Motion carried.
Recommended getting estimates from. 4 firms on central air conditioning
and furnace so this it em might be placed in budget. Recommended Marty's
Roofing be contacted for estimate on roof repair.
Studied budget and made estimates of needs for 1971.

NOTICE OF HEARING FOR CONVERSION OF CITY OWNED GENERATOR
Sealed proposals will be accepted by the City Council of the City of
Hutchinson until 7:30 P. M., August 10th for conversion of a City owned
100 KW Generator to natural gas fuel, enclosing in weatherproof housing
and installation near City Hall to provide Automatic emergency
generation for power uses in City Hall and Police Station.
Additionally, proposals should include price of a 5 KW 120/240
single phase engine driven generator with automatic load transfer
switch and test switch installed at South Park in the City of Hutchinson
to provide emergency power to transmitter located in the park.
All proposals must contemplate use of existing materials to the fullest
extent possible.
Proposals will be opened and publicly read at 7:45 P. M. on August 10th
by the City Council in the City Council Chamber.
The Council reserves the right to reject any and all proposals and to
waive any informalities in the manner of proposal.

That the City Council of the City of Hutchinson will consider the
vacation of the following alley, to -wit:
Alley located in Block 39, South 1/2 City
at a Regular Council Meeting on August 10, 1970, at 8:00 P. M., in the
Council Chambers of City Hall.
This publication is to give notice to all persons who may be interested
in the vacation of said alley to appear at above said described meeting
to be heard.

Water Bill, 108 Main South
Today I received a phone call from Mr. Burich at the Citizen's Bank.
He was perturbed that the bank had been paying the water bill at the
Senior Citizen's Center since the inception of the Senior Citizen's
program. He insisted that I reimburse the bank for the monies they have
paid over the years and bill the Senior Citizen's Center for that amount.
At his order I did order a readout of the meter and future bills will be
sent to the Senior Citizen's Center. I also reduced the current bill by
$7.80, the amount of the trash and refuse service, which is consistent
with our agreement with Mr. Junker not to charge for City Parks and
service refuse collection.
I was not here at the time of the origination of the Senior Citizen's
Center so I have no knowledge of arrangements that were made with the
Bank. I don't feel that I have authority to disburse monies in the manner
demanded by Mr. Burich.
If the practice of sending bills to the Bank was a breach of an agreement
with the City, I have no knowledge of such an agreement.
Part of Mr. Burich's choler seemed to arise from an expectation that we
should have detected this as an error and discontinued the billing earlier.
Apparently the Bank paid the bill each quarter and did not detect any
error or question the practice. I fail to see how our billing clerk or
myself could be expected to question this bill if the Bank did not.
At this point I must leave determination of Mr. Burich's request to the
Council.

In response to my letter to Francis Fisher, Regional Director of
the Chicago office of HUD, I have received the enclosed response signed
by Mr. Don Morrow for Mr. Fisher.
The letter outlines the status of the Hutchinson application at this
time, although the facts presented don't merit optimism for an early approval
for the housing project.
In previous years, it had been my experience that an application would
be approved within a 12 to 16 month period. Mr. Morrow's disclosure that
the backlog is now at least two years long points up the fact that although
federal expenditures for the program have grown at a rapid rate, demand
still outstrips the supply of aid funds.
I believe that we should again contact HUD officials if no word is
received concerning the processing of the application within two to three
months. I frankly wish that there would be a way I could suggest which
would provide an early solution to the housing problems of the elderly
in Hutch.

Dear Mr. Nelsen;
This is in reply to your letter of June 20, 1970 concerning the application for
Low Rent Housing in Hutchinson, .`Minnesota.
The application furnishes us with adequate information to document the community's
need for elderly housing in McLeod County and nothing further needs to be done
by the Authority.
As mentioned in your letter, the Chicago Region has exhausted its units for the
current Fiscal Year and no formal action can be taken until such time as Congress
approves additional funding. In addition, it should be stated that the Regional
Office has a backlog of applications that is approximately twice the amount of
one year's allocation under legislation now being considered.
Assuming Congress will take Favorable action on the pending legislation, the
Iiutebinson application will be included in the analysis of all applications to
determine the distribution of Program Reservations.
If sufficient funds are made available, the Hutchinson application will be
processed in Fiscal Year 1971 so that it can go under Annual Contributions
Contract- in Fiscal Year 1372.

