JANUARY 8, 1974
The meeting was called to order at the hour of 7:30 P.M. by
Mayor Black.
Members present were: Aldermen Westlund, Lueneburg, Haag,
and Ackland, in addition to Mayor Black. Members absent were:
None. Also present were: Administrative Assistant Mealey
and City Engineer Priebe. City Attorney Schantzen arrived
later in the meeting.
Reverend Waters was unable to attend the meeting. The
invocation, therefore, was dispensed with.
The minutes of the Regular Meeting of December 26, 1973 and
Special Meeting of January 2, 1974 were accepted as presented
on motion by Alderman Lueneburg, seconded by Alderman Westlund
and carried.
The current bills were accepted with the additions of $4,000
in payment of Assessment Services; $44.00 - Coalition of
Outstate Cities, conference fees; $100.00 - League of
Minnesota Municipalities, conference fees; on motion by
Alderman Westlund, seconded by Alderman Lueneburg and carried.

Investments and transfers were authorized in the following
funds and amounts on motion by Alderman Westlund, seconded
by Alderman Ackland and carried:
Sinking Fund No. 6 - Approximately $120,000
Sinking Fund No. 5 - Approximately $ 35,000
A transfer of $18,000 from Liquor Store Fund
to General Fund.
At 7:38 P.M. Mayor Black requested that bids received pursuant
to advertisement for new Street Flusher and Truck Chassis be
presented. Administrative Assistant Mealey opened said bids
and they were as follows:

in the amount of $7,955, accompanied by a Bid Bond for 10% of

the amount bid.
Johnson Motor Company, Inc. of Glencoe, Minnesota, submitted
bid for an International, net bid $6,380 with an addition of
$300 for a 2 speed axel and an addition of $780 for an automa-
tic transmission, accompanied by a certified check in the
amount of $425. Delivery to be approximately 180 days.
Moehring Motors of Hutchinson, Minnesota, submitted bid for a
GMC, net bid $8;035 with an addition of $325 for a 2 speed
axel and an addition of $925 for an automatic transmission.
Delivery to be made as soon as possible. Accompanied by a certified
check in the amount of $500.
Wigen Chevrolet of Hutchinson, Minnesota,submitted bid for a
Chevrolet, net bid $8,048, accompanied by a certified check in
the amount of $402.40. Delivery to be made as soon as possible.
Plowman Motors, Inc. of Hutchinson, Minnesota, submitted bid
for a Ford C-750, net bid $7,850, accompanied by a certified
check in the amount of $400. Delivery to be made approximately
250-300 days.
Alderman Westlund moved that the bids received for Truck Chassis
be referred to City Engineer Priebe and Street Superintendent
Roberts for study and recommendation. Alderman Ackland seconded
the motion and it carried.
Mayor Black noted that Wesley Greve had not been appointed as
Fire Marshall at the January 2, 1974 Special Council Meeting.
Mayor Black then'appointed Mr. Greve as Fire Marshall upon
Council ratification. Alderman Westlund moved the appointment
be ratified, Alderman Lueneburg seconded the motion and it
carried. Mayor Black then declared Wesley Greve as Fire Marshall
for the calendar year 1974.
Alderman Westlund moved the City of Hutchinson enter into
Agreement with the County of McLeod for Assessor during the
calendar year 1974. Alderman Ackland seconded the motion and
it carried. (TEXT)
A memorandum was received from the Office of State Aid reminding
if the City of Hutchinson wished to receive Engineering and
Technical Assistance for the calendar year 1974, approval of
the Agreement and a Resolution requesting this assistance
must be remitted to the Municipal Enaineers, Office of State
Aid. After considerable discussion, Alderman Haag moved

the City enter into said agreement and introduced Resolution
Number 5297 (Authorizing Payment for Services of Depart-
ment of Highways) and moved its adoption. Alderman Lueneburg
seconded the motion and upon vote being taken, all members
voted "aye" whereupon said resolution was declared adopted.

A memorandum and map was received from City Engineer Priebe
recommending the City purchase the excess right of way of
Burlington Northern, which is all of the following lots lying
South and East of the existing tract:
Block 28, Lots 6 through 10
Block 29, Lots 1 through 9
Block 36, Lots 1 and 2
After considerable discussion, Alderman Westlund moved the
subject be tabled until the City Engineer contact the Railroad
and obtain prices of the lots. Alderman Haag seconded the
motion and it carried.
Mayor Black explained that all procedures had been followed
in accordance with M.S.A. Laws for the 1974 Proposed Improve-
ment Projects, and at this time the Council would review and
study the petitions, objections, concurrances, received at
the 1974 Improvement Project Hearing. After the projects were
discussed in depth, and in view of the responses of those
present at the hearing, Mayor Black suggested the following
projects be included in the 1974 Improvements: (Note - Project
No. 74-22 is amended to curb and gutter only, deleting
bituminous surfacing and appurtenances.)

