SEPTEMBER 28, 1970
Mayor Kost called the meeting to order at 7:30 P.M. Reverend Donald McCann
delivered the invocation.
Alderman Black moved that the minutes of the regular meeting of September 14
be amended to state that Alderman Linder seconded the motion to approve resolu-
tion 3080 and further that the minutes be approved as amended. Alderman Linder
seconded the motion and it was carried.
On motion by Alderman Linder, seconded by Alderman Black, the following bills

Four representatives of the Civic Committee of the Hutchinson Women's Club were
recognized by Mayor Kost. The committee presented a suggestion to the Council
that the old hospital building be used as a civic center and inquired whether such
a plan might be feasible. It was fur her requested that the Council give considera-
tion to such usage of the building. Mayor Kost explained that a number of

Mayor Kost requested proposals for moving of the old nurses' home as advertised
and was informed that none had been received.

Alderman Black introduced Ordinance No. 382, annexing Sioux Second
Addition, and moved its adoption upon first reading. Alderman Linder
seconded the motion and upon vote being taken, all present voted "aye" and
Ordinance No. 382 was declared passed upon its first reading.
ORDINANCE NO. 382
AN ORDINANCE ESTENDING THE CORPORATE LIMITS OF THE CITY OF
HUTCHINSON AND ANNEXING THERETO CERTAIN LAND FORMERLY
LOCATED IN THE TOWNSHIP OF LYNN
THE CITY OF HUTCHINSON DOES ORDAIN:
Section I; A petition has been filed with the governing body of the City
of Hutchinson, Minnesota by Sioux Enterprises, Inc. for Sioux Second
Addition by petitioners, Howard Quade, Jr., Harry R. Hanson, Milton A
Brinkman and Ralph D. Westlund, Being one hundred percent sole owners of
the following described real property, to have said property annexed and
included within the corporate limits of the City of Hutchinson, County of
McLeod, State of Minnesota, to wit:
Beginning at a point in the North line of Lot 91, Lynn Addition,
823,0 feet West of the Northeast corner of Lot 91; thence South
parallel to the East line of said lot 91, a distance of 468.0 feet;
thence East parallel to said North line, a distance of 158.0 feet;
thence South parallel to said East line, a distance of 854.77 feet;
to a point in the South line of Lot 91; thence west along said South
line, a distance of 667.07 feet to the Southwest corner of Lot 91;
thence North along the West line of Lot 91, a distance of 1328.20
feet to the Northwest corner of Lot 91; thence East along said North
line a distance of 509.20 feet to the point of beginning, containing
18.65 acres.
Section II: The quantity of land embraced within the foregoing description
and bounded as described, is 18.6 acres.
Section III: The City Council hereby determines:
(1) that the annexation will be to the best interests of the City
of Hutchinson and of the territory affected
(2) that the territory described herein abuts upon the City and
is so conditioned as properly to be subjected to City Government

