15. NEW BUSINESS (9 P.M.)
a. Elmer Merickel would like to discuss the street grading in front of
the lots he owns in Oak Park Second Addition.
b. Mill Levy - The Council should bear -in -mind that the 1964 Mill Levy
must be established by October 10, 1964. Any deficiencies noted
in establishing the budget this last spring should be noted and
considered for this next Mill Levy.

a. Building Permits - Report from Planning Commission on Goebel application-
b. Petitions - Petition and Waiver of Hearing for Sewer and Water on
Oak Lane
c. Lewis Avenue - If the Project proceeds, a "Resolution ordering
installation of branch Sewer and Water pipes in advance of street
paving" should be passed. A time limit must be set within which
property owners may do this themselves. It is recommended that
this be kept short.

July 27, 1964
A regular Council Meeting was called to order by Mayor Rolfe in the
Council Chambers at the hour of 7:30 P.M.
Members present: Aldermen Hanson, Fitzloff, Johnson, Stearns, Attorney
Schantzen, Engineer Wilson, Asstt Engineer Powers
Members absent: Treasurer Smith
Mot ion was made, seconded and carried to approve the minutes of the
Regular Meeting of July 13, 1964.
Motion was made, seconded and carried that the following bills be
allowed and paid out of the proper funds as follows with the exception
of Donnor Communications, Minneapolis, Minnesota, in the amount of
$8,795.70, which is to be held pending written recommendation from

The following application for a Cigarette license for a period
beginning August 1, 1964 to December 31, 1964, accompanied by the proper
fee of $5.00, was presented:
McLeod County Agriculture Association - Fair Grounds
Motion was made, seconded and carried that the above application be
granted.
The following application for "On Sale" beer license beginning August 1,
1964 to December 31, 1964 and accompanied by the proper fee for $50.00
was presented:

Motion was made, seconded and carried that the above application be
granted.
Applications for trailer permits were presented as follows:

It was reported that Mrs. Howard has secured an apartment and put her
trailer up for sale, so no further action is necessary on this appli-
cation.
Mr. Carl Christensen is also to present an application for trailer
permit, but has not yet done so.
Motion was made by Alderman Fitzloff that Mr. Schultz, Mrs. Moisan and
Mr. Schmidt be notified they are to pay the inspection fee of $10.00 at
the City Clerk's office, and in accordance with City Ordinance No. 227,
the trailer will then be inspected by Chief of Police Broderius and/or
Engineer Wilson to determine whether a permit should be granted. Such
permits will be granted, upon recommendation, at the next Council
meeting, and will then be delivered by Chief of Police Broderius with
an affidavit to the City Clerk that permit was personally delivered.
Motion seconded by Alderman Johnson and upon vote being taken, the motion
carried.
Mayor Rolfe opened the hearing on Publication #890 at 8:00 P.M. for
Oak Park Storm Sewer District.
Property owners Bill Preese and Howard Popp were present.
Engineer Wilson gave a summary of the project and estimated costs.
Questions were asked as to whether it is necessary to include all three
projects - storm sewer, curb and gutter and street improvement - at this
time. Alderman Stearns reminded Mr. Pppp that the council had received

on that basis. Hearing closed.

Thereupon:
Alderman Stearns introduced the following resolution and moved its
adoption:
RESOLUTION NO. 2319
RESOLUTION ORDERING IMPROVEMENT
WHEREAS, Resolution #2312 of the City Council adopted the 13th
day of July, 1964, ordered a City Council hearing on the Oak Park Storm
Sewer District Project,
AND WHEREAS, ten days' published notice of the hearing through
two weekly publications of the required notice was given and the
hearing was held thereon on the 27th day of July, 1964, at which all
persons desiring to be heard were given an opportunity to be heard
thereon,

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
HUTCHINSON:
1. Such improvement is hereby ordered as proposed in the Council
resolution adopted July 13, 1964.
2. Plans and specifications prepared by Engineer Wilson for
such improvement pursuant to council resolution, a copy of which plans
and specifications is attached hereto and made a part hereof, are
hereby approved and shall be filed with the City Clerk.
Alderman Johnson seconded the motion to adopt said resolution, and
upon vote, the following voted in favor of said Resolution No. 2319:

Lewis Avenue Storm Sewer Project.
9 property owners were present.
Engineer Wilson gave a summary of the project and estimated costs.