The Mayor noted that 300 of the cost the City was responsi-
ble for and indicated that many citizens seemed unaware of
this fact. After discussion, Alderman Westlund moved the
revisions, as stated by the Mayor, be approved and introduced
Resolution No. 5300 - 5334 (Ordering Improvement and Preparation
of Plans) and moved their adoption. Alderman Lueneburg seconded
the motion and vote having been taken, all members voted "aye"

A letter of resignation was received from Diane Fowler (City
Clerk's Office - Receptionist) effective February 6, 1974.
It was noted that Diane and her husband Cole were moving to
Nebraska where her husband recently accepted a job as Assistant
Chamber of Commerce Manager. Alderman Westlund moved Mrs.
Fowler's resignation be accepted. Alderman Haag seconded the
motion and it carried. It was noted that appreciation be
expressed to Diane for the commendable work she performed.

A Trash and Refuse Affidavit was received from Mrs. Verna
Fratzke of 127 -6th Avenue N.E., Hutchinson, Minnesota. After
discussion, Alderman Westlund moved the request be denied due
to the fact that the current market value of her property
exceeded the $15,000 amount allowed. Alderman Haag seconded
the motion and it carried.
A Trash and Refuse Affidavit was received from Theophil
Gruenwaldt of 287 -5th Avenue N.E., Hutchinson, Minnesota.
After discussion, Alderman Westlund moved the request be
denied due to the fact that Mr. Gruenwaldts' income exceeded
the $1,800 per year allotment. Alderman Haag seconded the
motion and it carried.
Received was a Change Order from Rieke -Carroll -Muller, Inc.
indicating concurrence from Housing Urban Development concerning
Change Order No. 2 (Frederickson, Inc.). After discussion,
Alderman Lueneburg moved approval and authorization of Change
Order No. 2 (Frederickson, Inc.). Alderman Westlund seconded
the motion and it carried.
A petition was received to construct the proposed West River
Bridge to be located at the extension of School Road, between
Stoney Point Addition and Rolling Oaks lst Addition. After
discussion, it was the concensus of the Council that the City
Engineer be directed to report on plans for the West River
Bridge at the Regular Council meeting of January 22, 1974.
It was reminded that on January 16, 1974, at 2:00 P.M. in the
City Hall Auditorium, Miss Gail Charpentier of the Minnesota
Department of Labor and Industry will speak to all interested
in the provisions of OSHA and what those provisions can do to
and for employees and employers.
The Building Official's monthly report was accepted as presented
and ordered filed.
Five applications for Snow Removal permits were received. One
Each from Jerry Peterson of R.F.D #3; Curtis W. Paulsen of
236 Adams; Ed Peterson of 95 -5th Avenue N.W.; Downtown Shell of
Main Street and 2nd Avenue; and Roger Henke of 835 Spruce Street
North. After some discussion, Alderman Westlund moved the
permits be granted. Alderman Ackland seconded the motion and
it carried.
Mayor Black reminded that a breakfast meeting was scheduled
with Senator Bernhagen and Representative Kvam on January 9,
1974, 7:30 A.M. at Lee's Truck Stop.
Mayor Black noted also that the annual meeting of the Coalition
of Outstate Cities would be held on January 18, 1974, 10:00 A.M.
at the St. Paul Hilton Hotel. Mayor Black noted the COOC met

