per lot and only one dweller who resides
within the temporary dwelling

What structures qualify as temporary family health care dwellings under the new
law?
The specific structural requirements set forth in the law preclude using pop up campers on the
driveway or the "granny flat" with its own foundation as a temporary structure. Qualifying
temporary structures must:
• Primarily be pre -assembled;
• Cannot exceed 300 gross square feet;
• Cannot attach to a permanent foundation;
• Must be universally designed and meet state accessibility standards;
• Must provide access to water and electrical utilities (by connecting to principal dwelling or
by other comparable means 9);
• Must have compatible standard residential construction exterior materials;
• Must have minimum insulation of R-15;
• Must be portable (as defined by statute);
• Must comply with Minnesota Rules chapter 1360 (prefabricated buildings) or 1361
(industrialized/modular buildings), "and contain an Industrialized Buildings Commission
seal and data plate or to American National Standards Institute Code 119.2" 10; and
• Must contain a backflow check valve. I I
Does the State Building Code apply to the construction of a temporary family
health care dwelling?
Mostly, no. These structures must meet accessibility standards (which are in the State Building
Code). The primary types of dwellings proposed fall within the classification of recreational
vehicles, to which the State Building Code does not apply. Two other options exist, however, for
these types of dwellings. If these structures represent a pre -fabricated home, the federal building
code requirements for manufactured homes apply (as stated in Minnesota Rules, Chapter 1360). If
these structures are modular homes, on the other hand, they must be constructed consistent with
the State Building Code (as stated in Minnesota Rules, Chapter 1361).
What health, safety and welfare requirements does this new law include?
Aside from the construction requirements of the unit, the temporary family health care dwelling
must be located in an area on the property where "septic services and emergency vehicles can gain
access to the temporary family health care dwelling in a safe and timely manner."
What local ordinances and zoning apply to a temporary health care dwelling?
The new law states that ordinances related to accessory uses and recreational vehicle storage and
parking do not apply to these temporary family health care dwellings.

However, unless otherwise provided, setbacks and other local ordinances, charter provisions, and
applicable state laws still apply. Because conflicts may arise between the statute and one or more
of the city's other local ordinances, cities should confer with their city attorneys to analyze their
current ordinances in light of the new law.
What permit process should cities follow for these permits?
The law creates a new type of expedited permit process. The permit approval process found in
Minn. Stat. § 15.99 generally applies; however, the new law shortens the time frame within which
the local governmental unit can make a decision on the permit. Due to the time sensitive nature of
issuing a temporary dwelling permit, the city does not have to hold a public hearing on the
application and has only 15 days (rather than 60 days) to either issue or deny a permit. For those
councils that regularly meet only once a month, the law provides for a 30 -day decision. The law
specifically prohibits cities from extending the time for making a decision on the permit
application. The new law allows the clock to restart if a city deems an application incomplete, but
the city must provide the applicant written notice within five business days of receipt of the
application identifying the missing information.
Can cities collect fees for these permits?
Cities have flexibility as to amounts of the permit fee. The law sets the fee at $100 for the initial
permit with a $50 renewal fee, unless a city provides otherwise by ordinance
Can cities inspect, enforce and ultimately revoke these permits?
Yes, but only if the permit holder violates the requirements of the law. The statute allows for the
city to require the permit holder to provide evidence of compliance and also authorizes the city to
inspect the temporary dwelling at times convenient to the caregiver to determine compliance. The
permit holder then has sixty (60) days from the date of revocation to remove the temporary family
health care dwelling. The law does not address appeals of a revocation.
How should cities handle data it acquires from these permits?
The application data may result in the city possessing and maintaining nonpublic data governed by
the Minnesota Government Data Practices Act. To minimize collection of protected heath data or
other nonpublic data, the city could, for example, request that the required certification of need
simply state "that the person who will reside in the temporary family health care dwelling needs
assistance with two or more instrumental activities of daily living", without including in that
certification data or information about the specific reasons for the assistance, the types of
assistance, the medical conditions or the treatment plans of the person with the mental illness or
physical disability. Because of the complexities surrounding nonpublic data, cities should consult
their city attorneys when drafting a permit application.
Should the city consult its city attorney?
Yes. As with any new law, to determine the potential impact on cities, the League recommends
consulting with your city attorney.

