E-1 HUTCHINSON UNIT - WEST CENTRAL MENTAL HEALTH CENTER (attached) Alderman Alrick seconded the motion and upon vote being taken, all members present voted "aye" and Resolution No. 3928 was declared adopted by the City Council this 23rd day of March, 1970. Planning Commission's recommendation to table the request for pre zoning prior to annexation by Thomas E. and Alyce Mealey was considered along with the Mealey request for withdrawal of annexation petition. After due consideration Alderman Black moved that the request for withdrawal of petition be granted. Alderman Alrick seconded the motion and it was carried unanimously. Planning Commission's recommendation to table request of Midwest Modules, Inc. request for pre zoning to R-2 was noted. Planning Commission's recommendation to deny request by Cecil Conquest for rezoning R-1 to R-2 was considered. Alderman Alrick moved the Planning Commission's recommendation be accepted by the Council. Alderman Black seconded the motion and it was carried unanimously. Planning Commission's recommendation for pre zoning of Mini -Mods, Inc. to R-2 was considered. Alderman Black then introduced the following resolution and moved its adoption: RESOLUTION NO. 3029 PRE ZONING MINI -MODS, INC. PROPERTY TO R-2 (attached) Alderman Jensen seconded the motion and it was carried unanimously, whereupon, Resolution No. 3029 was declared adopted by the City Council this 23rd day of March 1970. REGULAR COUNCIL PROCEEDINGS -4- MARCH 23, 1970 Planning Commission's recommendation to deny rezoning request by Charles Draeger was duly considered. Alderman Alrick moved the Council accept the Planning Commission's recommendation, Alderman Black seconded the motion and it was carried unanimously. Discussion was held concerning the preliminary plat of Loren's Addition submitted to the Planning Commission by L. A. Richards. Alderman Black stated that it appears that the adjoining property owners are not sufficiently cognizant' of the potential effect of this plan on their property and recommended that they be made clearly aware of the ramifications of such a plan. Adm. Asst. Mealey stated tl-a t he would call Mr. Richards to be sure that this is accomplished. Alderman Alrick moved that the subject be tabled until the next Council Meeting. Alderman Black seconded the motion and it was carried unanimously. Alderman Black introduced Ordinance No. 359 for its second and final reading and moved its adoption as follows: ORDINANCE NO. 359 AN ORDINANCE PERTAINING TO FINES AND SENTENCES FOR ORDINANCE VIOLATIONS IN THE CITY OF HUTCHINSON (attached) Alderman Jensen seconded the motion and upon vote being taken all members present voted "aye" whereupon Ordinance No. 359 was declared adopted by the City Council this 23rd day of March, 1970. At the hour of 8:00 PWM. Alderman Linder declared open Public Hearing on -Assessment Roll for Project 1968-3, Watermain and Sanitary Sewer Project. There were no persons present to object or comment. Consideration was given to the document as presented to the Council. Alderman Black moved the hearing be closed. Alderman Jensen seconded the motion and it was approved unanimously. Alderman Black introduced the following resolution and moved its adoption: RESOLUTION NO. 3030 ADOPTING ASSESSMENT ROLL, PROJECT 1968-3, WATERMAIN AND SANITARY SEWER (attached) Alderman Jensen seconded the motion and upon vote being taken all members present voted "aye" and Resolution No. 3030 was declared adopted by the City Council this 23rd day of March, 1970. REGULAR COUNCIL PROCEEDINGS MIS MARCH 23, 1970 Alderman Linder introduced the following resolution and moved its adoption: RESOLUTION NO. 3031 RESOLUTION ESTABLISHING REDUCED TRASH AND REFUSE RATES FOR ELDERLY RESIDENTS ON REDUCED FIXED INCOME (Attached) Alderman Black seconded the motion whereupon Resolution No. 3031 was declared adopted by the City Council this 23rd day of March, 1970. Alderman Linder moved the American Legion's application for Club On -Sale license L be approved by Council. Alderman Alrick seconded the motion and it was carried unanimously. Mealey reported receipt of $5,000 from the Municipal Liquor Store and requested approval of transfer to General Fund. Alderman Black so moved, seconded by Alderman Alrick and motion was carried unanimously. Application for permit to park trailer at McDonald's Mobile Home Park was presented. Alderman Alrick moved application be approved. Alderman Black seconded the motion and it was carried unanimously. Adm. Asst. Mealey presented request from Engineering Department to consider a Change Order to Project 1969-1, Part II in order to most easily resolve the preliminary problems of