once a month to discuss problems concerning Outstate cities.
Mayor Black reminded also, that on January 26, 1974, the
League of Minnesota Municipalities is sponsering a conference
for Newly Elected Mayors and Councilmen to be held at the
Ramada Inn-McGeire's, in Arden Hills.
The Park and Recreation Board Minutes were accepted as presented
and ordered filed.
In r(ading the Park and Recreation Board minutes there was
a discussion concerning the approval of upright tombstones
in the Oakland Cemetery Park. After a lengthy and involved
discussion, it was noted that the concensus of the Park and
Recreation Board was to refer the matter of allowing upright
tombstones and to draft an ordinance indicating specific laws
and regulations for each park in the City, to City Attorney
Schantzen for study and recommendation.
An annual report of the Hutchinson Fire Department was received
from Fire Chief Eric Smith. Alderman Westlund questioned as
to what the comparison from last year to this year was.
Administrative Assistant Mealey informed it was approximately
the same.
Alderman Haag noted he had been approached by school bus
drivers expressing complaint of the stop sign upon entering
into or upon Fifth Avenue Southeast from Huron Street between
Blocks 63 and 64, South Half of City. It appeared to be an
extreme inconvenience to school bus operators. Alderman Haag
then introduced proposed Ordinance 1/74; (An Ordinance Revoking
A Certain Portion of a Through -Street in the City of Hutchinson)
and moved its adoption. Alderman Ackland seconded the motion
and upon vote being taken, said ordinance was declared adopted
upon its first reading.
Alderman Haag then noted that there was a traffic problem on
T.H. 15 between College Avenue and Griffin Avenue. He stated
cars have been parking in this area and the flow of traffic
would have to motivate around the parked cars causing a hazard.
After considerable discussion, Alderman Haag introduced proposed
Ordinance 2/74; (An Ordinance Regulating the Parking of Motor
Vehicles and Other Vehicles on Certain Streets of the City of
Hutchinson, Minnesota and Providing Penalty for Violation Thereof)
and moved its adoption. Alderman Ackland seconded the motion
and upon vote being taken, all members voted "aye" and said
ordinance was declared adopted upon its first reading.
REGULAR COUNCIL MEETING (8) JANUARY 8, 1974
Alderman Ackland noted that a meeting was scheduled on January
30, 1974 with the Township Boards and Fire Chief Eric Smith.
Purpose of the meeting was to consider renewal of Fire Protection
Contracts with the Townships, distribute and discuss the budget,
financial statement and to have a general meeting to discuss
any problems or questions anyone might have.
Mayor Black noted a Region 6E meeting was scheduled on January
30, 1974, 8:00 P.M. in the Council Chambers. The Mayor
encouraged Council attendance.
Alderman Westlund moved that the Annual Report of the Hutchinson
Fire Department, discussed earlier in the meeting, be accepted
as presented and ordered filed. Alderman Ackland seconded the
motion and it carried.
Mayor Black noted the many requests and complaints received
concerning the removal of snow and ice on sidewalks. Apparently
sidewalks are not being cleared causing a hazard
to pedestrians. After considerable discussion, Mayor Black
entertained a motion that all property owners be sent a letter
informing they are breaking the law in accordance with City
Ordinance No. 270 (An Ordinance Providing For the Removal of
Snow, Ice, Dirt, and Rubbish from Sidewalks) and emphasize the
dangerous hazard that has arisen due to this situation. If no
response is received upon receipt of said letter, another
letter be sent property owners ordering them to appear
for a hearing before the Council and explain why they have not
cleared their sidewalks. If still no action is taken by
property owners or if no party appears before the Council,
the Council will order the City Street Crew to do said work
and all charges will be placed on the property tax roll.
Alderman Haag so moved. Alderman Westlund seconded the motion
and it carried.
Administrative Assistant Mealey informed that the State of
Minnesota will be conducting a basic 3 day Civil Defense
Director's workshop at the Germain Hotel in St. Cloud,
February 25-27, 1974. It was noted that all expenses would
be paid by the Civil Defense. After discussion, Mayor Black
entertained a motion to authorize the City's Civil Defense
Officials to attend said meeting. Alderman Westlund so
moved. Alderman Ackland seconded the motion and it carried.
It was requested that a 13 year old generator, found in good
working condition, be mounted on a trailer to be used in
emergency or disaster situations. After discussion, Alderman
Westlund moved authorization of mounting said generator on a
trailer to be available for emergency and disaster purposes.
Alderman Lueneburg seconded the motion and it carried.
REGULAR COUNCIL MEETING (9) JANUARY 8, 1974
Administrative Assistant Mealey informed state legislation
(Chapter 351, 1973 Session Laws) requires all local govern-
mental units subject to recurrent flooding to participate in
the National Flood Insurance Program. Consequently,
he advised that the Corps of Engineers for technical review
have not completed their review as to whether the City's
proposed floodway and flood plain designations will meet the
Flood Plain Standards. Administrative Assistant Mealey stated
it was suggested in the interium, that the City adopt the
sample resolutions found in the "Flood Insurance" Booklet in
order to qualify the City to participate in the National Flood
Insurance Program.
After discussion, it was the concensus of the Council that
a draft of said resolutions be drawn.
Attorney Schantzen informed that on January 18, 1974 a con-
ference had been scheduled for the League of Municipalities
of Attorneys, and requested authorization to attend. After
some discussion, Alderman Westlund moved approval of Attorney
Schantzen's attendance at the conference. Alderman Ackland
seconded the motion and it carried.
There being no further business to come before the Council,
meeting was declared adjourned at 9:20 P.M. on motion by
Alderman Ackland, seconded by Alderman Lueneburg and carried.
Mayor Black entertained a motion that bids for Street Flusher
be referred to the City Engineer and the Street Superintendent
for study and recommendation. Alderman Haag so moved, Alderman
Ackland seconded the motion and it carried.

City Engineer Priebe was directed to draw -up plans and specifications
for the 1974 Improvement Projects.