WHEREAS, on May 12, 2016, Governor Dayton signed into law the creation and
regulation of temporary family health care dwellings, codified at Minn. Stat. §462.3593, which
permit and regulate temporary family health care dwellings;
WHEREAS, subdivision 9 of Minn. Stat. §462.3593 allows cities to "opt out" of those
regulations;
NOW THEREFORE the City Council of the City of Hutchinson, Minnesota, hereby ordains:
OPT -OUT OF MINNESOTA STATUTES, SECTION 462.3593:
SECTION 154.026(I). Pursuant to authority granted by Minnesota Statutes, Section 462.3593,
subdivision 9, the City of Hutchinson opts -out of the requirements of Minn. Stat. §462.3593,
which defines and regulates Temporary Family Health Care Dwellings.
This ordinance shall be effective immediately upon its passage and publication.

§ 154.026 ACCESSORY BUILDINGS.
(A) No accessory buildings shall be erected or located within any required side yard
setback, except as provided in §§ 154.056 and 154.057 of this chapter, for R-1 and R-2 Districts.
(B) Utility buildings in residential districts shall not exceed 200 square feet and shall
be six feet or more from all lot lines of adjoining lots, and shall not be located within a utility
easement.
(C) No accessory building or garage per single-family homes shall occupy more than
25% of a rear yard, nor exceed 1,000 square feet of floor area. All new homes shall either have
an attached or detached garage of at least 400 square feet. Garages less than 400 square feet, but
larger than 240 square feet, are allowed by conditional use permit. Garages less than 240 square
feet are not allowed. Garages between 1.000 square feet and 1,500 square feet may be allowed
with a conditional use permit if they do not occupy more than 25% of the rear yard. Garages
larger than 1,500 square feet are not allowed in residential zoning districts.
(D) No permit shall be issued for the construction of more than one accessory
detached private garage structure for each dwelling.
(E) No accessory building or use shall be constructed or developed on a lot prior to
the time of construction of the principal building to which it is accessory, except by conditional
use permit.
(F) Accessory buildings in all districts shall be located to the rear of the principal
building.
(G) No accessory building in a commercial or industry district shall exceed the height
of the principal building, except by conditional use permit.
(H) Utility sheds in residential districts which have floor areas greater than 200 square
feet shall have a floating concrete slab. Only one utility shed per home is permitted.
(I) Pole buildings shall be permitted only if siding and roofing in building materials
are similar to the principal structure. Pole buildings are allowed only by conditional use permit.
(J) Unattached garages require direct access by public way or in cases of interior lots,
a side yard drive setback dimension no less than ten feet between the property line and the
principal structure. Direct access to the public right-of-way is not permitted through the rear or
side yard of double frontage lots located on any collectors or arterial roadways, except for
properties platted prior to 1988.
(K) Pursuant to authority granted by Minnesota Statutes, Section 462.3593,

Nick Anhut from Ehlers will present the 2016 pre-sale report for the issuance of G.O. Improvement Bonds with a par
value of $4,010,000.
The City of Hutchinson issues 429 General Obligation Improvement Bonds on an annual basis to finance major
infrastructure capital expenditure projects. The first step in this process is for council to authorize a resolution to move
forward with providing a bond issuance to finance the capital expenditures.
Once the resolution is approved, Ehlers, who is the City's financial advisor, will initiate the process. Ehlers will
compile documents with city staff assistance, coordinate a bond rating call and solicit competitive bids on behalf of the
City of Hutchinson. The proposed Debt Issuance Schedule is provided in the Pre-Sale Report which accompanies this
board action form. The bond sale will be awarded to the winning bidder at the September 13th council meeting and
the bond proceeds are expected to be received in early October.
The 2016 bonding includes the following components:
1) 2016 Pavement Management Program ($2,520,000 par value; 15 year debt service)
2) 2016/2017 Heavy Equipment needs ($1,490,000 par value; 5 year debt service)

