TUESDAY, MAY 12, 1981
1. CALL TO ORDER
The meeting was called to order by Mayor Westlund at 7:30 P.M., with the follow-
ing members present: Aldermen Lueneburg, Gruenhagen and Beatty, in addition to
Mayor Westlund. Absent: Alderman Peterson. Also present: City Administrator
Plotz, City Engineer Priebe, and City Attorney Schantzen.
2. INVOCATION
The invocation was given by the Reverend Manley Swarthout of the Wesleyan Church.
3. MINUTES
The minutes of the Special Meeting of April 9, 1981 and Regular Meeting of
April 28, 1981 were approved as read upon motion by Alderman Lueneburg, seconded
by Alderman Beatty and unanimously carried.
4. PUBLIC HEARING - 8:00 P.M.
(a) CONSIDERING THE ISSUANCE OF "ON- SALE" INTOXICATING LIQUOR LICENSE TO
VERLA JOHANNING, MAX'S
Mayor Westlund called the public hearing to order at 8 :03 P.M. and read
Publication No. 2420, Notice of Public Hearing for Issuance of "On- Sale"
Intoxicating Liquor License to Verla Johanning, Max's.
City Administrator Plotz commented briefly on the requirements by City Or-
dinance for an Intoxicating Liquor License.
Following discussion, the motion was made by Alderman Lueneburg to close
the hearing. The motion was seconded by Alderman Beatty and carried unani-
mously.
It was moved by Alderman Lueneburg, seconded by Alderman Gruenhagen, to
grant the issuance of an Intoxicating Liquor License to Verla Johanning for
Max's. Motion unanimously carried.

6. RESOLUTIONS AND ORDINANCES
(a) ORDINANCE NO. 2/81 - AN ORDINANCE TO ESTABLISH, DESIGNATE, ACQUIRE, PROVIDE,
REGULATE, MAINTAIN AND IMPROVE AN OFF- STREET PARKING SYSTEM WITHIN A CENTRAL
BUSINESS OFF- STREET PARKING DISTRICT, AND TO LEVY SPECIAL ASSESSMENTS AND

Following discussion, the motion was made by Alderman Lueneburg, sec4oded
by Alderman Beatty, to waive second reading and adopt Ordinance No. 616 en-
titled An Ordinance to Establish, Designate, Acquire, Provide, Regulate,
Maintain and Improve An Off- Street Parking System Within A Central Biness
Off- Street Parking District, and To Levy Special Assessments and Tai and
To Issue Bonds for That Purpose. Motion unanimously carried.
(b) ORDINANCE NO. 3/81 - AN ORDINANCE AMENDING ORDINANCE N0. 464 CONCERNING
ZONING REGULATIONS IN THE CITY'OF HUTCHINSON AND THE OFFICIAL ZONING MAP

After discussion, Alderman Beatty moved to waive the second reading and adopt
Ordinance No. 617 entitled An Ordinance Amending Ordinance No. 464 Ccern-
ing Zoning Regulations In the City of Hutchinson and the Official Zoning Map
(Annexed Schmidtbauer Property). The motion was seconded by Alderman Gruen -
hagen and carried unanimously.
(c) ORDINANCE NO. 4/81 - AN ORDINANCE AMENDING ORDINANCE NO. 464 CONCERNING
ZONING REGULATIONS AND THE OFFICIAL ZONING MAP (ANNEXED CLIFTON HEIGHTS)
Mr. John Mlinar spoke on behalf of the Clifton Heights residents and ex-
pressed appreciation to the Council for zoning the area R -2 and keeping it
residential.
It was moved by Alderman Lueneburg, seconded by Alderman Beatty, to waive
the second reading and adopt Ordinance No. 618 entitled An Ordinance Amend-
ing Ordinance No. 464 Concerning Zoning Regulations and the Official Zoning
Map (Annexed Clifton Heights). Motion carried unanimously.
(d) ORDINANCE NO. 5/81 - AN ORDINANCE TO VACATE A PARK LANE IN BLOCK 2,
HELLAND'S FOURTH ADDITION
Following discussion, the motion was made by Alderman - Beatty to waive the
second reading and adopt Ordinance No. 619 entitled An Ordinance to Vacate
A Park Lane in Block 2, Helland's Fourth Addition. Seconded by Alderman

After discussion, it was moved by Alderman Beatty, seconded by Alderman
Lueneburg, to waive second reading and adopt Ordinance No. 620 entitled
An Ordinance to Vacate Utility and Drainage Easement In Helland's Third
and Fourth Addition. Motion unanimously carried.
(f) RESOLUTION NO. 6770 - TRANSFERRING $10,000 FROM LIQUOR STORE TO GENERAL FUND
Following discussion, the motion was made by Alderman Lueneburg to waive
reading and adopt Resolution No. 6770 entitled Transferring $10,000 from
Liquor Store to General Fund. The motion was seconded by Alderman Beatty
and carried unanimously.
(g) RESOLUTION NO. 6771 - RESOLUTION-AUTHORIZING SUBSTITUTION OF SECURITIES
TO FIRST STATE FEDERAL SAVINGS & LOAN ASSOCIATION OF HUTCHINSON, MINNESOTA
After discussion, Alderman Beatty moved to waive reading and adopt Resolu-
tion No 6771 entitled Resolution Authorizing Substitution of Securities to
First State Federal Savings & Loan Association of Hutchinson, Minnesota.
Seconded by Alderman Lueneburg, the motion unanimously carried.
(h) RESOLUTION NO. 6773 - RESOLUTION OF APPRECIATION (JOSEPH_.A. GETZ)_
Appreciation was expressed to Joseph Getz for the 16 years of service he
has given to the City as an employee in the Park Department.
It was moved by Alderman Beatty, seconded by Alderman Gruenhagen, to waive
reading and adopt Resolution No. 6773 entitled Resolution of Appreciation.
Motion carried unanimously.

