SEPTEMBER 141, 1970
Mayor Kost called the meeting to order at 7:30 P.M. Present were Alderman Black,
Alderman Alrick, Alderman Linder Alderman Peterson and Mayor Kost. Also present
were Attorney Schantzen, Engineer Priebe and Administrative Assistant Mealey.
Invocation was given by Rev. Donald McCann.
On motion by Alderman Black, seconded by Alderman Linder, the following minutes were
approved as presented: Special Meeting August 12, Regular Meeting August 24, Special
Meeting August 24, Special Meeting September 1, 1970.
Alderman Black moved, Alderman Linder seconded that $10,000 be approved for
transfer from the Liquor Store Fund to General Fund. The motion was carried unanimously.

On motion by Alderman Linder, second by Alderman Black, The City Clerk was
directed to write a check against the General Fund Ambulance account to the
Ambulance Account, Community Hospital in the amount of $2,206. The Hospital will
administer and retain the revenues from the ambulance operation from now on.
REGULAR COUNCIL MEETING - 7 - SEPTEMBER 14, 1970
Earl Fitzloff next appeared to ask that consideration be given to asking the High-
way Department approval of the use of additional right of way for the extension of
Lynn Road in front of his store. Alderman Linder explained that he had directed
City Engineer to contact the District Engineer regarding the problem and asked for
a report. Engineer Priebe reported that the response of the District Engineer was
to the effect that if the City of Hutchinson insisted on the use of additional right
of way he would accede if we would accept closing of the present South bound off -
ramp at the junction of Lynn Road and Highway 15 and the closing of the highway
entry at South Grade Road. A letter to this effect would follow. Mr. Fitzloff
thought this would be too high a price to pay for the additional right of way. It
was then generally agreed to await development of the street and accommodate as
best possible as the development occurs.
A request from the Fire Department for $5,000 budgeted for capitol purchase escrow
was next presented. On motion by Alderman Alrick, second by Alderman Black, the Clerk
was instructed to draw a check in the amount of $5,000 to the Fire Department.
It then being 8:00 P.M. Mayor Kost called public hearing on assessment roll for
improvement project 1969-1, Part 1, Sewer, water and storm sewer. Appearing to
question their assessments were Mr. Oswald Olson, Ronald Horswell, Datloff Weseloh,
John Miller and representatives from Minnesota Mobile Park Developers. At 8:55
P.M. the hearing was declared closed, no one else appearing. After discussion,
Alderman Black introduced Resolution No. 3077, a resolution to adopt assessment roll,
and moved its adoption. Second was by Alderman Linder. Upon being put to vote,
all present voted "aye" and the resolution was declared adopted.
RESOLUTION NO. 3077
RESOLUTION ADOPTING ASSESSMENT ROLL
PROJECT 1969-1, PART 1 - WATERMAIN,
STORM SEWER AND SANITARY SEWER
WHEREAS, pursuant to proper notice duly given as required by law, the Council
has met and heard and passed upon all objections to the proposed assessment for the
improvement of Michigan Street from its North end in the Hutchinson Industrial Park
to Highway 7; East Highland Park Drive from Highway 7 to Hackberry Avenue; T. H.
15 Service Road from Century Avenue to the North line of the Southside Terrace Plat;
Lewis Avenue from Larson Street to West City limits; Proposed Emerson Street from
the North line of T. H. 7 and 22 to 700' North thereof by storm sewer,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:

I. Such proposed assessments as amended, a copy of which is attached hereto and
made a part hereof, is hereby accepted and shall constitute the special assessment
against the lands named therein, and each tract of land therein included is hereby
found to be benefited by the proposed improvement in the amount of the asessment
levied against it.
2. Such assessment shall be payable in equal annual installments extending
over a period of 10 years, the first of the installments to be payable on or before
the first Monday in January, 1971 and shall bear interest at the rate of 7 per cent
per annum from the date of the adoption of this assessment resolution. To the first
installment shall be added interest on the entire assessment from the date of this
resolution until December 31, 1970. To each subsequent installment when due shall be
added interest for one year on all unpaid installments.

