05-05-1992 CCMMINUTES SPECIAL MEETING - HUTCHINSON CITY COUNCIL TUESDAY, MAY 5, 1992 The meeting was called to order at 5:00 P.M. by Mayor Ackland. The following were present: Mayor Paul L. Ackland, Councilmen John Mlinar, Marlin Torgerson and Don Erickson. Absent: Councilman Craig Lenz. Also present: Finance Director Kenneth B. Merrill and City Attorney G. Barry Anderson. Mayor Ackland stated the purpose of the meeting was to discuss Dakota Rail issues. He then reviewed the items discussed at the previous meeting regarding this matter. Attorney Anderson stated Eli Mills' counter-offer to the City was: (1) not to assess $8,000 for Adams Street improvement regarding Dakota Rail; (2) to decertify 1992 assessments for Third Avenue and not to certify future assessments; (3) to uncharge or forgive approximately $40,000 for Les Kouba Parkway; and (4) to proceed with the original transaction as originally scheduled. Following discussion, the motion was made by Councilman Torgerson, seconded by Councilman Mlinar and unanimously carried, to approve the terms stated by City Attorney Anderson. There being no further business, the meeting adjourned at 5:25 P.M.