8. UNFINISHED BUSINESS
(a) CONSIDERATION OF IMPROVEMENT FOR LOT 3, BLOCK 2, MADSON ADDITION
(DEFERRED APRIL 28, 1981)
The City Engineer reported he was waiting for a response from the property
owner. The item was, therefore, deferred.
(b) CONSIDERATION OF REVISIONS TO ZONING ORDINANCE N0. 464, WITH FAVORABLE -:
RECOMMENDATION OF PLANNING COMMISSION (DEFERRED APRIL 28, 1981)
Alderman Beatty reported the proposed revisions in Section 9 were a culmin-
ation of work done by the Planning Commission over a number of months. The
material came from various sources and included parking requirements for all
.zones as well as setbacks.
A question was raised by Alderman Gruenhagen regarding the changes in mA_ni-
mum lot.area and setbacks for Zone R -3 in Section 9. He pointed out the
proposed minimum would reduce the number of units to be built on a lot d
increase the cost per unit. Y
City Administrator Plotz explained the following reasons for the addi-
tional setbacks: 1) to increase green space, 2) to be responsive to com-
plaint the Planning Commission receives on the positioning of apartment
complex, such as Clinton House, and 3) to have a greater distance between
buildings for fire safety.
Fire Chief Schlueter commented that the Fire Department could probably per-
form its work without the additional setback, but he recommended that sprink-
ler systems be installed in buildings over one -story high.
Jim DeMeyer stated he was opposed to the proposed change in Section 9.
Following extensive discussion, the Mayor made the recommendation to ap-
prove the revised Zoning Ordinance No. 464, with the exception of Section 9
and to have the Planning Commission review it one more time.
The motion was made by Alderman Lueneburg to accept the amendments to Zon-
ing Ordinance No. 464, with the exception of Section 9, and refer it back
to the Planning Commission for further recommendation. Seconded by Alder-
man Beatty, the motion unanimously carried.

the first reading of Ordinance No. 7/81 entitled Amending Zoning Ordinance
No. 464 and set second reading for May 26, 1981. Motion carried unanimously.
9. New Business
(a) CONSIDERATION OF ADVERTISING FOR BIDS FOR COMMERCIAL KITCHEN FOR EVERGREEN
APARTMENTS
City Administrator Plotz reported the City would receive $32,500.00 in grant
assistance from Region 6E for equipment and furnishings in the Senior Center
and kitchen located in .Evergreen Apartments. It was recommended to adver-
tise for bids to be received on May 27, 1981 at 2:00 P.M.
After discussion, Alderman Beatty moved to authorize advertising for bids
for a commercial kitchen in Evergreen Apartments to be opened May 27, 1981
at 2:00 P.M. The motion was seconded by Alderman Gruenhagen and carried
unanimously.
(b) CONSIDERATION OF AL BRINKMAN'S SKETCH PLAN OF SECTION 32 OF HUTCHINSON
TOWNSHIP TO SPLIT PRESENT LOT INTO TWO PARCELS WITH FAVORABLE RECOMMENDATION
OF PLANNING COMMISSION
City Engineer Priebe reported the County and Township are asking the City
to consider AI::Srinkman's sketch plan of Section 32, Hutchinson Township,
to split the present lot into two parcels. He pointed out that the abutting
property, Our Savior's Lutheran Church, will be requesting annexation into
the City. Therefore, it was his recommendation to request a letter from the
present property owner of Section 32 stating it will be annexed into the City
when Our Savior's Lutheran Church or any other surrounding property owner
requests annexation.
Following discussion, the motion was made-by Alderman Beatty, seconded by
Alderman Lueneburg, to approve the sketch plan of Al Brinkman, with the con-
tingency of annexation. Motion unanimously carried.
(c) CONSIDERATION OF NEW FIRE TRUCK FOR FIRE DEPARTMENT
Fire Chief Schlueter requested authorization from the Council for the Fire
Department to advertise for bids to replace a 1942 fire truck with a new
one. He stated that with the present building going on in the City, the
additional pumping capacity was needed. The Fire Chief further stated that
there was $23,000.00 in the bank and $20,000.00 had been budgeted for the
Fire Department, with a total of $43,000.00 available toward the purchase
of the new fire truck.

Fireman Jim Brodd presented the estimated costs for a proposed 1250 G.P.M.
conventional pumper as submitted by four manufacturers. He stated there
would be a 12% increase each 6- months on the proposed cost.
After considerable discussion, it was the general consensus of the Council
that the first priority should be building the new fire station. Then they
would consider a new fire truck.
Following the Mayor's statement that available funds for the pumper were
questionable at this time; Jim Brodd stated the Firemen's Relief Associa-
tion would be willing to loan the City money from their funds on a percent-
age basis agreeable to both parties. The Mayor questioned the legality of
funding the truck in this manner.