3. The owner of any property so assessed may, at any time prior to certifica-
tion of the assesment to the County Auditor, pay the whole of the assessment on such
property, with interest accrued to the date of payment, to the City Treasurer,
except that no interest shall be charged if the entire assessment is paid within
30 days from the adoption of this resolution; and he may, at any time thereafter,
pay to the county treasurer the entire amount of the assessment remaining unpaid,
with interest accrued to December 31 of the year in which such payment is made.
4. The Clerk shall forthwith transmit a certified duplicate of this assessment
to the County Auditor to be extended on the proper tax lists of the county and such
assessments shall be collected and paid over in the same manner as other municipal
taxes.
Adopted by the Council this 14th day of September, 1970.
Mrs. Florence Satterlee then appeared before the Council to ask mediation in a
dispute she has with the contract trash and refuse hauler. The Council indicated
they would call Mr. Junker to appear before them to discuss the matter and other
questions relative to operation of the pickup service.
Superintendent of Parks, Fred Roberts then appeared to ask approval of design and
authority to negotiate contracts to erect a shelter and rest room facilities in
Northeast Park and shelter addition to the rest rooms in Riverview Park. Alderman
Peterson moved, seconded by Alderman Black, that the Mayor and Clerk be authorized
to negotiate and enter into contracts for the described improvements and committing
monies from the public sites trust fund for their accomplishment.
There then appeared Mr. Don Semple with Mr. Dick Larson and John Korngeible, to present
design plan for the proposed shopping center on Highway 15 South. Action of the
Planning Commission recommending approval was submitted. On Motion by Alderman
Linder, second by Alderman Black, the site plan and design was approved.
A letter from the Mrs. Jaycees requesting permission to hold a "Farmers Market's
in Library Square for one or two days between October 2nd and 10th, was read.
Approval of the Police Chief was noted. Alderman Linder moved, seconded by Alderman
Alrick, that permission be granted. All present voting "aye" the motion was declared
passed.
Action by the Airport Board, tentatively approving a sales office for aircraft at
the Airport was then taken up. On motion by Alderman Black, second by Alderman _
Linder, the Council approved the idea generally, with the same reservations 'mentioned_
by the Airport Board, to save the City harmless and resolution of space rental and
other needs.
Mayor Kost then reappointed Clint Tracy to the Utilities Commission subject to
Council ratification. On motion by Alderman Linder, Second by Alderman Black, the
appointment was confirmed.
REGULAR COUNCIL MEETING - 9 - SEPTEMBER 14, 1970
Ordinance No. 377, an ordinance to regulate the sale of non -intoxicating beverages
in the City of Hutchinson was then introduced by Alderman Black for its second and
final reading. Second was by Alderman Linder. On being put to vote, all present
voted aye. The Mayor then declared Ordinance No. 377 passed in its second reading
and directed its publication in the official newspaper.

Alderman Linder then introduced Resolution No. 3078, a resolution declaring cost
and ordering preparation of assessment roll, Project 17-7, Southwest Storm Sewer,
and moved its adoption. Second was by Alderman Black. On being put to the vote all
present voted "aye's and resolution No. 3078 was declared adopted.
RESOLUTION NO. 3078
DECLARING COST TO BE ASSESSED AND ORDERING
PREPARATION OF PROPOSED ASSESSMENT - PROJECT
17-7, SOUTHWEST STORM SEWER
WHEREAS, a contract has been let for the improvement of an area of the City
of Hutchinson known as the Southwest Storm Sewer District as outlined on the map on
file in the office of theCity Clerk by storm sewer construction
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:
1. The cost of such improvement to be specially assessed is hereby declared
to be $848,397.05.
2. The City Clerk, with the assistance of the Consulting Engineer shall
forthwith calculate the proper amount to be specially assessed for such improvement
against every assessable lot, piece or parcel of land, within the district affected,
without regard to cash valuation, as provided by law, and he shall file a copy of
such proposed assessment in his office for public inspection.
3. The Clerk shall, upon the completion of such proposed assessment, notify
the Council thereof.
Adopted by the Council this 14th day of September, 1970.
Alderman Linder then introduced resolution No. 3079 setting hearing date for the
assessment roll for project 17-7, Southwest Storm Sewer, for 8:30 P.M. in the
auditorium of City Hall on Monday, September 28th, 1970. Second was by Alderman
Black, and upon being put to vote, all present voted f1aye". Resolution No. 3079
was thereupon declared adopted.
RESOLUTION NO. 3079
RESOLUTION FOR HEARING ON PROPOSED ASSESSMENT
PROJECT 1707, SOUTHWEST STORM SEWER
WHEREAS, by a resolution passed by the Council on September 14, 1970, the
City Clerk was directed to prepare a proposed assessment of the cost of improving
an area of the City of Hutchinson known as the Southwest Storm Sewer District as
outlined on the map on file in the office of the City Clerk by storm sewer
construction,