Executive Summary of Proposed Debt
Proposed Issue:
$4,010,000 General Obligation Bonds, Series 2016A
Purposes:
The proposed issue includes financing for the following purposes (amount
includes project and financing costs):
• $2,520,000 Improvement Portion to finance the City's 2016 pavement
management program. Debt service will be paid from a combination of
$626,183 in special assessments levied for collection from 2017 to 2026,
and an ad valorem property tax levy levied for collection from 2017 to
2031.
• $1,490,000 Equipment Portion. Debt service will be paid from ad valorem
property taxes levied for collection from 2017 to 2021. Payments are
structured to replace expiring debt to keep the City's overall debt service
tax levy flat during this period.
Authority:
The Bonds are being issued pursuant to Minnesota Statutes, Chapters 412,
429, and 475.
The City has held the required public hearings and is under the maximum
amount of debt limit proscribed in each statutory authority.
For the Improvement Portion, because the City is assessing at least 20% of the
project costs the Bonds can be a general obligation without a referendum and
will not count against the City's debt limit.
Under Chapter 412, the City may issue General Obligation debt to finance
capital equipment. Because the amount of equipment certificates issued is less
than .25% of the City's market value ($2.1 million), a public hearing and
reverse referendum is not necessary.
The Equipment Portion of the Bonds does count against the City's General
Obligation Debt Capacity Limit of 3% of market value. It is estimated the
City will have $24.4 million in capacity remaining after this issuance.
The Bonds will be general obligations of the City for which its full faith, credit
and taxing powers are pledged.
Term/Call Feature:
The Bonds are being issued for a 16 year term. Principal on the Bonds will be
due on February 1 in the years 2018 through 2032. Interest is payable every
six months beginning August 1, 2017.
The Bonds maturing on and after February 1, 2026 will be subject to
prepayment at the discretion of the City on February 1, 2025 or any date
thereafter.
Bank Qualification:
Because the City is expecting to issue no more than $10,000,000 in tax exempt
debt during the calendar year, the City will be able to designate the Bonds as
"bank qualified" obligations. Bank qualified status broadens the market for
the Bonds, which can result in lower interest rates.

The City's most recent bond issues were rated "AA-" by Standard & Poor's.
The City will request a new rating for the Bonds.
If the winning bidder on the Bonds elects to purchase bond insurance, the
rating for the issue may be higher than the City's bond rating in the event that
the bond rating of the insurer is higher than that of the City.
Basis for Recommendation:
We have based this pre -sale recommendation on our understanding of the
City's fiscal condition, its project funding requirements, and its desire to
reduce future interest costs when possible. We believe the proposed financing
is the most efficient way to achieve these objectives, while maintaining future
flexibility for future prepayment and/or refinancing. This issue also coincides
with the City's past practices to finance these types of projects with this type
of debt issue and fits within the City's debt management plan.
Method of Sale/Placement:
In order to obtain the lowest interest cost to the City, we will competitively bid
the purchase of the Bonds from local and national underwriters/banks.
We have included an allowance for discount bidding equal to 1.20% of the
principal amount of the issue. The discount is treated as an interest item and
provides the underwriter with all or a portion of their compensation in the
transaction.
If the Bonds are purchased at a price greater than the minimum bid amount
(maximum discount), the unused allowance may be used to lower your
borrowing amount.
Premium Bids: Under current market conditions, most investors in municipal
bonds prefer "premium" pricing structures. A premium is achieved when the
coupon for any maturity (the interest rate paid by the issuer) exceeds the yield
to the investor, resulting in a price paid that is greater than the face value of
the bonds. The sum of the amounts paid in excess of face value is considered
"reoffering premium."
The amount of the premium varies, but it is not uncommon to see premiums
for new issues in the range of 2.00% to 10.00% of the face amount of the
issue. This means that an issuer with a $2,000,000 offering may receive bids
that result in proceeds of $2,040,000 to $2,200,000.
For this issue of Bonds we have been directed to use the premium to reduce
the size of the issue. The adjustments may slightly change the true interest
cost of the original bid, either up or down. You have the choice to limit the
amount of premium in the bid specifications. This may result in fewer bids,
but it may also eliminate large adjustments on the day of sale and other
uncertainties.
Review of Existing Debt:
We have reviewed all outstanding indebtedness for the City and find that there
are no viable refunding opportunities at this time.
We will continue to monitor the market and the call dates for the City's
outstanding debt and will alert you to any future refunding opportunities.