Alderman Lueueburg made the motion to defer action on the fire truck unfit
the new fire station is completed and then consider this matter at budg
time. .Seconded by Alderman Gruenhagen, the motion carried unanimously.'

(d) CONSIDERATION OF SETTING PUBLIC HEARING FOR PROPOSED $650,000 COMMERCIAL
DEVELOPMENT REVENUE NOTE (MCCORMICK PROPERTIES PROJECT /PRAIRIE HOUSE, INC.,
LESSEE)
City. Administrator Plotz reported that an industrial revenue bond was being
requested by McCormick Properties and the Prairie House, Inc. The required
financial statements were being forwarded to the City's auditing firm for
review. The $1,000.00 application fee has been received, which is non--
refundable. It was recommended to set a public hearing for June 9, 198"at
8:00 P.M.
Following discussion, the motion was made by Alderman Beatty to waive read-
ing and adopt Resolution No. 6772 entitled Resolution Relating to A Project
Under the Municipal Industrial Development Act; Calling for A Public Hearing
Thereon, and set public hearing for June 9, 1981 at 8 :00 P.M. The motion was
seconded by Alderman Gruenhagen and carried unanimously.
10. MISCELLANEOUS
(a) COMMUNICATIONS FROM CITY ADMINISTRATOR
City Administrator Plotz reported that he had attended a meeting this morn-
ing with the School Board regarding replacing the Old Armory with a new gym-
nasium. The City is negotiating with Citizens Bank for the purchase of the
Old Armory and the Wigens building. He anticipated that a committee would
be appointed shortly to work on this project.
Mention was made that the Fire Department Committee would be meeting on Mon-
day, May 18, at 7:00 A.M. to further discuss the design of the new fire sta-
tion.

The Parking Committee recently met and arrived at some proposed parking
spaces in the downtown area. A windshield appraisal will be done of some
property,and then a recommendation will come from the Downtown Development
District Advisory Board to the City Council. It will be approximately an-
other week before the appraisals are received.
The Joint Litchfield /Hutchinson Airport Committee will be meeting May 14,
1981 at 8:00 P.M. in the Litchfield City Hall. The Committee has already
met with the township officials and County Commissioners. This meeting will
be with land owners and the public to discuss proposed sites for the new
airport.
(b) COMMUNICATIONS FROM THE CITY ATTORNEY
City Attorney Schantzen reported that Attorney Ronald McGraw should be con-
tacted for a tender of defense and hold harmless agreement regarding the
lawsuit filed against-the City, Ralph D. Westlund, Gary D. Plotz, by Lor-
raine A. Meyer, Plaintiff and W. E. Reyerson, Attorney for Plaintiff.
It was moved by Alderman Beatty to enter into an agreement with Attorney
Ronald McGraw as recommended by the City Attorney. Seconded by Alderman
Gruenhagen, the motion unanimously carried.
11. CLAIMS, APPROPRIATIONS AND CONTRACT PAYMENTS
(a) VERIFIED CLAIMS
It was moved by Alderman Beatty, seconded by Alderman Gruenhagen and carried
unanimously, to approve the verified claims and authorize payment from the
appropriate funds.

City Engineer Priebe commented that the City staff would take the full 60 days be-
fore making a recommendation to the City Council.
The motion was made by Alderman Gruenhagen, seconded by Alderman Beatty, to refer
the bids to the City staff for review and recommendation. Motion unanimously car-
ried.

MINUTES
SPECIAL MEETING - HUTCHINSON CITY COUNCIL
TUESDAY, MAY 19, 1981
The special meeting of the City Council was called to order by Mayor Westlund at
8:00 A.M. with the following present: Aldermen Peterson, Lueneburg, Gruenhagen and
Beatty, in addition to Mayor Westlund. Also present: City Administrator Plotz and
John Miller.
The City Council discussed the status of the large barn in Rolling Oaks Addition
owned by John Miller. Mr. Miller reported that the two silos on the barn had been
taken down with a demolition permit. However, the main structure of the barn re-
mains. He reported that one to two people were working at dismantling the barn in-
tent it was estimated that the structure would be removed by September 15. The of the firm engaged to dismantle the barn was to salvage the materials and,
therefore, it would take this amount of time to remove.
The Ordinance of deposit was discussed. After much discussion, a motion was made
by Alderman Beatty and seconded by Alderman Gruenhagen that the deposit be $50.00
for the first five -days, $100.00 per day for the subsequent 10 -days; thereafter
$100.00 per working day or $1,000.00 per month, with removal to be completed by
September 15, 1981. In the event the structure is not removed within five days sub-
sequent to September 15, 1981, the deposit would be forfeited. Motion was carried.
It was also agreed the City would make available any snow fencing to John Miller
for the general safety of the public with installation and removal the responsi-
bility of John Miller.
The City Council discussed the proposed joint gymnasium with the School District
and the City. Mayor Westlund reported the School Board wanted to meet with the City
Council within the next two weeks. Mayor Westlund suggested that the City be pre-
pared with a sketch of the type of building that would meet the City's needs. It
was suggested that perhaps a local architect could put together some conceptual lay-
out and elevation of the building prior to the meeting of the School Board.
A motion was made by Alderman Lueneburg, seconded by Alderman Peterson, to employ
the services of Korngiebel Architects to complete the preliminary work between
$300 - 500 and not to exceed $500. Motion carried unanimously.
There being no further business, the meeting adjourned at 8:30 A.M.

