ORDINANCE NO. 273

AN ORDINANCE ADOPTING ZONING REGULATIONS IN THE CITY OF HUTCHINSON,
MINNESOTA
The City Council of the City of Hutchinson ordains as follows:
SECTION I. That Section 5-B (Map) of Ordinance No. 245 be amended so
that as amended same shall show as follows:
The boundaries of these districts as shown on the map
entitled "City of Hutchinson Zoning Map," which map is
hereby made a part of this Ordinance, provided however,
That part of Lots Seven (7) and Eight (8) of Auditors
Plat Lot 15 Auditors Plat Section Seven (7) -116-29
approximately 1301 frontage on file and of record in the
Office of the Register of Deeds in and for McLeod County,
Minnesota, and the same is hereby designated as and
hereby designated as and hereby made a part of that
District of said City Zoning Map, rezoning from R-1
to B-1.
SECTION II. Any person who shall violate or refuse to comply with
any of the provisions of this Ordinance shall be subject upon
conviction thereof to a fine of not less than twenty-five dollars
($25.00) or more than one hundred ($100.00) dollars or imprisonment
of not more than ninety (90) days for each offense. Each day that
the, violation is permitted to exist shall constitute a separate
offense.
SECTION III. This Ordinance shall be in full force and effect from
and after its passage and publication.
Alderman Hanson seconded the motion of Alderman Fitzloff to introduce
Ordinance No. 273 on its third and final reading. Upon roll call, all
members present voted in favor of Ordinance No. 273 and it was
declared passed on its third and final reading.
Adopted by the City Council this 26th day of April, 1965.
Mayor Rolfe re -appointed the following to the Library Board for
three year terms as recommended by the Library Board;
Elaine Clay, Ned Stearns, Jay Alrick
Motion was made, seconded and carried that these appointments be

Alderman Fitzloff introduced the following resolution and moved its
adoption:
RESOLUTION NO. 2361
WHEREAS, the Mayor of the City of Hutchinson has been
requested to enter into and ex_cute an "Assurances Required by
Title VI of the Civil Rights Act of 1964 and Part 15 of the Federal
Aviation Regulations" in connection with the operation and use of the
Hutchinson Municipal Airport;
NOW THEREFORE, it is hereby resolved by the City Council of the
City of Hutchinson that the Mayor of the City of Hutchinosn is hereby authorized
and directed to execute the said "Assurance"s Required by Title VI of the
Civil Rights Act of 1964 and Part 15 of the Federal Aviation Regulations"
in connection with the operation and use of said airport.
Alderman Hanson seconded the motion to adopt said resolution, and
upon vote being taken, the following voted in favor of Resolution No.2361:

Mr. L. D. Mills of the Nursing Home Board and Mr Francis Jensen, Supt
of ti!e Burns Manor Nursing Home gave a financial report on ths Burns
Manor Nursing Home.
Alderman Hansen made a motion to accept this report.
Alderman Fitzloff seconded the motion of Alderman Hanson, and upon vote
being taken, carried.
Mr Glen Grahn, State Highway Dept. was present in regard to the Traffic Signal;
at the intersection of Highways #7,# 22, and # 15.
LeRoy Klammer, a.s.seg� appointed to complete the unexpired term of �,S 5snr
Everett Oleson, gave a report on the work he had done during this period.
Discussion of the erection of a transformer station near Goebel's
Fixture Co. The clerk was directed to write the Utilities Commission
for information, and inform them of the requirementfor a Special Permit
for such construction according to Oifdinance No. 245.
Engineer Wilson explained the need of Contour Mapping and the benefits
for the Hutchinson area.
No action taken, decided to consider this project the coming year.
Alderman Fitzloff made a motion to have Engineer Wilson report on the
storm sewer problem in the area of the Altmeyer Farm Service.
Alderman Stearns seconded the motion of Alderman Fitzloff, and upon vote
being taken, carried.
Alderman Johnson made a motion to have Engineer Wilson report at the
next meeting on streets that need repair and seal coating.
Discussion of a temporary dam to be built this year. No action taken.