Milton Altmeyer stated his cost was high, and inasmuch as his water is
drained off in a private tile, he would not be benefited.
Hearing closed.
Discussion on project.
Action was tabled until the Special Council meeting of July 30, at
which time a decision will be reached.
Mr. Carl Hoeft stated that they do not feel they can pay an assessment
on tile for relieving back pressure on the storm sewer line. He did
agree to give easement for property for storm sewer along his west
property line.
Motion was made that Engineer Wilson obtain an easement to take care
of the storm sewer by the Carl Hoeft property. Motion seconded and
carried.
Mr. Don Dobratz stated that -he has a problem similar to the one of Carl
Hoeft concerning drainage on his property.
Mr. John Busch reported on the liquor store, as follows:
1. There is a need for an additional employee, with the potential
of taking over when Mr. Ames retires.
2. He presented a long-range program for the future - enlarging
the cooler facilities and store itself to give greater selection and
service as well as sales.
Alderman Johnson was authorized to talk over the matter of a third
employee with Mr. Ames and get his suggestions.
Engineer Wilson reported that he and Attorney Schantzen had attended
the County ditch 18 hearing wherein the petition was denied. Attorney
Schantzen reported that if the City wishes to do something for these
people, they have no recourse but to pay the assessments.
The building permit application of Goebel Fixture Company for a 501 x 120'
addition to the present building was referred to the Planning Commission,
with the recommendation that adjoining property owners be at the hearing
to voice any objections, or that Goebel Fixture Co. presents a petition
waiving objections when he appears before the Planning Commission.

Motion was made by Alderman Stearns that Resolution No. 2317 adopted
by the Council at the meeting of July 13, 1964, be amended to read
"bids will be opened and considered by the council at 8:00 P.M. on
August 10, 1964." Motion seconded and carried.
Recommendations from the Planning Commission were acted upon as follows:
Motion made and seconded that a T ecial permit be granted to Mrs. LeRoy
Houck, 300 E. Pishney Lane, by Zajicek Bros., to place a new roof on
her old garage and build a new attached garage. Motion carried
Motion made and seconded to denya special permit for Mr. Ray Ewald,
916 Lewis Ave., to build a double garage and breezeway in that it
conflicts with City Ordinance No. 245, Sec. 4-E. Motion carried.
Motion made and seconded to deny the preliminary plat of Hansen's
subdivision because it does not comply with the City ordinance cover-
ing half streets, with the recommendation that a revised plat be filed
with the changes as suggested by the City Engineer, Motion carried.
Mrs. Violet Horrmann was appointed by Mayor Rolfe to fill out the un-
expired term of Mrs. Charles Sheppard on the Library Board. Motion
was made and seconded that the appointment of Mrs. Horrmanri be ratified
by the council. Motion carried.
Attorney Schantzen was instructed to write to Mr. D. Whittet, real
estate broker, to indicate that the city is not at this time interested
in buying two lots on 2nd Avenue S. W. owned by Col. Harold Peterson.
Motion was made and seconded that the petition of Al Patrias, 192 5th
Ave. N. W. for a street light at Water Street and Fifth Ave. N. W. be
granted. Motion carried.
Engineer Wilson reported on a request for curb and gutter for 3 lots
on North Bluff Street. He recommended allowing this request under
certain conditions. Alderman Fitzloff and Engineer Wilson will inves-
tigate and report to the Council at its next meeting.
Motion was made and seconded to grant curb and gutter to Harry Poppen,
as petitioned, for lot 2, block 1, Southview Sub -division, 70' @$1.80
per lineal foot. Motion carried.
Motion was made and seconded to accept the petition and waiver of
hearing of Janice and Eugene M. Olsen for curb and gutter and street
base for lot 1, block 5, Hillcrest Addition. Motion carried.
Engineer Wilson reported that the street lights on the school road
are all one circuit and that the cost of converting to a second circuit
would be in the neighborhood of $550.00, with a resulting saving to the
city of approximately $175.00 per year. Following discussion, the
matter was tabled.
Motion was made and seconded that Attorney Schantzen ne.gotiit& an
agreement with Mr. Robert Mulvaney for easement for the Oak Park Storm
Sewer drainage for a sum not to exceed $400.00. Motion carried.

A letter was presented from the Franklin Street Baptist Church requesting
permission to use the band stand and the surrounding area in the library
square for one hour from 8:00 P.M. to 9:00 P.M. on Sunday evenings,
August 9, 16 and 23, 1964, for a "community hymn sings' type of program.
Motion was made, seconded and carried that the request from Franklin
Street Baptist Church be granted.
Alderman Fitzloff introduced the following resolution and moved its
adoption:
RESOLUTION NO. 2318
WHEREAS, Dr. Charles G. Sheppard, Health Officer of the City of
Hutchinson, has resigned from his position because he has sold his
practice and is leaving the city, and
WHEREAS, Dr. Sheppard has devoted time and talent to the service
of the City of Hutchinson at little personal reward to himself;
ROW THEREFORE, BE IT RESOLVED: That the City of Hutchinson does
hereby commend and thank Dr. Charles G. Sheppard for his service and
help as City Health Officer and appreciates the work done on behalf
of the City.
Alderman Stearns seconded the motion to adopt said resolution, and
upon vote being taken, the following voted in favor of this resolution