AND WHEREAS, the Clerk has notified the Council that such proposed assess-
ment has been completed and filed in his office for public inspection,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:
1. A hearing shall be held on the 28th day of September in the City Hall
at 8:30 P.M. to pass upon such proposed assessment and at such time and place all
persons owning property affected by such improvement will be given an opportunity
to be heard with reference to such assessment.
2. The City Clerk is hereby directed to cause a notice of the hearing on the
proposed assessment to be published once in the official newspaper at least two weeks
prior to the hearing and he shall state in the notice the total cost of the improve-
ment. He shall also cause mailed notice to be given to the owner of each parcel
described in the assessment roll.

ment roll for project 1969-2. Street improvement roject, for 8:00 P.M., Monday,
September 28th, 1970. Second was by Alderman "'end upon being put to vote,
all present voted "aye," and resolution No. 3080 was thereupon declared adopted.
RESOLUTION NO. 3080
FOR HEARING ON PROPOSED ASSESSMENT
PROJECT 1969-2, STREET IMPROVEMENT
WHEREAS, by a resolution passed by the Council on August 24, 1970, the City
Clerk was directed to prepare a proposed assessment of the cost of improving T.H.
No. 15 Service Road from Century Avenue to Franklin Street by grading and graveling,
and grading and seeding of embankment, and Second Avenue SE from Arch Street to
Michigan Street; Michigan Street from Fourth Avenue SE to its North eWd in Hutchinson
Industrial Park by subgrade preparation and gravel, and Century Avenue from Jefferson
Street to T. H. No. 15; Sherwood Street from Century Avenue to its North end (to
end of existing surface on Sherwood Street) by subgrade preparation, base, bituminous
pavement, curb and gutter and storm sewer, and Randall Road from Century Avenue to
Bradford Street; Bradford Street from Century Avenue to Sherwood Street; Goebel
Circle from Roberts Road to South of Roberts Road in Rice Addition by subgrade prepara-
tion, gravel base, bituminous pavement, curb and gutter, and
WHEREAS, the Clerk has notified the Cquricil that such proposed asessment
has been completed and filed in his office for public inspection,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:
1. A hearing shall be held on the 28th day of September, 1970 in the City
Hall at 8:00 P.M. to pass upon such proposed assessment and at such time and place
all persons owning property affected by such improvement will be given an opportunity
to be heard with reference to such assessment

2. The City Clerk is hereby directed to cause a notice of the hearing on
the proposed assessment to be published once in the official newspaper at least two
weeks prior to the hearing, and he shall state in the .notice the total cost of the
improvement. He shall also cause mailed notice to be given to the owner of each
parcel described in the assessment roll.
Adopted by the City Council the 14th day of September, 1970.
Alderman Linder then introduced resolution No. 3081, accepting bid of Harold Juul
Contracting Company, Inc. for 1970-2 Sewer and Water Project, subject to the ability
of the City to sell its bonds on September 22 and subject to the City's reservation
d the right to delete any part of the project prior to January 1, 1971 without
penalty, and moved adoption.