Section IV: Therefore, the City of Hutchinson, Minnesota, hereby ordains
and declares that the property hereinbefore described be and the same is
hereby annexed to, and included in the City of Hutchinson, Minnesota, as
effectually as if it had originally been a part thereof.
Section V: This ordinance shall be final and shall take effect and be in
force after filing certified copy thereof with the Minnesota Municipal
Commission, the County Auditor and the Secretary of State and from and
after its passage and publication.
Adopted by the City Council this 28th day of Septeiaber, 1970.
Mr. Lloyd Schmeling and his representative, Attorney Greggory Woods were
recognized by Mayor Kost and stated that they were present for Council
determination of Mr. Schmeling's request for variance at Westside Grocery.
Alderman Linder reported on the Planning Commission's resommencation that
the variance be granted for the purpose of construction additional 15 feet
of storage area to the basement with the following provisions: that the
covering concrete slab shall not now or at any future time support any
structure above the ground level; that the tree at the corner of Fifth
Avenue and Harrington adjacent to the Schmeling property is on City
Boulevard property and is the sole responsibility of the City and that it
shall not be damaged during the proposed construction; that a 75% to 80.1
open railing must be installed along the front and Fifth Avenue sidESof
the slab. After some discussion, Alderman Linder moved the Planning
Commission's recommendations be approved. Alderman Alrick seconded the
motion and upon vote being taken it was approved unanimously.
Discussion of budget meeting date was held. Alderman Black moved that a
public meeting be advertised and set for Tuesday, October 6, 1970 at 1:00
P.M.. Alderman Linder seconded the motion and it was carried unanimously.
Alderman Linder introduced Resolution No. 3084 adopting permanent zoning
of the Ted Hanson Property prior to annexation and reported findings of
the Planning Commission that B-3, General Business District is in keeping
with the surrounding area. Alderman Linder moved adoption of the resolution
and Alderman Peterson seconded the motion. Upon vote being taken it was
carried unanimously and Resolution No. 3084 was declared adopted by the
City Council.
RESOLUTION NO. 3084
RESOLUTION ADOPTING PERMANENT ZONING PRIOR
TO ANNEXATION
WHEREAS, Section 4 -A -2-b of Ordinance No. 245 states that land
proposed to be annexed to the City of Hutchinson is to be permanently
zoned and
WHEREAS, owner of certain properties hereinafter described, have
petitioned for annexation and have also petitioned for permanent zoning,
and

WHEREAS, publication of the required notice was given and a hearing
was held thereon before the Hutchinson Planning Commission on September
21, 1970 at which all persons desiring to be heard were given an opportunity
to be heard thereon,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON,
MINNESOTA:
Such permanent zoning is hereby ordered as follows:
"B-311 General Business
The South 132 feet of the East 132 feet of lot 91, Lynn
Addition in Section 1-116-30
Alderman Linder then introduced Ordinance No. 378, annexing the Ted Hanson
property, for its second and final reading, and moved its adoption.
Alderman Black seconded the motion and upon vote being taken all members
voted"aye" and Ordinance No. 378 was thereupon declared adopted and the
City Clerk was directed to publish the ordinance according to law.
ORDINANCE NO. 378
AN ORDINANCE INCORPORATING CERTAIN LANDS
SURROUNDED BY THE CITY OF HUTCHINSON, MINNESOTA
AND FORMERLY LOCATED IN THE TOWNSHIP OF LYNN
THE CITY OF HUTCHINSON DOES ORDAIN:
SECTION I. The following described property owned by Ted Hanson is
completely surrounded by the City of Hutchinson, Minnesota:
The South 132 feet of the E st 132 feet of Lot 91 Lynn
Addition in Section 1-116-30
SECTION II. MSA, Section 414.033, subdivision 4 provides that "If the
land is completely surrounded by land within the municipal limits, the
municipal council may by ordinance declare the land annexed to the
municipality, and any such land is deemed to be urban in character."
SECTION III. Therefore, the City of Hutchinson, Minne -,u to hereby ordains
and declares that the property hereinbefore described be and the same is
hereby annexed to and included in the City of Hutchinson, Minnesota as
effectually as if it had originally been a part thereof.
SECTION IV. This ordinance shall be final and shall take effect and be
in force after filing certified copy thereof with the Minnesota Municipal
Commission, the County Auditor and the Secretary of State and from and
after its passage and publication.
REGULAR COUNCIL MEETING - 7 - SEPTEMBER 285 1970
Ordinance No. 381 regulating explosives, was brought under discussion.
Alderman Black moved the ordinance be tabled and placed on the agenda for
the October 12 meeting in order to allow more time to study the ordinance.
Alderman Linder seconded the motion and it was carried unanimously.
At 8:05 P.M. Mayor Kost declared open Public Hearing on Assessment Roll
No. 34, 1969-2, Street Improvement Project, and read publication No. 3080,
Notice of Hearing. Approximately 35 persons were present for the hearing.
Administrative Assistant Mealey made a few remarks explaining the assessment
and stating that the interest rate is figured at 6% annually. A number
of questions were asked concerning individual lots. No serious objections
or problems were presented. At 8:40 P.M. Mayor Ko8t declared the hearing
adjourned, and announced that the meeting would be continued in the
Auditorium for the southwest storm sewer hearing.
At 8:45 Mayor Kost declared the hearing open on Assessment Roll No. 35,
Southwest Storm Sewer Project 17-7. Approximately one hundred persons
were present. Administrative Assistant Mealey made some explanatory
remarks stating that the interest rate has been retained at 6%, that
payments without interest would be acceptable in whole or in part until
the 28th of October.
A considerable number of questions were presented concerning lot sizes
assessed. It was explained that some errors were bound to occur as a
result of property transfers not yet recorded in the city clerks office,
and occasionally resulting from inadequate property descriptions. The
property owners were invited to sign a register stating the nature of
their questions concerning the assessments. Two representatives of
Rieke -Carroll -Muller were present to assist in answering questions.
The hearing was declared adjourned at 10:40 P.M. and the Mayor and Council
adjourned to the Council Chamber, to resume the regular proceedings.
Mr. Don Dressell, Dressell Realty, was recognized by Mayor Kost and
presented a petition for annexation and request for pre zoning to B-3 of
the Steffenson-Lund properties on South Highway 15.
Alderman Linder introduced Ordinance No. 383, annexing the Lund-Steffenson
properties which are 100.1 surrounded by the City of Hutchinson, and
moved its adoption. Alderman Peterson seconded the motion and upon vote
being taken all members present voted "aye" and Ordinance No. 383 was
declared adopted upon its first reading.
Alderman Linder then moved that the pre zoning hearing be set for 7:30 P.M.
October 19, 1970. Alderman Peterson seconded that motion and it was
carried unanimously.