Continuing Disclosure:
Because the City has more than $10,000,000 in outstanding debt (including
this issue) and this issue is over $1,000,000, the City will be agreeing to
provide certain updated Annual Financial Information and its Audited
Financial Statement annually as well as providing notices of the occurrence of
certain reportable events to the Municipal Securities Rulemaking Board (the
"MSRB"), as required by rules of the Securities and Exchange Commission
(SEC). The City is already obligated to provide such reports for its existing
bonds, and has contracted with Ehlers to prepare and file the reports.
Arbitrage Monitoring:
Because the Bonds are tax-exempt obligations/tax credit obligations, the City
must ensure compliance with certain Internal Revenue Service (IRS) rules
throughout the life of the issue. These rules apply to all gross proceeds of the
issue, including initial bond proceeds and investment earnings in construction,
escrow, debt service, and any reserve funds. How issuers spend bond
proceeds and how they track interest earnings on funds (arbitrage/yield
restriction compliance) are common subjects of IRS inquiries. Your specific
responsibilities will be detailed in the Signature, No -Litigation, Arbitrage
Certificate and Purchase Price Receipt prepared by your Bond Attorney and
provided at closing. You have retained Ehlers to assist you with compliance
with these rules.
Risk Factors:
Special Assessments: We have not assumed any pre -paid special assessments
and we have assumed that $626,183 in assessments will be levied as projected.
If the City receives a significant amount of pre -paid assessments or does not
levy the assessments, it may need to increase future levy portions of debt
service to make up for lower interest earnings than the expected assessment
interest rate.
Other Service Providers:
This debt issuance will require the engagement of other public finance service
providers. This section identifies those other service providers, so Ehlers can
coordinate their engagement on your behalf. Where you have previously used
a particular firm to provide a service, we have assumed that you will continue
that relationship. For services you have not previously required, we have
identified a service provider. Fees charged by these service providers will be
paid from proceeds of the obligation, unless you notify us that you wish to pay

Resolution Providing for the Sale of
$4,010,000 General Obligation Bonds, Series 2016A
A. WHEREAS, the City Council of the City of Hutchinson, Minnesota has heretofore determined that it
is necessary and expedient to issue the City's $4,010,000 General Obligation Bonds, Series 2016A
(the "Bonds"), to finance street improvements and the acquisition of capital equipment in the City;
and
B. WHEREAS, the City has retained Ehlers & Associates, Inc., in Roseville, Minnesota ("Ehlers"), as its
independent municipal advisor for the Bonds in accordance with Minnesota Statutes, Section 475.60,
Subdivision 2(9);
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hutchinson, Minnesota, as
follows:
1. Authorization; Findings. The City Council hereby authorizes Ehlers to assist the City for the sale of
the Bonds.
2. Meeting; Proposal Opening. The City Council shall meet at 5:30 p.m. on September 13, 2016, for the
purpose of considering proposals for and awarding the sale of the Bonds.
3. Official Statement. In connection with said sale, the officers or employees of the City are hereby
authorized to cooperate with Ehlers and participate in the preparation of an official statement for the
Bonds and to execute and deliver it on behalf of the City upon its completion.
The motion for the adoption of the foregoing resolution was duly seconded by City Council Member
and, after full discussion thereof and upon a vote being taken thereon, the

BACKGROUND/EXPLANATION OF AGENDA ITEM:
Currently, the City of Hutchinson Employee Handbook- Personnel Policy language regarding vacation leave with pay
for full time employees requires that an employee work a full year before being granted vacation leave. The has
proven to be difficult and restrictive for new employees who, for various reasons, need time some away from work
during the first year of employment. These include situations likes vacations planned prior to hire, important family
events (weddings, graduations, non-immediate family funerals), brief emergencies, and others.
To address this, administration is recommending that the Vacation Leave with Pay policy language be amended to
allow new full time employees to begin accruing vacation leave upon hire and allowing them to use accrued vacation
after 3 months of continuous full time employment and upon approval of the employee's supervisor. The actual
proposed language revisions are included in the attachment to this form.
It should be noted that even though new full time employees will be allowed to use accrued vacation after 3 months of
employment, the current policy language remains in place that states a new employee who terminates employment
prior to completing one year of service will not be compensated for any accrued vacation.