HUTCHINSON PLANNING COMMISSION
Tuesday, April 21, 1981
1. CALL TO ORDER
The regular meeting of the Hutchinson Planning Commission was called
to order by Chairman Don Erickson_at 7:30 P.M. with the.following mem-
bers being present: Bill Backen, Ted Beatty, Roland Ebent, Larry Romo,
and Clint Tracy in addition to Chairman Erickson. Elsa Young arrived
at 8:05 P.M. Absent: None. Also attending were City Administrator
Gary Plotz, Director of Engineering Marlow Priebe and Acting Building
Official Homer Pittman. Assistant City Attorney Jim Schaefer arrived
at 8:55 P.M.
2. MINUTES
The minutes of the regular meeting dated March 19, 1981 were unanimously
approved on motion by Clint Tracy and seconded by Larry Romo.
3. PUBLIC HEARINGS
(a) CONSIDERATION OF REQUEST SUBMITTED BY STAFF FOR REZONING OF NEWLY
ANNEXED CLIFTON HEIGHTS FROM R -1, SINGLE FAMILY RESIDENCE DISTRICT
TO R -3, MULTIPLE FAMILY RESIDENCE DISTRICT
The hearing was opened at 7:32.P.M. by Chairman Don Erickson with
the reading of publication # 2408 as published in the Hutch Leader
on Friday, April 10, 1981.
City Engineer, Mr. Marlow Priebe, explained all annexations
come into the city as R -1 and it was felt by staff R -3 would fit
better with the Comprehensive Plan.
Chairman Erickson then asked for further comments.
Mr. Dick Holt, 108 Garden Road, felt where his house is as well as
others already built should be left R -7. He then presented a map
of his proposal.
Mr. Lee Stritesky, 709 Hilltop Drive, stated he didn't see any rea-
son for a change of zoning.
Mr. Roman Haas, 113 Mark Drive, questioned why everything couldn't
be left R -1.
Mr. Tom Schafer, 708 Hilltop Drive, stated they have only been in
the city four months and now you want to rezone. What's the pur-
pose?

A lengthy discussion followed at which time it was explained to
the residents that with R -2 zoning setbacks are less restrictive
and perhaps this would be the route to take. In the case of a
disaster it would be easier to fully utilize each lot should it
be necessary to remodel or rebuild. Most of the residents"attend-
ing said they didn't know the difference between R -1 and R -2 and
would agree to the R -2 zoning.
Mr. John Mliner, 704 Hilltop Drive, asked if more entrances were
proposed for this area?
Mr. Marlow Priebe replied not at the present time."
The hearing was closed at 8:01 P.M. on motion by Ted Beatty and
seconded by Bill Backen. The motion carried unanimously.
Mr. Ted Beatty stated he would rather see the whole area zoned
the same than split it up. Clint Tracy stated he agreed.
Mr. Bill Backen then made a motion to rezone the developed area
including the three developed lots on Garden Road to R -2 and the
undeveloped portion R -3. Seconded by Larry Romo, the motion-car-
ried with Larry Romo, Roland Ebent, Bill•Backen and Don Erickson
voting in favor and Ted Beatty and Clint Tracy being opposed.
(b) CONSIDERATION OF REQUEST FOR CONDITIONAL USE PERMIT (PUD) SUBMITTED
BY RICHARD LARSON
Chairman Don Erickson opened the hearing at 8:06 P.M. with the
reading of publication # 2409 as published in the Hutch Leader
on Friday, April 10, 1981.
Marlow Priebe, Director of Engineering, explained Mr. Larson's PUD
proposal for single, two family and four family structures. This
type of housing would conform to the zoning and the Comprehensive
Plan.
Mr. John Mliner, 704 Hilltop Drive, stated he was concerned about
a problem of congestion on Garden Road for safety and in the case
of a fire.
Mr. Dick Holt - objected to the placement of the road as shown on
the map.
Mr. Duane Pischke, 114 Garden Road, felt this project would devalue
his property. It will be like a raceway by his house.

