SPECIAL MEETING - HUTCHINSON CITY COUNCIL
TUESDAY, OCTOBER 15, 1991
The special meeting was called to order by Mayor Ackland at 4:50
P.M. Present were: Mayor Paul L. Ackland, Aldermen Craig Lenz,
John Mlinar, Marlin Torgerson and Don Erickson. Also present: City
Engineer John Rodeberg, Fire Marshal George Field, Building Offi-
cial Jim Marka, Finance Director Kenneth B. Merrill, and City At-
torney G. Barry Anderson.
Sanitary And Water Services at 196 & 186 Third Avenue N.W.
Engineer Rodeberg reported on the project and commented the work
could not be done without violating the City's ordinance. Atten-
tion was directed to the Hutchinson Zoning Ordinance, Section 5.05,
Repairs And Maintenance. The property in question is a non -con-
forming use and is in the 100 year flood plain. He stated it was
staff recommendation to activate all past deferred assessments and
future assessments on Third Avenue N.W. and actively pursue removal
of all substandard and vacant housing on Third Avenue N.W.
Attorney Anderson stated there were deferred assessments against
the property on a 10 -year payment period. The value of the im-
provements exceed the value of the property. If the property were
forfeited for back taxes, the property was not worth the amount of
the assessments.
Mayor Ackland reported Mrs. Lorraine Wright had written a letter
opposing the curb and gutter improvement project in 1988 and had
objected to water service in the past. He questioned whether the
City could activate the deferred assessments according to the May
10, 1988 City Council minutes. The question was whether or not the
City should or could install water and sanitary sewer service to
the property.
Following discussion, Alderman Torgerson moved to accept the recom-
mendation of City staff not to provide installation of sanitary
sewer line service to the property based on the present City ordi-
nance and not to activate the deferred assessments at this time.
Motion seconded by Alderman Mlinar and unanimously carried.
The meeting was adjourned at 5:40 P.M.