A RESOLUTION AMENDING SECTION 13 — VACATION LEAVE WITH PAY - OF THE

THE HUTCHINSON CITY COUNCIL HEREBY AMENDS SECTION 13 — VACATION
LEAVE WITH PAY - OF THE CITY OF HUTCHINSON EMPLOYEE HANDBOOK —
PERSONNEL POLICY:
SECTION 13 VACATION LEAVE WITH PAY Vacation leave shall be determined by
length of service for regular full time and regular part time employees. Only those regular
part time employees who have worked 1200 hours or more in the initial anniversary year
and each subsequent preceding anniversary year are entitled to paid vacation leave. For
these employees, vacation leave shall be granted on a pro -rata basis.
For regular full time employees, the paid vacation schedule is as follows:
Upon hire, vacation accrues each bi-weekly @gy
period. Vacation accrues at a rate of 3.08 hours/bi-weekly pay period with a
final calendar year accrual of 3.00 hours. After three months of connnugus
service, vacation leave may be used as it is earned. subject to sonroval
by the employee's supervisor.
2 After completion of seven years of continuous service, an additional lump
sum of 40 hours vacation is granted. Vacation then accrues at the rate of 120
hours (3 weeks) per year. Vacation accrues at a rate of 4.62 hours/bi-weekly
pay period with a final calendar year accrual of 4.50 hours.
3 After completion of twelve years of continuous service, an additional lump
sum of 40 hours vacation is granted. Vacation then accrues at the rate of 160
hours (4 weeks) per year. Vacation accrues at a rate of 6.16 hours/bi-weekly
pay period with a final calendar year accrual of 6.0 hours.
For eligible regular part time employees, the paid vacation schedule is as follows:
After completion of one year of continuous service, the hours worked in the
previous 52 week period will be computed. If the hours worked exceed
1,200, the equivalent percentage (%) of regular full time annual hours (2,080)
will be calculated and applied to the regular full time accrual rate. (i.e. work
1,248 = 60% of full time; 60% of the 80hours/year accrual rate = 48 hours of
vacation accrual). The employee is credited with the lump sum vacation
hours.
2 After completion of seven years of working 1,200 or more hours, the
percentage (%) of hours worked will be applied to the regular full time
employee accrual rate of 120 hours/year and the resulting lump sum of,
vacation accrual credited to the employee.
3 After completion of twelve years of working 1,200 or more hours, the
percentage (%) of hours worked will be applied to the regular full time

employee accrual rate of 160 hours/year and the resulting lump sum of
vacation accrual credited to the employee.
If a paid holiday falls during an employee's vacation leave, the holiday shall not be counted
against the vacation time.
Vacation accrual may not be used until after it is earned and is posted on the payroll leave
accrual system. As vacation leave is granted to employees for a period of recreation, each
regular full time employee of the City must use at least 40 hours of vacation leave each
calendar year, beginning with the first full calendar year following the first continuous year of
employment. Beyond this requirement, leave time may accrue up to a maximum of two
times the current annual leave, as of each subsequent calendar year, for future use.
Each regular part time employee earning vacation must use at least the pro rata amount of
the 40 hours of vacation equal to the rate for which their vacation leave was earned (i.e.
worked 60% of full time, must use at least 24 hours of vacation). The minimum use of the
accrual must occur by the end of the anniversary year. Beyond this requirement, leave time
may accrue up to a maximum of two times the current annual leave, as of each subsequent
anniversary year, for future use.
In the year preceding retirement, there shall be no maximum limit on accrued leave. Leave
time not used according to this policy shall be forfeited.
All employees shall give a 10 -day advance notice to the immediate supervisor of desired
vacation dates if 2 or more days of vacation are requested; salaried employees shall give
this notice in writing. The supervisor shall determine whether requested dates allow for
reasonable scheduling of work within the department. When possible, vacation days shall
not be scheduled for a week when overtime is also required. Hourly employees shall be
eligible for no more than 40 hours pay in any week when vacation is used, except in
unusual circumstances or where other City policy authorizes the use.
Any employee leaving the municipal service in good standing after at least one year of
service and after giving proper notice of such termination of employment shall be
compensated for vacation leave accrued and unused to the date of separation.

hours of vacation equal to the rate for which their vacation leave was earned (i.e.
worked 60% of full time, must use at least 24 hours of vacation). The minimum use of the accrual
must occur by the end of the anniversary year. Beyond this requirement, leave time may accrue up
to a maximum of two times the current annual leave, as of each subsequent anniversary year, for
future use.
In the year preceding retirement, there shall be no maximum limit on accrued leave. Leave time
not used according to this policy shall be forfeited.
All employees shall give a 10 -day advance notice to the immediate supervisor of desired vacation
dates if 2 or more days of vacation are requested; salaried employees shall give this notice in
writing. The supervisor shall determine whether requested dates allow for reasonable scheduling
of work within the department. When possible, vacation days shall not be scheduled for a week
when overtime is also required. Hourly employees shall be eligible for no more than 40 hours pay
in any week when vacation is used, except in unusual circumstances or where other City policy
authorizes the use.
Any employee leaving the municipal service in good standing after at least one year of service and
after giving proper notice of such termination of employment shall be compensated for vacation
leave accrued and unused to the date of separation.

