A Regular Council Meeting was called to order by Mayor Don 0. Kost in the Council

official newspaper for the City of Hutchinson.
Motion by Alderman Linder, seconded by Alderman Black, that the Ministerial
Association again be requested to lead Invocation at the council meetings.
Motion carried unanimously.
Motion by Alderman Alrick, seconded by Alderman Linder, that the Chief of Police
beaauthorized to purchase a walkie-talkie out of the Dispatch budget. Motion
carried unanimously.
The Council authorized the Chief of Police to rent equipment for the washing
and repairing of parking meters as necessary.
Chief of Police Broderius questioned whether the Council has seriously considered
all -day parking on Franklin Street at a reduced rate. This question was referred
to the Parking Committee of the Chamber of Commerce through Alderman Alrick.
Mayor Kost appointed Aldermen Linder and Schafer as a committee to work *ith
the Fire Department on recommendations for more storage space for fire department
vehicles.
Engineer Priebe presented his cost estimates on water and sewer services to proposed
apartment site west of T.H. 15 and north of North High Drive, and Peterson's
Trailer Park west of Maplewood Academy.
Discussion on method of assessment or payment on lift stations. Engineer Priebe
was requested to forward these figures to developers of the proposed apartment
site, with a view to determinAng method of sharing costs.
Del Rieke of the consultant engineering firm of Rieke -Carroll -Muller Associates
presented revised cost estimates on the Southwest Storm Sewer and routes to;k be
considered. Engineer Priebe, Engineer Rieke and Alderman Black were instructed
to investigate possible easements for the alternate routes.
Engineer Priebe presented his recommendation 'on policy regarding annexation and
sanitary sewer, water and storm sewer installations to newly annexed areas.
Engineer Priebe presented the required number of copies of the Plan of the Final
Plat of Roberts Second Addition and stated it had been reviewed and approved by
the Planning Commission Secretary, with certain recommendations as filed.
Motion by Alderman Black, seconded by Alderman Linder, that the Plan of the Final
Plat of Roberts Second Addition be ordered filed and referred to the Planning
Commission. Motion carried unanimously.
Engineer Priebe was instructed to have the Street Department clear snow from
the sidewalk north of Roberts Road leading to the high school site.

APPOINTMENT OF CITY CLERK FOR 1969
BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:
That Agnes I. Monge be appointed as City Clerk of the City of Hutchinson
for a period of one year.
Alderman Linder seconded the motion to adopt said resolution, and upon vote
being taken all members present voted "aye" and Resolution No. 2817 was declared
adopted by the City Council this 13th day of January, 1969.

APPOINTMENT OF CHIEF OF POLICE
BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINGON, MINNESOTA:
That Frank Broderius be re -appointed as Chief of Police of the City of
Hutchinson for a period of one year.
Alderman Linder seconded the motion to adopt said resolution, and upon vote
being taken, all members present voted "aye" and Resolution No.. 2818 was
declared adopted by the City Council this 13th day of January, 1969.
Alderman Black introduced the following resolution and moved its adoption:

APPOONTMENT OF FIRE DEPARTMENT OFFICERS
BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:
That the following officers for the Fire Department be and hereby are
approved:

Alderman Black introduced the following resolution and moved its adoption:
RESOLUTION NO. 2820
APPOINTMENT OF LEGAL COUNSEL
BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:
That Milton D. Schantzen be hired as City Attorney at a retainer fee to
be determined for routine legal work of attending Council meetings, reviewing
minutes, work on resolutions and ordinances, and attending public hearings,
and other usual and ordinary legal services.
Matters such as appearances in District Court, Condemnation proceedings,
appearances before administrative agencies and other services not usually
conducted in the normal course of city business, will be billed as extra legal
services. Other services not usually conducted in the normal course of city
business will be billed as extra legal services.
Alderman Linder seconded the motion to adopt said resolution, and upon vote
being taken, all members present voted "aye" and Resolution No. 2820 was declared
adopted by the City Council this 13th day of January, 1969.
Alderman Black introduced the following resolution and moved its adoption:

RESOLUTION APPOINTING HEALTH OFFICERS
BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:

APPOINTMENT OF CITY ENGINEER
BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:
That Marlow V. Priebe be re -appointed as City Engineer of the City of
Hutchinson for a period of one year.
Alderman Linder seconded the motion tb adopt said resolution, and upon vote
being taken, all members present voted "aye" and Resolution Noe 2822 was
declared adopted by the City Council this 13th day of January, 1969.
The City Clerk presented "Assignment of Securities in Lieu of Bond by Public
Depositories" from Citizens Bank and The First National Bank of Hutchinson, to
cover fundsof the City of Hutchinson for the year 1969 (including Hutchinson
Utilities Commission, Hutchinson Community Hospital, Burns Manor Nursing Home
Fund, Sinking Funds, Public Sites Trust Fund, Off -Street Parking Racilities
Fund, and aftp other funds;of the City.)
Attorney Schantzen expressed his approval of Securities as submitted.
Alderman Black intrdduced the following resolution and moved its adoption:

Alderman Linder introduced the following resolution and moved its adoption:
RESOLUTION NO. 2824
BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:
That pursuant to statutory authority, the Municipal Engineer for and on
behalf of the Municipality of Hutchinson, Minnesota, is hereby authrized to
request and obtain from the Minnesota Department of Highways needed engineering
and technical services during the year of 1969; for which payment will be made
by the Municipality upon receipt of verified claims from the Commissioner of
Highways.

being taken, all members present voted "aye" and Resolution No. 2824 was
declared adopted by the City Council this 13th day of January, 1969.

Alderman Alrick introduced Ordinance No. 331 for its second and final reading
and moved its adoption:
RESOLUTION NO. 2823
RESOLUTION DESIGNATING DEPOSITORIES
BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:
That the following named banks, which are authorized to do a banking
business in Minnesota, be and they hereby are designated depositories
of the Public Funds of the City of Hutchinson in the County of McLeod,
State of Minnesota, by the City Cofsneil of said City, for the term com-
mencing January 13, 1969, for one year:
Citizens Bank, Hutchinson, Minnesota
The First National Bank'of Hutchinson, Hutchinson,
Minnesota
upon terms and conditions following, to -wit:
That this designation is subject to the right of said City of Hutchin-
son, Minnesota, to modify, vacate, or revoke the same according to law-,
and also subject to any depository agreement -executed pp ouant to Sec.
118.01 Minnesota Statutes of 1945, and that said depositories shall pay
on demand all deposits therein subject to payment on demand, and
BE IT FURTHER RESOLVED:
That the City Clerk of the City of Hutchinson is hereby authorized
and directed to deposit in each of said banks in a special fund known as
"City of Hutchinson" all monies that may come into her hands, and the
City Clerk shall maintain an equal amount of monies in deposit at each
of said banks at all times.
BE IT FURTHER RESOLVED:
That a copy of this Resolution be filed with the City Clerk and each
of the banks so designated.

RESOLUTION AUTHORIZING FILING OF APPLICATION WITH THE PUBLIC
HEALTH SERVICE, UNITED STATES OF AMERICA, FOR AN OFFER AND
ACCEPTANCE OF FEEL GRANT FOR
ACT (33SEWAGE
STREATMENT

THE WATER POLLUT
WHEREAS, under the terms of the Water Pollution Act, :(33 U.S.C. 446
et seq.), the United States of America has authorized a Grant of
$439,800.00 to the City of Hutchinson to aid in the construction of a
specific public project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA:
1. That Marlow V. Priebe, City Engineer, be and he is hereby
authorized to accept the Grant offer for the City of Hutchinson.

ORDINANCE NO. 330
AN ORDINANCE SAFEGUARDING PERSONS, BUILDINGS, AND, CONTENTS OF BUILDINGS FROM
ELECTRICAL HAZARDS ARISING FROM THE USE OF ELECTRICAL ENERGY AND ESTABLISHING
CERTAIN REQUIREMENTS RELATING TO ELECTRICAL WIRING AND ELECTRICAL INSTALLATIONS
OF ANY KIND AND PROVIDING FOR INSPECTION PROCEDURES AND ENFORCEMENT OF NATIONAL
ELECTRICAL CODE REQUIREMENTS.
THE CITY OF HUTCHINSON DOES ORDAIN:
Section 1. No Electrical Contractor or Home Owner shall make or cause to be
made or install any electrical wiring or electrical installations in the City
of Hutchihason without complying with the Electrical Code as formulated and
established by the latest National Electrical Code, a copy of which is on
file in the Office of the Clerk of said City and is by refer+a w made a part
hereof.
Section II. All electrical wiring and electrical installations must be made
by or under the supervision of a Licensed and Bonded Electrical Contractor or
by the Home Owner subject to inspection and Approval by the City Electrical
Inspector.
Section III. No Service Entrance Cable shall be used in Service Entrances.
Conduit meat be used, which said conduit shall be a type and of material
approved by the local authority charged with the enforcement of this Ordinance.
Section IV. It shall be the duty of the Superintendent of the Municipal Electric
Light and Power Plant of the City of Hutchinson and such person as he may des-
ignate to examine Request for inspection and inspect the wiring and Electrical
installations, and shall have and hereby is granted authority to approve
or reject said wiring and said electrical installations. Qualifications of the
City Electrical inspector as set forth in "MINNESOTA ELECTRICAL ACT" as passed
by the 1967 Legislature effective September 1, 1967. 326.244,INSPICYIONi
Subd. 4. "Each electrical inspector of any political subdivision must be
a licensed master or journeyman electrician under Section 326.242, Subdivision
1 (1) or Subdivision 2 (1) and may not otherwise engage or be employed in the
sale or installation of electrical wiring, devices, appliances or equipment,
and shall have no financial interest in any such business."
Section V. INSPECTION:
1. Required inspection:
Every new electrical installation in any construction,
remodeling,,replacement, or repair, except minor repair
work as defined* shall be inspected for compliance with
accepted standards of construction for safety to life and
property. *Minor work defined: Minor work shall mean the
adjustment or repair and replacement of worn
or defective parts of electrical fixtures,
switches, receptacles and other equipment
provided that such minor repairs are made
in compliance with accepted standards of
construction for safety to life and property
and do not require replacement of the wiring
to them.
2. Procddure:
At or before commencement of any installation required
to be inspected, the Electrical Contractor or Owner making
such installation shall submit a Request for Inspection
in a form prescribed by the Utilities Commission, and the
inspection fees required for such installations, to the City
Clerk who shall than forward a copy of the Request for
Inspection to the City Electrical Inspector.
Periodic Filing. On installations requiring more than 90
days in process of construction and in excess of $100.00
total inspection fees, the persons responsible for the
installation may prorate the fee for each month and submit
request for inspection in advance with appropriate fee
to cover each inspection period.