Alderman Black introduced Ordinance 380, an ordinance relating to the
exchange of real estate, for its second and final reading and moved its
adoption. Alderman Linder seconded the motion and upon vote being taken
all present voted "aye" whereupon Ordinance No. 380 was declared adopted
and the City Clerk directed to publish according to law.

AN ORDINANCE RELATING TO THE EXCHANGE OF REAL ESTATE
THE CITY OF HUTCHINSON DOES ORDAIN:
SECTION 1: The City of Hutchinson does own the hereinafter described real
estate located in the County of McLeod, State of Minnesota:
All that part of the following described tract: Part of Lot 90,
Lynn Addition to the City of Hutchinson, according to the plat on file
and of record in the office of the Register of Deeds of McLeod County,
Minnesota, and more particularly described as follows: Beginning at
a point on the South line of said Lot 90, said point lying Westerly
568.25 feet from the Southeast corner of said 19t 90; thence Northerly
on a line parallel to the East lira of said lot 90 a distance of 806
feet; thence Northeasterly to a point, said point lying 355 feet
Westerly of said East line of Lot 90 and 223 feet Southerly from the
North line of said Lot 90; thence Northerly on a line parallel with
the East line of said Lot 90, 223 feet to the North line of said Lot
90; thence Easterly along said North line of Lot 90, 355 feet to the
Northeast corner of said Lot 90; thence Southerly along the East line

the Register of Deeds of McLeod County, Minnesota described as follows,
to -wit: Beginning at a point 33 feet North of the Southwest corner
of said Lot ninety (90); thence North along the West line of said Lot
a distance of 443 feet; thence East parallel with the South line of
said lot a distance of 453.75 feet; thence North parallel with the
East line of said lot a distance of 864 feet to the North line of said
lot; thence East along the North line of said lot to the Northeast
corner thereof; thence South along the East line of said Lot to the
Southeast corner thereof; thence West along the South line of said

