and he is instructed to report to the council with all convenient speed
advising the council in a preliminary way as to whether the proposed improve-
ment is feasible and as to whether it should best be made as proposed or in
connection with some other improvement and the estimated cost of the improve-
ment as recommended.

Alderman Black moved the bills be approved as presented. Alderman Linder
seconded the motion and it was carried unanimously.
Adm. Asstt. Mealey presented a request from Chief of Police Broderius for
purchase of a new police patrol car along with specifications and request for
bids. Alderman Black pveadnted the following resolution and moved its adoption:
RESOLUTION NO. 3008
APPROVING SPECIFICATIONS AND CALLING FOR BIDS FOR POLICE
PATROL CAR
WHEREAS, it is deemed advisable to replace one Police Department patrol car,
and the Chief of Police of the City of Hutchinson has prepared and presented
specifications for a replacement car,

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:
1. Specifications as submitted are hereby approved.
2. Sealed bids will be received by the City Clerk of the City of Hutchinson,
Minnesota, until 7:30 P.M.on Monday, the 9th day of February, 1970, for a
Police Patrol Car.
3. Specifications shall be kept on file in the office of the City Clerk
and made available to prospective bidders.
4. The City Clerk is authorized and directed to cause to be inserted in
the official paper an advertisement for bids for the purchase of such patrol car.
The motion was seconded by Alderman Alrick and carried unanimously, whereupon
Resolution No. 3008 was declared adopted by the City Council this 26th day of
January, 1970.
Adm. Assft. Mealey requested approval of investment of approximately $98,000 in
Sinking Fund No. 1. Alderman Black moved the investment be authorized, motion
seconded by Alderman Alrick and carried unanimously.
Alderman Black briefly examined Assessment Roll for Project 1968-3, Watermain
and Sewer Project and moved that approval be tabled at this time and presented
at the meeting of February 9, 1970 in order to allow more time for study.
Alderman Alrick seconded the motion and it was carried unanimously.
Adm. Asset Mealey presented a report from the City Engineer on the purchase ff-s_
a grader for the Street Department and recommended that since the initial
determination to purchase the Austin -Western Grader was too late and the machine
had been sold, a leas:/aJHe'm9R be made with Ziegler, Inc. on the following
terms: a yearly payment of $3,600.00 to be made April 15, 1970, and 900.00 on
April 15, 197M; on May 15, 1971 finalize purchase of the machine for approximately
$4,866, to include 5% interest. This machine to be a 1954 Caterpillar. Engineer
Priebe outlined the specifications. Alderman Linder moved that the Mayor and
City Clerk be authorized to enter into such an agreement with Ziegler, Inc.
Alderman Black seconded the motion and it was carried unanimously.
Alderman Black introduced Ordinance No. 358 for its second and final reading
as follows, and moved its adoption:
ORDINANCE NO. 358
REGULATING OPERATION OF -MOTOR VEHICLES AND TRAFFIC LAWS
AND PROVIDING PENALTIES THEREFORE
THE CITY OF HUTCHINSON DOES ORDAIN:
SECTION I. The Minnesota Highway Traffic Regulation Act, Chapter 169, contained
in Minnesota Motor Vehicle and Traffic Laws 1969-1970 issued by Minnesota Depart-
ment of Highways, three copies of which are on file in the office of the City
Clerk of the City of Hutchinson, Minnesota, is hereby adopted by reference and
to become a part of this section and of this Ordinance. Revisions and amend-
ments thereto adopted by the Legislature of the Statd of Minnesotaare hereby
and by reference adopted by the City of Hutchinson.
SECTION II. All Ordinances or parts of Ordinances in conflict herewith are
hereby repealed.
SECTION III, This Ordinance shall take effect and be in force from and after
the publication hereof.
Alderman Linder seconded the motion and it was carried unanimously, whereupon
Ordinance No. 358 was declared adopted by the City Council this 26th day of
January, 1970.

Discussion was held on a/ snowmobile ordinance for the City of Hutchinson.
It was agreed that the latest state laws are not yet known and: -it would be well
to wait for new information on state legislation. Alderman Black moved the
subject be tabled until further information can be gathered, motion seconded by
Alderman Linder and carried unanimously.