3. Rough -in Inspection:
Where wiring is to be concealed, the inspector must be
notified in reasonable time to complete a rough -in
inspection prior to concealment, exclusive of Saturdays,
Sundays, and Holidays. In the event wiring is concealed
before reugh4iu:inspection without adequate notice having
been given to the inspector, the person responsible for
having enclosed the wiring shall be responsible for all
costs resulting from uncovering and replacing the cover
material.
Inspection Fees: (adopted from the Minnesota Electrical Act)
(1) Minimum fee for each separate inspection of an installation,
replacement, alteration or repair to a circuit up to 30
amop re (incl.) ------------------------------------------ $3.00
(2) Services, change of services, temporary services, additions,
alterations, or repairs on either primary or secondary services
shall be computed separately.
0 to and including 60 ampere capacity -4 ----------------- $4.50

For each additional 100 ampere capacity or
fraction thereof -------------------- $3.00
(3) Circuits, installations of, additions, alterations or repairs
of each circuit or sub -feeder shall be computed separately
including circuits fed from sub -feeders and including the
equipment served.
0 to and including 30 ampere capacity ------------------- $1.50
(maximum number of 0 to 30 ampere circuits
to be paid on is 30 in any one cabinet)
31 to and including 60 ampere capacity ---- -------------- $3.00
61 to and including 100 ampere capacity ----------------- $4.00
For each additional 100 ampere capacity or
fraction thereof -------------------------------------- $2.00
(4) Maximum fee on a single family dwelling shall not exceed
$16.00 if not over .100 ampere capacity. This includes service
feeders, circuits, fixtures and equipment as per 2 & 3 above.
This maximum fee provides for not more than one rough -in
inspection and on FINAL inspection per dwelling.
(5) Maximum fee on a single family dwelling shall not exceed
$32.00 if not over 200 ampere capacity. This includes service
feeders, circuits, fixtures and equipment as per 2&.& 3 above.
The maximum provides for not more than three ROUGH -IN inspections
and one FINAL inspection per dwelling.
(6) Maximum fee on apartment buildings shall>>not exceed $14.00 per
dwelling unit for the first 12 units ----$12.00 per dwelling unit
for the next a units and $10.00 per dwelling unit for balance.
(7) The maximum fee for a 0 to 60 ampere power outlet in a Trailer
park shall be $4.00 per trailer stall.
Section VI. Crimes (based on the "Minnesota Electrical Act" of 1967.)
It is a misdemeanor knowingly and willf6i11y to commit, or to
order, instruct, or direct another to commit, any of the following
acts:
(1) To make a false statement in any request for inspection,
certificate or other lawfully authorized or required
form or statement provided by this ordinance.