SPECIAL COUNCIL PROCEEDINGS July 30, 1964
A Special Council meeting was called to order by Acting Mayor Johnson
in the Council Chambers at the hour of 2:10 P.M.
Members present: Aldermen Hanson, Fitzloff, Johnson, Stearns,
Attorney Schantzen, Engineer Wilson
Members absent: Mayor Rolfe, Treasurer Smith
Also present: Members of Nursing Home Board - Mr. Mills, Mr.
Cone, Mrs. Zeleny, Mr. Braun, Mr. Lee.
Acting Mayor Johnson called for bids Publication No. 888.
The meeting was turned over to Mr. Roger Patch of Patch & Erickson,
Minneapolis, to open bids for kitchen equipment for Burns Manor
Nursing Home.
The following bids were received:

Discussion on bids.
The Nursing Home Board voted unanimously to recommend the following
to the City Council:
Resolved:
That the Hutchinson Nursing Home Board for the City of
Hutchinson recommends that the City Council of the City of
Hutchinson accepts the low bid of St. Paul Bar and Restaurant
Supply Co. of St. Paul for kitchen equipment for the Burns
Manor Nursing Home.
Alderman Stearns made a motion to accept the recommendation of the
Nursing Home Board to accept the bid of St. Paul Bar and Restaurant
Supply Co. of St. Paul for kitchen equipment for the Burns Manor
Nursing Home.
Alderman Hanson seconded the motion of Alderman Stearns and upon vote
being taken, the motion carried.
Discussion on Lewis Avenue Storm Sewer Project.
Mr. Johnson reported that Mr. Don Dobratz had verbally agreed to the
following:
1. A team of three Appraisers - one appointed by Mr. Dobratz,
one appointed by the City Council, and a third impartial one
appointed by the first two - should arrive at a fair price
on 16-1/2t of land for street right-of-way.
2. Mr. Dobratz would agree to a fair price set by this team of
Appraisers.
Mr. Don Kost has indicated that he is also willing to go along with
the above.
Alderman Stearns made a motion that Mr. James Paulson be appointed as
Appraiser for the City of Hutchinson to meet with an Appraiser
appointed by Mr. Dobratz and a third Appraiser chosen by the afore-
mentioned two Appraisers, to arrive at a fair price for 16-1/21 of
land for street right-of-way.
Motion seconded by Alderman Fitzloff, and upon vote being taken, the
motion carried.

Discussion on easement for Lewis Avenue Storm Sewer drainage by the
Chernousek and Bretzke properties.
Alderman Fitzloff introduced the following resolution and moved its
adoption:

Alderman Stearns introduced the following resolution and moved its
adoption:
RESOLUTION NO. 2321
RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND
ORDERING ADVERTISEMENT FOR BIDS
WHEREAS, the City Engineer tias prepar_t--a plans and specifications
for an Office and Maintenance Building, Department of Parks, and nas
presented such plans and specifications to the council for approval;
NOW THEREFORE, BE IT RESOLVED by the City Council of Hutchinson,
Minn:
1. Such plans and specifications, a copy of which are attached
hereto and made a part hereof, are hereby approved.
2. The City Clerk shall prepare and cause to be inserted in the
official paper, an ad-rertisement for bids upon the making of such
improvement under such approved plans and specifications. The adver-
tisement shall be published for one day, shall specify the work to be
done, shall state that bids will be opened and considered by the
council at 8:30 P.M. on August 10, 1964, in the Council chambers of
the city hall, and that no bids will be considered unless eealed and
filed with the clerk and accompanied by a cash deposit, cashier's
check, bid bond or certified check payable to the clerk for 10 per
cent of the amount of such bid.

The following application for a Cigarette license for a period beginn-
ing August 1, 1964 to December 31, 1964, accompanied by the proper
fee of $5.00, was presented:

Motion was made, seconded and carried that the above application be
granted.
Motion made that the bill of Donnor Communications covering the fire
department alerting system be paid at $4886.50, one-half the full
amount, per written recommendation from Mr. Englehart, Fire Chief,
with a letter explaining to Donnor how the balance will be paid.
Motion seconded and carried.
Report was given on progress of the building permit application of
Goebel Fixture Co.

August 7, 1964
Motion was made by Lloyd Torgrimson that the Hutchinson Planning
Commission recommends to the City Council of Hutchinson approval
of the request by the Goebel Fixture Company for a variance in
the side yard set -back requirement under section 12-Eb of Ordinance
245, on their application for land use permit no. 308..
Motion was seconded by Clinton Tracy, and upon vote being taken,
carried.
The Commission also recommends that in the approval of this request
for variance there be a stipulation that the owner of said property
shall be expected to maintain this building in a manner such as to
protect the value of the adjacent property.