Alderman Black introduced Ordinance No. 360 and moved its adoption as follows:
AN ORDINANCE PERTAINING TO THE AMENDMENT OF ORDINANCE NO. 245
CONCERNING ZONING REGULATIONS IN THE CITY OF HUTCHINSON
(Swanson and King -Motel Property)
THE CITY OF HUTCHINSON DOES ORDAIN:
The following described real property is hereby rezoned from 11R-111 Single
Family and Two Family Residential District, to 11B-311 General Business District:
Part of Government Lot 4, Section 35, T 117, R 30 McLeod County,
Minnesota described as follows:
Commencing at a point on the East line of said government lot 4 a
distance of 810 feet South of Northeast corner thereof; thence West,
pareallel with the North line of said Lot 4 a distance of 350 feet;
thence South, parallel with said East line, a distance of 389.3 feet
to the North Line of State Highway No. 7; thence Northeasterly along
said North line of highway to said East line; thence North, along said

Alderman Linder seconded the motion and it was carried unanimously, whereupon

Alderman Black introduced Ordinance No. 361 and moved its adoption as follows:

Alderman Black introduced Resolution No. 3009 and moved its adoption as follows:
RESOLUTION ACCEPTING PRELIMINARY PLAT
(Cedar Acres)
WHEREAS, the Planning Commission and the City Council have examined the
Preliminary Plat as submitted by Noell Investment for Cedar Acres and
WHEREAS, the Planning Commission has recommended approval of such Preliminary
Plat,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:
That the preliminary plat as presented and on file in the office of the
City Clerk for Cedar Acres be and is hereby accepted.
Alderman Linder seconded the motion and it was carried unanimously, whereupon
Resolution No. 3009 was declared adopted by the City Council this 26th day of
January, 1970.
Alderman Black introduced Resolution No. 3010 and moved its adoption as follows:
RESOLUTION COMMENDING DR. CURTIS SCHAFER
WHEREAS, Dr. Curtis Schafer has served faithfully as a member of the
Hutchinson City Council, and
WHEREAS, Dr. Curtis Schafer hxs devoted time and talent to service to the
City of Hutchinson through his membership on the Hutchinson City Council at
little personal reward to himself,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA,
That the City of Hutchinson does hereby commend and thank Dr. Curtis
Schafer for his service and help on the Hutchinson City Council and appreciates
the work donneon behalf of the City of Hutchinson.
Alderman Linder seconded the motion and it was carried unanimously whereupon
Resolution No. 3010 was declared adopted by the City Council this 26th day of
January, 1970.
Adm. Asst. Mealey outlined the details of a projected plan presented to the
r.. Planning Commission by Mr. John Kox%eible on behalf of Char -Bon, Inc. of
Hopkins, Minnesota to construct a planned housing development south of
Hutchinson on Jefferson Street to be known as River Hills Terrace. Mr. Mealey
presented the Planning Commissions recommendations as follows: There does
not seem to be any conflict with any of our long range plans in this type of
development; annexation should be considered as probable within a very few years;
prior to approval of the proposed plat a stipulation should be made to insist
on street design to the City's minimum standard; streets to be graded to drain
to the river in order to obviate the necessity of future storm sewer installa-
tion; that most of the cul-de-sacs shown on the rough design be eliminated
since they are costly to maintain and would put an inordinate strain on our
snow removal capabilities; in order to guarantee the park and recreation area
shown along the river for some 270 potential families, fee title to this land
should be conveyed to McLeod,County, the City of Hutchinson, or Hassan Valley
Township as a requisite for plat approval; approval should be dependent on
either a petition for annexation by the owners of the property or joint action
by the Hassan Valley Town Board and the City Council under the provisions of
the Municipal Commission Act to insure that annexation can be accomplished
when the need arises and the process of urbanization insists upon it. Mr.
Korngeible indicated that the owners are willing to consider most or all of
these recommendations. Alderman Linder moved that the Council concur with the
Planning Commission's recommendations, Alderman Black seconded the motion and
it was carried unanimously.
Alderman Black moved that the City Attorney be directed to get an opinion from
the Attorney General as to which governing body has jurisdiction over planning
within a two mile limit of the City. Alderman Linder seconded the motion and
it was carried unanimously.

Mayor Kost declared the public hearing on proposed street improvements open
at the hour of 8:00 P.M. and read Publication No. 1234, Notice of Hearing on
Improvement as follows: TO WHOM IT MAY CONCERN: Notice is hereby given that
the City Council of Hutchinson, Minnesota, will meet in the Council Chambers
of the City Hall at 8:00 P.M. on Monday, January 26, 1970 to consider making
of an improvement on