REGULAR COUNCIL MEETING - 13 - SEPTEMBER 14, 1970
A report of the Planning Commission recommending rezoning the East half of Block
29, South half of City from R-1 Residential to B-2 Central Business District, was
read. Alderman Linder introduced Ordinance No. 379, an ordinance amending Ordinance
No. 245 and rezoning the East half of Block 29, South Half City and moved its first
reading. Alderman Black seconded the motion and upon being put to vote all present
voted "aye". The ordinance was then declared passed on its first reading.
Alderman Alrick moved that the City Clerk be directed to advertise a call for
proposals to remove the old nurses home at 216 Franklin Street South. Second was by
Alderman Linder and upon being put to vote all present voted aye. The motion was
declared passed.
A request from the Elk's Lodge was then presented for a 3.2 beer on -sale license.
On motion by Alderman Alrick, second by Alderman Linder, the vote was unanimous to
issue the license.
Engineer Priebe then presented an updated plan for street construction and asked the
Council to consider the proposal for adoption of a long range policy guide.
Final plat for Loren's Addition was presented for approval. The final plat needs
exchange of lands between City and developer, and the Attorney was directed to prepare
ordinance for disposition of land in order to accomplish the exchange. Alderman
Black introduced Ordinance No. 380, an ordinance to dispose of land owned by the City
for its first reading and moved its passage. Alderman Alrick seconded the motion and
upon being put to vote all present voted aye. The ordinance was thereupon declared
passed at its first reading.
A listing of tax forfeited lands, as received from the County Auditor was presented.
Alderman Black moved approval of the classification and Alderman Linder seconded.
All present voting "aye" the motion was declared passed.
Further discussion on the properties involved was held. It was determined that it
would be desirable to purchase Lots 8 and 9 of Block 2, S Half City and Lot 5, Block
21, South Half of City. Alderman Peterson moved the City Clerk be authorized to
purchase these three lots. Alderman Black seconded the motion and the motion was
carried.
Alderman Black presented Ordinance No. 381, an ordinance to regulate the manufacture,
storage, handling, use and sale of explosives and providing a penalty for violation
thereof, and moved the first reading. Alderman Linder seconded the motion and upon
being put to vote all present voted "aye." The ordinance was thereupon declared
passed at its first reading.
A request from Mrs. Arthur Frank for a street light was referred to the Utilities
Commission on motion by Alderman Alrick, second by Alderman Peterson and carried
unanimously.
There being no further business before the Council, the meeting was declared adjourned
at 11:17 P.M.

Recommendations of Planning Commission
The Planning Commission, at its regular meeting of September 21, took the following
actions:
1. Recommended variance be granted to West Side Grocery to construct basement
level storage. Conditions recommended with the variance are that stipulation
be made that no superstructure will be considered, a railing be constructed
around the concrete deck on top of the addition to the building, and that
steps be taken to remove the tree on the corner which has been considered a
traffic hazard.
2. Recommend rezoning from R -1 -to I-1, the properties South of Second Avenue
I and East of the Crow River, as petitioned by Leonard Miller.
3, Recommended B-3 pre -zoning for the Ted Hanson annexation.
4. Submitted a preliminary suggestion that new streets be named in the following
system:
'a. Except as existing streets are extended, all new North South streets in the
NE quadrant of the City, East of Highway 15 and North of Highway 7, be
named, alphabetically for trees, shrubs and flowers. Since a start has
already been made in this quadrant to use tree names it seems a logical
continuation with the additional alphabetizing.
b. In the NW quadrant of the City, North of Highway 7 and West of Highway
15, new North-South streets to be named for States of the Union, alphabetic-
ally, skipping only "B" for which letter no one could think of a state

name.
c. In the SW area, North of Second Avenue and West of Dale, names of notable
Americans, alphabetically.
d. In the SW area between Dale and Highway 15, South of Second Avenue,
names of large Cities, alphabetically.
e. In the SE area, between Highway 15 and Adams, Presidents of the United
States.

S.F. 1 has a cash balance of $20,000 and principal and interest payment of $44,200
due on November 1. We will have to redeem investments sufficient to provide
the additional $24,200.
S. F. 2 has a cash balance of $9,082 in account which can be invested for the
better part of the next 12 months.
S. F. 4 has $5,241 in cash account which can be invested for a year.
S. F. 5 has $7,168 in account and $50,000 investment maturing on Oct. 27. Needs
are $11,125 next February. We could reinvest cash balance and maturing in-
vestment till then.
S. F. 6 has $19,664 in account and $94,000 investment maturing September 30. We
need $22,443 in November for principal and interest and $23,440 in January
for principal & interest. We should invest the balance.
S. F. 8 $26,933 in account. We need 10,436 in January. Most of this amount
could be invested till that time.
S. F. 9 $160,000 investment matures on Oct. 8. We will need approximately $31,000
in November for principal & interest. Balance could be invested.
$4,000 - Gemral to Airport per Budget
Off Street Parking Fund: $68,959 in account. Need $3,000 for recent construction
costs and $25,000 to Hospital Debt Retirement fund (S.F. 7). Balance could
be invested until spring.

and Refuse Charge
Gentlemen:
Reverend Crouse, pastor of the Assembly of God Church, has remitted
for water bill but pointedly refused to pay the delinquent and current
account for trash and refuse. I don't believe we have recourse against
a Church for this account, as we would against private property. I
would, however, defer to the City Attorney on this.
The basic problem that this refusal raises is that of treatment of other
churches. If we cannot collect from the Assembly of God Church,
and they refuse to pay, it seems that to be fair we would have to
discontinue the charge to any Church property.
