03-08-1976 HUCMRegular Meeting March 8, 1976 All Commissioners were present; also Ruth Hakel, Don Schimp, Bob Palmquist, Richard Peterson, Roger Gilmer, Les Oare, Bruce Ruisard, and Dennis Van Tiew. The minutes of the Special Meeting on February 12, 1976, were read and approved as read. The minutes of the Special Meeting on March 1, 1976, were read and approved as read. Counsel Peterson reported on the upcoming Bond Issue and a letter from Briggs Morgan on the subject. It will be necessary to ammend Supplement No. 2 to the original contract with United Power Assn. The Commission instructed Counsel Peterson to proceed as per instruc- tions from Briggs and Morgan. Counsel Gilmer reported on the progress in the Worthington lawsuit. From his findings the "suit" could get into court sometime in the fall of 1976. Discussion ensued concerning various problem items relative to the Worthington engine from their installation. After discussion about the Fuel Oil storage tank bids, a motion was made by Commissioner Tracy, seconded by Commissioner Filk, and carried, to accept the bid of Pittsburgh - DesMoines Company for 2 - 500,000 gallon storage tanks for a total of $116,300.00. Completion date 220 days from date of contract. On a motion by Commissioner Filk, seconded by Commissioner Tracy, and carried, it was agreed to pay Krasen Plumbing & Heating the final payment in the amount of $3,135.00 as per letter from Associated Con- sultants dated 2- 27 -76; the check shall be issued to both Krasen Plumbing & Heating Company and Damman Construction so that both en- dorsements are necessary for cashing to acknowledge final payment. The motion was made by Commissioner Filk, seconded by Commissioner Tracy, and carried, to pay Peterson & Gilmer law offices as follows: $875.80 for services re Worthington 20.00 for expenses re Chas. Wilson 750.00 semi - annual retainer Don Swanson of Associated Consultants presented some findings on Rate Schedules. After discussion concerning the hiring of a Utility Manager, a motion was made by Commissioner Filk, seconded by Commissioner Tracy, and carried, to employ Dale Frank starting April 1, 1976, with a salary of $21,000.00 for 1 year at which time a review would take place.