Mr. Dick Holt suggested that the three lots on Garden Road that
are undeveloped face Garden Road.
After a lengthy discussion, it was determined if the plan were
changed the land may not be used to its fullest extent. It was
pointed out also that this would not happen over night but rat-
her take place over several years.
Larry Romo stated we will be seeing more of this type of dwell-
ings in the future. He didn't feel traffic would be a problem.
Clint Tracy inquired if the duplex on the corner could possibly
face the other direction. Mr. Larson replied this couldn't be
done very easily.
Dick Holt questioned if there were any plans for playground area.
After discussion it was decided this be brought to the
attention of the Park Board.
Larry Romo made a motion to close the hearing at 8:45 P.M. The
motion was seconded by Roland Ebent.
After a brief discussion it was decided it would be better to
continue this hearing as many things have-yet to be resolved.
Larry Romo rescinded his motion to close the hearing and Roland
Ebent rescinded his second to the motion.
Clint Tracy felt perhaps an alternate street pattern could be
worked on and that playground area could be designated.
Chairman Erickson asked that the Park & Rec. Board see this plan
and give a recommendation.
Mr. Ted Beatty then made a motion to continue this hearing at the
next regular meeting which will be held May 19, 1981 and that the
developer Mr..- Richard Larson consider a different layout and that
park area be considered. Seconded by Clint Tracy, the motion
unanimously carried.
(c) CONSIDERATION OF REQUEST BY THE OWNER TO VACATE A PORTION OF PARK
LANE IN HELLANDS FOURTH ADDITION AND A PORTION OF THE EASEMENTS
IN HELLANDS THIRD AND FOURTH ADDITION
The hearing was opened at 9:00 P.M. by Chairman Erickson with the
reading of publication # 2410 as Published in the Hutch Leader
on Friday, April 3, 1981 and Friday, April 10, 1981.

Marlow Priebe explained that Mr. Helland had someone interested
in purchasing the three lots and dividing them into two lots.
He explained that Mr. Helland only wanted to relocate the access
to the park. Mr. Helland also owns lot 4 so he would be the only
one affected by the change. Mr. Priebe had checked with the
utilities and they had no objection.
On motion by Bill Backen, the hearing was closed at 9:04 P.M.
Seconded by Ted Beatty, the motion carried unanimously.
Mr. Ted Beatty then made the motion to recommend approval to
the City Council to rededicate the park access known as Park
Lane to the western edge of Lot 5. Seconded by Elsa Young,
the motion carried unanimously.
(d) CONSIDERATION OF REQUEST FOR REZONING OF NEWLY ANNEXED SCHMIDTBAUER
PROPERTY FROM R -1, SINGLE FAMILY RESIDENCE DISTRICT, TO R -2 & R -3
MULTIPLE FAMILY RESIDENCE DISTRICT;
The hearing was opened at 9:05 P.M. with the reading of publication
# 2411 as published in the Hutch Leader on Friday, April 10, 1981.
It was pointed out that this is the same situation as earlier.
presented for the Clifton Heights area. The newly annexed areas
come into the city as R -1 and now for future-development it was
felt R -2 and R -3 would be more suitable.
Mr. Jim Black, 15 Century Ave., felt that traffic would become a7
real problem on Century Avenue. He said he was speaking in behalf
of his neighbor Garey Knudsen as well who couldn't attend this
meeting tonight.
Mr. Donn Hoffman, 45 Century Avenue, stated that traffic is already
a problem. Future development will make it even worse.
Mr. Schmidtbauer, owner of the property, explained there were many
possibilities for exits to the west connecting to Hwy. # 15.
Elsa Young stated as the city grows more streets will automatically
be built.
There was question by Mr. Tracy about the one lot on Century Ave.
being zoned R -3 rather than R -2.
Mr. Schmidtbauer explained this was a large lot and he had a party
interested in building a four -plex on it. It was somewhat undesir-
able-because of the city putting a water tower directly by it. He
also indicated that the building would not face Century Avenue but
rather be facing the East.

Mr. Tracy asked Mr. Schmidtbauer if we could be assured there
would be nothing larger than a four -plex built on the lot located
on Century Ave. Mr. Schmidtbauer replied this could be in writing
if so desired.
On motion by Ted Beatty, the hearing was closed at 9:32 P.M.
Seconded by Bill Backen, it carried unanimously.
Mr. Ted Beatty then made a motion to recommend approval to the
City Council that the zoning be adopted as proposed. Seconded by
Elsa Young, the motion unanimously carried.
Mr. Black then thanked the Commission for this discussion and
stated he appreciated their time.
(e) CONSIDERATION OF REVISIONS TO ZONING ORDINANCE NO. 464
The hearing was opened by Chairman Erickson at 9:45 P.M.
Mr. Plotz explained these changes had all been discussed at
earlier workshops and all of the members had received copies of
the changes to review.
On motion by Clint Tracy, the hearing was closed at 9:48 P.M. -
Seconded by Ted Beatty, the motion unanimously carried.
Mr. Ted Beatty then made a motion to recommend approval of the
presented revisions to Zoning Ordinance No. 464. Seconded by
Bill Backen, the motion carried unanimously.
4. OLD BUSINESS
(a) DISCUSSION ON PROCEDURES CONCERNING SOLAR HEATING
Mr. Priebe stated he was waiting for material he had requested
from various places and when he received it- -staff will mail it
to the members for.review and it will be discussed at next
months meeting.
5. NEW BUSINESS
(a) DISCUSSION ON AL BRINKMAN'S SKETCH PLAN OF SECTION 32 OF HUTCHINSON
TOWNSHIP TO SPLIT PRESENT LOT INTO TWO PARCELS
After a brief discussion a motion was made by Ted Beatty to approve
to the City Council this request subject to receiving a letter from
the present property owner that it will ,-be annexed into the City at
the time Our Saviors Lutheran Church or any other surrounding prop -
erty-owner requests annexation. Seconded by Clint Tracy, the motion
carried unanimously.

