10-12-1959 HUCMOctober 12, 1959. Spefcial Meeting. ( 196) 197 Motion was made and seconded to grant an increase of $10.00 per month to Hugo Mahs, making his monthly salary $415.00. This increase effective October 1st, 1959. Motion was made and seconded to employ the following; Lester Ziegler Frank Wittmann DeWayne Rubedor Walter Marshall 1.25 per hr. 1.35 per hr. 375.00 per month. $375.00 per month. Motion was made and seconded to issue a check to the Central National Bank & Trust Company.. Des Moines, Iowa, in the amount of 74,450.00. 70,000.00 being the principal and $4,450 interest. All Commissioners were present, also the following persons, Leon Winter, of Buell & Winter Company, Jos. Casey, Carleton Beh Company, Hubert Schultz, Attorney, T. R. Lovell, Buell & Winter Company. The reason for the meeting was to discuss matters relating to the Gas Plant for Hutc bAnson, Minnesota. Moved by Commissioner Thompson that Buell & Winter Engineering Company be instructed to proceed with surveys, plans and specifications for a natural gas system for the City of Hutchinson, this being in accordance with the terms and conditions of their agreement with the City under date of October 24, 1954, and under date of April 10, 1959. G -17485 a WHEREAS, appellants are asking that the communities along the proposed Willmar Branch make a contribution of $120,665.00 to Northern Natural Gas Company to help pay the branch line construction costs, and, WHEREAS, the distributors of natural gas to the communities along the branch line desire early construction of the Branch so that natural gas service will be initiated in the fall of 1960. NOW THEREFORE BE IT RESOLVED BY THE HUTCHINSON UTILITIES COMMISSION that the chairman and secretary be and they are hereby authorized to enter into an agreement with the other distributors and Northern Natural Gas Company pledging; that the Commission will pay Hutchinson's proportionate share of said contribution if the appeal is successful which share is estimated not to exceed $25,000000. by Commission Dahl Motion was made o adopt the above resolution and seconded by Commissioner Thompso . The motion was unanimously carried. WHEREAS, the Hutchinson Utility Commission on behalf of the City of Hutchinson on October 29, 1954, entered into an agreement with the Carleton D. Beh Company, Des Moines, Iowa, to furnish 'fiscal agency service in connection with securing an allocation of natural gas for the City of Hutchinson, Minnesota, said agreement identified as "contract No. 311, and, WHEREAS, said agreement provided that the Carleton D. Beh Company furnish adequate legal representation before the Federal Power Commission, and pro -Vide personal testimony of a qualified financial witness before said Commission, as well as provide all legal documents in approximate amounts of two hundred copies each for prosecuting Hutchinson's case before the Commission and serving all parties thereto, and WHEREAS, the Carleton D. Beh Company has provided such agreed service to the satisfaction of said Hutchinson Utilities Commission in putting the case before on two separate occasions since 1954, which application resulted in a Certificate of Convenience and Necessity being issued by the FPC (dumber 324, wherein applicant Northern Natural Gas Company, a common carrier, was directed to serve the City of Hutchinson, Minnesota with an adequate allocation of natural gas, for distribution by the Hutchinson Utilities Commission through a municipally owned and operated gas distribution system, and WHEREAS, the Carleton D. Beh Company has paid the expenses in- curred to date of allocation, and until this date, and have billed the Hutchinson Utilities Commission for its Contract No. 3 amount, 1 1 lt3b ) 201 NOW THEREFORE, the Hutchinson Utilities Commission does hereby approve the contract rat e for payment of 3% of the estimated amount of the cost of establishing the natural gas system of $600,0000 with the understanding that if the final cost of the system should amount to more or less than the $600.,000 estimated amount, that the services billed at 3% of the estimated amount shall be adjusted to 3% of the final amount of the bond issue, and this adjustment mill be made when the Carleton D. Beh Company is paid for services rendered under Contracts No. 1 and No. 2 dated October 29, 1954, with the Hutchinson Utilities Commission. And, the Hutchinson Utilities Commission does hereby authorize payment of the amount billed under Contract No. 3, $18,000, by the issuance of a Natural Gas Revenue Pledge Order, to be included in the Natural Gas Revenue Bond Issue when brought out at a later date, and to be payable from the future net earnings of the Hutchinson Municipal Natural Gas Distribution System, and the President and Secretary are hereby authorized and di- rected to sign the said Pledge Order drawn in favor of the Carleton D.