to convey title for the property described in Section I unto L. A. Richards
in return for which the City will 3aeceive title to the property described
in Section II from L. A. Richards and W. T. Richards.
SECTION IV: NOW THEREFORE BE IT ORDAINED THAT: The City of Hutchinson
shall convey by Quit Claim Deed title to said real estate described in
Section I and in return City of Hutchinson shall receive title to said
real estate described in Section II.
Alderman Linder reported on the Planning Commission's findings on Leonard
Miller's request for rezoning of his property along the Crow River and
introduced Ordinance No. 384 for its first reading and moved its adoption.
Alderman Peterson seconded the motion, and upon vote being taken all
members present voted "aye" whereupon Ordinance No. 384 was declared
passed upon first reading.
Alderman Black reviewed the Planning Commission's recommendations for a
plan for naming new streets and introduced Resolution No. 3085 and moved
its adoption. Alderman Linder seconded the motion and upon vote being
taken said resolution was declared adopted unanimously.
RESOLUTION NO. 3085
ADOPTING STREET NAMING PLAN
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON,
MINNESOTA:
THAT the following system of street naming is hereby effective
applicable to all new streets and is recommended for streets upon which
no construction has begun and which are not yet in use even though names
have been designated; excepting continuations of streets already in use:
REGULAR COUNCIL MEETING -10- SEPTEMBER 28, 1970
1. Except as existing streets are extended, all new North-South
streets in the Northeast quadrant of the City, East of Highway 15
and North of Highway 7 be named, alphabetically, for trees, shrubs
and flowers.
2. In the Northwest quadrant of the City, North of Highway 7 and West
of Highway 15, new North-South streets to be named for States of the
Union, alphabetically, omitting only "B" for which there is no state.
3. In the Southwest area, North of Second Avenue and West of Dale,
names of notable Americanscto be used, alphabetically.
4. In the Southwest area between Dale and Highway 15, South of Second
Avenue, names of large cities to be used, alphabetically.
5. In the Southeast area, between Highway 15 and Adams (Highway 22) -
Presidents of the United States.
6. In the Southeast area, South of Highway 7, East of Adams (Highway
22) to be named for lakes and streams, alphabetically.
7. All new East-West streets to be numbered as nearly as possible to
conform to existing numbering system.
The Council then turned its attention to discussion of the hearings. One
question concerning an assessment on Project 1969-2 remained unresolved and
the City Engineer was directed to investigate the claim further and adjust

Thereupon, Alderman Black introduced Resolution No. 3086, adopting assessment
roll No. 34, Project 1969-2 street improvement, and moved its adoption.
Alderman Linder seconded the motion and upon vote being taken all members
voted "aye" and resolution No. 3086 was declared adopted unanimously.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON,
MINNESOTA:
1. Such proposed assessment, as amended, a copy of which is attached
hereto and made a part hereof, is hereby accepted and shall constitute
the special assessment against the lands named therein, and each tract of
land therein included is hereby found to be benefited by the proposed
improvement in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending
over a ,period of 10 years, the first of the installments to be payable on
or before the first Monday in January, 1971 and shall bear interest at the
rate of 6% per annum from the date of the adoption of this assessment
resolution. To the first installment shall be added interest on the entire
assessment from the date of this resolution until December 31, 1970. To
each subsequent installment when due shall be interest for one year on
all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certifica-
tion of the assessment to the County Auditor, pay the whole of the assess-
ment on such property, with interest accrued to the date of payment, to the
City Treasurer, except that no interest shall be charged if the entire
assessment is paid within 30 days from the adoption of this resolution;
he may thereafter pay to the County Treasurer the installment and interest
in,?rocess of collection on the current tax list, and he may pay the remain-
ing principal balance of the assessment to the City Treasurer.
4. The Clerk shall forthwith file the assessment rolls pertaining to this
assessment in his office and shall certify annually to the County Auditor
on or before October 10 of each year the total amount of installments and
interest which are to be come due in the following year on the assessment
on each parcel of land included in the assessment roll.

REGULAR COUNCIL MEETING - 12 - SEPTEMBER 28, 1970
Discussion was then held concerning the questions raised on the southwest
storm sewer hearing. The City Engineer in conjunction with the Consultant
Engineer were directed to investigate the validity of the claims presented
and adjust the assessments as required.
Thereupon, Alderman Black introduced Resolution No. 3087, resolution
adopting assessment roll No. 35, Project 17-7, Southwest Storm Sewer, and
moved its adoption. Alderman Peterson seconded the motion and upon vote
being taken all members voted "aye"' and said resolution was declared
adopted unanimously.