The Arbor Day Celebration, May 2, 10:30 a.m. in Library Square was discussed with
Schnobrich saying the contest winner will be announced and a DNR representative
will present the plague and flag to Mayor Westlund.
Schnobrich reported on the status of the spring planting with about half of the
plant material in the ground.
Mrs. Axel Jensen suggested that fertilizer be used in Library Square on the land -
scape plantings. She said well rotted sheep manure could be obtained free from
Mrs. Jerebek from rural Hutchinson.
Highway 15 North between 4th Avenue north and 5th Avenue north will be widened by
the State Highway Department for traffic in 1981. The removal of 18 American elm,
2 Hackberry and 1 Ash will have to be completed before the project can be started.
Due to the loss of the majestic elm shade trees, Bruce Peterson made a motion to
have the city donate trees to the planted -on private property to compensate the
loss. The motion was seconded by Roy Johnsen and was unanimously passed.
Ivan Larson suggested that before fall, interested scouts should be sought to haul
firewood to the elderly.
Ivan Larson questioned thoroughness of contract complettion by Hutchinson Landscaping
for the elm pruning contract. More strict control over cleanup was proposed by
Bruce Peterson with the inactment of a 10% retention fee until approval of com-
pletion.
Jerry Brown proposed a Downtown Green Up project whereby local retail businesses
be allowed the right to place window flower boxes and possibly sidewalk planters
on Main Street in order to green up the downtown area. Brown proposed this in the
form of a motion. Motion was seconded by Roy Johnsen with four yes votes and one
abstention.
Schnobrich stated that the cottenwood trees on Linden Street which were petitioned
by local residents for removal, have turned out to be female. Ivan Larson made a
motion to have Hutchinson Landscaping remove the trees. Seconded and unanimously
passed.
Jerry Brown suggested that small crab apples or other low growing trees be planted
on Miller Street between Lynn and Merrill on the south side -in order to allow
boulevard planings due to over head wires.

HISTORY
On March 31, 1981 an application for a conditional use permit*to allow a
Planned Unit Development (PUD) to be called "Kimberly's Country Estates"
was submitted by Richard Larson to be located East of Garden Road in Clifton
Heights. A public hearing was held on April 21, 1981 at which time many of
the neighboring property owners.were present stating their opposition to this
particular plan. The hearing was continued at the regular meeting of May 19,
1981 and a new plan was presented. There was discussion and it was determined
there was a need for a park in this area.
FINDINGS OF FACT
1. The required application was submitted and the appropriate fee paid.
2. Notices were mailed to the surrounding property owners as well as published
in the Hutchinson Leader on Friday, April 10, 1981.
3. It was determined by the Commission that no additions or changes could be
made to the units without another hearing as this would be an amendment to
the PUD.

FINDINGS
1. Richard Larson, Builder, has made application to the City Council for a
Conditional Use Permit under Section 6.07, C.5 of Zoning Ordinance No. 464 to allow
the construction of single, two family and four family housing structures as per
Planned Unit Development located on Garden Road in Clifton Heights, having the fol-
lowing legal description:

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON, MINNESOTA:
FINDINGS
1. Kenneth Wendlandt of Hutchinson has applied for a variance from Section
6.05, B.3 of the Zoning Ordinance No. 464 from the required rear setback of 25'
to 8' for the purpose of constructing a garage to replace the present garage, with
the property being located at 726 Hassan Street.
2. The Planning Commission has reviewed the application for a variance and
has recommended to the City Council that the application be granted.
3. The Council has considered the effect of the proposed variance upon the
health, safety, and welfare of the community, existing and anticipated traffic con-
ditions, light and air, danger of fire, risk to the public safety, and the values of
property in the surrounding area and the effect of the proposed variance upon the
Comprehensive Plan.
4. Because of conditions on the subject property and on the surrounding property,
it is possible to use the subject property in such a way that the proposed variance
will not impair an adequate supply of light and air to adjacent. property, unreason-
ably increase the congestion in the public streets, increase the danger of fire, en-
danger the public safety, unreasonably diminish or impair health, safety, comfort,
morals, or in any other aspect be contrary to the intent of the ordinance and the
Comprehensive Plan.
5. The special conditions applying to the structure or land in question are
peculiar to such property or immediately adjoining property and do not apply gener-
ally to other land or structures in the district in which such land is located.
6. The granting of the application is necessary for the preservation and enjoy -
ment of a substantial property right of the applicant. It will not merely serve as
a convenience to the applicant, but is necessary to alleviate demonstrable hardship
or difficulty.
CONCLUSION
The application for variance for the purpose designated is granted based upon
the findings set forth above for a variance for a 16' setback from the lot line to
the building.

Pursuant to Section 6.05, B.3, of Zoning Ordinance No. 464, the Hutchinson
Planning- Commission is hereby submitting its finding of fact and recommend-
ation with respect to the aforementioned request for variance.
HISTORY
On April 30,, 1981 an application was submitted by Mr. Bruce Drahos request-
ing variances for the reduction of the required rear setback of six (6) feet
to three (3) feet and a reduction of the required sideyard setback of six (6)
feet to three (3) feet for the purpose of replacing•a garage. At the regular
meeting of the Commission held on May 19, 1981 a public hearing was held.
No one was present voicing any objection to the request.
FINDINGS OF FACT -
1. The required application was submitted and the appropriate fee paid.
2. Notices were mailed to the surrounding property owners as well as published
in the Hutchinson Leader on Friday, May 8, 1981.
3. The property owner pointed out that he actually is moving the garage
further from the neighboring property than the present garage is.
RECOMENDATION
It is the recommendation of the Planning Commission that the.sideyard variance
be granted for four (4) feet and the rear yard variance be granted for three (3)
feet.