429A11 (Laws 1953, Ch. 398, as amended).
The area proposed to be assessed for such improvement is the property abutting
on such streets. The estimated cost of such improvement is $770,000.
Such persons as desire to be heard with reference to the proposed improvement
will be heard at this meeting.
More than 50 persons were present for the hearing.
Mayor Kost then turned the meeting over to Engineer Priebe who outlined the
proposed five year basis for upgrading the City streets and improvement planning.
The over-all cost to be based on this year's project, the quantity of material
needed - estimated - and stated that it would amount to approximately $12.00
per line foot. Engineer Priebe referred to a map he mounted for display and
pointed out the areas projected for the 1970 project, explaining that some of
these streets are new areas meeting the requirements of subdivision agreements,
some are projects delayed by the southwest storm sewer project and three are
constant repair streets.
Mayor Kost.acknowledged receipt of petition signed by 94 residents of Lynn Road
as follows: "We, the undersigned, being residents and taxpayers of the City of
Hutchinson, County of McLeod, and property owners of property abutting on Lynn
Road in said City do hereby protest to the making of an improvement on Lynn Road
by subgrade preparation, bituminous base, bituminous pavement, curb and gutter
and to the proposed assessment for such improvement to our property."

Mayor Kost also acknowledged/petition from residents of Kay Street as follows:
Hutchinson City Council, City Hall Hutchinson, Minnesota, 55350: Gentlemen:
This letter is a reminder to the Council that approximately two and a half years
ago a duly signed petition was submitted to the City of Hutchinson for street,
curb,.and gutter on Kay Street from Roberts Road to Lea Street and on Lea Street
from Kay Street to Larson Street. This request has been held by the City since
that time due to the impending installation of the storm sewer, part of which was
scheduled to be laid under Kay Street. The storm sewer construction was finally
completed last fall. We therefore ask that the original request for street, curb,
and gutter as described above be included on the 1970 street construction schedule.