MINNESOTA:
1. Such proposed assessment, as amended, a copy of which is attached
hereto and made a part hereof, is hereby accepted and shall constitute the
special assessment against the lands named therein, and each tract of land
therein included is hereby found to be benefited by the proposed improvement

OCTOBER 6, 1970
Mayor Kost called the meeting to order at 1:10 P.M. pursuant to
notice as published in the official newspaper on Wednesday, September
30, 1970 and Friday, October 2, 1970.
Members present were: Mayor Kost, Alderman Black, Alderman Linder,
Alderman Alrick. Also present were Administrative Assistant Mealey,
Engineer Priebe.
The meeting was convened for the purpose of public review of the
proposed 1971-1972 budget.

Subject Application for Federal Grant Assistance for Park Purchase
Gentlemen:
We have finally received design plans and quantity estimates from our
consultant for the 55 acre parcel on the Crow River owned by Earl and Loretta
McDonald.
As you will recall, both bodies authorized a joint application for grant
funds through the "Open Space" program of the Department of Housing and
Urban Development. While waiting for the design and quantity estimates
to be done this summer, one of those whimsical flukes of fate occurred and
the Congress re -funded a program through the Department of the Interior
for "outdoor Recreation".
This latter program is one in which the State of Minnesota participates
to the extent of 50% of the local share of the project. Since the HUD
program is a 50%-25/0./-25% project, I contacted the Minnesota Office of
Local and Urban Affairs of the State Planning Agency regarding the program.
I am recommending that we make this application through the Office of
Local and Urban Affairs of the State of Minnesota to the Bureau of Outdoor
Recreation of the Department of the Interior. To do this, and to simplify
the considerations of the application, I believe that the City of Hutchinson
should be the applying agency rather than a joint application.
The application continues all the provisions for reservation of
approximately 20 acres of the 55 acre 'ac quis ition for establishment of
an ecology lab and nature conservancy under the direction and control of
the School District. But for reasons of simplicity and pressing time (since
the application must be in by October 15) I believe that a one agency
application would be easier to make.

I would like to have you place on the agenda for Monday evening's
council meeting a request for a conditional use permit from 11-1-70
to 11-1-71.
This request is for the purpose of Midwest Module setting up a
model mobile home on our property in the City df Hutchinson. This
model home will be used as a temporary situation and a sales office
until such time as we can put it on one of the regular pads that
we will be constructing.
It is further understood by Mid West Module that this is a
temporary use permit and that the sewer and water are only a
temporary hook up.
If the special use permit is granted it will not be construed
as being a permanent situation by Mid West Module. I will be at
the meeting that evening should there be any questions; I will
be happy to answer them at that time.

ORDINANCE NO. 381
A MODEL ORDINANCE REGULATING THE MANUFACTURE
STORAGE, HANDLING, USE AND SALE OF EXPLOSIVES
AND PROVIDING A PENALTY FOR VIOLATION THEREOF
THE CITY OF HUTCHINSON ORDAINS:
Section 1. Scope
(a) This ordinance shall apply to the manufacture,
keeping, having, storage, sale, transportation, and use
of explosives and blasting agents.
(b) It shall not apply to the following:
(1) Transportation of explosives or blasting
agents when under the jurisdiction of and in com-
pliance with the regulations of the Federal Depart-
ment of Transportation.
(2) Shipment, transportation and handling of
military explosives by the Armed Forces of the United
States and the State Militia
(3) Transportation and use of explosives or
blasting agents in the normal and emergency opera-
tion of federal agencies or state or municipal fire
and police departments, providing they are acting
in their official capacities and in the proper per-
formance of their duties.
(4) Sale and use (public display) of pyro-
technics commonly known as fireworks.
(c) This ordinance shall not apply to the following
commodities and items:
-(1) Stocks of small arms ammunition; propellant -
actuated power cartridges; small arms ammunition
primers in quantities of less than 1,000,000 smoke-
less propellant in quantities of less than 750 pounds.
(2) Explosive actuated power devices when in
quantities of less than 50 pounds net weight of ex-
plosives.
(3) Fuse lighters and fuse igniters.
(4) Safety fuse (safety fuse does not include
cordeau detonant fuse), and 3/32 inch cannon fuses
or matchlock fuses (slow match).
(5) The sale or transfer of black pdwder or
other commonly used non -smokeless propellant in indi-
vidual transactions involving quantities of five (5) pounds
or less when used for muzzle loaded sports equipment.

