I am hereby appealing the above assessment in the amount of $2563.03
for the following reason. When we were at the hearing considering
the project we were told at the meeting that if I had paid an assessment
on one side I would not be assessed for the other side with the exception
of the curb. Now I am told this is not true in my case because I am in
an addition. I was of the opinion that at the hearing we were presented
111.the facts, and not just some of the facts and then find an assessment
such as this to be the case, when I expected only the curb and gutter.
I am also opposed to the project due to the fact that several
parcels are still agricultural in nature, and may not be collected till
it is developed, and that it seems the road is not ready for long term
paving as it appears to get torn up so often for various projects.

Dear Council Members:
We are moving to southeastern Minnesota June 13, 1981; therefore,
we will be unable to attend the City Council Meeting on Monday night,
June 15, 1981. However, we are writing this letter to voice our
opinion on the resurfacing of Merrill Street.
We feel that Merrill Street is in no need of repair at this
time. We did sign the petition to inform you of our opposition to
this project.
We hope you will consider our opinion in this letter and that
of our neighbors who signed the petition.

RE: Assessment - Lot 84 & E 187' of Lot 20
Dear Mr. Plotz,
In regards to the assessment on Lot 84 & 187' of Lot 20, Merrill's
Subdivision of Lot 86, Lynn Addition. It is a corner lot on Lynn
and Miller. When Lynn Road was improved I paid for* 100.11 improvement
and at that time I was told that when you have a corner lot you were
only assessed for the longest side.
I feel the assessment I have received is unfair and requesting that
since I have paid for 100.11 of improvement already that I only be
assessed for 87' on the Miller improvement.
I am enclosing g-a map of the lots showing that Lot 20 is only a narrow
strip which runs along the 500 block on the north side of Miller.
I am asking that the city council please reconsider this assessment.

Curb and Gutter and Appurtenances
We wish, via this letter to express our opposition to
the proposed curb and gutter installation. The reason for
our opposition is: We will not be doing any construction
until 1982. We can not at this time, determine when ingresses
and egresses should be. it very well could be that it would
be better not to have curb at certion sections to facilitate
parking. Having it put in this year and ripping out parts of
it next year will cause us appreciable and uneeded costs.
Ideally we would like to be open for a few months to determine
where and how heavy the traffic is.
When we purchased this land we had no indication that this
installation was proposed. The first we heard of this was the
letter from The City of Hutchinson, May 26. We want to emphasize
that we are not against these improvements per se, but only
on what for us is such 'short notice.
We request that the improvements affecting our property
be postponed.

RESOLUTION NO.
RESOLUTION AUTHORIZING AGREEMENT WITH
CITY ADMINISTRATOR RELATING TO DEFERRED COMPENSATION
WHEREAS, Gary D. Plotz, City Administrator of the City of Hutchinson, has elected
to be excluded from membership in the Public Employees Retirement Association, which
election has been approved by the City Council; and,
WHEREAS, prior to such action the City has contributed an employer's contribution
to the Public Employees Retirement Association for his account; in the amount of
5 -1/2% of gross salary; and,
WHEREAS, by reason of such election, the City's employer contribution to PERA on
his account will cease; and,
WHEREAS, Minnesota Statutes, Section 353.025, Subdivision 3, provides as follows:
"[DEFERRED COMPENSATION; CITY CONTRIBUTION.] If an election of exclu-
sion is made, and if the City Administrator and the governing body of
the City agree in writing that the additional compensation is to be de-
ferred and shall be contributed on behalf of the City Administrator to
a deferred compensation program which meets the requirements of Section
457 of the Internal Revenue Code of 1954, as amended through December 31,
1980, the governing body may compensate the City Administrator, in addi-
tion to the salary allowed under any limitation imposed on salaries by
law or charter, in an amount equal to the employer contribution which
would be required by Section 353.27, Subdivision 3, if the City Adminis-
trator were a member of the association."
WHEREAS, the City Council desires to exercise the authority conferred by the afore-
mentioned Subdivision 3, and provide compensation to an alternative deferred compen-
sation plan at a_rate of 5 -1 /2y of gross salary,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hutchinson, Min-
nesota, as follows:
1. In addition to the City Administrator's salary now in effect or which may
hereafter be established from time to time as his stated salary, Plotz shall be com-
pensated in an additional amount equivalent to 5 -1/2% of gross earnings, if he were
a member of the Public Employees Retirement Association subject, however, to the
provisions of the following paragraph of this resolution.
2. Such additional compensation shall be paid only if and during the time
that there is an agreement between the City and Plotz wherein it is agreed in writing
that the additional compensation is to be deferred and shall be contributed on behalf

of Plotz to a deferred compensation program which meets the requirements of Section
457 of the Internal Revenue Code of 1954, as amended through December 31, 1980.
3. Accumulated PERA contributions made by the employee with accumulated in-
terest will be transferred to an alternative deferred compensation program selected
by Plotz.
4. The accumulated employer's contribution cannot be reimbursed to either the
City or individual pursuant to Minnesota Statutes, Section 353.27; however, the City
hereby agrees to a negotiated lump sum payment equal to y of past employer's
contributions.
5. The Mayor, acting in behalf of the City, is hereby authorized to enter into
an agreement based on paragraphs 1 through 4 with Plotz. Upon execution of such
agreement, the Mayor, City Administrator and other appropriate officials of the City
are authorized to take the actions necessary to give effect to the provision of the
agreement.
Adopted by the City Council this day of , 1981.