Mayor Kost also acknowledged receipt of petition for local improvement by
installation of watermain along the proposed Roberts Road extension between
the West line of School Road and a point 1000 feet West signed by Earl and
Loretta J. McDonald.
Mayor Kost invited comments from the citizens present, stating that this hearing
had been called for the specific purpose of informing the Council what the
attitudes and feelings of the residents of the community are concerning the
need for upgrading of city facilities.
Mr. Wayne Burtelle,525 Lynn Road stated that the project is too expensive when
added to the storm sewer assessment. Mr. Leonard Gruett, 437 Linden stated
that the proposed assessments would cost more than one third of the total assessed
value of his property. Mr. H. E. Jensen stated that it would cost him between
four and five thousand dollars, that he already has curb and gutter and that the
only rough spot on his block is at the intersection and that he felt it wrong
to tear up good paiaement. Engineer Priebe explained that Lynn Road is designated
as an MSA Street so that it is designed and built to accommodate heavier tonnage.
The additional cost to be absorbed by the State Highway Department. The actual
cost to the property owners would be no different than a regular residential
street even though it is wider. Mayor Kost added that if the street is renewed,
it would have to comply with State standards.
A questioner asked whether the construction would interfere with the gas lines.
Engineer Priebe stated that it has not yet been checked with the gas company
but that it should be deep enough and that the telephone company would also be
consulted.
Mr. Bob Roberts stated that he is strongly against improvement on Kay from
Roberts Road South because he owns 10 of the 11 lots and there is not yet any
construction so that it would be necessary to tear out for every driveway.
Mrs. Rivers, College and Ash Streets asked about assessment for corner property.
Mayor Kost explained that they would be assessed for the long side only.
Mr. Warren Moe, 685 Lindon inquited about the necessity for changing the elevation
of the street to meet existing curb and gutter. Engineer Priebesstated that
it might have to be replaced but that the City would take care of it. Mr. Moe
then inquired whether the street had been platted so that he might know where
the street will run and --whether his trees would have to come down. Engineer
Priebe stated that he has not checked on that yet but would do so. Mayor Kost
stated that the City would try to safe the trees. Mr. Moe stated that he wants
the road.
Mr. Ray Clemenson voiced his objection to Linden Avenue improvement and stated
that he believes the assement should be spread over the entire city rather than
property owners.
Mayor Kost explained that the City can not charge property owners who have their
assessments half paid for additional roads, and that the proposed plan includes
streets where people have indicated they want improvement; further that it costs
more to maintain substandard streets than to replace them.
Mr. Larry Sorenson, 550 Linden stated that he is very much in favor of the
improvement.
There were numerous questions concerning costs for specific properties.
A discussion was held on tax rates. Mayor Kost explained that only 20% of the
real estate taxes goes to the City and that the remaining 80% goes to other
agencies than the City. He stated thtt it is not possible to say what the
taxes will be, but that we are trying to hold the line and there are no plans
for raising them.
Mr. Fulmer Peterson, 415 Washington expressed his thanks to the Mayor and Council
for calling this hearing and commended all present for the orderly conduct of
the meeting. He then stated that while he is not against the improvement, he
does feel that in addition to the Southwest Storm Sewer, the assessments are too
high and asked whether it might be possible to relieve the situation in some way.
Mayor Kost reiterated that if we do not assess we must go to a general tax which
would raise the mill levy 35 - 40 %.
COUNCIL PROCEEDINGS -8- JANUARY 26, 1970
Mr. Harold Synstelyn stated that he is looking forward to the improvements.
Mr. I. Burich inquired who would be assessed for the area along the city
limits at Second and Michigan, whether it would be the developers. He was
informed that it would be and for sewer and water also. Mr. Larry Graff stated
that he is in favor of improving Ash Street.
Alderman Black moved that the hearing be adjourned at the hour of 8:55 P.M.
Alderman Linder seconded the motion and it was carried unanimously.
Due to the large number of people present, it was decided to remove the
proceedings to the auditorium on the second floor.
Mayor Kost called the hearing to order at the hour of 9:14 P.M. and read
Publication No. 1232 as follows: "Notice of Special Hearing for Rezoning.
To Whom It May Concern: Notice is hereby given that the City Council of the City
of Hutchinson will meet in the City Hall Cogncil Chambers at 9:00 P.M. on Monday,
January 26, 1970 to consider rezoning the following area: ReZO ping from Bl to
BSC: That part of Lot 17 of Auditor's Plat of Section 7 - Township 116 North,
Range 29 West lying West of a line 765 feet East of and parallel with the West
line of said Lot 17. Resoning from R2 to BSC: Lots 1, 2, 3, 4, 5, and 6 of
Block 1 of Southiside Terrace. Rezoning from R2 to Bl: Lots 1 and 2 of Block
2 of Southside Terrace. The above descriptions encompass an area fronting on
Highway 15 immediately North of the New Municipal Hospital. Such persons as
desire to be -heard with reference to said rezoning will be heard at this meeting."
Mayor Kost then explained that at the meeting of December 29, 1969 a delegation
of people concerned about this proposed zoning had presented objections to it
and the Council had agreed to get further opinions from the Minnesota Highway
Department concerning the effect of traffic on highway considerations, that
Midwest BlkahhdLhg would be asked for a written opi.mmnn of the general and specific
effects of a Shopping Center on the area as well as the total city from a Planning
standpoint; the developers to meet with the Hospital Board and the Council -to
meet with the Hospital Board. Mayor Kost stated that these things had been
accomplished and read a petition signed by the property owners within 300 feet of
the affected property stating their approval and support of the proposed land
use. The Mayor then read a letter to the City Engineer from the State Department
of Highways stating that the plan'is acceptable.
Mayor Kost read the recommendations from Midwest Planning and Research, Inc.
in .its entirety (copy attached) .
Mr. Dale McLain asked whether the allowance of a Shopping Center would set a
precedent for a manufacturing plant_to move in across the road. Mayor Kost
replied that the SC zoning is more restrictive than B3, General Business and that
the area referred to is outside the city limits and would have to be prezoned
if the developer wants to annex. Mr. McLain stated further that part of the
reason for rezoning the down town area commercial was to keep like things in
like areas, and that he feels that a Shopping Center should not be permitted
in the area of the hospital.
Mr. Chuck Carlson introduced himself and stated that he gathers that Midwest
Planning feels that this is a major decision for the city; that everyone present
is interested in the best interests of Hutchinson. "There is a ,substantial
amount of property down town that is zoned commercial and that the real issue
is probably the price of parking space. We need more down town parking and I
think if we had it people would find it advantageous to locate in down town
Hutchinson and we would have a great shopping center. Our major point should
be down town parking for the business area The Hutchinson trade area is not
large enough to support a Shopping Center."
Mr. H. C. Jensen introduced himself as the retired Postmaster and reviewed the
retail business history of the city citing the opposition in the past to
expansion and change and stated that if the shopping center does not locate here
it is likely to go to Glencoe or Litchfield and their business communities will
prosper as a result.
Mr. Poffenberg er, the Super -Valu representative stated that the only function
of the organization is to assist independent merchants and they want to give
the store adequate parking. Property is hard to get in Hutchinson. The reason
they are interested in Hutchinson is that people here do shop at metropolitan
centers and a venture like this does help the downtown business district, and
will represent a plus to the community. The shopping center will virtually

