Liquor & wine 355.66 15,455.41 Regular Council Proceedings - 4 - March 101 1969 Frank Broderius, as Disaster Chairman for the McLeod County Red Cross, stated the Red Cross will aid persons who must be moved from their homes in the event of a flood of the Crow River. The Mayor has the power to declare an emergency and to order evacuation of homes. He further stated the Red Cross will give financial help for the preparation of food for workers, but the City must provide a food preparation center. Tom Mealey was instructed to work with the Civil Defense department and other city departments to set up a flood control program. The Sxmer Citizens Center is to be used as a food preparation center. Frank Engelhart notified the Council he has made an emergency closing of the Public Library because of danger from gas fumes from gas underground which has seeped from theSinclair storage tanks. He is working with the State Fire Marshal and the local Fire Inspector. John Miller and LeRoy Majeski stated they will be requiring water and sewer services for the proposed Mobile Home Park in Rolling Oaks. Mr. Miller stated he hag agreed to bring water and sewer to the edge of the proposed park at no cost to the city. Mr. Miller and Mr. Majeski were requested to bring in a 100% petition for water and sewer to eliminate the need for a public hearing. The City Clerk presented the following Petition for Annexation, duly filed with the County Auditor and Township Boardrp from Carl E. and Joyce K. Motion carried unanimously. The City Clerk presented petition for water and sewer from Carl Moehring to service lot to be annexed (north of Lewis Avenue at Larson Street intersection.) Engineer Priebe was instructed to ask Mr. Moerhing to have other property owners join in a 100% petition to eliminate the need for a public hearing. Tom Mealey reported the city needs tepair parts for the sewer rodding equipment, at an estimated cost of $821.95. Mr. Mealey was authorized to order the equipment needed inasmuch as the city will be receiving approxi- mately $1100.00 from Johnson Bros. Construction Co. for use of this equipment. Engineer Priebe reported new date will have to be set for opening of bids on the Southwest Storm Sewer inasmuch as the Advertisement for Bids did not appear in the Construction Bulletin as required. Alderman Linder introduced Ordinance No. 337 for its first reading and moved its adoption: RESOLUTION NO. 2849 RESOLUTION ORDERING PREPARATION OF REPORT ON IMPROVEMENT WHEREAS, it is proposed to improve Dale Street (County Road #7) from Linden Avenue to approximately 400* south of County Road #77 by watermain, and the south line of Lot 90 in Lynn Addition from proposed Sunset Avenue extension to Dale Street (County Road #7) by sanitary sewer, and to assess the benefited property for all or a portion of the cost of the improvement, pursuant to Minn. Stats., Secs. 429.011 to 429.111 (Laws 1953, Ch. 398, as amended), NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA: That the proposed improvement be referred to Marlow V. Priebe, City Engineer, for study and that he is instructed1to report to the council with all convenient speed advising the council in a preliminary way as to whether the proposed improvement is feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimated cost of the improvement as recommended. Priebe, City Engineer, with reference to the improvement of Dale Street (County Road #7) from Linden Avenue to approximately 4001 south of County Road #77 by watermain, and the south line of Lot 90 in Lynn Addition from proposed Sunset Avenue extension to Dale Street (County Road #7) by sanitary sewer, and this report was received by the council on March 10, 1969 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNEGOTA: 1. The council will consider the improvement in accordance with the report_ and the assessment of abutting property for all or a portion of the cost of the improvement pursuant to Minn. (Project 17-7 Southwest Storm Sewer) WHEREAS, Resolution No. 2837 as adopted by the City Council on February 24, 1969, fixed the date of Thursday, March 27, 1969, at 2:00 P.M. for the opening and consideration of bids for the improvement of an area of the City of Hutchinson known as the Southwest Storm Sewer District, as outlined on the map on file in the office of the City Clerk, by storm sewer construction, and WHEREAS, it has been determined that it is not feasible to open bids on the date as specified in Resolution No. 2837. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUTCHINSON, MINNESOTA: 1. The city clerk shall prepare and cause to be inserted in the official paper and in the Construction Bulletin an advertisement for bids upon :the making of such improvement under such approved plans and speci- fications. The advertisement shall be published three times, shall specify the work to be done, shall state that bids will be opened and considered by the council at 2:00 P.M. on Thursday, April 3, 1969, in! -the council chambers of City Hall, and that no bids will be considered unless sealed and filed with the clerk and accompanied by a certified or cashier's check or a bidder's bond in the amount of ten per cent (10) of the amount bid. 2. Such advertisement shall further state that the City reserves the right to reject any and all bids and to waive any informalities or irregularities, and that no bidder may withdraw his bid for a period of thirty (30) days. Monge, Cit Clerk (Published in The Hutchinson Leader on Friday, March 14, 1969 PUBLICKV1101 NO. 1161 ORDINANCE NO. 334 AN ORDINANCE TO CONTROL THE OPERATION OF SNOWMOBILES WITHIN THE CORPORATE LIMITS OF THE CITY OF HUTCHINSON I= CITY OF HUTCHINSON DOES ORDAIN: Section I For the purpose of this Ordinance, the following definitions shall apply: A. Snowmobile - A self-propelled vehicle