Monthly Meeting
January 13, 1964.
A monthly meeting of the Hutchinson Utilities Commission was held
on January 13, 1964 in the Hutchinson Utilities Billing Office.
Commissioner Shenpard and Commissioner Quade were present; also
Attorney Comer, Supt. Young, Supt .Kiaiken and Hugo Mahs .
Motion was made by Commissioner Sheppard, seconded by Commissioner
Quade, to appoint Howard P. Quade as vice - president.
Motion was made by Commissioner Quade, seconded by Commissioner
Sheppard, to issue a check in the amount of 200.00 -- additional
change for cash drawer.

OF SECURITZIFS FY DEPOSITORY
"RESOLVED, That, whereas, a question has been raised to
.determine whether or not it is necessary for an Assignment of
Securities be submitted to the Hutchinson Utilities Commission
and accepted by them from depositors of funds of the Commission,
and.,
WHEREAS, the City Attorney, Milton D. Schantzen, in his
letter dated January 8, 1.964 quotes Willard C. Olson, Supervisor of
the Municipal Division of the Department of Public Examiner of
the State of Minnesota as stating 'There should be only one
Assignment of Securities directed to the City of Hutchinson.
This Assignment would cover all funds includin- those of the
Hutchinson Utilities Commissions. and.
WHEREAS, The Hutchinson Utilities Commission has requested
their attorney D. 0. Comer to give them his opinion regarding
the necessity and advisability of requiring such Assignment of
Securities, and,
WHEREAS, D. 0. Comer, attorney for the Hutchinson Utilities
Commission, has rendered his opinion to the Commission that an
Assignment of Securities be required of any depository in which
Hutchinson Utilities Commission funds are to be deposited in any
amount in excess of that guaranteed by the Federal Deposit
Insurance Corporation. Such requirement being recommended and
advised because of potential responsibility on the individual
Commission members for funds under their custody and such opinion
being given in spite of the statement of Willard C. Olson,

NOW, THEREFORE, IT IS HFRE9Y RESOL`TED, That the Hutchinson
Utilities Commission follow the recommendation of its attorney
D. 0. Comer and require the Assignment of Securities incompli-
ance with the law, which Assignment must be aocpted by the
Hutchinson Utilities Commission and which Assignment may be
Joint with the City of Hutchinson, and that any funds on deposit
in any depository or any funds to be deposited from and after
January 31, 1964 shall be withdrawen from such depository
failing to provide such an Assignment and any .funds to be
deposited shall be placed only in a depository furnishing such
an Assignment.
Adoption of the foregoing Resolution was moved by
Commissioner Howard P. Quade, seconded by Commissioner R. I.
Sheppard and unanimously carried by the members of the Commission at
a meeting of the Hutchinson Utilities Commission held at the
billing office in the City of Hutchinson on Monday, January 13,
1964, at 5 P. M.