RESOLUTION GRANTING VARIANCE FROM SECTION 6.05, B.3 OF THE
ZONING ORDINANCE NO. 464 FOR REDUCTION OF SETBACKS
TO REPLACE GARAGE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON, MINNESOTA:
FINDINGS
1. Bruce Drahos of Hutchinson has applied for a variance from Section 6.05, B.3
of the Zoning Ordinance No. 464 for the reduction of the required rear setback of six
feet to three feet and a reduction of the required sideyard setback of six feet to
three feet for the purpose of replacing a garage, with the property being located at
215 Washington Avenue West.
2. The Planning Commission has reviewed the application for a variance and has
recommended to the City Council that the application be granted.
3. The Council has considered the effect of the proposed variance upon the
health, safety, and welfare of the community, existing and anticipated traffic con-
ditions, light and air, danger of fire, risk to the public safety, and the values of
property in the surrounding area and the effect of the proposed variance upon the
Comprehensive Plan.
4. Because of conditions on the subject property and on the surrounding property,
it is possible to use the subject property in such a way that the proposed variance
will not impair an adequate supply of light and air to adjacent property, unreason-
ably increase the congestion in the public streets, increase the danger of fire, en-
danger the public safety, unreasonably diminish or impair health, safety, comfort,
morals, or in any other aspect be contrary to the intent of the ordinance and the
Comprehensive Plan.
5. The special conditions applying to the structure or land in question are
peculiar to such property or immediately adjoining property and do not apply gener-
ally to other land or structures in the district in which such land is located.
6. The granting of the application is necessary for the preservation and enjoy-
ment of a substantial property right of the applicant. It will not merely serve as
a convenience to the applicant, but is necessary to alleviate demonstrable hardship
or difficulty.
CONCLUSION
The application for variance for the purpose designated is granted based upon
the findings set forth above for a sideyard variance of four feet and a rear yard
variance of three feet.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUTCHINSON, MINNESOTA:
FINDINGS
1. Bill Marquardt of Hutchinson has made application to the City Council for a
Conditional Use Permit under Section 6.07, C.5 of Zoning Ordinance No. 464 to allow
the replacement of a garage in a IC -1 zone, having the following legal description:
Lot 4, Block 24, North Half City of Hutchinson
2. The City Council has considered the recommendation of the Planning Commission
and the effect of the proposed use on the health, safety, and welfare of the occupants
of the surrounding lands, existing and anticipated traffic conditions, and the effect
on values of properties in the surrounding area and the effect of the use on the Com-
prehensive Plan.
3. The Council has determined that the proposed use will not be detrimental to
the health, safety, or general welfare of the community nor will it cause serious
traffic congestion nor hazards, nor will it seriously depreciate surrounding property
values, and the proposed use is in harmony with the general purpose and intent of
the Zoning Ordinance and the Comprehensive Plan.
CONCLUSION
The application for Conditional Use Permit for the purpose designated is granted,
based upon the findings set forth above.

This is a statement of the terms and conditions upon which bids
for the purchase of the Bonds are to be received and considered,
the sale thereof awarded and the Bonds issued.
BID OPENING AND SALE
Bids for these Bonds will be opened It , 1981, at
.M., C.D.T., at the Council Chambers at the City Hall
in Hutchinson, Minnesota. The bids will be considered and sale
awarded by the City Council at P.M., C.D.T., on the same
date. These Bonds are offered on the following terms:
PURPOSE
The $1,370,000 Improvement Bonds of 1981 will be issued pursuant
to the provisions of Minnesota Statutes, Chapters 429 and 475,
to finance street, curb and gutter, storm sewer, sanitary sewer
and watermain improvements within the City. The $1,250,000
Parking Improvement Bonds will be issued pursuant to Minnesota
Statutes, Section 459.14 and Chapter 475 to finance the acquisition
and construction of automobile parking facilities in the City.
The $730,000 General Obligation Fire Hall Bonds will be issued
pursuant to Minnesota Statutes, Chapter 475, to finance the
acquisition and construction of a new fire station in the City.
MATURITIES AND REDEMPTION
The Bonds will be dated as of August J , 1981, will be issued as
negotiable investment securities with attached interest coupons,
will be in the denomination of $5,000 each unless otherwise
designated by a purchaser within 48 hours of award of sale and
the bonds of each issue will mature serially on February 1, in