designed for travel on snow or ice or a natural terrain, steered by wheels, skiffs or runners. B. Operator - A person who operates or is in actual' control. C. Operate - To control the operation of a snosmbbile, Section II It is the intent of this Ordinance to -supplement the laws of the State of Minnesota, Chapters 168 through 171, Minnesota Statutes, with respect to the operation of certain motor vehicles commonly known as snowmobiles. This Ordinance is not intended to allow what the state statutes prohibit nor to prohibit what the state statutes allow. Section III It is unlawful for any person within the city limits of the City of Hutchinson to operate a snowmobile as follows, to -wit: A. On private property of another without permission of the owner or occupant of said property. B. On publicly owned lands, including schools, recreation areas, playgrounds, cemetery and airport, except as permitted by this Ordinance. C. Within the right of way of any street, avenue, alley, or sidewalk except as permitted by this Ordinance. D. In a manner so as to create a loud, unnecessary or unusual noise which disturbs, annoys or interferes with the peace and quiet of other persons. Section IV Section III of this Ordinance shall not prohibit the opewation of a snowmobile as follows, to -wit: A. A ,snowmobile may make a direct crossing of a street provided the crossing is made at an angle of approximately ninety degrees (90o) to the direction of the street and at --a place where no obstruction prevents a quick and safe crossing; provided the snowmobile is brought to a complete stop before crossing the shoulder or main traveled way of the street and the driver yields the right.of way to all oncoming traffic which constitutes an immediate hazard. B. A snowmobile may be operated upon the streets and avenues within the City of Hutchinson in an emergency during the period of time when and at locations where snow upon the roadway renders travel by autompbile impractical. Section V It is unlawful to operate a snowmobile on the public streets and highways and in publicly owned areas unless the operator shall have a valid motor vehicle driver's license or is accompanied by a licensed driver who is actually occupying a seat in the vehicle, and without having such-singwmobile registered as provided in Section 84.82 Minnesota Statutes. Section VI. No person shall operate or halt any snowmobile carelessly or heed- lessly in disregard of the rights or the safety of others, or in a manner so as to endanger any person or property, and shall not exceed twentyhfive (25) miles per hour on lands designated in Section III. Ordinance No. 334 (continued) page 2 Section VII No snowmobile shall be driven within one hundred (100) feet of any fisherman, pedestrian, skating rink or sliding area where the operation would conflict with use or endanger other persons or property. Section VIII All snowmobiles shall have the following equipment, to -wit: A. Standard mufflers which are property attached and which properly reduce the noise of operation of the vehicles to the minimum noise necessary for operating the vehicle. No person shall use a muffler cut-out, by-pass, or similar device on s"d vehicle. B. Adequate brakes as required by Minnesota Statutes, Chapter 169, as it pertains to motor vehicles, and at lease one head light and one tail light. C. A Safety or so-called "dead man" throttle in operating condition. A Safety or "dead man" throttle is defined as a device which, when pressure is removed from the accelerator or throttle, causes the motor to be disengaged from the driving trach. Section IX It is unlawful for the owner or operator to leave or allow a snowmobile to be or remain unattended on public property. Section X. Notwithstanding the prohibitions of this Ordinance, the Superintendent of Arks and Playgrounds, with the prior approval of the Park Board, shall have the authority to designate certain park areas for the use of snowmobiles and to establish rules and regulations for the use thereof. The Mayor shall have the authority to designate public areas, other than schools, park property and playgrounds, that he shall deem available for such use. Section XI. Any person violating the terms of this Ordinance shall, upon conviction thereof, be fine a sum not to exceed One Hundred Dollars ($100.00) or shall be imprisoned foraiperiod of not more than ninety (90) days. The Council expressed the opinion that only one business should be licensed for taxi service in the city and that the person who purchased the exitting business should have first opportunity for a license. Members absent: Gordon Bublitz, John Povolny Also present: Jim Hawks, Midwest Research JIM HAWKS, COMPREHENSIVE PLANNING Jim Hawks presented his views on past growth and future growth and planning for the City of Hutchinson, especially as pertains to updating -,the present Comprehensive Plan and qualifications for 1170111 program. He stated that if application were filed today for 1170111, the earliest approval could be received would be between January and June of 1970, or later. He emphasized that all plans have to be approved by the State Highway Dept., the State Planning Agency and the local School Board so their needs will be considered in comprehensive plans. Engineer Priebe stated that the city's plan now needs updating because it is old, should qualify for 11701T1, zoning is outdated, street patterns need updating, and the city has installed new water, sewer and storm sewer lines which should be included and considered in future planning. Mr. Hawks agreed to present cost estimates for updating of the present Com- prehensive Plan , including qualification for 1170111 program. (Also see note at end of minutes.) They were told assessments would not be made until such time as they annexed to the city.