construction of the service road on Highway 15 South from the Hospital to the cemetery, involving construction of sewer, water and storm sewer Alderman Black moved the Engineer's request be approved. Alderman Alrick seconded the motion and it was carried unanimously, Adm. Asst. Mealey presented City Engineer's request for small addition to be made to the Lynn Road section of 1970-1, Street Improvement, in order to properly design the intersection of Lynn Road and Washington Avenue, and requested date for hearing be set for April 27. The addition to consist of the portion between Lynn Road and Grove Street on Washington Avenue. Alderman Black moved this request be approved, and the time set for 8:00 P--.-M-.-- Alderman .M.Alderman Alrick seconded the motion and it was carried unanimously. -- Adm. Asst. Mealey requested permission to engage Rieke -Carroll -Muller to assist in development of construction plans for street improvements on an hourly_ basis to relieve the over -burden on the City Engineering Department. Alderman Black moved the request be approved. Alderman Linder seconded the motion and it was carried unanimously. Alderman Black moved that April 13 be established for cutoff date for petitions for service for sewer and water in order that time be allowed for hearings and projects planned and completed before freeze up..Alderman Alrick seconded the motion and it was carried unanimously. Alderman Black moved that the City Council accept Planning Commission's recommenda- tion to reappoint Mr. David Jensen for a full term on the Planning Commission. Alderman Linder seconded the motion and it was carried unanimously. SPECIAL COUNCIL MEETING MARCH 25, 1970 A special Council meeting was called to order by Mayor Kost at 8:30 A.M. Wednesday, March 25, 1970 to take up the subject of the purchase of the Rebecca Blenn home at 122 Franklin Street, for addition to the off street parking system of the City of Hutchinson. Members present: Mayor Kost; Alderman Linder, Black, Alrick Jensen. Also present: Engineer Priebe, Attorney Schantzen, Adm. Asst. Meaiey After discussion of the question, Alderman Black moved that the Mayor and Clerk be authorized to purchase the property from the off-street parking fund and redeem investments sufficient to pay the purchase price of $25,000 plus closing costs. The purchase price shall be paid on delivery of good and marketable title except that the schedule of payment shall be as follows to wit: $5,000 immediately; $10,000 on April 15, 1970, and $10,000 on June 1, 1970 if vacant at that time, or upon vacation of the premises if earlier than that date. Closing costs and taxes to be paid upon statement submitted by attorney for seller. The motion was seconded by Alderman Alrick and upon vote being taken, all members present voted "Aye" and the motion was carried unanimously. Meeting was declared adjourned at the hour of 9:05 A.M. S (PUBLISHED IN THE HUTCHINSON LEADER, FRIDAY, MARCH 27, 1970) PUBLICATION NO. 1260 ORDINANCE NO. 362 AN ORDINANCE REGULATING GARBAGE AND REFUSE COLLECTION WITHIN THE CORPORATE LIMITS OF THE CITY OF HUTCHINSON THE CITY OF HUTCHINSON DOES ORDAIN: SECTION Z. All garbage and refuse accumulation in the City of Hutchinson shall be accumulated, conveyed and disposed of by the City of Hutchinson through its legally authorized agent, the City Collection Contractor. No person shall collect or convey for hire over any of the streets or alleys of the City, or dispose of any garbage accumulated in the City, except the City's duly authorized agent. SECTION II. For the purpose of this Ordinance the following terms, phrases, words, and their derivations shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number, the words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory. (1) "Garbage" is animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food. (2) "Garbage and Refuse Collection Contractor" is the person with whom the City shall contract for collection of garbage and refuse in the City. (3) "Refuse" is all wastes (except body wastes), including rubbish, tin cans, paper, cardboard, yard clippings, glass jars and bottles and wood normally resulting from the operation of a household or business establish- ment, but not including garbage. (4) "Commercial Establishment" is any premises wherea commercial or industrial enterprise of any kind is carried on, and shall include clubs, churches and establishments of non-profit organizations, where food is prepared or served or goods are sold. (5) "Single Family Residential Unit" is any household with a single family residing therein. (6) "Multiple Family Residential Unit" is any household wherein more than one family