BACKGROUND/EXPLANATION OF AGENDA ITEM:
AERIAL BUCKET TRUCK
The proposed transaction is a 2-for-1 transaction for a new aerial boom truck, primarily utilized for Forestry
operations in Streets & Parks and also used interdepartmentally for facility maintenance.
This transaction would replace two current trucks with one truck. The current trucks are:
STRT-447-HTK 55'/ 60' wh - 18 years old
STRT-373-TK1 28'/ 33' wh - 28 years old
The goal was to come up with as high a working height as possible on a light cab/chassis, so the truck GVWR
remained under 26,000 lbs. which will allow operators without a commercial driver license (CDL) to use the truck.

This equipment was identified for funding within the recently updated debt management plan.

In response to your request for a quote on a 47' aerial basket and custom body to be installed on your
2017 Ford F-550 84" CA chassis with diesel engine and automatic transmission, I am pleased to offer

Versalift VST -47-1 complete with three (3) insulated booms and to include the following features:
- 47 foot to bottom of platform.

48" high x 34" wide x 18" deep fiberglass compartment with aluminum transverse open to both sides
with full width shelf 12" from top of compartment and full width drawer to pull both ways at bottom.
Doors to have 3 -paint D -ring latches and spring loaded door holders. Top of compartment to be
covered with aluminum treadplate. Fiberglass gelcoat white to match cab.
- 130" long x 94" wide steel treadplate platform body. Top surface of deck to be coated with black
"sure -foot" non. -skid material. Long sills to be 4" x 8" subframe with 3" channel integral
crossmembers.
- ICC type bumper at rear with aluminum treadplate apron tapered from end of body to rear
outriggers.

Library Board Meeting Minutes
Monday, July 25 2016 @ 4:30 p.m.
Present: Jon Ross, Dianne Wanzek, Mary Christensen, Gerry Grinde, Steve Bailey, and Katy Hiltner, Ex -Officio
Excused: Julie Lofdahl and Jack Sandberg
Jon Ross called the meeting to order. The minutes from the June 27, 2016 meeting were reviewed. Motion
made to approve minutes as written by Dianne Wanzek, seconded by Steve Bailey. Minutes approved as written.
Old Business:
Lighting in Library:
New LED bulbs have been installed on the main and 2"d floor (large decorative fixtures.) Due to a small fan
attached to each bulb, the new bulbs are creating a buzzing/humming noise. Jamie Johnson with Minnesota
GreenCorps is looking into options for quieter bulbs. There have been no reported patron complaints with the
noise.
Summer Reading Program -
A total of 84 teens have signed up for the Teen Summer Reading Program — wow! The library saw a successful
Minute to Win It Program in June with 7 teens in attendance. The Children's Reading Program has over 500
participants — very successful! Upcoming Stories in the Park programs include a Minnesota Science Museum
water program on Thursday, July 28. In case of inclement weather, the event will be held at the county
fairgrounds.
One Book, One Community—
The committee is still in the process of selecting a book. Funding considerations for next year include pursuing a
Legacy grant to help cover programming costs.
New Business:
Budget Requests —
Pioneerland Library System issued funding request letters on July 7, 2016, to area cities and counties. This year's
request is a 2% increase over FY2016. Katy will be speaking before the Hutchinson City Council on Tuesday,
Sept. 27tH
Job Posting — Library Assistant I
The library is need of a Library Assistant I. Katy will be posting the job notice internally this week and will then
create a public post (if needed). The hours available for this Library Assistant I position are 5-9 hours/week with
a Saturday rotation (10 a.m.-5 p.m.)
Coming Up: Annual Used Book Sale -
The Friends Annual Used Book Sale will be held Friday, Sept. 16th 10 a.m.-6 p.m. and Saturday, Sept. 17th
9 a.m.-4 p.m. This book sale will coincide with the Hutchinson Arts and Crafts Festival, which will feature the
Legacy arts program "One Another."
Fall Projects -
Katy's idea is to create a monthly newsletter and calendar featuring library news and programs. Katy also talked
with Kay Johnson at the River Song Music Festival. Kay suggested that Katy put together a few draft articles for a
possible library column in the newspaper. In addition to print materials, Katy would like to update the Library's
Web page to include an "About" page highlighting the library's history. In addition, Katy is talking with the
Friends of the Library to find out if there is interest in creating a Friends' page.
Pokemon GO -
Library Square is busy with Pokemon Go! Board members commented that the gaming has provided good
interaction for children.
Other -
Tuesday Aug. 2"d (afternoon) -Friday, Aug. 5t", Katy will be out of the office on a vacation.