eliminate competition from the surrounding communities.
Mr. Earl Schmidt asked how much land is involved in terms of city blocks and
was informed it would be not quite five. He then asked how many other concerns
are interested besides Super Value and was informed that the space is pretty
well committed.
Mr. J. Harold Beytein inquired how many firms are committed to this shopping
center and stated that he is looking forward to a successful center and feels
that firm commitments are needed. Mr. Ryan, representative of the developer
stated that in addition to Super -Valu a small Target -type operation is seriously
negotiating and a variety -type store. He stated that they are presently
unable to commit themselves to a lease because the zoning is needed first. The
financing is arranged.
A discussion on parking ensued.
At the hour of 10:07 P.M., Alderman Black moved the hearing be closed, seconded
by Alderman Linder and carried unanimously.
The Council then returned to the Council Chamber to continue the meeting.
Alderman Alrick stated that it seems that this project developed very'quickly
at a time when interested people did not have an opportunity to give it enough
thought, and that insufficient consideration had been given by the City to
which direction commercial growth should take and where this developer might
best locate. He stated further that he did not like to see business real estate
move from down town to a lower cost area without bfirm assurance that it is
in the best interest of Hutchinson.
Further discussion followed and Mayor Kost summed up by stating that the only
consideration of the Council is with the zoning of a piece ofpproperty.
Alderman Black introduced Ordinance No. 357 for its second and final reading
and moved its adoption as follows:

Mayor Kost called for conclusions on the street program. Engineer Priebe
commented on the number of trees that would have to be removed from Lynn Road
64 in all, and stated that in conversation with the State Highway Department,
he had determined that a possible alternative would be to maintain parking on
one side only necessitating removal of only 11 trees. There was general agree-
ment that Lynn Road would not be included in the project.
It was also agreed that Kay Street South of Roberts Road would not be included.
Alderman Black introduced the following resolution and moved its adoption:

Mayor Kost acknowledged receipt of a letter from an elderly widow requesting
reduction of trash removal charges. Mayor Kost stated that with the approval
of the Council he would reply to the effect that an effort would be made to
work something out, since we are in the process of changing trash haulers.
Engineer Priebe recalled that an easement on the Zachow property will be needed.
Alderman Black moved that the Council direct the City Attorney to obtain the
necessary easement, Alderman Linder seconded the motion and it was carried
unanimously.
Alderman Alrick reported that Mr. Vance Zeringer, owndr of the Hutch Hotel
has requested some arrangement for parking for his guests during snow removal
periods. Engineer Priebe stated that he would need a survey of the number of
cars to be parked. It was suggested that special tags be issued to guests.
Adm. Ass?t. Mealey said that he would work it out with him.
There being no further business before the Council, Mayor Kost called for a
motion to'adjourn. Alderman Black so moved, seconded by Alderman Linder and
the meeting was declared adjourned at the hour of 11:12 P.M.

Tae January ,meeting of the Hutchinson Safety Council was held at
the Velvet Coach with 10 members in attendance.
Meeting was opened by President Otto with silent table prayer.
George Dahlgren ;ave a report on the Defensive Driving School Vhich
he had attended in Minneapolis. Discussion was had on promoting
this school in Hutchinson and the Presi.:ent appointed iv►r. Dahlgren
and Frank Broderius; Chief of Police, to investigate this further
as to cost etc.

At a Chamber of Commerce Board of Directors meeting on Pebruary
4,9 it was unanimously agreed that this request be submitted to
the City Council.
We are asking that we be allowed to exchange quarters in the City
Hall so that we may occupy the present assessor's office. He, in
turn, could occupy the present Chamber of Commerce office. This
Will allow us doable the amount of space asci ve would, therefore,
gladly pay doable the amount of rent, i.e., $20.00 per month.
We would hope that this change over could occur no later than
April ll 1970.

1970 they will no longer serve.

necessary to effect a transition to another authority.

SUBJECT: Estimate of expenses, trash and refuse service
Madam and Gentlemen:
Attached is a report from Mr. James Junker relative to his immediate
costs of establishing a refuse collection system for Hutchinson.
Attorney Schantzen and I have gone through this with Mr. Junker
and eliminated interest as an element in the cost computation as
well as correcting the error in computation of dump expenses.
As you may or may not know, the trac-loader and shovel shown as
capital expense are items that Mr. Miller is using in the operation of
our present landfill site. They would be valueless to our proposed
new operation. Repairs and maintenence are shown relatively high
in this projection because Mr. Miller has not maintained the
equipment as is usually recommended and the deterioration of the
equipment is, as a result, greater than normal.
Wage estimates must be measured against a minimum of six employees
and doesn't seem high for that many people.