resides. SECTION III. All garbage and refuse accumulated in the City shall be collected, conveyed, and disposed of by the City of Hutchinson through its legally authorized agent, the City Collection Contractor. No person shall for hire collect, convey over any of the streets or alleys of the City, or dispose of any garbage accumulated in the City, except the duly authorized City Garbage and Refuse Collector, provided that this Ordinance shall not prohibit the disposal of garbage in dwellings by any device which grinds and deposits the garbage in a sewer. The Garbage and Refuse Collection Contractor and his employees shall have the right to enter upon private property at all reasonable hours of the day for the purpose of collecting garbage and refuse. - 1 - ,r i SECTION IV. All garbage and refuse accumulated on any premises shall be placed and maintained in containers. Garbage and refuse containers shall be provided by the owner, tenant, lessee or occupant of the premises. Such container shall be maintained in a good, clean, neat and sanitary condition at all times. The garbage containers shall be equipped with handles, tight fitting covers and shall be water tight. The garbage containers shall have a capacity of not more than thirty (30) gallons. SECTION V. Garbage and refuse containers shall be placed for collection at one place at ground level on the property and accessible to the street or alley from which collection is made. SECTION VI. Garbage and refuse accumulated at residential properties shall be collected at least once each week. The owners of premises upon which garbage or refuse is accumulated who desire personally to collect and dispose of their own garbage and refuse shall use a container provided with a tight cover so operated and maintained as to prevent offensive odors escaping therefrom, and refuse from being blown, dropped or spilled from the container. The ownership of garbage and refuse material set out for collection and collected by the City Garbage Collection Contractor shall be vested in the City. SECTION VII. The City shall make a charge against each single family residential unit, each complex of multiple dwellings, and each commercial, industrial, religious and educational establishment. The monthly charge shall be established by resolution of the City Council and shall from time to time be increased or decreased in the same manner, as the -Council in its best judgment shall determine necessary to defray the costs of collection. The charges for garbage and refuse colle ction shall be made on three (3) month billing periods. All accounts shall be considered delinquent if not paid by 20 days after the due date. All delinquent accounts shall be certified by the City Clerk of the City of Hutchinson, who shall prepare an assessment roll each year on or before October 1, providing for assessment of the delinquent amounts against the respective properties served. SECTION VIII. The City Garbage and Refuse Collection Contractor shall and is hereby authorized to negotiate for the collection of garbage and refuse with the owners or occupants of multiple family residential units, commercial establishments and industrial establishments and educational and religious establishments located within the City of Hutchinson. Any dispute for charges, by said customers and the Contractor, or Contractor and said customers, shall be allowed to be appealed by either party to the City Council of the City of Hutchinson, who shall then set and establish the collection fee. SECTION IX. No commercial collection and refuse hauler shall operate on the streets, alleys and right-of-ways of the City of Hutchinson without a permit by the City Council, and in no instance shall collection of garbage and refuse for hire be made within the City by a Commercial hauler or any other hauler, with vehicles other than those equipped with regulation garbage "packers". SECTION X. Should any section, sub -section, sentence, clause or phrase of this Ordinance, for any reason, be held invalid, such decision shall not off -set the validity of the remaining portions of this Ordinance. The City of Hutchinson hereby declares that it would have passed this Ordinance and each section, clause, sentence and phrase hereof, irrespective of the possibility that any one or more sections, sub -sections, clauses sentences of phrases be declared unconstitutional or invalid. 