04-10-1959 HUCM174 (165) NOW THEREFORE BE IT RESOLVED BY THE UTILITIES COMMISSION OF THE CITY OF HUTCHINSON, MINNESOTA: 1. That Hubert H. Schultz, attorney at law, of Sanborn, Iowa be and he hereby is employed as attorney to represent this Commission in all hearings and proceedings before the Federal Power Commission in the above numbered dockets ar! he is authorized to take whatever action may be required for the purpose of securing an allocation of natural gas to the City. 2. That the engineering contract heretofore entered into between the City and Buell & Winter, Consulting Engineers, Insurance Exchange Building, Sioux City, Iowa and subsequently approved and confirmed by this Commission providing for engineering services in connection with the planning and con- struction of a municipal gas distribution system for the City and further providing for expert engineering services to pre- pare and present to the Federal Power Commission necessary studies, surveys, exhibits and testimony, be and the same is hereby reaffirmed, approved and accepted which contract is attached hereto marked "A" and made a part of this Resolution. April 10, 1959. Special Meeting. A special meeting of the Hutchinson Utilities Commission was held on the aforesaid date at the office of Dr. R. I. Sheppard. All commissioners were present, together with Supt. Young, Attorney Elmer Jensen, Hubert H. Schultz, Leon Winter and Joseph Casey. G- 17485 and G -17486 in which the Commission has cintervened, and, con 2 L ca WHEREAS, the need and desire of the City and its a E U) commercial and industrial establishments for natural gas service N D O is now even more great than it was and it would be in the public Q z LL interest that an allocation be sought in the present dockets. That the existing contracts dated October 29, 1954 between the City Council of the City of Hutchinson, Minnesota as approved by the Hutchinson Light and Power Commission now known as Hutchinson Utilities Commission and the Carleton D. Beh Company of Des Moines, Iowa relative to the financing of the proposed natural gas system at the City of Hutchinson be ratified and confirmed again this date in the light of current conditions and the terms therein set out are to be the same with the exception of one change in contract no. 2, paragraph 4, lines 5 and 6 which previously set out interest rates as follows; 1132% for bonds maturing one to ten years from date of issue and 4% for bonds maturing after ten years from date of issue" to be changed to read now as follows; 114% for bonds maturing one to ten years from date of issue and 41,% after 10 years from date of issue," and in all other respects said contracts are ratified, approved and confirmed, which contracts are attached hereto marked "B ", "C", and "D" and made a part of this Resolution. The undersigned hereby certifies that he is the Secretary of the Hutchinson Utilities Commission. That hereto attached is a true, correct, and complete copy of a resolution unanimously adopted by said Hutchinson Utilities Commission at a special meeting thereof held on April 10, 1959.