NURSING HOME BOARD MEETING -- July 16, 1970
The Board of Directors for Burns Manor met July 16, 1970 at 12:oo noon, Burns
Manor, Hutchinson, Minnesota. All members were present, president Milan Braun presi-
ding. A welcome was given to the latest appointee to the Board, Heinz Fruck.
Minutes of the previous meeting were approved.
On motion by D. J. Black, seconded by Myron Johnson and carried, the bills for
the previous month were allowed on a basis of ability to pay.
Wallace Kurth led a discussion as to finances in relation to rates. Tentatitely
suggested ware rates of $11.00 for intermediate care facilities and $13.00 for
skilled care facilities. It was deemed advisable to study and consider this matter
further and the members agreed to convene for a special meeting Tuesday July 28, 1970
at 5:00 p.m. for this and other unfinished business.
The correspondence regarding preventive maintenance for the elevator was pre-
sented. The board decided not to accept the offer. Mrs. Geier was directed to ob-
tain the name and model of the elevator installed.
On motion by D. J. Black, seconded by Myron Johnson, and carried, with Heinz
Fruck abstaining from the vote, it was agreed to proceed to send the laundry to the
hospital.
The matter of the fire alarm system was discussed. Myron Johnson advised that
the cost would be $48.00 for each alarm and $21.00 per month for maintenance. On
motion by Myron Johnson, seconded by D. J. Black and carried, it was resolved that
the fire alarm system be installed.
Mrs. Geier reported that the total amount paid for the Van was $3,017.91.
There being no further business meeting ad36urned at 2:45 p.m.

BURNS MANOR SPECIAL BOARD MEETING -- July 28, 1970
A special meeting of the Board of Directors for Burns manor was called to order
July 28, 1970 at 5:00 p.m. at Burns Manor, president Milan Braun presiding. All
members were present.
Mrs. Geier reported the bank balance to be $1831.52.
On motion by Lucille Ulrich, sdconded by Vi Horrmann, it was resolved that Mavis J.
Geier should be appointed to the position of administrator, eliminating the position
of acting administrator.
The matter of rates was again place before the Board. Mrs. Geier reported on rates of
other homes in and around the area. She also advised the Board that Burns Manor had about
64 welfare residents and 65 private residents. On motion by D. J. Black, seconded by
Myron Johnson, and carried, the following policv was agreed on:
"As of Sept. 1, 1970, rates at Burns Manor shall be $12.00 per day for skilled
care facilities and $10.30 per day for intermediate care facilities. Private room res-
idents shall pay $1.00 premium per day in addition to rates set forth in accordance with
care provided. "
It was further resolved on motion by Heinz Fruck, seconded by Myron Johnson and
carried, that all accounts receivable shall be due on the 10th day of each month.
The administrator was directed to advise the residents and/or their guardians and
or trustees as to the foregoing action. She was further directed to advies the family
of residents Bakeberg, Kowalke, and Steck respectively, that 10 days from the date of
notice would be allowed for settlement of these residents overdue accounts.
The Board of Directors agreed to meet for regular meetings the first Thursday
following the 10th of each month at 12:00 noon.
There being no further business meetinT adjourned at 6:35 p.m., to reconvene
August 13, 1970, 12:00 noon at Burns Manor.

RECREATION AND PARK BOARD
AUGUST 5, 1970
Meeting was called to order by Dick Peterson at 7:30 at the
Hutch Cafe.
Members present were: Milt Lueneberg, Bud Daggett, Dick
Peterson, Les Linder, Don Falconer, Dr. May, and Spencer
Beytien.
Nominations were open and appointments made, as following:

Mayor Kost announced the reappointment of Mrs. Carl Moehring to the Hospital
Board for five years and reappointment of Mr. Donald Flynn to the Housing and
Redevelopment Authority for five years, and asked council approval of these
appointments. On motion by Alderman Black, seconded by Alderman Linder, both
appointments were confirmed by the Council.
Ordinance No. 374, annexation of the Mini -Mod property Northeast, was presented
by Alderman Black who moved its first reading. Seconded by Alderman Linder.
All present voted aye, whereupon the ordinance was declared passed at its
first reading.
Alderman Linder presented Ordinance No. 375, an ordinance annexing the Sam
Buehler property southeast, and moved its first reading. Second by Alderman
Black. All present voted aye, whereupon the ordinance was declared passed on
its first reading.
Alderman Black, presented Ordinance No. 372, an ordinance prohibiting open
burning in the City of Hutchinson and moved its second reading. Alderman
Alrick second. All present voted aye, whereupon the ordinance was declared
adopted at its second reading and the City Clerk was directed to publish the
ordinance pursuant to the provisions of the City Charter.
ORDINANCE NO. 372
AN ORDINANCE PROHIBITING OPEN BURNING IN THE CITY
OF HUTCHINSON, MINNESOTA
THE CITY OF HUTCHINSON DOES ORDAIN:
REGULAR COUNCIL MEETING - 4 - July 27, 1970