REDEMPTION FEATURE
Bonds maturing in the years 1992 and thereafter are subject to
redemption and prepayment at the option of the City in inverse
order of serial numbers on February 1, 1991, and any interest
payment date thereafter, at a price equal to the principal amount
thereof plus accrued interest to the date of redemption.
RATES; INTEREST PAYMENT DATE
Interest on the Bonds will be payable on February 1, 1982, and
semiannually thereafter on each February 1 and August 1. All
Bonds maturing on the same date must bear interest at a single
uniform rate designated by the successful bidder, not exceeding
the rate specified for Bonds of any subsequent maturity. Each
rate must be in an integral multiple of 5/100 of 1% and no rate
nor the net effective rate may exceed 12 %. No supplemental or
"B" coupons will be permitted.
PAYING AGENT
Principal and interest will be payable at a suitable -bank
recommended by the purchaser and approved by the City Council,
and the City will pay the customary charges for this service
provided that such recommendation is received within 48 hours
after the sale, and the City Council will select the paying
agent if the recommendation is not approved.
CUSIP NUMBERS

The City will assume no obligation for the assignment or printing
of CUSIP numbers on the Bonds or for the correctness of any
numbers printed thereon, but will permit such assignment and
printing to be done at the expense of the purchaser, if the
purchaser waives any extension of the time of delivery
caused thereby.
DELIVERY
Within_40 days after the sale, the City will furnish and
deliver at the office of the purchaser or, at his option,
will deposit with a bank in the United States,.selected by
the purchaser and approved by the City as its agent to permit
examination by and to deliver to the purchaser, the printed
and executed Bonds, the legal opinions of Dorsey, Windhorst,
Hannaford, Whitney & Halladay, of Minneapolis, Minnesota, and
a certificate stating that no litigation in any manner question-
ing the validity of the Bonds is then threatened or
pending. The charge of the delivery agent must be paid by
the purchaser, but all other costs, with the exception of
printing of CUSIP numbers as indicated, will be paid. by the
City. The purchase price must be paid upon delivery of the
Bonds, in funds available for expenditure by the City on
the date of payment.
LEGAL OPINIONS
Legal opinions on each bond issue will be furnished by Dorsev.
Windhorst, Hannaford, Whitney & Halladay, of Minneapolis,
Minnesota. The legal opinions will be printed on the
appropriate bond issue at the requests of the purchaser. The
legal opinions will state that the bonds of each issue are valid
and binding general obligations of the City.
BIDS; PRICE; GOOD FAITH CHECKS
Sealed bids for not less than $3,295,000 and accrued interest on
the principal sum of $3,350,000 from the date of the Bonds to the
date of delivery must be mailed or delivered to the undersigned
and must be received prior to time of bid opening. Each bid
must be unconditional and must be accompanied by a certified
or cashier's check or bank draft in the amount of $67,000, payable
to the order of the City Administrative Assistant -Clerk of the
City, to be retained by the City as liquidated damages if the
bids is accepted and the bidder fails to comply therewith.

The bid authorizing the lowest net interest cost (total interest
from date of Bonds to stated maturities, less any cash premium
or plus any amount less than $3,350,000 bid for principal) will
be deemed the most favorable. In the event that two or more bids
state the lowest net interest cost, the sale of the Bonds will
be awarded by lot. No oral bid and no bid of less than $3,295,000
plus accrued interest on all of the Bonds will be considered, and
the City reserves the right to reject any and all bids, to waive
any informality in any bid and to adjourn the sale.

SUBJECT: Storm Sewer
In preparation of the 1981 projects, we have been involved in the assessment cal -
culations for the annual improvements, including storm sewer. We intend to assign
the total cost of storm sewer for the areas to be drained, including streets, to
the individual property benefitted. Areas such as City parks and City facilities
will be the responsibility of the City proper and would be paid by ad valorem in
taxes.

SUBJECT: Engineering and Administrative Fees - 1980 and 1981 Projects

The City has taken engineering and administrative fees from the bond issue based
on a set dollar amount as established in the City budget. In recent years this
has been $110,000.00 ($70,000.00 engineering and $40,000.00 administrative), irre-
gardless of the amount or size of the bond issue.
After discussing this procedure with our bonding consultant and also comparing
this with other communities, it is common practice to charge a percentage of the
estimated or the bid price of the project to the general fund.
The typical percentage charges are as follows:
10% Engineering (Design)
5% Staking, Inspection, and Field Work
5% Administration
20%
In addition, capitalized percentages in cost of interest are charged to the bond
issue.
It would be our intent to make the charges pursuant to the above percentage break-
downs for both the 1980 and 1981 projects. The dollar amount,of this transfer
will be provided you at a later date under a separate resolution.
We have reviewed this revised procedure with Buzz Schantzen, and he has found it
to be acceptable.

Building codes and specifications are set at the year of pet-wit, even if they change

Mike Monge spoke and Showed slides of tornados and slides of hazardous chemical
placement in Hutchinson. He stated Hutchinson has an excellent warming system
and h`- has disaster plans for Park: Towers, Evergreen Towers, all schools, huspltal
and Burns Manor. The slides from the tornado in Xenia, Ohio, showed what could
happen to all of these buildings. The Siren is not just for tornados but also for
a chemical disaster. Many things occur in a chemical lisaster as to where located,
wind direction and what type of chemical. He stressed the safety of goad organized
pre -planning. Geo Field also commnied on safety hazards and sated be sure and
listen to KDUZ for information. They will come ern the air at any hour in case of
a disaster. Also stated the fire siren does not go off from 10:104 p.m. to 7:00 a.m.
Lots of cooperation and colrinunication is needed when sa disaster strikes
The maeting adjourned with the announcement that Gary Hackfelt will speak at the
Miy 18th greeting.