Alderman Stearns informed the Council of an inquiry for the purchase of
Lot 8, Park Subdivision, if it is rezoned from R-2 to B-3 (commercial)
Alderman Fitzloff made a motion to rezone Lots 6,7, & 8 Park Subdivision
from R-2 to B-3 and set a hearing for the next Planning Commission
meeting.
Alderman Stearns seconded the motion of Alderman Fitzloff, and upon vote
being taken, carried.
Alderman Fitzloff introduced the following resolution and moved its
adoption:
RESOLUTION NO. 2362
ASSURANCE OF COMPLIANCE WITH OFFICE OF EMERGENCY PLANNING
REGULATION 5 UNDER TITLE VI OF THE CIVIL RIGHTS ACT OF 1964
CITY OF HUTCHINSON HEREBY AGREES THAT it will comply with titleVI
of the Civil Rights Act of 1964 and all requirements imposed by or
pursuant to Regulation 5 of the Office of Emergency Planning (30 FR 321)
issued pursuant to that title, to the end that, in accordance with title
VI of that Act and the Regulation, no person in the United States shall,
on the ground of race, color, or national origin, be excluded from participation
in, be denied the benefits of, or be otherwise subjected to discrimination
under any program or activity for which the Applicant receives Federal
financial assistance from the Agency; and HEREBY GIVES ASSURANCE THAT it
will immediately take any measures necessary to effectuate this agreement.
If any real property or structure theron is provided or improved with
the aid of Federal financial assistance extended to the Applicant by the
Agency, this assurance shall obligate the Applicant, or in the case of any
transfer of such property, any transferee, for the period during which the
real property or structure is used for a purpose for which the Federal
financial assistance is extended or for another purpose involving the
provision of similiar services or benefits. If any personal property is
so provided, this assurance shall obligate the Applicant for the period
during which it retains ownership or possession of the property. In all
NX other cases, this assurance shall obligate theXXMKKXKM Applicant
for the period during which the Federal financial assistance is extended
to it by the Agency.
THIS ASSURANCE is given in consideration of and for the purpose of
obtaining any and all Federal grants, loans reimbursements, advances,
contracts, property, discounts or other Federal financial assistance
extended after the date hereof to the Applicant by the Agency. The
Applicant recognizes and agrees that such Federal financial assistance
will be extended in reliance on the representations and agreements
made in this assurance, and that the united States shall have the right
to seek judicial enforcement of this assurance. This assurance is binding
on the Applicant, its successors, transferees, and assignees, and the
person or persons whose signatures appear below are authorized to sign
this assurance on behalf of the Applicant.

this application and to file it in the appropriate State office for the
purpose of obtaining certain Federal financial assistance under the

Ken.Butler of the Airport Commission requested authority to employ an
operator for the Airport.
Alderman ritzloff made a motion to accept the recommendation of the
Airport Commission to enter into a contract for a period of one year
with R. Krantz,
as operator of the Municipal Airport, and to build 6 or 8 hangars
optional at the descretion of the Airport Commission.

Association:
Alderman Fitzloffmadea motion to approve the variance for a 15' set-
back on the west side of the proposed addition to the Hutchinson i
..Creamery Association, as recommended by the Planning Commission.
.Variance fee of $5.00 paid. ;

Alderman Johnson seconded the -motion of Alderman Fitzloff, and upon !
vote, carried. ”
Discussion of proposed purchase offer of $250.00 for Lots' 3, & '4 Park
Subdivision.
Alderman Stearns made a motion to accept the purchase offer :of
$250.00 for Lots 3 & 4 Park Subdivision from Merritt Jensen,, and
direct the City Attorney to draw up the necessary papers"+for the '

alley easement.
Alderman Fitzloff seconded the motion of Alderman Stearns, and upon' i
vote, carried.
Alderman Fitzloff made a motion to approve -the
following building permit: with Engineer approval ;
Hutchinson Creamery Association - 35 Adams Street North.' c
Boiler House and Warehouse - Lot 4 & 5, Block 46 W2 -
Alderman Johnson seconded the motion of Alderman Fitzloff and upon
vote being taken, carried.

SPEUAL COUNCIL PROCEEDINGS May N 1965
A Special Council Meeting was called to order by Mayor Rolfe in the
Council Chambers at the hour of 8:00 A.M.
Members present: Aldermen Hanson, Johnson, Fitzloff, Stearns, Attorney
Schantzen, Engineer Wilson, Treasurer Smith
Members absent: None
Discussion of budget.
No action taken.
Discussion of establishing a Sinking Fund for the Fire Department and
Water Department. It was decided to consult the Auditors on how this
should be done.
Motion was made, seconded and carried to establish a Sinking Fund for the
Fire Department in the amount of $5,000.00 yearly and for the Water
Department as proposed on the increase on water rates.
Motion was made, seconded and carried to adjourn at 9:15 A.M.

:`he Hutchinson Safety Council met for their regular meeting on April 26th,
at 12 o°clod-. noon, at hotel .Jorgenson. Hine members were in attendance.
It was moved and seconded that letters of appreciation be sent to the
Hutchinson Leader & ICDIJD for their safety messages during the flood.

Broderius go as delegates to the Safety Council At -yards Presentation dinner
