03-27-1987 CCMMINUTES SPECIAL MEETING - HUTCHINSON CITY COUNCIL FRIDAY, MARCH 27, 1987 The open portion of the closed special City Council meeting was called to order by Mayor Ackland at 12:45 P.M. Present were: Alderman John Mlinar, Alderman Marlin Torgerson, Alderman Pat Mikulecky, and Mayor Paul L. Ackland. Absent: Alderman Mike Carls. Also present: Assistant City Clerk Kenneth B. Merrill and Legal Counsel Dayle Nolan. 1. CONSIDERATION OF RESOLUTION NO. 8473 - RESOLUTION OF AGREEMENT WITH CHIEF OF POLICE AND RELEASE OF ALL CLAIMS Mayor Ackland stated that although Alderman Carls was on vacation, he had been advised of the contents of the agreement and had sent a note stating he was in full agreement with the claims of settlement. The motion was made by Alderman Mikulecky, seconded by Alderman Torgerson, to waive reading and adopt Resolution No. 8473 entitled Resolution Relating To Certain Proceedings Involving The Chief Of Police; Authorizing Settle- ment Of Claims. Motion unanimously carried. 2. CONSIDERATION OF RESOLUTION NO. 8474 - SPECIAL LEGISLATION REMOVING CHIEF OF POLICE OF HUTCHINSON FROM CIVIL SERVICE RULES AND REGULATIONS Mayor Ackland stated that upon adoption of this Resolution, he would deliver copies to Senator John Bernhagen and Rep. Steve Dille for legislative action which would affect only the City of Hutchinson. Alderman Torgerson moved to waive reading and adopt Resolution No. 8474. Motion seconded by Alderman Mikulecky and carried unanimously. 3. CONSIDERATION OF REPEALING PROMOTION OF NANCY BUSS TO OFFICE SUPERVISOR Mayor Ackland stated that Nancy Buss' promotion should have gone through the Civil Service Commission and was improperly handled. He then reviewed her previous salary and recommended her promotion be repealed and put the salary back to $8.59, effective now. Following discussion, Alderman Torgerson moved to repeal the promotion and put the salary at $8.59, effective immediately. Motion seconded by Alder- man Mlinar and unanimously carried. 4. CONSIDERATION OF REQUESTING CIVIL SERVICE COMMISSION TO ADVERTISE AND INTERVIEW FOR POSITION OF OFFICE SUPERVISOR There was discussion whether the position of office supervisor should be advertised at this time or wait until a full-time chief had been hired. The motion was made by Alderman Mlinar to request the Civil Service Commis- sion to advertise and interview for the position of office supervisor. Mo- tion seconded by Alderman Torgerson. Motion failed with a roll call vote of 1 �� I CITY COUNCIL MINUTES - MARCH 27, 1987 Alderman Mlinar voting aye and Aldermen Torgerson, Mikulecky and Mayor Ack- land voting nay. Alderman Torgerson moved to table consideration until a future date. Alder- man Mikulecky seconded the motion and unanimously carried. 5. CONSIDERATION OF APPOINTMENT OF ACTING CHIEF - MAYOR'S RECOMMENDATION Mayor Ackland stated it was his recommendation to appoint Dick Waage as act- ing chief until the City decides it wants to hire a full-time chief. Alderman Torgerson moved to accept the recommendation of the Mayor for acting chief. Motion seconded by Alderman Mikulecky and carried unani- mously. 6. ADJOURNMENT The motion was made by Alderman Torgerson, seconded by Alderman Mlinar, to adjourn at 1:00 P.M. Motion unanimously carried. 2