(2) To perform electrical work for another without a
proper license for such work.
(3) To fail to file a request for inspection when required.
(4) To interfere with, or refuse entry to, an inspector
lawfully engaged in the performance of his duties.
(5) To violate any lawful rule, regulation or order of
the Utilities Commission.
Section VII. Ordinances No. 158 and No. 317, pertaining to the use of electrical
energy and establishing requirements relating to electrical wiring and electrical
installations, and providing for penalty for violation thereof, are hereby revoked
in total and superseded by this Ordinance.
Section VIII. Any person, firm or corporation vt6l&tL*ngoan9rn*f the provisions
of this ordinance shall upon conviction thereof, be fined by a fine of not to
exceed $100.00 or by imprisonment in the County Jail, not exceeding ninety (90)
days or both. Each day that a violation is permitted to exist shall constitute
a separate offense.
Section VII. This ordinance shall be in full force and effect after publication
in the official newspaper.

advertise for bids for a police patrol car, bids to be opened at 8:00 P.M. on
Feburary 10, 1969, in accordance with specifications and recommendation presented.

ORDINANCE NO. 331
AN ORDINANCE AUTHORIZING IMPOUNDING PROPERTY; PROVIDING FOR RELEASE OR
DISPOSAL THEREOF.
THE CITY OF HUTCHINSON DOES ORDAIN:
SECTION 1. Impounding. Any vehicle parked in violation of the
ordinances and regulations of the City; any water craft docked or moored
in violation of the ordinances and regulations of the City; any property;`,
which shall unlawfully interfere with, obstruct or tend to obstruct or",
render dangerous for passage or unsafe any public street, lands or waters;
or any property lawfully coming into the possession of the City and
remaining unclaimed by the owners, shall be impounded when such impoundment
is necessary and in the public interest or in the interest of preservation
of the private right in the property.
SECTION 2. Care. Impounded property shall be stored and cared for by
the Chief of Police to reasonably insure its preservation and returned to
the owner at the earliest opportunity. Any cost of storage or tare shall
be paid by the owner before return of the property. If the cost of care
and storage exceeds the value of the property, or the property is of no
value, it may be summarily disposed of.
SECTION 3. Unclaimed ]property. Impounded property unclaimed after
reasonable notice to the owner shall be sold.
SECTION 4. Public Sale. Impounded property may be sold at public
auction to the high*st bier for cash after publication of a notice of
a sale in the official newspaper not less than ten days before the date
of the sale, and after mailing a copy of such notice to the owner thereof
by certified mail no less than five days before the sale, at his last known
address, if such address can reasonably be ascertained:
SECTION 5. Private Sale. Impounded property may be sold at a private
sale after it has been in the possession of the city for at least three
months, after publication of a notice of sale in the official newspaper
once not less than ten days before the date of the sale, and after mailing
a copy of such notice to the owner thereof by certified'mail no less than
five days before the sale, at his last known address, if such address can
reasonably be ascertained.
SECTION 6. Notice. The required notice shall state the time and
place of sale, the description of the property, the cost of removal and
storage for which the sale will be held, and that the sale is pursuant to
the provisions of this ordinance.
SECTION 7. Conduct of Sale. The Chief of Police or such person as
may be designated by him, shall conduct the sale and shall execute and
deliver to the purchaser, a certificate of sale of such property.
SECTION 8. Proceeds of Sale. The proceeds of the sale shall be
applied to expenses of sale, then to the costs of impounding, including
removal, storage, and care. Any balance remaining shall be placed in the
general fund- of the City subject to the right of the owner to claim the
some upon application and satisfactory proof of ownership within six
months of the sale.
SECTIW 9. Animals Excluded. This ordinance shall not apply to
animals impounded under Ordinance No. 255.
SECTION 10. This o4dinance shall be in force and in effect from

and after its passage and publication.

CONTOUR MRRS AND COMPREHENSIVE PLAN
Engineer Priebe proposed that additional contour maps be ordered from
the 1968-1969 budget.
Motion by John Povolny, seconded by Tom Cone, that the Planning Commission
recommends to the City Council additional contour maps for approximately
520 acres at an estimated cost of $3276.00 as outlined on the map on file
in the office of the City Engineer. Motion carried.
Engineer Priebe was requested to ask Jim Hawks to attend the March or
April Planning Commission meeting to discuss updating of the Comprehensive
Plan of the city.

PLAN FOR FINAL PLAT OF ROBERTS 2ND ADDITION
Engineer Priebe presented the Plan of the Final Plat of Roberts 2nd
Addition.
Motion by Leslie Linder, seconded by Ethne Stearns, that the Planning
Commission recommends to the City Council that the Plan of the Final
Plat of Roberts 2nd Addition be approved subject to the Secretary's report
(i.e. 12' easement for utilities on side lot lines); and further that
the Planning Commission recommends that approval of the Final Plat be
contingent upon signing of a Subdivision Agreement to include the
following: .
1. Southwest Storm Sewer to be under contract before Building
Permits are issued; drainage plan.
2. Proposed Kay Street to be graded before utilities installed.
3. Parks and -Playgrounds contribution of $910.00.