Section 2. Definitions
In this ordinance, the following words are used as defined below:
(a) Blasting agent shall mean any material or mixture con-
sisting of a fuel and oxidizer, intended for blasting not other-
wise classified as an explosive and in which none of the in-
gredients are classified as an explosive, provided that the
finished product, as mixed and packaged for use or shipment,
cannot be detonated by means of a No. 8 test blasting cap
when unconfined.
NOTE 1: A No. 8 test blasting cap is one
containing two grams of a mixture of 80%
mercury fulminate and 20% potassium chlor -
late, or a cap of equivalent strength.
NOTE 2: Nitro -Carbo -Nitrate. This term
applies to any blasting agent which has
been classified as nitro -carbo -nitrate
under the Department of Transportation
Regulations, and which is packaged and
shipped in compliance with the regula-
tions of the Department of Transportation.
(b) Explosive -actuated power devices shall
mean any tool or special mechanized device which
is actuated by explosives, but not to include
propellant -actuated power devices. Examples of
explosive -actuated power devices are jet tappers
and jet perforators."
(c) Explosive or explosives shall mean any
chemical compound, mixture or device, the primary
or common purpose of which is to function by ex-
plosion, i.e., with substantially instantaneous
mixture or device is other wise specifically clas-
sified by the DOT (formerly ICC). The term'Ex-
plosives' shall include all material which is
classified as Class A, Class B and C1ass.0 . . .
NOTE 1: Classification of explosives is
described by the Department of Transpor-
tation, DOT (formerly Interstate Commerce
Commission, TCC) as follows:
(1) Class A Explosives. Possessing, deto-
nating or otherwise maximum hazard; such as
dynamite, nitroglycerin, picric acid, lead
azide, fulminate of mercury, black powder,
blasting caps, and detonating primers.
(2) Class B Explosives. Possessing flam-
mable hazard, such as propellant explosives
(including some smokeless propellants).

photographic flash powders, and some spe-
cial fireworks.
(3) Class C Explosives. Includes certain
types of manufactured articles which contain
Class A or Class B•explosives, or both, as
components but in restricted quantities.
(4) Forbidden or Not Acceptable Explosives.
Shall mean explosives which are forbidden or not
acceptable for transportation by common carriers
by rail freight, rail express, highway, or water in
accordance with the regulations of the DOT
(formerly ICC).
NOTE 2: Certain chemicals and certain fuel
materials may have explosive characteristics
which are not specifically classified by the
DOT (formerly ICC) and are not readily classi-
fied for coverage in the Code. Authoritative
information should be obtained for such un-
classified materials and action commensurate
with their hazards, location, isolation and
safeguards, should be taken.
(d) Highway shall mean any public street, public alley
or public road.
(e) Inhabited buildings shall mean a building or struc-
ture regularly used in whole or in part as a place of human
habitation. The term "inhabited building" shall also mean
any church, school, store, railway passenger station, air-
port terminal for passengers, and any other building or
structure where people are accustomed to congregate or
assemble, but excluding any building or structure occupied
in connection with the manufacture, transportation, storage
and use of explosives.
(f) Magazine shall mean any building or structure,
other than an explosives manufacturing building, approved
for the storage of explosives.
(g) Motor vehicle shall mean any self-propelled ve-
hicle, truck, tractor, semi -trailer, or truck -full trailers
used for the transportation of freight over public highways.
(h) Propellant -actuated power devices shall mean any
tool or special mechanized device or gas generator system
which is actuated by a smokeless propellant or which releases
and directs work through a smokeless propellant charge.
(i) Person shall mean any individual, firm, co -partner-
ship, corporation, company, association, joint stock associa-
tion, and including any trustee, receiver, assignee or per-
sonal representative thereof.
(j) Public conveyance shall mean any railroeld car,
street car, ferry, cab, bus, airplane, or other vehicle
which is carrying passengers for hire.
(k) Railway shall mean any steam,.electric, diesel,
electric or other railroad or railway which carries passen-
gers for hire on the particular line or branch in the vicinity
where explosives are stored or where explosives manufacturing
buildings are situated.

