June 3, 1986
All Commissioners were present; also present were Mgr. Alexander,
Counsel Peterson, Attorney Roger Gilmer, Jane Hodgins, Hutchinson
Leader staff writer, "Butch" Wentworth and Ruth Hakel.
President Daggett called the meeting to order at 6:30 p.m.
He stated the only item on the agenda was relative to the continued
employment of Todd Alexander.
President Daggett called on Counsel Peterson to explain the options
available to the Ccmmi.ssion at this point in time.
Counsel Peterson stated that basically Todd is an employee at will.
He was hired less than three months ago and not subject to the
union contract, which does require cause for termination. Employee
at will means - employer can dismiss employee with reason or no
reason.
The chair recognized Attorney Gilmer who appeared on behalf of
Todd Alexander_ and who agreed on the interpretation of the law;
however, he felt that the law had in some cases changed in that
one cannot dismiss without cause.
After uitfer discussiot., Attoinc-;y Gilmer stated he felt tic only
issue was whether or not the COIlIiliSsion could terminate an employee
on probation with or without cause.
President Daggett commented that they could terminate without cause.

noon June 4, 1986. Motion was seconded by Commissioner Daggett.
Motion was called, two ayes and one nay (Ted Beatty).
The above being the only item on the agenda, a motion was made by
Commissioner Lyke, seconded by Commissioner Beatty to adjourn the
meeting at 7:40 p.m. Motion was unanimously carried.

Special Meeting
June 10, 1986
All Commissioners were present; also present were Mgr. Alexander,
Counsel Peterson, Jane Hodgins, Hutchinson Leader staff writer
and Ruth Hakel.
President Daggett called the meeting to order at 6:30 p.m.
President Daggett called upon Counsel Peterson to report on his
findings in regard to government contracts for data processing
equipment from I.B.M. After Counsel Peterson called the attorney
general's office, he learned that the State of Minnesota had a
contract with I.B.M. The Hutchinson Utilities Commission being
a governmental unit qualifies under this contract. This eliminates
the need for specifications and bids.
After discussion, a motion was made by Commissioner Beatty,
seconded by Commissioner Lyke to authorize management to proceed
with purchase order no.10240 for Option A hardware and. software
as outlined in tlae May 27 riinutes, totaling $38,531. Motion was
unanimously carried.
There being no further business, a motion was made by Commissioner
Lyke, seconded by Commissioner Beatty to adjourn at 6:40 p.m.
Motion was unanimously carried.