2 - SECTION XI. Ordinance No. 286, together with the provisions of any ordinances or parts of ordinances heretofore enacted which are in conflict herewith, are hereby repealed. SECTION XII. Any person, firm or corporation violating any provision of this Ordinance, upon conviction thereof, shall be fined not to exceed $300.00 or by imprisonment in the county jail for not more than ninety (90) days. SECTION XIII. That the City Council of the City of Hutchinson has investigated the necessary facts to ascertain, and does hereby find, determine and declare, that the matter of accumulation, collection and disposition of garbage and refuse does have a direct and immediate effect upon the public peace, health, welfare and safety of the inhabitants of the City of Hutchinson and the establishment of this Ordinance and of the rules, laws and regulations set out herein are re- quired to protect the public peace, health and safety and welfare of the inhabitants of said City. SECTION XIV. This Ordinance shall be in full force and effect from and after its passage and publication in the official City newspaper. The preliminary plat of Hanson's third Addition was presented to Council. Alderman Black moved that public hearing be set for April 20, 1970 at 8:00 PM. Alderman Alrick seconded the motion and it was carried unanimously. Further discussion was held on the Street Improvement Project. Alderman Linder then introduced the following resolution and moved its adoption: RESOLUTION NO. 3032 RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS (Attached) Alderman Alrick seconded the motion and it was carried unanimously whereupon Resolution No. 3032 was declared adopted by the City Council this 23rd day of March, 1970. Alderman Linder then introduced the following resolution and moved its adoption: RESOLUTION NO. 3033 RESOLUTION ORDERING PREPARATION OF REPORT ON IMPROVEMENT (Washington Avenue Section of Lynn Road - Attached) Alderman Alrick seconded the motion and it was carried unanimously whereupon Resolution No. 3033 was declared adopted by the City Council this 23rd day of March, 1970. Discussion on trash burning. Mayor Kost stated that the City is required to prohibit burning under state law. Alderman Black moved that the question of City ordinance be referred to City Attorney. Alderman Linder seconded the motion and it was carried unanimously. Discussion on the Housing Code. Adm. Asst. Mealey reported that the Building Inspector has begun a program of making Housing Code inspections of dwellings for which a final water reading has been called, in the hope that the more . obvious deficiencies prior to occupancy might be corrected. He asked approval to send a letter to each of the real estate agencies dealing in in -city properties to advise them of this system. Mayor Kost directed the Administrative Assistant and Building Inspector to meet with the real estate agencies for discussion of the plan. Adm. Asst. Mealey reported that County Auditor Schultz has asked that the Council make a firm commitment this week as to whether or not it is preferred that the City Clerk be appointed Deputy Registrar - Motor Vehicles. Further, that prior to appointment of any new Deputy Registrar, it is required that a three-day intensive training program be taken, established as April 6, 7, 8, in St. Paul. Adm. Asst. Mealey requested that he be authorized to attend the training session and to appoint a person to handle the office and see that that person is trained. After due deliveration, Alderman Black moved that the City Clerk be appointed Deputy Registrar for Motor Vehicles and make necessary plans for establishment of this office in City Hall. Further that the City Clerk be authorized travel expense to attend the training sessions in St. Paul. Alderman Linder seconded the motion and it was carried unanimously Adm. Asst. Mealey reported that there are several small parcels of land entirely surrounded by the City, but still part of the townships, and others surrounded on three sides. Alderman Black moved that a hearing be held on April 13, at 8:00 P.M. for the purpose of hearing the property owners' opinions regarding annexation. Alderman Black further moved that the City adopt a firm policy to effect annexation of every property which is or becomes 100% surrounded by the City of Hutchinson. Alderman Linder seconded the motion and it was carried unanimously. Im REGULAR COUNCIL PROCEEDINGS MARCH 23, 1970 Alderman Black moved that the Mayor and City Clerk be authorized to sign Termination of Agreement between The City of Hutchinson and Leonard Miller, dba Hutchinson Refuse Service; and Contract with Mr. J. Junkers, dba Junkers Sanitation Service at such time as these indentures have been signed by the parties of the second part. Alderman Linder seconded the motion and it was carried unanimously. There being no further business, motion was made seconded and carried to adjourn at the hour of 11:20 P.M. - 7 -