(1) Small arms ammunition shall mean any shotgun, rifle,
pistol or revolver cartridge, and cartridge for propellant -actuated
power devices and industrial guns.. Military -type ammunition containing explosive
bursting charges, spotting or pyrotechnic projectiles is excluded from this
definition.
(m) Small arms ammunition primers shall mean small percussion -
sensitive explosive charges, encases in a cup to ignite propelland powder.
(n) Smokless propellants. Smokeless propellants, commonly called
smokeless powders in the trade, used in small arms ammunition, cannon, rockets,
propellant -actuated power devices, etc.
(o) Special industrial explosive devices shall mean explosive -
actuated power devices and propellant -actuated power devices.
(p) Special industrial explosives materials shall mean shaped
materials and sheet forms and various other extrusions, pellets, and packages
of high explosives, which include dynamite, TNT, PETN, RDX, and other similar
compounds used for high -energy -rate forming, expanding and shaping in metal
fabrication, and for dismemberment and quick reduction of scrap metal.
SECTION 3. Mandatory Permits for Acquisition and Use.
It shall be unlawful for any person to acquire, possess, use,
sell or handle any explosive as defined in section 2 of this ordinance,
except as otherwise provided by section 1, within the City of Hutchinson
without having a permit in his possession.
(a) Such a permit shall be issued only by the City Clerk,
upon approval of the City Council.
(b) Any person desiring a permit as required by this section
shall make application therefor in writing to the City Clerk
on such forms as the City Council may prescribe.
(c) Before any permit is issued by the clerk he shall notify
the Chief of the Fire Department and the Chief of Police, that
such permit is desired. Upon receipt of such notification the
Fire Chief shall inspect the premises upon which the applicant
desires to store, handle and use the explosives set forth in the
application and if he is satisfied (1) that no serious fire hazard
will be created, and (2) that the applicant plans to store and
use the explosives in the manner prescribed by this ordinance, he
shall endorse his approval upon said application and return it to
the clerk who shall present the same to the Council.
(d) The Council shall deny the issuance of any such permit to
anyone who:
(1) Has been convicted within the past ten (10) years of
a felony or gross misdemeanor involving moral turpitude
or anyone who is presently under indictment for any such crime;
or
(2) Has been within the past ten (10) years convicted of a
crime in which the use, possession or sale of narcotics or
illicit drugs was an element; or

(3) Has been treated within the past ten (10)
years for addiction to narcotic or illicit drugs, or
has been within such time period admitted to any
hospital or institution for treatment of narcotic
or illicit drug addiction, or has been within such
time period, certified by a licensed medical doctor
as being addicted to narcotic or illicit drugs; or
(4) Has been within the past ten (10) years, treated
for alcohol addiction, admitted to any hospital or in-
stitution for treatment of alcohol addiction, or certified
by a licensed medical doctor as being addicted to alchol;
or
(5) Has been within the past ten (10) years, admitted to any
hospital or institution because of or for treatment of any
mental deficiency, or certified by a licensed medical doctor
as being mentally ill or mentally deficient; or
(6) Has been within the past ten (10) years, acquitted of
any criminal charge by reason of insanity; or
(7) Is not twenty-one (21) years of age at the time when
application for such permit is made.
(d) If the Council grants the permit the Clerk shall, upon receipt of
a fee, established by Council by resolution, prepare and deliver to said
applicant such permit as is requested in said application, provided that
no permit shall be granted for a period as determined by Council action
at the time of permit application.
SECTION 4. Permit Application
The application for a user's permit shall be sworn to by the
applicant and shall contain the following information
(a) Name and address of the applicant;
(b) The applicants date of birth;
(c) Where applicant intends to permanently store the explosives
he intends to use and the storage security measures provided at
the storage and use sites;
(d) The applicant's intended use for explosives he purchases
pursuant to any permit that may be issued to him; and
(e) All such additional information as may be prescribed by
the City Council in determining whether the applicant is qualified
pursuant to section 3 of this ordinance to possess such permit.
SECTION 5. Permit Revocation
A permit may be revoked or suspended at any time by order of the
City Council for any violation of the provisions of this ordinance or
upon the creation or existence of any condition which would be in the
opinion of the Chief of the Fire Department or Chief of Police create or
tend to create a serious fire hazard.