SECTION I. No person shall conduct, cause, or permit the
disposal of refuse, waste, or other solid material by open burning or cause,
suffer, allow or permit open burning of any type or manner within the City
limits of the City of Hutchinson.
SECTION II. Exceptions herefrom may be allowed upon application and
the granting of a special permit by the City Council. All applications for
a special permit shall be accompanied by a payment of a fee in the amount of
Five Dollars ($5.00) and the following are exceptions for which applications
may be made:
A. Fires purposely set for the instruction and training
of public and industrial fire -fighting personnel.
B. Fires set for the elimination of a fire hazard which cannot
be abated by any other practicable means.
C. Fires purposely set for forest or game management in
accordance with practices recommended by the Minnesota
Department of Conservation, the Minnesota Department of
Agriculture and the United States Forest Service.
D. The burning of hydrocarbons which must be wasted through
the use of atmospheric flares.
E. The burning of trees, brush, grass, and other vegetable
matter in the clearing of land, right-of-way maintenance
operations and agricultural crop burning.
SECTION III. This ordinance shall not apply to wood burning
fireplaces nor to fires used solely for the preparation of food by barbecuing.
SECTION IV. Any person violating any of the provisions of this
ordinance shall, upon conviction thereof, be punished by a fine of not
more than Three Hundred Dollars ($300) or by imprisonment for a period of
not more than ninety (90) days.
SECTION V. This ordinance shall be final and shall take effect
and be in force from and after its passage and publication.
Alderman Black introduced Ordinance No. 373, an ordinance establishing a
Park and Recreation Board for the City of Hutchinson, and moved its second
reading. Alderman Alrick second. All present voted aye, whereupon the
ordinance was declared adopted at its second reading and the City Clerk was
directed to publish the ordinance pursuant to the provisions of the City
Charter.
REGULAR COUNCIL MEETING - 5 - JULY 27, 1970
ORDINANCE NO. 373
AN ORDINANCE CREATING A PARK AND RECREATION BOARD
AND PRESCRIBING ITS DUTIES.
THE CITY OF HUTCHINSON DOES ORDAIN:
SECTION 1. That there is hereby created and established an advisory
board to be known as the Park and Recreation Board.
SECTION 2. That said board shall consist of seven members, six
of whom shall be appointed by the Mayor of said City of Hutchinson,
with the consent of the City Council of said City, and one member of
said City Council, to be designated by said Council, One member of the
Planning Commission of said City, designated by the commission, shall
be assigned to the Park and Recreation Board as non-voting delegate.
SECTION 3. The terms of the members first appointed by the Mayor
shall be for one, two, or three years, the Mayor, to designate in the
appointment notices the appointees for each of said respective terms,
and the terms of the successors to said appointees shall be for three
years except as otherwise provided in section 4 hereof. An appointive
member shall continue to serve until his successor is appointed.
SECTION 4. Any vacancy in the appointive membership shall be
filled by appointment by the Mayor, with the consent of said City
Council, and such appointee shall serve for the unexpired tam ,to filled.
SECTION 5. Said board shall elect from its membership a chairman,
a vice-chairman, and a secretary, who shall serve for such terms and shall
have such powers and perform such duties as may be prescribed in the rules of
said board.
SECTION 6. Meetings of the board shall be held at such times and
places as may be prescribed in the rules of the board or as may be fixed
by the chairman, consistent with such rules; provided, however, that at
least one meeting shall be held in each calender month.
SECTION 7. At least four members of the board, present at a meeting of
said board shall constitute a quorum for the transaction of business.
SECTION 8. it shall be the duty of said board:
(a) To study and determine the park and recreational needs of
the City, and to make recommendations to the Mayor and Council in respect
thereof, including general and specific matters of policies and of recre-
ational programs in furtherance of said needs of the City.

Dear Mr. Schumacher:
We have received complaints of excessive particulate emissions
on a grain and fertilizer loading and unloading operation in
Hutchinson, Minnesota. This loading operation is being
carried out by your subsidiary, Hutch Transport Company. Our
field investigators have made an inspection and found the
grain loading operation is in violation of -APC 6, "No person
shall cause or permit the handling, use, transporting or
storage of any material in a manner which may allow avoidable
amounts of particulate matter to become air -borne.
Pursuant to Minnesota Statutes, 1967, Chapter 116.08, said
violation is a misdemeanor punishable by 90 days and/or
$300, and each day of violation constitutes a separate
offense. In addition said -violation is subject to civil
actions upon certification of the matter to the Minnesota
Attorney General.
Within fourteen (14) days from the date of this letter you are
instructed to contact the Director of Air Quality, Mr. Edward
IA. Wiik, Nutri a proposal for coripi3ance with all Agency regu-
lations. Should this not be done the Agency will forthwith
certify this case to the Attorney General for immediate enforce-
ment -action as well as notify those persons in your vicinity
having authority in the enforcement of the general criminal law.