SECTION 6. May Not Transfer to Unauthorized Person
No person shall sell, transfer or give away any explosive or
blasting agent to anyone who does not possessa valid permit issued
pursuant to section 3 of this ordinance.
SECTION 7. Seller's Record.
Every person selling or giving away any explosives covered by
this ordinance shall keep at all times an accurate record in a bound
book, of all such explosives handled by him, indicating a detailed
account of:
(a) Date of each transference of explosives;
(b) Amount of each such transference;
(c) Name and address of each purchasor or transferee;
(d) Manufacturer of the explosives being transferred;
(e) The type of and any identification numbers of explosives
being transferred;
(f) Explosives owner's or user's permit number;
(g) Intended place of storage of the explosive by the
purchasor or transferee;
(h) Intended use site; and
(i) Security measures provided at the storage site and at the
use site.
Such record book shall at all reasonable times be open to the
inspection of the Chief of the Fire Department and Chief of Police and
all duly constituted law enforcement officials of the City of Hutchinsgn.
In addition on the first day of every month the seller or transferor
shall make a report to the Chief of the Fire Department or Chief of
Police of the transactions which took place that month.
SECTION 8. Storage and Security Requirements.
Any person storing handling, using or in any way disposing of
explosives covered by this ordinance shall maintain minimum safety and
security features of all permanent and temporary storage facilities in
a manner prescribed by the rules and regulations of the Minnesota State
Fire Marshall governing the storage, handling, use and transportation of
the blasting agents and explosives.
SECTION 9. Report of Thefts.
Any person who has explosives in his possession and who incurs
a loss or theft of all or a portion thereof upon discovery of such loss
or theft shall immediately, and in no event longer than twenty-four (24)
hours from the time of discovery, inform the office of the local Chief of
Police of the loss or theft, the amount missing and the approximate time
of the occurence.

SECTION 10. Bomb Threats.
It shall be unlawful for anyone:
(a) As a hoax, to communicate or cause to be communicated the
fact that a bomb or any other explosive device has been placed in any
building or in any location other than a building.
(b) As a hoax to threaten to bomb any person, place or building.
(c) To knowingly permit any telephone or other means of
communication under his control to be used for any purposes prohibited by
this section.
(d) As a hoax, to place or cause to be placed in any location
any article, constructed or placed with intent to give the impression
that said article possesses explosive capability.
SECTION 11. Penalty.
Any person who shall violate any provision of this ordinance shall
upon conviction thereof before the Municipal Court of the City of
Hutchinson, be punished by a fine of not more than $300.00, or ninety
(90) days for each such offense.
SECTION 12. Severability.
The contents of this ordinance are declared to be severable and should
any section, clause, paragraph or provision hereof be declared by any
court to be invalid, the same shall not affect the validity of the
ordinance as a whole or any part thereof other than the part so declared
to be invalid.
SECTION 13. Effective Date
This ordinance shall take effect and be in force from and after its
publication.

Section IV. This ordinance shall be final and shall take effect and be
in force after filing certified copy thereof with the Minnesota Municipal
Commission, the County Auditor and the Secretary of State, and from and
after its passage and publication.
